PART I - PRELIMINARY 3. Interpretation

(1) In these Regulations _

"the Act" means the Road Traffic Act 19g5;

5 "km/h" means kilometre(s) per hour;

"kw" means kilowatt(s):

"large motor bicycle" means a motor bicycle which -

(u) if not attached to a sidecar, has a maximum net power output exceeding 25 kw or a polver to weight ratio exceeding 0.16 kwlkg, or

(b) if attached to a sidecar, forms a combination therewith having a power to weight ratio exceeding 0.16 h/kg;

"maximum authorised mass", -

(a) in relation to a motor vehicle or a combination of vehicles, neither of which is constructed itself to carry a load, means the unladen weight of the motor vehicle or the combination, and

(b) in relation to any other motor vehicle or combination, means the weight which the vehicle or the combination is designed or adapted not to exceed when in normal use and travelling on a road laden;

"maximum net power output", in relation to a motor bicycle, means the maximum net power ouþut of its engine as measured in accordance with the test conditions specified in document ISO 4106 published by the Intemational Organisation for Standardisation under reference ISO 1978 4106-09-01;

"medical group 1" means a group of categories comprising -

(Ð categories A, 41, B, 81, Bl (invalid carriage), B+E, F, G, H, K, L, P and 'w,

(b) category Dl, where the vehicles to which the category relates do not exceed a maximum authorised mass of -

(Ð 4250 kg if a mechanical lift for a wheelchair is fitted and no trailer drawn, and

(iÐ 3500 kg in any other case, and

(c) category S, where the vehicles to which the category relates do not exceed a maximum authorised mass of 3500 kg;

"medical group 2" means a group of all categories other than -

(a) in the case of categories in medical group I whose extent is not limited in that group, those categories, and

6 (b) in the case of categories in that group whose extent is so limited, those categories to that extent;

"minimum test vehicle", in relation to a category, means a vehicle of a specification shown in relation to that category in column 2 of the table in schedule 10;

"mm" means millimetre(s);

"motor bicycle" means a two-wheeled motor vehicle, being a motor vehicle comprised within category A or P;

"motor car" means -

(a) any motor vehicle of a class comprised within category B-fE, and

(b) any motor vehicle which would be of a class comprised within that category were it not propelled by electrical or steam power and comprised within category L or S;

"occupational road" means -

(a) in the case of a road *nr"O is a highway maintainable at the public . expense, -

(Ð an unclassified road, being a road which has not been classified by the Department as maintainable for use by motor vehicles, or

(iÐ a farm road, being a road, or that part of it, which lies within the curtilage of land forming part of a farm, and

(b) in the case of a road which is not a highway maintainable at the public expense, such a road to which the public has access;

'þrescribed certificate" means a certificate which -

(a) is in the form prescribed in Part 1 of Schedule 2 to the ATC Regulations,

(b) has been issued under regulation 15 thereof, and

(c) has not ceased to have effect;

'þublic passenger vehicle" has the same meaning as in the Act 2001a;

"steam vehicle" means a motor vehicle propelled by steam power;

"tachograph" has the same meaning as in the Road Traffic (European Agreement) (Crews of Vehicles engaged in International Road Transport) Order 2O03s;

7 "test" means a test of competence to drive; and

"works truck" means a motor vehicle designed for use in private premises and driven on a road only -

(a) in delivering goods from or to such premises to or from a vehicle on a road in the immediate neighbourhood, or

(b) in passing from orle part of any such premises to another part or to other private premises in the immediate neighbourhood, or

(c) in connection with road works while at or in the immediate neighbourhood of the site of such works.

(2) For the purposes of these Regulations, a motor vehicle shall not be regarded as driven in the immediate neighbourhood of premises or a site unless it is driven on a road for the shortest distance and in any case for a distance not exceeding 600 metres.

(3) In these Regulations -

(a) references to mopeds in class P, are to a class of mopeds in category P having two wheels; and

(b) references to mopeds in class P, are to a class of mopeds in category P having more than two wheels.

(4) For the purposes of these Regulations, the date on which a motor vehicle is first used shall be construed in accordance with regulation 3(3) and (a) of the Road Vehicles (Maintenance and Use) Regulations 20026.

(5) For the purposes of these Regulations, a category -

(Ð which is specified in an entry in column I of the following table is comprised within a category specified in that entry in column 2 or 3;

(b) which is specified in an entry in column 2 of that table is comprised within a category specified in that entry in column 3.

4. Designation of categories as groups

Where a person has within the period of ten years ending on the date of the coming into force of a licence which he has applied for -

(a) held a licence; or

(b) passed a test authorising the granting ofa licence, being a licence authorising him to drive a vehicle of a category specified in column I of the table in Schedule 2, the classes or descriptions of vehicles specified in relation thereto in column 2 of that table are designated as a group for the purposes of paragraph 2(1)(b) or paragraph 2(2), as the case may be, of Schedule 3 to the Act.

PART II _ DRIVING LICENCES

5. Time for application for licence

An application for the grant of a licence may be received and dealt with at any time within fwo months before the date on which the grant of the licence is to take effect.

6. Residence qualification not to apply

(1) Paragraph 6(14) of Schedule 3 to the Act does not apply to -

(Ð the grant ofaprovisional licence; or

(b) the grant of a full licence to the holder of a British licence or a Community licence who, although not normally resident in the Island, satisfies the Department that he is to become so forthwith.

9 (2) In this regulation -

"British licence" means a licence granted under the law for the time being in force in any part of the United Kingdom, any part of the Channel .Islands or Gibraltar which corresponds to Schedule 3 to the Act, not being a licence corresponding to a provisional licence;

"Community licence" means a document issued in respect of an EEA State other than the United Kingdom by an authority of that or another EEA State (including the United Kingdom) authorising the holder to drive a motor vehicle, not being -

(a) a document containing a statement to the effect that that or a previous document was issued in exchange for a document issued in respect of a State other than an EEA State,

(b) a document in any of the forms for an international driving permit annexed to the Paris Convention on Motor Traffic of 19267, the Geneva Convention on Road Traffic of 19498 or the Vienna Convention on Road Traffic of 1968e, or

(c) a document issued for the purpose of enabling a person to drive a motor vehicle with a view to passing a test; and

"EEA State" means a State which is a Contracting Party to the Agreement on the European Economic Area signed at Oporto on 2nd l|l{ay 1992 as adjusted by the Protocol signed at Brussels on 17th March 1993.

7. Duration of a provisional licence

The period of one year is prescribed for the purpose of paragraph 7(1Xd) of Schedule 3 to the Act.

8. Conditions of provisional licence

(1) Subject to the following provisions of this regulation, the holder of a provisional licence shall comply with the following conditions in relation to motor vehicles of a class which he is authorised to drive by virtue of the provisional licence, that is to say, he shall not drive such a motor vehicle -

(a) otherwise than under the supervision of a qualified driver who is present with him in or on the vehicle;

(b) unless a distinguishing mark in the form set out in Schedule 3 is displayed on the vehicle in such a manner as to be clearly visible to other persons using the road from within a reasonable distance from the front and from the back of the ' vehicle;

10 (c) at a speed exceeding -

(Ð 20 miles per hour in the case of a vehicle constructed or adapted to carry only one person, and

(iÐ 50 miles per hour in any other case;

(d) in the case ofan agricultural tractor, unless, ifhe is under seventeen years ofage, he is driving it on an occupational road;

(e) while it is being used to draw a traile¡ unless the trailer is being drawn on an occupational road;

(Ð in the case of a motor bicycle, unless the requirements in paragraph (2) are met.

(2) The requirements to paragraph (1)(f) which refers are that - (a) the driver - (i) holds a prescribed certificate that he has successfully completed an approved training course relating to the vehicle or to a vehicle of the same class, or

(iÐ is driving the vehicle as part of such a training course; and

(b) if the vehicle has no sidecar - (Ð it is a learner motor cycle or a moped, and

(iÐ no person other than the driver is carried on it.

(3) Save as provided in paragraph (4), where the holder of a provisional licence has passed a test which authorises him to be granted a full licence to drive a particular class of motor vehicles -

(a) the conditions in paragraph (1) do not apply; but

(b) the conditions in regulation 9(1)(i) and (ii) apply as if they appliedto theholder of a provisional licence, in relation to the driving by him of motor vehicles of that class.

(4) Where -

(a) the holder of a provisional licence has passed a test which authorises him to be granted a full licence to drive a particular class of motor vehicles; and

(b) in relation to that class he will become a person to whom regulation 9(2) will apply on his being granted such a licence,

11 then no condition referred to in paragraph (3)(b) applies when he is driving a motor vehicle of that class, provided that he is doing so under the same conditions or circumstances as are prescribed in regulation 9 (2).

(5) The condition in paragraph (l)(a) does not apply where the holder of the provisional licence -

(a) is undergoing a test;

(b) is driving an agricultural tractor constructed or adapted to carry only one person;

(") is driving a vehicle constructed or adapted to carry only one person (not being an agricultural tractor), provided that -

(Ð he is driving the vehicle on an occupational road, or

(iÐ he holds a fi.rll licence authorising him to drive another vehicle comprised within category B+8, C+E, D+8, F or S; or

(d) is driving a motor bicycle with or without a sidecaiattached.

(6) The condition in paragraph (1)(e) does not apply where the holder of the provisional licence is driving, and is authorised by virtue of that licence to drive, -

(a) a motor vehicle drawing a trailer, being a combination falling within'category B+E, C+E, C1+8, D*E or Dl+E; or

(b) an agricultural tractor drawing a trailer, provided that -

(Ð the agricultural tractor is constructed or adapted to carry more than one person, and

(iÐ he is aged seventeen years or over.

(7) The condition in paragraph (1)(f) does not apply where the holder of the provisional licence is driving a power-assisted pedal cycle.

