D. PUBLIC CONVENIENCE AND NECESSITY EVALUATION The City of Los Angeles is very concerned if a new request to sell alcohol is subject to one of the conditions below. There is a strong likelihood that the City wil deny your "public convenience or necessity" application if one of the above listed conditions apply to your site. (It is stronqlv suggested that you contact your Council Offce and discuss your project. If the Council Offce does not oppose your project, you should then check with your local area police vice unit as well as the Planning Department Public Counter at (213) 482-7077 for the determination of whether the proposed site is within a Specific Plan area, and the Community Redevelopment Agency (CRA) project staff at (213) 977-1682 or 977- 1665, to determine if your site is in a CRA Project Area. If any of the five conditions listed below apply to your site, you should carefully consider if you want to file for a Public Convenience or NecessitY finding.

1. The proposed site is in an area with a long-term level of undue concentration of alcoholic beverage outlets.

2. The geographic area is the target of special law enforcement activity, Le., police task force is working on reducing vice in the area, or eliminating juvenile crime (such as cruising or graffiti) or gang activity.

3. The proposed site is in close proximity to sensitive uses, including schools, parks, churches, youth activities, homeless shelters, mental health or alcohol or drug treatment centers.

4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to: loitering.public intoxication, driving. under the influence, assault, vandalism, prostitution, -.- drug violatioiis, 5. The project proposes a total of 35 establishments, including 28 establishments that wil offer on-site alcoholic beverage servce (such as restaurants, the proposed hotel, catering operations in conjunction with special event facilities, movie theater, food halls, dance clubs, music clubs, bars, and other potential uses), five establishments that will sell alcoholic beverages for off-site consumption (such as a grocery store, and wine store), and two establishments with a combination of on-and off-site consumption (such as a wine bar). It is also anticipated that the hotel wil include numerous tyes of alcohol sales, such as a restaurant, room servce, catering, lobby and pool bar/lounge(s), and in-room mini-bars but is considered one establishment for puroses of this request. Some establishments wil contain both indoor and outdoor/patio dining areas in which on-site consumption is requested.

Yes. The City Planning Commssion approved a conditional use permt for alcoholic beverage sales in their determination dated June 26, 2007 under Case No. CPC 2006-9702-ZC-CU-CUB- CUX-ZV -DA.

The project proposes a total of35 full-alcohol establishments, including 28 establishments that wil offer on-site alcoholic beverage servce (such as restaurants, the proposed hotel, caterig operations in conjunction with special event facilities, movie theater, food halls, dance clubs, music clubs, bars, and other potential uses), five establishments that will sell alcoholic beverages for off-site consumption (such as a grocer store, convenience store, and wine store), and two establishments with a combination of on-and off-site consumption (such as a wine bar). The size of each business will vary depending on the tye of operation. Restaurants that serve alcohol may range in size from a few hundred feet in the proposed food hall to several thousand square feet for full servce restaurants with a bar. Retail establishments wil also vary from the size of a potential wine shop to larger spaces in the case of a full servce grocery store.

6. % of floor space devoted to alcoholic beverages:

The percentage of floor space devoted to alcoholic beverages will vary from establishment to establishment. Some restaurants may have separate bars. The five proposed establishments that will sell alcohol beverages for off-site consumption wil have varying amounts of floor area devoted to the display of alcoholic beverages.

7. Hours of Operation:

a. What are the proposed hours of operation and which days of the week will the establishment be open?

The proposed hours of operation for restaurants with on-site sale and consumption are 6 a.m. to 2 a.m. Monday through Sunday. The proposed grocery store and possible convenience store may be open to the public 24-hours a day. Special event facilities wil generally be open durng the day and into the night as dictated by the tye of event. Hours of operation will be established for each individual establishment durg the plan approval process required by Case No. CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA.

b. What are the proposed hours of alcohol sales?

The sale of alcoholic beverages for on-site consumption wil occur durng the proposed hours of operation for each restaurant; otherise, the hours will be as required by the Departent of Alcoholic Beverage Control. For the proposed grocery store and possible convenience store, the sale of alcohol will be limited to the hours approved by the Deparent of Alcohol Beverage Control. For special event facilities, the tye of event wil dictate the hours of alcohol sales.

8. Parking:

a. Is parking available on the site? (If so, how many spaces?)

Yes. On-site parking wil be provided for both residential and commercial uses on each development block as required by the Los Angeles Municipal Code. More specifically, parking for the commercial uses will comply with § 12.21.A.4(i), which requires one space for every 1,000 square feet for projects in the Downtown Business Distrct. The parking will be in multi-level podium and subterranean parking garages. Valet parking wil also be available for many of the commercial uses including the hotel and restaurants. It should be noted that the proposed parking supply will considerably exceed the Code requirements.

It is not yet known if any game machines or pool tables wil be incorporated into the establishments as an ancilar use. Approval of coin operated game machines requires approval of a conditional use pert, which was not requested as part of the recent alcohol conditional use permt.

