The Chairman ruled, and the Committee agreed, in terms of Section 50B(4)(b) of the Local Government (Scotland) Act 1973 in terms of Standing Order 3.2.2, that item 12, which was not specified in the Agenda, should be considered as a matter of urgency because of the need for the decision to be taken before the next meeting.

4. MINUTES OF MEETING OF 8 FEBRUARY 2006

The minutes of the meeting of 8 February 2006 were approved.

Arising from Item 4, Councillor Kelly asked if a reply had been received from BT regarding the lack of broadband coverage in Southend, and the north end of Jura. Deirdre Forsyth stated she had not yet received a reply but confirmed she would contact BT again regarding this.

Arising from Item 17, Councillor Currie stated that piles have been cut down to water level at Bruichladdich Pier and pose a hazard for small boats. It was agreed that Richard Kerr would investigate this.

5. PUBLIC QUESTION TIME

Chief Inspector Harry Miller informed the Committee that Strathclyde Police would be giving a presentation to the next meeting regarding the police call centre.

He then explained to the Committee that the Police office in is being upgraded. One of the rooms will then be available for Council use and will be manned by a member of Council staff 3 mornings a week and function like a mini Servicepoint.

Councillor Colville then asked Chief Inspector Miller if, when planning the new police station in Campbeltown, they had taken into account the right of way between Hazelburn Business Park and Tesco. Chief Inspector Miller confirmed this has been taken onto account and informed the Committee they will soon be at the stage of applying for planning permission.

Councillor Kelly then asked if a CCTV would be sited to monitor Aqualibrium. It was stressed that there is extensive surveillance inside the building but the exterior also needs to monitored. It was agreed Chief Inspector Miller would liaise with Sandy Mactaggart regarding this matter. Consideration should be given to moving the TV at the Royal Hotel so that its view would include Aqualibrium. Deirdre Forsyth will contact Kintyre Crime Prevention Panel regarding this matter.

6. PLANNING APPLICATIONS

The Committee considered and dealt with the applications for planning permission as detailed below.

05/01789/DET Mr and Mrs Peacock. Detailed. Erection of two dwellinghouses. Land south- west of East Trodigal Cottage, Machrihanish.

Decision

That planning permission be granted as a ‘minor departure’ to the provisions of the development plan, subject to: i) The standard condition and reason; ii) The conditions and reasons listed in the report; iii) The decision notice being issued following the completion of a voluntary revocation of permission 04/01009/OUT under Section 65 of the Town and Country Planning (Scotland) Act 1997.

8. COMMUNITY PLANNING PARTNERSHIP PRESENTATION

Brian Barker, Policy and Strategy Manager, gave an interesting and informative presentation about the work undertaken and the structure of the Community Planning Partnership.

Decision

It was agreed there will be regular reports submitted to the Area Committee regarding Community Planning issues.

9. KINTYRE WAY PRESENTATION

Colin Hossack from the Forestry Commission reported the status of the Kintyre Way to the Committee. He answered questions and circulated maps to enlighten the Committee to the progress that has been made, and the work still to be done.

The Committee were pleased to note the work being done to create the Kintyre Way.

10. FUSIONS

The Committee were advised of the future arrangements for the development of better-integrated children’s services through the FUSIONS initiative.

Decision

The Committee noted the contents of the report and agreed that a further report will be made to the August meeting.

11. ISLE OF GIGHA IMPROVEMENTS TO SERVICE DELIVERY

The Committee considered a report outlining the possibility of appointing a person on the island of Gigha to carry out roads, amenity and property maintenance work there.

Decision

The Committee agreed to appoint a suitable part time person for Gigha, as discussed in the report.

12. MID ARGYLL SAILING CLUB

A request was received regarding the re-constitution of Mid Argyll Sailing Club. The Club wish to use the site adjacent to the former swimming pool in Ardrishaig to store dinghies over the summer. The site is held on the surplus property account and Legal Services are currently dealing with a Title issue which is preventing a disposal of the subject property at the present time. The planners have advised that planning permission for change of use will be required. Decision

To issue a basic occupancy agreement to Mid Argyll Sailing Club on the basis of nil rental, incorporating all the usual safeguards from the Council’s point of view, for the period up to the end of September this year and month to month thereafter, subject to all planning permission being obtained.

05/02063/OUT W.C. and M.I. Wood Outline Erection of single detached dwellinghouse and septic tank Land East of Gleann A Gaoidh, by Portnahaven, Isle of Islay

The Chairman commenced by introducing those present and explaining the procedure.

Richard Kerr on behalf of the Head of Planning explained the reasons for the recommendations of approval as per the reports.

APPLICANT Mr Wood reiterated what had been stated in the report by the Head of Planning and explained to the Committee that he had had discussions with the Planning Department prior to applying for planning permission in order to locate a suitable site. He also stated that he has a strip of land which would act as a natural barrier and he would be cutting back trees at the roadside in order to increase visibility at the access point.

OBJECTORS Mr Bouttell introduced himself to the Committee and distributed a handout, which outlined the main point in support of the objections (Appendix 1). He then went on to discuss each point in detail, a copy of which is attached to this minute (Appendix 2).

COUNCILLORS

Councillor Hay asked for clarification of what outline planning permission allowed the applicant to do and Richard Kerr explained that it was the first of a 2 part process, an approval in principal, but that a further application for the reserved matters must be then submitted. Outline planning permission is valid for 3 years.

Richard then explained that Scottish Water have not objected to the application but they cannot guarantee connection to the water supply until an application is made for this as it is operated on a first come, first served basis.

Councillor Currie then asked if the skyline would be greatly affected if this planning permission was granted and Richard Kerr explained that as the house would be set in low lying land, the impact on the skyline would be minimal.

Councillor Colville asked about the visibility at the entrance to the site and Richard Kerr stated that if the applicant cut away the trees at the side of the road, the visibility would be improved substantially and there should therefore be no problem.

SUMMING UP

The applicant reinforced what he had said earlier in the meeting and explained that his application meets the criteria as far as the Planning Department are concerned and stated that they had never had any problems with the water supply in the last 20 years.

Richard Kerr then explained that it is a difficult stretch of land to find plots, and this particular plot will be the least intrusive for the countryside.

Mr Boutell emphasisied his points as made earlier, urged the Committee to make the right decision and thanked them for going to Islay in order to see the site and meet the objectors.

Richard Kerr the stated that the report should be amended at condition 4, part 6 to read: “Any porches shall have traditional “peaked” roofs;” with any reference to dormers taken out.

DECISION

Councillor McKinlay moved that the planning application be granted subject to the conditions and reasons stated in the report by the Head of Planning, as amended by the deletion of any reference to dormers in condition 4. Councillor Findlay seconded the motion.

There were no amendments, so the motion was carried unanimously.

APPENDIX 2 An Gleann Site Visit - 20.2.2006

1. My name is Douglas Kennedy Bouttell and I have been asked to be spokesperson on behalf of all the objectors with regard to this application for Outline Planning permission. There is no relationship, collusive or otherwise between me and any of the objectors, however I do know four of them, to speak to, and I’m on the Christmas card list of one of them. For the avoidance of any doubt I would like to make it clear that there is nothing personal between the objectors and the applicant. I would also ask that the Committee members uphold the democratic process and deliberate all aspects of this application under the strict governance of Argyll and Bute Council’s code of conduct for members of council and in particular those parts of the code titled Duty, Selflessness, Integrity, Propriety and Objectivity.

