  • Legal Aid Clinics in West Bengal
LEGAL AID CLINICS IN WEST BENGAL A REPORT 2013 The Commonwealth Human Rights Initiative 1 Written By: Deepan Kumar Sarkar & Ujjaini Chatterjee Edited By: Madhurima Dhanuka, CHRI 2 BACKGROUND & CONTEXT The Commonwealth Human Rights Initiative (CHRI) is an independent, non-partisan, international non-governmental organization, mandated to ensure the practical realization of human rights in the countries of the Commonwealth. The prison reforms programme at CHRI aims at increasing transparency of a traditionally closed system and ensuring accountability. A major area of its work is focused on highlighting failures of the legal system that result in terrible overcrowding and unconscionably long pre- trial detention and prison overstays, and engaging in interventions to ease this. As part of our prison reforms in West Bengal, we have been actively focusing on improving access to effective legal aid for prisoners. As part of this initiative we conduct legal aid clinics in some correctional homes in Kolkata in collaboration with students from the National University of Juridical Sciences & Calcutta University. The Legal Aid Clinics entitled as ‘Shadhinota – Empowering Inmates of Correctional Homes’ – have been quite successful in activating the State Legal Services Authorities towards delivery of legal aid in correctional homes. Since 2010, we have been able to ensure appointment of legal aid lawyers in approx. 80% of the 300-odd cases that were reviewed by students during these legal aid clinics. CHRI has also been able to create legal awareness regarding various legislations such as 436A Cr.P.C, Juvenile Justice Act, and Plea Bargaining etc. amongst inmates of correctional homes. Legal Aid Clinics are not only beneficial for the inmates but are also an important tool in clinical legal education for students.

  • False and Misleading Advertisements and Protection of the Consumers: Indian Scenario1
International Journal of Law and Legal Jurisprudence Studies :ISSN:2348-8212 False and Misleading Advertisements and protection of the consumers: Indian scenario1 Dr Swati Sinha And Dr Pradip kumar Das Abstract: Advertising has a positive contribution on consumers thought processes and purchasing decision. But at same time one needs to recognize that advertising has immense manipulative power and capacity to harm the consumer and the public interest. Misleading and false advertisement not only leads to increased distribution costs, resulting in increased selling price, but also tends to tempt the Consumers to buy what he does not necessarily need. Advertisements mould the needs of consumers to a large extent and influence their social behavior. Misleading and false advertising has harmful effect on the vulnerable sections of the society, namely, children, youth, and the poor. Many of the advertisements are directed towards children and the youth. They do not contain any information about the product’s nutritional value. In fact, many of the products advertised are habit-forming and provide little value for money. Irrespective of this entire phenomenon happening in the regime of advertisement this sector has great value in socio economic and political development of any globalised country where market is free. Keeping in view the positive and negative impact of development of business of advertisement on consumers it is high time to think and rethink the regulatory measures in this regard. This paper will highlight the relevant social legal and economic aspect of this area. Key Words: Consumer, Advertisement, Misleading advertisement, False advertisement, Vulnerable sections, Social behavior etc. 1 .

Ltd. (A Govt. Company) 41, Chowringhee Road, Kolkata - 700 071. FOREWORD The present volume of Annual Report for 2009-10 of the Department of Higher Education gives an account of the activities carried out in the Deptt. along with those undertaken in different wings of the Deptt. and various autonomous organizations associated with it. The Report also presents, in brief, the facilities of the higher education available in the State. The Govt., despite its various limitations, has been taking conscious measures to uplift the status of higher education in the State, both in terms of quality and access. While making sincere efforts towards increasing Gross Enrolment Ratio in higher education across the State, we have focused the backward areas of the State. We are also in the process of updating the education map of the State to priorities the need of various regions for setting up new colleges, creating new faculty positions or providing development grants. During the year 2009-10, 12 colleges of the State have been declared as “Centres with potential for excellence” by UGC. It is indeed a significant achievement for the State to have 16 such centres as on date in State Universities. Number of NAAC accredited colleges in the State has also gone up during the year.
