AN ACT TO APPROPRIATE FUNDS FROM THE GENERAL FUND TO THE DEPARTMENT OF PUBLIC WORKS TO ADDRESS THE FLOODING DAMAGE RESULTING FROM TROPICAL STORM COLLEEN. BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAM: Section 1. The sums listed in each section below are appropriated from the General Fund to the Department of Public Works (the "Department") to fund the costs of immediate correction and repairing of damage from Tropical Storm Colleen and to prevent future flooding problems. In those instance where the sums appropriated for land, survey and design costs are also sufficient to include construction costs, at least in part, the Department is authorized to undertake construction thereof. The village Mayors shall coordinate the implementation of the projects set out in Sections 1 through 20 of this Act with the appropriate government agencies. The Mayors shall also advise the Department in detail as to the precise locations of the projects for their particular villages. Section 22. The Department of Land Management is directed to coordinate planning with the Department to identify homes which are located in flood areas, including property owners on San Antonio, Sgt. Mendiola and Limtiaco Streets, in the of Barrigada, especially those flood areas caused or exacerbated by the due to construction, and to locate suitable alternate sites on government land which may be utilized, if it is later determined to be desirable to do so by the Legislature after submission of supporting documents by the Governor, for land exchanges with the owners of these homes. A list of potential land exchanges may be submitted to the Legislature at the discretion of the Governor. Section 23. The Department of Land Management and the Department shall locate suitable areas for ponding basins to eliminate excessive water build up, either on government or private land, and shall make contact to negotiate the willingness of acquisition of land for ponding basins. A list of potential ponding basin areas may be submitted to the Legislature at the discretion of the Governor. Section 24. One Hundred Thousand Dollars ($100,000) are hereby appropriated from the General Fund to the Department to obtain such appraisal and survey services as are required for the condemnation or other acquisition of property needed for the various projects and land exchanges and acquisitions set out in Sections 2 through 23 of this Act. Section25. The Governor may transfer among the various items of appropriation made in this Act such amounts as may be necessary to address shortfalls in appropriations; provided, that no project is jeopardized by such transfer. A list of potential land exchanges may be submitted to the Legislature at the discretion of the

The Department of Land Management and the Department of 3 Public Works shall locate suitable areas for ponding basins to eliminate excessive 4 water build up, either on government or private land, and shall make contact to 5 negotiate the willingness of acquisition of land for ponding basins. AN ACT TO APPROPRIATE FUNDS FROM THE GENERAL FUND TO THE DEPARTMENT OF PUBLIC WORKS FOR THE PURPOSE OF ADDRESSING THE FLOODING DAMAGES RESULTING FROM TROPICAL STORM COLLEEN.

The Committee on Ways & Means conducted a public hearing on Monday, November 6, 1989 beginning at 9:00 a.m. at the Legislative Session Hall to gather testimony on Bill No. 1016. Committee Acting Chairperson Senator Herminia D. Dierking conducted the hearing, being joined by Senators Frank Santos, George Bamba, Doris Brooks and Martha Ruth. TESTIMONY

Mayor Raymond Laguana of Barrigada and President of the Mayor's Counal of Guam testified orally in full support of Bill No. 1016. He indicated that the Department of Public Works should be present to respond to questions being addressed. He also indicated that Public Law 20-114 on the flooding problems has not been implemented by DPW. No funds have been released as of this date, November 6, 1989. He stressed that before any other bills are passed into law, Public Law 20-114 must be implemented first.

Mayor Greg Borja of Santa Rita and Chairman of the Finance and Legislative Committee of the Mayor's Council of Guam submitted written testimony in support of the Bill. He ask that the Committee amend the proposed bill to include additional request made by his colleagues. He too has two additional flooding problems which requires immediate attention.

Mayor Nito Blas of Mangilao submitted written testimony in support of the Bill which did not include any flood funding for his village. He informed the Committee that he did submit a listing of problem areas to the Director of Civil Defense with copies to the Department of Public Works and the Governor but doesn't know what happen to it. So Mayor Blas submitted to the Committee a list of priorities of flooding projects in the Mangdao are that requires immediate action. Out of the eleven items listed, six has been addressed on Public Law 20-114. Mayor Francisco N. Lizama and Vice Mayor Daniel E. Sablan of Sinajana submitted written testimony in support of Bill No. 1016.

Mayor Ungacta -of Agana, Mayor Frank Portusach of Agana Heights, Mayor Juan C. Cruz of Inarajan, and Mayor Vicente L. San Nicolas of Asan- Maina submitted written testimony in support of the Bill.

