PERUTUSAN Timbalan Perdana Menteri Malaysia Merangkap Menteri Dalam Negeri Dan Pengerusi Yayasan Pencegahan Jenayah Malaysia (MCPF) MINIT MESYUARAT AGUNG KE-23 PERUTUSAN Timbalan Perdana Menteri Malaysia merangkap Menteri Dalam Negeri dan Pengerusi Yayasan Pencegahan Jenayah Malaysia (MCPF) Assalamua’laikum Warahmatullahi Wabarakatuh, Salam Sejahtera dan Salam 1Malaysia. Bersyukur kita ke hadrat Allah S.W.T. kerana dengan izin dan limpah kurnia-Nya, kita berpeluang berhimpun sempena Mesyuarat Agung Tahunan Yayasan Pencegahan Jenayah Malaysia (MCPF), kali Ke-25. Jenayah dan kegiatan jenayah masih membimbangkan rakyat. Sungguhpun kadar indeks jenayah negara menurun, namun masyarakat masih sangsi dengan tahap keselamatan awam. Polis Diraja Malaysia (PDRM) sebelum ini diiktiraf sebagai agensi keselamatan terbaik di ASEAN menerusi pelbagai usaha pembanterasan jenayah. Namun persepsi umum masyarakat masih negatif, apa lagi disuakan dengan pelbagai berita jenayah setiap hari. Untuk mengharapkan sebuah negara bebas mutlak daripada jenayah adalah mustahil. Tetapi apa yang mungkin boleh dilakukan adalah dengan mengambil semua langkah perlu untuk mengurangkan kejadian jenayah atau untuk mencegahnya. Pencegahan adalah usaha yang membabitkan pelbagai sektor, berserta disiplin dan tindakan bersepadu. masyarakat dan segmen lain komuniti amat penting bagi mengawal meningkatnya kadar jenayah. Berlakunya jenayah adalah satu peringatan bahawa kita tidak boleh memandang remeh hal keselamatan dan kesejahteraan awam. Ingatlah, jenayah boleh berlaku di mana-mana dan di dalam keadaan apa sekalipun. Di sinilah kita sebagai petugas ketenteraman awam dan setiap anggota masyarakat perlu saling membahui tanggungjawab mencegahnya. Dengan itu, saya menyeru ahli MCPF semua peringkat negeri dan daerah agar bergerak lebih proaktif dengan melaksanakan pelbagai program dan aktiviti pencegahan, bagi memastikan kadar jenayah di Malaysia terus menurun. Di bahu kitalah letaknya tanggungjawab untuk mengembalikan keyakinan serta persepsi positif masyarakat terhadap kemampuan mengawal dan mencegah jenayah. Sekian dan selamat bersidang. Sehubungan dengan itu, YBhg. Tan Sri/ Dato’ Sri/ Datuk/ Dato’/ Tuan/ Puan sebagai Ahli MCPF dijemput hadir ke mesyuarat tersebut. Adalah dimaklumkan, kehadiran Mesyuarat Agung MCPF tertakluk kepada ahli yang telah didaftarkan sahaja mengikut Artikel 15(a) Perlembagaan MCPF. Sila bawa notis ini pada hari mesyuarat bagi memudahkan proses urusan masuk dan pendaftaran. 4. PENDAHULUAN 1.1 Mesyuarat dimulakan dengan ucapan Pengacara Majlis dan bacaan doa oleh Ustaz Mohammad Husni bin Ali dari Bahagian Agama dan Kaunseling (BAKA), Ibupejabat Polis Kontinjen Selangor. 1.2 Seterusnya Setiausaha Kehormat MCPF, SAC Dato’ Zainal bin Abu mengalu-alukan kehadiran semua ahli mesyuarat. Beliau mengambil kesempatan mengucapkan terima kasih kepada YAB Dato’ Seri Dr. Ahmad Zahid Hamidi yang sudi mempengerusikan mesyuarat pada kali ini. Makluman 2. UCAPAN ALUAN YAB PENGERUSI MCPF 2.1 YAB Dato’ Seri Dr. Ahmad Zahid Hamidi yang mempengerusikan mesyuarat mengalu-alukan kehadiran semua serta mengucapkan Selamat Hari Polis Ke-210 yang telah disambut pada 25 Mac 2017 yang lalu. Makluman 2.2 YAB Pengerusi menekankan bahawa MCPF mesti memberi tumpuan kepada program dan aktiviti pencegahan jenayah. Beliau merakamkan ucapan penghargaan kepada MCPF dan Jabatan Pencegahan Jenayah dan Keselamatan Komuniti (JPJKK), Polis Diraja Malaysia yang sentiasa bekerjasama berusaha melaksanakan program pencegahan jenayah di seluruh negara. Makluman 5 MINIT MESYUARAT AGUNG KE-24 2.3 YAB Pengerusi berharap pada tahun ini MCPF akan