We understand that all work shall be subcontracted out. O-A-K understands that, as the Construction Manager-At-Risk, it will be our responsibility to provide a complete and functional reconstruction of Estero Boulevard in 5 to 7 discreet segments over a period of approximately 8 to 10 years. One of the most challenging segments of this project will occur in the first segment - also referred to as the ‘Core Area’. Within this area there are approximately 1,225 properties of which 1,063 are residential and the remaining are businesses. We will be working closly with the County, the Town of Fort Myers Beach and the residents and businesses within each of these individual segments to ensure the needs, concerns and requests of each are listened to and addressed in a timely manner. a) Construction activities within coastal environments

Our team is very sensitive to ensuring that the environment in and around the work zone is always protected, safe and clean.

Although this project falls outside the coastal setback and general permit line according to Florida Department of Environmental Protection, O-A-K will consult with Lee County’s CCCL permit manager, David Kriger, Environmental Specialist III; and his field representative Jennifer Cowart, Engineering Specialist II to insure that a cooperative effort is made to protect the dunes and beach from any impact from construction. We also will require that erosion control plans be submitted and followed by all subcontractors using best management practices when performing de-watering or excavation that may affect the conditions of the SFWMD and NPDES permits that we will obtain and enforce.

During construction it will be our responsibility to ensure the construction and surrounding areas are safe and free of flooding and flying debris during storms and the potential tropical storm and/or hurricanes. We will also be taking into account tidal changes.

Sea turtle nesting season begins May 1st and ends on October 31st each year. Our team members will ensure that during evening work, should this be permitted, all lights will be shielded from the beach and we don’t anticipate working within the turtle nesting areas. b) Efforts to minimize extended impacts to adjacent properties and facilities users

O-A-K will, through our public outreach program, give prior notice to all property owners of any activities that will affect their facilities, particularly business. We will direct the public to business access through signage and in some cases construct temporary entry/exits. Excavating across side streets onto Estero Blvd. will take place as often as possible during night time or low volume periods depending on County authorization. Most importantly, we will instruct and monitor our subcontractors to assure that work required in access areas is completed as rapidly as possible and in low volume periods.

O-A-K realizes that peak season, according to public websites and observations by our staff and others, generally runs from mid-December through mid-April. Generally the best way to handle this is to keep a fixed lane pattern in place during that time so as to avoid confusing the traveling public during their stay. We therefore schedule long duration activities during this period so as to minimize interruption of the traffic flow established in the MOT plan. Also during this period, we will not schedule sidewalk demolition activities in front of businesses where foot traffic is their main mode of access. There are also “short peaks” during the off-season that will require allowances in the schedule for delayed progress. These include those events listed above. In these cases also, we believe that prior notification and consistency in the traffic pattern leads to less interruption than changes during those event periods. We will therefore not schedule work that will require lane closures and lane shifts during these times. d) Maintenance of Traffic during construction (This includes pedestrian and cyclist MOT)

At O-A-K, one of our great assets is our trained and certified MOT supervision staff. This skill set will aid us in our review and suggestions regarding the MOT design. This also allows us to recognize what is and what isn’t working during the construction phase and to make corrections as may be required. We understand that the actual work on the project is not to be self-performed, but our certified flaggers will be available in emergency situations or when temporary needs arise in order to keep traffic flowing. As for pedestrian and bicycle traffic, we intend to guide them through the construction zone using signage, ramps, fencing and barricades to create a safe “path” through each affected area. e) Utility Coordination

We know that the town of Fort Myers Beach has water, gravity sewer and force main running the length of the project and that some of this will be replaced or re-located as part of this project. We intend to liaison with them both prior to and during any activities that affect these services. We also will invite them to be on-site to observe and participate in any pressure and bacteriological testing should they wish to. We will enforce the Florida 811 law with all of our subcontractors regarding location and protection of all existing utilities including, but not limited to, buried and overhead electric, cable and telephone and buried natural gas lines. We will hold pre-construction meetings for all involved or potentially affected utility entities and encourage their attendance at these and our construction progress meetings.

