Tobacco 1997-34 Tobacco 1997-34 TOBACCO ACT 1997 TOBACCO (MINIMUM RETAIL PRICE) NOTICE (No.5) 2020 LN.2020/468 In exercise of the powers conferred on him by section 4A of the Tobacco Act 1997, the Collector of Customs has made the following notice- Title. 1. This Notice may be cited as the Tobacco (Minimum Retail Price) Notice (No.5) 2020. Commencement. 2. This Notice comes into operation on the 18 December 2020. Minimum retail prices for tobacco. 3.     Selling Tobacco, Electronic Cigarettes and E-Liquids • You must be registered with the Scottish Government to sell tobacco products, electronic cigarettes or e-liquids by retail. Register online at: www.tobaccoregisterscotland.org/ • It is an offence to supply a tobacco product, cigarette papers, electronic cigarettes or e-liquids to anyone under 18 (even if they claim it is for an adult) • It is an offence for any person under 18 to buy a tobacco product or cigarette papers. • It is an offence for any person over 18 to knowingly buy or attempt to buy a tobacco product or cigarette papers on behalf of someone under 18. • Cigarettes must only be sold in packs of 20 or more. It is illegal to sell single cigarettes. • The sale of cigarettes via a vending machine for use by customers is prohibited. The Consequences of Not Complying with the Law: There are serious consequences for those who do not comply with tobacco sales legislation. Trading Standards Officers have powers to issue Fixed Penalty Notices for offences such as selling to someone aged under 18, not being a registered seller, and not displaying the required notice (see below). The fixed penalty has been set at £200. This will increase by £200 for every offence committed within a two year period. It should be noted that a fixed penalty can be issued to either a sales assistant, the owner of the premises, or both. If a retailer is found to be in breach of tobacco sales legislation three times within a two year period, the local authority can apply to the courts to have the retailer banned from selling tobacco.

  • TOBACCO (To Be Filed by Manufacturers Who Do Not Participate in the Master Settlement Agreement) for Sales Made Within Michigan During the 2002 Calendar Year
    ANNUAL CERTIFICATION OF COMPLIANCE FOR MANUFACTURER OF CIGARETTES AND/OR “ROLL-YOUR-OWN” TOBACCO (To be filed by manufacturers who do not participate in the Master Settlement Agreement) For sales made within Michigan during the 2002 calendar year Amendments in 2002 to the Tobacco Products Tax Act (1993 PA 327) support enforcement of the escrow requirements for tobacco product manufacturers who are not participating in the tobacco Master Settlement Agreement (1999 PA 244). The amendments require that non-participating manufacturers (NPM’s) provide to the State, and anyone who sells their cigarettes and/or ‘roll-your-own’ tobacco for consumption in Michigan, an annual certification of compliance. By providing the certification, they are attesting to the fact that they have met their escrow obligation under Act 244. The amendments prohibit anyone in Michigan from acquiring, possessing, or selling cigarettes and/or ‘roll-your-own’ tobacco manufactured by an NPM who has failed to provide the certification. The Act provides severe penalties for NPM’s, or anyone selling the cigarettes and/or ‘roll-your-own’ tobacco of NPM’s, for failure to comply with the requirements. The cigarettes, including ‘roll-your-own’ tobacco, of an NPM who has failed to provide the annual certification required by the Tobacco Products Tax Act are subject to seizure or confiscation from anyone in possession of them. If an NPM or any other person does not comply with these requirements, they may be subject to a civil fine not to exceed $1,000.00 per violation, in addition to other penalties that may be imposed under this act or the revenue act.
