Introduction

1. The Licensing Board

1.1 The Angus Licensing Board (“the Board”) is constituted under Section 5 of Schedule 1 to the Licensing () Act 2005 (“the Act”) as amended. The Board is the licensing authority for the local government area of Angus for the purposes of the Act. The main administrative centre for Angus Council is based at Angus House, Orchardbank Business Park, , DD8 1AN.

1.2 Angus shares its borders with the City of Dundee, Perth & Kinross, and Aberdeenshire Councils and covers around 2182 square kilometres benefiting from 93km of coastline. Around 116,520 people live within the area which is set on the east coast of Scotland. The seven main towns in Angus are , , , Forfar, , and Montrose.

2. The Licensing Board

2.1 The current Board was formed in May 2017 following the local government elections and comprises ten members, all of whom are elected members of Angus Council. Five returned to serve on the Licensing Board from the previous Board complement of 9.

2.2 On 25 May 2017 all 10 current members received the statutory day's training from Alcohol Focus Scotland in licensing legislation and Board functions. This included a post training examination which required them to pass with a minimum of 75%. They all duly passed.

2.3 As well as the above noted statutory training, the Board recognises the need for development of understanding and awareness of licensing law and practices, and having up to date knowledge of the effects of alcohol on people across Angus. The Board are of the view that this is essential to making informed licensing decisions.

2.4 In the year from 1st April 2017 to 31st March 2018, the Board convened on ten occasions to determine the applications as shown at Appendix 1. Applications permitted to be dealt with in accordance with the Boards Scheme of Delegation are shown at Appendix 3. A breakdown of the Boards current premises licences are shown at Appendix 4.

2.5 Applications before the Board were dealt with in an open and transparent manner in accordance with current licensing legislation, the Scottish Government Guidance issued to Local Authority Licensing Boards, the Board’s three year Statement of Licensing Policy 1 December 2013 – 30 November 2016, as extended under transitional arrangements, and the Board’s Supplementary Statement of Licensing Policy Extended Hours over Christmas and New Year November 2016. 2.6 Information and assistance was made available to persons making representations or lodging objections and those wishing to apply for a licence. Information was provided by way of telephone call or email to the Board’s licensing staff, the Boards’ website and guidance notes associated with each particular Application. 2.6 To further assist applicants, the Boards’ website provides procedural guidance on how it will deal with applications and details the fees applicable to each type of application

2.7 The Board is fully aware of the need to ensure that the licensing process is accessible to all and thus information and assistance is always available on request for those who require special arrangements to access any part of the process.

2.8 At the Board meetings, the Board attempts to make the process as informal as possible and consistent with the carrying out of the Board's quasi-judicial function. The Board always attempts to follow best practice in enforcement including adoption of standards, which will, in its actions, be proportionate, accountable, consistent, transparent and targeted.

2.9 Under the Act, the Board is responsible for considering applications for:-

• premises licences • provisional premises licences • temporary licences • occasional licences • personal licences • transfer of premises licences • variation of premises licences • extensions of licensing hours in respect of: • the sale of alcohol by retail; and • the supply of alcohol in members clubs

3. The Licensing Objectives

3.1 Section 4 of the Act sets out the following five licensing objectives ("the licensing objectives"):-

• preventing crime and disorder • securing public safety • preventing public nuisance • protecting and improving public health, and • protecting children and young persons from harm

3.2 The licensing objectives represent the principles upon which the licensing system is based. In exercising its functions under the Act, the Board has full regard to the licensing objectives. The Board acknowledges that the 5 licensing objectives carry equal weight and importance and are of paramount consideration when they are exercising their responsibilities. The Board considers that their Statement of Licensing Policy 2013 – 2016 and Supplementary Licensing Policy Statement Extended Hours over Christmas and New Year November 2016 also promote the licensing objectives with particular reference to prevention of crime and disorder, prevention of public nuisance and promotion of public health.

