P R O S P E C T U S

BRIEF HISTORY

Midnapore is one of the old centres of oriental learning. During the rule of East India Company initiative was taken to impart Western Education in this District. In 1834 Midnapore Zilla School was established which was upgraded to Entrance standard in 1857, in the year of the great Indian Mutiny. The F.A. Course was introduced in 1873 at the School and the School was raised to the status of a Second Grade College. The School and the College remained under the same management upto 1887. Law courses were introduced in this College in 1892. After which some changes occurred in the teaching programmes of the College. In 1916 the B.L. course was abolished and I.Sc course was introduced. In 1922 pleadership course was abolished and B.Sc course was introduced.

In 1997, during the 125 year celebration of the college, the Governing Body of took initiative to establish a Law College at Midnapore.Accordingly the Principal of Midnapore College approached to the State Government for permission to establish a Law college at Midnapore.

The State Government of West Bengal by an order bearing No. 484 – Edn (CS), dated 31.03.2000 issued permission to the Principal of Midnapore College to establish a Law College styled as Midnapore Law College strictly on self financing basis. Midnapore Law College was thus established by Midnapore College under the stewardship of Sri Mukul Ranjan Ray who served Midnapore College as Principal from 1982 to 2001. The Vidyasagar University authority granted affiliation to Midnapore Law College to teach both Three Year LL. B. & Five Year B. A. LL. B. (Hons.) Courses with the approval of the Bar Council of India. This decision of the University was communicated to the Principal of Midnapore College on 17th July, 2000. After this the Bar Council of India was approached to grant approval of affiliation.

On obtaining the approval of affiliation from the Bar Council of India, Midnapore Law College started admitting the students in both Three Year LL. B. & Five Year B. A. LL. B. (Hons.) Courses from the session 2002-03. The Law College started functioning in one academic building of Midnapore College, named as Netaji Janma Satavarsiki Siksha Bhavan, within Midnapore College premises. In 2003, Midnapore Law College was sifted to its own campus at Jharnadanga, Rangamati near Midnapore Railway Station.

On 30th May, 2003 Midnapore Law College obtained permanent affiliation of the Vidyasagar University. The Bar Council of India also accorded permanent approval of affiliation to Midnapore Law College on 17th July, 2004. The University Grants Commission also recognized the College under Section 2 (f) as communicated through the letter of the UGC, bearing No. F. 8 – 98/2008 (CPP – I) dated 22nd May, 2008.

COURSES OFFERED

1) Five Year B. A. LL. B. (Hons.) consisting of 10 Semesters of Six months’ duration each.

2) Three Year LL. B. consisting of 6 Semesters of Six months’ duration each.

ELIGIBILITY FOR ADMISSION

Application for admission is to be made in prescribed form within dates notified by College authority for each academic session. Admission Forms with Prospectus are sold by the College Office.

Minimum qualification for Five Year B. A. LL. B. (Hons.) is Higher Secondary or equivalent examination having passed with 45 % of marks in aggregate in case of General Category applicants & 40 % of the total marks in case of S. C. & S. T. applicants.

The minimum qualification for admission in Three Year LL. B. course is Degree (10 + 2 + 3 pattern) Examination having passed with 45 % of marks in aggregate in case of General Category applicants & 40 % of the total marks in case of S. C. & S. T. applicants.

However, the applicants are required to appear in the Entrance Test to be conducted by the College which is to be followed by counselling. Qualified candidates are required to take admission within the prescribed dates and the list of the qualified candidates and with date of admission will be notified in the College Notice Board. The selected candidates will have to present all original mark-sheets and testimonials for verification by the College Office for the purpose of admission. Those who appeared at the H. S. Examination / Degree Examination of the current year may also apply and will be admitted provisionally, if selected. Their continuation is subject to obtaining minimum marks as required by the Bar Council of India. 2

AGE ON ADMISSION

 The maximum age for seeking admission into a stream of five year Integrated Bachelor of Law Degree Programme, is limited to twenty years in case of the General Category of applicants and twenty two years in case of applicants from S.C., S.T. & O. B.C. Candidates.

 The maximum age for seeking admission into a stream of Three Year Bachelor Degree Course in Law is limited to thirty years with the right of the University to give concession of 5 further years for the applicants of S.C. or S.T. or O.B.C.

RESERVATION OF SEATS

The College maintains the reservation of seats as per Govt. Order. However, the College Management reserves the right of discretion on this behalf if the required number of candidates is not available against the reserve seats.

