Arising from Item 4 Councillor Currie asked if the issues at Bruichladdich Pier had been investigated . Peter Bain stated he would enquire and report back to a future meeting of the Area Committee.

Arising from item 5 Councillor Kelly asked if there had been any feedback from Chief Inspector Millar regarding the CCTV at Aqualibrium as the Kintyre Crime Prevention Panel are keen to pursue this. Sergeant Baillie confirmed she would check and it would be reported back to the next Area Committee.

Arising from Item 9 Councillor Kelly stated Colin Hossack had not yet supplied the information on Bengullian to Members. It was agreed Deirdre Forsyth would chase this up.

Arising from item 11 it was noted that that this job has still not been advertised due to new procedures which are in place. It was agreed that Deirdre Forsyth would speak to Alison Debling, the Leadership Support Officer, to clarify this procedure.

7. MINUTES OF MID ARGYLL PARTNERSHIP MEETING OF 21 FEBRUARY 2006

The minutes of the Mid Argyll Partnership meeting of 21 February 2006 were noted.

8. CALL MANAGEMENT - PRESENTATION BY STRATHCLYDE POLICE

Sergeant Baillie, Argyll and Bute Council’s Local Authority Liaison Officer, gave an interesting and informative presentation to the Committee about Strathclyde Police’s new call management system. She advised the Committee that if they receive queries from their constituents, they should pass them on to Strathclyde Police.

Decision

1. The Committee thanked Sergeant Baillie for the information on call management.

2. It was agreed that there would be a further report in a few months time.

9. PUBLIC QUESTION TIME

Councillor McAlpine informed the Group that at the meeting of the Roads Liaison Group with Argyll and Bute Council, Strathclyde Police and BEAR on 8 March 2006, it was agreed that Tarbert Road Crossing be taken off the agenda. He asked for a written explanation from the police as to why this has happened. Sergeant Baillie advised that Inspector Sutherland was the appropriate contact for this and agreed she will bring it to his attention.

Councillor Currie then asked Sergeant Baillie to advise the Chief Constable that the comments made by Jamie McGrigor MSP, that there should be a full time police presence on Colonsay, does not reflect the local views from Colonsay who consider such a presence to be unnecessary and a waste of money. Sergeant Baillie agreed to pass this on.

10. PLANNING APPLICATIONS

The Committee considered and dealt with the applications for planning permission as detailed below.

065/00352/OUT Mr and Mrs J Brolly. Outline. Erection of two dwellings. Land east of Torbreck, Ford.

Decision

The Committee agreed that a PAN 41 hearing be held prior to the determination of the application, in view of the number of representations received. This hearing will be held on Tuesday 2 May 2006 at 2pm.

12. GRUINART FLATS SPECIAL PROTECTION AREA FOR BIRDS

The Scottish Executive has invited the Council to respond to a proposal to add an additional qualifying interest to a designated Special Protection Area for Birds as a Special Area of Conservation (SAC) under the European Union Habitats Directive. The Council’s views are to be sent to Scottish Natural Heritage (SNH) who are undertaking the consultation process, the results of which will be sent to the Scottish Ministers.

Decision

That the Council will not raise objections to the inclusion of an additional bird species as a qualifying interest in the existing Special Protection Area.

13. CAMPBELTOWN FLOODING

The Committee were informed of progress on issues affecting the Council which relate to Scottish Water’s ongoing sewerage infrastructure works in Campbeltown.

Decision

The Committee agreed:

1. To note the contents of the report.

2. To instruct the Head of Roads and Amenity Services to confirm with Scottish Water that there will be insufficient funding available to finance Low Askomil promenade option.

14. REVENUE AND CAPITAL ROADS BUDGET 2006/2007

The Committee considered a report containing the proposals for the Revenue and Capital budgets for the road network for 2006-2007.

Decision

The Committee noted the contents of the report.

15. PROPOSED FORTNIGHTLY DOMESTIC REFUSE COLLECTION TRIAL - ISLAY AND JURA

The Committee were informed members of a proposed fortnightly refuse collection trial on Islay and Jura. The principle for the trial areas was given approval at the Strategic Policy Committee on 19 January 2006 subject to reports to relevant Area Committee.

Decision

The Committee agreed:

1. To approve a proposed trial on Islay and Jura for a fortnightly general refuse collection service uplift alternating with garden waste uplift.

2. With the increased garden wate composting provision, the likely implementation at Gartbreck waste disposal facility of a pollution Prevention Control permit (PPC) and commercial misuse, the unmanned civic amenity skips be removed.

3. That there should be discussions with the community on the implementation of the foregoing issues.

16. SCOTTISH WATER INVESTMENT PROGRAMME

The Committee were updated on the ongoing discussion with Scottish Water in connection with their investment programme with regard to Quality and Standards Programme (Q&S) 3 and their Growth Programme with regard to Development Constraints.

Decision

1. The Area Committee endorsed the priorities contained in Appendix A, with the following amendment –

2. It was agreed that Scottish Water should be asked what their levels of leakage are throughout the area, and whether these could be addressed in order to help to remove development constraints.

3. It was agreed that Scottish Water should be asked why Gigha, Craighouse and Minard are not included in Scottish Water’s priorities since they are already the subject of development constraints.

4. It was agreed that Scottish Water be asked whether the recent mains water connection to Defence Estates Machrihanish has added to the Campbeltown water supply constaints.

5. It was agreed that Scottish Water be asked to work with Council officers through a local network group.

Civic Government Hearing Hearing to consider variation of Late Hours Catering Licence Elaine Munro, Hillview, 14 Kintyre Gardens, Campbeltown.

Councillor McKinlay welcomed everyone to the Hearing and explained the procedure. Elaine Munro holds a late hours catering licence, which permits her to trade between the hours of 11.00pm and 2.00am at the locations specified in the licence. She now seeks a variation to the licence so that she can continue to serve any customer who joined the queue at her van before 2.00am.

Evidence was led by Elaine Munro and Strathclyde Police.