(8) In this regulation "qualified driver" means a person who -

(Ð if he is a disabled driver, -

(Ð holds a full licence authorising him to drive motor vehicles of a class falling within category B, C+E or D*E,

(ii) is supervising a provisional licence holder who is driving a motor vehicle ofthat class, and

(iiÐ would in an emergency be able to take control of the braking and steering functions of the vehicle in which he is a passenger;

l2 (b) in any other case, holds a full licence authorising him to drive motor vehicles of the same class as the motor vehicle being driven by the provisional licence holder whom he is supervising;

(c) has held the full licence in question for at least three years; and

(d) unless he is a member of the armed forces of the Crown acting in the course of his duties, is at least 2l years ofage.

9. Restrictions on newly qualified drivers

(1) Subject to the following provisions of this regulation, a person who is required to pass a test before he becomes entitled to hold or obtain a full licence authorising him to drive motor vehicles of any class shall not, for a period of twelve months -

(a) from the coming into force of the first such licence granted to him by reason of his passing that test; or

(b) from the return to him, by reason of his passing that test, of such a licence previously held by him, drive a motor vehicle of that class -

(Ð unless a distinguishing mark in the form set out in Schedule 4 is displayed on the vehicle in such a manner as to be clearþ visible to other persons using the road from within a reasonable distance from the front and from the back of the vehicle,

(iÐ at a speed exceeding 50 miles per hour.

(2) The restrictions imposed by paragraph (1) do not apply to -

(a) a person who is driving a vehicle falling within category B1 (invalid carriage), F, G,H,K,SorW;

(b) a person who -

(i) is driving a vehicle of a class comprised within category Q*E, and

(iÐ .holds a fulI licence -

(A) which authorises him to drive vehicles of all classes comprised within category B, and

(B) which is not subject to the restrictions imposed by paragraph (1);

(c) a person who -

(Ð is driving a public passenger vehicle of a class comprised within category D*E, and

T3 (ii) holds a licence under section 40 of the Road Transport Act 2001 authorising him to do so;

(d) a person who holds a full licence granted by reason of his having passed a test at a time when he held a permit or licence which, by virrue of the Road Vehicles (International Circulation) Order 2006t0, entitled him to drive motor vehicles in the Island;

(e) a person who is a member of the naval, military or air forces of Her Majesty and is driving in uniform a vehicle which is the properfy of the Crown;

(Ð a constable who is driving a vehicle for police purposes;

(e) a member of a fire brigade who is driving a vehicle for fire brigade purposes;

(h) a member of an ambulance service who is driving an ambulance in the performance of his duties;

(i) a person engaged in the motor trade who is driving -

(i) a vehicle on a road for the purpose of marshalling it in relation to premises adjacent to that road, or

(iÐ a vehicle under a trade licence in accordance with regulations 29 and 30 of the Licensing and Registration of Vehicles Regulations 2004'r; or

ú) a person who is driving an electric vehicle falling within category L which, if it were propelled other than by electric porver, would be -

(i) an engineering site vehicle comprised within category S, or

(iÐ a works truck falling within category W.

10. Full licence not carrying provisional entitlement

(1) Paragraph 6(5) of Schedule 3 to the Act does not apply in the case of a fulI licence which -

(a) is limited (whether pursuant to an application by its holder or otherwise) to vehicles of a particular construction or design; or

(b) authorises its holder to drive only vehicles comprised within category K.

(2) The said paragraph 6(5), in its application to a full licence which does not authorise the driving of a vehicle comprised within category B or P, has effect subject to the limitation that it does not authorise its holder to drive any motor bicycle comprised within

14 category A subject to the same conditions as if he were authorised by a provisional licence to drive the last mentioned vehicle.

(3) The said paragraph 6(5) has effect subject to the limitation that it does not authorise the holder of a full licence to drive a vehicle of any class comprised within any category after the expiration of six months from the date on which he passed a test which authorises him to be granted a fuIl licence to d¡ive a class of vehicles comprised within that category.

11. tr'ull licence carrying provisional entitlement to drive a motor bicycle 'Where, by virtue of paragraph 6(5) of Schedule 3 to the Act, and subject to regulation 10, a full licence to drive motor vehicles of certain classes only also authorises its holder to drive a motor bicycle subject to the same conditions as if he were authorised by a provisional licence to drive that vehicle, that paragraph shall apply subject tp the limitation that the holder of such a licence, when driving a motor bicycle on a road, shall comply with the requirements of regulation 8(2) as if those requirements were imposed by this regulation.

12. Signature of licence

(1) Part 1 of a licence shall incorporate the usual signature of the person to whom the licence is granted.

(2) Every person to whom a licence is granted shall forthwith sign Part 2 thereof in ink with his usual signature.

13. Lost or defaced licence

(1) If the holder of a licence -

(a) satishes the Department that the licence or either part of it has been lost or defaced and that he is entitled to continue to hold the licence;

(b) unless the Department otherwise directs, furnishes the Department with either a photograph or a part of the licence in accordance with paragraph 6(1)(aa) of Schedule 3 to the Act; and

(c) pays the prescribed fee, the Department shall, on the furnishing of the photograph or on the surrender of any part of the licence which has not been lost, issue to him a duplicate licence and shall endorse on it any particulars endorsed on the original licence, and the duplicate so issued shall have the same effect as the original.

(2) If at any time while a duplicate licence is in force the original licence or either part of it is found, the person to whom the original licence was issued shall -

(a) if it is in his possession, return it to the Department; or

15 (b) if it is not in his possession but he becomes alvare that it is found, take all reasonable steps to obtain possession of it and if successful retum it as soon as may be to the Department.

14. Disabilities relating to medical groups 1 and 2

(1) The following disabilities are prescribed for the purposes of paragraphs 4(1), 5(1) and 5A(1) of Schedule 3 to the Act in relation to an applicant for, or the holder of, a licence authorising him to drive classes of motor vehicles comprised within medical group 1 or 2-

(a) epilepsy;

(b) diabetes requiring insulin treatment;

(") severe mental disorder;

(d) liability to sudden attacks of disabling giddiness or fainting other than such attacks falling within sub-paragraph (e);

(e) liability to sudden attacks of disabling giddiness or fainting which are caused by any disorder or defect of the heart as a result of which the applicant for the licence or, as the case may be, the holder of the licence has a device implanted in his body which, by operating on the heart so as to regulate its action, is designed to correct the disorder or defect;

(Ð persistent misuse of drugs or alcohol, whether or not such misuse amounts to dependency;

(e) inability to read in good daylight (with the aid of glasses or contact lenses if wom) a registration mark fixed to a motor vehicle and containing -

(i) characters 79 mmhigh and 57 mm wide in a case where they are viewed from a distance of

(Ð 12.3 metres by an applicant for, or the holder of, a licence authorising the driving of vehicles of a class comprised within category K only, and

(B) 20.5 metres in any other case, or

(iÐ characters 79 mmhigh and 50 mm wide in a case where they are viewed from a distance of-

(A) 12 metres by an applicant for, or the holder of, a licence authorising the driving of vehicles of a class comprised within category K only, and

(B) 20 metres in any other case, or

t6 (iiÐ characters 79 mm high and 44 mm wide in a case where they are viewed from a distance of

(A) 11.7 metres by an applicant for, or the holder of, a licence authorising the driving of vehicles of a class comprised within category K only, and

(B) 19.5 metres in any other case.

(2) The disability specified in paragraph (1)(e) is prescribed for the purposes of paragraph 4(3Xb) of Schedule 3 to the Act, and an applicant for a licence suffering from that disability shall satisfy the conditions that -

(a) the driving of a vehicle by him in pursuance of the licence is not likely to be a source ofdanger to the public; and

(b) he has made adequate arrangements to receive regular medical supervision by a cardiologist (being supervision to be continued throughout the period of the licence) and is conforming to those arrangements.

(3) A disability which consists solely of any one or mo¡e of , -

(u) the absence of one or more limbs;

(b) the deformity of one or more limbs; or

(c) the loss of use of one or more limbs which is not progressive in nature, is prescribed for the purposes of paragraph a(3)(a) and (c) of Schedule 3 to the Act.

(4) Subject to paragraph (5), the circumstances prescribed for the purposes of paragraph 5(1) of Schedule 3 to the Act are that the person who is an applicant for or holder of a licence -

(a) has been disqualified by an order of a court by reason that the proportion of alcohol in his body equalled or exceeded -

(i) 87.5 microgrammes per 100 millilitres of breath, or

(ii) 200 milligrammes per 100 millilitres of blood, or

(iiÐ 267.5 mllligrarnmes per 100 millilitres of urine;

(b) has been disqualified by an order of a court by reason that he failed without reasonable excuse to provide a specimen when required to do so pursuant to section 6 of the Act; or

(") has been disclualihed by an order of a court on two or more occasions within any period often years by reason that -

IV (Ð the proportion of alcohol in his breath, blood or urine exceeded the respective limit prescribed in section 7E(2) of the Act, or

(iÐ he was unfit to drive through drink contrary to section 5 of the Act.

(5) For the purposes of paragraph (aXa) and (b) an orde¡ shall not be taken into account'unless it was rnade on or after lst April 1992, and paragraph (aXc) shall not apply to a person unless the last such order was made on or after that date.

(6) In connection with any question of a medical nature which appears to it to arise in relation to the exercise of its functions -

(a) under this regulation or under regulation 15 or 16; or

(b) otherwise under Schedule 3 to the Act, the Department may be assisted by an assessor drawn from a panel of registered medical practitioners appointed for the purpose by the Department.

(7) In this regulation -

.'cardiologist" means a registered medical practitioner who has a special interest in disorders or defects ofthe heart;

..severe mental disorder" includes mental disorder, mental impairment, severe mental impairment, or psychopathic disorder within the meaning of section 1 of the Mental Health Act 1998"; and

references to a limb include references to a part of a limb, and references to loss of use, in relation to a limb, include references to a deficiency of limb movement or power.