ABOUT TEACHING PROCESS

Qualified and experienced teachers, Senior Advocates of the Bar and Senior Members of the Bench and various other Legal Luminaries offer their services for academic purposes. Interactive mode of teaching has been adopted here and a skill of reading, research analysis and writing are developed through project assignments. The process of conducting seminar on emerging trends, remedial classes, group discussion and tutorials are other modes of offering scientific methodology of teaching. The Vidyasagar University has introduced Semester system in 3 Year LL. B. courses and a Semester system in 5 Year B. A. LL. B. (Hons.) in parity with some of the pioneer Law Schools and Universities in India. The Semester system can only enable the students to be identified with the emerging and modern topics in Law and to gather current information about law. In 5 Year B. A. LL. B. (Hons.) courses, this College has launched 60 papers of different subjects in law and 36 papers in 3 Year LL. B. courses in accordance with the guideline of UGC and Bar Council of India and as per the syllabi of the Vidyasagar University, West Bengal.

STUDENT FACILITIES

The College Authority is trying its best to provide such type of environment within which a student can develop his personality to the fullest extent.

 The College provides Railway Concession Forms to bonafide students.

 Free uninterrupted internet and computer facilities are provided to the learners in the Library.

 Xerox facilities are available to the students on payment basis.

 Canteen facilities are provided inside the College premises.

 One standard playground is provided for games and sports facilities inside the College premises on sharing basis.

LIBRARY

The College has a well equipped library with a good number of books and in additions; the library provides attractive and valuable authoritative law journals and also magazines of general nature. Separate rules and regulations are available from Library office. The Library Cards will be provided by the College Office within fifteen days from the commencement of the classes. 3

IDENTITY CARD

Students’ Identity Cards are issued by the College Office free of cost and the students are required to collect the Identity Card within 15 days from the commencement of class for each session. The students must bring Identity Card with him/her while coming to College. A student will have to show Identity Card to the College staff on demand for verification as and when required.

Identity Card must be kept carefully in the custody of the student and is not transferable. In case the Identity Card is lost / stolen the matter be immediately reported to the nearest Police Station. Duplicate Identity Card may be issued in such cases on obtaining application for the same with a copy of the GD and on payment of Rs.50/- ( Rupees Fifty ) only.

INSTRUCTIONS AND EXAMINATIONS i) Instruction in various subjects shall be provided by the College as per the scheme of instruction and syllabi prescribed. ii) The programme of instruction, examinations and vacations shall be notified by the Principal of the College. iii) The medium of instruction and examination shall be English. iv) At the end of each Semester, University Examinations shall be held as prescribed, by the University.

v) Backlog examinations shall be conducted at the end of each Semester by the University. vi) A candidate shall be deemed to have passed the Semester Examination if he / she secures not less than 40% in each subject and in aggregate. vii) The Examinations are conducted and results are published by the affiliating University.

REGISTRATION AND MIGRATION

The students admitted in any LL. B. course are required to apply within a month of admission for Registration of the University on payment of requisite fees. Registration Certificate of the Vidyasagar University is to be obtained before submission of fee and form for University Examination.

Students who come from other Universities (except Vidyasagar University) will be provisionally admitted. After admission they shall apply through the Principal within one month from the date of admission to the Vidyasagar University with the Migration Certificate for Registration with following documents :

(a) Age proof Certificate, (b) Pass Certificate (or mark sheet) and (c) Migration Certificate (in original).

The College will not be held responsible if the concerned University does not sanction migration to such candidate and / or Vidyasagar University refuses to issue Registration Certificate to any candidate. In such cases provisional admission given at this College may be cancelled and no refund of fees will be made.

The students appeared in the H.S. / Degree Examination in the current year may also apply for Provisional Admission with Special Permission of the Director / Principal of the College. They may be given Provisional Admission on fulfillment of required formalities. Provisional Admission will be treated as cancelled if the candidate failed to obtain qualifying marks at the last public examination. Refund of fees may be made on cancellation of Provisional Admission after a deduction of Admission.

AWARD OF DIVISION

Candidates who have passed all the examinations of the B. A. LL. B. (Hons.) / LL.B Degree Course shall be awarded Divisions by the affiliating University in accordance with the total aggregate marks secured by them in all the Semester Examinations taken together.

1) First Class: 60% and above. 2) Second Class: 40% and above but less than 60% 3) Minimum Pass marks: Minimum pass marks in each paper shall be 40%.

Candidates who have not passed the examinations in the first attempt can repeat the papers if they failed to qualify in three papers only, provided that the students are required to meet the minimum aggregate marks as provided by the University Regulations.

GENERAL RULES OF EXAMINATIONS

Regarding examination of B. A. LL. B. (Hons.) & LL. B. courses the Rules and Regulations of the affiliating University are to be followed. These Rules and Regulations are subject to change from time to time.

The curricula as approved by the affiliating University are to be followed till these are not changed and modified.

