1.0 Introduction 1.1 Project Background and Description To improve the quality and reliability of service in the power distribution system networks in the State of Madhya Pradesh, the Government of Madhya Pradesh (GoMP) has taken initiatives to invest in the power sector availing financing assistance from the Asian Development Bank (ADB) as development partners. The investments involve expansion, upgrading and reconfiguration of the existing power distribution system improvement in central Madhya Pradesh (Figure: 1.1).

Figure 1.1: MP DISCOM-Central Jurisdiction The proposed investments are necessary to: (i) facilitate increased power transfers to accommodate increased demand and economic growth; (ii) improve supply-side energy efficiency by system de-bottlenecking and reducing technical losses; (iii) reduce the intensity of greenhouse gas (GHG) and other emissions via improved system efficiency; (iv) support expanded private sector participation in distribution system operations and other energy services; and (v) facilitate poverty reduction via improved electricity services and economic growth.

This social monitoring report provides information pertaining to the project for the period January to June 2018. The report is prepared by Environmental Planning and Coordination Organization [EPCO], Bhopal, Department of Environment, GoMP) for MP DISCOM-Central.

The project is categorized as “B” for Involuntary Resettlement (IR) and “C” for Indigenous Peoples as per the ADB’s SPS. The core principles are consistent with the standards of the original safeguards documents and loan covenants. The RP covers the involuntary resettlement impact caused by the project activity.

The main features of the project of DISCOM – Central under this loan includes:

 Distribution system improvement (i) Construction of 88 new 33/11 KV substations; (ii) Installation of 473.52 km of 33 KV and 201.86 km of 11 KV distribution Lines; (iii) Installation of 331 No.s Capacitor Bank and (iv) Construction of 22 No.s Control Room buildings  Capacity building for the executing agency staff

It is being implemented by DISCOM-C Bhopal under ADB Loan no. 3066.

1.2 Purpose of the Report The report captures the overall social safeguards implementation progress in compliance to project’s Resettlement Framework and regulatory requirements. The various social safeguard related issues addressed during the reporting period has also been covered, with reference to the progress achieved and current status of reporting period. The current report covers the implementation progress of social safeguards during January to June 2018.

2.0 Project Resettlement Entitlement, Assistant & Benefits 2.1 Introduction In accordance with the R&R measures suggested for the project, all affected households and persons will be entitled to a combination of compensation packages and assistance depending on the nature of ownership rights on lost assets and scope of the impacts including socio- economic vulnerability of the affected persons and measures to support livelihood restoration if livelihood impacts are envisaged. The affected persons will be entitled to the following five types of compensation and assistance packages: i. Compensation for crops/ trees at their replacement cost; ii. Compensation for structures (residential/ commercial) and other immovable assets at their replacement cost, if any;

iii. Assistance in lieu of the loss of business/ wage income and income restoration assistance;

iv. Rebuilding and/ or restoration of community resources/facilities, if affected by the project.

2.2 Cut-off Date for Entitlements Affected persons meeting the cut-off date requirements will be entitled to a combination of compensation measures and assistance, depending on the nature of ownership rights of lost 2

assets and scope of the impact, including social and economic vulnerability of the affected persons. For title holders, the date of notification vide Section 4(1) of LA Act will be treated as the cut-off date, and for non-titleholders the start date of project census survey i.e. July 19, 2013 will be the cut-off date. Unforeseen impacts will be mitigated in accordance with the principles of this RP.

2.3 Entitlement Matrix The Entitlement Matrix in Table 2.1 summarizes the main types of losses and the corresponding entitlements in accordance with the NRRP and ADB policies.

3.0 Project Implementation Status & Social Impact

As per the updated work of DISCOM-C, the power distribution system improvement project under ADB Loan No 3066 IND includes construction of 88 New 33/11 KV Substations and installation of 473.52 km 33 KV and 201.86 km 11 KV distribution lines, installation of 331 Capacitor Bank in the existing substations (Annexure-I).

3.1 Status of Implementation (As on June 2018)

With regards to sub project, the works are almost completed while, the implementation of works newly added in the updated scope of work is under progress (Annexure-I). The overall progress of this project during the reporting period (January to June 2018) includes - total 87 No.s new substations have been constructed and 436.5 km of 33 KV & 175.36 km of 11 KV distribution lines have been laid down. Similarly, all 331 No.s Capacitor Banks have been installed & commissioned in the existing substation of Bhopal & Region as per the scope of work (Table 3.1).

3.2 Overview of Social Impacts

The legal framework and principles adopted for addressing resettlement issues in this project have been guided by the existing legislation and policies of the Government of India, the Government of Madhya Pradesh, and by the involuntary resettlement policy of Asian Development Bank stated in the ADB’s Safeguard Policy Statement (2009).