15. Disabilities relating to medical group 1 only

(l) Epilepsy is prescribed for the purposes of paragraph 4(3Xb) of Schedule 3 to the Act in relation to an applióant for a licence authorising him to drive motor vehicles of a class comprised within mediõal group 1, being a person suffering from epilepsy who satisfies the conditions prescribed in paragraph (2)'

(2) The conditions to which paragraph (1) refers are that -

(a) he has been free. from any epileptic attack during the period of one year immediately preceding the date when the licence is to be granted; or

(b) if he has not been free from such an attack within that period, he has had an epileptic attack while asleep more than three years before the date when tl¡e li"ettõe is to be granted and has had epileptic attacks only while asleep between the date of that attack and the date when the licence is granted,

(Ð he complies as far as practicable with the directions regarding his treatment for epilepsy, including directions as to such regular medical check-ups forming part of that treatment as may from time to time be given him by the registered medical practitioner supervising the treahnent,

(iÐ if required by the Department, he has provided a declaration signed by him that he will observe the condition in sub-paragraph (i), and

(iiÐ he satisfies the Department that the driving of a vehicle by him in accordance with the licence is not likely to be a source of danger to the public.

(3) Diabetes requiring insulin treatment is prescribed for the purposes of paragraph 4(3Xb) of Schedule 3 to the Act in relation to an applicant for a licence authorising him to drive motor vehicles of a class comprised within medical group 1, being a person suffering from that disability who satisfies the conditions prescribed in paragraph (4).

(4) The conditions to which paragraph (3) refers are that -

(a) if requested to do so by the Department, he provides with his application a report from a registered medical practitioner sufficient to satisff the Department that he has a history of responsible diabetic control with a minimal risk of incapacity due to hypoglycaemia;

(b) he provides a declaration signed by him that he will -

(Ð comply as far as reasonably practicable with such directions regarding his treatment for diabetes as may for the time being be given him by the registered medical practitioner supervising that treatment, and

(iÐ immediately report to the Department in writing any significant change in his condition; and

(c) he satisfies the Department that the driving of a motor vehicle in accordance with the licence is not likely to be a source of danger to the public.

16. Disabilities relating to medical group 2 only

(1) The following disabilities are prescribed for the purposes of paragraphs 4(1), 5(1) and 5A(1) of Schedule 3 to the Act in relation to an applicant for, or the holder of, a licence authorising him to drive classes of motor vehicles comprised within medical group 2 -

(a) save in the case of an excepted licence holder, abnormality of sight in one or both eyes of such a kind that the person concerned cannot meet the relevant standard of visual acuity;

(b) save in the case of an excepted licence holder, sight in only one eye unless the person concerned -

19 (i) has visual acuity no worse than 619 in his sighted eye,

(iÐ while suffering from the disability, has held, at any time in the period of ten years ending on lst July 2007, a licence authorising him to drive motor vehicles of a class comprised within medical group 2, and

(iiÐ satisfies the Department, when applying for such a licence, that he has had adequate recent driving experience and has not during the period of ten years immediately before the date of the application been involved in any road accident in which his defective eyesight \¡/as a contributory factor;

(c) liability to seizures arising from a cause other than epilepsy.

(2) Epilepsy is prescribed for the purposes of paragraph 4(3Xb) of Schedule 3 to the Act in the case of an applicant fo¡ a licence authorising him to drive motor vehicles of a class comprised within medical group 2, being a person suffering from epilepsy who satisfies the conditions prescribed in paragraph (3).

(3) The conditions to which paragraph (2) refers are that -

(Ð he satisfies the Department that during the period of ten years immediately preceding the date when the licence is granted -

(Ð he has been free from any epileptic attack, and

(iÐ he has not required any medication to treat epilepsy; and

(b) he satisfies the Department that the driving of a vehicle by him in accordance with the licence is not likely to be a source of danger to the public-

(4) Diabetes requiring insulin treatment is prescribed for the purposes of paragraph 4(3Xb) of Schedule 3 to the Act -

(a) in the case of a person suffering from the disability who -

(Ð is an applicant for a licence authorising him to drìve motor vehicles in medical grorp 2,

(iÐ satisfies the Department that, while suffering from the disability, he has held, at any time in the period of ten years ending on lst Ju,ly 2007, a licence authorising him to drive motor vehicles of a class comprised within that group, and

(iii) satisfies the same conditions as are prescribed in regulation 15(a);

(b) in the case of any other person suffering from the disability who -

(i) is an applicant for a licence authorising him to drive motor vehicles in medical group 2 which are in category Cl or Cl*E,

20 (iÐ satisfies the Department that he has for at least four weeks been undergoing treatment with insulin, and

(iiÐ satisfies the conditions prescribed in paragraph (5).

(s) The conditions to which paragraph (4xbxiii) refers are that-

(a) he has not, during the period of one year ending on the date of the application, required the assistance of another person to treat an episode of hypoglycaemia suffered while he was driving;

(b) he makes an arrangement to undergo at intervals of no more than twelve months an examination by a hospital consultant specialising in the treatment of diabetes and conforms as far as reasonably practicable to that arrangement;

(c) his application is supported by a report from such a consultant sufficient to satisfy the Department that he has a history of responsible diabetic control with a minimal risk of incapacity due to hypoglycaemi4'

(d) he provides a declaration signed by him that he will -

(Ð comply as far as reasonably practicable with such directions regarding his treatment for diabetes as may for the time being be given him by the registered medical practitioner supervising that treatment,

(iÐ immediately report to the Department in writing any significant change in his condition, and

(iiÐ provide such evidence as the Department may request that he continues to carry out the monitoring mentioned in sub-paragraph (e);

(e) he regularly monitors his condition and in particular undertakes blood glucose monitoring at least twice daily and at times relevant to the driving of motor vehicles; and

(Ð he satisfies the Department that the driving of a motor vehicle in accordance with the licence is not likely to be a source of danger to the public.

(6) For the purposes of paragraph (1)(a) the relevant standard of visual acuity means

(a) in the case of a person who -

(Ð at any time during a period specified in an item in column 2 of the following table, first held or first holds -

(A) an obsolete vocational licence, or

(B) a valid licence authorising him to drive classes of motor vehicle comprised within medical group 2, and

21 (iÐ if he is the applicant for a licence to which sub-paragraph (a)(i)(B) refers, satisfies the Department that he has had adequate recent driving experience and has not during the period of ten years immediately before the date of his application been involved in any road accident in which his defective eyesight was a contributory factor,

the standard prescribed in relation to him in that item in column 3; and

(b) in the case of a person who -

(Ð is an applicant for a licence to which sub-paragraph (axixg) refers, but

(iÐ does not fall within sub-paragraph (a),

the standard prescribed in relation to him in item 4 of that table.

(7) In this regulation -

references to measurements of visual acuity are references to visual acuity measured on the Snellen Scale;

22 "excepted licence holder" means a person who -

(a) is an applicant for, or the holder of, a licence authorising him to drive vehicles comprised within category Cl or Cl+E (as distinct from C or C+E), and

(b) was, at a time before lst February 2000, the holder of a licence authorising him to drive vehicles comprised within former group 1;

"former group" has the same meaning as in regulation 19; and

"obsolete vocatíonal licence" means - (a) in the case of a goods vehicle, a licence which -

(Ð was granted before lst February 2000, and

(iÐ authorised the driving of vehicles comprised within former group 1, and

(b) in the case of a passenger vehicle, a licence which -

(Ð is of a kind to which sub-paragraph (a) refers, and

(iÐ together with a public service licence granted under section 4 of the Road Trafflrc (Public Service Vehicles) Act 1964t3, authorised the driving of public service vehicles within the meaning of that Act.

17. Persons who become resident in the Island

(1) A person who -

(Ð becomes resident in the Island;

(b) is the holder of a permit which is for the time being valid; and

(") is not disqualified by an order of a court for holding or obtaining a licence in the Island,

shall, during the period of twelve months after he becomes so resident, be treated for the purposes of paragraph 1(l) and (2) of Schedule 3 to the Act as the holder of a full licence authorising him to drive motor vehicles of the classes or descriptions which he is authorised to drive by that permit.

(2) The following provisions of the Act apply in relation to permits or the holders of permits subject to the following modifications -

rr 1964 c. 8

23 (Ð section 42(l), (4) and (5) þroduction of licence to police), as if the references to a licence included references to a permit;

(b) section 44(2) þower of arrest unless driver gives name and address or produces licence), as if the reference to a licence included a reference to a permit;

(c) section 48(1) (forgery and misuse of licences), as if the reference in sub- paragraph (a) to a licence included a reference to a permit;

(d) paragraph 14(a) of Schedule 3 (duty of coUrt when removing disqualification), subject to the substitution, for the words "endorsed on the licence, if any, previously held by the applicant", of the words "notified to the Department";

(e) paragraph 20(4) of Schedule 3 (duty to produce licence to court), as if the references to a licence included references to a permit;

(Ð paragraph 2l(2) of Schedule 3 (duties of court on ordering disqualif,rcation or endorsement), subject to the substitution, for the words from "shall also on production" onwards, of the words "shall also on the production of the permit retain it and forward it to the Department, which shall keep the permit until the disqualification has expired or has been removed or the person entitled to the permit leaves the Island and that person (in any case) has made a demand in writing for its return to him".

(3) In this regulation "permit" means a domestic driving permit or a Convention driving permit as defined in article 3 of the Road Vehicles (International Circulation) Order 2006, not being a domestic driving permit in the case of which any order made or having effect as if made by the Deparlment is for the time being in force under article 6(8) of that Order.

