DRAFT.

AN ORDINANCE TO AMEND THE GAME PRESERVATION ORDINANCE.

BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof :—

1. This Ordinance may be cited as the Game Preservation Short title. (Amendment) Ordinance, 1939, and shall be read as one with the Game Preservation Ordinance, hereinafter referred to as the prin• Cap. 64. cipal Ordinance.

2. Section 2 of the principal Ordinance shall be amended by Amendment of the addition of the following words at the end of the definition of section 2 of the principal "police officer" appearing therein :— Ordinance. "and any person authorised by the High Commissioner to exercise the powers conferred on a police officer by this Ordinance."

3. Section 10 of the principal Ordinance shall be amended by Amendment of the addition of the following subsection at the end thereof as sub• section 10 of the principal section (5) :— Ordinance. " (5) Any police officer may confiscate any apparatus or de• coy used for the snaring or capture of any bird or animal con• trary to the provisions of this Ordinance and may release any bird or animal so snared or captured."

OBJECTS AND REASONS.

This draft Ordinance amends the Game Preservation Ordinance (Chapter 64) by providing that the powers exercisable by police officers and wardens under that Ordinance may be exercised also by persons specially authorised for the purpose by the High Commissioner, and by extending these powers to include summary powers of confiscating apparatus used in trapping birds and animals contrary to the pro• visions of the Ordinance, and of releasing the bird or animal so trapped. The par• ticular object of the amendments is to enable prompt and effective measures to be taken to stop the practice of trapping and caging song birds in towns, which has become very prevalent.

AN ORDINANCE TO AMEND THE DEAD SEA CONCESSION ORDINANCE, 1937.

BE IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof :—

Short title. 1. This Ordinance may be cited as the Dead Sea Concession (Amendment) Ordinance, 1939, and. shall be read as one with the No. 23 of 1937. Dead Sea Concession Ordinance, 1937, hereinafter referred to as the principal Ordinance.

Amendment of 2. The Schedule to the principal Ordinance shall be amended Schedule to the by the following alterations to the text of •the Concession set out principal therein :— Ordinance. (a) the substitution of the word "salts" for the word "salt" and the insertion of a bracket")" between the words "use!" and "from", appearing in the paragraph commencing with the word "THIRDLY" in Article 2 thereof; (b) the insertion of the word "rights" immediately after the word "existing", appearing in the paragraph commencing with the word "FOURTHLY" in Article 2 thereof; (c) the substitution of the figure "4J" for the figure "It?" ap• pearing in paragraph (ii)(b) of Article 25 thereof; (d) the deletion of the word "and" appearing between the words "Company" and "which cannot be settled" in para• graph (1) of Article 35 thereof.

Commencement. 3. This Ordinance shall be deemed to have come into force on the 19th day of August, 1937.

OBJECTS AND REASONS.

This Ordinance rectifies one or two minor errors which appear in the text of the Concession for the extraction of salts and minerals in the Dead Sea, as it is set out in the Schedule to the principal Ordinance, which validates the Concession. The errors appeared in the first reprint of the Concession published in the Gazette No. 260 of 1st January, 1930, but they did not appear in the actual original agree• ment signed by the parties.

NOTICE.

PALESTINE RAILWAYS.

TRANSPORT OF CITRUS FRUIT BY RAIL FOR SHIPMENT VIA HAIFA.

IT IS HEREBY NOTIFIED that from the 1st December, 1939, and until further notice,

the following regulations will apply in respect of the offloading of wragohs used for the conveyance of citrus fruit to Haifa :—

(i) The period allowed free for the offloading of wagons at Haifa Port from the time first placed for offloading will be limited to four hours after which demurrage will be charged at the rate of 9 mils per hour or part thereof per ton of the carrying capacity of the wagons used.

(ii) Sunday will not be regarded as a "dies non".

(iii) Wagons shall be deemed to be placed for offloading when they are shunted on to lines 3, 6, 7 and 7 loop opposite transit sheds Nos. 3, 6 and 7 or on the lines on the front of the Quay or when they are placed at any other point where offloading is authorised. (iv) Wagons placed between 1800 and 0600 hours will not be liable to de­ murrage charges until four hours have elapsed from 0600 hours, except as provided for in paragraph (vii) below.

(v) Wagons will be placed for offloading in the order in which they arrive and once placed will not be shunted out for offloading elsewhere.

(vi) The Railway reserves the right to make arrangements with the Port

Manager to offload any wagons remaining under load in; excess of the period allowed free and to collect a charge for this service in accordance with the special rates prescribed for this service in the order made under section 10(1) of the Ports Ordinances, 1926-1933, and published in Pal­ estine Gazette No. 482 of the 27th December, 1934; in addition to any demurrage charges which may have accrued.

(vii) The Railway will require that offloading shall continue during the night if this is demanded by the situation. In this event demurrage charges will be raised on any wagons not offloaded within four hours of being placed in position. ,/ •

(viii) The notice published in the Palestine Gazette No. 832 dated the 27th Oc­ tober, 1938, is hereby revoked.