Utilization of LASER scanning will allow us to capture all of the visible improvements during our first pass through during survey. The use of the scanner eliminates returns to the job and provides greater detail of existing conditions and grades.

The RFQ emphasizes very tight time frames - We can do enough data collection in one day that it would take a conventional field crew more than a week to do. What this means is we are 3 to 5 times faster getting the critical data to the engineer of record. Other surveyors would have to have at least 3 times the number of staff dedicated to this job than we do. This is time off the front end of the job. Normally, for a 5 to 6 mile road job you would need to allocate about 2 to 3 months for the survey visible improvement data collection. We could do a job of that length in less than a month.

The RFQ emphasizes minimal disruption to the pedestrian walks and traffic way. The use of LASER scanning allows us to do our surveying without having to send our field staff out into the pavement areas. This minimizes disruption and enhances safety. f) Construction Inspection Services

O-A-K has an established Quality Control Program to perform inspection and testing of all items of work required by the technical specifications. This QC Program ensures conformance to applicable specifications and plans with respect to materials, workmanship, construction, finish, and functional performance. The QC Program has proven effective for control of all construction work performed and specifically includes surveillance and tests required by the technical specifications, and any other activities deemed necessary by O-A-K to establish an effective level of quality control as expected by the owner.

The QC Program Administrator is Leo Smith. Mr. Smith exceeds the minimum qualifications for Program Administrator as outlined in AC-150/5370-10F. g) Public Information Plan

Community awareness and proactive, constant communication with affected parties will be critical to the success of Estero Boulevard improvements. In a project such as this one, EVERYONE is affected by the construction—property owners, business owners, residents, workers and visitors. To “kick-off” the project, a newsletter will be mailed to property owners, businesses and residents on Fort Myers Beach. The newsletter will inform the public of the upcoming project, what to expect during construction, and who to contact with questions or concerns. A 24-hour toll-free telephone hotline, website address and email will be provided in the newsletter. Notifications will be made to media outlets to further inform the public about the upcoming project and will continue throughout construction.

Prior to construction of each segment, our Public Information Consultant (PIC) will mail a postcard announcing a preconstruction public information meeting where property owners, businesses and residents within the construction zone will have an opportunity to view plans and have one-on-one discussions with the project team (including the designer, O-A-K, Lee County staff and the Town of Fort Myers Beach). Smaller group meetings and one-on-one meetings will be scheduled as necessary throughout construction. Posted signs and maps will be used during construction to help pedestrians safely navigate around construction areas.

The PIC will work as an extension of O-A-K and Lee County staff to provide the community with up-to- date construction information about all aspects of the project. PIC staff will attend construction meetings to ensure upcoming activities are relayed to the public prior to the event. In addition, our PIC will have telephone contact availability with O-A-K’s Senior Project Manager, Leo Smith, 24-hours per day. This provides the team the ability to resolve issues immediately and “get the word out” to the public via flyers, email or media in the event that unanticipated traffic or utility disruptions occur. Maintaining business access and utility services for customers is crucial to promoting project acceptance.

In the case of planned utility disruptions or events, residents will be notified via door-to-door flyers, email or website as determined by the Lee County and Town of Fort Myers Beach staff. In the case of unplanned emergency utility disruptions or events, the emergency plan will be implemented to quickly communicate the disruption and inform residents of the expected service restoration time and plan.

Annual events are an important part of a municipality’s economy. As part of our public involvement plan, we will track events from smaller events to large annual events such as the Shrimp Festival scheduled for March 14 - 15, 2015 and the American Sand Sculpting Championship and Beach Festival scheduled for November 21 - 30, 2014. We will work with event coordinators to ensure construction activities don’t interfere with the success of their events.

O-A-K and all of our subcontractors will be required to carry point-of-contact cards that will be given to the public and the media in the field directing them to contact our PIC for information concerning the project. This allows the contractors to continue working uninterrupted, and ensures that the public and media are receiving the most timely and accurate information through one single point of contact. Politically sensitive issues will be immediately brought to the attention of Lee County personnel and may need to involve assistance from Town of Fort Myers Beach personnel.

