Wodonga Area Land Acquisition (Validation) Act 1980 156 ANNO VICESIMO NONO ELIZABETHAE SECUNDAE REGINAE VICTORIA Wodonga Area Land Acquisition (Validation) Act 1980 No. 9401 An Act to validate certain Purchases made by the Minister for State Development Decentralization and Tourism pursuant to the Wodonga Area Land Acquisition Act 1973. [Assented to 20 May 1980] BE IT ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say): Preamble. Whereas the Wodonga Area Land Acquisition Act 1973 empowered the Minister administering that Act to purchase land in the State of Victoria lying within a circle of 55 kilometres radius and centred on the mid-point of the Union Bridge connecting the Rural City of Wodonga in the State of Victoria to the City of Albury in the State of New South Wales: And whereas the Wodonga Area Land Acquisition {Amendment) Act 1974 amended- the said Wodonga Area Land Acquisition Act 1973 with effect from the 1st day of January 1975 so that thereafter the Minister was empowered to purchase land lying within the area proclaimed as a designated area pursuant to sub-section (2) of section 2 of the Albury-Wodonga Agreement Act 1973: And 1980 Wodonga Area Land Acquisition {Validation) No. 9401 157 And whereas some areas of land lying within the area prescribed by the Wodonga Area Land Acquisition Act 1973 but either partly or wholly outside the proclaimed designated area were purchased by the Minister pursuant to contracts entered into after the 1st day of January 1975: And whereas all such contracts of sale relating to land wholly or partly outside the designated area have been completed and doubts have arisen as to the authority of the Minister to make such purchases: Be it therefore enacted by the Queen's Most Excellent Majesty by and wath the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say): 1. (1) This Act may be cited as the Wodonga Area Land shon tuie. Acquisition {Validation) Act 1980. (2) This Act shall come into operation on the day on which it commence- receives the Royal Assent. "*"'• 2. Notwithstanding anything in any Act, the purchase by the Minister of— {a) in the case of items 1 to 3 in the Schedule, all of the land described in column 1 pursuant to the contracts of sale between the Minister and the persons specified in column 2 and in respect of which settlement was effected on the date specified in column 3; and {b) in the case of items 4 to 10 in the Schedule, those parts of the lands described in column 1 thqit lie outside the designated area declared under sub-section (2) of section 2 of the Albury-Wodonga Agreement Act 1973 pursuant to the contracts of sale between the Minister and the persons specified in column 2 and in respect of which settlement was effected on the date specified in column 3— shall not be invalid for the reason that, at the time the aforementioned contracts of sale were entered into, the lands referred to in paragraphs (a) and {b) lay outside the designated area declared under sub-section (2) of section 2 of the Albury-Wodonga Agreement Act 1973.     A Potted History Of North East Victoria Based on Vision & Realisation A Centenary History of State Education in Victoria Volume 3 Education Department of Victoria 1973 edited by Graham J Lee 1North of Rutherglen in the Gooramadda-Howlong area, Major Mitchell had crossed the Murray River on his return journey to Sydney in 1836. Even prior to Mitchell, squatters had moved into Victoria further upstream. In 1835, Mackillop and Macfarlane moved up the Mitta Mitta tributary to establish a run further south in Lake Omeo district. Charles Ebden was the first to take up a run in the north-east; during 1835 he established the Mungabareena run on the north bank of the Murray at the present site of Albury. Within weeks Ebden had crossed the Murray and established the Bonegilla run on the flats between the Mitta and Little River (Kiewa). With Ebden were William Wyse and James Gullifer; the latter established a run just south of Rutherglen in 1844. During Mitchells 1836 trek, Spalding attempted to settle Thologolong on the Murray above the junction with the Mitta Mitta; Vardy moved into this run in 1837 because Spalding had been forced to retreat temporarily when aborigines killed two of his men. West of that run, Waite took up Bungil, east of Mt Granya, with Jobbins at Talgarno, further west on the banks of the Mitta Mitta junction and Cobham to the south along that tributary at Wagra. Down the Murray past the Bonegilla run and the Kiewa tributary, Charles Huon squatted at Wodonga and in 1837 built the Baranduda homestead.

[\9th December, 1978.] DE it enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say) :— short utie. i. (l) This Act may be cited as the National Parks Act 1978. Principal Act (2) In this Act the National Parks Act 1975 is called the Principal No. 8702. Amended by Act. No. 9114. commence- (3) Except where otherwise expressly provided this Act shall mnt' come into operation on the 26th day of April, 1979. Amendment of 2. The Table of Parts and Divisions in section 1 (3) of the Principal Act shall be amended as follows :— (a) For the expression " ss. 17-32c." there shall be substituted the expression " ss. 17-32D."; (b) For the expression " ss. 28-32A.
