South East England Regional Assembly Development would not conflict with or prejudice the implementation of the Regional Spatial Strategy (RPG9 and alterations) or the draft South East Plan (March 2006) particulary as the scheme is in South East Water's approved Water Resource Plan. A package of mitigation should be secured. Royal Borough Of Windsor And Maidenhead (No comments received at time of producing this report). Surrey Heath Borough Council No objection subject to BFBC being satisfied that there is no conflict with development plan policies and that the land is restored to its former condition. Natural England No objection as the proposal would not have a significant effect on features of interest of the SSSI involved. National Grid Transco The application has been assessed in relation to the operational electricity and gas transmission network. Given the proximity and sensitivity of the networks of the proposal, the risk is negligible. The Ramblers Association (No comments received at time of producing this report). 4 REPRESENTATIONS 159 petition style objection letters (4 with no address) have been received from residents located within the Martins Heron area and The Warren on grounds of: * Creation of new vehicle entrance into Swinley Forest from Bog Lane/Wareham Road/New Forest Ride junction (could use alternative access) * The creation of compound 6 immediately behind residential properties * Could use Compound 7 * Traffic and road safety issues * Prolonged and intensified noise, air pollution, light pollution and vibration from vehicles using the access point and compound area * Prolonged disruption to Swinley Forest pedestrian access and public rights of way network * Adverse impact upon adjacent SSSI and Wildlife Heritage Sites * Loss of trees * Request conditions restricting hours of work and deliveries, assessment of noise levels, future access to pipeline via existing accesses 4 additional comments and objections have been received in response to consultation on removal of Compound 6: * Welcome removal of compound 6 * Re-iterate concerns regarding the vehicular access from Bog Lane (access M) – highway safety issues using this roundabout and access such as visibility and blind bends, proximity to residential properties and impact upon residential amenities * Potential damage to residential properties due to proximity * Would expect constraints on vehicular movements (condition 3) to be strictly adhered to * Re-iterate concerns regarding loss of trees and shrubbery in the vehicular access location, and would expect replacement planting to be as existing or native species * Would remain opposed to any compound in this location * There are existing access points which could be used as alternatives to Bog Lane such as Blanes Lane and the A322 * Impact upon ecology * If approved request conditions to expand on the hours of construction/delivery to include access from access M, removal of soil from site, deliveries, construction work and no queuing); gate to be removed and planting reinstated, all future access to be via existing accesses and a 24 hour helpline provide [Officer comment: planning permission would be required to create a permanent access, the condition restricting hours of construction and deliveries does include Planning & Highways Committee 20th September 2007 deliveries to access M (as it is associated with the application site), and would also include any works associated with the construction such as removal of spoil. Conditions cannot be included in relation to queuing on the road and requiring a 24 hours helpline to be provided - although this has been included as an informative ]. A response has been received from South East Water in regard to the access onto Bog Lane and Compound 6: * Compound 6 now removed * Access retained onto Bog Lane to allow a temporary vehicular access to the pipeline route during the construction phase (to allow delivery of pipeline and excavated material to be removed). This would utilise the existing vehicular access to Thames Water Ascot Sewage Treatment Works * Access point from Bog Lane will only be used during the temporary construction period with no proposals to create a permanent access * Where reasonably practical, the scheme does allow for use of existing vehicular access into Swinley Forest, however access points between A322 and the railway line have been considered unsuitable, the use of an access south of the railway on the Swinley Road is unsuitable due to restricted visibility, use of Blanes Lane would extend the construction impacts across a wider areas * South East Water will endeavour to keep local residents informed about the commencement and progress of the construction such as letter drops, site notice boards and contact details for the site manager and out of hours helpline numbers A letter raising comments and observations has been received from Chavey Down Association on grounds of: * Impact upon SPA * Traffic (relating to the closure of Priory Road and diversion onto Longhill Road) * Damage to highways * Access, parking and safety – vehicle access to residential and emergency vehicles be maintained, and that suitable alternative parking (proper lighting and security) are provided *