Many community awareness techniques have been used in the past by our team including project post cards, newsletters, flyers, point-of-contact cards, project website and social media, variable message boards, posted signs and maps, local media and one-on-one contact. For projects located in heavy business areas, we use Business Information Surveys to gather contact information, hours of operation, and delivery times. While the combination of these techniques works well, the crucial element to the public information plan, especially during construction, is providing a 24-hour toll-free telephone hotline. Our PIC staff will be on-call around the clock to speak with property owners, business owners and residents. We believe it is imperative to have someone available to answer resident and business concerns and questions, and resolve construction issues at all times. With in-depth technical knowledge of transportation and infrastructure projects, PIC staff can resolve many typical issues without having to involve O-A-K. However, on more complex issues, PIC’s first call is to O-A-K to resolve the matter timely. This quick response process establishes trust in the project team and maintains goodwill toward Lee County as well as the Town of Fort Myers Beach.

Along with the public information plan submitted here by our proposed sub- consultant, we would like to work with Lee County Transit to promote the trolley program as the most effective and worry-free way to get to the beach and back. We see this as not only a way to help ease traffic during construction, but also to encourage people that try the trolley to continue to use it long term.

Construction Scheduling

Scheduling is key to bringing a project in on time and on budget. Owen-Ames-Kimball believes in using project schedules as a proactive tool to stay on schedule, not a passive method of reporting what we assume will happen. We will utilize EADOC’s system with our own Microsoft Project as support to further breakdown the schedule parts and to track other important project data. Every office and project trailer is equipped with computer capability for Project usage in the office or in the field. These computers are linked by the internet to our main exchange server and they are used for short-term schedules and field work to update the project manager, job site superintendent and general superintendent.

(Con’t) It is important to provide a careful review by environmental, regulatory and governmental agencies (i.e. Lee County, Fort Myers Beach Fire Control District, SFWMD, FPL, Lee County Utilities, etc.) that have jurisdiction over this project. Their review and input early and continuously eliminates delays and/or costly corrective work. These elements will be factored into each schedule. Any potential delivery problems need to be exposed early in the project so unnecessary delays can be avoided later. Construction techniques and safety matters will also need to be considered as the schedule is developed for this project. We understand that this entire project will be completed in 5 to 7 discrete segments. Cash flow projections, generated by proper scheduling techniques, are information that you may need to provide proper planning. To accomplish this, it is important to begin planning and scheduling even during the design phase so that construction means and methods, procedures, material and equipment are considered and integrated into the project at an early date.

Our scheduling is usually done through the use of a computer generated Critical Path Management schedule. Even though we prepare the schedule, we request and encourage input from you and subcontractors. The schedule is presented to all bidders at the pre-bid meeting so they are fully aware of their own schedule requirements prior to bidding. We invite input from the successful bidders after the bid process, to assure further commitment.

Furthermore, subcontractors are interviewed prior to the award of their contract, to ensure their understanding and acceptance of the schedule. Subcontractors and suppliers may also be required to complete a Material/Shop Drawing Delivery Form that assists in identifying key delivery dates they must commit to and meet. Once construction commences, the schedule is discussed at each progress meeting. A two-week segmented schedule is also provided at these meetings so each subcontractor is aware of their commitment for the upcoming period, as well as the overall schedule commitment.

The schedule also includes Owner and Engineer related activities and decision time frames, as well. In some instances, phasing of the project is required to allow the continuation of existing operations, to take advantage of weather, price or material availability constraints, or to simply improve on the overall construction schedule. We understand the impact that construction progress has on productivity, costs and safety. Our scheduling approach to these often-uncertain environmental factors provides the best method of project management control.

Total Program Schedules:

• Typically are generated in the concept planning phase of a total project management contract. • Total Project Schedules map planning, design, permitting, estimating, bid pricing, construction, and project turnover activities in order to form a baseline map to fulfill owner long-term project needs. • Are initiated by office project management staff and finalized by the project manager after consultation and review with the general superintendent. • Are communicated to the Project Team - the County, Design Team, and Owen-Ames-Kimball personnel - in order to track the overall project. • Become base activities for more detailed components scheduling, i.e. design development may be broken down further.

