An Act to authorize the Construction of certain Lines of Railway by the State. [28th December 1880.] HEREAS it is expedient that the construction of certain lines of Preamble, W railway more particularly described in the Schedules hereto should be undertaken by the State at the public expense : Be it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say) :— 1. This Act may he cited for all purposes as " The Railway Title of Act. Construction Act 1880." 2. In this Act the following terms shall have respectively the interpretation of following meaning and extent— terms- The term "the Board" shall mean the Board of Land and Works. The term 4C lands " shall include all real estate messuages lands tenements and hereditaments of any tenure. 3. It shall 1)0 lawful to make and maintain the following railways power to make in the lines and upon the lands described in the Schedules hereto and railways. within any deviation thereof as herein provided, and all proper works and conveniences in connection therewith (that is to say) :— The undermentioned Country Lines Nos. 1 to 17:— (1.) A railway commencing at the termination of the Dnnolly st.Amaudto and St, Arnaud Railway in the borough of St. Arnaud and Donald- terminating Published as a Supplement to the ' Victoria Government Gazette' of Friday, 31 st December 1880. 89 Hailway Construction. [44 VICT. terminating in the township of Donald in the line and upon First Schedule. the lands described in the First Schedule hereto, to he called the St, Arnand and Donald Railway. Inglewood to Charl- (2.) A railway commencing at the termination of the Sandhurst tOD. and Inglewood Railway in the borough of Inglewood and terminating at the township of Charlton in the line and upon Second Schedule. the lands described in the Second Schedule hereto, to be called the Inglewood and Charlton Railway. Charlton to Wyche- (3.) A railway commencing at the termination of the said proof. Inglewood and Charlton Railway and terminating at the township of Wycheproof in the line and upon the lands Third Schedule. described in the Third Schedule hereto, to he called the Charlton and Wycheproof Railway. Borung to Boort. (4.) A railway commencing on the said Inglewood and Charlton Railway in or near to the parish of Borung and terminating at the township of Boort in the line and upon the lands Fourth Schedule. described in the Fourth Schedule hereto, to be called the Borung and Boort Railway. Eaglehawk to (5.) A railway commencing on the Sandhurst and Inglewood Kerang. Railway and terminating at the township of Kerang in the line and upon the lands described in the Fifth Schedule Fifth Schedule. hereto, to be called the Eaglehawk and Kerang Railway. Shepparton to Nu- (6.) A railway commencing at the termination of the Goulburn murkah. Valley Railway in the township of Shepparton and terminat ing at the township of Numurkah in the line and upon the Sixth Schedule. lands described in the Sixth Schedule hereto, to be called the Shepparton and Numurkah Railway. Benalla towards (7.) A railway commencing on the North-Eastern Railway in Yarrawonga. the township of Benalla and terminating in the parish of St. James' in the line and upon the lands described in Seventh Schedule. the Seventh Schedule hereto, to be called the Benalla and Yarrawonga Railway. Horeham to Dim (8.) A railway commencing at the termination of the Stawell boola. and Horsham Railway in the parish of Horsham and ter minating at the township of Dimboola in the line and upon Eighth Schedule. the lands described in the Eighth Schedule hereto, to be called the Horsham and Dimboola Railway. Branxholme to Cas- (9.) A railway commencing on the Portland and Hamilton Rail terton. way at the township of Branxholme and terminating at the township of Casterton in the line and upon the lands Ninth Schedule. described in the Ninth Schedule hereto, to be called the Branxholme and Casterton Railway. Ballaratto Scarsdale. (10.) A railway commencing on the Ballarat and Ararat Railway in the parish of Dowling Forest and terminating at the borough 90 No. 682.] Railway Construction. borough of Scarsdale, in the line and upon the lands described in the Tenth Schedule hereto, to be called the Tenth Schedule. Ballarat and Scarsdale Railway. (11.) A railway commencing on the Melbourne and Murray Castiemaine to River Railway in the