Motion

That the conditions on the licence remain the same at 11.00pm to 2.00am.

Moved by Councillor McKinlay, seconded by Councillor Colville.

Amendment

That the licence be amended to allow the applicant to trade between the hours of 11.00pm and 2.30am.

(A ) THE APPLICATION

(i) Development Requiring Express Planning Permission:

• Site for the erection of a dwellinghouse (details reserved); • Installation of septic tank and soakaway (details reserved).

(ii) Other Aspects of the Development:

• Water connection to be to existing public main.

(B) RECOMMENDATION

It is recommended that planning permission should be refused for the reason set out in this report.

(C) DETERMINING ISSUES AND MATERIAL CONSIDERATIONS

This is a proposal for a dwelling to be situated on a bare land croft which is located approximately one kilometre to the north of Port Charlotte. Development plan policy and the Council’s ad hoc policy on croft land supports the development of croft houses on bare land crofts, provided that there are no adverse servicing or access constraints.

The site is accessed by a lengthy private way which emerges onto the public road between walls on either side. Visibility at this point is very deficient, being of the order of 50 metres in either direction whereas the Council’s normal standards would require 160 metres. As land on either side of the access is in separate ownerships to that of the applicant, and the applicant is unable to secure agreement to any improvement of either geometry or visibility at the access point, the Area Roads Engineer recommends that the application be refused on road safety grounds. With the exception of access considerations, the proposal is acceptable in other respects.

There are no other objections from consultees or third parties. Despite the Council’s support for the development of croft houses on croft land, the proposal does not accord with development plan policy insofar as a safe means of access cannot be achieved, and intensification of use of this sub-standard junction would be detrimental to the interests of road safety.

REASON FOR REFUSAL RELATIVE TO APPLICATION 05/01530/OUT

1. The proposal is for the erection of a dwelling on a bare land croft which is accessed via a private way from the A847. Visibillity at the junction of this private way with the public road is impaired by the presence of stone walls and vegetation on land outside the applicant’s control; with available visibility being of the order of 45 metres to the south and 60 metres to the north, whereas the Council’s normal standard for a derestricted road would require minimum visibility splays of 160 metres to be achievable in either direction. Additionally, there is insufficient land within the applicant’s control to enable the geometry of the junction to be improved sufficient to enable two vehicles to pass each other at the access point clear of the public road which would be desirable prior to any intensification of use of this access. The proposal therefore conflicts with Policy STRAT 4A of the Islay, Jura and Colonsay Local Plan (1st Review and Alteration) 1988, in that it would entail development in the countryside with inadequate servicing arrangements, involving the intensification of use of a sub-standard junction with a classified road, to the detriment of road safety.

APPENDIX RELATIVE TO APPLICATION 05/01530/OUT

A. POLICY OVERVIEW

Argyll and Bute Structure Plan 2002

STRAT DC 5 – Development in Sensitive Countryside

A) Within Sensitive Countryside encouragement shall only be given to small scale infill, rounding-off, redevelopment and change of use of building development or to single dwellinghouses on bareland crofts or single additional dwellinghouses on individual crofts subject to consistency with STRAT AC 1 C).

B) In special cases …

C) Developments which do not accord with this policy are those outwith A) and B) above and those with incongruous siting, scale and design characteristics or resulting in unacceptable forms of ribbon development or settlement coalescence.

D) Developments are also subject to consistency with other policies of the Structure Plan and in the Local Plan.

STRAT AC 1 – Development in Support of Farms, Crofts and Estates

Subject to development being consistent with sustaining the key environmental features and the operational integrity of agricultural units, croft land and estate land, encouragement shall be given to:

C) The principle of a single dwellinghouse on appropriate sites on bareland crofts is supported by this Plan. On crofts with existing dwellinghouse(s), a single additional dwellinghouse accords with this policy subject to its occupation being for crofting purposes. In all cases, development which results in an undesirable break-up of crofts and croft land assets is not supported by this plan.

Islay, Jura and Colonsay Local Plan (1st Review and Alteration) 1988

STRAT 4 – A presumption in favour of single or small scale residential development in the countryside.

STRAT 4A – All proposals for single or small scale residential development in the countryside will be examined in terms of infrastructure and servicing implications and in scenic areas and coasts careful consideration will be given to the design, setting and scale of development.

Council ad hoc Croft House Policy 1998

Sets out a presumption in favour of building a house on a bareland croft.

Argyll and Bute Local Plan (Finalised Draft) 2005

P/DCZ 5 – Sensitive Countryside Areas and Boundaries - identifies the site as being within ‘sensitive countryside’ for the purposes of Structure Plan policy STRAT DC 5

Policy HO 1 – establishes situations in which there is a presumption in favour of housing development, including inter alia B.5 the development of a house on a bare land croft, subject to there not being any unacceptable servicing or access impact. However, this policy is currently subject to adverse representation which does not allow it to be a material consideration in respect of the current application. .

B. OTHER MATERIAL CONSIDERATIONS

(i) Site History

There is no relevant planning history in respect of the current application site.

(ii) Consultations

• Highlands and Islands Airports (10.08.05) – No objections.

• RSPB (15.08.05) – No objections.

• SEPA (23.08.05) – No objections subject to a note to the applicant.

• Scottish Natural Heritage (29.08.05) – No objections.

• Area Roads Manager (08.09.05) – Recommends that the current application be refused on road safety grounds. The existing access arrangements onto the public highway are substandard with existing visibility splays allowing for 60m to the north and 45m to the south. It is the consideration of the Area Roads Manager that visibility splays of 215m are required in both directions are required in addition to an improvement to the geometry of the bellmouth. This cannot be achieved using land within the applicant’s control and therefore it is appropriate that permission be refused.

• West of Scotland Archaeology Service (28.10.05) – No objections subject to an identified area of archaeological interest within the croft being safeguarded from the impact of development.

• Crofters Commission (06.04.06) – No comments.

• Scottish Water – No response to date.