11. Will you have signs visible on the outside which advertise the availability of alcohol?

No. It is anticipated that signage for all establishments selling alcoholic beverages wil be coordinated and will generally consist of business identification signs. A condition of Case No.

CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA is as follows: "There shall be no advertising of any kind or tye, including advertsing directed to the exterior from within, promoting or indicating the availability of alcoholic beverages."

12. How many employees will you have on the site at any given time?

The exact number of employees is not known at this time.

13. Wil all employees who sell alcohol attend the local State ABC training class on how to properly sell alcohol?

Pursuant to a condition of Case No. CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA, all employees of each business servng alcohol on-site shall receive "Server Awareness Alcohol Training" (STAR) and LEAD programs, as respectively sponsored by the LAPD and California Alcoholic Beverage Control Departent.

14. What security measures will be taken including:

a. Posting of rules and regulations on the premises to prevent such problems as gambling, loitering, theft, vandalism and truancy.

Individual operators will have operations plans addressing these concerns, as well as have employees trained in alcohol awareness issues. The internal and self-contained orientation of

the project allows for self-monitoring, thereby enhancing the securty operations of the project. A comprehensive securty plan is stil to be deterned.

b. Wil security guards be provided and if so, when and how many?

It is anticipated that no securty guards will be provided within the dining establishments or

off-site sale retail establishments. However, as part of the project's securty plan, securty

offcers may be stationed at key locations to preserve the safety of the project's residents, tenants, and visitors. Each individual night club/dance hall operator will provide their own securty guards. The exact number of securty personnel wil be determined by the Zoning Administrator durng the plan approval process.

15. Wil there be minimum age requirements for patrons? If so, how wil this be enforced?

Patrons of all ages wil be able to frequent the hotel and restaurants on the premises. Entr into any bar within the project wil be limited to patrons who are at least 21 years of age. To ensure this, patrons wil be screened for proper identification.

The exterior of the buildings and public areas will be illuminated. However, due to the size of the

project, the mixed-use natue, and the arrangement of buildings and uses, it is not anticipated that patrons will necessarily be visible from the street.

1. Wil the gross sale of alcohol exceed the gross sale of food items on a quarterly basis?

All tenants are not in place. It is anticipated that establishments such as a grocery store or convenience store would have greater receipts for food sales than for alcohol sales. However, this would not be tre for establishments such as a wine store.

2. Will cups, glasses or other similar containers be sold which might be used for the consumption of liquor on the premises?

It is possible that as part of a tyical grocery store or convenience store inventory, cups, glasses and other similar household items wil be available for purchase but no consumption of alcohol will be allowed on the premises of the proposed grocery store or convenience store. A wie store (with off-site sales) and/or a wine bar (where both on-site serce and off-site sales would occur) may also sell glasses and other containers.

3. Will beer and wine coolers be sold in single cans or will wine be sold in containers less than 1 liter (750 ml)?

The specific operating procedures of tenants -are unown at this time, however, detailed information will be provided durng the plan approval process. A grocery store, potential convenience store, and potential wie bar wil sell beer and wine in the amounts and size containers as may be allowed by the Departent of Alcoholic Beverage Control.

4. Wil "fortified" wine (greater than 16% alcohol) be sold?

Some establishments might choose to serve and sell premium wine products with greater than 16% alcohol, such as cognacs and brandies. The proposed grocery store will sell fortfied and distilled spirits as may be allowed by the Departent of Alcohol Beverage Control.

The occupancy load is unown at this time. However, all establishments seeking approval to sell and dispense alcoholic beverages wil meet the maximum occupancy loads as deterined by the Departent of Building and Safety and the Fire Departent.

Since the project is proposed to be phased over a number of years, it is not yet known how large each establishment wil be. Seating will be reviewed by the Zoning Administrator as part of the plan approval processes.

3. Is there to be entertainment such as a piano bar, juke box, dancing, live entertainment, movies, etc.? (Specify?)

5 Live entertinment with incidental dancing is proposed at a maximum of eight clubs/bars and event facilities. In addition, it is anticipated that some of the establishments might choose to offer some entertainment ancilary to their primary operations, consisting oflow-key dinner music, including piano, guitar or other strg instrents. Because specific tenants have not yet committed to space, details on the number of facilities and extent of entertainment has not yet been determined.

4. If a cocktail lounge is to be maintained incidental to a restaurant, the required floor plans

must show details of the cocktail lounge and the separation between the dining and lounge facilities.

It is anticipated that some of the establishments, including the proposed hotel, might choose to

offer a cocktail lounge ancilar to their primary operations. Because specific tenants have not yet commtted to space, details on the separation between dining and lounge areas have not yet been determned. Floor plans will be provided durng the plan approval process.

5. Food Service

a. Will alcohol be sold without a food order?

It is anticipated that some facilities, such as a restaurant bar, hotel bar, the special events facility and other potential clubs/bars might offer the on-site sale of alcoholic beverages without a food order. Additionally, there may be two establishments with a combination of on-site sale and consumption and off-site sales, such as a wine bar, which may not necessarly serve food.

b. Wil there be a kitchen on the site as defined in the Los Angeles Municipal Code?