2 If we take the Planning Application Report and start at the paragraph titled (A) Determining issues and material considerations we see that no mention is made, at this point, regarding the fact that the proposed site is in a Rural Opportunity Area. I would refer you to the Minutes of Meeting of Mid Argyll Kintyre & Islay Area Committee held on 2.11.05 and in particular the Development Services Planning Application Report prepared by Peter Bain. He says and I quote “However, following public consultation, representations have been lodged to the disposition of the ‘Rural Opportunity Areas’ throughout all of Argyll and Bute. Consequently, ‘Rural Opportunity Areas’ cannot be considered as a material planning consideration in the determinations of applications at the present time”. The Planning application in this case was withdrawn. This meeting was attended by Councillors Colville, Findlay, Kelly, McMillan, Currie, Hay, and McAlpine.

Reference is made to Rural Opportunity Areas on page 35 of the Planning Report in answer to one of the objections, however, our interpretation of this statement is merely that the goalposts have been changed from the Report written for the November meeting and the report written for this one.

Reference was also made to Planning Advice Note number 72 inferring that the application was consistent with the advice. One of the pieces of advice in this Planning Advice Note, not mentioned in this particular Planning report, is that “Attention should be paid to established building lines and orientation of any buildings in the area. Overlooking should be avoided.”

(B)Conditions and reasons relative to application 05/02063/OUT Item 4(i) states that the dwelling shall be single storey in height, however item 4(vi) States that dormers (which are encouraged in the design) shall have traditional peaked roof. We therefore have a house which is single storey but is encouraged to have two floors. I would refer you back to Planning advice note No 72 “Attention should be paid to established building lines and orientation of any buildings in the area. Overlooking should be avoided.” Overlooking would be further exacerbated by the addition of another floor.

Items 7 & 8 are indicative of an effort to agree an element of road safety. Without seeing the exact design of the bellmouth or visibility splays I would estimate or hazard a guess to at least 300m² of the site being cleared in order to create the site access. With regard to areas I would like to clarify some matters of fact.

The site is stated to be 0.65acres in area, however, as a Surveyor of many years this seemed somewhat conservative especially seeing the site as defined in the Application's 1: 2500 scale Location Plan.

0.65 acres equates to 2632m². Using the Ordnance Survey GGP system I calculate the site area to be approximately 4500m² i.e 1.11 acres or almost twice that stated in the Planning Report. Is this another error?

A. Appendix Relative to Application 05/02063/OUT The Policy overview looks fairly impressive quoting Structure Plans and Local Plans however the report seems to be fairly selective in it's content. There was no reference, for example, to page 10 of the Planning Advice note ‘Housing in the Countryside’. This advice note clearly states on this page, and I quote “But it is important to ensure that any new development does not overload the capacity of current services and infrastructure". This omission begs the question - Why does the Planning Report fail to mention this?

The Scottish Executives publication ‘Rural Solutions are required for Rural locations’ even offers advice on the Role of Councillors. It states :- “Development in the countryside can be sensitive politically. It is very important that there is a solid core of planning policy and guidance, which is accepted, understood and applied consistently. If there is to be more development in the countryside it has to be well planned and then implemented properly. The process has to be seen to be fair and impartial and councillors must demonstrate a commitment to policy”.

B. Other Material Considerations (ii) The Consultations with the public utilities are fairly well covered elsewhere in the Planning report, however, Scottish Water comments are not known in detail to the objectors. As this subject is dealt under (iii) Publicity then I will speak about the water supply at that point. I would also propose to clarify the sequence of events regarding neighbour notification in a similar fashion.

Points of representation or objections are as stated in the report, however, some clarification is required with regard to the comments and answers to these objections given by the Planning Department.

Starting on page 31 0f the Planning Application Report. The objection to the visibility of the proposed house should be obvious especially with one of the conditions giving the developer the scope to paint the building in white. The physical size is not yet known, however, with a wallhead height of say 2.2 metres, a minimum roof pitch of 37 degrees and a gable depth of say 10 metres would equate to a ridge height of 6.60 metres and that does not include the exposed element of underbuilding i.e. the height above ground level could be in excess of 7 metres or 23 feet in old money.

Again we would ask for some consistency. The adjacent proprietor to the west at had a planning application for a new house refused by this committee when heard on 7th September 2005. One of the main reasons stated by Tim Williams was that "by virtue of its elevation …..detract from landscape setting of its surroundings" He (Tim Williams) also stated in this application and again I quote "It should be noted that good design of buildings in the countryside should not need to rely on buildings having to be hidden by otherwise unnecessary planting", which brings me neatly to our next point.

The planning report for this application totally contradicts the previous statement. On page 32 it is stated by the same Tim Williams that "a suitable landscaping scheme would be a condition of its approval" Where is the consistency of approach?

With regard to this application creating a precedent we are not encouraged by the statement that "the capacity of this location to absorb further residential development is considered to be extremely limited". It does not say "non existent" it says "extremely limited". In other words there could be further development allowed.

With regard to the public services and in particular the water supply we are totally confused by the response from Scottish Water. On the one hand they don't object to the application and on the other they will not guarantee connection. I think that is known as sitting on the fence. The existing house at An Gleann has two cold water storage tanks installed. This is because the existing water supply is so erratic.

There are health and safety issues here. Even if the applicant obtains Full Planning permission to build a house on this plot the Building Control Department would throw out any building Warrant application as the Technical Standards, Part E on page 2 at para 4 state that "Suitable provision must be made for access to the outside of a building for fire fighting and rescue vehicles from a public road. A water supply installation must be available……". Furthermore section 6(102) of the Housing Scotland Act 2001 clearly states that a house will meet the tolerable standard if it "Has an adequate piped supply of wholesome water available within the house".

What is the point of granting Outline Planning Permission if the known facts regarding the state of the existing water supply are left out of the equation? The Planning officer seems to have totally missed the point regarding the supply of water for fire fighting purposes, in the event of fire at either properties, and we would question his expertise on this subject. It would not matter which house was on fire. There is not enough water pressure to service the existing house with a wholesome supply, all year round never mind having enough on tap for fire fighting purposes.

We take exception to the statement made that "this application has been competently submitted". For the avoidance of any doubt the original application was dated 14th of June 2005 and was signed by the agent. Not only was it signed by the agent it stated that the neighbours were notified on 15th June 2005 and that the plot was situated at Octofad Farm. This contravened the requirements of Article 8 and Article 9 of the Town and Country Planning (General Procedure) Order 1992 as it contains a statement which the agent knew to be false or misleading. This means he was guilty of an offence. How the Planning Officer can state that the application is competent beggers belief.

The question of ribbon development would not appear to have been grasped, appreciated or understood either. As a general opinion it appears to me that Bruichladdich, Port Charlotte and Portnahaven/Port Wemyss were clearly defined and identifiable villages. In recent times Bruichladdich has extended it's boundary to Coultorsay to the west and Braeside to the East. Smaller settlements like have also expanded in a linear fashion with Nerabus almost joined up with Octofad.

