AN ACT TO APPROPRIATE FUNDS FROM THE GENERAL FUND TO THE DEPARTMENT OF PUBLIC WORKS TO REPAIR AND CORRECT THE FLOODING DAMAGE CAUSED BY TROPICAL STORM COLLEEN, TO CORRECT A PREVIOUS APPROPRIATION, AND TO AUTHORIZE PRIVATE TELEPHONES AT GUAM MEMORIAL HOSPITAL FOR RELATIVES' USE.

1 BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAM: 2 Section 1. Legislative intent. The Legislature recognizes that 3 Tropical Storm Colleen caused very serious flooding damage and related 4 problems which must be addressed immediately. 5 Section 2. Emergency. Because of the emergency nature of the 6 damage, the requirements of the government bidding and procurement procedures for the projects covered by this Act are hereby modified as follows : (a) That the Director of Public Works (the llDirectorn) solicit sealed bids by publishing in a newspaper of general circulation at least three (3) times within a period of ten (10) days a request for bids; (b) That the Director request in writing bids from all licensed Guam contractors, giving such addressees ten (10) days to respond to such request, such ten-(10-)day period to coincide with the same period for those bids solicited by the newspaper advertisements; (c) At the expiration of such ten-(10-)day period, the Director shall award the projects for which bids were solicited to the lowest responsible bidder or bidders and make such awards within ten (10) days after the bids are opened. Except as modified by this section, the general government bidding and procurement laws and regulations shall otherwise apply. Section 3. Appropriations. The following sums are hereby appropriated from the General Fund to the Department of Public Works to correct and repair the damage from Tropical Storm Colleen, and to prevent future flooding : (a) Agana. for projects identified in this Act shall be expended exclusively as specified in this Act. Section 6. Clarification of previous appropriation. Section 1 of Public Law 20-96 is hereby repealed and reenacted to read: "Section 1. Eighty-Eight Thousand Dollars ($88,000) are appropriated from the General Fund to the Department of Public Works to repair and replace the corrugated (Butler-type) sheetmetal roofing, steel purlings, insulation, and the lighting and electrical systems of

the Santa Rita Community Center / Mayor's Office. " Section 7. Time limit. Since the funds appropriated by this Act are for emergency correctiorls and repairs, the projects funded by this Act must be completed by April 30, 1990, failing which the unexpended funds for unfinished projects shall revert to the General Fund. Section 8. Projects on private land. A contractor carrying out a project funded by this Act may not trespass on private land to complete the same without the express permission of the owner(s) of such land. Section 9. Return of surplus funds. The Governor is hereby authorized to return to the various agencies from which the monies were originally taken pursuant to his State of Emergency Declaration any surplus amounts remaining after the completion of the projects funded by this Act. Section 10. Exclusive telephones for relatives at Guam Memorial Hospital. The Administrator of the Guam Memorial Hospital shall provide telephone facilities for the use of relatives of patients during such relativest visits to the hospital. Such facilities will be exclusively dedicated for such use and shall not consist of the permissive use of the hospital's own telephones. Therefore the sum of Five Hundred Thousand Dollars ($500,000.00) is hereby appropriated from the General Fund to the Mayors' Council to fund the costs of correcting and repairing the damage from Tropical Storm Collen, and also to prevent future flooding.

Section 2. The Mayors' Council shall determine the priorities of the problem areas which shall be addressed.

I am requesting for someone who ; familarized in this field and also find an economical way I solve this problem. A) Radio Barrigada: The residence of Mr. Jose George is one of three families effected. There are in need of a dry well due to the fact the area in too small for a ponding basin or relocate the family.

B) San Antonio Area: The residence of Mr. Paul Mendiola is one of the eight families effected in this area needs to buy 'land for ponding basin, dry well or relocate the family.

C) Leyang Barrigada: The residence of Mr. Gregorio Garrido and Mr. Anthony Kamminga is in need of an additional land for ponding basin, dry well, or relocate the families, All the above listing is need of your attention because it will cost the government a great amount of money to eliminate the flooding problems in these areas. ROUTE 17 - CROSS ISLAND ROAD During and after heavy down pour, the road near the residence of Mr. Vicente Guerrero and Mr. Ricardo Calvo becomes a lake and vehicles with low exhaust system cannot pass through, together with soil erosion on the road causing mud slime over road pavement.

