The Decline of Formal Marriage: Inevitable or Reversible? MARSHA GARRISON* I. Introduction All over the industrialized world, marriage is in decline. Cohabitation, which has waxed as marriage has waned, is a much less stable relational form. In the United States, half of all cohabiting relationships dissolve within eighteen months;' in both North America and Europe, children born to cohabiting parents are two to four times more likely to experience their parents' separation than are children born to married parents.2 Cohabitation is also a more variable relational form than marriage. * Professor of Law, Brooklyn Law School. Dr. MacPhee created Volume VII when he added supplemental data and errata to the original 1792 Volume II. This electronic edition has been amended for the errata noted by Dr. MacPhee. - i - THE LIVES OF OUR FATHERS PREFACE TO VOLUME II In Volume I the author has established the surnames of most of our Clan and has proposed the sources of the peculiar name by which our Gaelic compatriots defined us. In this examination we have examined alternate progenitors of the family. Any reader of Scottish history realizes that Highlanders like to move and like to set up small groups of people in which they can become heads of families or chieftains. This was true in Colonsay and there were almost a dozen areas in Scotland where the clansman and his children regard one of these as 'home'. The writer has tried to define the nature of these homes, and to study their growth. It will take some years to organize comparative material and we have indicated in Chapter III the areas which should require research. In Chapter IV the writer has prepared a list of possible chiefs of the clan over a thousand years. The books on our Clan give very little information on these chiefs but the writer has recorded some probable comments on his chiefship. -

[tabgroup layout="vertical"] The Emergence of “Divorce Before Consummation” as a Legal Category in Jordanian Sharia Courts #fictions written by Geoffrey Hughes May 3, 2016 Today’s inquiry into the nature of legal fictions takes us to Jordan’s government- run Sharia courts, where the concept of “divorce before consummation” ṭalāq( qabl al-dakhūl) has become something of a “living fiction.” Nowadays, “divorce before consummation” is dutifully tracked through the Sharia Courts’Annual Statistical Report in its section on divorces. Those figures are (somewhat ironically) further disseminated by dissident Islamic intellectuals in their critiques of the state, its courts, and the broader society. A representative sample of over 800 marriage contracts dating from 1926 to 2011 that I constructed shows that the category of “divorce before consummation” appeared relatively suddenly in marriage contracts in the late nineties, after which point a small but consistent number of contracts in the sample invoked the category. Interviews with Court officials and experts in customary law reveal that secular officials in governors’ 1 of 9 [tabgroup layout="vertical"] offices have been obviating Sharia Court authority for decades in extreme cases of “divorce before consummation” in the name of public order. Yet despite solving an immediate problem by filling a gap in the courts’ system of terminology for personal [marital] status, the concept has simultaneously become a sort of platform from which people can voice critiques of not only the broader society but also the state and the courts themselves. As I have argued elsewhere (Hughes 2015), Jordan is home to a number of overlapping codes of family law. -

The Disquisition on Ptolemy's Geography of Scotland first appeared in the Transactions of the Gaelic Society of Inverness, and, later, as a pamphlet. The Publisher feels sure that the issue of these Treatises in their present foim will confer a boon on those who cannot have access to them as originally published. They contain a great deal of information on subjects which have for long years interested Gaelic students and the Gaelic public, although they have not always properly understood them. Clan Donald Lands Trust: The First Steps A recollection from the Right Honourable Godfrey James Macdonald of Macdonald, 8th Lord Macdonald and 34th High Chief of Clan Donald, March 2019 Introduction It is now nearly fifty years since our Clan embarked on the latest chapter of our great history, namely the establishment of the Clan Donald Lands Trust. What we created then was without precedent - a Clan owning its own lands, administered by a board of Trustees from all parts of the English speaking world, for the benefit of all clansmen worldwide. This was a truly gargantuan undertaking, and as there are now only two of the original Trustees still alive, Clanranald and myself, I think that it is important to place on record those exciting, nail-biting, terrifying and sometimes desperate early days that have enabled the Clan Donald Lands Trust to become a reality. Background Following the death of my father in November 1970 and the inevitable sale of the Macdonald Estates to cover two lots of Death Duties and other inherited honourable debts some dating back to 1812, I was approached by Donald J Macdonald of Castleton, then President of the Clan Donald Society of Edinburgh. It had always been his dream that the Clan should acquire a small piece of the original Kingdom of the Isles, and that it should be held in perpetuity for all clansmen, while also concentrating on the historical and educational aspects associated with the Lordship of the Isles. The family were under enormous pressure to conclude a sale of the estate by the end of July 1971, so the Clan had less than six months to raise sufficient funds to enable it to make a meaningful offer for the estate. -

