    Selling Tobacco, Electronic Cigarettes and E-Liquids • You must be registered with the Scottish Government to sell tobacco products, electronic cigarettes or e-liquids by retail. Register online at: www.tobaccoregisterscotland.org/ • It is an offence to supply a tobacco product, cigarette papers, electronic cigarettes or e-liquids to anyone under 18 (even if they claim it is for an adult) • It is an offence for any person under 18 to buy a tobacco product or cigarette papers. • It is an offence for any person over 18 to knowingly buy or attempt to buy a tobacco product or cigarette papers on behalf of someone under 18. • Cigarettes must only be sold in packs of 20 or more. It is illegal to sell single cigarettes. • The sale of cigarettes via a vending machine for use by customers is prohibited. The Consequences of Not Complying with the Law: There are serious consequences for those who do not comply with tobacco sales legislation. Trading Standards Officers have powers to issue Fixed Penalty Notices for offences such as selling to someone aged under 18, not being a registered seller, and not displaying the required notice (see below). The fixed penalty has been set at £200. This will increase by £200 for every offence committed within a two year period. It should be noted that a fixed penalty can be issued to either a sales assistant, the owner of the premises, or both. If a retailer is found to be in breach of tobacco sales legislation three times within a two year period, the local authority can apply to the courts to have the retailer banned from selling tobacco.

    To Whom it may concern ISO Test methods for cigarette tar and nicotine content are outdated and unrepresentative of the actual yield and toxins intake due to smoker compensation - Countries should adopt the Health Canada Intense test method, like RIVM Holland The old and outdated ISO test criteria for cigarette tar and nicotine content used by the HK Government Lab is way out of date. The industry deliberately perforates the filter and paper of the tobacco rods with tiny holes to ‘cheat’ the current ISO machine test methods. What actually happens is the smokers wrap their fingers and of course mouth around the filter to compensate for the additional dilution air being sucked in through the perforations. The ISO smoking test machine is not real world, does not compensate by blocking the holes and hence reveals test results that are far, far lower than the smokers actually inhale. RIVM, the Dutch Ministry of Health, has adopted the Health Canada Intense smoking test criteria which better reveals the actual tar and nicotine in each cigarette rod since they tape over the perforated holes in the same way that the smoker compensates with fingers and mouth, to seal the holes - and then test the actual values. Attached herewith you can see the vast disparities as revealed in the RIVM test data which show the level of toxics which the smokers actually inhale versus the mythical ISO data preferred and provided by the manufacturers. Countries Kong need to switch to the Health Canada Intense method of cigarette testing asap and inform the public accordingly of the actual level of toxins they inhale when they smoke cigarettes.

It produces three of the top five worldwide cigarette brands: Winston, Mild Seven and Camel. Other international brands include Benson & Hedges, Silk Cut, Sobranie of London, Glamour and LD. With headquarters in Geneva, Switzerland, and net sales of USD 8 billion in the fiscal year ended December 31, 2007, Japan Tobacco International has more than 22,000 employees and operations in 120 countries. Since April 2007, Gallaher Limited (“Gallaher”), the UK-based tobacco products manufacturer, has also formed part of the Japan Tobacco Group. In this response to the FTC Document, we use the term “JTI” to refer collectively to Japan Tobacco International and Gallaher. JTI, which has its UK headquarters in Weybridge, Surrey, has a long-standing, significant presence in the UK market. Its UK cigarette brand portfolio includes Benson & Hedges, Silk Cut, Camel, Mayfair, Sovereign and More, as well as a number of other tobacco products including cigars (such as Hamlet), roll-your-own tobacco and pipe tobacco. JTI manufactures product for the UK market at sites in the UK (in Northern Ireland and Cardiff) and outside it (for example, in Germany).     38 2000 Tobacco Industry Projects—a Listing (173 pp.) Project “A”: American Tobacco Co. plan from 1959 to enlist Professors Hirsch and Shapiro of NYU’s Institute of Mathematical Science to evaluate “statistical material purporting to show association between smoking and lung cancer.” Hirsch and Shapiro concluded that “such analysis is not feasible because the studies did not employ the methods of mathematical science but represent merely a collection of random data, or counting noses as it were.” Statistical studies of the lung cancer- smoking relation were “utterly meaningless from the mathematical point of view” and that it was “impossible to proceed with a mathematical analysis of the proposition that cigarette smoking is a cause of lung cancer.” AT management concluded that this result was “not surprising” given the “utter paucity of any direct evidence linking smoking with lung canner.”112 Project A: Tobacco Institute plan from 1967 to air three television spots on smoking & health. Good penetration has been achieved, with Sovereign accounting for about 2 1/2 % of the market . Gains have been from Benson & Hedges customers (who would probably otherwise have switched to Lambert & Butler) and from Lambert & Butler customers . Sovereign was launched specifically to attack Lambert & Butler (at the lower end of the market), because Benson & Hedges customers seemed to be converting to Lambert & Butler on price grounds . This is a trend in the cheaper end of the market, which now accounts for about 30% share. Sovereign retails at £2 .65 and Lambert & Butler at £2 .75, although both are discounted in supermarkets . Other competitive brands tend to be Royals (24s, but now also in a 20 pack at £2.75) and Mayfair (£2.59), and probably also Embassy Regal and JP Superkings. Sovereign advertising has employed a jester, a joke in the visual and emphasis on price . There has also been sampling activity and direct mail offering money off. Experience has indicated that price reductions are much more motivating to consumers than free gifts or other offers . The strategy has been to market price marked packs where possible, but plain packs in supermarkets to allow for discounting . This also applies to Lambert & Butler . The belief is that Sovereign users are likely to have a repertoire of brands and to be very price sensitive .