3.3 The Board accepts that the quantity of alcohol consumed can adversely contribute to the level of crime and disorder within an area. The Board therefore continue to be committed to acting with to pursue policies intended to prevent crime and disorder. To that end, the Board expects all applicants for premises licences to implement and maintain appropriate and robust policies and practices to address all factors which impact on crime and disorder, including underage drinking, drunkenness on premises, public drunkenness, violent and or aggressive behaviour, noise nuisance, possession and or use of illegal substances and driving whilst under the influence of alcohol.

3.4 The Board continues to be committed to ensuring the safety of residents, visitors and businesses within Angus and always seeks to ensure that the operators of licensed premises take all necessary measures to implement their Statement of Licensing Policy.

3.5 In 1999, Angus Council promoted byelaws prohibiting drinking in certain public places within the Burghs of Brechin, Carnoustie and Montrose. The byelaws were extended to include the Burghs of Arbroath and Kirriemuir in 2008. In 2011 the byelaws were amended and they now apply to certain areas within all seven burghs – Brechin, Carnoustie, Montrose, Arbroath, Kirriemuir, Forfar and Monifieth. These byelaws are intended to assist in making safe all public areas covered by them and further assist the Board in ensuring the licensing objective of securing public safety is being met.

3.6 The Board is committed to protecting the amenity of residents and occupiers of other businesses from the potential adverse consequences of licensed premises whilst at the same time recognising the valuable social and business service such premises provide. The Board is fully aware that nuisance occurs frequently at or around the terminal hour of on-trade businesses and applicants for on-trade premises licences are required to outline to the Board, and implement, effective policies on the dispersal of patrons. The Board accepts that nuisance can be created by noise, and applicants are asked to plan their business to be as considerate as possible to neighbouring occupiers. For example, details of outside areas used for smoking, drinking and control of patrons whilst using those areas, are required to be addressed by Applicants in their operating plans. Premises offering music either live or recorded are required to detail their proposals to

limit noise emissions from the premises. Such proposals include measures aimed at controlling noise from amplified and non-amplified music, singing and speech so as to be inaudible within any adjacent noise sensitive property, particularly between 11pm and 7am. Other measures include keeping doors and windows closed, and the installation of soundproofing measures and sound limiters. Generally, new applications for outdoor areas prohibit alcohol consumption beyond 9pm in the outside area.

3.7 The Board is fully aware that the excessive consumption of alcohol can have a damaging effect on health. The Board considers that this may be either on a single occasion or through prolonged excessive use. One particular area of concern for the Board relates to irresponsible promotions and the Board strictly applies the interpretation of an irresponsible promotion as contained in para 8(2) of Schedule 3 of the Act.

3.8 The Board has particular regard to the views of NHS Tayside and Angus Alcohol and Drugs Partnership (ADP) in considering measures to ensure the protection of public health from the abuses of alcohol. The Board also continues its close relationship with the ADP and supports its initiatives around responsible drinking.

3.9 The Board considers that applicants should participate in measures to inform the public of safe drinking limits, the number of units in particular drinks and the availability of non-alcoholic drinks.

3.10 The Board also requires Applicants to demonstrate their policies on the sale of alcohol to persons already intoxicated and to under-age persons.

3.11 The Board supports the provision of family friendly premises within their area. The Board therefore expects that applicants fully understand the additional responsibility this places on them and that this is reflected in their operating and layout plans, facilities to be provided, and the practices and procedures to be implemented by the applicants. The Board however recognises that parents and other adults accompanying children also retain responsibilities.

3.12 The Board will have particular concerns in permitting children and young persons into premises where the operating plan indicates that the supply of alcohol is the primary purpose of the service to be provided.

3.13 The Board therefore expects all applicants to provide details of the applicants’ proposals to prevent the sale of alcohol to children or young persons including, but not restricted to the following:- • Effective and responsible premises management • Appropriate instruction, training and supervision of those employed to secure the protection of children and young persons from harm

• Adoption of best practice guidance on prevention of sales of alcohol to children or young persons • Limitations on the hours when children or young persons may be present in all or parts of the premises • Limitations or exclusions by age when certain activities are taking place • Acceptance of accredited proof of age cards with photographs or passports • Age verification policy of 25 (Challenge 25) to be implemented

3.14 Where applicants intend permitting children under the age of 5 to access the premises, the Board requires that baby changing facilities, which are accessible to persons of either gender, to be provided on the premises.