The Origins and Expansion of the O’Shea Clan At the beginning of the second millennium in the High Kingship of Brian Boru, there were three distinct races or petty kingdoms in what is now the County of Kerry. In the north along the Shannon estuary lived the most ancient of these known as the Ciarraige, reputed to be descendants of the Picts, who may have preceded the first Celts to settle in Ireland. On either side of Dingle Bay and inland eastwards lived the Corcu Duibne1 descended from possibly the first wave of Celtic immigration called the Fir Bolg and also referred to as Iverni or Erainn. The common explanation of Fir Bolg is ‘Bag Men’ so called as they allegedly exported Irish earth in bags to spread around Greek cities as protection against snakes! However as bolg in Irish means stomach, generations of Irish school children referred to them gleefully as ‘Fat bellies’ or worse. Legend has it that these Fir Bolg, as we will see possibly the ancestors of the O’Shea clan, landed in Cork. Reputedly small, dark and boorish they settled in Cork and Kerry and were the authors of the great Red Branch group of sagas and the builders of great stone fortresses around the seacoasts of Kerry. Finally around Killarney and south of it lived the Eoganacht Locha Lein, descendants of a later Celtic visitation called Goidels or Gaels. HAMMOND Ethnicity and the Writing of Medieval Scottish history1 ABSTRACT Historians have long tended to define medieval Scottish society in terms of interactions between ethnic groups. This approach was developed over the course of the long nineteenth century, a formative period for the study of medieval Scotland. At that time, many scholars based their analysis upon scientific principles, long since debunked, which held that medieval ‘peoples’ could only be understood in terms of ‘full ethnic packages’. This approach was combined with a positivist historical narrative that defined Germanic Anglo-Saxons and Normans as the harbingers of advances in Civilisation. While the prejudices of that era have largely faded away, the modern discipline still relies all too often on a dualistic ethnic framework. This is particularly evident in a structure of periodisation that draws a clear line between the ‘Celtic’ eleventh century and the ‘Norman’ twelfth. Furthermore, dualistic oppositions based on ethnicity continue, particu- larly in discussions of law, kingship, lordship and religion. Geoffrey Barrow’s Robert Bruce and the Community of the Realm of Scotland, first published in 1965 and now available in the fourth edition, is proba- bly the most widely read book ever written by a professional historian on the Middle Ages in Scotland.2 In seeking to introduce the thirteenth century to such a broad audience, Barrow depicted Alexander III’s Scot- land as fundamentally -

History Of The Mackenzies Alexander Mackenzie THE HISTORY OF THE MACKENZIES. ORIGIN. THE CLAN MACKENZIE at one time formed one of the most powerful families in the Highlands. It is still one of the most numerous and influential, and justly claims a very ancient descent. But there has always been a difference of opinion regarding its original progenitor. It has long been maintained and generally accepted that the Mackenzies are descended from an Irishman named Colin or Cailean Fitzgerald, who is alleged but not proved to have been descended from a certain Otho, who accompanied William the Conqueror to England, fought with that warrior at the battle of Hastings, and was by him created Baron and Castellan of Windsor for his services on that occasion. THE REPUTED FITZGERALD DESCENT. According to the supporters of the Fitzgerald-Irish origin of the clan, Otho had a son Fitz-Otho, who is on record as his father's successor as Castellan of Windsor in 1078. Fitz-Otho is said to have had three sons. Gerald, the eldest, under the name of Fitz- Walter, is said to have married, in 1112, Nesta, daughter of a Prince of South Wales, by whom he also had three sons. Fitz-Walter's eldest son, Maurice, succeeded his father, and accompanied Richard Strongbow to Ireland in 1170. He was afterwards created Baron of Wicklow and Naas Offelim of the territory of the Macleans for distinguished services rendered in the subjugation of that country, by Henry II., who on his return to England in 1172 left Maurice in the joint Government. -