Ada asking him to request the 20th Guam Legislature to convene and address the funding to correct the flooding problems.

1. The retaining sea wall on route one - seashore side. The original wall has collapsed over the years and sand is now blocking the water passage coming from a ditch on the opposite side of the road. This causes a tremendous amount of flooding into the homes of Miss Pilar Kamrninga and Mr. Jose Manibusan, whose wife is handicapped. This situation makes it very difficult for both residents when there is a heavy downpour of rain to combat the flooding that occurs.

2. The Taguag River Bridge located at the end of Assumption Drive. According to Mr. David Camacho, his assessment of this bridge has been submitted through the proper channels, but as of this writing, no response has been received. These people affected are as follows: Mrs. Vicenta Alcon, Mr. Jesus Perez, Mrs. Theresa Cruz, Mrs. Rita Gumataotao, Mr. Juan Aflleje and Mrs. Josefina Rapolla.

3. The cleaning of the Taguag River, which runs from A. Quenga Street out to route one, behind the K-Automotive Shop. This - - assessment was done by Sixto Quintanilla.

4. The cleaning of the Masso River on Assumption Drive was also assessed by Mr. Quintanilla. The problem at this site is uprooted bamboo trees that have fallen into the river. Dur- ing heavy rains, the bamboo blocks the water paths and flows heavily on the sides close to the banks, causing some erosion on private properties.

5. Quenga Court - This road is totally inaccessible. The pot holes are large enough for a child's swimming pool. During the heavy downpour of rain last Saturday, September 9th, the homes of Mr. Joaquin Cruz and Mr. David Taimanglo were flood- ed. The repair of this road is very necessary in order to prevent future flooding.

6. Spruance Drive, Nimitz Hill. The Ditches on both sides of this drive, from Kamingaville down past the Nimtz Hill Estates, needs cleaning. This people affected are: Mr. Frank Castro and mr. Jose Cruz. 7. River on Bella Street needs cleaning. Flooding in resi- dential homes occured Saturday, September 9th, Those affected in these areas are: Ms. Jennifer Terlaje, Mr. Frank Salas, Mr. Tony Falcon, Mr. Tomas Unsiog and Mr. Miguel Cruz.

8. Ditch near the 7-Eleven in Piti caused major flooding of approximately nine homes, including the Mayor's home. This culvert is located under Marine Drive across to the Santos Park. It nees to be flushed and san on oceanside needs to be dredged. Those affected in these areas are: Mr. Pedro Hart, Mr. Greg Concepcion, Mr. Jose Fejeran, Mr. Jose Quenga, Mrs. Abby Certeza, Ms. Eleanor Tuncap, Mr. Steve Aguon, Mayor Isabel Haggard and Mrs. Magdalena Tajalle. Dry Wells is being recommended for the Hillside residents all along Marine Drive, who are always flooded- during a heavy downpour.

The Twentieth Guam Legislature convened in session at 2PM, Thursday, October 5, 1989 resolved into the Committee of the Whole, chaired by the chairman of the Committee on Ways and Means, Senator Carl T. C. Gutierrez and the chairman of the Committee on General Governmental Operations, Senator Ted S. Nelson, for the purpose of receiving testimony concerning Bill 994. BACKGROUND Testimony was received during the session, which was called because of the emergency situation declared by Governor Joseph F. Ada caused by conditions resulting from damage caused by Tropical Storm Colleen. The Speaker had been in receipt of letters from almost all of the nineteen village mayors, forwarded by the president of the Mayors' Council, Raymond Laguana. This material was received by the Committee of the Whole as information for preparation for substitute Bill 994.