Most establishments wil have kitchen facilities.

6. Wil discount alcoholic drinks or a "" be offered at any time? Provide a copy of the proposed menu if food is to be served.

It is anticipated that some establishments might wish to offer promotional pricing on alcoholic beverages. Since the restaurant establishments have not been selected, proposed menus are not available at this time.

D. PUBLIC CONVENIENCE AND NECESSITY EVALUATION

The City of Los Angeles is very concerned if a new request to sell alcohol is subject to one of the conditions below. There is a strong likelihood that the City wil deny your "public convenience or necessity" application if one of the above listed conditions apply to your site. (It is strongly suggested that you contact your Council Offce and discuss your project. If the Council Office does not oppose your project, you should then check with your local area police vice unit as well as the Planning Department Public Counter at (213) 482-7077 for the determination of whether the proposed site is within a Specific Plan area, and the Community Redevelopment Agency (CRA) project staff at (213) 977-1682 or 977-1665, to determine if your site is in a CRA Project Area. If any of the five conditions listed below apply to your site, you should carefully consider if you want to file for a Public Convenience or Necessity finding.

6 1. The proposed site is in an area with a long-term level of undue concentration of alcoholic beverage outlets.

According to infonnation provided by the State Departent of Alcoholic Beverage Control, the project site is in an area of undue concentration of alcoholic beverage licenses. The project site is located within census tract 2075, which allows 4 on-site licenses and 3 off-site licenses. Curently, there are 21 on-site licenses in this census tract and 3 licenses for off-site sales. The proposed project would add up to 28 on-site licenses, 5 off-site licenses and two licenses that would be a combination of on- and off-site sales. Nonetheless, the project's objectives of enhancing the livability of the area and fostering a 24-hour environment in the City's urban core

require a development with a diversity of uses, including restaurants, stores, and other venues that serve and/or sell alcoholic beverages.

2. The geographic area is the target of special law enforcement activity, Le., police task force is working on reducing vice in the area, or eliminating juvenile crime (such as cruising or graffti) or gang activity.

Based on a meeting with Sergeant Walker of the Los Angeles Police Departent, the area is not

the target of any special law enforcement activity.

3. The proposed site is in close proximity to sensitive uses, including schools, parks, churches, youth activities, homeless shelters, and mental health or alcohol or drug treatment centers.

The only sensitive uses within the immediate project area (i.e. 600 foot radius) are that noted in Question A.17 above: The Colbur School of Performng Ars.

4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to: public intoxication, driving under the influence, assault, vandalism, prostitution, drug violations, loitering.

Based on a meeting with Sergeant Walker of the Los Angeles Police Departent, the project site does not fall within a LAPD recovery area.

5. The proposed site is located in a Specific Plan or Community Redevelopment Agency Project area which specifically includes a policy to control future alcoholic beverage sales.

The project site is within the Buner Hil Redevelopment Project Area. However, neither the original Bunker Hill Redevelopment Plan nor its two amendments include policies addressing the control of alcoholic beverage sales.

E. If the project site is not subject to one of the above criteria, your project wil be evaluated by the City Council with consideration given to the following possible benefis and detriments to the community:

The project wil provide up to 2,660 housing units in the downtown urban core where it is both appropriate and desirable. The project site wil be conveniently located for downtown professionals who currently commute from neighboring communities and counties. Furhermore, the project has been carefully planned to create a unified development on three sites (thee phases), which will be linked by distinguished architectue and a unified and enhanced streetscape. Such improvements wil add to the aesthetic appeal and fuctionality of the area. Many of the proposed restaurants wil accommodate outdoor patio/terrace spaces, which wil create an extension of the open space areas where people can relax and congregate in a safe, attactive, and enjoyable environment. The enhanced streetscape will seamlessly connect the sites that compose the project to enable pedestran-frendly use. The new buildings wil present compellng modem architectual works, and will complement the Frank Gehr-designed Walt Disney Concert Hall. In addition to the residential uses, the project includes approximately 275 hotel rooms and 449,000 square feet of retail floor area. These commercial and retail opportities will enhance the livability of the area for the project's residents in paricular, and welcome residents as well as visitors throughout the region.

The revitalization effort proposed by the applicant are anticipated to serve as a catalyst for continued investment in the subject property and surounding neighborhoods. This request supports the project's goal of serng as a focus for the neighborhood's revitalization efforts. The establishments within which the on- and off-site sales of alcoholic beverages wil occur wil not adversely affect the economic welfare of the community, but rather wil contrbute to the success of the development. The project will positively affect the economic welfare of the community by expanding retail uses available in the Buner Hil and Civic Center areas, fuher integrating new residents in close proximity to the retail and entertainment options which will be available at the project and enhancing the attactiveness of the Buner Hil neighborhood as a center for commercial investment. It will also positively benefit the City through generation of additional sales tax revenue and business license and other fees, and by providing additional short-term and long-term employment opportities to area residents. The LAEDC estimates that Phase I of the project will create approximately 1,950 full time equivalent jobs and a peak workforce of about 650 constrction workers. Phases II and il wil create an additional 4,700 full time equivalent jobs. LAEDC also estimates the creation of2,500 permanent jobs in Phase I and 2,800 additional jobs in Phases II and II.