3.15 The Board requires details of the category and location of any gaming machines on the licensed premises. The Board acknowledges that Applicants have a duty under the Gambling Act 2005 to ensure that children and young persons do not access gaming machines above category D (as specified in the Gambling Act 2005). Licensed premises may have both category C and Category D gaming machines and applicants are asked by the Board to consider siting, or may be required to site, Category C machines away from child-friendly areas where no or unsatisfactory measures are in place to deny children and young persons access. Clubs may also have certain types of category B gaming machines and the Board applies the above restriction on child and young person access to these types of machines. 3.16 The Board will also require Applicants to provide details of the times and locations within the premises where children and young persons are to be permitted.

3.17 The Board further recognises that the licensing objectives provide potential reasons for refusal of an application for the grant, variation or transfer of a premises, temporary premises, or provisional licence, or an occasional or extended hours licence under the 2005 Act. In addition that breach of the licensing objectives may provide grounds for reviewing any type of licence under the Act. Conditions attached to any grant of an application under the Act may, be based on any one or more of the 5 licensing objectives.

4 Angus Licensing Board Statement of Licensing Policy and Supplementary Statement of Licensing Policy Extended Hours Over Christmas and New Year November 2016

4.1 The Boards’ Statement of Licensing Policy has been in effect since November 2013. The Boards’ Supplementary Statement of Licensing Policy Extended Hours over Christmas and New Year has been in effect since November 2016. The Board consistently has regard to both Policies when exercising its functions, and any relevant Policy and or statutory provisions are included in

every Board Report which is prepared for each item heard by the Board.

4.2 The Board at its meeting of 5 November 2017 initiated a review of its current Statement of Licensing Policy 1 December 2013 – 30 November 2016 and Supplementary Statement of Licensing Policy Extended Hours over Christmas and New Year 2016 and is currently undertaking the consultation process.

4.3 The Board when drafting its new Policy will have full regard to the relevant statutory provisions of the 2005 Act, the licensing objectives and the recently updated Scottish Government Guidance to local Authorities for Licensing Boards on Statement of Licensing Policy and Overprovision Assessment. Throughout the review and consultation process, the Board will have such regard and will continue to do so when the final Policy Statement is approved.

Duty to assess overprovision

4.4 Section 7 of the Act requires the Board to include in its Statement of Licensing Policy, a statement as to the extent to which the Board considers there to be an overprovision of Licensed premises or licensed premises of a particular description in any locality within the Boards area. Having regard to Section 7 of the Act and recently updated Scottish Government Guidance to local authorities for Licensing Boards, the Board determined that the localities which the Board should identify and examine should be the Burghs of Arbroath, Brechin, Carnoustie, Forfar, Kirriemuir, Montrose and Monifieth.

4.5 The Board’s current Statement of Licensing Policy includes a policy statement to the effect that it has not been possible to identify any locality where data supports a robust and compelling argument that the prevalence of licensed premises has reached, or is close to reaching overprovision. Therefore, there is no presumption against the granting of new licences within any locality in Angus. However, the Board recognises that each application for a premises licence requires to be determined on its own merits and the Board may still refuse an application if it is satisfied, from evidence presented to it, that there would be an overprovision of licensed premises in that locality if the application were to be granted. The localities examined during the previous Policy Statement review were the same. As noted at paragraph 4.2 the Board are currently in the process of reviewing their current Statement of Licensing Policy 1 December 2013 – 30 November 2016 and Supplementary Licensing Policy Statement Extended Hours over Christmas and New Year November 2016. The Board’s new Statement of licensing Policy is due to be published on or before 4 November 2018.

5.0 Summary of decisions made by, or on behalf of, the Board

5.1 During the period 1st April 2017 – 31 March 2018 the Board heard and determined 3 premises, 2 provisional, 14 non minor variation, 9 extended hours and 1 transfer application. The Board also heard and determined 4 premises licence review hearings, 2 current personal licence holder hearings, and 1 new personal licence grant hearing.