TESTIMONY During the Committee of the Whole, the following mayors gave oral testimony concerning the water damage in their villages: Raymond Laguana, Greg Borja, Frank Portusach, Frank Lizama and Tito Mantanona. Mayor Laguana gave an overview of the flooding problems. Mayor Portusach gave an oral report of specific damages in his village. The other testifying mayors supported Bill 994 and the individual letters from each mayor, forwarded to the Speaker by the president of the Mayors' Council.

The following directors from the administration also gave oral testimony: Tony Blaz from PUAG, Benigno Palomo from the Department of Public Works, Michael J. Reidy from the Bureau of Budget and Management Research and Joe Terlaje from Civil Defense.

Director Blaz stated that his department was only concerned with sewer problems and that the Department of Public Works is the department concerned with flooding and drainage.

Director Palomo indicated that he would work with all the mayors individually to itemize the specific needs in their village.

A question and answer period followed:

Senator Tanaka expressed concern over the priorities of which flooding areas would be addressed . first. Director Palomo indicated that he wanted to contract jobs out. Senator Tanaka brought up the Polaris Point flood area and the Barcinas area in the village of Merizo as areas which needed to be addressed. 1 Senator Ruth wanted to know wit~. :a .L pr Jirector Palomo indicated that all of them were to some degree.

Senator Bamba brought up that 10 days is a short time to estimate the c .d contract work out to be done. He also brought up the problem of entry on private pr ;for land access and possible land exchanges with some individuals.

Senator Santos indicated that the Department of Land Management ~Liduldbe contacted for their input concerning possible government land which could be exchanged with certain individuals who are living in areas that will not be free of floods, in addition to the responsibility given to the Department of Public Works by Executive Order 89-26. He also was concerned that a system of ponding basins on private property be set up and that private property be acquired for this purpose. It was also discussed that in the Asan GHWRA development, federal funds could be mandated for improvement, and that federal money should be used before local money is spent.

Senator Lujan indicated that in the 19th and 20th Guam Legislatures various appropriations had been made and inquired whether funds appropriated in PL 20-18 had been released. She also indicated that cleaning debris from culverts could be done through the mayors hiring of their own village people. Director Palomo indicated that he would prefer temporary workers be hired through the Department of Public Works, unless they are small projects that mayors can do.

Senator Bordallo was concerned that only one or two people are on 24 hour call throughout the night at the Department of Public Works to take emergency call matters. Director Palomo indicated that they merely took the calls but that they would be calling for other persons to respond to emergencies.

Senator Brooks indicated. that culverts are not regularly maintained in the territory. Director Palomo indicated that they have an on-going cleaning program, but it is not enough. Director Terlaje indicated that he would like four houses to be set aside for emergencies to evacuate individuals, such as the Garrido family, now living at Civil Defense due to flooding.

Senator Mailloux was concerned about approval of engineering plans on construction, allowing improper water drainage.

Senator Aguon indicated that a study is needed on all the problem areas to produce a plan to address the situation.

Senator Reyes indicated supplemental funds are needed for the present emergency, with more flexibility than in the normal budget. Director Reidy indicated that he saw the situation as needing engineering solutions and land exchange solutions.

Senator Quitugua was concerned that the building permit section be available to advise individuals on locating their houses on their lots. Director Palomo indicated that this is available. Senator Quitugua also inquired whether FEMA emergency flooding insurance is available. Director Terlaje indicated that it was only available if there was a Presidential Declaration of the emergency. Senator Duenas indicated that many individuals are building their ho flood areas. Director Palomo indicated that the maps in his department are inadequate *vise people on these problems. Director Terlaje indicated that his department always ad .ndividuals to move to higher areas. Director Reidy indicated that he felt caution was ne A in the expenditures of public funds to correct naturally occurring situations on private pr erty, specifically the use of land exchange.

COMMITTEE FINDINGS & RECOMMENDATIONS The motion to rise indicated that the Committees on Ways and Means and the Committee on General Governmental Operations should prepare a bill with information received from the Director of Public Works in conjunction with the mayors of the villages, to have a bill and report ready for session on October 16.