18. Invalid carriages

For the purposes of Schedule 3 to the Act and all regulations made thereunder the maximum unladen weight specified in the definition of "invalid carriage" in section 65(3) of the Act shall continue to be varied from 254 kg to 5 l0 kg.

19. Classification of vehicles - transitional provisions

(1) Where a licence granted before lst February 2000 authorises the driving of motor vehicles of a class comprised within a former group, it shall be treated for all purposes of the Act as authorising the driving of motor vehicles comprised within the corresponding category or categories.

(Z) Where a person before lst February 2000 passed a test authorising the grant of a licence to drive motor vehicles of a class comprised within a former group, the test shall be treated for the purposes of paragraph 2 of Schedule 3 to the Act as authorising the grant of a licence to drive motor vehicles comprised within the corresponding category or categories.

(3) A licence mentioned in paragraph (1) or granted under paragraph (2) shall be subject to -

24 (a) any limitation specified in column 3 of Schedule 5; and

(b) any other limitation or restriction imposed under Schedule 3 to the Act. (4) Where -

(Ð by virtue of one provision of Schedule 5 an authorisation to d¡ive a motor vehicle of any category is subject to a limitation; and

(b) by virrue of another such provision an authorisation to drive a motor vehicle of that category is subject to no limitation or to a lesser limitation,

the limitation mentioned in sub-paragraph (a) does not apply.

(5) In this regulation-

"forme¡ group" means a group of classes or descriptions of motor vehicles which -

(a) is specified in column I of Schedule 5, and

(b) had effect before 1st February 2000;

"corresponding category or categories", in relation to a former group, means the category or categories which -

(a) are specified in relation to that group in column 2 of Schedule 5, and

(b) have had effect from lst February 2000.

PART III _ THEORY TEST

20. Theory test before taking the test of competence to drive

Subject to regulation22, a person may not submit himself for a test of competence to drive unless at the time of making his application to take that test he satisfies the Department that he has, at some time during the period of two years ending on the date of the test, passed the test ("the theory test") described in Part 1 of Schedule 6, being the test which is hereby prescribed for the purpose of paragraph 2(2C) and (2D) of Schedule 3 to the Act.

21. Nature and conduct of theory test, and evidence of results

(1) Part2 of Schedule 6 makes provision for the nature and conduct of the theory test, evidence of the results of the test and generally with respect thereto.

(2) Part 3 of Schedule 6 provides for the forms which shall be used in notifting the result ofthe test and as evidence thereof.

25 ZZ. Circumstances where passing the theory test is not required before taking a test of competence to drive

(1) Regulation 20 does not apply to a ¡ierson submitting himself for a test of ,o.np.i"o6 to drive for the pu{pose of obtaining the grant of a full licence authorising him to drivô a class or classes of vehicles set out in an entry in column 2 of the table in Schedule 7 in the circumstances set out in column 3 in that entry.

(2) Regulation 20 does not apply to a person submitting himself for a test of competence to drive if within the period of two years ending on the date of that test he has pu5èd in a country or territory outside the Island a test which the Department has satisfied itself èorresponds to the theory test relating to the class of vehicles which he is submitting himself for the test of competence to drive.

(3) Regulation 20 does not apply to a person submitting himself for a test of competence to drive if -

(a) he is a person to whom paragraph (1) of regulation 17 relates; and

(b) on the date of that test he has not been resident in the Island for more than twelve months.

PART IV _ DRIVING TESTS

23. Persons by whom tests may be conducted

(1) Tests may be conducted -

(a) by examiners appointed by the Department;

(b) by the chief constable in so far as concerns the testing of -

(Ð members of the Isle of Man Constabulary, or

(iÐ persons employed in the driving of vehicles for police purposes by the Department of Home Affairs'

(Z) The Chief Constable may, subject to the approval of the Department, authorise suitable persons to act as examiners of those who submit themselves for a test.

24. Nature of tests

(1) Subject to the following provisions of this regulation, the testwhich aperson is required io pur. bãfore a full licence can be granted to him authorising him to drive a motor v"ñi"1. of a class comprised within any particular category is a test carried out on a vehicle of that class which satisfies the person conducting the test -

26 (a) that the person taking the test -

(Ð as respects a motor vehicle comprised within category K, is adequately conversant with , and

(iÐ as respects any other motor vehicle, is fully conversant with that Code;

(b) generally that the person taking the test is competent to drive, without danger to and with due consideration for other users of the road, the vehicle on which he is tested; and

(c) that the person taking the test is able to comply with such of the additional requirements specified in Schedule 8 as are referred to in column 3 of Schedule 2 in relation to the category which comprises the class of vehicle on which he is tested.

(2) Where the person conducting the test -

(a) may be satisfied as to the matters specified in paragraph (1); but

(b) concludes that the person being tested should only be passed in relation to vehicles of aparticular construction or design, the certificate of passing such test and any full licence subsequently granted shall be limited accordingly, whether or not the test was conducted on a vehicle of that construction or design.

(3) Subject to paragraph (2) and to the following provisions of this regulation, a person who has passed a test to drive vehicles of a class or description comprised within any particular category shall be deemed for the purposes of the Act and of these Regulations competent to drive, in addition to vehicles of a class or description comprised'within that particular category, also vehicles of a class or description comprised within any additional category in relation thereto which.is referred to in column 4 of Schedule 2.

(4) Subject to paragraph (5), if a person has passed a test on a vehicle with automatic transmission, he shall, in relation to vehicles of a class or description which he is thereby authorised to drive, whether they fall within a category in column I or 4 of the table in Schedule 2, be subject to the limitation that he may drive only such of those vehicles as have automatic transmission.

'Where (5) a vehicle is comprised within category F, K or P, being a category falling within column 4 of Schedul e 2, the limitation set out in paragraph (4) shall not apply.

(6) Subject to paragraph (7), if a person has passed a test on a vehicle adapted on account of a disability affecting him, he shall, in relation to vehicles of a class or description which he is thereby authorised to drive, whether they fall within a category in column I or 4 of the table in Schedule 2, be subject to the limitation that he may drive only such of those vehicles as are so adapted.

)'7 (7) For the pu{poses of paragraph (6), a test passed on a motor bicycle with a sidecar may be treated in an appropriate case as a test passed on a vehicle adapted on account of a disability.

(8) A person who passes a test shall -

(a) if he passes the test on a motor bicycle without a sidecar in respect of category A, be authorised to drive all classes of motor bicycle comprised within that category;

(b) if he passes the test on a motor bicycle with a sidecar in respect of category A, be authorised to drive all classes of motor bicycle with a sidecar comprised within that category;

(c) if he passes the test on a motor bicycle without a sidecar in respect of category 41, be authorised to drive all classes of motor bicycle comprised within that category; or

(d) if he passes the test on a motor bicycle with a sidecar in respect of category 41, be authorised to drive all classes of motor bicycle with a sidecar comprised within that category.

(9) If on or after lst July 2007 a person passes a test on a vehicle comprised within category Dl, then, unless he is thereby authorised to d¡ive vehicles in that category regardless of their maximum authorised mass, he shall be subject to the limitation that he may not drive a vehicle in that category exceeding a maximum authorised mass of -

(a) 4250kgif a mechanical lift for a wheelchai¡ is frtted and no trailer is drawn; and

(b) 3500 kg in any other case.

(10) If a person passes a test whereby he is authorised to drive a vehicle or combination comprised within category C, C+E, D or D-lE, he shall, unless the test was taken with a motor vehicle fitted with a tachograph, be subject to the limitation that he may not drive a vehicle or combination in that category on a journey which will take him outside the Island.

(11) If a person passes a test on a steam vehicle comprised within category S, he shall be subject to the limitation that he may not drive an engineering site vehicle comprised within that category other than an engineering site vehicle to which paragraph (12) relates.

(12) An engineering site vehicle to which this paragraph relates is a vehicle of that description which -

(a) falls within an additional category specified in column 4 of Schedule 2;

(b) is subject to the limitations applying to that category as set out there; and

(c) may be driven by the person in question under the provisions of paragraph (3) by virtue of his holding a full licence to drive a vehicle comprised within a category set out in columns I and 2 of that Schedule.

28 25. Eligibility to apply for test in respect of certain categories of vehicles

(l) Subject to the following provisions of this regulation, an applicant for a test to drive motor vehicles within a category specified in an item in column 2 of the table in Schedule 9 must hold a full licence authorising the driving of motor vehicles within the category specified in that item in column 3.

(2) Paragraph (1) shall not apply to an applicant who is a full-time member of the armed forces of the Crown.

(3) Where a full licence authorises the driving of vehicles in category Dl by virtue of an entry in column 4 of Schedule2,then, for the purposes of paragraph (1), that licence shall not -

(a) be taken as a full licence authorising the driving of such vehicles; and

(b) thereby enable a test to be taken in respect of vehicles in category D1+E.

26. Appointment for test

(1) A person who desires to take a test to be conducted by an examiner appointed under regulation 23(1)(a) shall apply for an appointment for such a test to the Department, which shall make any arrangements necessary for the taking of the test.

(2) An applicant for an appointment under paragraph (1) shall, when making an application, pay to the Deparbment the prescribed fee in respect of the test.

27. Production of test vehicle

(1) A person submitting himself for a test to drive vehicles comprised within a category shown in column 1 of the table in Schedule 10 shall -

(a) provide a vehicle having a specification equivalent to or (except in the case ofa test respecting category 81, F, G, H, K, L, P, S or W) higher than that shown in relation to that category in column 2 of that table; and

(b) comply with any condition shown therein in relation to that category-

(2) A person submitting himself for a test shall provide a vehicle which -

(a) is not fitted with a device designed to permit a person other than the driver to operate the accelerator, unless any pedal or lever by which the device is operated, and any other parts which it may be necessary to remove to make the device inoperable by such a person during the test, have been removed; and

(b) is reasonably representative of the class to which it belongs and is otherwise suitable for the purposes of the test.