(iii) Publicity

The proposal has not required to be publicised. No letters of representation have been received to date.

(iv) Assessment

The application relates to a bareland croft located in the wider Islay countryside, within which the provisions of STRAT 4 and STRAT 4A of the adopted Islay, Jura and Colonsay Local Plan (1st review and alteration) 1988 set out a general presumption in favour of single and small scale residential development, subject to environmental, infrastructure and servicing implications.

In respect of the emergent ‘Argyll and Bute Local Plan’ (Finalised Draft) 2005, the application site is located within an area designated as ‘Sensitive Countryside’ wherein the provisions of policy STRAT DC 5 of the Argyll and Bute Structure Plan 2002 seeks to resist development of open countryside. It is noted that an exception may be made to this restriction where the application site relates to the erection of a dwelling on a bareland croft which meets the requirements set out under policy STRAT AC 1. No representations have been lodged in respect of the proposed designation of this land as ‘Sensitive Countryside’ as part of the local plan public consultation process, and it is therefore appropriate to give this aspect of emergent policy due weight in the determination of this application.

Locational/Operational Requirement:

The applicant has not submitted a specific claim of locational or operational need in respect of the current application. However, it is noted that the application site forms part of a bareland croft wherein there is, under the provisions of the Council’s ad hoc Croft House Policy and policy STRAT AC 1 of the Argyll and Bute Structure Plan 2002, a presumption in

favour of the erection of a dwellinghouse to be occupied for crofting purposes. The applicant has indicated that he would be prepared to enter into a Section 75 Legal Agreement tying the proposed dwellinghouse to the remaining croft land. Such an agreement would be required in order to underpin the crofting justification for a development within an open countryside site in an area of ‘Sensitive Countryside’, and to prevent further croft sub- division and possible future claims for additional dwellings.

Economic Benefit:

None, other than that associated with construction.

Environmental Impact:

The application site is an open countryside site set back approximately 600m west of the public highway at the transition point between gently rising land and a steeper slope to the west. An existing single storey dwelling is located some 170m to the north west at the top of the steeper slope and a 1½ storey dwelling sits at a similar level on the slope (as the application site) some 140m to the south of the application site. The application site is open to view from the public highway to both the north east and south east. The application site is generally screened from view to the east by two existing dwellinghouses located either side of the junction of the private way which serves the site.

The application site is located within an area designated as ‘Sensitive Countryside’ in the emerging local plan which indicates that the capacity for further development in this area is constrained; the principle concern in this area being to prevent the coalescence of the settlements of Port Charlotte and Bruichladdich. It is considered that the erection of a single or 1½ storey dwellinghouse of traditional design and finishes would be consistent with the existing dispersed settlement pattern of the surrounding area and would not appear as either a prominent or incongruous feature within the existing landscape setting, also given the crofting justification for the development of this open countryside site, approval of the current application would not set a precedent for further development in this area of constrained capacity and as such would not significantly erode the area of ‘open’ countryside which separates the settlements of Port Charlotte and Bruichladdich.

Effect on the Conservation of Natural and Heritage Resources:

The application site is located within the SSSI and SPA area which is classified for its internationally important populations of chough, hen harrier, corncrake, Greenland white-fronted goose, Greenland barnacle goose, whooper swan and common scoter. Scottish Natural Heritage have advised that the current application is unlikely to significantly affect any qualifying feature either directly or indirectly and that there is scope for a housing site within the croft. European legislation requires that the Council should carry out an ‘appropriate assessment’ in respect of development sites within SPA’s. The absence of any objection to the proposal from Scottish Natural Heritage and from the RSPB on nature conservation grounds is material to such an assessment, and it is concluded that the SPA qualifying interests would not be prejudiced by the proposal. Scottish Natural Heritage has indicated its wish to be consulted in the case of any reserved matters application, when precise siting would enable their interests to be assessed further

The West of Scotland Archaeology Service advise that a site of archaeological interest is partly located within the boundaries of the croft. No objections are raised to the proposal provided that no development is undertaken within the identified area and that no development commences on site until such time as the identified area has been safeguarded from development activities by the erection of a fence. The affected area only relates to a small part of the croft and its preservation would not preclude development of a single dwelling.

Infrastructure and Servicing Implications:

The application site is served by an existing private way which serves four existing dwellinghouses. The Area Roads Manager has advised that the junction of the existing private way and the public highway is substandard in respect of both the access geometry and visibility afforded to drivers exiting onto the public highway and as such is not suitable to

accommodate further development without being upgraded. At present, the visibility at the junction is severely affected by stone boundary walls and vegetation on private land on both sides of the junction. Visibility to the south is presently 45 metres and 60 metres to the north. The Area Roads Manager has specified that given likely traffic speeds on this stretch of road visibility splays of 160 metres in both directions are required; although it should be noted that standards actually prescribe 215 metres for derestricted roads. It is also considered desirable that intensification of the access point should involve alteration of the geometry of the junction to provide sufficient room for two vehicles to pass each other clear of the public road. This would avoid stationary vehicles having to stand on the public road waiting to turn right whilst another vehicle was travelling down the access towards the public road.

The provision of such junction improvements would require the setting back of the stone boundary walls on either side of the junction and would involve land in private ownership which is outwith the application site and outwith the control of the applicant. The applicant has indicated that the third parties with control over the land necessary to implement the required visibility improvements would not be amenable to the setting back of the existing boundary wall, and as such, the applicant is unable to provide any significant improvement to what is an existing dangerous access onto the public highway. The Area Roads Manager is of the view that it would not be appropriate to approve further development which would intensify the use of the existing substandard access and recommends that outline planning permission be refused for reasons of road safety.

(C) DETERMINING ISSUES AND MATERIAL CONSIDERATIONS

This application seeks approval in principle for the development of a dwelling at Largiemore Farm to the north west of Kilkenzie, Campbeltown. The locality is subject to the Campeltown ‘Catchment Area’ established by Policy STRAT 4 of the adopted local plan, which removes the general presumption in favour of development in the open countryside.