A regular course of study for eligibility to appear at the LL.B. Examination of a semester shall mean attendance of not less than 75% of the aggregate in lectures, in subjects listed in the scheme of instruction. Provided that, in special cases and for sufficient cause shown, the Vice Chancellor, on the recommendation of the Principal, may condone the deficiency not exceeding 10% attendance on medical grounds when the application submitted at the time of actual illness is supported by a certificate from an authorised Medical Officer, and approved by the Principal. In case condonation in attendance on medical ground is sought the applicant shall pay the prescribed fee and the decision of the University be final.

In any semester of the course, if a candidate fails to secure the minimal percentage of attendance, he/she shall not be eligible to appear in the examination of that semester, and he/she shall have to enroll himself / herself to undergo afresh a Regular Course of study of the corresponding semester in subsequent academic session, in order to become eligible to appear for the examination.

AWARD OF DEGREE

The LL.B. Degree in the Faculty of Law will be conferred on a candidate by the Vidyasagar University who has pursued a regular course of study for three academic years for Three Year LL. B. Course and five academic sessions for Five Year B. A. LL. B. (Hons.) Course as prescribed in the scheme of instruction and has passed all the examinations as prescribed in the scheme of examinations.

THE CODE OF CONDUCT FOR THE STUDENTS

The College takes a pro-active position on all matters relating to professional and appropriate code of conduct on the part of the entire College community - students, faculty and non-teaching staff.

In furtherance of its commitment to an environment of honesty, fairness and mutual respect, the College Management will take serious cognizance of acts of academic / professional misconduct that include cheating on academic exercises, plagiarism, misrepresentation and interference of any kind in the access of fellow students to College services, among others.

Issues like sexual harassment and ragging etc. will also be seriously death with as per Law of the Country. 5

Steps will also be taken against derogatory acts on the part of any student or acts of gross misconduct or indiscipline.

The admission will also be cancelled if a student is found involved in misconduct, activities of in- discipline and such other activities which may be against the academic atmosphere and normal functioning of the College.

The students of the College will not be allowed to organize any meeting, deputation, demonstration, agitation etc. which may hamper the normal functioning of the College and can create tension amongst students and / or vitiate academic atmosphere of the College.

Irregular attendance in classes, negligence in class work, insubordination, misconduct etc. will invite disciplinary measures against the student concerned which includes fine, detention, expulsion from the College etc.

The decision of the College Authority in this regard be final.

COLLEGE UNIFORM ( MANDATORY ) :

The students will have to wear prescribed uniform as stated below :

For Male students : White Shirt, Black Trouser, Black Tie, Black Coat or Sweater, Black Shoes.

For Female students : White Sharee with navy blue border or White Salwar Kameez with Black Dupatta and Black Coat or Black Cardigan.

Students are permitted to enter into the college campus being properly clad on with prescribed uniform. Violation of this rule may be treated as act of indiscipline.

STUDENTS’ COUNCIL The college will provide a Students Council, which will give suggestions for redressal of the grievances of the students. One student from each class/semester will be nominated in the Council considering his/her academic performance, class attendance and conduct. The recommendations of the Council will be considered by the College Management aptly. The Principal./Teacher- in-Charge will the President of the Council. The nominees of the College Management shall have occasional interactions with the Council, with the object of providing good education within the constrains of a self-financing institutions in rural Bengal. This Council is only an advisory body to college management as regards students’ activities.

Rules and Regulations for the Degree of 5 Year B. A. LL. B. (Hons.) & 3 Year LL. B. Courses.

Each paper shall be of one hundred (100) marks. The break-up is given below:

1) University Written Examination - 80 Marks

2) Internal Assessment (Written) - 20 Marks

Fee Structure for Five Year B. A. LL. B. (Hons.) & Three Year LL. B. Courses

1. Course Fee Rs. 20,000/- for each Semester to be paid in Cash / Bank Draft during admission to each Semester (subject to upward revision).

2. Admission Fee Rs. 5,000/- for each course.

3. Students’ Activities Fee Rs. 200/- for each Semester.

N. B. : (a) Fee structure is subject to revision to meet escalation of expenses for maintenance and development and revision of pay of the college staff. (b) Course Fee is to be paid by Cash / Bank Draft drawn in favour of “Midnapore Law College” Payable at “Midnapore”. (c) The continuing students are required to pay Course Fee and other fees and get enrolled within 15 days from commencement of each Semester. (d) If any student considers that he / she is not getting the academic facilities in this College commensurate to the Course Fee he / she is paying, then he / she may apply for Transfer Certificate with refund of the Course Fee he / she has paid for the current Semester only to the College which will be granted. The College authority reserves the right to issue Force Transfer Certificate to a candidate if found irregular in class attendance, poor performance in college examinations and / or found involved in repeated acts of indiscipline / misconduct.