The Resettlement Plan for distribution system improvement project under ADB Loan No 3066 IND is updated in June to August 2018 by DISCOM-C and submitted for approval of ADB. However, during the social monitoring (January to June 2018) of the project it has identified that no social impacts due to project implementation, i.e. there was no requirement of private land for project sub-components of the project.

All the 88 New 33/11 KV Substations (including 13 No.s New Substations added in the updated scope of work) are located on government land. The land allotment approvals of Revenue Dept. received by the MPPKVVCL through Govt circular no-F-6-25/2010/7/Nazul, Bhopal, dated 18th August 2010 (Annexure-II). Additional work of installation of permanent 100 KVA DTR to replace temporary rental distribution transformer & associated 11 KV & LT distribution lines will not require land acquisition, it will be executed along the road & avoid farming areas.

The distribution lines of 33 KV (total - 473.52 km) and 11 KV (total – 201.86 km) & LT line are double pole based and distribution lines mainly follow the road right of way (RoW). The project is not likely to cause any impact on forest or forest dwelling communities. Additionally, wherever the distribution lines passes through the agriculture land, care has been taken to place the pole on the plot edges to avoid impacts on the land. Therefore the project has no resettlement impacts due to the implementation of its components.

4.0 Compensation All subproject components are implemented on Government land only and there was no requirement of private land for project. All the Substations are located on government land. There was no impact due to erection of poles for distribution lines by DISCOM-C. The distribution lines mainly follow the right-of-way of roads, canals and agriculture hedge etc. As a result, poles and distribution lines will have no impact on land and other assets. So, the payment of compensation is not trigger in sub project.

5.0 Public Consultation and Disclosures 5.1 Consultation The implementation of R&R activities is a multifaceted task demanding constant monitoring during various stages of implementation. Consultation with the stakeholders during various stages of project is necessary due to dynamics at different stakeholder level that might create more challenges for the program implementation. A regular consultation with affected persons is necessary to ensure their participation, identify problems, create ownership of the program and smooth sailing of the project. Photographs of site visits and Attendance list of people who participated in consultation process is given in Annexure III are given in Annexure IV.

During this reporting period, site visits were undertaken for holding direct consultations with affected persons if any. The main objective of the site visits were to check the implementation of R&R activities and affected persons with damage of land if any. Public consultation was organised at various project location of substation and distribution lines.

The key findings of the consultation meetings were:

 People were generally supportive and aware of the project but wanted construction activity to be completed during non cropping season and between harvests.  People usually wanted to know about the compensation to be paid to APs if any.  People wanted to receive regular updates about the upcoming implementation activities and schedule.  Affected persons were satisfied in general and were willing to support the project.

5.2 Disclosures To ensure transparency in planning and active involvement of APs and other stakeholders, the project information, draft Resettlement Plan report will be uploaded on the official website of the EA and ADB. The final resettlement plan will be uploaded after the final approval from ADB. The summary of the final RP will be made available in vernacular language. The official of IA will continue interaction with affected persons if any and information dissemination through consultation will continue throughout Investment Program implementation period.

6.0 Grievance Redress Mechanism The Grievance redress committee (GRC) is set up by DISCOM-C - PMU and consists of representatives from the local Panchayat Head, a District Revenue Commissioner, representative from the EPC Contractor(s) only during construction phase, designated staff of DISCOM-C - PMU on safeguards, Manager/Director of DISCOM-C - PMU, and a witness of the complainant/affected person if any.

Responsibilities: The GRC is expected to: (i) resolve issues on land acquisition (if any), compensation to temporary damages to crops and plants, and other use of land such as borrow areas for distribution lines and substations; (ii) convene twice a month to review complaints lodged (if any), (iii) record the grievances and resolve the issues within a month (30 days) from the date the grievance was filed, (iv) report to the complainant(s) the status of grievance resolution and the decisions made. So far, no compliant/ issue related to loss of crop/tree and damage of land was received for the local resident in or near the project site location.

Cumulatively till end of reporting period, there is no affected person/ local resident allege for the loss of their standing crops and land damaged due to this project was recorded.

Procedures: Minor grievances on compensation or environmental issue during construction will be resolved onsite through the EPC Contractor(s) Project Site Engineer. As a formal process of grievance resolution, the procedure is described below.

(i) Affected persons (APs) are informed in writing by MP DISCOM-C - PMU (or designated representative) of the damages and entitlements for compensation. If the APs are satisfied, compensation can be claimed from MP DISCOM-C - PMU through the EPC Contractor(s). If the APs are not satisfied, they can request for clarification from MP DISCOM-C - PMU. If the APs are not convinced with the outcome, they can file the grievance to the GRC with the help of MP DISCOM-C - PMU who will provide the written documentation.