The site now lies within a ‘rural opportunity area’ delineated by the 'Argyll & Bute Local Plan' (Finalised Draft) 2005. There are no objections to the disposition of ‘rural opportunity areas’ in Kintyre, nor are there objections to this application from consultees or third parties. It is therefore appropriate to grant permission as a ‘minor departure’ to the adopted plan, according weight to the more recent expression of Council policy given in the emergent plan.

CONDITIONS AND REASONS RELATIVE TO APPLICATION: 06/00208/OUT

4. Any details pursuant to Condition 1(a) above shall show a dwelling of local traditional design and finish which shall incorporate the following elements:- (i) The dwelling shall be single storey in height. (ii) The window openings shall have a strong vertical emphasis. (iii) The walls shall be finished in a recessive coloured wet dash render / smooth coursed cement render / natural stone. (iv) The roof shall be symmetrically pitched to at least 37 degrees and be finished in natural slate or a good quality substitute slate. (v) The building shall be of a general rectangular shape and gable ended. (vi) Any porches (which are encouraged in the design) shall have traditional "peaked" roofs. (vii) Details of the proposed finished floor level of the dwelling relative to an identifiable fixed datum located outwith the application site.

Reason: In the interests of visual amenity, to reflect/retain the vernacular building traditions of the area and the existing settlement pattern, and in order to protect the setting of a Scheduled Ancient Monument.

5. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Scotland) Order(s) 1992, (or any Order revoking and re-enacting that Order(s) with or without modifications), nothing in Article 3 of or Schedule 1 to that Order, shall operate so as to permit, within the area subject of this permission, any development referred to in Parts 1 and Classes 1,2 and 3, and in Part 2 and Classes 7 and 9 of the of the aforementioned Schedule 1, as summarised below:

PART 1: DEVELOPMENT WITHIN THE CURTILAGE OF A DWELLINGHOUSE Class 1: The enlargement, improvement or other alteration of a dwellinghouse. Class 2: Any alteration including enlargement to the roof of a dwellinghouse. Class 3: The provision of any building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwellinghouse or the maintenance, improvement or other alteration of such a building or enclosure.

PART 2: MINOR OPERATIONS Class 7: Gates, fences, walls and other means of enclosures. Class 9: Stone cleaning and exterior painting of any building work.

No such development shall be carried out at any time within these Parts and Classes without the express grant of planning permission.

Reason: To protect the area and the setting of a Scheduled Ancient Monument within the locality of the proposed dwellinghouse from unsympathetic siting and design of developments normally carried out without planning permission; these normally being permitted under Article 3 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992.

6. Any details pursuant to Condition 1 above shall include details of a scheme of boundary treatment, surface treatment and landscaping works. Details of the scheme shall include:

• Location and design, including materials of any walls, fences and gates; • Surface treatment of means of access and hardstanding areas.

The dwellinghouse shall not be occupied until the approved boundary treatment, surface treatment works have been undertaken in accordance with the duly approved details.

Reason: To ensure the implementation of a satisfactory scheme of boundary, surface and landscape treatment required in order to protect the setting of a Scheduled Ancient Monument and to integrate the proposal with its surrounds.

7. Any details pursuant to Condition 1 above shall include the provision of parking and turning for two vehicles within the application site. Thereafter the required parking and turning arrangements shall be implemented in accordance with the duly approved details prior to the occupation of the dwellinghouse.

Reason: In the interests of road safety.

8. No development shall commence on site until the first 5m of the private access serving the site from its junction with the public highway has been surfaced, to a specification to be agreed in writing in advance with the Area Roads Manager, to the satisfaction of the Council as Planning Authority.

Reason: In the interests of road safety.

9. Prior to the commencement of works on site investigations shall be carried out by a suitably qualified Environmental Consultant to investigate fully the extent and scope of ground contamination within the site, and a report addressing this issue shall be submitted for the approval of the Council as Planning Authority, in consultation with the Council’s Head of Public Protection. In the event that contamination is identified, then this report shall include details of remedial measures and disposal methods of the contaminated material which shall be removed in accordance with the methodology for doing so agreed in writing with the Council as Planning Authority to its satisfaction prior to the commencement of construction works on site.

Reason: In the interests of public health, as the site may be contaminated as it includes an area of made-up ground of unknown infill material and in order to ensure that any contamination is removed appropriately.

10. Prior to the development commencing a full appraisal to the satisfaction of the Council as Planning Authority of the quantity, quality and adequacy of the private water supply to serve the development, including the means to do it shall be carried out by a qualified hydrologist in consultation with the Council’s Head of Public Protection and the proposed works in relation to water provision shall first be agreed in writing by the Council as Planning Authority. Furthermore the development itself shall not be occupied until the required works have been provided to the satisfaction of the Planning Authority.

Reason: In the interests of public health and in order to ensure that an adequate private water supply in terms of both quality and quantity can be provided to meet the requirements of the proposed development.

• Development Plans (20.02.06) - The application site lies within a proposed Rural Opportunity Area (ROA) identified in the Finalised Draft Local Plan. There have been no specific representations received in respect of this particular ROA or of the site itself.

• NATS (27.02.06) – No objections.

• Area Roads Manager (15.03.06) – No objections subject to conditions in respect of access geometry, visibility, and onsite parking and turning facilities.

• Area Environmental Health Manager (24.03.06) – No objections subject to conditions in respect of the investigation and remediation of contaminated land and also to ensure the adequacy of the proposed private water supply.

• Historic Scotland (31.03.06) – No objections subject to conditions in respect of siting, design and finishes of the proposed dwellinghouse and a restriction of ‘permitted development’ rights for the provision of additional outbuildings in order to minimise the impact of the development upon the setting of a nearby scheduled ancient monument.

• West of Scotland Archaeology Service (11.04.06) – No direct archaeological issues as the ground concerned has already been heavily disturbed by former quarrying operations. Concern is however raised in respect of the potential impact of the development upon the setting of a nearby scheduled ancient monument.

