Report No 583/08 ANGUS COUNCIL DEVELOPMENT STANDARDS COMMITTEE - 10 JUNE 2008 DELEGATED APPROVALS REPORT BY THE DIRECTOR OF INFRASTRUCTURE SERVICES Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report determined by the Head of Planning and Transport in accordance with the Scheme of Delegation detailed in Standing Orders. 1.0 RECOMMENDATION 1.1 The Committee is asked to note the applications, detailed in the Appendix, determined under delegated powers. 2.0 INTRODUCTION 2.1 In terms of the Scheme of Delegation to officers, the Head of Planning and Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance. The Head of Planning and Transport is further authorised to refuse minor planning applications that are clearly contrary to planning policies (e.g. illuminated signs, satellite antennae, certain householder applications, etc). 3.0 DELEGATED DECISIONS 3.1 Attached as an Appendix is a list of 77 applications determined under delegated authority during the period 13 May 2008 to 3 June 2008. 4.0 FINANCIAL IMPLICATIONS 4.1 There are no financial implications. 5.0 HUMAN RIGHTS IMPLICATIONS 5.1 There are no Human Rights issues arising directly as a result of this report. Lowson Director of Infrastructure Services Uniform\DCDELGAT Report No 583/08 ANGUS COUNCIL DEVELOPMENT STANDARDS COMMITTEE LIST ‘A’ - DELEGATED APPROVALS Application No. Promoter Location 07/00666/REM Mr & Mrs B Fitzpatrick Erection of a Dwellinghouse - Re-Application at:- Site At Balnuith Balnuith Tealing Angus Conditions 1 That the development to which this permission relates must be begun not later than:- (a) the expiration of five years from the date of the grant of outline planning permission; or (b) the expiration of two years from the final approval of the reserved matters, or in the case of approval on different dates, the final approval of the last such matter to be approved, whichever is the later. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the Planning Authority. 3 That the rainwater run-off from roofs and hard standings be directed to a soakaway system to the satisfaction of the Building Control Authority. 4 That the disposal of sewage effluent be in accordance with the standards required by both the Building Control Authority and the Scottish Environment Protection Agency. 5 That prior to the commencement of development a detailed specification of proposed landscaping and boundary enclosures shall be submitted to and approved in writing by the planning authority. The approved scheme shall thereafter be implemented in accordance with the approved details prior to the occupation of the dwellinghouse. 6 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of 5 years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species. 7 That the roof material shall be blue slate or a material giving a similar appearance to the satisfaction of the planning authority. 8 That the proposed dry dash render is not approved as part of this permission and the external walls of the approved house shall be finished in a wet dash render the colour of which shall be agreed in writing with the planning authority and thereafter implemented prior to occupation of the dwellinghouse. Uniform\DCDELGAT Report No 583/08 07/01115/FUL Tayside Developers Ltd Erection of Industrial Units with Office Facilities at:- Ground At Berryfauld Road Kirkton Industrial Estate Arbroath Angus Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the Planning Authority. 3 That the development hereby approved shall be restricted to uses within Classes 4&6 as defined in the Town and Country Planning (Use Classes) (Scotland) Order 1997 with no development within use Class 5 allowed to take place without an express grant of planning permission from the Planning Authority. 4 That no activities shall be carried out in the external yard area other than the loading and unloading of goods and materials. 5 That except for normal access all external doors shall be kept shut. 6 That hours of operation within the site shall be restricted to 0700 to 2200 hours. 7 That noise from heating, ventilation, refrigeration or air conditioning plant shall not give rise to a noise level in excess of NR Curve 35 between 0700 hours and 2200 hours and NR Curve 25 at all other times, assessed within any residential property with windows open. 8 That prior to the commencement of development detailed plans showing existing and proposed ground levels and proposed floor levels relative to a fixed ordnance datum shall be submitted for the written approval of the Planning Authority. Thereafter the development shall be undertaken in accordance with the approved details. 9 That no works in relation to the development hereby approved shall take place unless a scheme of hard and soft landscaping works has been submitted to and approved by the Planning Authority. Details of the scheme shall include: (a) Existing and proposed ground levels relative to a fixed datum point; (b) Existing landscape features and vegetation to be retained; (c) The location of new trees, shrubs, hedges and grassed areas; (d) A schedule of plants to comprise species, plant sizes and proposed numbers and density; (e) The location, design and materials of all hard landscaping works including walls, fences and gates; (f) A programme for the completion and subsequent maintenance of the proposed landscaping. All soft landscaping proposals shall be carried out in accordance with the approved scheme and shall be completed during the planting season immediately following the commencement of development or such other date as may be agreed in writing with the Planning Authority. Any planting which, in the opinion of the Planning Authority within a period of five years from the completion of development, is dying, being severely damaged or becoming seriously diseased, shall be replaced by plants of similar size and species to those originally required to be planted. Uniform\DCDELGAT Report No 583/08 10 That no development in connection with the planning permission hereby approved shall take place unless full details of the proposed means of disposal of surface water from the development have been submitted to and approved in writing by the Planning Authority. Unless otherwise agreed in writing by the Planning Authority, surface water shall be disposed of via the use of Sustainable Urban Drainage Systems and the development shall not be occupied unless the agreed drainage system has been provided in its entirety. 07/01189/FUL Mr C MacFarlane Change of Use of First and Second Floors and Alterations to Form Five Flats at:- Commercial Hotel 28/30 South Street Newtyle Angus PH12 8UQ Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the Planning Authority. 3 That prior to the implementation of the change of use hereby approved the party floor between the ground floor commercial premises and the first floor flats shall be insulated as detailed in paragraph 6.3 of the noise impact assessment prepared by Charlie Fleming Associates dated 8 February 2008 or any other construction approved in writing by the Planning Authority. 4 That prior to the implementation of the change of use hereby approved, evidence shall be submitted to demonstrate to the written satisfaction of the Planning Authority that noise from the ground floor commercial premises shall not exceed Noise Rating curve NR10 within any of the 1st floor flats. Compliance shall be assessed/demonstrated using the same methodology used in the noise impact assessment prepared by Charlie Fleming associates dated 8th Feb 2008 including sound transmission tests in accordance with BS EN ISO 140-4:1998 measurement of sound insulation in buildings and building elements - Part 4 field measurement of airborne sound insulation between rooms. 5 That prior to installation the precise details of the proposed replacement windows shall be submitted for the written approval of the planning authority. Thereafter only windows that comply with the approved details shall be installed. 6 That notwithstanding the approved drawings show the use of white wet dash render, the colour of the render to be applied shall be approved in writing by the planning authority prior to its application. The external walls of the building shall be finished in the approved render prior to the occupation of any of the dwellings hereby approved.