Mayor John Blas of Yigo, Mayor Vicente San Nicolas of Ordot-Chalan Pago, Mayor Antonio Babauta of Agat and Mayor Isabel Haggard of Piti also testified in support of Bill No.1016.

Mr. Jack Rice, a concerned citizen, testified orally on Bill No. 1016, indicating that drainage is very important in the communities.

RECOMMENDATION

The Department of Land Management is directed to coordinate planning with the Department of Public Works to identify homes which are located in flood areas, especially those flood areas caused or exacerbated by the government of Guam due to construction, and to locate suitable alternate sites on government land which may be utilized, if it is later determined to be desirable to do so by the Legislature after submission of supporting documents by the governor, for land exchanges with the owners of these homes. A list of potential land exchanges may be submitted to the Legislature at the discretion of the Governor. Section 23. The Department of Land Management and the Department of Public Works shall locate suitable areas for ponding basins to eliminate excessive water build up, either on government or private land, and shall make contact to negotiate the willingness of acquisition of land for ponding basins. A list of potential ponding basin areas may be submitted to the Legislature at the discretion of the Governor. Section24 One Hundred Thousand Dollars ($100,000) are hereby appropriated from the General Fund to the Department for the purpose of obtaining such appraisal and survey services required for the acquisition of property to be condemned or acquired for the various projects set forth in Sections 2 through 23 of this Act. Section 25. The Governor may transfer among the various items of appropriation made in this Act such amounts as may be necessary to address shortfalls in appropriations, provided that no project is jeapardized by such transfer. We, the Mayor and Vice Mayor of the District of Sinajana, are here today - to submit testimony in favor of the passage of Bill No, 1016, AN ACT TO APPROPRIATE FUNDS FROM THE GENERAL FUND TO THE DEPARTMENT OF PUBLIC WORKS FOR THE PURPOSE OF ADDRESSING THE FLOODING DAMAGES RESULTING FROM TROPICAL STORM COLLEEN.

The initial action of the Mayors' Council on October 4, 1989 in adopting Resolution No. 89-01, resulted in the Governor declaring an emergency on flooding islandwide and released $250,000.00 of emergency funds to addressed the present and immediate problems.

I The 20th Guam Legislature, in turn, upon reconvening at a regular session, called for a Committee of a whole, to hear concerns from the Mayors' Council as they present their flooding problems in their respective cornmunit ies . This resulted in the passage of 1.8 million dollars to supplement the emergency fund released to address the P.O. Boz 788 immediate problems. LLqmr, 9u.m Wet0 We hope that with the passage of Bill No. 1016, we can forsee resolving the technical and long term flooding problems that were not addressed in the initial funding that was released and/or appropriated. On Section 14 of said Bill, it asks for the appropriation of $105,000 for the construction cost of two flooding problems that were not otherwise addressed in the initial release and appropriation. This is one sample of a technical and long term problem that requires further funding.

:t is with deep concern for the safety and welfare of the people af Agana Heights and that of the other villages that I come before you to testify in favor of Bi 11 No. 1016, which wi 11 appropriate funds for the vi ilage of Agana Heights, Agana-Anigua and Agat to address the flooding problems in the respecciie comnunities. On behalf of the Municipal Planning Council and the residents of Agana Heights, I am here today to submit testimony in favor of Bill Ho. 1016, which wi11 appropriate 5828,500 to address the flooding problems in Agana ne~gnts. As you know, the flooding problems are not just a resuit of Trooicsi Storm Colleen. The problems have existed slnce way back, and I have constantiy and persistent 1 y complained to the responsible agencies to address tnese ~T~D:?T!s. There is a need for RCPs and inlets at Taigigao Road, Francisco Gavler Avenue, Ul loa Untalan Avenue, Cotla Drive, Punot Drive and Gosepn :riz Avenue)

Due to the low elevation on Ulloa Untalan Road, flooding occurs in tle lower lying area of this road. The flooding of Tropical Storm Colleen c3used sewer 1 ine back up in some of the rersidential areas, caused an inconvenience and posed a health hazard to some of my constituents). There was extensi.ie water run-off coming from the school grounds and from Kotla store area :a the residence of Jose and Rafaela Cruz, which is located next to the Agana Heights Elementary School. The Cruz property was flooded with over four reet of water during the storm. On Taigigao Road, the residence of Augusto OelgaC0. Carmen Indalecio, Frank Indalecio and Victor Salas are affected by flooding occuring on the lower spot of Taigigao Road, which makes it impassable to the above named residents of Taigigao Road, I recomnend constructing a bridge on the lower spot as indicated on the map. The heavy rains during and in the aftermath of the storm has caused intensive water run-off, resulting in damage and erosion of some of the Streets and roads withing the municipality of Agana Heights. BE IT RESOLVED BY TBE MAYOR'S COUNCIL OF GUAM:

WHEREAS: on Monday, October 2, 1989, the people of Guam were informed that Tropical Storm Colleen was on a cotlrse heading towards Guam; and WHEREAS: fortunately said Tropical Stonn Colleen ouddenly changed her direction of travel and spared Guam the force of her winds; and WHEREAS: despite being spared the force of tropical storm winds, Guam was subjected to the impact and effects of that storm's feeder ban activity; and WHEREAS: said impact and effects caused massive flooding in numerous and various areas all over the Island, creating great inconvenience and costs to the residents of Guam, as well as, paralyzing the traffic and transportation of the residents to such degrees that worker8 were not able to report for duty on time; and WHEREAS: Guam is now entering the typhoon season and can expect to be subjected to the effects of other storms and adverse weather conditions; and WHEREAS: unless the Government of Guam takes positive action to insure that flooding does not occur, by creating spill ways for the passage of stom rain water and/or by alleviating the clogging and stoppage of existing drainage' and spillway systems, there wi 11 be additional incidents of flooding; and WHEREAS: said flooding does not only cause unnecessary inconvenience and costs to the ~eovlo, the business enterprises and the Government of 6u&, but also causor danserour traffic situations, creates public health hazards, affecting each man, .woman and child on Gum, due to rtagnant water and debris and wastes carried by said water; and

WHEREAS; the individual Mayors and Vice Mayors of the various municipalities and villages of Gum have received and are being inundated with calls for help and relief from residents and citizens whose homos and property have been flooded by the rains of Tropical Stonn Colleen; and WHEREAS: this has not been the first occurrence of there problems but rather that these problems have constantly recurred during heavy rain and thunderstorms; and WHEREAS: even at thore times, the thsn-Comissionionetr and thcn-Assistant Commissioners unsuccessfully tried to get assistance from the Government and have repeatedly suggested long term solutions to these recurring problems, said ruggertions apparently falling on deaf earst

NOW, TBEREFORE, BE IT:

RESOLVED: that the Mayor's Council of Guam, on behalf of the Mayors and Vice-Mayors of the municipalities and villages of Guam and on behalf of the people of the Territory of Guam, does hereby firmly requests the Honorable Joseph F. Ada, Governor of Guam, to consider and to make the number one priority of the Government of Guam, the problems of flooding in all of the villages and areas of Guam and on the highways, streets and roads of the Island, and to immediately order the necessary Government of Guam agencias to develop and implement curative measures to prevent said flooding now and in the future; and be it further 2ESOLVED: that the Mayor's Council of Guam, on behalf of the Mayors and Vice-Mayors of the municipalities and villages of Guam and on behalf of the people of the Territory of Guam, does hereby firmly requests the Honorable Joseph F. Alrhough we have been spared of the full tropical storm force wind of storm Colleen, the tail-end seems to have done tremendous damages by its heavy rain causing severe flooding in numerous locations in Inarajan. The report submitted by my office pointed out the most critically affect- ed areas during the recent storm exist at Pauline'.; residence in Malojloj and the neighboring low lying areas. Bill 1016 addresses these problems in many other ways than just physically controlli~!~water from heavy rainfalls. This Bill will also provide sense of security to many resid- ents in that particular area.

Senntors, at the onset of every storm or typhoon warning, these re- sidents fear great loss of property and suffer life-threatening condit- ions that many of them are seeking shelters elsewhere. Evacuation be- comes very much a part of storm routine. Packing emergency supplies and re-locating your family during adverse weather conditions are some- thing we can do without. Can we imagine re-1ocati:lg an ill member of the family when there's a storm going on? Can we :,onestly justify the hardship and fcnr thcsc rcsidcnts go through in tc!rms of dollars?

My dear Senators, I think we can imagine these things as well as we can justify where every penny of Bill 1016 goes. The Malojloj Ponding Well, for instance, will benefit numerous residents who became victims of past flooding. I'm sure all of us share the pl.ght of our constit- uents asking for help so that we can say, "We deli,er an obligation that delivers so many from the cruelty of fear and insa..urity.
