On se rappellera qu’en décembre dernier, les députés avaient adopté deux amendements à l’article 1er du projet de loi, légalisant les pratiques de téléchargement des œuvres via les réseaux peer-to-peer : la fameuse « licence globale », contre l’avis du Gouvernement, et tout particulièrement du ministre de la Culture, Renaud Donnedieu de Vabres. Nouveau rebondissement dans la nuit de lundi à mardi… le Gouvernement décide de retirer l’article 1er du projet de loi… provoquant la fureur d’un certain nombre de députés, notamment des députés PS. Jean-Marc Ayrault dénonce la volonté de « bafouer les droits du Parlement ». Christian Paul utilise quant à lui la notion de « contrefaçon de démocratie ». Malgré la confirmation de la légalité de cette procédure de retrait d’article par le Président de l’Assemblée (décision du Conseil constitutionnel du 26 juillet 1984), les députés PS bien renseignés indiquent qu’un tel retrait n’a jamais été fait depuis 45 ans et qu’il sera soumis au contrôle du Conseil constitutionnel.

Depuis 1958, se sont succédé Jacques Chaban-Delmas (1958-1969, 1978-1981 et 1986-1988), Achille Peretti (1969-1973), Edgar Faure (1973-1978), Louis Mermaz (1981-1986), Laurent Fabius (1988-1992 et 1997-2000), Henri Emmanuelli (1992-1993), Philippe Séguin (1993-1997), Raymond Forni (2000-2002), Jean-Louis Debré (2002-mars 2007), Patrick Ollier (mars-juin 2007) et Bernard Accoyer (depuis juin 2007). Lors de sa première séance, l’Assemblée nouvellement élue, présidée par son doyen d’âge, élit son Président. Cette élection, acquise pour toute la durée de la législature, a lieu au scrutin secret à la tribune. Si la majorité absolue des suffrages exprimés n’a pas été obtenue aux deux premiers tours de scrutin, au troisième tour, la majorité relative suffit et, en cas d’égalité de suffrages, le plus âgé est élu.

A major reason for this was contingent: the selection of a candidate who three months before polling day was placed under investigation for embezzling public funds. Other reasons were more structural, in particular the progressive dislocation of the bipolar multipartism which had characterised France’s party system for over four decades and the resultant strategic divisions within the Right. Although broadly chronological, this analysis of the long electoral cycle of 2016–17 assesses the respective importance of proximate and long-term factors in the Right’s defeat.