Instead of clearly identifiable settlements we now have all villages of the Rhinns subjected to a Planning policy which intends to have them all joined up. The application before us today is just another piece of infill. In Planning Speak you can call it rounding off , however, it is the thin end of the wedge. If this application is successful we would predict that another application would not be long in being submitted to build a house to the West of ‘An Glean’. This in turn would encroach on the boundary at Easter Ellister to the West. At the top of the hill to the East we now have the new quarrying operation which is indicative further linear progression being allowed between Octofad and An Gleann. The recent new build between Easter Ellister and Wester Ellister on the North side of the road again illustrates the insidious joining up of the Rhinns settlements. The relevance of standing on the pier at was again lost on the planners. This was merely a simple statement to allow the committee to see the bigger picture regarding Ribboning on a practical level.

Councillor Donald Kelly opened the meeting by welcoming and thanking everyone for attending the February Meeting of the Kintyre Initiative Working Group. He extended a warm welcome to all the M.S.P.’s, Scottish Water and Hendrie Barbour who had travelled to be at the meeting.

Mull of Kintyre Half Marathon and 10K – Councillor Donald Kelly introduced Hendrie Barbour who gave a presentation, a copy of which is attached, on the Half Marathon and 10K which will be held on Sunday 28th May at 10.30 a.m. There followed a discussion, and the chairman expressed the thanks and best wishes of everyone present to MOKRUN for organising this event.

Dunfermline Car Club – Work continues in arranging a car rally for the area.

Campbeltown to Machrihanish Railway Walk – No progress.

Fessenden Project – It was reported that the transmission went well with the broadcast to Brant Rock.

Westport – Councillor Rory Colville intimated that funding is in place and work should commence in May.

4. UPDATE/REPORT ON NEW GOLF COURSE

No update.

5. SCOTTISH WATER REPORT

Jane McKenzie and Caroline Jones from Scottish Water were welcomed to the meeting. Tarbert – The Tarbert project has been up and running successfully for sometime, odour complaints having been dealt with. The situation regarding the old pumping station and the capacity of the system were raised. Jane Mackenzie will report back on these issues to a future meeting. Campbeltown – Phase I of the Campbeltown Project has commenced to allow upgrading of the pumping station and it should be completed by March or April 2006. Phase II should start in June. It was agreed that Scottish Water needs to keep everyone updated. A meeting has been held with Low Askomil residents advising them of Phase II works.

Scottish Water agreed to investigate a major burst at Clachan and also the proposed treatment works at Muasdale. Scottish Water agreed to supply goods for the Mull of Kintyre Half Marathon and 10k.

6. TOURISM/LEISURE INITIATIVES

Kintyre Way – Marcus Adams and John Bakes gave the Group an update on the Kintyre Way. The Kintyre Marketing Group have agreed to form a new company called “Long and Winding Way” (LWW). The next stage is for LWW and Argyll and Bute Council to enter into an agreement to give LWW responsibility for managing the walk. It is hoped that the opening date for the Walk will be June 10th. A logo has been produced and a website is being set up.

7. FERRY INITIATIVES

Councillor Donald Kelly asked each MSP to give their views on the failed tender process and also what measures they have taken to secure the reinstatement of the Campbeltown to Ballycastle Ferry.

Maureen Macmillan MSP stated her disappointment in the tender process for the Campbeltown to Ballycastle ferry service. She is hopeful that the other companies and the local group, although they had not been preferred bidders, could now be approached. Maureen intimated that she has written to the Minister to request that this is pursued further.

George Lyon MSP advised the Group that he has been supportive of the service since day 1. He stated that he stills thinks there is an opportunity to get the ferry service up and running but wants to be confident that we have a robust service which will work.

Jim Mather MSP indicated that he is really keen to see the Scottish Executive go the extra mile to find out why people did not bid. He said that Professor Neil Kay thought the Scottish Executive should consider ordering a ship and leasing it to a future operator. He thought that a properly executed ferry would increase population, increase tax and reduce benefits and said that we have to argue for this.

Jamie McGrigor MSP stated his huge disappointment in the tender process. He intimated his regret that Andrew Banks had not been asked to help as he has proved the Orkney alternative to Northlink could pay. Jamie advised the Group that he would try to find out why no contact with Orkney was made.

Les Oman from DBAG stated his disappointment there were no tenderers. The Irish are still 100% behind the ferry going ahead. DBAG support any operator with a robust case. The group agreed to continue their support for the service and to try in whatever way possible to make it happen.

8. AIRSHOW 22nd – 23rd July 2006

Derrick Lang advised the Group that the Airshow is progressing well. The aircrafts which are attending have still to be finalised but the American Military will be doing a static display. Ticket prices are to be agreed this week. A business and marketing plan is now in place thanks to the work of Iain Johnstone who has been employed through A.I.E. A projected economic impact of the Airshow is attached for information.

12. CAMPBELTOWN AIRPORT CONSULTATIVE ITEMS

a) Loganair Ltd – No report.

b) Highlands and Islands Airports Ltd – The monthly figures were discussed and a copy is attached. Derrick Lang advised the Group that there would be a large-scale Dutch exercise from 13th February to 24th February involving 500+ personnel.

c) Defence Estates – No report. A copy of the letter received regarding the future of the base is attached.

13. INITIATIVES/PRIORITIES AND THEMES FOR FUTURE MEETINGS.

The Yellow Book – Kevin Williams gave an informative presentation on the Campbeltown and Kintyre Strategy. After discussion Councillor Donald Kelly proposed the nominees of the Steering Group as follows: 3 Local Councillors, Jim Martin from Campbeltown Community Council and Ivor Watson or Marie Kennedy from Campbeltown Traders Association.

Banners – Photographs and literature were circulated to the Group on the banners, which are erected in Bushmills. It was agreed to pursue this initiative and the Group were asked to think of famous people associated with the area. Jim Mather MSP then updated the Group on The Scotland Fund.

Opportunity Kintyre – Les Oman intimated to the Group that a meeting would be held this week and that things should progress quickly when an announcement has been made about the successful areas.

Forestry Commission – A letter was read to the Group from the Forestry Commission stating that they do not object to site sharing of telecommunications masts. Orange phone company have been written to regarding coverage in the Southend area but to date no response has been received.

Loganair – A letter has been received from Loganair concerning the use of the Saab 340 but it was noted that if Loganair’s tender is successful they will still be using the Twin Otter.

The issue of schoolchildren travelling to Gigha and having to wait a long time at the terminal was discussed. It was agreed to write to Cal-Mac and contact Douglas Hendry Director of Community Services.

3. MATTERS ARISING

Japanese Knotweed

A gentleman from Tarbert has formulated a solution which seems to kill off Japanese Hogweed but at this moment he is unwilling to share the recipe. All the ingredients have been purchased ‘over the counter’. Alison Hay will make further enquiries. The Forestry Commission and Roads service may be interested as their present formula ‘round-up’ is failing to treat the problem conclusively.

4. SCOTTISH WATER

No representative was available but Jane McKenzie sent the following report:

1. First Time Provision - Ardrishaig and Lochgilphead

I have spoken to Deirdre Forsyth and Ron Bowe of Ardrishaig CC re this and have told them that I will investigate and respond directly to them.

2. Japanese Knotweed - Our Environmental Engineer has advised me of the following The knotweed will be sprayed by a licensed contractor a number of times before we start work at a site. If we are constructing a new main contaminated material will be excavated, set aside in designated area and marked as contaminated, it will then be returned to the area it was excavated from and machinery cleaned as appropriate. Uncontaminated excavated material will be set aside in a clean area and returned to the clean location. For excavation at PS/ WwTW etc the excavated material will be disposed of to landfill or buried on site; if the latter we will get agreement from the council and SEPA and follow the appropriate guidance.

3. Loose Manhole Cover - Barmore Road

This cover has not been replaced yet. SW have a contractor, Martin Pipelines, in the area replacing missing covers and this one will be included in their list.

4. First Time Provision - Tarbert

There is additional capacity in the Waste Water system for 40 houses to be connected. There were 9 houses considered for First Time Provision however all of these were outwith reasonable cost.

5. FORESTRY COMMISSION

Andy Buntin informed the meeting that the Torinturk by-pass is now in operation and seems to be working successfully.

As there has been no response from Vodaphone, Orange is going ahead with discussions for a separate mast.

Money has been made available to drain and clear the Castleton - Lochgilphead foot path and a survey of its usage will take place. If it proves to be successful further improvements will be made.

A ‘Robbers Den’ trust has now been formed to obtain the land back from the Crown Office for the use of the Community.

Dalriada Project now has lottery funding and workers are at present being appointed. New appointee David McGilp has arranged a meeting for 2 March as the new ‘Company’ needs to locate more funding. Alison Hay expressed concern that as a member she had not been informed of this Meeting.

Auchindrain Museum has agreed to permit the use of their car park by members of the public using the new ‘Forest Drive’. Information about the new initiative will be available at the car park and the Museum.

Bengullian –The Forestry Commission and Argyll & The Islands Enterprise have discussed bike tracks and new forest walks being established.

Issues around the path agreements have delayed the opening of the Kintyre Way until 10 June 2006. The Kintyre Marketing Group have agreed to form a new Company called ‘Long and Winding Way’ and have reached an agreement with Argyll and Bute Council which will give the group responsibility for the management of the route.

6.(a) Ardrishaig Community Council

At the last meeting there was a presentation by Shanks and also the company dealing with the water pipe installation. The community seemed to be happy with the proposals.

6(b.) Dunadd Community Council

The new Ward boundaries, the Water and Sewerage proposals and Parking were all discussed at the last meeting. There was also a very interesting presentation by the Dalriada project. It was suggested that David McGilp be invited along to the next MAP meeting.

6 (c) Inveraray Community Council

The new group are having their second meeting tonight. Discussions will be taking place regarding the upgrading of the town. (Painting etc) Multi ownership of most of the property makes co-ordinating the project difficult. Hopefully a maintenance agreement can be entered into.

6(d) Lochgilphead Community Council

The public toilets are to be completed with the next two months. A crossing island is to be situated in Lochnell Street in front of the toilets. The bus bays seem to be working well. Parking charges are to be implemented in Argyll Street as soon as can be arranged. The Lorne Street car park is to be re-profiled and lorries will only be permitted between 6.00p.m. and 8.00 a.m. Their removal will permit 25/30 extra parking spaces. Buses are kept in the Stag garage and will be re-sited when the garage closes. The new flats will have their own parking spaces.

6(e) South Knapdale

6(g) Craignish Community Council

Water and sewerage problems still ongoing. The ‘twenty’s plenty’ signs at the School have still not been erected. Brian Rattray reported that there is no funding until the next financial year. The committee felt that the money budget for the Bus Turning Bay was in excess and wondered why part of this could not be use to erect the signs. It was explained that this money was ‘ring fenced’. Brian will discuss the problems with Donnie McLeod and get him to phone Alison Hay as the safety of the community is crucial.

6(h) Furnace Community Council

Anti social behaviour has been causing problems within the village and the police are working with the community in trying to encourage the young folk to find hobbies and interests that will discourage them from hanging about the bus stop and the playing fields. The playing fields need to be used correctly and it was felt that John Downie could become involved in this matter.

Access to more funding is necessary for the refurbishment of the Village hall and the group will be sending a representative to next weeks funding road- show.

8. BRITISH WATERWAYS BOARD

David Lyon was welcomed to his first meeting. Work on the A83 canal bridge is progressing well and as the closure times have been well advertised very few problems have arisen. Stripping and painting and an overhaul of the electrics and mechanics are planned. Dredging will continue on the Millers’ Bridge - Cairnbaan section of the canal until the end of March allowing the canal to open on 3 April for summer use. An agreement has been made with Mr Cochran and M & K MacLeod’s to permit the silt dredged to be emptied on to the adjoining field. The silt has been tested and has a very high nutritional value.

New pontoons have been installed at Bellanoch and will permit an extra 8 - 10 boats to moor.

British Waterways have been working with Argyll and Bute Council on the Ardrishaig Area Plan and ideally would like to put in more pontoons at the entrance to the sea lock but as yet have had no response from Crown Estates.

10. COUNCIL REPORTS

10.(a) Operational Services.

Inveraray Re-surfacing at Church Square and at the bus ‘pull-in’ is scheduled. BEAR are due to rectify flooding at Church Square.

Lochgilphead Development Services have issued tenders for the upgrading of the public Toilets.

Ardrishaig Work has started on the flower beds. One complaint has been received concerning speeding on the Bridge ‘diversion route’ and this will be reported to the Police.

Minard MacLeod’s have planning permission for additional housing at Victoria Park. It is hoped that the lower part of the road will be adopted but probably not the top section. Page 25

Furnace Tarring is due to begin on the section of road leading to the quarry. The twenty’s plenty signs should be sited before the autumn.

Tarbert Pot holes leading to the Timber pier are to be filled. Concern was expressed that the filling of pot holes would be inadequate and that the contract stated that after six months of settling that the whole surface would be done.

Drimvore There have been problems with the dust lorries servicing this route and it is hoped that the Council will be able to withdraw from the current contract.

Kilmartin Investigations on flooding have been held up until MacLeod’s agent Mr John McFadden is available to visit the site.

Keep Scotland in Bloom John Downie is keen that communities should be involved in this project, which is not a competition, but an incentive to encourage the communities to tidy up their areas. John will contact all Community Councils directly.

TranServ Scotland From the 1 April 2006 TranServ Scotland will be taking over the contract from BEAR and it is hoped that the current BEAR staff will transfer. (see attached memo).

10(b) Community Services

‘Meet the Funders’- Felicity Kelly advised that any one wishing to attend should book an appointment with the funder/s of their choice. Although this poster has already been sent out it was agreed that it should be sent again so that everyone had the opportunity to take advantage of the advice.

The possibility of an Income Generation Seminar was discussed and Felicity agreed to discuss this with AIE.

The Youth Forum AGM is due to be held in Tarbert on the 1 and 2 June 2006.

The Community Centre Council still has no Secretary. No weekend lets are being accepted until after the 1 April 2006. Those already booked will be honoured.

On the 9 March 2006 the Argyll & Bute Community Planning Partnership are holding a one day workshop on The National Standards of Community Engagement. Information will be sent to all Community Councils again along with a short explanation on why it is important for the community to be represented. All communities are reminded that the closing date for Community Grants is 22 March 2006 and as the budget has been cut it would be advisable for all interested parties to ensure their applications are received before that date. All applications will be considered at the May Area Meeting. Page 26

10(b) David Hewitt issued a hand out detailing the proposal for a Mid Argyll Community Survey. It was felt that the survey would identify areas in need of regeneration and that the Mid Argyll Partnership could be a lead organisation in the project. He also issued an illustration of the type of Survey that would identify the needs of the community. The total cost of the survey and the charges of Consultants to read and report on the survey would be £4000. Funding would need to be raised for this sum. Lochgilphead Community Council carried out a survey a number of years ago and had 500 responses and which highlights areas needing attention at that time.