borough of Castiemaine and terminat- Maldon- ing at the borough of Maldon in the line and upon the lands described in the Eleventh Schedule hereto, to be called the Eleventh Schedule. Castiemaine and Maldon Railway. *' (12.) A railway commencing on the Ovens River and Beech- Everton to Myrtie- wortli Railway near the Everton railway station and termi- ford* nating at the township of Myrtleford in the line and upon the lands described in the Twelfth Schedule hereto, to be Twelfth schedule, called the Everton and Myrtleford Railway. (13.) A railway commencing at the termination of the Geelong coiae to camper- and Colac Railway in the township of Colac and terminating down- at the township of Camperdown in the line and upon the lands described in the Thirteenth Schedule hereto, to be Thirteenth Schedule. called the Colac and Camperdown Railway. (14.) A railway commencing on the North-Eastern Railway at Tallaroo.k to Yea. the Tallarook railway station ground and terminating at the township of Yea in the line and upon the lands described in the Fourteenth Schedule hereto, to be called the Tallarook Fourteenth and Yea Railway. Schedule. (15.) A railway commencing on the Melbourne and Murray Footscray to Bacchus River Railway about two miles and three-quarters west of arsi* the Footscray station and terminating in parish of Parwan in the line and upon the lands described in the Fifteenth Schedule hereto, to be called the Footscray and Bacchus Fifteenth Schedule. Marsh Railway. (16.) A railway commencing on the Gippsland Railway at the Traraigon to iiey- township of Traraigon and terminating at the township of Heyfield in the line and upon the lands described in the Sixteenth Schedule hereto, to be called the Traraigon and sixteenth Schedule. Heyfield Railway. (17.) A railway commencing on the Gippsland Railway Morweii to Mirboo. Morwell and terminating near the township of Mirboo in the line and upon the lands described in the Seven teenth Schedule hereto, to be called the Morwell and Seventeenth Mirboo Railway. Schedule- And the undermentioned Suburban and Special Lines Nos. 18 to 23 :— (18.) Alphington Railway. Melbourne to (20.) A railway commencing on the Melbourne and Murray Coburg. River Railway at or near to the Essendon Junction and terminating at the township of Coburg in the line and Twentieth Schedule. upon the lands described in the Twentieth Schedule hereto, to be called the Melbourne and Coburg Railway. Caulfleld to Frank- (21.) A railway commencing on the Gippsland Railway near ston. the Caulfielcl railway station and terminating at the township of Franks ton in the line and upon the lands described in Twenty-first the Twenty-first Schedule hereto, to be called the Caulfield Schedule. and Frankston Railway. Wodonga to the (22.) A railway commencing at the termination of the North- Murray. Eastern Railway at Wodonga and terminating at the Victorian bank of the River Murray opposite the town of Albury in New South Wales in the line and upon the lands Twenty-second described in the TAventy-second Schedule hereto, to be called Schedule. the Wodonga and Murray Railway. Ballarat to Ballarat (23.) A railway commencing on the Ballarat and Maryborough Racecourse. Railway in the parish of Ballarat and terminating at the Ballarat Racecourse in the parish of Dowling Forest in the Twenty-third line and upon the lands described in the Twenty-third Schedule. Schedule hereto, to be called the Ballarat Racecourse Branch Railway. Limit of deviation. 4. It shall be lawful to deviate from any of the lines of railway described in the said Schedules on either side thereof at any part thereof to the respective distances provided for in and by such Schedules but not to any greater distance ; and any of the said lines may be increased in length to an extent of not more than one-tenth of the entire length of such line as described in any such Schedule. Limit of expenditure 5. The expenditure for the construction of the said Country Lines per mile for construction of of raihvavs includino- stations shall be restricted to an average over railways. the whole of such Countrv Lines of Three thousand seven hundred and twenty-five pounds per mile, and the expenditure for rolling-stock for the whole of such lines shall not exceed the sum of One hundred and sixty-one thousand two hundred and sixty pounds.
