Revocation The Regulations mentioned in schedule I are hereby revoked. PART I - PRELIMINARY 3. r 2ool c. 14 5 "km/h" means kilometre(s) per hour; "kw" means kilowatt(s): "large motor bicycle" means a motor bicycle which - (u) if not attached to a sidecar, has a maximum net power output exceeding 25 kw or a polver to weight ratio exceeding 0.16 kwlkg, or (b) if attached to a sidecar, forms a combination therewith having a power to weight ratio exceeding 0.16 h/kg; "maximum authorised mass", - (a) in relation to a motor vehicle or a combination of vehicles, neither of which is constructed itself to carry a load, means the unladen weight of the motor vehicle or the combination, and (b) in relation to any other motor vehicle or combination, means the weight which the vehicle or the combination is designed or adapted not to exceed when in normal use and travelling on a road laden; "maximum net power output", in relation to a motor bicycle, means the maximum net power ouþut of its engine as measured in accordance with the test conditions specified in document ISO 4106 published by the Intemational Organisation for Standardisation under reference ISO 1978 4106-09-01; "medical group 1" means a group of categories comprising - (Ð categories A, 41, B, 81, Bl (invalid carriage), B+E, F, G, H, K, L, P and 'w, (b) category Dl, where the vehicles to which the category relates do not exceed a maximum authorised mass of - (Ð 4250 kg if a mechanical lift for a wheelchair is fitted and no trailer drawn, and (iÐ 3500 kg in any other case, and (c) category S, where the vehicles to which the category relates do not exceed a maximum authorised mass of 3500 kg; "medical group 2" means a group of all categories other than - (a) in the case of categories in medical group I whose extent is not limited in that group, those categories, and 6 (b) in the case of categories in that group whose extent is so limited, those categories to that extent; "minimum test vehicle", in relation to a category, means a vehicle of a specification shown in relation to that category in column 2 of the table in schedule 10; "mm" means millimetre(s); "motor bicycle" means a two-wheeled motor vehicle, being a motor vehicle comprised within category A or P; "motor car" means - (a) any motor vehicle of a class comprised within category B-fE, and (b) any motor vehicle which would be of a class comprised within that category were it not propelled by electrical or steam power and comprised within category L or S; "occupational road" means - (a) in the case of a road *nr"O is a highway maintainable at the public . expense, - (Ð an unclassified road, being a road which has not been classified by the Department as maintainable for use by motor vehicles, or (iÐ a farm road, being a road, or that part of it, which lies within the curtilage of land forming part of a farm, and (b) in the case of a road which is not a highway maintainable at the public expense, such a road to which the public has access; 'þrescribed certificate" means a certificate which - (a) is in the form prescribed in Part 1 of Schedule 2 to the ATC Regulations, (b) has been issued under regulation 15 thereof, and (c) has not ceased to have effect; 'þublic passenger vehicle" has the same meaning as in the Road Transport Act 2001a; "steam vehicle" means a motor vehicle propelled by steam power; "tachograph" has the same meaning as in the Road Traffic (European Agreement) (Crews of Vehicles engaged in International Road Transport) Order 2O03s; 4 2oo1 c.27 5 s¡ ¡oslo¡ 7 "test" means a test of competence to drive; and "works truck" means a motor vehicle designed for use in private premises and driven on a road only - (a) in delivering goods from or to such premises to or from a vehicle on a road in the immediate neighbourhood, or (b) in passing from orle part of any such premises to another part or to other private premises in the immediate neighbourhood, or (c) in connection with road works while at or in the immediate neighbourhood of the site of such works. (2) For the purposes of these Regulations, a motor vehicle shall not be regarded as driven in the immediate neighbourhood of premises or a site unless it is driven on a road for the shortest distance and in any case for a distance not exceeding 600 metres. (3) In these Regulations - (a) references to mopeds in class P, are to a class of mopeds in category P having two wheels; and (b) references to mopeds in class P, are to a class of mopeds in category P having more than two wheels. (4) For the purposes of these Regulations, the date on which a motor vehicle is first used shall be construed in accordance with regulation 3(3) and (a) of the Road Vehicles (Maintenance and Use) Regulations 20026. (5) For the purposes of these Regulations, a category - (Ð which is specified in an entry in column I of the following table is comprised within a category specified in that entry in column 2 or 3; (b) which is specified in an entry in column 2 of that table is comprised within a category specified in that entry in column 3. 6 so a7zloz 8 TABLE (Regulation 3(5)) Calegories comprised within other categories I 2 J A1 A BI B B+E C1 C, or Cl+E C+E D1 D, orDl+E D+E 4. Designation of categories as groups Where a person has within the period of ten years ending on the date of the coming into force of a licence which he has applied for - (a) held a licence; or (b) passed a test authorising the granting ofa licence, being a licence authorising him to drive a vehicle of a category specified in column I of the table in Schedule 2, the classes or descriptions of vehicles specified in relation thereto in column 2 of that table are designated as a group for the purposes of paragraph 2(1)(b) or paragraph 2(2), as the case may be, of Schedule 3 to the Act.