The project will also positively impact the economic welfare of the community by providing a hotel and high quality commercial uses near the Civic Center. According to the Economic and Revenue Impact Study prepared by the Los Angeles Economic Development Corporation on May 20, 2005, the proposed project will contrbute on-going annual rents and revenue of approximately $222,000,000 upon build out (includes retail and restaurant sales, hotel receipts, residential and commercial rents) and $95,200,000 in anual incremental federal, state, county, and local governent tax revenue.

Moreover, one of the public benefits agreed to by the applicant under the Disposition and Development Agreement executed with the Community Redevelopment Agency is a local hirig goal for permanent jobs. More specifically, the applicant has committed to a 30% hiring goal on all permanent jobs and "First Source" hirg procedures by which employers within the project

8 wil be required to give local workers early notice and a ffrst opportity to apply for pennanent jobs. To maximize this opportity for local workers to gain employment at the project, the applicant is also contrbuting $500,000 to support training that wil help ensure that local workers have the skills needed to get hired for the jobs created by the project.

The Central City Community Plan designates the property Regional Center Commercial and the proposed uses of the propert are consistent with this designation. The General Plan states that Regional Centers should become "mixed use centers that provide jobs, entertainent, culture, and serve the region." The project fuhers this goal by providing residential, commercial, and retail uses within the same site, and a cultual focal point for the Civic Center and Bunker Hil. The project also effectuates key goals of the Central City Community Plan. One key Objective ofthe Plan is that new housing options should be provided in a settng that wil encourage the creation

of "an active, 24-hour downtown environment for curent residents." The project's mixed-use natue, including the venues which propose to sell alcoholic beverages, is aimed at providing project residents, as well as non-resident community members, with dining, retail and other entertinment options. Alcoholic beverage servce is an expected amenity with a meal servce and it is reasonable to expect a fully integrated mixed-use development to include not only restaurants that offer alcohol servce incidental to the sale and servce of food, but other establishments that wil contrbute to creating a vibrant 24-hour downtown environment.

Similarly, it is reasonable to expect that uses such as a grocery store will sell a full line of alcoholic beverages for off-site consumption.

A limited number of establishments that serve and/or sell alcoholic beverages are proposed to be included in each phase ofthe project. The restaurant establishments wil offer a range of dining choices, including different cuisines and atmospheres. The sale of alcoholic beverages is of critical importce to the successful operation of these facilities to attact and cater to a sophisticated clientele. Since the establishments will be part of a carefully controlled, ffrst-class project, the servce of alcoholic beverages will enhance the quality of the project site and the Buner Hil neighborhood. The project also includes a grocery store and possible convenience store and wine shop, which wil offer alcohol for off-site sale and consumption. A grocery store is a much needed land use in the area and the sale of alcohol at a grocery store wil not unduly add to the concentration of alcohol sales outlets in the area. The project wil also include a full servce hotel which may offer alcohol sales for guests in a restaurant and lobby and/or poolside bar, as well as through room servce and in-room mini bars. Accordingly, this approval wil not result in an umeasonable concentration C?f such establishments, but will provide numerous public beneffts including public convenience, entertainment opportities, and aesthetic and economic improvements.

2. Possible Detrimental Impacts

The project area is in Los Angeles Police Deparent Reportng Distrct No. 132. According to the Departent of Alcoholic Beverage Control, there were 85 crimes in the last reporting period for which infonnation is available. In this same period the average crimes per reportng distrct in

9 the City was 322. Consequently, the project is not in an area of higher than average crime because crimes in Reportng Distrct 132 are far less than the cityide average.

Also, based on a meeting with Sergeant Walker of the Los Angeles Police Departent, although the Central Division ofthe LAPD is subject to excessive calls, strained police resources, and high rates of alcoholism, homelessness, etc., the immediate project area (the Buner Hil area) does not generate these problems.

To ensure that the project wil not create any detrmental impacts on the surounding area, the specific details of each establishment will be reviewed pursuant to a plan approval process required under Case No. CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA. This process will allow for a comprehensive review of each request with input from each prospective tenant, the Police Departent, the Council offce, and any other interested parties. Securty plans, floor plans, and seating limitations, and as well as the mode and character of the operation, will be addressed and assured through this process and the imposition of site-specific conditions.

3. With reqard to the operation of the proposed business explain:

a. The method of business operation: (large volume of alcohol to food sales, "late" hours (after midnight), high % unskiled (no ABC training class) staff, high % of underage (under 21) staff, etc.)

