Addis Analyst in Middle Eastern Affairs February 14, 2011 Congressional Research Service 7-5700 www.crs.gov RL33476 CRS Report for Congress Prepared for Members and Committees of Congress Israel: Background and U.S. Relations Summary On May 14, 1948, the State of Israel declared its independence and was immediately engaged in a war with all of its neighbors. Armed conflict has marked every decade of Israel’s existence. Despite its unstable regional environment, Israel has developed a vibrant parliamentary democracy, albeit with relatively fragile governments. The most recent national elections were held on February 10, 2009, ahead of schedule. Although the Kadima Party placed first, parties holding 65 seats in the 120-seat Knesset supported opposition Likud party leader Benjamin “Bibi” Netanyahu, who was designated to form a government. Netanyahu’s coalition includes his own Likud, Yisrael Beiteinu (Israel Our Home), Shas, Habayet Hayehudi (Jewish Home), the United Torah Judaism (UTJ), and the new Ha’atzmout (Independence) party. The coalition controls 66 of 120 Knesset seats. Israel has an advanced industrial, market economy with a large government role. Israel’s foreign policy is focused largely on its region, Europe, and the United States. Israel’s foreign policy agenda begins with Iran, which it views as an existential threat due to Tehran’s nuclear ambitions and support for terrorism. Achieving peace with its neighbors is next. Israel concluded peace treaties with Egypt in 1979 and Jordan in 1994, but not with Syria and Lebanon. Recent unrest in Egypt is rekindling latent anxiety in Israel about the durability of the peace treaty Egypt and Israel have relied upon for 30 years. -

But is that assumption right? May the conflict lack legality altogether, on one side or both? Have there been war crimes committed by both sides as many suggest? The 2014 Israeli – Gaza conflict (that lasted some 52 days and that was called 'Operation Protective Edge' by the Israeli Defence Force) allows a way to explore some of the underlying issues of the overall conflict. General Sir Nick Parker explains how he advised Geoffrey Nice to approach the conflict's legality and reality from a military point of view. Geoffrey Nice explains what conclusions he then reached. Were war crimes committed by either side? Introduction No human is on this earth as a volunteer; we are all created by an act of force, sometimes of violence just as the universe itself arrived by force. We do not leave the world voluntarily but often by the force of disease. As pressed men on earth we operate according to rules of nature – gravity, energy etc. – and the rules we make for ourselves but focus much attention on what to do when our rules are broken, less on how to save ourselves from ever breaking them. That thought certainly will feature in later lectures on prison and sex in this last year of my lectures as Gresham Professor of Law but is also central to this and the next lecture both on Israel and on parts of its continuing conflict with Gaza. -

Istituto Affari Internazionali IAI WORKING PAPERS 12 | 16 – May 2012 Israel and the Palestinians After the Arab Spring: No Time for Peace Andrea Dessì Abstract While spared from internal turmoil, Israel and the Palestinian Territories have nonetheless been affected by the region’s political transformation brought about by the Arab Spring. Reflecting what can be described as Israel’s “bunker” mentality, the Israeli government has characterized the Arab revolutionary wave as a security challenge, notably given its concern about the rise of Islamist forces. Prime Minister Netanyahu has capitalized on this sense of insecurity to justify his government’s lack of significant action when it comes to the peace process. On the Palestinian side, both Hamas and Fatah have lost long-standing regional backers in Egypt and Syria and have had to contend with their increasingly shaky popular legitimacy. This has spurred renewed efforts for reconciliation, which however have so far produced no significant results. Against this backdrop, the chances for a resumption of serious Israeli-Palestinian peace talks appear increasingly dim. An effort by the international community is needed to break the current deadlock and establish an atmosphere more conducive for talks. In this context, the EU carries special responsibility as the only external actor that still enjoys some credibility as a balanced mediator between the sides. "The Palestine Papers" So far this morning not a single word has been published or broadcast in the US press on the most extensive disclosure of internal documents on the Middle East peace process by Al Jazeera and The Guardian, a more significant cache than from Wikileaks. And already the Middle East is consumed with the revelations. I've enclosed below, just in case you haven't seen asap, the initial Guardian report and the Guardian column by Jonathan Freedland, the chief columnist on the subject in that newspaper, the Tom Friedman of Britain, a friend of mine, who also writes a column in the Jewish Chronicle, the leading Jewish newspaper in London. It all speaks for itself II. SOTU For what it's worth (with a full sense of duty and futility), the Democrats should respond to the Republican response to the SOTU in the following manner: The Republicans have designated Rep. Paul Ryan (R-Weird) to give their formal televised response, but La Pasionaria of the Tea Party, Rep. Michelle Bachmann (R-Fringe) is also giving a response at the same time. Therefore, the Democratic talking points should be to characterize the President's SOTU as the program to meet the challenges the nation is facing while characterizing the GOP response as politically divisive cond confused. -