By accurately targeting the ultimate build-out budget costs of each trade early-on in design, the project team can identify project systems to accurately fulfill the expressed needs of the Owner.

Bids receipts can be compared against a marketplace benchmark budget. Awards are made from a knowledgeable perspective as to market costs.

Proposals for added work, whether initiated as change orders brought into play by subcontractors, or whether initiated by a scope change in the Owner’s program, can be accurately reviewed to ensure validity and fair market value for the price paid.

The cost estimating process starts immediately in the design phase of the project. Initial estimates are made using gross systems data such as per acre costs for site development. As drawings move through design development in to working drawings, a base number is established on trade detailed quantitative estimates. Thereafter, budgets are updated item-by-item as working drawings in process are reviewed.

Project information is clearly compiled and released to industry information sources such as Dodge, Construction Data Reports, and building industry associations. Plans are made available to bidders online, mailing them a thumb drive or in our office plans room. In the instance of bidders from out of the area, overnight mail is made readily available through our office. Questions during bidding are encouraged and our firm acts as an information pipeline between the Design Team and prospective bidders. The object of these combined actions is to get the most information possible to all prospective bidders and make documents readily available to the marketplace.

Value Engineering During Systems Selection and Construction As is typical to most value engineering efforts, systems identified for consideration for the project by the design team are evaluated from the perspective of O-A-K as to cost and viability within the local construction marketplace. A second value engineering method, often overlooked by many other construction firms, is used successfully by Owen-Ames-Kimball. Subsequent to receipt of trade bids from contractors, the Company conducts pre-award conferences with the apparent low bidder to ensure completeness of the proposal and ability to perform. At these pre-award conferences a clear and concise format for introduction of value engineering suggestions by trade contractors is reviewed.

Best Management Practices During the Construction Process This is standard procedure at Owen-Ames-Kimball Company. We believe that our firm carries the finest reputation for sound, efficient, and fair management. When the price of the project is established—through trade contractor bidding—our reputation is a key ingredient in cost control of the end product. During construction, the high regard our Company carries to the marketplace extends to the project in terms of reasonable change order pricing when necessary and absence of claims for unjustified cost increases.

An Accurate Accounting System The above steps, key to the “subjective side” of cost control, must be coupled with a structured approach to cost accounting that is timely. Cost Control From the beginning of the project, we approach cost control as an ongoing effort that includes value delivery and trade management. In order to provide you with the best value and highest quality we work with the designer to identify more economic ways to accomplish your design goals. We buy within the marketplace at the best possible price. We maintain an extensive history of job costs on all of our construction projects, which is used for budgeting and cost comparisons. We include a design and construction contingency with each budget we prepare as well as in our master budget. Charges against this contingency and its balance are always included in our status budgets—this information is readily available to you at any time.

(Con’t) Additionally, we provide a very detailed and comprehensive cost accounting system that provides you the exact financial status of the entire budget at any time. Through our preliminary budgets, master budget, project cost summary reports, purchase order files, change order logs, field work order logs and our monthly invoices, we provide a system to not only report the costs—but to maintain them as well.

Through our system of budget and cost control, current cost-versus-budget information is available at any time. We maintain an extensive history of job costs on all of our construction projects, which is computerized and readily available for budgeting and cost comparisons. The initial budget is based on information as it becomes available from the designer and founded on our historical job cost records from past projects and conditions. As drawings are further developed and defined, the pricing becomes more detailed, including actual take off and unit pricing.

Our total program of cost management includes constant monitoring of the budget and provides cost control recommendations necessary to complete the work within the budget requirements. These steps, along with others, ensure that you receive the best value for your money.

Describe your firm’s approach to creating open book GMPs, one page maximum.