29 (3) A person submitting himself for a test in respect of category B, 81, Bl (invalid carriage), B-lE o¡ L shall provide a motor vehicle which -

(a) is fitted with a front passenger seat unless -

(Ð it is a vehicle falling within category B1 (invalid carriage) and is constructed without a front passenger seat, or

(iÐ it has been adapted on account of a disability of the person who has submitted himself for the test and as part of that adaptation has had the front passenger seat removed;

(b) subject to sub-paragraph (a), is fitted with a properly anchored and f,rnctioning three-point seat belt for use with the front passenger seat (or, if there is no such seat, with another seat in which the person conducting the test may conveniently sit for the purpose of the test); and

(c) in the case of a vehicle having a front passenger seat, is fitted vrith a head restraint as an integralpart ofthat seat.

(4) A person submitting himself for a test in respect of category B or B1 (invalid carriage) shall provide a vehicle which is frtted with an interior rear-view rnirror providing adequate rearward vision from the front passenger seat, unless it is a vehicle of a kind mentioned in paragraph (3)(a)(i) or (ii).

(5) A person submitting himself for a test in respect of category B, C, Cl, B+E, C+E, Cl+E, D, D1, D*E or Dl+E shall provide a motor vehicle which is not carrying goods or burden other than fixed items which are characteristic of the class to which the vehicle belongs.

(6) A person submitting himself for a test in respect of category C, D1, B*E, CIE or Dl+E shall provide a motor vehicle which is fitted with an exterior nea¡side mirror and an exterior offside mirror providing adequate rearward vision from the seat occupied by the person conducting the test.

(7) A person submitting himself for a test in respect of category C, Cl, B*E, CIE or Cl+E shall provide a motor vehicle which -

(a) has a closed box body with no rear window; or

(b) has every rear window covered so that the driver cannot see through it by using a rear-view mirror during the test.

(8) A person submitting himself for a test in respect of category C, D, C+E or D*E shall provide a motor vehicle fitted with an antilock braking system, but this paragraph does not apply if - (a) the vehicle was first used before lst October 2003; and

(b) the test is taken before I st April 2009.

30 (9) A person submitting himself for a test in respect of category C, Dl, C+E or Dl+E shall provide a motor vehicle in which any seat occupied by -

(a) the person conducting the test; or

(b) any person authori.sed by the Department to attend the test for the purpose of supervising it or otherwise, is provided with a properly anchored and functioning two- or three-point seat belt.

(10) A person submitting himself for a test in respect of category C or C+E shall provide a motor vehicle fitted with eight forward gear ratios, but this paragraph does not apply if-

(a) the vehicle was first used before lst October 2003; and

(b) the test is taken before lst April 2009

(11) A person submitting himself for a test in respect of category C, Cl, D1, C+E, Cl+E or Dl*E shall provide a motor vehicle which is fitted with a seat which is firmly secured to the vehicle and in such a position that the person conducting the test may properly do so and is protected from bad weather during the test.

(12) A person submitting himself for a test in respect of category D, Dl, D*E or Dl+E shall provide a motor vehicle which is fitted with a seat so placed that the person conducting the test can, from the deck of the vehicle on which the driver is seated, clearly observe the road to the rear of the vehicle without the use of any optical device, unless -

(Ð the construction of the vehicle makes it impossible to fulfil that requirement; or

(b) the examine¡ consents to the requirement not being complied with in consequence of an arrangement to conduct part of the test elsewhere than on a road.

(13) A person submitting himself for a test in respect of category B+E, C+E, C1+8, D*E or Dl+E shall provide a motor vehicle which is fitted with linkage and braking mechanisms which are designed for use when the t¡ailer is fully laden. 'Where (14) a person submitting himself for a test fails to provide a vehicle in accordance with the relevant provisions of this regulation, the examiner shall refuse to conduct the test.

28. Other requirements relating to test

(1) A person submitting himself for a test shall - (a) produce to the examiner who is to conduct the test -

3l (Ð his provisional licence, full licence carrying a provisional entitlement, or other driving permit by virrue of which he is entitled to drive in the Island, and

(iÐ where such a licence or permit does not contain his photograph, a valid passport establishing his identity;

(b) sign both the examiner's attendance record and a declaration, produced to him by the examiner, that the¡e is in force, with respect to the vehìcle produced for the test, a policy of insurance which complies with the requirements of paragraph 3 of Schedule 5 to the Act;

(c) except where the test is for -

(Ð a motor bicycle,

(iÐ a vehicle mentioned in paragraph (3XaXi) or (ii) of regulation2T, or

(iiÐ any other vehicle in which it is impractical fo¡ a person other than the driver to be carried safely,

allow the examiner, and any person authorised by the Department to attend the test for the purpose of supervising it or otherwise, to travel during the test in the vehicle provided in accordance with that regulation; and

(d) where the test is for a motor bicycle with or without a sidecar, produce to the examine¡ a prescribed certificate that he has successfully completed an approved training course relating to the vehicle or class of vehicle on which the test is to be carried out.

(2) Where a person submitting himself for a test fails to comply with paragraph (lXa), (b), (c) or (d), the examiner shall refuse to conduct the test.

29. Evidence of result of test

(1) A person who passes a test shall be fumished with a certificate in the form (adapted as the case may require) set out in Part I of Schedule 11.

(2) A person who fails to pass a test shall be furnished with a staternent to that effect in the form (adapted as the case may require) set out in Part 2 of Schedule 11.

(3) An applicant for a licence who before the licence is granted is required to satisfy the Department that he has passed a test shall, at the time when he applies for the licence, deliver the certificate under paragraph (l) to the Department for retention.

30. Period of ineligibility for subsequent test

Subject to paragraph 2(3) of Schedule 3 to the Act, the period during which a person who has submitted himself for a test and failed to pass that test shall be ineligible to submit himself for

32 another test on a vehicle of a class or description comprised within the same category is one month.

31. Extended test

(1) Any reference to a test in the foregoing provisions of this Part shall be construed as a reference to an extended test in a case where a person -

(a) desires to take such a test; or

(b) is disqualified by a court order for holding a licence until he passes such a test.

(2) In the case of a person to whom paragraph (lxb) refers, he shall, on passing an extended test on a vehicle to which the disqúalification relates, be granted a full licence authorising him to drive -

(a) such categories of vehicles specified in column I of the table in Schedule 2; and,

(b) such additional categories of vehicles specifred in column 4 thereof, as a full licence authorised him to drive immediately before he was disqualified.

(2) In this regulation "extended test" means a test which -

(a) relates to the driving of a vehicle other than a vehicle comprised within category K; and

(b) is so modified that the time during which the person drives on roads is not less than 60 minutes.

THEORYTEST

PART I

KNOWLEDGE AND UNDERSTANDING

ScoPe ofqueslions l. The theory test shall be to establish whether a person has sufhcient knowledge and understanding ofsuch matters relevant to the safe, competent and careful driving of motor vehicles as are set out in paragraph 5.

2. (1) Subject to sub-paragraph (2), the test shall include questions on all the matters specihed in paragraph 5.

(2) The test need not include questions on all the matters in sections F and G of paragraph 5, provided that at least one question, chosen at random, is asked on each of those sections.

45 (3) If the candidate has stated that he intends to apply to submit himself for a test of competence to drive - (a) motor bicycles comprised within category A or A1; or

(b) mopeds in class Pr,

the test ("the motor bicycle test") shall include questions relating to the driving of a motor bicycle.

(4) If the candidate has stated that he intends to apply to submit himself for a test of competence to drive motor vehicles other than - (a) motor bicycles comprised within category A and A1; and

(b) mopeds in class Pr,

the test ("the test for vehicles other than motor bicycles" ) shall not, subject to sub-paragraph (5), include questions relating to the driving of a motor bicycle.

(5) A candidate who intends to submit himself for a test of competence to drive mopeds in class P, only, may, at his own option, take the theory test in the form of either the motor bicycle test or the test for vehicles other than motor bicycles.

3. The test shall consist, in either a multiple choice or multiple response format of at least 35, and not more than 56, questions drawn from a set of questions approved by the Department.

4. The Departrnent shall - (Ð make available at the Isle of Man College and at the Tynwald Library for reference by the public every set of questions approved by the Department for the purpose of the theory test; and

(b) cause a notice of such availability to be published in a newspaper published and circulating in thè Island, not less than one month before any such set of questions is used for the purpose of the theory test.

5. The matters referred to in paragraph2 arc-

A: Road traffic regulation

Road traffic regulations including road signs, road markings, signals, rights of way and speed limits.

B: The driver

(l) The importance ofalertness and attitudes to otherroadusers.

(2) Perception, judgement and decision-making, including especially reaction time and changes in driver behaviour due to the influence of alcohol, drugs and medicinal products, state of mind and fatigue,

C: The road

(1) The most important principles concerning the observance of safe distance between vehicles, braking distances and roadholding under various weather and road conditions,

(2) Driving risk factors related to various road conditions, in particular as they change with the weather and the time of day or night.

(3) Characteristics of various fypes of road and the related stailtory requirements.

46 D: Other road users

(1) Specific risk factors related to the lack of experience of other road users and the most vulnerable categories ofuser such as children, pedestrians, cyclists and people whose mobility is reduced.

(2) Risks involved in the movement and driving of various types of vehicle and the different fields of view oftheir drivers.

E: General rules and regulations and other matters

(l) Rules concerning the administrative documents required for the use of vehicles

(2) General rules specif,ing how the driver must behave in the event of an accident (setting device and raising the alarm) and the measures which he can take to assist road accident victims where necessary.

(3) Safety factors relating to persons carried, including, in the case ofthe motor bicycles test, balancing with a passenger.