(iii) Publicity

The application has been advertised as a ‘potential departure’ to the provisions of the approved development plan, (closing date 17th March 2006). No letters of representation have been received.

C. ASSESSMENT

The site lies within the Campbeltown Catchment Area wherein the presumption in favour of single or small scale residential development in the countryside is removed. Within this area the provisions of STRAT 4 of the adopted ‘Kintyre Local Plan’ (1st review and alteration) 1988 seek to restrict development because of the incremental and cumulative effect of development on the environment.

In respect of the emergent ‘Argyll and Bute Local Plan’ (Finalised Draft) 2005 the application site is located within an area designated as ‘Rural Opportunity Area’. No specific representations have been lodged in respect of the proposed designation of this land as ‘Rural Opportunity Area’ as part of the local plan public consultation process, and it is therefore appropriate to give emergent policy due weight in the determination of this application. The provisions of STRAT DC 4 of the ‘’Argyll and Bute Structure Plan’ 2002 would support the principle small scale residential development on suitable sites within a ‘Rural Opportunity Area’.

Locational/Operational Need:

The applicant has not submitted any claim of locational or operational need in respect of the current proposal.

Economic Benefit:

None, other than construction.

Environmental Impact:

The application relates to a 0.1ha former quarry site located within the wider Kintyre countryside to the north west of the settlement of Kilkenzie. The application site itself lies in a depression, which is currently waste ground, immediately in front of the old quarry at Largiemore. The land to the north of the site rises steeply to the site of an old fort which is a scheduled ancient monument. The application site is elevated above the land to the south which is lower lying, undulating agricultural land over which the site shall be visible from Kilkenzie and the A83 public highway; from these views however a development on the application site shall relate to the siting of Largiemore Farm, a linear grouping comprised of a farmhouse and agricultural buildings approximatley 200m to the west, and which is located at a similar level on the hillside as the application site. The existing settlement pattern within the surrounding landscape setting comprises traditional farm clusters, dispersed single and small groups of dwellinghouses and the settlement of Kilkenzie. It is considered that the erection of a single dwellinghouse of an appropriate traditional design and finishes at this location on the lower hillside would be in keeping with the existing settlement pattern and would not result in a prominent or incongruous feature within the wider landscape setting.

Effect on the Conservation of Natural and Heritage Resources:

The application site lies some 150m south of the site of a former fort which is designated as a scheduled ancient monument. Historic Scotland have advised that the proposed dwellinghouse would not have a direct impact upon the scheduled area, however, it is noted that the development could potentially impact upon the setting of the scheduled site which at present, in views from the approach along the farm track, are wide open and uninterrupted by modern development with the exception of the former quarry site. Historic Scotland have advised that, given the proposed location of the dwellinghouse in a depression immediately in front of the former quarry site, a low and unobtrusive structure of appropriately traditional design and materials would be unlikely to have a significant adverse impact upon the setting of the scheduled site, and may be considered as consistent with the provisions of STRAT DC 9 and POL BE 1A of the Development Plan.

There are no known constraints in respect of natural heritage resources.

Sterilisation of Natural Resources:

None.

Infrastructure and Servicing Implications:

Access to the site is to be via an existing private way. The Area Roads Manager has not raised any objections to the proposal subject to the provision of parking and turning for two vehicles within the application site and for a minor improvement to the surface of the junction of the private road and public highway where surface water and debris are presently being deposited from the private access onto the public highway. Whilst this area of land is outwith the application site and the applicants specific ownership it is the consideration of the Planning Department that this minor matter may be adequately addressed by imposition of a suspensive planning condition.

Foul drainage is to be to a new septic tank and soakaway (details reserved); water is to be by connection to a proposed private water supply (details reserved). The Area Environmental Health Manager has not raised any objections subject to the imposition of a planning condition to ensure the adequacy of the proposed private water supply. It is further advised that given the former quarry use of the site that planning conditions in respect of the investigation and, if necessary, remediation of contaminated land also be imposed on any grant of planning permission.

D. REASONED JUSTIFICATION FOR DEPARTURE TO THE DEVELOPMENT PLAN

The proposal does not conform with the provisions of the adopted Kintyre Local Plan 1984 & First Review 1988, insofar as the development lies within the ‘Campbeltown Catchment Area’ defined by Policy STRAT 4, which removes the presumption in favour of small scale development in the countryside. This plan is now substantially out of date and the policy position is under review as part of the preparation of the 'Argyll & Bute Local Plan'. The Finalised Draft of the emergent plan identifies the site as falling within a ‘rural opportunity area’ within which small scale development opportunities may be found. The draft plan has been the subject of public consultation and there are no objections to the principle of, or the intended disposition of, ‘rural opportunity areas’ in

Kintyre. With this in mind, it is appropriate to accord weight to this most recent expression of Council policy in preference to the outdated provisions of the adopted plan. The proposal satisfies the advice given in the government’s Planning Advice Note 72 in that it secures an acceptable relationship with its surroundings and does not have an adverse impact upon landscape character.

D. CONSIDERATION OF THE NEED FOR A PAN 41 HEARING

Planning Advice Note 41 recommends that Planning Authorities intending to make decisions which would represent departures from the provisions of an adopted development plan, in cases where applications are the subject of objections, should give consideration as to whether it is appropriate to hold a local hearing in advance of making any determination. It is the Council’s practice to follow this advice, however, there have been no representations from the public in respect of the current application and it is therefore advised that it would not be necessary to hold a PAN 41 hearing prior to the determination of this application.

MULTI-USE BUILDING ON GIGHA

1. SUMMARY

1.1 This report describes a proposal to investigate the provision of a multi use Servicepoint building near the ferry slip on Gigha.

2. RECOMMENDATION

2.1 The area committee approves the proposal and supports officers investigations into funding opportunities.

3. BACKGROUND

3.1 The public conveniences owned by the council at Gigha slip are in poor condition and housed in temporary buildings. The council has provided a video conferencing facility for Gigha but they are not in a suitable site.