It was felt that as long as the collected data was put to good use that the MAP group should become involved in this process. Alison Hay pointed out that the recent Audit report had highlighted that more ‘ground level’ input was needed by Argyll and Bute Council and that a survey such at this would allow local communities/and or individuals, to have their say. Copies of the proposal are to be sent out to each Community Council and the topic will be discussed further at our next meeting in May.

11 ANY OTHER BUSINESS

Lynette MacDonald has been appointed as the new Environmental Warden. A copy of the review of Environment Wardens will be circulated to all Community Councils.

(A ) THE APPLICATION

(i) Development Requiring Express Planning Permission:

(B) RECOMMENDATION It is recommended that:

i) planning permission be granted as a ‘minor departure’ to the provisions of the development plan, subject to the standard outline conditions and reasons and the conditions and reasons listed in the report; and ii) a PAN 41 hearing be held prior to the determination of the application, in view of the number of representations received.

(C) DETERMINING ISSUES AND MATERIAL CONSIDERATIONS

This application proposes the development of two house plots at Ford between the road to Torran and the River Ford. The site is located within the Ford inset map forming part of the Mid Argyll Local Plan 2nd Alteration 1993. The proposal does not conform with the provisions of the adopted plan, insofar as it represents a linear extension of the settlement, which cannot be regarded as infill, rounding off or redevelopment in conformity with Policy HO 10.

The emergent 'Argyll & Bute Local Plan' (Finalised Draft) 2005 has considered future development options, and has included the application site within the proposed expanded village boundary. No representations have been lodged in respect of the proposed inclusion of this land in the Ford settlement boundary as part of the local plan public consultation process, and it is therefore appropriate to give emergent policy due weight in the determination of this application. The Dunadd Community Council have raised issues they would wish to be considered, but do not intend these to preclude permission being granted. Eleven letters have been received from households in support of the proposal and twelve representations have been received from households opposed to the proposal.

If developed, the site would represent the point at which development on the east side of the road terminates, as it meets the point where existing linear development commences on the opposite side of the road. The proposal may be regarded as a modest extension to the village as a ‘minor departure’ to the adopted local plan, on the basis that it accords with adopted structure plan policy and with uncontested provisions of the emergent local plan, which represent the most up to date expression of Council policy. However, as such a decision would be contrary to the adopted development plan, it will be necessary to hold a PAN 41 local hearing in advance of determination of the application.

4. Pursuant to Condition 1(a) above, any submitted details shall indicate dwellinghouses which are:

i) finished in wet dash render or natural stone or a mixture of both; ii) with a roof covering of natural slate or good quality slate substitute; iii) of no greater than one and a half story in height; iv) incorporating windows with a strong vertical emphasis; v) a roof pitch of not less than 37 o and not greater than 42o vi) with a ridge line located parallel to the public road forming the frontage of the site.

Reason: In the interest of visual amenity and in order to integrate the proposed dwellinghouse(s) with its surroundings.

5. Pursuant to Condition 1(a) above, any submitted details of the dwellings shall include a finished floor level relative to a fixed datum off-site. The development shall be implemented in accordance with such details as may be approved in writing.

Reason: In order to ensure that consideration may be given to the level of the proposed building in the interests of visual amenity.

6. Notwithstanding the details shown on the approved plan, the approved plots shall be served by means of a single shared access point to the public road, which shall be formed in accordance with the Council’s highway drawing G300, with a bellmouth area surfaced in dense bitumen macadam for a distance of 5 metres back from the carriageway edge prior to the first occupation of either of the proposed dwellings. The gradient of the shared access shall not exceed 1 in 15 within 5 metres of the edge of the carriageway and thereafter shall not exceed 1 in 7.

Reason: In the interests of road safety.

7. The access point required by condition 6 above, shall have visibility splays of 90.0 metres by 2.0 metres formed from the centreline of the proposed access. Prior to development commencing, these visibility splays shall be cleared of all obstructions over one metre in height above the level of the adjoining carriageway and thereafter shall be maintained clear of all obstructions over one metre in height to the satisfaction of the Planning Authority.

Reason: In the interests of road safety.

9. Prior to the occupation of either dwelling, a turning area and two car parking spaces shall be constructed and made available for use within the curtilage of the respective dwelling, which shall be retained thereafter for the parking and manoeuvring of vehicles.

Policy STRAT 2A – identifies Ford as a settlement appropriate for development proposals of local importance.

'Argyll and Bute Structure Plan' 2002 and 'Argyll & Bute Local Plan' (Finalised Draft) 2005

The site is now contained within an enlarged village envelope defined in the emergent ‘Argyll and Bute Local Plan’, which provides for a growth in the village of Ford. The local plan gives spatial expression to adopted Structure Plan policy STRAT DC 1 as follows:

STRAT DC 1 – DEVELOPMENT WITHIN THE SETTLEMENTS – Encouragement shall be given , subject to capacity assessments, to developments in the settlements as follows: A) – n/a B) – within the small towns and villages (including Ford) to development serving a local community of interest, up to and including medium scale development, on appropriate infill, rounding-off and redevelopment sites … C) – n/a D) – developments which do not accord with this policy are those outwith (A) to (C) above and ….. development which results in excessively high development densities, settlement cramming or inappropriate rounding-off on the edge of settlements. E) – n/a.

B. OTHER MATERIAL CONSIDERATIONS

(i) Site History

None relevant.

(ii) Consultations

Area Roads Manager (report dated 14.03.06): no objections subject to conditions regarding access and parking

Scottish Water (letter dated 29.11.05): no objections in principle. Separate application to be made direct with Scottish Water in due time for a connection to the public water main.

Dunadd Community Council (15.3.06): raise concerns regarding the potential increase in pollution of the Ford River from septic tanks, possible problems associated with water pressure for supplies to existing properties, and increased traffic on the road. It is stated that “whilst not precluding the granting of planning permission, these would seem to be issues worth considering”. Comment: It is proposed that these two plots are served by a single septic tank and a soakaway within the site. Any outfall to the River Ford would be subject to a SEPA discharge consent, and SEPA would be unlikely to accept this if a discharge to ground meeting Building Warrant requirements could be achieved. The development is proposed to be served by the public water supply and Scottish Water have indicated that they do not object to this, subject to remaining capacity being available at the time of proposed connection. Traffic levels on the Ford – Dalavich road may well be increasing, but they are not approaching the capacity of this single track road. The Area Roads Engineer has not raised objections to the proposal.

The proposal has been advertised under Article 9 (Vacant Land) on the 03.03.06 and separately as a Departure to the ‘Mid Argyll Local Plan’ on the 10.03.06. The period for representations expires on the 31.03.06. Eleven letters have been received from households in support of the proposal and twelve representations have been received from households opposed to the proposal. Their names and addresses are listed at the end of the report.

Those opposing the application raise the following issues:

If the application is approved as a departure to policy, it will open the way for development on the shore side of the road from Ford to Dalavich, undermining the distinctive character of Ford village;

Policy HO10 of the adopted plan seeks to restrain the development of small communities. A more liberal interpretation of this policy in response to dwindling land resources in small settlements would lead to unfettered and unsustainable development, which would only presumably be halted when a boundary was reached;

Policies RUR 1 and 2 seek to resist development with unacceptable environmental impact in scenic areas. It is considered that the existing house adjacent to the site (granted contrary to recommendation in 1999) already has a detrimental impact, setting a precedent for further ribbon development and further a further permission will compound this;

Comment on the above: The current local plan excludes the application site from the village boundary, but this dates form 1993 and is becoming outdated as infill sites within the village envelope are becoming exhausted. The consultation draft of the new local plan proposed a Potential Development Area (including the application site) on the east side of the road leaving Ford in the Dalavich direction, to provide for the future development of Ford. In view of representations lodged against this as part of the local plan consultation process, this PDA was deleted from the Finalised Plan, but the application site was retained in the extended settlement boundary in order to provide some small scale expansion of the settlement. Land beyond the site is now included in ‘Countryside around Settlement’ in the Finalised Plan which would not currently afford any potential for further development to the north. Development of the site would not therefore be a precursor to further development or lead to uncontrolled ribbon development. If approved, the site would represent the point at which development on the east side of the road terminates, as it meets existing linear development on the opposite side of the road. Any future applications for the development of land opposite to the existing houses on the west side of the road would need to be determined on their merits in the light of the circumstances and policy situation prevailing at that time.

Most of the houses along the Ford Dalavich road are occupied by the retired or as second homes. The contribution of the proposed houses to relieving the local housing problem would be minimal. Development opportunities are available in Torran and Inverliever nearby, and these should be an opportunity to relieve pressure on Ford, before the area between Ford and Torran becomes an unrelieved sprawl of development;

Comment: Occupancy of the proposed houses is unknown and uncontrolled and therefore this is not a material planning consideration. Members will be aware of the consents which have been granted on Torran Farm, both at Torran and Inverliever. These do indeed relieve development pressure on the village of Ford, but cannot be used as justification for precluding any further development of the village. The expansion of the settlement boundary provided for in the Finalised Plan is modest, having had regard to other development opportunities in the locality, including those at Torran.

The road through the village is single track and already overburdened with traffic including timber lorries and other heavy vehicles.

Comment: The Area Roads Engineer has not objected to the proposal on either road capacity or safety grounds.

Page 36 Those persons expressing support for the application have done so on the following basis:

Additional rural housing opportunities should be supported where possible as many communities are left to decline or are unable to move forward due to infrastructure constraints. Ford is one of the communities fortunate enough to be able to expand without servicing restraints and advantage should be taken of this in order to avoid stagnation and to breath life into the community.

The proposals form part of an overall investment package in the diversification of Torran Farm which should be supported both in terms of providing additional housing and supporting the development of community facilities.

C. ASSESSMENT

The application relates to approximately 0.3 hectares of land below the public road, which falls away to the River Ford to the rear. It has boundaries defined by a row of pine trees to the south and a hedgerow to the north. There are no features on the site other than for several conifers. The site lies to the north of a recently completed dwelling, and faces land on the opposite side of the road which has been allocated for development for many years under local plan Policy HO12, and which forms a ‘potential development area’ in the new local plan, but which has not to date, been brought forward for development. The application site marks the limit of the 'Argyll & Bute Local Plan' settlement boundary to the east of the road to Torran; beyond which development switches to an existing single linear row of detached properties on the opposite side of the road. Land to the north of the application site was contained in a further proposed ‘potential development area’ identified in the Consultation Draft of the new local plan, but this was deleted in the Fiinalised Plan in response to representations received during the consultation process. This land has now been designated ‘Countryside around Settlement’ in the Finalised Plan, which limits opportunities for development, although this status is being contested by the landowner and others, and will eventually require to be addressed at the local plan inquiry. Whatever the outcome of the future for this land, it does not have implications for the acceptability of the plots now proposed.

Proposals within designated landscape areas (in this case the Loch Awe area of local landscape significance) are to be assessed against Policies RUR 1 and 2.

Environmental Impact: The application site is below road level, is contained on either side by trees between the road and the river at the rear, and immediately adjoins existing roadside development to the south. Its development would neither be prominent nor sporadic, nor would it impinge on key views or detract from key environmental features of the designated area of landscape significance. The site forms a series of contained paddocks running along the road north out of Ford, which are a distinctive feature locally. The potential development of these paddocks has been addressed as part of the preparation of the new local plan, with the initial identification of a Potential Development Area in the Consultation Draft version of the plan, which was deleted in the Finalised Draft as a result of representations. The application site was however retained in the enlarged village envelope for Ford set out in the Finalised Plan, in order provide a limited opportunity for the future expansion of the village, up to the point where the row of existing buildings commences on the west side of the road. The development of these two plots would not set a precedent for further linear development, given the current status of the land to the north in the Finalised Plan as ‘Coumtryside around Settlement’, which would not support further linear development. The landowner has, however, made representations to the Finalised Plan requesting that the PDA be reinstated. The future of the land to the north would ultimately therefore be addressed separately as part of the local plan public local inquiry process.

Locational/operational need: None associated with the proposal.

Economic Benefit: The applicants have asked that Members attention is drawn to the fact that their intention is that the sale of this land should contribute to the ongoing diversification of their farm holding at Torran, and their associated development proposals including the relocation of the farmstead, the development of housing on the site of the existing farm, and the commercial development proposed at Torran Bay.

Servicing and infrastructure implications: The proposal would not give rise to any significant concerns in this regard.

Page 37 The proposal is not consistent with the policies of the adopted Mid Argyll Local Plan, in so much that it would extend the settlement of Ford beyond its presently defined limits in a linear form inconsistent with the adopted local plan policies. Latterly, consideration has been given to the planned expansion of the settlement of Ford as part of the emergent local plan process. The application site is now contained within the proposed expanded settlement boundary delineated in the 'Argyll & Bute Local Plan' (Finalised Draft) 2005. This has been the subject of public consultation as part of the local plan process and has not attracted any representations. Accordingly, significant weight can be attached to the emergent plan in the assessment of the current application.

In the context of Structure Plan Policy STRAT DC 1, which provides for the expansion of existing settlements in conformity with areas identified in the emergent plan, the proposal can now be considered consistent with the Council’s latest, and uncontested, expression of policy and should be approved as a ‘minor departure’ to the provisions of the adopted local plan.

D. REASONED JUSTIFICATION FOR DEPARTURE TO THE DEVELOPMENT PLAN

The proposal does not conform with the provisions of the adopted Mid Argyll Local Plan 1985 (1st Alt. 1989 and 2nd Alt. 1993) insofar as the development represents a linear extension of Ford which does not constitute infill, rounding off or redevelopment of the established settlement. The plan is now substantially out of date and is to be superseded by the provisions of the 'Argyll & Bute Local Plan' (Finalised Draft) 2005, which now includes the application site in the planned expanded settlement boundary for Ford. As this proposal has been the subject of consultation as part of the local plan process and as no representations have been lodged, this expanded boundary can be expected to be rolled forward into the final adopted version of the plan. With this in mind, it is appropriate to accord weight to this most recent expression of Council policy in preference to the outdated provisions of the adopted plan.

