Marks-Richardson This paper is a qualitative study on the influence of race and culture in the instructional planning within classrooms in a suburban school district. The study was designed using a focus group of teachers in grades 4-8 who demonstrated successful growth for African American students using value added measures on state assessments. The focus group members met to answer pre- determined research questions that tied to exploring the role of race and culture in the classroom. INTRODUCTION In the 1900s, advancements in music reproduction technology gave rise to two major copyright questions: (1) should sound record- ings be protected and (2) if so, to what degree? These questions stemmed from two considerations: (1) what promotes the progress of the useful arts and (2) what decisions need to be made in light of technological advancements that facilitate the reproduction of music? Today, new techniques of producing music present novel varia- tions on these questions. Specifically, how do music software pro- grams alter our conception of how sound recordings are produced, and to what extent, if any, should music producers be able to sample sound recordings constructed from pre-made loops? This Note is an attempt to answer these questions. Part II outlines the purpose of cop- yright law and how it applies to music. Part III discusses how the 1909 Copyright Act and early 20th century cases reflected initial atti- tudes asserting that sound recordings should not be protected. Part IV * Harvard Law School, J.D.