3.2 The Marine and Coastguard Agency [MCA] approached the council to discuss a shared building which could house toilets and storage for their equipment which they will have to move from its existing site in the near future. Strathclyde Police have also asked the council if there was a place where they could site a cell and have use of an office.

3.3 Gigha Heritage Trust are currently using one of the AIE craft units near the hotel, but have for some time thought that an office near the slip would be a better site for them especially for the provision of information to visitors.

3.4 Fyne Homes now have 10 occupied houses and another 8 due to be completed in summer 2006. They require to consider where best to manage these houses from. Gigha Heritage Trust also need to provide an office for housing management purposes. ACHA will soon be the residual landlord of a few houses on Gigha too and all three organisations may consider a joint housing management post.

The NHS are interested in entering into discussions about a shared use building which could be used as the doctors surgery.

3.5 Taking all of these disparate requirements into account, brief discussions with all parties have taken place and all agreed that it would be worthwhile to pursue the option of a Servicepoint similar to that on Colonsay, with the addition of storage/cell and toilets.

3.6 Fyne homes have agreed to take up a request to Communities Scotland for initial feasibility funding into both the capital cost and the consequent revenue requirements.

1. SUMMARY

1.1 This report outlines a proposal to reallocate area capital monies originally set aside for the formation of a new Peninver footpath.

2. RECOMMENDATION

2.1 It is recommended that the sum allocated from the area capital budget for the formation of a new Peninver footpath be reallocated to the provision of signage on the B842.

3. BACKGROUND

3.1 In 2003 the area committee agreed to allocate £10,000 towards the formation of a new footpath in Peninver.

3.2 It has not been possible to provide the required footpath for this price.

3.3 There is a requirement for safety signage on the B842 for cars, cyclists and pedestrians and £10,000 would be sufficient to do this.

A816 LOCHGILPHEAD TO OBAN ROAD - LANE CLOSURE AT CARNASSARIE

1. PURPOSE

The purpose of this report is to inform Members of the implications of the recent decision by the Strategic Policy Committee not to undertake any remedial works on the failed retaining wall adjacent to the A816 Lochgilphead to Oban Road at Carnassarie.

2. RECOMMENDATIONS

It is recommended that Members note the contents of this report.

3. DETAIL

A section of retaining wall supporting the A816 Lochgilphead to Oban Road collapsed in December of last year and single lane traffic control was set up immediately to divert traffic from the side of the carriageway affected by the failure.

After ensuring that it was safe to allow vehicles to continue to use the lane distant from the collapse, Development Services produced an outline design to realign the road at an estimated cost of £900,000.

The Strategic Policy Committee decided to take no action meantime as there is no money in the capital programme, continue with single lane working with traffic control and monitor the situation. It also agreed to contact the Scottish Executive to ascertain if any additional funding could be provided to the Council to assist in dealing with the situation at Carnassarie.

4. CONCLUSIONS

• Although no action will be taken to reinstate two lane traffic at Carnassarie meantime, costs will continue to be incurred by the Council whilst monitoring of the site and maintenance of site traffic control arrangements are ongoing.

• A decision from the Scottish Executive on special funding is awaited.

• Depending upon the Scottish Executive’s decision on funding, traffic control arrangements at Carnassarie will require some further consideration i.e. possible replacement of temporary traffic lights and signing with a more permanent installation.

5. IMPLICATIONS

5.1 Policy – The decision not to carry out remedial works at Carnassarie was based on budgetary considerations. The policy document ‘Road Maintenance & Asset Management Plan for the Road Network’ states that ‘…..the purpose of the plan is to design a sustainable maintenance regime capable of managing the road network asset within the available resources and ensuring that the asset will be available for future generations’. 5.2 Financial – Costs for the maintenance of traffic control and monitoring of the site will be funded by the local Area Manager through his Revenue Roads Maintenance Budget. 5.3 Personnel - None 5.4 Equal Opportunities - None 5.5 Legal – The section of road adjacent to the failed retaining wall will continue to be managed and maintained by the Council as required under Section 1 of the Roads (Scotland) Act 1984.

RURAL TRANSPORT GRANT 2006-07

1. SUMMARY

The purpose of this report is to put forward proposals for experimental public transport services to be funded by the Rural Transport Grant that the Council receives from the Scottish Executive. Each Area Committee, with the exception of Helensburgh and Lomond which is now within the Westrans Regional Transport Partnership boundary, will consider a similar report particular to their area and the decisions will be collated, evaluated and ranked against the available funding and presented to the Strategic Policy Committee for approval.

2. RECOMMENDATION

It is recommended that members agree the use of Rural Transport Grant to provide the additional public transport services as detailed.

3. BACKGROUND

For the last eight years the Scottish Executive has provided the Council with additional funding for the promotion of rural public transport services within the authority’s area. The settlement figure for 2006-07 is £509,000 of which the Executive had initially allocated £81,000 to Strathclyde Passenger Transport (now Strathclyde Partnership for Transport) but following the redefining of boundaries with the introduction of the statutory Regional Transport Partnerships the Executive have announced that a further £30,000 of the main allocation will be given to SPfT for the additional area of Helensburgh and Lomond (Ward 34) which now falls within the Westrans boundary. This leaves a balance of £398,000 for services in the remainder of Argyll and Bute, a reduction of £13,000 on last year following the removal of Ward 34 (Arrochar, Succoth, Tarbet). £120,000 of the grant has been used over each of the past eight years to support existing services that the Council would have otherwise had to discontinue.

£278,000, therefore, remains to continue support for previously authorised projects (section A) or to promote new projects throughout the whole Council area. The Scottish Executive is encouraging Councils to consider, where appropriate, community transport alternatives to conventional scheduled bus services, particularly in remote areas. In some cases these types of services may prove to be more cost effective. New experimental services for consideration are described in section B.

In order to gauge the performance of the services provided under the auspices of the Rural Transport Grant, the objective criteria contained in the Council’s Public Transport Guidelines have been applied and appropriate comment is included where applicable. It is proposed that, as in previous years, those experimental services not achieving growth be discontinued and replaced by others of an experimental nature. Due to the reduction in overall funding some services can no longer be funded and these are included in the report.

As far as possible, the funding is spread equally across the Council’s areas. However, this is not always possible as some areas already have adequate public transport services. It should be noted that some of the costs shown below are estimates.

4. RURAL TRANSPORT GRANT EXPENDITURE 2005-2006

Section A. Services and projects in operation or approved previously which it is recommended be continued.

SERVICE: Tarbert and Lochgilphead (Serving both the Bute and Cowal and Mid Argyll, Kintyre and Islay areas.) CONTRACTOR: West Coast Motors DESCRIPTION: This service has three functions. It was originally introduced as part of other links, which together create a through journey from Rothesay to Lochgilphead and return. It also provides some local links within Tarbert and in general enhances the bus service between Tarbert, Ardrishaig and Lochgilphead. COST: The amount of Rural Transport Grant required to 31st March 2007 will be £20,000. COMMENCED: 14th August 2000 COMMENTS: Usage of this service has fluctuated considerably according to the figures declared by the former operator D and E Henderson of Tarbert. On 16th April 2006, by agreement with the Council, the contract was transferred to West Coast Motors and a revised timetable introduced which linked some of the journeys on this service to the Tarbert Skipness service. During 2005 the service carried 5,187 passengers at a subsidy per passenger of £7.95, well ahead of the guideline criteria figure. However, in conjunction with the new operator it is intended to promote this service vigorously because of the additional journey opportunities and connections with ferries now possible as a result of the revised timetable. Accordingly it is recommended that the service be funded for a further year.

SERVICE: Ardrishaig/Lochgilphead and Oban (serving Oban, Lorn and the Isles and Mid Argyll, Kintyre and Islay areas) CONTRACTOR: West Coast Motors DESCRIPTION: Enhanced service and route development following withdrawal of service by Scottish Citylink Coaches Ltd. July 2002. Four journeys each way on school days and two journeys each way on Saturdays and school holidays. COST: £10,611.71 estimate per annum to year ending 31st March 2007. COMMENCED: Five-year commitment from 17th July 2005. COMMENTS: Prior to July 2002 the service on this route consisted of a return journey from Ardrishaig to Oban, daily during the summer and on four days a week during the winter, operated by Scottish Citylink Coaches Ltd. In addition to this a journey operated from Oban to Lochgilphead and return on school days only. During the winter and when schools were on holiday there were days where there was no service on the route.

In the first year of operation, the enhanced service carried a total of 16,938 passengers. In the second year of operation (July 2003 to July 2004) this rose to 21,390. For the twelve months ending 19th march 2005 the passenger total was 21,990 indicating that modest growth was still being achieved on the service. However to year ending 18th March 2006 this figure had fallen to 20,992. Nonetheless, the subsidy per passenger of £1.67 is still well within the guideline criteria.

Continued promotion of the service by both the Council and the contractor is required to maintain this favourable position and either consolidate it or achieve modest growth.

SERVICE: Additional Bus Services on Islay and Jura CONTRACTOR: Ben Mundell Ltd. trading as Islay Coaches and Alex Dunnachie trading as Charles MacLean DESCRIPTION: Additional Summer Sunday bus services on Islay and an additional journey on Thursday evenings from Jura to Bowmore and return. COST: £13,740 (Estimate) COMMENCED: The seasonal commitment to provide additional services has operated since summer 2003. COMMENTS: It is hoped to re-introduce the additional seasonal Sunday bus journeys on the existing routes for the full season with an emphasis on the Bowmore to Portnahaven section of route. A Thursday evening journey from Craighouse to Bowmore was authorised late last year and approval for continuation is sought.

SERVICE: Additional “On Request” Ferry Service between Jura and Islay CONTRACTOR: ASP-Seascott DESCRIPTION: Early morning request journey on Tuesdays and Saturdays during the CalMac summer timetable. COST: £2,500 (Estimate) COMMENCED: Summer 2004 COMMENTS: It is hoped to re-introduce the additional request sailing of the Islay – Jura ferry to provide a connection with the 0700 CalMac ferry sailing from which will operate on Tuesdays and Saturdays only from 20th May until 23rd September 2006.

Last year the sailing was requested on 14 occasions (12 Saturdays and two Tuesdays) and carried 90 passengers at a subsidy of £14.78 per passenger. While this figure is well over the guideline criteria figure of £3.50 per passenger the overall amount involved is small.

SERVICE: Kintyre Evening Services CONTRACTOR: West Coast Motors DESCRIPTION: Enhanced evening bus services to Southend and Machrihanish. COST: £8,122.40 COMMENCED: 10th December 2001 COMMENTS: These services were introduced as part of an initiative to revive Campbeltown evening services following the uncertainty created by their proposed withdrawal. Following local consultation, the evening journeys were re-timed in an effort to increase patronage. Despite substantial additional cost, no significant increase in patronage was experienced and the previous times were re-introduced at a saving of approximately £11,000 per annum. The contractor has been asked to supply patronage figures for the evening services so that the figures can be measured against the Guideline Criteria. It is recommended that this enhancement continue.

SERVICE: Lochgilphead and Campbeltown (Tuesdays Only) CONTRACTOR: West Coast Motors DESCRIPTION: Additional journey introduced as part replacement for withdrawn Citylink service. COST: £2,188.16 COMMENCED: 29th October 2002

COMMENTS: This service is an additional journey on an existing schools / local contract which hitherto only operated on school days. The Tuesdays Only journey was originally introduced between Tayinloan and Campbeltown as it provided the only means of direct transport between the Gigha Ferry and Campbeltown following the withdrawal of a Scottish Citylink Coaches journey. The service was then extended to Clachan and later to Lochgilphead. Figures for the individual journey are not yet available but taken as a whole, the contract carried 3,716 fare paying passengers to the year ended 27th November 2004 at a subsidy of £3.72 per passenger, slightly over the Guideline Criteria figure of £3.50. It is recommended that this enhancement continue.

SERVICE: Campbeltown and Sound of Kintyre CONTRACTOR: West Coast Motors DESCRIPTION: Service to Sound of Kintyre (refurbished ex RAF housing) and Vestas – Celtic Wind Technology Ltd. factory. COST: £27,409.59 COMMENCED: 31st March 2003 COMMENTS: This enhanced service has shown continued growth since being introduced. In the year to 25th December 2004 a total of 5,201 fare paying passengers have been carried at a subsidy per passenger of £4.82. As the service has not been operating for two years we do not have like for like comparative figures but the total carried in the first 12 months of operation was 3,472. In the year to 18th March 2006 growth has continued and the service carried 5,637 passengers at a subsidy per passenger of £4.71. The service will continue to be promoted vigorously in the hope of continuing to achieve modest growth in patronage. It is, therefore, recommended that Rural Transport Grant be used to continue the experimental service for a further year.

SERVICE: Campbeltown Ring’n’Ride CONTRACTOR: West Coast Motors DESCRIPTION: Demand Responsive Service, Monday to Friday serving Campbeltown, Campbeltown Airport and Southend COST: £9,066.88 COMMENCED: 10th January 2005 COMMENTS: This new service was the subject of a detailed report to members on 8th December 2004. The majority of the funding for the service has come from the Scottish Executive by means of a special grant as part of a study into the value of this sort of service to rural areas. A small sum of Rural Transport Grant is still required towards the cost of operation of the service for 2005-06. The amount has increased from last year due to the end of the contribution from the Social Work budget. However, Social Work will still continue to supply Homecare Assistants to travel with the bus when their clients are being transported for at least this financial year.

In the year to 18th March 2006 the service carried a total of 10,064 passengers and is bound to increase further as a result of the new national free concessionary travel scheme.

SERVICE: Inveraray and Lochgilphead Commuter service CONTRACTOR: West Coast Motors DESCRIPTION: Operation of the existing school days only morning journey from Inveraray on Mondays to Fridays throughout the year and a return journey after 1700hrs in the evening at a time to be decided following local consultation.

COST: £28,847.57 COMMENCING: 4th April 2005 COMMENTS: This service was the subject of an earlier experiment, which failed through lack of use. There now appears to be a greater willingness to support such a service although the cost is substantial. To bring the service within the Guideline Criteria will require at least 17 return journeys per day. The service operates to and from Ardrishaig and will divert via the hospital but cannot operate via Kilmory as there is nowhere suitable to turn a large vehicle.

The opinions of local community organisations, potential users and major employers in the area were sought prior to fixing the evening departure time and the service was given the maximum publicity by way of timetable leaflets, press advertising, radio advertising and bus stop information panels. The assistance of community organisations was also sought in publicising the service.

From commencement on 2nd May 2005 to 18th March 2006 the service has carried 3,238 passengers at a subsidy of £8.63 per passenger. Unfortunately, this figure is still very high but numbers have been increasing steadily and the service should be given a further year to see if this trend continues. A further publicity campaign will also be arranged for the service.

Section B. In addition to the suggestion for a demand responsive evening service in north west Islay which has been included in the Islay proposals noted above the following two suggestions have been received from members.

SERVICE: Ardrishaig and Lochgilphead Local Bus Service 422 CONTRACTOR: West Coast Motors DESCRIPTION: Enhancement of the existing service to provide a more regular frequency between Ardrishaig and Lochgilphead, restoring some of the journeys withdrawn in December 2000. COST: £8,500 COMMENCING: during 2006 COMMENTS: Although this project was approved last year subject to funding being available no progress was made. It has now proved possible to set aside a small sum for this service in the event that the Bus Route Development Grant bid for the service to the new hospital is unsuccessful.

SERVICE: Mid Argyll Transport Volunteers CONTRACTOR: Mid Argyll Transport Volunteers DESCRIPTION: Funding to complement the organisation’s Rural Communities Transport Initiative Grant application in order to continue their activities. COST: £1,000 COMMENCING: 2006 COMMENTS: In offering local authorities a Rural Transport Grant allocation the Scottish Executive is encouraging authorities to fund community transport where this appears to be a viable alternative to conventional transport. The Mid Argyll Transport Volunteers provide a valuable service to those over sixty years of age by providing them with transport to medical appointments, shopping or other journeys they require to make if they are unable to make arrangements for the journey themselves.

5. SUMMARY

The estimates for this year’s grant expenditure in Mid Argyll, Kintyre and Islay total £116,680.46. Where services operate in two Council areas the cost is split between the two areas. Estimates will be converted to final figures once the 2006 inflation uplift figure has been applied to qualifying contracts and the results of tenders are known for those services where prices have still to be obtained.

2.2 The Area Committee is asked to agree that £1,000 be vired from Leisure Development to the Education Development Grant budget. The recommendations attached would fully commit the Education Development budget for the reminder of this financial year and £2400 would remain in the Leisure Development budget.

Additional Information This organisation was formed in 1948 providing an opportunity for groups involved in amateur dramatics to perform one act plays. Depending on the numbers of entries, the Festival runs in Ardrishaig Village Hall for 3 or 4 evenings with 3 plays per evening. A professional adjudicator is engaged for the Festival and gives a public review of each performance, plus a private review for the actors in each play.

It has shop front premises in a prominent position in Campbeltown and is staffed by both paid staff and volunteers. Please supply a very brief summary: The community flat, based in Broom Cottage has for the last 10 years offered opportunities for parents, children and families to take part in a wide range of activities. Recently, the flat has focussed on childcare. However, the new committee is keen to see family activities taking place where parents can learn alongside their children and be involved in their education through learning new skills and visiting places of interest.

Additional Information The volunteer members of this group undertake relevant training each year to ensure a safe and secure environment for children to learn new skills and experience working as part of a team. The organisation is supported by the Council’s Homelink worker who encourages parents to become involved in their children’s education.