E. CONSIDERATION OF THE NEED FOR A PAN 41 HEARING

Planning Advice Note 41 recommends that Planning Authorities intending to make decisions which would represent departures from the provisions of an adopted development plan, in cases where applications are the subject of objections, should give consideration as to whether it is appropriate to hold a local hearing in advance of making any determination. It is the Council’s practice to follow this advice, and therefore in the light of the representations received in this case, it will be appropriate to hold a PAN 41 hearing in order to afford interested parties to present their case to Members before a final decision is reached.

PROPOSED ADDITION OF QUALIFYING INTEREST GRUINART FLATS SPECIAL PROTECTION AREA FOR BIRDS ISLE OF ISLAY

1 SUMMARY

1.1 The Scottish Executive has invited the Council to respond to a proposal to add an additional qualifying interest to a designated Special Protection Area for Birds as a Special Area of Conservation (SAC) under the European Union Habitats Directive. The Council’s views are to be sent to Scottish Natural Heritage (SNH) who are undertaking the consultation process, the results of which will be sent to the Scottish Ministers.

2 RECOMMENDATION

2.1 It is recommended that the Council should not raise objections to the inclusion of an additional bird species as a qualifying interest in the existing Special Protection Area.

3 BACKGROUND

3.1 The Habitats Directive seeks the establishment of a network of Natura 2000 sites to conserve natural habitats and species of plants and animals which are rare, endangered or vulnerable in the European Community. The network is to include two types of area, namely, Special Areas of Conservation (SAC’s) to support rare, endangered or vulnerable natural habitats and species of plants or animals, and Special Protection Areas (SPA’s) to support significant numbers of wild birds and their habitats.

3.2 Gruinart Flats is has been designated as an SPA since 1988, primarily in respect of its barnacle goose and Greenland white fronted goose populations, along with other species. It is now proposed to add chough (Pyrrhocorax pyrrhocorax) as an additional qualifying interest.

3.3 The site supported a winter peak mean of 42 roosting individuals and 44 feeding birds between 2001 and 2004 amounting to approximately 5% of the GB chough population. The SPA also supported an average of 4.6 breeding pairs annually during the same period, amounting to 1.3% of the GB population. SNH recommends that this level of use of the site by chough merits their inclusion as an additional qualifying interest within the SPA.

4. CONSEQUENCES OF DESIGNATION

4.1 In the event of development being proposed within an SPA, the Council is required by legislation to undertake an ‘appropriate assessment’ to determine whether ‘qualifying interests’ would be adversely affected as a consequence of proposed works. In practice, advice is sought from SNH as to the likely effects of development upon protected species and their comments and recommendations inform the Council’s assessment of the nature conservation implications of development. This arrangement is already effective in respect of the Gruinart Flats SPA, so the inclusion of considerations pertaining to an additional species ought not to be significantly more onerous than the current situation.

4.2 The EU Habitats Directive requires that only scientific factors can be taken into account in designations. Both SNH and the Scottish Executive are, however, aware of the socio- economic impact of designations, particularly where they are widespread in areas such as Islay. There is therefore a commitment to implementing the SAC programme through positive partnerships with those who live and work on the land. In terms of restrictions on development, it is often possible through discussion to modify potentially damaging proposals to avoid adverse impacts upon designated areas.

4.2 Experience elsewhere on Islay to date, has shown that the presence of chough should not necessarily be regarded as an inhibitor of development, but that their foraging and breeding requirements ought to be taken into account in order to avoid disturbance or displacement (by requiring developers to provide artificial nest sites to replace those lost in the reoccupation of derelict buildings, or by prohibiting construction works during the bird breeding season, for example). These requirements can usually be met by the imposition of conditions attached to planning consents.

4.3 As part of the designation process, Circular 6/1995 requires planning authorities to consider extant planning consents within proposed designations and to consider whether the implementation of such consents would have a significant effect on the ecological value of sites. Gruinart Flats is not an area which subject to any significant pressure for development. All the land within the SPA is identified as ‘sensitive countryside’ in the ‘Argyll and Bute Local Plan (Finalised Plan) 2005’, where development opportunities will be very limited in planning policy terms. The extant consents with the SPA are as follows:

04/00755/DET Tayovullin – demolition and replacement of dwelling (Jun 04);

05/01840/DET Garra Ellabus – alterations to dwelling (Sept 05).

These applications were subject to consultation with SNH at the time, bird interests were assessed and appropriate conditions to protect bird interests were imposed by the Council where recommended. It is not considered that the implementation of these consents would have adverse consequences for the ecological value of the redesignated site, should the additional species become protected under the current SPA.

5 IMPLICATIONS

FLOODING IN CAMPBELTOWN

1. PURPOSE

The purpose of this report is to inform the Area Committee of progress on issues affecting this Council which relate to Scottish Water’s ongoing sewerage infrastructure works in Campbeltown.

2. RECOMMENDATIONS

It is recommended that Members:-

a) Note the contents of this report. b) Instruct the Head of Roads and Amenity Services to confirm with Scottish Water that there will be insufficient funding available to finance the Low Askomil promenade option.

3. DETAIL

• Low Askomil Pipeline Route

Scottish Water initially proposed three discrete options for the new pipeline route between Quarry Green and the treatment works at Slaty Farlan. One of the proposed routes, against the seawall at Low Askomil and incorporating a promenade walkway, was some £3.5 million more expensive than Scottish Water’s favoured option.

Consideration was given to seeking additional funding from the Scottish Executive to make up the deficit between the cheaper option and the Low Askomil promenade option and thereby provide a much-needed amenity. Unfortunately, as there is no history of major flooding at Low Askomil and the wall is now in reasonable condition, the proposed scheme will not meet criteria set by the Scottish Executive for coastal defence scheme funding. On the basis that there will be no major benefits in relation to flood prevention and/or coastal protection, an application for external funding cannot therefore go forward.

• High Street Culvert

The Council has investigated various means of reducing the frequency of flooding at the High Street culvert. Last year the culvert was surveyed and jetted out to remove siltation. A new entry grill arrangement was also constructed at Dalaruan. In an effort to reduce the water table at Millknowe and hence increase the available capacity for surface water, the Millknowe Burn was recently cleaned out.

Future works being planned include a safe-working platform at Milknowe culvert for ease of maintenance and the installation of pre-warning telemetry at Dalaruan culvert to alert stand-by staff to the risk of flooding. Further investigation is ongoing into the potential for attenuating water in the Millknowe area to reduce the rate of flow of surface water entering the drainage system during flood conditions; and a cut off drain from the Ballegreggan Burn at Low Askomil is also being given some consideration.

4. CONCLUSIONS

Although ultimate responsibility for the continuing maintenance of the High Street culvert has yet to be established, it is the responsibility of Argyll & Bute Council to assess and maintain watercourses (culverted or otherwise) which are in danger of flooding non-agricultural land; on this basis, Argyll & Bute Council will continue to seek means of reducing the flow of surface water into the High Street culvert.

5. IMPLICATIONS

5.1 Policy - None 5.2 Financial – Any future works to remove water from the High Street Culvert will be funded by the Revenue Flood Prevention budget. 5.3 Personnel - None 5.4 Equal Opportunities - None 5.5 Legal – Issue of responsibilities for High Street Culvert still under consideration.

REVENUE AND CAPITAL ROADS BUDGET FOR 2006 - 2007

1. PURPOSE

To indicate to members the proposals for the Revenue and Capital budgets for the road network for 2006 – 2007.

