Selling Tobacco, Electronic Cigarettes and E-Liquids the Consequences Selling Tobacco, Electronic Cigarettes and E-Liquids • You must be registered with the Scottish Government to sell tobacco products, electronic cigarettes or e-liquids by retail. Register online at: www.tobaccoregisterscotland.org/ • It is an offence to supply a tobacco product, cigarette papers, electronic cigarettes or e-liquids to anyone under 18 (even if they claim it is for an adult) • It is an offence for any person under 18 to buy a tobacco product or cigarette papers. • It is an offence for any person over 18 to knowingly buy or attempt to buy a tobacco product or cigarette papers on behalf of someone under 18. • Cigarettes must only be sold in packs of 20 or more. It is illegal to sell single cigarettes. • The sale of cigarettes via a vending machine for use by customers is prohibited. The Consequences of Not Complying with the Law: There are serious consequences for those who do not comply with tobacco sales legislation. Trading Standards Officers have powers to issue Fixed Penalty Notices for offences such as selling to someone aged under 18, not being a registered seller, and not displaying the required notice (see below). The fixed penalty has been set at £200. This will increase by £200 for every offence committed within a two year period. It should be noted that a fixed penalty can be issued to either a sales assistant, the owner of the premises, or both. If a retailer is found to be in breach of tobacco sales legislation three times within a two year period, the local authority can apply to the courts to have the retailer banned from selling tobacco. Those found selling tobacco products, electronic cigarettes or e-liquids illegally when they are not registered to do so can be fined up to £20,000 and sent to prison for six months. Notice Requirement: The following notice must be displayed in a prominent position, which is clearly visible to anyone purchasing cigarettes, at every retail premises at which tobacco is sold. It must not be less than 297mm x 420mm (A3), with no character being less than 36mm in height. Electronic cigarettes or e-liquids do not require a notice. 1 Display of Tobacco Products, Smoking Related Products and Pricing: All cigarettes, cigars, rolling tobacco, or any other product containing tobacco must not be displayed for sale to the public. Electronic cigarettes or e-liquids can be displayed Additionally if you sell products that contain tobacco then anything which is classed as a “smoking related product” must also be removed from view. Herbal Tobacco • Cigarette holders However the legislation does allow tobacco and smoking related products (items in List 1) to be displayed temporarily in some limited circumstances: - 1. Following requests to buy or see tobacco or smoking related products by a customer, or 2. Incidental displays while staff are actively – 1. assessing stock levels for the purposes of stock control, 2. restocking, 3. undertaking staff training, 4. pricing, 5. cleaning the storage unit, 6. refurbishing the storage unit, or 7. refitting the storage unit. Only part of the storage unit can be uncovered at any time (no more than 1000 cm2). 2 Display of Prices Retailers must ensure that they are complying with the Price Marking Order 2004 which requires the price of all goods to be clearly displayed in store. There is specific legislation for the display of prices for tobacco and smoking related products. You are free to use more than one of these methods. 1. Poster Style Price List, 2. Counter Tobacco Catalogue, or 3. Price Labels. All price lists and labels must be written in: • Helvetica or Arial bold or plain font, black on a white background. • In the same font size throughout the text. • All the letters should be in lower case except for the first letter of a word which may be in upper case. The only information that can be given about tobacco products is the brand name, the price, the number of cigarettes in a pack, or the weight of tobacco in the pouch. For cigars, the country of origin and dimensions; and for pipe tobacco, the cut and type of tobacco used can also be given. 1. A Poster Style Price List A poster style price list must - 1. Be titled ‘Tobacco Products/Smoking Related Products Price List’ 2. Not exceed 1250cm2 (e.g. A3 paper size) 3. Not have any border or frame 4. Use wording with characters no higher than 7mm (30 point font). 5. Be limited to one price list for each separate area where tobacco and smoking related products are located and can be paid for (or if there is more than one till at this location one price list per till). Tobacco Catalogue (under the counter) Only one product catalogue can be located at each point of sale. It must be kept out of view until it is requested by a customer (over the age of 18). The catalogue must only be displayed for as long as is necessary for the customer to obtain the information they need. Wording in the catalogue must not be larger than 14pt using either Helvetica or Arial bold or plain font on a white background. Pictures are allowed but if they are used they must be of the actual product and be no more than 50 cm2. Shown below is an example of how such a catalogue could look with pages containing both pictures and text. Individual Price Labels • May be placed on covered shelving or on the front of the storage unit. • The wording must use either Helvetica or Arial bold or plain font on a white background. • The size of the font must be no larger than size 14pt font (4mm). • Each label must be no larger than 9 cm2. • Only one label per product line. • Only contain the brand name, the price and the number of units per pack.     Take a stand against Illegal Tobacco The current state of play Illegal tobacco sales in the UK continue to undermine legitimate business whilst providing criminals with huge profits. The continued availability of cheap illegal tobacco in communities across the country undermines attempts to prevent underage people accessing tobacco as illegal tobacco sellers do not care who they sell to. The smuggling of tobacco is a multibillion pound industry for criminals. The high level of tax in the UK, the large difference in the tax rates between the UK and other countries, and the openness of international borders creates the perfect environment for criminals to operate. Criminal organisations and opportunist smugglers are targeting the lucrative UK tobacco market. HM Revenue & Customs' 2012/13 estimates show that revenue theft could be as much as £2.9 billion.1 For a criminal, tobacco smuggling is relatively easy. Tobacco products come in small packages, are highly valuable and easy to transport; whilst the risks of detection, prosecution and conviction, though improving, are low relative to the huge profits. For example, a single container of illegal cigarettes can provide criminals with a profit of up to £2 million.2 It's clear more needs to be done! Did you know? Oktober 2007 Fusionskontrolle: Kommission genehmigt geplante Übernahme von Altadis durch Imperial Tobacco unter Auflagen Die Europäische Kommission hat nach der EU-Fusionskontrollverordnung die geplante Übernahme des französisch-spanischen Unternehmens Altadis durch das britische Unternehmen Imperial Tobacco genehmigt. Die Entscheidung der Kommission ist an die Bedingung geknüpft, dass das neue Unternehmen auf bestimmten nationalen Märkten mehrere Marken für Tabak zum Selbstdrehen, Pfeifentabak und Zigarren veräußert. Die Kommission hatte bei der Prüfung des Fusionsvorhabens in Bezug auf diese Märkte wettbewerbsrechtliche Bedenken angemeldet. In Anbetracht der genannten Verpflichtung kam die Kommission zu dem Schluss, dass der Zusammenschluss den wirksamen Wettbewerb im Europäischen Wirtschaftsraum (EWR) oder in einem wesentlichen Teil desselben nicht erheblich behindern dürfte. Imperial Tobacco Group plc ist in der Herstellung und dem Vertrieb einer breiten Palette von Tabakerzeugnissen (Zigaretten, Drehtabak einschließlich Zigarettenpapier, Pfeifentabak und maschinengefertigten Zigarren) tätig und in mehr als 130 Ländern präsent. Das Portfolio des Unternehmens enthält die Zigarettenmarke West, die Drehtabakmarken Drum, Golden Virginia und Van Nelle und die Zigarettenpapiermarke Rizla.