At O-A-K, our approach to Open Book GMP is rather straight forward. We first develop a spreadsheet showing all rates for our general conditions items and an initial projection of the time their use will be required. We do the same with our personnel rates. We use past unit costs from similar projects to develop an original estimated maximum price. As plan development goes forward, we add in prices obtained from bidders along with our mark-up and replace the historical data with firm unit prices. We present to the county ALL prices we receive from qualified bidders to show that we are offering the most cost effective package for the required work. There will be times that the lowest price may not be the best price and we will inform you of that type of situation (e.g. Local vs. out of area contractors, DBE vs. non-DBE). Contingency amounts are agreed to during this process and become part of the maximum price. When design and pricing has reached the level where we feel assured that there will be no surprises of major consequence to either us or the county, we present our GMP. All involved parties know at each point in the process exactly where the actual quotes are replacing estimated prices and making the cost to the county closer to the GMP. As the project progresses, we include the amount remaining for all pay items, along with the balances in the contingency. We DO NOT spend contingency funds without the prior consent of the owner.

Of course, the Guaranteed Maximum Price must account for the maximum time the project will take. This is a product of our own estimate which combines the work required with the time estimates of the subcontractors for each trade. It is up to O-A-K to determine the phase scopes and integrate the scheduled times provided by these subcontractors, thereby obtaining for the county both the GMP and GMT.

In general, these numbers are set during the 85 to 90% plan completion stage, but our method of using historical costs and replacing them as design proceeds gets us close fairly quickly.

We are looking forward to using the County’s EADOC’s system for sharing all project financials. O-A-K is a very transparent company and everything we do will be open and easily accessible to the County at anytime and those it wishes to give access to.

Request for Qualifications | RFQ140308 | Construction Management Services for Improvements to Estero Boulevard Page 54 4 Budget Compliance Adhering to the agreed upon GMP in the face of construction delays, price escalation, error’s and omissions, and requested plans modification is important. Describe your firm’s approach for resolution of these items. No points will be given if the answer to this question is your firm never has delays, errors, and omissions. The intent is to examine the “what-if” scenario; two pages maximum.

1) Construction Delays - are possible due to inclement weather, material shortages, etc. In the event of construction delays, we search for alternate activities that can be fast tracked to provide efficiencies further along in the project to re-gain time. We also instruct our subcontractors to add additional crews or work longer hours to catch up if they fall behind. Most important to this situation, we search out potential delays before they happen and make contingency plans that are incorporated into the schedule. We also make sure that the cause of delays are communicated to all involved parties so they know not just that the project is delayed, but why it is and how we intend to fix it.

2) Material Price Escalation - Since this project is segmented, we have a reasonable expectation that we can require a fixed price for the duration of each portion and incorporate these prices into the segment GMP. In the case of flexible supply, and therefore flexible price, we try to anticipate for this and incorporate it into the GMP. Extreme price escalations are usually known before hand and our subcontractors are often instructed to stockpile materials prior to escalation, and bill for stored materials which we verify before submitting as part of our invoice to the county.

3) Error’s and Omissions - O-A-K takes a team approach with the design / engineering team members when it comes to E&O. Should we encounter an Error or an Omission during construction we will work through the issue and a cost assignment will be determined among the team members. Should O-A-K be responsible, than we will take responsibility.

4) Requested Plans Modification - The owner of the project usually generates such requests and we consider it our responsibility to follow through on these requests in the following manner: first we review the proposed request and determine what effect it will have on other parts of the project. We then provide a cost/benefit to you so that you can determine what effect it will have on the overall budget and schedule. Should you determine that the plan modification is beneficial to you, we immediately proceed to gather any pricing or discounts that will be required and incorporate the modification into the schedule.

Communication is key to the success of any project. Leo Smith, your senior project manager, is a construction industry veteran having more than 49 years of experience. John Solich will be your onsite project manager. He brings over 31 years of construction industry experience and his well known to the County having worked for Lee County DOT. Bill Edwards, your lead job site superintendent, has 19 years of experience. Bill is a hardworking individual who is meticulous and communicates well. Mr. Smith has extensive experience leading design teams to a successful conclusion. Included in this experience was his time as program manager at Manchester - Boston Regional Airport coordinating a $250 million program that involved 8 design teams and multiple disciplines within each team.

Although we have our own Project Management System, Procore, we will be using the County’s state-of- the-art cloud based project management system called EADOC’s. Every member of the team will have 24/7 access to this system.