3. DETAIL

3.1 The proposed works are split fairly evenly between Mid Argyll, Kintyre and Islay reflecting the demands on the sub-areas. 3.2 Slightly more funding is allocated in the capital budget for Kintyre to reflect the £12,500 contribution from the Capital Budget Infrastructure Improvements as highlighted in the paper to this Area Committee on 7th September 2005. 3.3 The report reflects the increased funding made available for road maintenance through the revenue budget but please note that this level of funding is still approximately £1,000,000 less than required to properly maintain the road network in line with the Road Maintenance Asset Management Plan.. 3.4 The Capital allocation is better this year however the settlement for the next financial year, 2007 -2008 is considerably less. 3.5 It is intend that most of the Capital work is completed by the end of September. 3.6 The attached appendices indicate the levels of expenditure in each area.

PROPOSED FORTNIGHTLY DOMESTIC REFUSE COLLECTION TRIAL FOR ISLAY AND JURA

1. SUMMARY

1.1 This report informs members of a proposed fortnightly refuse collection trial on Islay and Jura. The principle for trial areas was given approval at the Strategic Policy Committee on 19th January 2006 subject to reports to relevant Area Committee. A further report on the outcome of such a trial IS to be brought to the Strategic Policy Committee prior to the 2007/08 budget meeting.

2. RECOMMENDATIONS

2.1 Members approve a proposed trial on Islay and Jura for a fortnightly general refuse collection service uplift alternating with garden waste uplift. A separate brown wheeled bin will be provided for garden waste collections. The garden waste bin will be uplifted fortnightly during the growing season i.e. March to October and once every 4 weeks from November to February.

A survival recycling bag for empty cans, tins, aerosols, plastic drinks and milk bottles will also be provided and filled bags should be collected with the existing separate paper and cardboard bin. Householders who do not wish a garden waste wheeled bin can instead be provided with a free home composting bin.

2.2 With the increased garden waste composting provision, the likely implementation at Gartbreck waste disposal facility of a Pollution Prevention Control permit (PPC) and commercial misuse, the Port Ellen unmanned civic amenity skips are removed.

3. BACKGROUND

3.1 Scottish Executive Landfill Allowance Scheme Targets.

3.1.1 The Scottish Executive has set landfill allowance targets for each local Authority. These targets impose a landfill limit for each council from 2005/06 until 2009/10 with this limit tightening year on year. After 2010 it is likely targets will be even more onerous as the Scottish Executive uses this scheme to enforce compliance with European Landfill Diversion targets. This scheme has been referred to in previous SPC reports and most recently in the 19th January 2006 report.

3.1.2 Fines proposed by the Scottish Executive for not achieving these landfill limits are £25, £50, and £150 per tonne in n 06/ 07, 07/08 and 08/09 respectively. To assist in achieving these targets, a move towards fortnightly general waste collections and increased recycling and composting collections will assist in reducing landfill while increasing recycling and composting.

3.2 Recycling and Composting targets

3.2.1 In addition to the Scottish Executive Landfill Trading scheme, other recycling and composting targets that the council aim to comply with are as follows:

a) Scottish Executive targets of recycling and composting 25% of council collected waste in 2006 and 30% by 2008.

b) Argyll and Bute Area Waste Plan target of 50% recycling and composting of council collected waste by 2010.

3.3 Pollution Prevention Control (PPC) Waste Management Licensing Regime

3.3.1 European Landfill Directive and subsequent Landfill (Scotland) Regulations set strict conditions for operating landfill sites. The continued use of the landfill facility on Islay depends on the Council achieving a Pollution Prevention Control permit (PPC) issued by the Scottish Environment Protection Agency (SEPA).

A PPC permit would replace the current Waste Management licence for the Gartbreck site on Islay and puts more onerous conditions on the site operation including substantial engineering requirements i.e. impermeable lining barrier required before waste can be landfilled.

The council has a capital budget to carry out the engineering works in 2006 and this work is currently out to tender. Assuming a PPC permit is issued by SEPA, it is highly likely that the conditions of waste acceptance at the site will leave the practice of unstaffed open skips questionable from a PPC permit compliance aspect, thus leaving the council open for potential prosecution. Western Isles Council were recently prosecuted and fined for receiving unchecked waste at one of their landfill sites and Argyll and Bute Council could be in a similar position should the Port Ellen open skips continue.

3.3.2 With the Council adopting the “polluter pays” principle forced by European and National Legislation and Guidance to business waste producers, unstaffed open skips are being misused by some commercial operators who are using these for illegal disposal. It is estimated that the skips at Port Ellen includes up to 50% of commercial waste. It is estimated that approximately £20,000 per year potential income to the council is being lost due to the misuse of these skips.

4.1 Current Refuse Collection and Recycling Facilities on Islay and Jura.

4.1.1 In line with most of Argyll and Bute , householders on Islay and Jura receive a weekly refuse collection plus an optional paper cardboard recycling uplift in a separate wheeled bin. In addition there are over 20 recycling points for textiles, cans, glass and plastic drinks and milk bottles.

The local community recycling group Rejig service the textile, can and plastic bottle banks and the council collect from the glass banks.

At the Gartbreck recycling and landfill facility there are also recycling containers or bays for scrap, fridges/freezers, other white goods, waste electrical equipment, engine oil, cooking oil plus a composting area. These services/facilities combined with the good work carried out by local council staff and Rejig has resulted in recycling on Islay and Jura going from 3% in 2003 to over 20% recycling and composting in 2005.

This is an impressive improvement in a 2 year period and the council wishes to build on this with other kerbside options for garden waste, plastic bottles and cans. With the current funding available, this can only be achieved by reducing general waste collections to fortnightly and supplementing these with garden waste collections plus survival bags for plastic and cans to be collected in the paper and cardboard recycling bin.

4.1.2 Garden waste would be composted at Gartbreck site for site restoration or for use by grounds maintenance staff on Council ground. The council has a capital kerbside recycling budget to fund additional recycling/composting bins, bags, additional shredding equipment (which will be required for handling larger green waste amounts) and small conveyer system to help Rejig with the sorting of plastic bottles and cans (possibly the council also with the paper and cardboard).

4.1.3 The proposed trial would commence in the summer of 2006 and would run at least until the end of 2006/07 financial year with its evaluation included in the SPC report as part of the 07/08 budget process.

4.1.4 Householders will be given the choice of a garden waste wheeled bin or a home composting bin. Any householder who does not already have a paper and cardboard bin can still be provided with one should they wish and all who have a paper and cardboard bin will be provided with a supply of survival sacks for plastic and cans.

Any householder who has a small paper and cardboard bin or a small

domestic wheeled bin i.e. 140 or 180 litre bin, can swap for a larger size but anyone who wishes an additional 240 litre general waste bin would have to purchase it.

Changes may have to be made to the frequency of commercial uplifts to ensure an efficient use of resources.

5. IMPLICATIONS

Legal: The trial proposed will assist with landfill diversion targets as per Scottish Executive Landfill Trading Scheme administered on their behalf by SEPA.

Policy: Will assist with waste diversion and recycling targets as per the Area Waste Plan for Argyll and Bute. Changes to general waste refuse collection may move towards more compulsory collection of certain waste.

Financial: The trial will assist in avoiding stringent financial penalties from the Scottish Executive if landfill allowances are exceeded, particularly in future years with penalties rising to £150 per tonne.
