COUNTERPROPOSAL

I, Katherine Pyeatt, hereby submit this counterproposal requesting that the Commission amend Section 73 202(b) of its Rules, FM Table of Allotments, to allot FM Channel 224C3 to Gustine, Texas in lieu of Channel 290C3 to Rising Star, Texas as proposed in the Notice of Proposed Rule Making in the above-captioned proceeding

As demonstrated in the attached channel study, this proposal conflicts with the NPRM proposal to allot Channel 290C3 to Rising Star, Texas The counterproposal is providing for a 1' local service to the community of Gustine, Texas

Gustine, Texas is an incorporated community with a population of 436 Gustine has its own mayor, Walter Stevens, its own city office, its own volunteer fire department, post office, city ofices and several local churches. The Petitioner respectfully submits that the public interest would be served by allocating Channel 224C3 to Gustine as that community's first local FM service. The proposed channel 224C3 will provide additional diversity and an outlet for local self-expression to Gustine residents and therefore is in the public interest.

In order for Channel 224C3 to be allotted at Gustine, Texas, three vacant allotments will need to be replaced with equal or better channels, they are' Mullin, Baird, and Rotan Also, the pending allotment for Channel 243A at Evant will need to be replaced with Channel 241A and the reference coordinates for the vacant allotment, Channel 240A at Burnet will need to be relocated approximately 1.97 km south.

See revision of FM Assignment Policies and Procedures, 90 FCC 2d 88 (1992) (See, Attachment A) Note The vacant allotment for Channel 224N Mason was dismissed by Report & Order MM Docket No. 01-159, DA 03-826, released March 21,2003

Reference coordinates for Channel 224C3 at Gustine are:

In order for Channel 224C3 to be allotted at Gustine, Texas, the vacant allotment for Channel 224C3 at Mullin, Texas must be replaced by Channel 243C3 Attached hereto is a channel study confirming that Channel 243C3 can be allotted to Mullin, Texas, consistent with the FCC’s FM separation rules provided the necessary changes are made at Evant and Baird. See revision of FM Assignment Policies and Procedures, 90 FCC 2d 88 (1992) (h,Attachment B) Note Channel 243C2 at Lago Vista was dismissed by Report & Order, DA 03-1533, released May 8, 2003 Also note Dismissal was filed with the Commission on June 30, 2003 for Channel 243A at Goldthwaite, Texas (See, Attachment C)

In order for Channel 243C3 to be allotted at Mullin, Texas, the pending allotment for Channel 243A at Evant must be replaced by Channel 241A Attached hereto is a channel study confirming that Channel 241A can be allotted to Evant, Texas, consistent

In order for Channel 241A to be allotted at Evant, Texas, the reference coordinates for the vacant allotment for Channel 240A at Burnet, Texas must be moved approximately 1 97 km south. Attached hereto is a channel study confirming that the Reference coordinates for Channel 240A can be relocated 1.97 km south consistent with the FCC’s FM separation rules. See revision of FM Assignment Policies and Procedures, 90 FCC 2d 88 (1992) (&, Attachment E)

In order for Channel 243C3 to be allotted at Mullin, Texas, the pending allotment for Channel 243C3 at Baird, Texas must be replaced by Channel 290C2. This is the conflict with the NPWs proposal for Channel 290C3 at Rising Star. Attached hereto is a channel study confirming that Channel 290C2 can be allotted to Baird, Texas consistent with the FCC’s FM separation rules provided the necessary change is made at Rotan, Texas See revision of FM Assignment Policies and Procedures, 90 FCC 2d 88 (1992) (&, Attachment F)

Reference coordinates for Channel 290C2 at Baird, Texas are

32 17 19N 99 08 04 W

In order for Channel 290C2 to be allotted at Baird, Texas, the vacant allotment for Channel 290A at Rotan, Texas must be replaced by Channel 288A. Attached hereto is a channel study confirming that Channel 288A can be allotted to Rotan, Texas consistent with the FCC’s FM separation rules provided the reference coordinates for the vacant allotment 287A at Coahoma, Texas is moved 4 72 km east See revision of FM Assignment Policies and Procedures, 90 FCC 2d 88 (1992) (&. In order for Channel 288A to be allotted to Rotan, Texas, the vacant allotment for Channel 287A at Coahoma, Texas must be relocated 4 72 km east. Attached hereto is a channel study confirming that the reference coordinates for channel 287 at Coahoma, Texas can be relocated east 4 72 km consistent with the FCC’s FM separation rules See revision of FM Assignment Policies and Procedures, 90 FCC 2d 88 (1992) (See, Attachment I)

The new reference coordinates for Channel 287A at Coahoma, Texas are

Should this counterproposal be granted, and Channel 224C3 be allotted to Gustine, Texas, Petitioner will apply for Channel 224C3 at Gustine, Texas and after it is authorized, will promptly construct the new facility.