menerima peruntukan tahunan daripada Kementerian Kewangan dan bukannya peruntukan one-off seperti sebelum ini. Makluman 2.4 YAB Pengerusi seterusnya memaklumkan tentang contoh terbaik yang ditunjukkan oleh MCPF Daerah Batu Pahat dan Pontian Johor yang sentiasa melaksanakan pelbagai program dan aktiviti pencegahan jenayah dengan mencari dana sendiri tanpa mengharapkan peruntukan kewangan daripada MCPF Pusat semata-mata. Beliau berharap MCPF Daerah yang lain dapat mengikuti contoh tersebut. MCPF Negeri dan MCPF Daerah mesti bergerak lebih efektif dan proaktif lagi dalam melaksanakan pelbagai program dan aktiviti pencegahan jenayah. Tindakan: MCPF Negeri dan Daerah 2.5 YAB Pengerusi turut menekankan agar penglibatan masyarakat perlu dipertingkatkan lagi supaya masyarakat dapat memahami usaha-usaha yang dijalankan oleh pihak penguatkuasa serta tidak menyalahkan pihak polis semata-mata apabila sesuatu kejadian jenayah berlaku. Makluman 3. MENYEMAK DAN MENGESAHKAN MINIT MESYUARAT AGUNG TAHUNAN MCPF KALI KE-23 BERTARIKH 26HB. MAC 2016 3.1 Minit Mesyuarat Agung Tahunan MCPF Kali Ke-23 telah disemak oleh semua ahli mesyuarat. YBhg. Datuk Mak Foo Wei (No. Ahli: 102057) mencadangkan agar minit mesyuarat tersebut disahkan dan disokong oleh YBhg. Tan Sri Datuk Robert Phang (No. Ahli: 101576). 3.2 Minit mesyuarat telah disahkan tanpa sebarang pindaan. Makluman 6 MINIT MESYUARAT AGUNG KE-24 4. PERKARA BERBANGKIT 4.1 Pindaan Perlembagaan MCPF 4.1.1 Setiausaha Kehormat memaklumkan bahawa Mesyuarat Agung Luar Biasa (EGM) MCPF telah diadakan pada 15 Mei 2016 dan permohonan pindaan Perlembagaan MCPF telah diluluskan oleh Jabatan Pendaftaran Pertubuhan Malaysia (ROS) pada 17 Jun 2016. 4.1.2 Manakala penubuhan MCPF Daerah adalah melalui MCPF By- Laws and Regulations (Ref.1/2016) dan MCPF By-Laws and Regulations (Ref.1/2017) (Amendment to Ref. 1/2016) yang telah diluluskan oleh Mesyuarat EXCO MCPF Bilangan 4- 2016/2017 bertarikh 23 Ja nuari 2017. Makluman 4.2 Sistem pencalonan dan pengundian EXCO MCPF yang lebih sistematik 4.2.1 Setiausaha Kehormat memaklumkan bahawa Jawatankuasa Pengurusan MCPF yang dipengerusikan oleh YBhg. Tan Sri Lee Lam Thye memutuskan agar satu jawatankuasa untuk mengkaji dan memperkenalkan sistem pencalonan dan pengundian EXCO MCPF akan dibentuk dalam tempoh masa terdekat. Tindakan: Jawatankuasa Pengurusan MCPF 5. MEMBENTANGKAN DAN MELULUSKAN LAPORAN TAHUNAN 2016 5.1 Setiausaha Kehormat telah membentangkan Laporan Tahunan 2016 sepertimana yang telah diedarkan kepada semua ahli mesyuarat. 5.2 Laporan tersebut telah dicadangkan sah oleh YBhg. Datuk Francis Yap (No. Ahli: 100760) dan disokong oleh semua ahli mesyuarat. Makluman 7 MINIT MESYUARAT AGUNG KE-24 6. MEMBENTANGKAN DAN MELULUSKAN LAPORAN PENYATA KEWANGAN TAHUN BERAKHIR 31 DISEMBER 2016 6.1 Cik Kok Siew Yee mewakili Tan Sri Eddy Chen Lok Loi (Bendahari MCPF) telah membentangkan Laporan Kewangan Tahun Berakhir 31 Disember 2016 yang telah diaudit oleh Juruaudit Bertauliah iaitu Deloitte. Makluman 6.2 Beliau memaklumkan tentang dana terkumpul / accumulated funds adalah berjumlah RM6,047,213.00. Beliau seterusnya meminta ahli mesyuarat untuk merujuk kepada laporan penyata pendapatan dan perbelanjaan pada mukasurat 5 penyata kewangan. Makluman 6.3 Seterusnya YBhg. Datuk Mak Foo Wei (No. Ahli: 102057) telah mencadangkan agar Laporan Kewangan yang dibentangkan dapat diluluskan dan telah disokong oleh Encik Kelvin Yeap (No. Ahli: 100171). Laporan diterima sebulat

