Proposed AMICUS BRIEF Project SALAM, the Muslim Solidarity Committee And the Masjid As Salaam ________________________________________________________________________ On October 10, 2006, Yassin Muhidden Aref (hereinafter “Aref”), and Mohammed Mosharref Hossain (hereinafter “Hossain”) were convicted of terrorism-related charges in connection with an FBI sting involving the sale of a fake missile for a fictitious terrorist attack, and for money laundering. Aref was also convicted of one count of lying to the FBI. On March 8, 2007 the two defendants were sentenced to 15 years incarceration each. Their appeals to the Second Circuit Court of Appeals and to the U.S. Supreme Court were denied, and they have exhausted their appellate remedies. Aref and Hossain have petitioned this court pursuant to the Federal Rules of Criminal Procedure, Section 2255 for, among other issues, the appointment of an independent prosecutor to review their cases to determine if the government and the courts provided them with necessary exculpatory information, a fair trial and justice. They seek relief similar to what was granted in People v. Theodore Stevens (a Stevens review), or what the Inspector General of the Department of Justice recommended in his June 10, 2009 Report to correct the failure of the Justice Department to identify and provide exculpatory information in terrorism cases – an independent review. Copeland, PhD University of Pittsburgh, 2006 This study aims to evaluate whether surprise and intelligence failure leading to mass casualty terrorism are inevitable. It explores the extent to which four factors – failures of public policy leadership, analytical challenges, organizational obstacles, and the inherent problems of warning information – contribute to intelligence failure. This study applies existing theories of surprise and intelligence failure to case studies of five mass casualty terrorism incidents: World Trade Center 1993; Oklahoma City 1995; Khobar Towers 1996; East African Embassies 1998; and September 11, 2001. A structured, focused comparison of the cases is made using a set of thirteen probing questions based on the factors above. The study concludes that while all four factors were influential, failures of public policy leadership contributed directly to surprise. Psychological bias and poor threat assessments prohibited policy makers from anticipating or preventing attacks. Policy makers mistakenly continued to use a law enforcement approach to handling terrorism, and failed to provide adequate funding, guidance, and oversight of the intelligence community.

    Outline of the 9/11 Plot Staff Statement No. 16 Members of the Commission, your staff is prepared to report its preliminary findings regarding the conspiracy that produced the September 11 terrorist attacks against the United States. We remain ready to revise our understanding of this subject as our work continues. Dietrich Snell, Rajesh De, Hyon Kim, Michael Jacobson, John Tamm, Marco Cordero, John Roth, Douglas Greenburg, and Serena Wille did most of the investigative work reflected in this statement. We are fortunate to have had access to the fruits of a massive investigative effort by the Federal Bureau of Investigation and other law enforcement agencies, as well intelligence collection and analysis from the Central Intelligence Agency, the National Security Agency, the State Department, and the Department of Defense. Much of the account in this statement reflects assertions reportedly made by various 9/11 conspirators and captured al Qaeda members while under interrogation. We have sought to corroborate this material as much as possible. Some of this material has been inconsistent. We have had to make judgment calls based on the weight and credibility of the evidence. A Kuwaiti from the Baluchistan region of Pakistan, KSM grew up in a religious family and claims to have joined the Muslim Brotherhood at the age of 16.

An identical response is being sent to the other Senators who joined in your letter. The decision to charge Mr. Abdulmutallab in federal court, and the methods used to interrogate him, are fully consistent with the long-established and publicly known policies and practices of the Department of Justice, the FBI, and the United States Government as a whole, as implemented for many years by Administrations of both parties. Those policies and practices, which were not criticized when employed by previous Administrations, have been and remain extremely effective in protecting national security. They are among the many powerful weapons this country can and should use to win the war against al-Qaeda. I am confident that, as a result of the hard work of the FBI and our career federal prosecutors, we will be able to successfully prosecute Mr. Abdulmutallab under the federal criminal law. I am equally confident that the decision to address Mr. Abdulmutallab's actions through our criminal justice system has not, and will not, compromise our ability to obtain information needed to detect and prevent future attacks. There are many examples of successful terrorism investigations and prosecutions, both before and after September 11, 2001, in which both of these important objectives have been achieved -- all in a manner consistent with our law and our national security interests.
