WELLINGTON SHIRE COUNCIL Road Discontinuance and Road Deviation Pursuant to section 189 and section 206 including Clause 3 of Schedule 10 of the Local Government Act 1989 (the Act), the Wellington Shire Council at its meeting of 19 June 2018, has formed the opinion that a piece of Lot 1 TP390485 (Volume 4516 Folio 159) and part of Lot 1 TP380885 (Volume 6554 Folio 704) Parish of Binginwarri, both shown horizontally hatched on the plan, are not reasonably required as a road for public use and has resolved to discontinue these roads and transfer these portions of land to the adjoining property owner by private treaty. CITY OF GREATER BENDIGO Adoption of Community Local Law and Local Law No. 10 – Administration At its meeting on 18 July 2018 the Greater Bendigo City Council resolved to adopt the new Community Local Law and the amended Local Law No. 10 – Administration. The Local Laws will come into effect on 1 September 2018. The Community Local Law replaces the following three City of Greater Bendigo Local Laws: Environment Local Law No. 3 Streets and Roads Local Law No. 4 Municipal Places Local Law No. 5. The Community Local Law has the following objectives: (a) Provide for the peace, order and good governance of the municipal district (b) Provide a safe and healthy environment so that the community and visitors can enjoy a quality of life that meets its expectations (c) Prohibit, regulate and control activities, events, practices or behaviours in public places so that no detriment is caused to the amenity of the area, nor nuisance to a person or detrimental effect to a person’s property (d) Provide for the safe and fair use and enjoyment of public places (e) Provide for the safe and fair use of roads (f) Protect Council assets and land and regulate their use (g) To provide standards and conditions for certain activities in relation to the physical and visual environment within the municipality. ROAD MANAGEMENT PLAN 2018 In accordance with the Road Management Act 2004 (Act) and the Road Management (General) Regulations 2016, Mount Alexander Shire Council gives notice that it proposes to amend the Mount Alexander Shire Road Management Plan. NOTICE OF MAKING OF A LOCAL LAW (Community Amenity Further Amendment) Local Law No.1 of 2018 Notice is given pursuant to section 119(3) of the Local Government Act 1989 that Port Phillip City Council (Council), at its meeting held on 18 July 2018, resolved to make (Community Amenity Further Amendment) Local Law No. 1 of 2018 (Amending Local Law), thereby amending Council’s Local Law No. 1 (Community Amenity Local Law) 2013 (Existing Local Law). The Amending Local Law amends the Existing Local Law by inserting: a) a new definition of ‘Heavy Vehicle’ into clause 6 of the Existing Local Law; b) a new clause 29A into the Existing Local Law, requiring a permit to keep or allow to be kept a heavy vehicle on residential premises and imposing a maximum penalty of 20 penalty units for non-compliance; and c) into Schedule 1 to the Existing Local Law a Penalty Infringement of 10 penalty units for an offence against the new clause 29A. LOCAL LAW NO. 1 OF 2018 COMMUNITY AMENITY The Wangaratta Rural City Council, at its meeting of 17 July 2018, resolved to make Local Law No. 1 of 2018 Community Amenity and to give notice in accordance with section 119(3) of the Local Government Act 1989. The Local Law will supersede the Local Law No. 1 of 2014 Community Amenity and Local Law No. 3 Murray to Mountains Rail Trail and will operate throughout the municipal district of Wangaratta Rural City Council. The purpose of the Local Law is to: revoke Local Law No. 1 of 2014 – Community Amenity (Amendment) and Local Law No. 3 of 2009 – Murray to the Mountains Rail Trail made by Council; provide for and assure equitable, orderly and enjoyable use by people of community facilities, including roads; protect Council Property and other community assets from loss or unnecessary or avoidable damage; support provision by Council of a safe, clean and healthy environment in areas under its control and management; and provide generally for the peace, order and good government of the Municipal District. This Local Law commences operation on the day following the day on which notice of the making of this Local Law is published in the Victoria Government Gazette. The purpose of the Local Law is to: a) replace the former Open Air Burning Local Law 2007; b) control burning-off for essential fire prevention and fuel reduction on land other than Council land and as far as possible to protect the Shire’s air quality; and c) promote a physical and social environment free from hazards to health in which the residents of the municipal district can enjoy a quality of life that meets the general expectations of the community.
