MLS as a Sports Product – the Prominence of the World’s Game in the U.S. April 8, 2021 Abstract The purpose of this Working Paper is to analyze how soccer at the professional level in the U.S., with Major League Soccer as a focal point, has developed over the span of a quarter of a century. It is worthwhile to examine the growth of MLS from its first game in 1996 to where the league currently stands as a business as it moves past its 25th anniversary. The 1994 World Cup (held in the U.S.) and the subsequent implementation of MLS as a U.S. professional league exerted a major positive influence on soccer participation and fandom in the U.S. Consequently, more importance was placed on soccer in the country’s culture. The research reported here explores the league’s evolution and development through the cohesion existing between its sporting and business development, as well as its performance.

April 23, 2020 David Rabinowitz, Esq. Deborah Shapiro, Esq. After reviewing the application, deposit copy, and relevant correspondence, along with the arguments in the second request for reconsideration, the Board finds that the Work exhibits copyrightable authorship and thus may be registered. The Work is a design that consists of three overlapping rhombus shapes in shades of grey, black, and white1 bisected horizontally by the text “Vancouver Whitecaps FC” in white coloring. An image of the Work is below: 1 Note: in the first letter of reconsideration, applicant included an image of the logo in shades of blue and white. David Rabinowitz, Esq. April 23, 2020 Deborah Shapiro, Esq. Moses & Singer LLP While common shapes and typographic ornamentations alone are not copyrightable, some combinations of common or standard design elements may contain sufficient creativity with respect to how they are juxtaposed or arranged to support a claim to copyright. See Feist Publ’ns, Inc. v. Rural Tel. Serv. Co., 499 U.S. 340, 358 (1991). A determination of copyrightability in the combination of standard design elements depends on whether the selection, coordination, or arrangement is done in such a way as to result in copyrightable authorship.