(ii) The GRC conducts a hearing of the grievance in the presence of the APs and will provide a decision within 15 days from the receipt of the complaint. Minutes of the meeting are approved by MP DISCOM-C - PMU and provided to the APs including the decision made by the GRC. If the APs are satisfied with the GRC decision, they can claim the compensation from MP DISCOM-C - PMU and/or EPC Contractor(s). Records of all grievances received for the subprojects are summarized region-wise in Table 6.1.

To ensure that public grievance and/or complaint on environmental (and social) issues are addressed during the implementation of the power distribution system improvement project, the PMU of DISCOM-C has constituted Project Grievance Redress Mechanism vide Order No. MD/ MK/ 01/ Estt./ RI-01/ 9229 dated 20.10.2014 to ensure APs’ grievances regarding Environmental/Social safeguard related matters are addressed and to facilitate timely project implementation (Annexure-V & VI). The Project GRC meeting has been conducted regularly on monthly basis at each circle. However, no complaint received/ registered so far.

Ashoknagar O&M 7.0 Institutional Arrangements The Madhya Pradesh Madhya Kshetra Vidyut Vitaran Company Limited (MPMKVVCL) or Madhya Pradesh Central Power Distribution Company Ltd (MP DISCOM-C) serves as the 8 executing agencies (EAs) and implementing agencies (IAs) for the project. DISCOM-C has established project management units (PMUs) to implement the ADB loans in Madhya Pradesh Power Sector Program. Field level staff/engineer is deputed at divisional level who are primary responsible for the environmental and social assessment as well as implementation of RPs for their respective components. Keeping in view the capacity of DISCOM-C and its existing PMU, the DISCOM-C has established project management units or Environmental and Social Management Unit (ESMU) has been reconstituted headed by the Project Director (ADB) / Nodel Officer-PMU and Environmental Specialist with five other technical members The constitution of Environmental & Social Management Unit (ESMU) has strengthened the Environmental & Social Safeguard Monitoring Activities (Annexure-V). The PMU is designated as social development specialist within the PMU along with other engineering units to address the social and resettlement issues of the program and for Resettlement Plan implementation, PMU is responsible for overall coordination, preparation, planning, implementation, and financing. The EA ensures that key institutions including local governments are involved in RP updating and implementation. The PMUs are responsible for managing the site activities related to safeguards and to work closely with the field level staff.

8.0 Monitoring and Evaluation Monitoring is the responsibility of the EAs/IAs. Regular monitoring activities are carried out internally by DISCOM-C and their PMUs to assess resettlement implementation progress and identifying potential difficulties and problems. RP implementation is closely monitored through internal monitoring arrangements, to assess resettlement progress and identify potential difficulties and problems.

DISCOM-C monitors the progress of implementation of safeguard plans, verifies the compliance with safeguard measures and their progress toward intended outcomes, documents and discloses monitoring results identifies necessary corrective and preventive actions in the periodic monitoring reports and submits periodic monitoring reports (bi-annual) on safeguard measures as agreed with ADB. PMU will be responsible for managing and maintaining affected person databases, documenting the results of the affected person census. Semi-annual monitoring reports documenting progress on resettlement implementation and resettlement plan completion reports will be provided to ADB for review.

During this reporting period the consultant has visited various project sites to conduct field visits and to scrutinize overall implementation of social and environmental measures of the project. Monitoring and evaluation reports documenting progress on resettlement implementation and RP completion reports will be provided bi-annually by the PMU to ADB for review.

9.0 Conclusion The allotment of government waste land is completed for construction of 88 substations and the construction and commissioning of New 33/11 KV Substation work is almost completed (98.28%). The sub-stations sites are all government wasteland and do not cause any impact on standing crop and agricultural land. Similarly, 87.96% of 33 KV Line and 80.73% of 11 KV distribution line was laid down. In case of distribution lines, contractor has carried out project works during post harvesting period of crop, so as to minimize impact on standing crop and agricultural land. The single/double-pole distribution line has not caused any impact on land.

The distribution lines mainly follow the road/canal ROW for which they obtain permission. Wherever it passes through agricultural land there is no impact on the land. The distribution line not passes through any Reserve/ Protected forest area. The DISCOM defines the ROW for distribution on the basis of a walk-over survey. The local community, representatives of rural local body are present in the walk-over survey.

During this reporting period, there is no issue or case related to loss of crop/ trees cutting/ felling and damage of land was observed. The project will have no involuntary resettlement and no physical or economic displacement of people. All the proposed substations of the project are built on government waste land. As there is no private land acquisition for the project so, the impacts associated with land acquisition are deemed to be minor. No permanent loss of livelihood is foreseen.

Executing Agency is closely monitoring and coordinating with respective departments to expedite RP activities implementation and resolving of any social issues, to complete all social safeguard activities.
