Explanatory notes to the tariff These notes appear in the Customs Tariff at the beginning of chapter 4. (a) The expression "whole cheeses", as used in sub-heading 04.04 A I(a), shall be taken to apply to whole cheeses of the conventional flat cylindrical shape of the following not weights: - Emmentaler: not less than 60 kgs. but not more than 130 kgs.; - Gruyère and Sbrinz: not less than 20 kgs. but not more than 45 kgs; - Bergkäse: not less than 20 kgs. but not more than 60 kgs.; - Appenzell: not less than 6 kgs. but not more than 8 kgs. (b) The expression "whole cheeses", as used in sub-heading 04.04 E I(b)l(aa), shall be taken to apply to: - whole chooses of the conventional flat cylindrical shape of a net weight of not less than 39 kgs., but not more than 44 kgs.; - cubic blocks of cheese of a net weight of not less than 16 kgs., but not more than 21 kgs. 2. Sub-heading 04.04 A I(b)2 shall be taken to apply only to goods the pickings Cf which bear at least the following particulars: - the description of the cheese; - the at content, by weight, in the dry matter; - the packer responsible - the country of origin of the choose. 3. For the purposes of sub-heading 04c04 D I, the expression "put up for retail sale" shall be taken to apply to cheese of kinds classified under that sub- heading put up in immediate packings of a net weight not exceeding 1 kg., containing portions or slices of an individual not weight not exceeding 100 grs. 4. For the purposes of sub-headings 04.04 A I(a), 1 I(b) and D I, the term "free-at-frontier value" shall be taken to mean the free-at-frontier price or free-on-board price in the country of exportation, plus a lump sura to be ddeterminedin respect of the expenses of delivery to the customs territory of theCommunity. B. IMPORT REGIME

(i) The general régime in force in the Community is that described in document MTN/DP/W/9.

(ii) As explained in the document mentioned above, the Community has entered into a number of commitments with its suppliers. These commitments are of various kinds:

(a) Bindings grantedwithin GATT as a result of negotiations in GATT - Bindings in respect of Emmentaler, Gruyere, Sbrinz, Bergkäse and Appenzell (04.04 A I) satisfying certain specifications in regard to price, quantity and presentation. The free-at-frontier prices as set out in the table below were those which were negotiated, but in the negotiations it was provided that these prices would be automatically adjusted in the light of changes in the price of Emmentaler in the Community. The customs duties charged on these products range from 7.5 to 15 UA/100 kgs.1 This concession benefits all third countries which satisfy the conditions laid down by the Community (submission of certificates); at present, the countries in question are Switzerland, Finland and Austria.

Prom 1 July 1970 the minimum values shall be automatically adjusted to take account of changes in the factors determining the formation of Emientaler prices in the Community. This adjustment shall be by way of an increase or decrease of 14 UA in the minimum values for every increase or decrense of 1 UA per 100 kg3. in the cocoon tarCet price of m1lk in the Conmunity. (d) The Comsnity reserves the right autonomously to reduce the customs duties from 20 UA to 15 UA by raising the value limits by 5 UA. - For Glarus herb cheese, 12 per cent bound duty (04.04 B): this duty is suspended by autonomous concession at 6 per cent.

(b) Autonomous concessions - Processed cheese based on Emmentaler, Gruygre or Appenzell cheese (04.04 D I). The levy applicable to these products is 30 UA/100kgs. subject to observance of a minimum free-at-frontier price (at present not less than 150 UA/100 kgs.). The countries respecting these conditions are Switzerland, Austria and Finland - Cheddar more than nine months old and with a free-at-frontier value of not less than a certain price pegged to the threshold price for Cheddar (the present price is 202 UA/100 kgs.) (04.04 E I(b) la). A levy of 15 UA/100kgs. is charged on this product. - Tilsit, Butterklse and Kashkaval (04.04 E I(b) 2 and 3). The levy is reduced by 40 or 50 per cent if it is shown that the free-at-firontier offer price is not lower than a minimum price. At present, certificates are granted in respect of the following cheeses originating in the countries mentioned: - Tilsit : Switzerland, Austria, Finland, Romania - Butterkäse : Austria - Kashkaval : Romania, Bulgaria, Hungary, Turkey

(a) United Kingdom imports of Cheddar from New Zealand The conditions governing imports of this cheese are laid down in Protocol No. 18 of the Act of Accession. A. DESCRIPTION OF THE REGIME

(i) The general régime applied in the Community is described in document MTN/DP/W/9.

(ii) Agreementsentered into by the Community with two third countries produce certain effects on measures with respect to the export of cheeses: (1) An agreement with Switzerland dated 26 July 1968 concerning the observance of a free-atfrontier price for certain kinds of cheese. The cheeses in question are, in particular, the medium-hard cheeses such as Tilsit, Gouda, Edan, Fontina, Danbo and cheeses like St. Paulin, Esr/Sm, Italico as well as cheeses having a certain water content in non-fatty substances; (2) an agreement with Spain dated 5 June 1970 under which the EEC has undertaken to respect a free-at-frontier price in respect of all cheeses other than soft cheeses. (B) Other measures - Price supplements charged on the following headings: 0404.14 Fr 100 per 100 kgs. gross 0404.28 Fr 80 per 100 kgs. gross 0404.30 Fr 50 per 100 kgs. gross By charging these price supplements it is possible to reduce to some extent the difference in prices between imported and domestic cheeses. Supplementary customs duty of Fr 80 per 100 kgs. gross charged on imports falling within heading 0404.24 in excess of the quantity imported in 1974.

In the absence of conclusive evidence in the form of an approved certificate showing that the dairy products used in the manufacture of imported processed cheese (heading 04.04.30) were obtained in the exporting country itself: supplementary customs duty of Fr 120 per 100 kgs. gross charged on imports falling within this heading. - Agreements with Austria, European Communities and Finland fixing a reference price for the importation of the following cheeses (cx Nos. 0404.22/28): Butterkdse, Danbo, Edam, Elbo, Esrom, Fontal, Fontina, Fynbo, Galantine, Gouda, Havarti., Maribo, Molbo, Mimolette, Samsoe, Saint-Paulin, Tilsit, Tybo, Kartano, Kesti, Korsholm, Kreivi, Luostari, Saaristojunsto-Skargardost, Turunmaa, as well as other cheeses having a water content in non-fatty substances of more than 57 per cent bat not more than 67 per cent. A supplementary duty of Fr 110 per 100 kgs. gross is charged on imports of the above-mentioned cheese varieties from countries to which the above-mentioned arrangements do not apply.

II. Exportrégime

Given the relatively high level of the milk price fixed for producers in Switzerland, cheeses cannot always be sold either in .the domestic market or in foreign markets at prices covering the cost of production. The sale of these products consequently results in losses, which are covered by public funds and in part by a contribution by the producers themselves (Dairy Accourt of the Confederation). This policy does not involve any undercutting nor does it have the result that prices of Swiss products are lower than the prices of equivalent foreign products, whether in the domestic market or in export markets. The range of cheeses exported by Switzerland that are covered by the system described above is very small:
