General Terms and Conditions of Business and Use for Connected Rmi Services for Commercial Users GENERAL TERMS AND CONDITIONS OF BUSINESS AND USE FOR CONNECTED RMI SERVICES FOR COMMERCIAL USERS General information Connected RMI Services allows independent providers (hereinafter referred to as ‘users’) to provide repair and maintenance services (hereinafter referred to as ‘services’) for BMW, MINI and Rolls Royce vehicles, if the relevant vehicle owner (hereinafter referred to as ‘the customer’) so wishes. The following services can be provided for customers: Service partner services: As service partners for a vehicle, users receive the following information from the vehicle: • Teleservice Call Special sensors in the customer’s vehicle constantly check the wear behaviour and fluid levels. If maintenance work is required on the vehicle (and only in this case), all the relevant data for the automatic Teleservice Call is sent to you. • Teleservice Battery Guard The ‘Teleservice Battery Guard’ continuously monitors the customer vehicle’s battery level. If a battery problem is detected, the user or the customer is informed in good time to avoid difficulties with starting Company the engine or battery-related breakdowns. No. 42243 Breakdown assistance: If the user is appointed as the breakdown assistance partner for a vehicle, the customer can contact the user directly from the vehicle if and when a breakdown occurs. All the relevant data about the vehicle status and the current position of the customer’s vehicle is immediately transferred to you, and a voice connection is established. Depending on the vehicle generation and the country the vehicle is in, users can request the required data with customer approval and retrieve it remotely. The user can also carry out approved control functions remotely, provided that this service is enabled for their country and the vehicle meets the necessary technical specifications. The BASE (BMW Assistant for Service Events) application is provided for performing the accident assistance and breakdown assistance services. Please refer to the application’s user manual for further information. This manual can be downloaded from and viewed in the BMW AOS portal on the BASE preview page. Electronic service history: The user can view a customer’s electronic service history. This can be viewed using the KaSIO application. Customer approval through BMW CarData is not required for this. To view the electronic service history through the API, customer approval must be obtained by means of BMW CarData. Please refer to the application’s user manual for further information. The manual can be downloaded from and viewed in the BMW AOS portal on the KaSIO preview page. Repair history: The user can view a customer’s repair history. This can be viewed using the KaSIO application. Customer approval through BMW CarData is not required for this. To view the repair history through the API, customer approval must be obtained by means of BMW CarData. Please refer to the application’s user manual for further information. The manual can be downloaded from and viewed in the BMW AOS portal on the KaSIO preview page. The range of services offered may vary depending on what country the customer’s vehicle is being used in. In the first step, the user carries out the general setup and service setup (see Section 2). The user then carries out the vehicle allocation (see Section 3). Conclusion and subject matter of the contract 1.1 Bayerische Motoren Werke Aktiengesellschaft, Petuelring 130, 80788 Munich, registered office and registry court: Munich HRB 42243 (hereinafter referred to as ‘BMW’) provides Connected RMI Services in accordance with these General Terms and Conditions of Business and Use (‘Conditions of Use’). A contractual relationship regulating the use of Connected RMI Services between BMW and the user shall exist as soon as the user has accepted these Conditions of Use. 1.2 According to the definition of an ‘independent economic operator’ by EU Regulation 2018/858, the offer for using Connected RMI Services is aimed exclusively at entrepreneurs who are directly or indirectly involved in vehicle maintenance and repair. 1.3 The subject matter of the contract is the provision of vehicle-specific data using the aforementioned AOS applications or the API, which enable the user to provide the service in question. The data is transferred from BMW, MINI and Rolls Royce vehicles to BMW in the context of using BMW ConnectedDrive, MINI Connected or Rolls Royce Connect services. 2. Connected RMI Services – general setup and service setup The general setup and service setup can be performed using the ‘Connected RMI Services Administration’ AOS application and using ‘BMW CarData’. The first step is to perform the general setup. This is absolutely essential for subsequently carrying out the setup for the desired service. In the Connected RMI Service Administration, the general setup can be found under the ‘General Setup’ menu item, and under ‘Account Settings’ in BMW CarData. The service setup can then be completed in Connected RMI Services Administration or BMW CarData.