F: Road and vehicle safety

(l) Mechanical aspects of the vehicle with a bearing on road safety, i.e. the detection of the most common faults, in particular in the steering, suspension and brake systems, fyres, lights and direction indicators, reflectors, rear-view mirrors, and the exhaust system; and, in the case of a test for vehicles other than motor bicycles, this includes windscreen and wipers, and seatbelts.

(2) Vehicle safety equipment, being-

(a) in the case of the moto¡ bicycle test, equipment which includes in particular the use of crash helmets and visors; and

(b) in the iase of the test for vehicles other than motor bicycles, equipment which includes in particular the use of seat-belts and child safety equipment.

G: Environmental matters

Rules regarding vehicle use in relation to the environment, including the appropriate use of audible waming devices, moderate fuel consumption, limitation of pollutant emissions and matters of a similar nature.

PART 2

NATURE AND CONDUCT ETC. OF TESTS

Nature of the test

6 The theory test shall be either - (Ð a w¡itten examination of questions comprising printed text and graphical images; or

(b) an examination in the form of a sequence of displays of electronically produced text and graphical images constituting the questions on a video screen, by use of which screen the candidate records his chosen answers as electronic data, the test being conducted by the Department of Education at such place and by such person as that Department may appoint.

47 Duration of test

7. The examination shall last-

(a) 40 minutes plus 8 minutes for each 7 questions over 35; or

(b) if the candidate requires the assistance of a súitably qualified person because he has reading diffrculties, 80 minutes plus 16 minutes for each 7 questions over 35.

Persons by whom test may be conducted

8. A test shall be conducted by a person designated by the Department of Education and approved by the Department for the purpose.

Applicationfor test

9 (l) An application to take a test shall - (a) be made in writing to the Department of Education on a form supplied by that Department;

(b) state the full name, address in the Island and date of birth of the candidate, and such other details as may reasonably be required;

(c) state the preferred location for the test (if arrangements are made for tests to be held at more than one place);

(d) certifo that the candidate at the d¿te of application has attained the age of 16 and is not disqualihed for driving by order of a court;

(e) be signed and dated by the candidate;

(Ð unless the candidate holds a licence granted under paragraph 6 of Schedule 3 to the Act, be countersigned by a person resident in the Island who is ofsuch a capacity as is acceptable to the Department for the pulpose, and who shall certify that he is resident in the Island, verify the identity of the candidate and specifo-

(Ð his full name and address and a telephone number at which he may be contacted by the Department or the Department of Education,

(ii) the capacity in which he countersigns the application, and

(iiD the number of years over which he has known the candidate;

(e) be accompanied by-

(Ð a fee of such amount as the Department of Education may reasonably prescribe, and

(iÐ a photograph ofthe candidate, bearing on the reverse a certificate by the countersignatory in the following terms - "I [name] certifu that this is a true likeness of [candidate's nameJ"

followed by the signature ofthe countersignatory and the date.

(2) Subject to paragraph (3), the Department of Education shall, as soon as practicable after receiving an application complying with sub-paragraph (1), notifu the candidate of the time and place where the test will take place, and the notice shall include a notification of the effect of paragraph I I .

48 (3) The Department of Education may reject an application for a test if a statement has been issued to the candidate unde¡ paragraph l2(3) or (4) less than 7 days before the date ofthe application.

(4) Where the candidate cancels the appointment for a test more than 7 clea¡ days before the time appointed, the Deparünent of Education shall refund the fee paid by him.

Identification and conduct of candidate

10. (l) When the candidate for a test presents himself for the test, he shall, befo¡e the test commences, produce to the person conducting the test one of the following documents

(u) a passport;

(b) an identily card, licence or transport pass issued by a Department, Statutory Board, local authority, employer, trade union, sfudents' union or professional body; or

(c) such other document as appears to the person conducting the test sufficiently to identify the candidate, together with such evidence of the candidate's date of birth as appears to that person to be sufhcient, if that document does not include the date of birth.

(2) The candidate shall also, before the test commences, sign a record ofhis attendance.

(3) The candidate shall during the test comply wilh such reasonable instructions as the person conducting the test may give for the purpose of ensuring the proper and orderly conduct of the test.

Power to reftne to conduct test

11. (1) The person conducting a test shall refuse to allow the candidate to take the test if he has not complied with all the requirements of paragraph 10.

(2) The person conducting a test may refuse to allow the candidate to take the test if he has not, at least 14 days before the time appointed, notihed the Deparlment of Education of any special needs he has.

(3) For the purpose ofsub-paragraph (2) "special needs" means a reasonable requirement for special treatment during the test because of - (a) reading difficulties;

(b) the test not being available in a language the candidate understands;

(c) physical disablement.

(4) The person conducting a test shall refuse to allow the candidate to take the test if he requires üte assistance ofan interpreter and attends the test-

(a) without an interpreter approved by the Department of Education to act as such; or

(b) with an interpreter tò whom the candidate is related or with whom he is closely associated.

Marking and notif.cation of result of test

12. (t) As soon as practicable after completion of a test, the Department of Education shall either-

(a) cause the test paper retumed by the candidate to be marked; or

49 (b) in the case where the candidate has answered the questions by means of using a video screen, cause the results of the electronically undertaken and recorded marking of his electronically stored answers to be recorded in print,

for the purpose of ascertaining whether the candidate has demonst¡ated knowledge and a sound understanding of the matters on which the questions were set in accordance with paragraph 5.

(2) If the candidate has passed the test, the Department of Education shall as soon as practicable-

(a) furnish him with a certificate in form A in Part 3; and

(b) send a copy of the certificate to the Deparhnent,

(3) If the candidate has failed the test, the Department of Education shall as soon as practicable fi¡mishhim with a statement in form B in Part 3.

(4) If the Department of Education is satisfied that a certificate or statement issued unde¡ sub- paragraph (2) or (3) has been issued in error, it shall cancel the certihcate or statement and fi.rmish the candidate with a statement or certihcate, as the case may be, in its place; and if it cancels a certificate under this sub- paragraph it shall notifl the Department of the cancellation.

(5) For the purpose ofacceptance by the Departrnent that a candidate who has passed the theory test may submit himself for a test of competence to drive, a certificate ñrmished under paragraph (2) shall, unless it is cancelled under sub-paragraph (4), be valid for a period of 2 years commencing with the date on which the theory test was taken.

(6) A certiflrcate in form A, or a statement in form B, prescribed in Part 3 of Schedule I to the ¡a Driving Tests (Theory Tests) Regulations 2001 may be used in place of the corresponding certificate or statement prescribed in Part 3 of this Schedule, provided that an amendment in writing to, or an overprint on, the certificate or statement identihes it as having been issued under these Regulations in respect of the theory test.

Appeal

13. (1) A candidate may, 14 within days after a statement is issued to him under paragraph l2(3) or (4) , request the Department of Education

(a) to cause his test paper to be marked afresh; or

(b) in the case where the candidate has answered the questions by means of using a video screen, to ' cause the electronic data record of his answers and of the results of the electronic marking of them to be recorded in printed writing and be examined.

(2) A request under sub-paragraph (l) shall be made in writing and be accompanied by the statement and a fee ofthe amount prescribed under paragraph l(tXgXi).

(3) On receipt of a request under sub-paragraph (1) the Department of Education shall, as the case may be, cause the candidate's test paper to be marked afresh o¡ the record in print to be examined, and paragraph 12 (but not this paragraph) shall apply with any necessary modifìcations in relation thereto.

(4) If on a marking of a test paper or examination of a record in print under this paragraph it is determined that the candidate has passed the test, the fee paid under sub-paragraph (2) shall be refunded.

Communications with Department of Education

14. (l) Any communication by a person with the Department of Education for the purposes of this Schedule shall be made to such address as that Departrnent specifies in a direction given by it.

50 (2) Where immediately before the coming into operation of these Regulations there was such a di¡ection in force under the Driving Licences (Theory Tests) Regulations 2000 or the Driving Tests (Theory Tests) Regulations 2001, that direction shall continue in force unless or until replaced by a direction under paragraph (1).

PARTI

Driving test: categoríes A, AI and P l. Each test candidate must satisfy the person conducting the test as to -

(a) his ability to -

(Ð carry outproperly the activities, and

(iÐ perform competently, without danger to and with due consideration for other road users, the manoeuvres,

specihed in sections A to F below in all respects in accordance with those sections; and

(b) his understanding of the way to balance safely with a passenger'

2. The sections to which paragraph I refers are - Ä. Eyesight

Read in good daylight (with the aid of corrective lenses if worn) a registration mark fixed to a motor vehicle and containing letters and figures either

(a) 79 mm high and 57 mm wide at a distance of 20.5 metres; or

(b) 79 mm high and 50 mm wide at a distance of 20 metres; or

(c) 79 mmhigh and 44 mmwide at a distance of 19'5 metres.

B. Yehicle safety checks

(1) Describe how to perform a check on the condition and safefy of one component of the vehicle, chosen at the test conductor's discretion from the list of components specified in paragraph (2), and demonstrate an actual check on the condition of a second component, similarly chosen from the list.

(2) The components are: tyres, brakes, steering, emergorlcy stop switch (if fitted to the vehicle), chain, oil levels, lights, reflectors, direction indicators, and audible warning device.

C. Preparation to drive

(l) Adjust rear-view mi¡rors.

(2) Adjust crash helmet.

D. Technical control of vehicle

(1) Start the engine and move off smoothly (uphill and downhill as well as on the flat).

(2) Accelerate to a suitable speed while maintaining a straight course, including during gear changes.

(3) Adjust speed to negotiate left or right turns at junctions, possibly in ¡estricted spaces, while maintaining control of the vehicle.