5.2 All of the granted applications were found to be compliant with the licensing objectives, and consistent with the Licensing (Scotland) Act 2005, the Board’s Statement of Licensing Policy and Supplementary Statement of Licensing Policy Extended Hours Over Christmas and New Year November 2016 and Scottish Government Guidance issued to local authorities for Licensing Boards.

5.3 The decision from the Board on each application, review or personal licence hearing was based on its individual circumstances and merits, as was all transfer of premises, extended hours, occasional, minor variation and personal licences which were able to be dealt with under delegated authority in accordance with the Boards Scheme of Delegation which can be accessed here http://www.angus.gov.uk/sites/angus-cms/files/2017- 06/Statement%20of%20Policy%20-%20Alcohol.pdf

5.4 Objections and representations were received to three applications for non- minor variations and one new premises licence application. These mainly comprised concerns over perceived potential noise problems from increased hours, playing of live music or entertainment, possible disturbance from increased numbers of persons arriving and leaving causing a disturbance at dispersal times and noise nuisance from smokers. All objections and representations were taken into account in the Boards’ decision making process.

5.5 In assessing applications, the Board also used a considerable number of different sources of information to enable them to reach fully considered determinations. These sources included reports from Angus Licensing Standards Officer, Scottish Government Guidance issued to Local Authority Licensing Boards, Police Scotland, NHS Tayside, Angus Drug and Alcohol Partnership, Alcohol Focus Scotland, Scottish Fire and Rescue Service, Scottish Ambulance Service, Local Residents, Angus Local Licensing Forum, Angus Council Services including Building Standards, Environmental and Consumer Protection, Roads, Planning and Safe Events, information and or submissions made by objectors and representors’, members of the public, local licence holders, material from local and national news on alcohol issues and misuse, relevant legislation and applicable case law, and guidance and advice obtained from the Board’s licensing practitioners .

5.6 As mentioned at paragraph 5.1 above, during the period 1st April 2017 to 31st March 2018 there were four premises licence reviews heard by the Board, and 2 current personal licence holders and one personal licence applicant were also brought before the Board. In respect of the first premises licence review the Chief Constable of Police Scotland had sought a review on the grounds that conditions of the premises licence had been breached and the licensing objectives of preventing crime and disorder, securing public safety and protecting children and young persons from harm were not being met. The Board determined having full regard to all information before it and after hearing parties submissions that they were not satisfied the grounds for review had been established and no further action was taken. The licence

holder did not have legal representation.

5.7 In respect of the second premises licence review a member of the public had requested a review hearing due to noise nuisance emanating from live music functions and having regard to the licensing objectives, the licence holder was not a fit and proper person. The Board after fully considering the information before them and after hearing party’s submissions determined that it did not disclose a ground for review. The premises licence holder was represented by a legal representative.

5.8 In respect of the third and fourth premises licence reviews, review hearings took place as a result of non-payment of annual fees. The Board, after full and careful consideration, determined that both licences were to be revoked.

5.9 In respect of the 3 Personal Licence hearings, the Board in the first case had received a notice of conviction of a relevant offence from the Chief Constable of Police Scotland in respect of a current licence holder. After fully considering the notice of conviction, having heard from the representative of Police Scotland, receiving advice from the Boards’ legal adviser and noting that the licence holder who had been invited to attend the Board on a previous occasion was not present again despite being invited to attend the Board meeting, the Board determined to make an order revoking the licence with immediate effect.

5.10 The second case was in respect of an Application for a new grant. A notice of conviction of a relevant offence from the Chief Constable of Police Scotland had been received. No comment was received from the Licensing Standards Officer. After considering the terms of the letter and submissions made at the hearing by Police Scotland the Board agreed to grant the Application

5.11 In the third case the Board had received notification of a conviction of a relevant offence from the Chief Constable of Police Scotland in respect of a current licence holder. Prior to the Board determining the Application the Licence Holder surrendered his licence.

6.0 Licensed Hours

6.1 In granting licences the Board recognises that licensing hours are important to individual licensed premises, but can have a wider impact for an area. Balanced against this, the Board does not wish to unnecessarily inhibit the development of thriving and safe evening and night time local economies which are important for investment, employment and tourism. The Board considers that the on sale policy hours are appropriate for Angus and represent a balance between the interests of the public, residents, licensed businesses and patrons of licensed premises.