Since the passing of Tropical Storm Colleen has pointed up long standing problems existing in the territory due to flooding, which have recently become worse, and since any new storm passing through the area can only repeat the damage caused by Tropical Storm Colleen, the Committee on Ways and Means and the Committee on General Governmental Operations "ecommends that the testimony, oral and written, received during the Committee of the Whole on Bill 994 on October 5, 1989, be adopted by the Committees and that the information derived from the coordination of the director of the Department of Public Works, the village mayors, as well as other officials of the administration, be inserted into a substitute bill to take care of problems not only caused by the recent tropical storm but to mitigate the flooding problems which are recurrent throughout the territory.

A fiscal note was not prepared during the Committee of the Whole hearing .

It is the recommendation of Committee on Ways and Means and the Committee on General Governmental Operations to pass a substitute bill incorporating the above recommendations, which is attached and labelled Bill 994, as substituted by the Committee on Ways and Means and General Governmental Operations. Section 2. The Mayors' Council shall determine the priorities of the problem areas which shall be addressed.

At the Mayors Counci 1 regular meeting held on October 4th, the total flooding problems were addressed. A1 1 the Mayors unanimous1y voted that a resolution be drafted and submitted to Governor Joseph F. Ada asking him to request the 20th Guam Legi~.latureto convene and address the funding to correct the flooding problems.

The 20th Guam Legi sl ature's Speaker, Vi ce-Speaker s.nd Chairman of the Commi t tee on Energy, Uti 1 i ties t Consumer Protect ion were present at the request of Mayor kaymcmd Laguana, President of the I-layors' Counci 1 . When discussing the funding for the f loading problem, the mayors were assured that on the fol lowing day (October 5th) the 20th Guam Legislature would convene to appropr i ate adequate funding to accommodate the needs of each vi 1 l age.

The Mayors were asked to go back to their respective off ices and 1 ist a.1 1 the areas of flooding problems in their 2 Municipalities so that the Legislature can derive at a figure to appropriate funding to correct the flooding probl ems.

The following are the Municipality of Dededo's floodir~g problem areas that need to be corrected:

VILLAGE OF AGANA HEIGHTS

1) FALLEN POWERLINE IN THE FOLLOWING AREA: a. Residence of Veronica Villareal (House No. 150) 1. LIVE WIRE HANGING FROM POWER POLE (Fallen tree caused power line to break)

RECOMMENDATION OFFERED: There are many trees throughout the village that are protruding out to the roadways and obstructing power lines that need immediate attention by the GPA tree trimming crew. To avoid accidental breakage of power lines, suggest that the GPA crew trim all tree branches that are protruding and obstructing power lines throughout the village. Trees that are protruding over roadways pose a hazard to large vehicles, such as school buses.

2) FLOODED AREAS THAT WERE AFFECTED BY TROPICAL STORM COLLEEN

a. PARKING AREA OF AGANA HEIGHTS ELEMENTARY SCHOOL b. FONTE RIVER/BRIDGE - Clogged up with bamboo trees and debris; overflowing 1. Recommend reconstruction/relocation of bridge as indicated on map. c. ROUTE 7 TO FONTE DRIVE - Trees and bamboos need to be cut down. Bamboos are sticking out to the road and pose a hazard to school buses passing by.

d. DRY WELL ON VICENTE SALAMON DRIVE \ \< 1. The dry well is overflowing. There is inadequate maintenance to the dry well. e. JOSEPH CRUZ AVENUE 1. Residence of Jose and Rafaela Cruz (Next to Agana Heights Elementary School. There is extensive water run-off coming from the sctiool grounds and from Kotla store area. The cruz property was flooded with over four feet of water during the storm. 2. Residence of Antonio Chaco (236 Joseph Cruz Avenue) 3. Property of the Terlaje Family and Garrido family (next to Nana's Store)

COMMENTSIRECOMMENDATIONS: Simple cleaning and upkeep of the storm drainage systems, culverts, and the proper maintenance of the drywell and ponding basins could have alleviated the flooding in some of the areas mentioned above. The heavy rains during and in the aftermath of the storm has caused intensive water run-off, resulting in damage and erosion on almost all of the streets and roads within the municipality of Agana Heights.