We assume that EADOC’s system will allow us to provide a complete record of every meeting that is held by the project team. Tracks meeting dates and times, locations, meeting topics, and attendees. Minutes will be distributed to meeting attendees via email, and each attendee has the ability to approve and/or amend the minutes.

The meeting minutes provides an invaluable record of who said what, when, and what issues were discussed and assigned to individuals during the course of the project. We will provide a safe, secure and centralized archive for all of the project’s meeting minutes and will be accessible and available at any future date, so that meeting minutes can be easily reviewed.

Our preferred method of interface with all parties of the process is through daily communication. During the design/pre-construction phase, our staff has constant communication with the design team while preparing the budget estimates. We recommend regularly scheduled Team Meetings with Lee County, Town of Fort Myers Beach, T.Y. Lin International, and Owen-Ames-Kimball Company at which the components of the project are presented, discussed, and decisions reached.

Regular Progress Meetings are held, where safety, quality, and schedule are the main topics of discussion. We use several forms of communication to update the team on project progress. These include:

• Lee County’s EADOC’s project management system • Regularly scheduled Team meetings • Monthly project report • Monthly financial report • Daily communication with the Field Superintendent • Construction progress meetings • 24/7 access via internet and mobile phone

We are also available for any meetings with the residents and businesses to present the project and give updates. This will be coordinated by our public information consultant.

O-A-K has always met or exceeded project DBE goals. O-A-K/Florida has met or exceeded DBE goals re- quired on all of its contracts and all bids submitted. It should be noted that these percentages have all been achieved using local firms in the Southwest Florida area. In fact, on a recent Housing Authority of the City of Fort Myers project, we exceeded our Client’s expectations for DBE participation. The Housing Authority required that stringent Housing and Urban Development Act Section 3 participation be put in place for its Dr. Carrie D. Robinson Community Center renovation to achieve the outreach efforts for the Authority’s Section 3 goal of 40% DBE sub trade participation from the neighborhood in which the project is located. Through O-A-K’s efforts in conjunction with Authority staff, 82% Section 3 participation was achieved on this project. A letter of recom- mendation from the Housing Authority for this project can be found on the next page.

Some of O-A-K’s activities to help in meeting this Section 3 goal were to assist in collateral material preparation and distribution, hold multiple pre-bid meetings in the project’s neighborhood as well as to make contact with local media to provide information to the community on this project opportunity. To encourage disadvantaged and minority subcontractor bidding, O-A-K participates in DBE job fairs with FGCU Small Business Development Center.

Trades and services for which O-A-K has contracted directly in Lee County with DBE’s include practical supply and vendor requirements for design, site utilities, earthwork, paving, sodding and landscaping, site demolition, and concrete flat-work.

Unique tools used by our company include: • Direct mailings to DBE’s in the area - Telephone contact by project manager. • Targeted packaging of trade bids to accommodate bidding by DBE firms. • Pre-Bid Community Outreach and Educational Meeting • Specific provision at the pre-bid conference to discuss DBE needs. • Waiving of bonding for contracts under $200,000 • Qualification Assistance to Potential Firms • On-site employment of DBE’s for all miscellaneous services possible. • Payment Program to help fund operations through construction process • SBA 8A DBE Mentor/Protégé Program

We have successfully implemented the DBE program with all public agencies.

It is our intent to use local subcontractors wherever possible. We do support and encourage equality in selecting our subcontractors where price and quality are equal. As detailed on the previous page, we have a long history of working with small business subcontractors to assist in their success. We participate each year in Florida Gulf Coast Universities SBDC Matchmaker workshop where over 100 small/minority business owners come and learn about doing business with O-A-K. We also participate in other similar trade shows throughout the year. We were named Contractor of the Year six of the eight years the award was given out by the local American Subcontractors Association. We have always valued and nurtured the relationship with our subs.

We will provide a list of project subcontractors to Lee County, which will be selected by O-A-K through the bidding process at the establishment of a Guaranteed Maximum Price (GMP) for your review. We will at that time be able to provide Lee County with all subcontractors’ business information and assist in the selection of subcontractors for this project.