6.2 For applications relating to occasional Licences and general licensed premises (except for off sale licensed premises) – the licensed hours permitted by the Board are:-

11.00 am to 12.00 midnight on Sundays 11.00 am to 12.00 midnight - Monday to Thursdays (inclusive) 11.00 am to 1.00 am Friday and Saturday

For applications relating to licensed premises where the activities permitted to be carried on as specified in the operating plan comprise public entertainment ( such as dance halls, discotheques and night clubs) and provided that alcohol is sold as an ancillary to the entertainment , the licensed hours generally permitted by the Board are:-

11.00am to 12.00 midnight on Sundays 11.00am to 12.00 midnight Monday to Thursdays (inclusive) 11.00am to 2.00 am Friday and Saturday

6.3 In terms of the Act, the sale of alcohol for consumption off the premises is not permitted before 10.00 am and after 10.00 pm. The Board's policy is that maximum available licensed hours of 10.00 am to 10.00 pm each day are generally appropriate for off sales. However, each off sales application is assessed on its own merits against these licensed hours and the Board aims to ensure that the licensing objectives are being promoted in such applications. If this is not demonstrated to the Board, the Board may grant reduced hours for off sales.

6.4 Each application for a premises licence is assessed on its own merits against the on sale policy hours appropriate to the type of activity for which a licence is being sought. Where an application received is requesting licensed hours exceeding 14 hours, the Board will require further information for the consideration of such applications and the Board will take into account the effect of granting such a licence will have on the area.

6.5 Should an application be received in respect of opening earlier than 11am, the Board will expect the applicant to justify their request and demonstrate measures that promote the five licensing objectives.

6.6 Extended hours applications are individually assessed on their own merits. When the extended hours sought are in respect of on sale premises and fall outwith on sale policy hours appropriate to the applicant's premises, the applicant is required to demonstrate to the Board that there are good reasons for the hours sought and that the hours are appropriate in the circumstances . The applicant will require to provide the Board with sufficient information to enable a decision to be made in this regard. This information will include:-

• the hours sought; • a description of the special event or occasion;

• the proposed activities to take place during these hours; • when each activity will take place; • why the event or occasion is considered to be special; • why the event or occasion cannot take place within the on sale policy hours appropriate to the applicant premises.

7.0 The Angus Local Licensing Forum

7.1 The role of the Angus Local Licensing Forum (“the Forum”) is to keep under review the operation of the Act in the Angus area, to review the relevant Board functions, give policy advice and make recommendations to the Board as the Forum considers appropriate.

7.2 The Forum was first established on 22 November 2007, and currently has 11 members. The Forum consists of 4 premises and personal licence holders, 1 Angus resident, 2 representatives from Angus Council Health Education and Social Work Service, a representative of the Angus Drugs and Alcohol Partnership (A.D.P), 1 representative from Scottish Fire and Rescue Service, 2 representatives from Police Scotland and the Angus Licensing Standards Officer. The Chair of the Forum is a premises and personal licence holder. The Forum meets on a quarterly basis.

7.3 The Licensing Board are formally required to meet with the Forum at least once in each calendar year. They jointly meet every year in November and have done so since 2008. They meet in the Town and County Hall, Forfar. A copy of the joint minute of the 9th Joint meeting of the Forum and the Board held on 3 November 2016 is attached as Appendix 5. The Minute of the meeting of the Forum and the Board on 2 November 2017 is due to be placed before their Joint Meeting for approval at its meeting in November 2018.

7.4 On 20 September 2017 members of the Forum attended a regional seminar in Dundee hosted by Alcohol Focus Scotland on the alcohol licensing system in Scotland. The Forum found the seminar to be of great benefit. The Forum, along with other attendees were invited to explore their experiences and learning gained in licensing over the past 4 years and were asked to identify any areas of ongoing challenge. The Forum were happy to note that Alcohol Focus Scotland is to review all the information gathered at the regional events and use it to produce a full report with clear recommendations.

