    KOPEL 3/17/2015 11:41 AM THE HISTORY OF FIREARM MAGAZINES AND MAGAZINE PROHIBITIONS David B. Kopel* I. INTRODUCTION In recent years, the prohibition of firearms magazines has become an important topic of law and policy debate. This article details the history of magazines and of magazine prohibition. The article then applies the historical facts to the methodologies of leading cases that have looked to history to analyze the constitutionality of gun control laws. Because ten rounds is an oft-proposed figure for magazine bans, Part II of the article provides the story of such magazines from the sixteenth century onward. Although some people think that multi- shot guns did not appear until Samuel Colt invented the revolver in the 1830s, multi-shot guns predate Colonel Colt by over two centuries.1 Especially because the Supreme Court’s decision in District of Columbia v. Heller2 considers whether arms are “in common use” and are “typically possessed by law-abiding citizens for lawful purposes,”3 the article also pays attention to whether and when particular guns and their magazines achieved mass-market success in the United States. From the defeat of General Edward Braddock and the use of flank companies of riflemen in the French and Indian War, to the use of long rifles against Ferguson and the death of General Simon Fraser in the Revolutionary War at Saratoga, to the War of 1812 when British General Robert Ross was shot on the way to take Baltimore in 1814 and when long rifles were instru- mental at New Orleans in January 1815, up to the modern wars with the use of such arms as the Accuracy International AX338 sniper rifle, sharpshooters have been crucial in the outcome of battles and campaigns. I wish to dedicate this discussion to a true American patriot, Chris Kyle, a much decorated Navy Seal sniper whom we lost in February of this year, having earned two silver and four bronze stars in four tours of service to his country. He stated that he killed the enemy to save the lives of his comrades and his only regret was those that he could not save. My subject tonight is not intended to be especially profound, but if we are to judge from the attention given it by television, the moving picture industry, and in books of fiction, history and biography, it reasonable to assume that guns and their use in that period so broadly referred to as "the Winning of the West" is a subject of general interest. A discussion of specific weapons is usually more meaningful if these weapons may be related to im- pertant movements in history. This is often not as easy as it may seem. In many cases we have reason to believe certain weapons should have been on the scene at a given time, but were they? As men like Sam Smith, Herschel Logan, Henry Stewart and many others of you know, a serious conscien- tious reseacher cannot be satisfied with vague references and must accept nothing but positive proof.