PART 2

Driving test: categories B, Bl, BI (invalid carriage) and B+E

3. (l) Subject ro sub-paragraphs (2), (3) and (4), each test candidate must satisfo the person conducting the test as to his ability to -

(a) carry outproperly the activities; and

(b) perform competently, without danger to and with due consideration for other road users, the manoeuvres, specif,red in sections A to F below in all respects in accordance with those sections'

(Z) Any requirement contained in those sections shall, in the case of a test for a licence authorising the driving of a vehicle in category Bl or Bl (invalid carriage), be complied with only to such extent as is compatible with the characteristics of the vehicle on which the test is taken.

(3) A test candidate unde¡taking a test for a licence authorising the driving of a combination compriseà within category B+E must additionally satisfy the person conducting the test as to his ability to carry out iroperly the activities specifred in section G, except that, in the case of a disabled driver, the requirements to and recouple the tractor vehicle and trailer shall be met by the driver describing under oral questioning "tr"ô"pi. how those activities should be þerformed.

4. The sections to which paragraph 3 refers are -

A. Eyesight

Read in good daylight (with the aid of corrective lenses if wom) a registration mark hxed to a motor vehicle and containing letters and figures either

(a) 19 mmhigh and 57 mm wide at a distance of 20'5 metres; or

(b) 79 mm high and 50 mm wide at a distance of 20 metres; or

B. Vehicle safefy checks

(l) In the case of a test for a licence authorising the driving of vehicles in category B, Bl or Bl (invalid caniage) only, describe how to perform a check on the condition and safet¡r of one component of the vehicle, chisen at the test conductor's discretion from the list of components specihed in paragraph (3), and demonstrate an actual check on the condition of a second component, similarly chosen from the list.

(2) In the case of a test for a licence authorising the driving of combinations in category B+E only, àemonstrate (or at the test conductor's discretion describe how to perform) five checks on five diffe¡ent matters chosen by the test conductor from those set out in the following sub-paragraphs, namely -

(a) the condition and safety of a component of the motor vehicle or trailer (as relevant) specified in paragraPh (3);

(b) the condition and safety of one of the following: the body of the trailer, any sheeting used in respect of a load on the trailer, a load itself, anything intended to secure such a load, the trailer's cabin locking (ifany), or its cargo doors (ifany);

(c) the condition and safety of the trailer coupling mechanism or its brake and electrical co¡rnections.

55 (3) The components are: tyres, brakes, steering, lights, reflectors, direction indicators, audible warning device, and the liquids used in the braking system, steering system, engine or elsewhere in the vehicle as a coolant, lubricant, cleaner or otherwise,

C. Preparation to drive

(1) Adjust the seat as necessary to obtain a correct seating position.

(2) Adjust rear-vie'ff mirrors, head restraint and seat belt.

(3) Check that the doo¡s are closed.

D. Technical control ofvehicle

(1) Sta¡t the engine and move off smoothly (uphill and downhill as well as on the flat),

Ø Accelerate to a suitable speed while maintaining a shaight course, including during gear changes.

(3) Adjust speed to negotiate left or right turns at junctions, possibly in restricted spaces, while m4intaining control of the vehicle.

(4) Brake accurately to stop where directed, if need by by performing an emergency stop. (5) Either - (a) perform any two of the following manoeuvres, namely -

(Ð reverse in a straight line and reve¡se right or left rouncl a corner while keeping within the correct traffic lane,

(iÐ tum the vehicle to face the opposite way, using forward and reverse gears,

(iii) park the vehicle and leave a space þarallel, oblique or right-angle), both forwards and in rèverse, on the flat, uphill and downhill; or

(b) in the case of a test for a licence authorising the driving of combinations in category BaE only, reverse in an S-shaped curve.

E. Behaviour in traffic

(1) Observe (including the use of the rear-view mirrors) road alignment, markings, signs, ald potential or actual ¡isks.

(2) Communicate with other road users, using the authorised means,

(3) React appropriately in actual risk situations.

(4) Comply with ¡oad traffic regulations and the instructions of the police and trafÍic controllers.

(5) Move off from the kerb or a parhng space.

(6) Drive the vehicle correctly positioned on the road, adjusting speed to trafhc conditions and the line of the road.

(7) Keep the right distance between vehicles.

(8) Change lanes.

(e) Pass parked or stationary vehicles and obstacles.

(1 l) Turn right or left atjunctions or to leave the caniageway.

(12) Where the opportunity arises, -

(a) pass oncoming vehicles, including in confined spaces;

(b) overtake in various situations;

F. Alighting from vehicle

Take all necessary precautions when alighting.

G. Trailers

Uncouple the trailer from the tractor vehicle, then park the hactor vehicle parallel to the trailer, then drive the tractor vehicle from the parked position to in front ofthe trailer so that the tractor vehicle and trailer can be easily coupled, and fînally recouple the tractor vehicle and trailer.

PART 3

Driving lest: categories C, CI, C+E and Cl+E

5. (l) Each test candidate must satisfy the person conducting the test as to his ability to -

(Ð carry outproperþ the activities; and

(b) perform competently, without danger to and with due consideration for other road users, the manoeuvres, in all respects in accordance with the sections prescribed in sub-paragraph (2), (3) or (4), as the case may be.

(2) In the case ofcandidates taking a test for a licence authorising the driving ofvehicles comprised within category C, Cl, C+E or Cl*E, the manoeuvres and activities rnentioned in sections A to E and H below are prescribed.

(3) In the case of candidates taking a test for a licence authorising the driving of vehicles comprised within category C or Çl-E, not being vehicles comprised within category C1 or Cl+E, the manoeuvres and activities mentioned in section F are also prescribed,

(4) In the case of candidates taking a test for a licence authorising the driving of combinations comprised within category C+E or Cl+E, the activities mentioned in section G are also prescribed.

6. The sections prescribed in paragraph 5 are -

A. Eyesight

(a) the condition and safety ofa component ofthe vehicle specified in paragraph (3);

(b) the condition and safety of one of the following: the body of the vehicle, any sheeting used in respect ofa load on the vehicle, a load itself, anything intended to secure such a load, the vehicle's cabin locking (ifany), or its cargo doors (ifany);

(c) the vehicle's tachograph (if fitted for joumeys outside the Island) or any other part of the dashboard inst-ument panel.

(2) In the case of a test for a licence authorising the (Siving of combinations in category C+E or Cl+E only, demonstrate a check on one matter, and describe'hoy to perform a check on u.róthã. matter, chosen by the test conductor f¡om those set out in the following shb-paragraphs, namely -

(a) the condifion and safeff of a component of the motor vehicle or trailer (as relevant) specified in paragraph (3);

(b) the condition and safety of one of the fotlowing: the body of the trailer, any sheeting used in respect of a load on the hailer, a toad itself, anything intended to secure such a load, or the trailer's cargo doors (ifany);

(c) the condition and safety of the coupling mechanism or the brake and electrical connection between the tractor vehicle and the trailer.

(3) The components are: tyres, brakes, steering, lights, reflectors, di¡ection indicators, audible waming device, the power-assisted braking and steering systems, wheels, wheelnuts, mudguards, windscreen, windows and wipers, the air pressure in the braking system, air tanks fo¡ the braking ,-yrt.-, the suspension, and the'liquids used in the braking system, steering system, engine or elsewhle in the vehicle as a coolant, lubricant, cleane¡ or otherwise.

C. Preparation to drive

(l) Adjust the seat as necessary to obtain a correct seating position.

(2) Adjust rear-view mirrors and seat belt.

(1) Check the power-assisted braking and steering systems-

(2) Use the various braking systems.

(3) Use the speed reduction systems other than the brakes.

(4) Adjust course to allow for the length ofthe vehicle and its overhang.

59 G. Trailers

(l) Uncouple the trailer from the hactor vehicle, then park the tractor vehicle parallel to the hailer, then drive the tractor vehicle from the parked position to in front of the trailer so that the tractor vehicle and traile¡ can be easily coupled, and hnally recouple the tractorvehicle and trailer.

(2) Park the vehicle at or by a loading ramp or platform (or equivalent installation) in a position which would enable the safe loading or unloading of the trailer.

H. Vehicle safety

Show awareness of vehicle safety measures and be able to operate vehicle safety systems.

PART4

Driving test: categories D, Dl, D+E and Dl +E

7 . ( l) Each test candidate must satisff the person conducting the test as to his ability to -

(a) carry out properly the activities; and

(b) perform competently, without danger to and with due consideration for othe¡ road users, the manoeuvres,

in all respects in accordance with the sections prescribed in sub-paragraph (2), (3) or (4), as the case may be.

(2) In the case of candidates taking a test for a licence authorisiag the driving of vehicles comprised within category D, Dl, D+E or Dl+E, the manoeuvres and activities mentioned in sections À to E and H belów are prescribed.

(3) In the case of candidates taking a test for a licence authorising the driving of vehicles comprised within category D or D+E, not being vehicles comprised within category Dl or Dl+È, the manoeuvres and activities mentioned in section F are also prescribed.

(4) In the case of candidates taking a test for a licence authorising the driving of combinations comprised within category D+E or Dl+E, the activities mentioned in section G are also prescribed.

8. The sections prescribed in paragraph 7 are -

(a) the condition and safety of a component of the motor vehicle or trailer (as relevant) specified in paragraph (3);

(b) the condition and safety of a feature ofthe vehicle or trailer (as relevant) specihed in paragraph (4);

(c) the condition and safety of the coupling mechanism or the brake and electrical connection befween the tractor vehicle and the trailer.

(3) - The components are: tyres, brakes, steering, lights, reflectors, direction indicators, audible warning device, the power-assisted braking and steering systems, wheels, wheelnuts, mudguards, windscreen, windows and wipers, the tachograph (if fitted for journeys outside the Island) or other dashboard instrument, the air pressure in the braking system, ai¡ tanks for the braking systèm, the suspension, and the liquids used in the braking system, steering system, engine or elsewhere in the vehicle as a coolant, lubricani, cleaner or otherwise.