7.6 At the Joint meeting of the Forum and Board on 2nd November 2017 discussion took place regarding the Board’s Supplementary Statement of Licensing Policy Extended Hours over Christmas and New Year 2016. Forum members requested that the Board re-consider its Policy in general. As mentioned above at paragraph 4.2 the Board are in the process of reviewing this Policy and will give careful consideration to the submissions made by the Forum in respect of the policy.

8.0 Conclusion

8.1 The Board are delighted to report that licensed premises in Angus have been well run and relatively problem free during the period 01/04/2017 to 31/03/2018. In this respect, the Board congratulates and thanks the licensed trade in its efforts in promoting and upholding the licensing objectives and complying with the Board's Statement of Licensing Policy and Supplementary Statement of Licensing Policy Extended Hours over Christmas and New Year November 2016.

8.2 Whilst the Board accepts that licensed premises in Angus are well run and regulated, the Board will continue to ensure that high standards are maintained and the licensing objectives of the 2005 Act are complied with in the period 01/04/2018 to 31/03/2019.

8.3 The Board expresses its extreme gratitude of the efforts of the many officers, partners and stakeholders involved in ensuring that licensed premises in the Angus area are compliant with, and kept well informed of, the requirements of the vast array of licensing legislation and regulations.

1. WELCOME AND INTRODUCTIONS

Sheena Cochrane welcomed all those present to the ninth Joint Meeting of the Angus Local Licensing Forum and Angus Licensing Board. Thereafter introductions were made.

2. MINUTE OF PREVIOUS JOINT MEETING

There was submitted and noted the minute of meeting of the Joint Meeting of the Angus Local Licensing Forum and the Angus Licensing Board of 5 November 2015.

3. ANGUS LOCAL LICENSING FORUM

Sheena Cochrane, Chairman of the Forum, reminded those present that there was a statutory requirement for the Licensing Board and the Forum to meet together at least once a year. She stressed that the joint meeting marked the continuation of a positive relationship between the Licensing Forum and the Licensing Board and that the Forum had a wide range of knowledge, interests, experience and skills, all of which were available to the Board to help them in developing and exercising their functions.

Mrs Cochrane advised that the membership of the Forum had not changed much over the last year, unfortunately, Gillie Gilfillan had resigned due to work commitments. However, the forum had appointed Angie Merrilees, who was a training provider and was a welcomed member to the Forum as she came with a wealth of experience.

The Forum members had enjoyed working alongside Mark Gillespie, LSO over the last year and thanked him for all his reports to the meetings and keeping them up to date with a number of issues like the new Air Weapons and Licensing (Scotland) Act 2015.

Mrs Cochrane thanked Sergeant Bethway for all his help over the last few years as she understood that he was moving on to pastures new. She also thanked Paul Perrie, Scottish Fire and Rescue Service for his input and support.

She advised that in February 2016, Derek Mitchell from the Community Safety Liaison Team had finalised the Licensed Premises document which had been compiled to assist members of the licensing trade with some of the issues surrounding their premises and encouraged proactive activities to deter the negative aspects sometimes associated with them. It was hoped that members of the licensing trade would use it as a tool in conjunction with training.

This year also saw the launch of the toolkit for “Alcohol Licensing in your community – How you can get involved” This excellent and useful document explained how the licensing process worked in Scotland and provided some practical tips to help people who wanted to get involved. This booklet was available on-line from the Alcohol Focus website.

On 20th September, members of the forum attended a seminar in Dundee hosted by Alcohol Focus Scotland on the alcohol licensing system in Scotland. It was noted that this was the third of four regional events which took place across the country throughout the month. It was attended by 34 people who covered a broad range of perspectives and sectors including Board members, Solicitors, Police, Alcohol and drugs partnerships and Public Health improvement.

The event consisted of a variety of presentations, two group discussions and an individual exercise and as the forums looked ahead to newly constituted licensing boards with a fresh round of Statements of Licensing Policy in 2017/18, attendees were invited to explore their experiences and learning gained in licensing over the past four years, and to identify any areas of ongoing challenge. Alcohol Focus Scotland will review all of the information gathered at the regional events and use this to produce a full report with clear recommendations.

