Aanwijzing dealeroverlastgebied Amsterdam Centrum, Waterlooplein en omgeving (Dealeroverlastgebied 1.3)(3B, 2015, 132) Afdeling 3B Nummer 132 Publicatiedatum 23 juni 2015 Onderwerp Aanwijzing dealeroverlastgebied Amsterdam Centrum, Waterlooplein en omgeving (Dealeroverlastgebied 1.3) De burgemeester van Amsterdam Overwegende: dat de burgemeester op grond van artikel 2.8 Algemene Plaatselijke Verordening (APV) gebieden in Amsterdam kan aanwijzen als overlastgebied indien er sprake is van ernstige verstoring of bedreiging van de openbare orde. De burgemeester bepaalt bij de aanwijzing of er sprake is van een gewoon overlastgebied, een uitgaansoverlastgebied of een dealeroverlastgebied. In deze gebieden gelden verschillende regimes van verblijfsverboden. In een dealeroverlastgebied kan op basis van artikel 2.9A APV aan personen die zich schuldig maken aan de handel in drugs of nepdope een verblijfsverbod (DOG-maatregel) worden opgelegd voor drie maanden. Indien de persoon zich hieraan opnieuw schuldig maakt, kan een verblijfsverbod voor de duur van zes maanden volgen; dat thans in Amsterdam drie gebieden zijn aangewezen als dealeroverlastgebied: Amsterdam Centrum De Wallen (1.1), Amsterdam Centrum Nieuwezijds Voorburgwal (1.2) en Amsterdam Zuidoost Flierbos- dreef (3.2). Deze gebieden zijn aangewezen naar aanleiding van een onderzoek naar (nepdope)dealers in Amsterdam. Uit dit onderzoek bleek dat de (nepdope)dealers zich voornamelijk in bovengenoemde gebieden bevonden; dat de burgemeester voornemens is per 1 juli 2015 de dealeroverlastgebieden Centrum 1.1 en 1.2 samen te voegen. De burgemeester is voorts voornemens per 1 juli 2015 dealeroverlastgebied Amsterdam Zuidoost 3.2 in te trekken; dat in de gebieden Zuidelijke Nieuwmarkt, Waterlooplein, Uilenburg en de centrumzijde van de Weesperbuurt en de Plantagebuurt (hierna: Waterlooplein e.o.) sprake is van ernstige (hard)drugsoverlast en drugsgerelateerde criminaliteit.