It also contains an overview of Palestinian society and politics and descriptions of key Palestinian individuals and groups— chiefly the Palestine Liberation Organization (PLO), the Palestinian Authority (PA), Fatah, Hamas, and the Palestinian refugee population. The “Palestinian question” is important not only to Palestinians, Israelis, and their Arab state neighbors, but to many countries and non-state actors in the region and around the world— including the United States—for a variety of religious, cultural, and political reasons. U.S. policy toward the Palestinians is marked by efforts to establish a Palestinian state through a negotiated two-state solution to the Israeli-Palestinian conflict; to counter Palestinian terrorist groups; and to establish norms of democracy, accountability, and good governance within the Palestinian Authority (PA). Congress has appropriated assistance to support Palestinian governance and development amid concern for preventing the funds from benefitting Palestinian rejectionists who advocate violence against Israelis. Among the issues in U.S. policy toward the Palestinians is how to deal with the political leadership of Palestinian society, which is divided between the Fatah-led PA in parts of the West Bank and Hamas (a U.S.-designated Foreign Terrorist Organization) in the Gaza Strip. Following Hamas’s takeover of Gaza in June 2007, the United States and the other members of the international Quartet (the European Union, the United Nations, and Russia) have sought to bolster the West Bank-based PA, led by President Mahmoud Abbas and Prime Minister Salam Fayyad. -

Universities have often produced compartmentalized elites inside each nation-state and they don’t communicate with one another: they are either elite that publish globally and perish locally or elite that publish locally and perish globally. -

A day-long event “Ending the Occupation: The Path to Independence, Justice, and Peace for Palestine” was followed by the civil society meeting on “Ending the Occupation: Creating the Space for Human Rights, Development, and a Just Peace”. The Forum brought together political figures, academics, civil society activists, intellectuals and diaspora representatives, including many Israelis and Palestinians, based in the Middle East and elsewhere. Participants articulated a constructive analysis of the current situation and suggestions on how to end the occupation. -

International Affairs and Global Strategy www.iiste.org ISSN 2224-574X (Paper) ISSN 2224-8951 (Online) Vol.82, 2020 President Trump Peace Strategy: Emerging Conflict Between Israel and Palestine Jibrin Ubale Yahaya, PhD Department of Political Science, National Open University of Nigeria (NOUN), Jabi Abuja Abstract When Donald Trump was elected as US President in November 2016, he initially signaled some real hope for the peaceful resolution of the Israeli-Palestinian conflict. Some analysts argued that he may actually manage to deliver what he calls "the deal of the century" and bring peace to Israel and Palestine. These assumptions were based on the fact that President Trump is the type of person that could wake up one morning, say "enough", and pressure Israeli and Palestinian leaders to sign a peace deal on his terms. Early on in his presidency, Trump made the conflict a strategic priority and unconventionally chose to go to the Middle East (Saudi Arabia, Israel and Palestine) on his first trip abroad as President. During a press conference with Palestinian Authority President Mahmoud Abbas in Bethlehem, he said that "if Israel and the Palestinians can make peace, it will begin a process of peace all throughout the Middle East." This was in line with Europe's standard inside-out approach (Israeli-Palestinian peace first, Israeli-Arab normalization later). But on December 2019, Trump made it clear that his much-anticipated peace deal will favour Israel when he recognized Jerusalem as Israel's capital and promised to move the US embassy there. This led Abbas to brand Trump's peace efforts as "the slap of the century" and say the US could no longer play any role in the Middle East peace process following the move. -

Reparations - Acknowledgment of Israel responsibility/apology - Recognition of refugee’s rights: the right of return, the right to restitution and compensation - Palestinian and Israeli leaderships have a common interest in resolving the refugee issue in a just and reasonable manner because: o They agree that they will be no peace without a just resolution of the refugee issue which has been standing at the heart of conflict since 1948; o It is their common interest to reach a satisfactory closure of the matter: since individual rights are at stake (rather than the national rights of the future Palestinian State), the risk of future potential (thousands, perhaps millions) law suits filed by unsatisfied refugees against Israel and/or Palestine cannot be overlooked; o Both States have a right to peace and security and the satisfaction of refugees is crucial in this regard. This advocates for the establishment of a comprehensive resolution of the refugee issue which would facilitate their rehabilitation and empowerment after years of suffering. - Thus, a just resolution of the refugee issue can provide Israel and the future Palestinian State with a historic opportunity to achieve a “true” peace for two reasons: o By recognizing the injustice caused to refugees (which constitutes today the majority of the Palestinian population), Israel would be in position to ask for refugees’ forgiveness and put an end to the corresponding Arab resentment; 1 o Since the refugee issue has also become over the years a regional matter involving in particular Lebanon, Syria and Jordan, it also provides Israel with the historic chance to normalize its relations with other Arab countries (i.e.