There is alot of work to be done, uch as buying property for the ponding basin, dry well and elocatating the families. I am requesting for someone who familarized in this field and also find an economical way o solve this problem. A) Radio Barrigada: The residence of Mr. Jose George is one of three families effected. There are in need of a dry well due to the fact the area in too small for a ponding basin or relocate the family. B) San Antonio Area: The residence of Mr. Paul Mendiola is one of the eight families effected in this area needs to buy land for ponding basin, dry well or relocate the family.

1. The retaining sea wall on route one - seashore side. The original wall has collapsed over the years and sand is now blocking the water passage coming from a ditch on the opposite side of the road. This causes a tremendous amount of flooding into the homes of Miss Pilar Kamminga and Mr. Jose Manibusan, whose wife is handicapped. This situation makes it very difficult for both residents when there is a heavy downpour of rain to combat the flooding that occurs. 2. The Taguag River Bridge located at the end of Assumption Drive. According to Mr. David Camacho, his assessment of this bridge has been submitted through the proper channels, but as of this writing, no response has been received. These people affected are as follows: Mrs. Vicenta Alcon, Mr. Jesus.Perez, Mrs. Theresa Cruz, Mrs. Rita Gumataotao, Mr. Juan Aflleje and Mrs. Josefina Rapolla. 3. The cleaning of the Taguag River, which runs from A. Quenga Street out to route one, behind the K-Automotive Shop. This assessment was done by Sixto Quintanilla. 4. The cleaning of the Masso River on Assumption Drive was also assessed by Mr. Quintanilla. The problem at this site is uprooted bamboo trees that have fallen into the river. Dur- ing heavy rains, the bamboo blocks the water paths and flows heavily on the sides close to the banks, causing some erosion on private properties.

5. Quenga Court - This road is totally inaccessible. The pot holes are large enough for a child's swimming pool. During the heavy downpour of rain last Saturday, September 9th, the homes of Mr. Joaquin Cruz and Mr. David Taimanglo were flood- ed. The repair of this road is very necessary in order to prevent future flooding. 6. Spruance Drive, Nimitz Hill. The Ditches on both sides of this drive, from Karningaville down past the Nimtz Hill Estates, needs cleaning. This people affected are: Mr. Frank Castro and mr. Jose Cruz. 7. River on Bella Street needs cleaning. Flooding in resi- dential homes occured Saturday, September 9th, Those affected in these areas are: Ms. Jennifer Terlaje, Mr. Frank Salas, Mr. Tony Falcon, Mr. Tomas Unsiog and Mr. Miguel Cruz.

8. Ditch near the 7-Eleven in Piti caused major flooding of approximately nine homes, including the Mayor's home. This culvert is located under Marine Drive across to the Santos Park. It nees to be flushed and san on oceanside needs to be dredged. Those affected in these areas are: Mr. Pedro Hart, Mr. Greg Conception, Mr. Jose Fejeran, Mr. Jose Quenga, Mrs. Abby Certeza, Ms. Eleanor Tuncap, Mr. Steve Aguon, Mayor Isabel Haggard and Mrs. Magdalena Tajalle,

ROUTE 17 - CROSS ISLAND ROAD During and after heavy down pour, the road near the residence of Mr. Vicente Guerrero and Mr. Ricardo Calvo becomes a lake and vehicles with low exhaust system cannot pass through, together with soil erosion on the road causing mud slime over road pavement.

RECOMMEND : Clear up and install adequate drainage/storm culvert to allow mudslide and rain water to flow across the road and drain into river below. BISHOP APURON AND BISHOP FLORES ST., 3OUTE 17 Soil erosion and hill side wash off covers existing CORAL filled street due to inadequate storm drain the the area, causing residents at times to abandon vehicles and walk to their homes. 4. Lucio Road in Agana Springs, - Entrance is giving way to erosion. - We recommend backfilling. 5. Ponding Basin at Chalan Gumayuus. - Plugged up due to heavy vegetation and dirt residue. - We recomend digging excess dirt resdue and clearing of vegetation inside and outside fence and securing the fence- P.0.