Berdasarkan keputusan ujian penilaian asas undang-undang yang di jalankan terhadap pelatih-pelatih kursus asas konstabel pada Jan 2020, saya dapati keputusan tersebut tidak mencapai tahap yang memuaskan. Melalui kajian ini saya dapat merumuskan, terdapat beberapa kelemahan yang diperolehi sepanjang proses pembelajaran. PDRM perlu merangka beberapa kaedah yang boleh memperbaiki segala kelemahan yang terdapat semasa proses pembelajaran tersebut. Proses pembelajaran asas undang-undang ini disampaikan dengan menggunakan bahasa Melayu kepada pelatih-pelatih konstabel yang berlatar belakangkan pelbagai kaum. Yang pastinya, pengguanan bahasa Melayu bukan menjadi satu punca kepada kelemahan dalam proses pembelajaran undang-undang tersebut.

He also uploaded a picture of him shaking hands with the Zakir, who is dressed in a suit. PAS meanwhile uploaded a picture of Hadi embracing Zakir in what they called a “historic meeting” of their own in Putrajaya. The meeting is part of the Indian national preacher’s Malaysia tour from April 15 - 18, PAS said in a Facebook post. Zakir, whom the Agong awarded 'tokoh maal hijrah' in 2013, courted controversy when inspector-general of police (IGP) Khalid Abu Bakar ordered the cancellation of the Malacca and Kuala Lumpur lectures, citing a threat to public peace. Hindu groups had lodged police reports against the lecture, saying that Zakir had previously made slanderous comments against other religions. Khalid retracted the ban on the Kuala Lumpur event, while Home Minister Ahmad Zahid Hamidi overturned the IGP’s decision on the Malacca lecture. The government increasingly targeted regime critics and those challenging conservative societal norms in 2014. In August and September alone, at least eight people faced sedition charges. In March, in a move that was widely viewed as politically motivated, the Court of Appeal reinstated the 2012 sodomy conviction of opposition leader Anwar Ibrahim. Also in March, authorities arrested 114 Shiite Muslims in Perak for attending a religious celebration. In June, Prime Minister Najib Razak and a political ally filed a defamation suit against editors Steven Gan and Fathi Aris Omar of the independent online outlet Malaysiakini for the publication of compilations of reader comments concerning Najib. In August, the Court of Appeal upheld a conviction of malfeasance against Inspector General of Police Tan Sri Khalid Abu Bakar and his subordinates in the cover-up of the high-profile torture and killing of Kugan Ananthan, who died in 2009 while in police custody. Despite the ruling, Khalid retained his post. Malaysia’s LGBT (lesbian, gay, bisexual, and transgender) community faces discrimination and hostility from both state and nonstate actors. In June, an Islamic law court in the state of Negeri Sembilan fined 16 transgender women and sentenced them to seven days in prison under a law that prohibits men from wearing women’s clothing in public.

This is also known as pre-trial detention. However, under certain circumstances, the suspect can be remanded repeatedly depending on the number of police reports filed against him or her. Such a practice is also known as chain remand and is said to infringe on the rights of the arrested suspect. However, this practice is technically permissible under the law, as provided under section 117 of the Criminal Procedure Code (“CPC”). This article aims to study the application of the law with regards to chain remand and identify weaknesses in the existing legal provisions. Furthermore, this study also seeks to explore the justifications for practicing chain remand in Malaysia and its implications on the detainees at large. Through its findings, this study highlights the existing loopholes in the law that need to be addressed to ensure that justice is upheld.
