De burgemeester bepaalt bij de aanwijzing of er sprake is van een gewoon overlastgebied, een uitgaansoverlastgebied of een dealeroverlastgebied. Indien de persoon zich hieraan opnieuw schuldig maakt, kan een verblijfsverbod voor de duur van zes maanden volgen; dat thans in Amsterdam drie gebieden zijn aangewezen als dealeroverlastgebied: Amsterdam Centrum De Wallen (1.1), Amsterdam Centrum Nieuwezijds Voorburgwal (1.2) en Amsterdam Zuidoost Flierbos- dreef (3.2). Deze gebieden zijn aangewezen naar aanleiding van een onderzoek naar (nepdope)dealers in Amsterdam. Uit dit onderzoek bleek dat de (nepdope)dealers zich voornamelijk in bovengenoemde gebieden bevonden; dat de burgemeester voornemens is per 1 juli 2015 de dealeroverlastgebieden Centrum 1.1 en 1.2 samen te voegen.