The beautiful Angus garden competition 2016 which, for the second year, was open to Licenced Premises was again well received and this year it had been expanded to include a number of different awards. This helped encourage local licensed premises to make the most of their outside space and street fronts with the winner of the Licenced Premises being the Vaults Bar, Monifieth, owned and run by Mrs Cochrane.

At last year’s Joint meeting discussion took place regarding the extension of hours regarding the Boards policy in relation to the extended hours over Christmas and New Year and the Forum members requested that the Board re-consider its Policy in general in respect of extended hours over Christmas and New Year. She advised that the members of the Forum had been delighted to see the item on the Boards agenda earlier today and endorsed their views and decision.

As a Forum, Mrs Cochrane felt members experience had grown over the past nine years and were now well on their way to carrying out their remit as set out in the 2005 Act. It was also heartening to have such a good working relationship with the Board.

In conclusion, Mrs Cochrane thanked Forum members for their commitment to take their role seriously and attending meetings without fail. She also thanked Angus Council for the administrative and financial support which had been given to the Forum in the past year.

4. ANGUS LICENSING BOARD

On behalf of the Board, the Convener, Councillor Craig Fotheringham, expressed their appreciation for the opportunity to hold an annual joint meeting and indicated that it underpinned the mutual benefit of working together for the people of Angus. Both organisations strived constantly to encourage responsible drinking within the County and to work towards reducing anti-social behaviour.

Councillor Fotheringham advised that since the last joint meeting of the Angus Licensing Board and Licensing Forum on 3 November 2015, the Angus Licensing Board has met on eight occasions and during these meetings the Board has dealt with the following matters : -

• 6 new premises licence applications • 9 requests to vary premises licences • 2 requests to relieve the failure to comply with a procedural requirement • 4 matters pertaining to Personal Licences • 1 review of Premises Licence for non-payment of fees • 5 Occasional Licence applications • 9 Extended Hours applications The following applications were also dealt with in accordance with the Scheme of Delegation:

• 517 Occasional Licence applications • 18 Extended Hours applications • 76 Personal Licence applications • 105 Requests for minor variation or transfer • 7 Premises licences had been surrendered • 1 Confirmation of a Premises Licence

As of 19 October 2016 there were 337 premises licences in-force, 114 on-sales, 138 on/off sales and 85 off sales.

He advised that the Air Weapons and Licensing (Scotland) Act 2015 would have an impact on the Board in the future with the fifth licensing objective, “protecting children from harm” being amended to “protecting children and young people from harm”.

The three year period for the Statement of Licensing Policy has been abolished and replaced by a “licensing period”; this period effectively runs for the period between 18 months after the date of an ordinary election for local councillors.

The Act also extended the information which could be provided to the Licensing Board to allow any relevant information to be lodged in respect of the applicant or, where the applicant is a company, a connected person or any person who would become an interested party should the application be granted.

He advised that the Board would now be in a position to refuse to grant a licence on the basis that the applicant was not a fit and proper person to hold a premises licence.

It was noted that the Court of Session on 21 October 2016 had refused the Scotch Whisky Association's appeal over minimum pricing. This reinforced their earlier judgement that minimum pricing was a legal, effective and proportionate measure to protect public health and life. This had been welcomed by the Board as "Minimum pricing was widely supported by doctors, social workers, children's charities and the public who wanted to get rid of the cheap vodkas and super-strength ciders that caused so much damage.

He concluded by thanking the Licensing Team for their most willing support, guidance and advice and also thanked the Board members for their wealth of knowledge, experience and wisdom which they constantly bring to all Licensing Board meetings and matters. The Board also appreciated the most valuable attendance and input from Police Scotland, Scottish Fire and Rescue Service, ECP and Building Standards Officers who frequently have to endure lengthy meetings and deliberations without being called to comment. Their presence was much appreciated.

He wished the Licensing Forum every success in the year ahead and hoped to continue to attend future meetings.