(4) The featu¡es are: the service doors, the emergency exits, the first-aid equipment, the fire extinguishers, and any other piece of safety equipment.

C. Preparation to drive

(1) Adjust the seat as necessary to obtain a correct seating position.

(2) Adjust rear-view mirrors and seat belt.

(3) Check that the doors are closed.

D. Technical control of vehicle

(1) Stan the engine and move off smoothly (uphill and doùnhill as well as on the flat).

(2) Accelerate to a suitable speed while maintaining a straight course, including during gear changes.

(3) Adjust speed to negotiate left or right tums at junctions, possibly in restricted spaces, while maintaining control of the vehicle.

(4) Brake accurately to stop where di¡ected, if need by by performing an emergency stop.

(s) Either - (Ð perform any two of the following manoeuvres, namely -

9 (t) Each test candidate must satisf, the person conducting the test as to his ability to -

(a) carry out properly the activities; and

(b) perform competently, without danger to and with due consideration for other road users, the manoeuvres, in all respects in accordance with the sections prescribed in sub-paragraph (2), (3) or (4), as the case may be.

(2) ln the case of candidates taking a test for a licence authorising the driving of vehicles comprised within category F, G, H, K, L, S and W, the manoeuvres and activities mentioned in sections A and B below are prescribed.

(3) In the case of candidates taking a test for a licence authorising the driving of vehicles comprised within category F, G, L, S and W, the manoeuvres and activities mentioned in section C are also prescribed.

(4) In the case ofcandidates taking a test for a licence authorising the driving ofvehicles comprised within category H, the manoeuvres and activities mentioned in section D are also prescribed.

A. Eyesight

B. Control ofvehicle and behaviour in trafñc - general

(1) Start the engine of the vehicle.

(2) Move away straight ahead or at an angle.

(3) Overtake, meet or c¡oss the path ofother vehicles and take an appropriate course.

(4) Tum right-hand and left-hand corners correctly.

63 (5) Stop the vehicle in an emergency and normally, and in the latter çase bring it to ¡est in an appropriate part of the road.

C. Control of vehicle and behaviour in traffic - categories F, G, L, S and W

(l) Carry out manoeuvres involving the use of reverse gear (except where the vehicle is not f,rtted with a means of reversing).

Ø Indicate intended actions at appropriate times by giving appropriate signals in a clear and unmistakable manner, except that, in the case of a test taken -

(a) on a vehicle with a left-hand drive; or

(b) by a disabled person fo¡ whom it is impracticable or undesirable to give signals by arm,

there shall be no requirement to give signals which cannot be given by mechanical means.

(3) Act correctþ and promptly on all signals given by traffic signs and traffic controllers and take appropriate action in relation to signals given by other road users.

D. Control ofvehicle and behaviour in traffic - category H

(l) Indicate intended actions at appropriate times by giving appropriate signals in a clear and unmistakable manner, except that, in the case of a test taken -

(a) on a vehicle with a left-hand drive; or

(b) by a disabled person for whom it is impracticable or undesirable to give signals by arm,

there shall be no requirement to give signals which cannot be given by mechanical means.

(2) Act correctly and promptly on all signals given by traffic signs and traffrc controllers and take appropriate action in relation to signals given by other road users.

(3) Drive the vehicle backwards and cause it to face in the opposite direction by means of tracks.

MINIMUM TEST VEHICLES

(a) the cornbination is capable ofan unassisted speed of 100 km/h on the level; and

(b) the cargô compartment of the trailer consists of a closed box body at least as wide and as high as the corresponding dimensions of the drawing vehicle:

Provided always that, in the case ofsub-paragraph (b), the closed box body may be narrower than the drawing vehicle if the driver's view to the ¡ear of the trailer is made possible only by the use of the external rear-view rnirrors of the drawing vehicle

C1 Any vehicle in category Cl which has -

66 (a) a maximum authorised mass of 4000 kg;

(b) a length of at least 5 metres; and

(c) a cargo compartment consisting of a closed box body at least as wide and as high as the corresponding dimensions of the cab,

and which is capable of an unassisted speed of 80 km/h on the level

CI+E A combination of a minimum test vehicle for category Cl and atrailer with a maximum authorised mass of 2000 kg, where -

(a) the combination -

(i) has a maximum authorised mass of 4000 kg and a length of at least 8 metres, and

(ii) is capable of an unassisted speed of 80 km/tr on the level; and

(b) the cargo compartment of the trailer consists of a closed box body at least as wide and as high as the corresponding dimensions of the drawing vehicle:

(i) he has passed a test to drive a vehicle in category D I , being a vehicle of a kind specified in paragraph (a) or (b) in column I of the following entry, or

(ii) he has passed a test to drive a vehicle in any category with a maximum authorised mass exceeding 3500 kg, or

(iii) he is at least 21 years old and has heid for at least fwo years a full licence to drive vehicles in category B (as distinct from Bl)

1. These Regulations consolidate with amendments the revoked Regulations mentioned in Schedule L The principal amendments are as follows.

Reguløtiott 4

2. In oonformity with European practice the terrn "category" is used throughout the Regulations to describe a group of classes or descriptions of motor vehicle which is authorised by licences to be driven on roads. By designating categories as groups for the purposes of paragraph 2(1Xb) and (2) of Schedule 3 to the Act, regulation 4 effectively provides that the granting of a licence to drive any one class of vehicle within a category in column 1 of Schedule 2 also authorises the driving of all classes of vehicle within that category, but subject to the limitations prescribed later in the Regulations.

Regulation 6

3. The disapplication of the residence qualification is extended to holders of a Community licence or a British licence within the meaning of the regulation.

Regulation I

4. Paragraph (lxd) restricts to occupational roads a provisional licence holder driving an agricultural tractor if he is under 17 years of age.

5. Paragraph (lXe) now prohibits a provisional licence holder from drawing a trailer on a road other than an occupational road (as defined in regulation 3(1)) whereas previously he was prohibited from drawing a trailer at all. This prohibition does not apply in the circumstances set out in paragraph (6).

6. Paragraph (5Xb) exempts a provisional licence holder driving a single-seat agricultural tractor from the requirement that he be accompanied by a qualified driver, whereas previously the exemption applied to agricultural tractors generally.

7. Paragraph (5)(c) makes new provision disapplying, in the case of a vehicle constructed or adapted to carry only one person (not being an agricultural tractor), the requirement that a provisional licence holder be accompanied by a qualified driver, but the disapplication applies only if the person concerned is driving the vehicle on an occupational road or if he holds a full licence to drive another vehicle comprised within category B+E, C+E, D*E, F or S.

8. Paragraph (8) amends the dehnition of "qualihed driver" by requiring a qualif,red driver in all cases to have held for at least three years a full licence to d¡ive the vehicle of the provisional licence holder whom he is supervising.

10. Paragraph (4Xa) and (c)(i) prescribes certain amended circumstances under which the Department of Transport may satisfy itself whether an applicant for or a holdei of a licence is suffering from a prescribed disability'

11. Paragraph (6). enables the Departrnent to appoint a panel of registered medical practitioners to advise on queqtions of a medical nature arising under regulation 14,75 or 16 or otherwise under Schedule 3 to the Act.

Reguløtion 15

12. This regulation is about relaxing the prohibition on granting a licence to persons suffering from certain prescribed disabilities in a case whgre the licence is to drive ligþter vehicles or combinations in medical group l. Paragraph (2)(i) and (ii) prescribes additional conditions which need to be met if a person suffering from epilepsy is to be granted such a licence. Paragraphs (3) and (4) provide a statutory framework for relaxing the prohibition on being granted such a licence in the case of a person suffering from diabetes requiring insulin treatment.

Regulation 16

13. This regulation makes new provision. First, it prescribes additional disabilities subject to which a person may not be granted a licence to drive heavier vehicles or combinations in medical group 2. Second, it relaxes the prohibition on granting such a licence to a person suffering from epilepsy, but it prescribes more stringent conditions to be met than those conditions prescribed in relation to epilepsy in medical group 1' Finally, it makes a like relaxation, and prescribes related conditions, with respect to licensing a person to drive certain vehicles in medical group 2 who suffers from diabetes requiring insulin treatment.

Reguløtion 17

14. This regulation, which deals with persons who become resident in the Island, extends from three to twelve months the period within which holders of prescribed permits may use them in the Island as if they were fi'rll licences.

Regulation 22

15, Paragraph (3) is new. It provides a limited relaxation from taking the theory test in the case of persons who, on becoming resident in the Island, possess a permit prescribed in regulation 17.

IJ Reguløtion 24

16. Paragraph (tXaXÐ relaxes the requirement for knowledge of the Highway Code in the case of a person taking a test to drive vehicles in category K.

17. Paragraphs (a) to (12) make new provision placing limitations in certain circumstances on the vehicles which persons passing a test may drive.

Regulation 25

18. This regulation and Schedule 9 make new provision with respect to staged tests.

Regulation 27

19. Apart from paragraph (2), this regulation makes new provision. Paragraph (1) and Schedule 10 provide for the taking of tests on minimum test vehicles.

20. Paragraphs (3) to (13) make further provision with respect to the vehicles on which tests are to be taken. Paragraph (14) provides for compliance with the regulation.

Reguløtion 28

21. Paragraph (l)(c)(ii) and (iii) add further exceptions to the requirement that a person submitting himself for a test must be accompanied in the test vehicle by an examiner.

Regulation 31

22. This reguiation makes provision for extended tests in the circumstances specified there.

Schedule 2

23. Column 3 of the table refers to the expanded requirements of Schedule 8 which need to be met in connection with passing a test to drive vehicles of a category in column 1.

24. Column 4 specihes additional categories of vehicles which may be driven if a. person passes a test to drive vehicles of a category in column 1.

Schedule I

25. This Schedule expands the requirements - additional to those described in Part IV of the Regulations - which must be met for the purposes of passing a driving test.