5. UPDATE BY POLICE SCOTLAND

PC Sean Scanlon gave members an update into the work currently being undertaken by Police Scotland and explained to Angus Licensing Board members how it was important to have early intervention regarding any troublesome licensed premises as it was found that this approach helped avoid further problems in the future.

He also advised that Police Scotland were working closely with Mark Gillespie, LSO and met with him on a regular basis to discuss any issues.

The Chairman thanked PC Scanlon for his update and advised him that many licensees were grateful of the help and support that they had recently received from Police Scotland.

6. CHIEF CONSTABLES REPORT TO ANGUS LICENSING BOARD

There was submitted and noted the Chief Constables Report to the Angus Licensing Board for the period 1 April 2015 to 31 March 2016.

7. PRESENTATION ON SOCIAL ATTIDTUDES TO ALCOHOL SURVEY

Dr Drew Walker, Director of Public Health NHS gave a presentation on the key findings of the Angus Alcohol Scoping Exercise carried out in 2015.

He advised that this survey, which set out to explore local attitudes and behaviours in relation to alcohol, had been commissioned by the three Tayside Alcohol and Drug Partnerships (ADPs). The Tayside ADPs had worked closely with partners to help inform them about the harmful effects alcohol can have, as well as promoting responsible and safe drinking through strategic planning and action at a local level.

An online survey was chosen as a fast and more cost-effective alternative to a postal survey, telephone survey or face-to-face interviews. It was aimed at adults aged 16+. Survey questions covered several broad areas. These were: personal drinking behaviour, environments where people consume alcohol, personal purchasing behaviour, attitudes towards alcohol, parental influence over children drinking alcohol and availability of alcohol. Questions were filtered according to whether the respondent reported being a drinker or a non-drinker. The survey ran from 21May to 2nd July 2015.

He reported that 2078 responses had been received. Demographic information was collected however, many respondents did not answer the relevant questions. The analysis of the

findings therefore included exploring any patterns related to recorded demographic factors and also to those who did not complete individual demographic items.

Regards the consumption of Alcohol, a significant majority (89%) stated that they drank alcohol; 5 respondents did not answer this question.

Not surprisingly, with such a substantial proportion reporting that they drank alcohol the responses to this question were not patterned according to SIMD or gender, nor were ever having been a drinker or reasons for not drinking. Those aged 65+ were much less likely to state that they drank alcohol, but absolute numbers were small and 7 out of 10 had been drinkers previously.

Just over 7 out of 10 respondents (71%) stated that they purchased alcohol at a large supermarket. Just over one third (37%) bought alcohol at a restaurant or cafe and a third (33%) at a bar or nightclub. Seventeen percent reported purchasing at a convenience store and 6% at an off-licence. Other sources were reported less frequently: sports or members club (3%); online (4%) and some individual reports such as duty free, at special events or at a specialist winery. Females were more likely than males to buy at a supermarket.

The survey had provided a rich data set, allowing ADPs to have a better understanding of local attitudes to alcohol and to identify particular groups within the population where attitudes and behaviour were likely to put people at greater risk. It was limited by the considerable proportion of missing data. However, the proportion for whom demographic information was completed would appear to be reasonably representative of the general population, apart from males being poorly represented and this cohort had allowed sub- group analysis that would inform approaches to prevention work.

Members of the Board asked various questions and discussion took place regarding the frustration that Board members felt when feeling that their hands were tidied when dealing with large applications, which included supermarkets applying for off sales licences. Members felt that it would be easier if there was a robust overprovision policy in place which could withstand a legal challenge however, it was acknowledged that there was a number of hurdles to clear before this could be considered.

It was hoped that the results of the survey would hopefully help improve the services available to support individuals and families affected by alcohol misuse. The Chairman thanked Dr Walker for his very informative presentation.

9. GENERAL DISCUSSION

Following some discussion regarding the extension of hours under the Licensing (S) Act 2005, which both Forum and Board members found to be very fruitful and interesting, Mrs Cochrane in conclusion, thanked all those present for their attendance and contribution to what had been a successful joint meeting which marked the continuation of a positive relationship between the Local Licensing Forum and the Licensing Board.

It was agreed that the Forum meet on the following dates:-