The business operations will vary by establishment depending on the natue of each establishment (i.e., restaurant versus wine bar or grocer store). The method of operation will be reviewed and approved by the Zoning Admiistrator durng the plan approval process. Case No. CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA includes a condition requiring all employees of each business servng alcohol on-site to receive "Server Awareness Alcohol Training" (STAR) and LEAD programs, as respectively sponsored by the LAPD and California Alcoholic Beverage Control Deparent.

b. Would the business duplicate a nearby business already in existence?

While there are a number of establishments with on-site licenses within the census tract, the proposed project will introduce up to 2,660 new residential units and the associated residents, along with employees from the commercial businesses. The sale of alcohol at the proposed restaurants wil be a public convenience to these new residents as well as to the visitors, toursts, and employees in the surounding offce buildings. According to the Departent of Alcoholic Beverage Control, there are only three outlets with licenses for off-site sales within the census tract. The proposed project will introduce a full serce grocery store to serve the expanding residential population in Buner Hil. The sale of alcohol at the three proposed retail locations within the project will provide a public convenience to the existing residents

in Buner Hil as well as servng the residents of the new 2,660 units that will be constrcted

as par of the proposed project.

Furhermore, the project is located within an area designated for Regional Center Commercial uses and is adjacent to other commercial uses, including restaurants and retail shops in the

offce buildings to the south of the project site along Grand Ave. The project is also located within the Bunker Hil Redevelopment Project Area, which is an established mixed-use community intended to provide a full range of residential and commercial options for

businesses and households within walking distance of the Civic Center office towers on Buner Hil. Other prominent land uses within the area include MaCA, the Walt Disney

10 Concert Hall, California Plaza, the Music Center and other high-rise office building developments. Land uses within the project's immediate vicinity include residential, entertinment, offce, government, parking strctues and surface parking lots. The sale of alcoholic beverages is an excepted component within this tye of project. The development provides a settng wherein many patrons are likely to fulfill shopping, dining and entertinment needs in one visit. A review of other similar mixed-use projects indicates that the sale of alcohol is an int~gral part of such mixed-use settings. c. Other non-alcohol sales business options available so alcohol does not have to be sold, e.g., more specialty products, broader range of items like fresh meats or fruits and vegetables, etc.

The proposed project wil include a variety of retail stores and commercial uses for residents and visitors alike that will not involve the sale of alcoholic beverages. The grocery store is anticipated to be a major tenant and the target tenant is an upscale health food grocery store that wil offer a broad range of organic produce, meats, and other items. The sale of alcohol wil be an accessory use to the project as a whole, and marketed at a segment of the population that is not likely to become a high crime risk for the City.

Some establishments wil contain both indoor and outdoor/patio dining areas in which on-site consumption is requested.

A. PROJECT DETAILS

The size of each business wil var depending on the tye of operation. Restaurants that serve alcohol may range in siz from a few hundred feet in the proposed food hall to several thousand square feet for full service restaurants with a bar. Retail establishments wil also var from the size of a potential wine shop to larger spaces in the case of a full service grocery store.

6. % of floor space devoted to alcoholic beverages:

The percentage of floor space devoted to alcoholic beverages wil var from establishment to establishment. Some restaurants may have separate bars. The five proposed establishments that

wil sell alcohol beverages for off-site consumption wil have varing amounts of floor area devoted to the display of alcoholic beverages.

7. Hours of Operation:

a. What are the proposed hours of operation and which days of the week will the establishment be open?

The proposed hours of operation for restaurants with on-site sale and consumption are 6 a.m. to 2 a.m. Monday though Sunday. The proposed grocery store and possible convenience store may be open to the public 24-hours a day. Special event facilities wil generally be open durig the day and into the night as dictated by the tye of event. Hours of operation wil be established for each individual establishment during the plan approval process required by Case No. CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA.

b. What are the proposed hours of alcohol sales?

The sale of alcoholic beverages for on-site consumption wil occur durig the proposed hours of operation for each restaurant; otherwise, the hours wil be as required by the Deparent of Alcoholic Beverage Control. For the proposed grocery store and possible convenience store, the sale of alcohol wil be limited to the hours approved by the Deparent of Alcohol Beverage Control. For special event facilities, the tye of event wil dictate the hours of alcohol sales.

8. Parking:

a. Is parking available on the site? (If so, how many spaces?)

Yes. On-site parking wil be provided for both residential and commercial uses on each development block as required by the Los Angeles Municipal Code. More specifically, parking for the commercial uses wil comply with § 12.21.A.4(i), which requires one space for every 1,000 square feet for projects in the Downtown Business Distrct. The parking wil be in multi-level podium and subterranean parking garages. Valet parking wil also be available for many of the commercial uses including the hotel and restaurants. It should be noted that the proposed parking supply wil considerably exceed the Code requirements.

b. If spaces are not available on the site, have arrangements been made for off-site parking by lease or covenant?

It is not yet known if any game machines or pool tables wil be incorporated into the establishments as an ancilar use. Approval of coin operated game machines requires approval of a conditional use pennit, which was not requested as par ofthe recent alcohol conditional use pennit.

11. Wil you have signs visible on the outside which advertise the availability of alcohol?

No. It is anticipated that signage for all establishments selling alcoholic beverages wil be

coordinated and wil generally consist of business identification signs. A condition of Case No.

CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA is as follows: "There shall be no advertising of any kid or tye, including advertising directed to the exterior ftom within, promoting or indicatig the availability of alcoholic beverages."

12. How many employees wil you have on the site at any given time?

The exact number of employees is not known at this time.

13. Wil all employees who sell alcohol attend the local State ABC training class on how to properly sell alcohol?

Pursuant to a condition of Case No. CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA, all employees of each business serving alcohol on-site shall receive "Server Awareness Alcohol Training" (STAR) and LEAD programs, as respectively sponsored by the LAPD and California Alcoholic Beverage Control Deparent.

14. What security measures will be taken including:

a. Posting of rules and regulations on the premises to prevent such problems as gambling, loitering, theft, vandalism and truancy.

Individual operators wil have operations plans addressing these concerns, as well as have employees trained in alcohol awareness issues. The internal and self-contained orientation of the project allows for self-monitoring, thereby enhancing the security operations ofthe project. A comprehensive security plan is stil to be detennined.

b. Wil security guards be provided and if so, when and how many?

3 It is anticipated that no securty guards wil be provided within the dining establishments or

off-site sale retail establishments. However, as par of the project's securty plan, securty offcers may be stationed at key locations to preserve the safety of the project's residents, tenants, and visitors. Each individual night club/dance hall operator wil provide their own securty guards. The exact number of security personnel wil be detennined by the Zoning Administrtor durg the plan approval process.

15. Wil there be minimum age requirements for patrons? If so, how wil this be enforced?

Patrons of all ages wil be able to frequent the hotel and restaurants on the premises. Entr into any bar within the project wil be limited to patrons who are at least 21 years of age. To ensure this, patrons wil be screened for proper identification.

There are no public schools within 1000 feet of the project site. The private Colbur School of Perfonning Ars is located adjacent to the project site at 200 Grand Avenue.

No. There wil be no exterior fencing around the project site.

19. Wil the exterior of the site be iluminated with security lighting bright enough to see patrons from the street?

The exterior of the buildings and public areas wil be iluminated. However, due to the size of the

project, the mixed-use natue, and the arangement of buildings and uses, it is not anticipated that patrons wil necessarly be visible from the street.

4 B. THE FOllOWING QUESTIONS ARE TO BE ANSWERED WHERE ONLY THE OFF-SITE SALE OF ALCOHOLIC BEVERAGES IS SOUGHT:

1. Wil the gross sale of alcohol exceed the gross sale of food items on a quarterly basis?

All tenants are not in place. It is anticipated that establishments such as a grocery store or convenience store would have greater receipts for food sales than for alcohol sales. However, this would not be tre for establishments such as a wine store.

2. Wil cups, glasses or other similar containers be sold which might be used for the consumption of liquor on the premises?

It is possible that as par of a tyical grocery store or convenience store inventory, cups, glasses and other similar household items wil be available for purchase but no consumption of alcohol wil be allowed on the premises of the proposed grocery store or convenience store. A wine store (with off-site sales) and/or a wine bar (where both on-site service and off-site sales would occur) may also sell glasses and other containers.

3. Wil beer and wine coolers be sold in single cans or wil wine be sold in containers less than 1 liter (750 ml)?

The specific operating procedures of tenants are unkown at this time, however, detailed information wil be provided durig the plan approval process. A grocery store, potential convenience store, and potential wine bar wil sell beer and wine in the amounts and size containers as may be allowed by the Deparent of Alcoholic Beverage Control.

4. Wil "fortified" wine (greater than 16% alcohol) be sold?

Some establishments might choose to serve and sell premium wine products with greater than 16% alcohol, such as cognacs and brandies. The proposed grocery store wil sell fortified wines and distiled spirits as may be allowed by the Deparent of Alcohol Beverage Control.

C. THE FOllOWING QUESTIONS ARE TO BE ANSWERED WHERE ONLY THE ON-SITE SALE OF ALCOHOLIC BEVERAGES IS SOUGHT:

1. What is the occupancy load as determined by the Fire Department (number of patrons)?

The occupancy load is unkown at this time. However, all establishments seeking approval to sell and dispense alcoholic beverages wil meet the maximum occupancy loads as determined by the Deparent of Building and Safety and the Fire Deparent.

2. What is the proposed seating in all areas?

Since the project is proposed to be phased over a number of years, it is not yet known how large

each establishment wil be. Seating will be reviewed by the Zoning Administrator as par of the plan approval processes.

3. Is there to be entertainment such as a piano bar, juke box, dancing, live entertainment, movies, etc.? (Specify?)

5 Live entertinent with incidental dancing is proposed at a maximum of eight clubslbars and event facilities. In addition, it is anticipated that some of the establishments might choose to offer some entertinent ancilar to their priar operations, consisting of low-key diner music, including piano, guita or other strg instrments. Because specific tenants have not yet committed to space, details on the number of facilties and extent of entertinent has not yet been determined.

4. If a cocktail lounge is to be maintained incidental to a restaurant, the required floor plans

must show details of the cocktail lounge and the separation between the dining and lounge facilities.

It is anticipated that some of the establishments, including the proposed hotel, might choose to

offer a cocktil lounge ancilar to their priar operations. Because specific tenants have not yet committed to space, details on the separation between dining and lounge areas have not yet been determined. Floor plans wil be provided durg the plan approval process.

5. Food Service

a. Wil alcohol be sold without a food order?

It is anticipated that some facilities, such as a restaurant bar, hotel bar, the special events facility and other potential clubslbars might offer the on-site sale of alcoholic beverages without a food order. Additionally, there may be two establishments with a combination of on-site sale and consumption and off-site sales, such as a wine bar, which may not necessarily serve food.

b. Wil there be a kitchen on the site as defined in the Los Angeles Municipal Code?

Most establishments wil have kitchen facilities.

6. Wil discount alcoholic drinks or a "Happy Hour" be offered at any time? Provide a copy of the proposed menu if food is to be served.

It is anticipated that some establishments might wish to offer promotional pricing on alcoholic beverages. Since the restaurant establishments have not been selected, proposed menus are not available at this time.

D. PUBLIC CONVENIENCE AND NECESSITY EVALUATION

The City of Los Angeles is very concerned if a new request to sell alcohol is subject to one of the conditions below. There is a strong likelihood that the City wil deny your "public convenience or necessity" application if one of the above listed conditions apply to your site. (It is strongly suggested that you contact your Council Offce and discuss your project. If the Council Offce does not oppose your project, you should then check with your local area police vice unit as well as the Planning Department Public Counter at (213) 482-7077 for the determination of whether the proposed site is within a Specific Plan area, and the Community Redevelopment Agency (CRA) project staff at (213) 977-1682 or 977-1665, to determine if your site is in a CRA Project Area. If any of the five conditions listed below apply to your site, you should carefully consider if you want to file for a Public Convenience or Necessity finding.

1. The proposed site is in an area with a long-term level of undue concentration of alcoholic beverage outlets.

According to Inonnation provided by the State Deparent of Alcoholic Beverage Control, the project site is in an area of undue concentrtion of alcoholic beverage licenses. The project site is located within census tract 2075, which allows 4 on-site licenses and 3 off-site licenses. Curently, there are 21 on-site licenses in this census trct and 3 licenses for off-site sales. The proposed project would add up to 28 on-site licenses, 5 off-site licenses and two licenses that would be a combination of on- and off-site sales. Nonetheless, the project's objectives of enhancing the livability of the area and fosterig a 24-hour environment in the City's urban core

require a development with a diversity of uses, including restaurants, stores, and other venues that serve and/or sell alcoholic beverages.

2. The geographic area is the target of special law enforcement activity, i.e., police task force is working on reducing vice in the area, or eliminating juvenile crime (such as cruising or graffti) or gang activity.

Based on a meeting with Sergeant Walker of the Los Angeles Police Deparent, the area is not

the taget of any special law enforcement activity.

3. The proposed site is in close proximity to sensitive uses, including schools, parks, churches, youth activities, homeless shelters, and mental health or alcohol or drug treatment centers.

The only sensitive uses within the imediate project area (i.e. 600 foot radius) are that noted in Question A.I7 above: The Colburn School ofPedonning Ars.

4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to: public intoxication, driving under the influence, assault, vandalism, prostitution, drug violations, loitering.

Based on a meeting with Sergeant Walker of the Los Angeles Police Deparent, the project site does not fall within a LAPD recovery area.

5. The proposed site is located in a Specific Plan or Community Redevelopment Agency Project area which specifically includes a policy to control future alcoholic beverage sales.

The project site is within the Bunker Hil Redevelopment Project Area. However, neither the original Bunker Hil Redevelopment Plan nor its two amendments include policies addressing the control of alcoholic beverage sales.

E. If the project site is not subject to one of the above criteria, your project wil be evaluated by the City Council with consideration given to the following possible benefits and detriments to the community:

The project wil provide up to 2,660 housing units in the downtown urban core where it is both appropriate and desirable. The project site wil be conveniently located for downtown professionals who currently commute from neighborig communities and counties. Furtennore, the project has been carefully planed to create a unified development on three sites (thee phases), which wil be lined by distinguished architectue and a unified and enhanced streetscape. Such improvements wil add to the aestetic appeal and fuctionality of the area. Many of the proposed restaurants wil accommodate outdoor patio/terrace spaces, which wil create an extension of the open space areas where people can relax and congregate in a safe, attactive, and enjoyable environment. The enhanced streetscape wil seamlessly connect the sites that compose the project to enable pedestran-frendly use. The new buildings wil present compelling modem architectural works, and wil complement the Fran Gehr-designed Walt Disney Concert Hall. In addition to the residential uses, the project includes approxiately 275 hotel rooms and 449,000 square feet of retail floor area. These commercial and retail opportities wil enhance the livabilty of the area for the project's residents in parcular, and welcome residents as well as visitors throughout the region.

The revitalization efforts proposed by the applicant are anticipated to serve as a catalyst for continued investment in the subject propert and surounding neighborhoods. This request supports the project's goal of serving as a focus for the neighborhood's revitalization efforts. The establishments within which the on- and off-site sales of alcoholic beverages wil occur wil not adversely affect the economic welfare of the community, but rather wil contrbute to the success of the development. The project wil positively affect the economic welfare of the community by expanding retail uses available in the Bunker Hil and Civic Center areas, further integrating new residents in close proxiity to the retail and entertinment options which wil be available at the project and enhancing the attactiveness of the Bunker Hil neighborhood as a center for commercial investment. It wil also positively benefit the City though generation of additional sales ta revenue and business license and other fees, and by providing additional short-tenn and long-tenn employment opportnities to area residents. The LAEDC estimates that Phase I of the project wil create approximately 1,950 full time equivalent jobs and a peak workforce of about

650 constrction workers. Phases n and il wil create an additional 4,700 full time equivalent jobs. LAEDC also estimates the creation of2,500 pennanentjobs in Phase I and 2,800 additional jobs in Phases n and il.

The project wil also positively impact the economic welfare of the community by providing a hotel and high quality commercial uses near the Civic Center. According to the Economic and Revenue Impact Study prepared by the Los Angeles Economic Development Corporation on May 20, 2005, the proposed project wil contrbute on-going anual rents and revenue of approxiately $222,000,000 upon build out (includes retail and restaurant sales, hotel receipts, residential and commercial rents) and $95,200,000 in anual incremental federal, state, county, and local governent ta revenue.

Moreover, one of the public benefits agreed to by the applicant under the Disposition and Development Agreement executed with the Community Redevelopment Agency is a local hiring goal for pennanentjobs. More specifically, the applicant has committed to a 30% hirg goal on all pennanent jobs and "First Source" hirg procedures by which employers within the project

wil be required to give local workers early notice and a ffrst opportity to apply for permanent jobs. To maximize this opportity for local workers to gain employment at the project, the applicant is also contrbuting $500,000 to support traing that wil help ensure that local workers have the skils needed to get hired for the jobs created by the project.

The Central City Community Plan designates the propert Regional Center Commercial and the proposed uses of the propert are consistent with this designation. The General Plan states that Regional Centers should become "mixed use centers that provide jobs, entertinent, cultue, and serve the region." The project furters this goal by providing residential, commercial, and retail uses within the same site, and a cultual focal point for the Civic Center and Bunker Hil. The

project also effectuates key goals of the Central City Community Plan. One key Objective of the Plan is that new housing options should be provided in a settg that wil encourage the creation

of "an active, 24-hour downtown environment for curent residents." The project's mixed-use natue, including the venues which propose to sell alcoholic beverages, is aimed at providing project residents, as well as non-resident community members, with dining, retail and other entertinent options. Alcoholic beverage service is an expected amenity with a meal service and it is reasonable to expect a fully integrated mixed-use development to include not only restaurants that offer alcohol service incidental to the sale and service of food, but other establishments that wil contrbute to creating a vibrant 24-hour downtown environment.

Similarly, it is reasonable to expect that uses such as a grocery store wil sell a full line of alcoholic beverages for off-site consumption.

A limited number of establishments that serve and/or sell alcoholic beverages are proposed to be included in each phase of the project. The restaurt establishments wil offer a rage of dining choices, including different cuisines and atmospheres. The sale of alcoholic beverages is of critical importce to the successful operation of these facilities to attact and cater to a sophisticated clientele. Since the establishments wil be par of a carefully controlled, first-class

project, the service of alcoholic beverages wil enhance the quality of the project site and the Bunker Hil neighborhood. The project also includes a grocery store and possible convenience store and wine shop, which wil offer alcohol for off-site sale and consumption. A grocery store is a much needed land use in the area and the sale of alcohol at a grocery store wil not unduly add to the concentration of alcohol sales outlets in the area. The project wil also include a full service hotel which may offer alcohol sales for guests in a restaurant and lobby and/or poolside bar, as well as though room service and in-room mini bars. Accordingly, this approval wil not result in an uneasonable concentration of such establishments, but wil provide numerous public beneffts including public convenience, entertinment opportnities, and aesthetic and economic improvements.

2. Possible Detrimental Impacts

Is the immediate area in which the license is sought subject to: (Check with your local Police Department area "Senior Lead Offcer")

a. Excessive calls to the Police Department b. Police resources being already strained c. High rates of alcoholism, homelessness, etc. d. Large "youth" (under 21) population

The project area is in Los Angeles Police Deparent Reporting Distrct No. 132. According to the Deparent of Alcoholic Beverage Control, there were 85 crimes in the last reporting period for which information is available. In this same period the average cries per reporting district in

9 the City was 322. Consequently, the project is not in an area of higher than average crie because crimes in Reporting Distrct 132 are far less than the cityide average.

Also, based on a meeting with Sergeant Walker of the Los Angeles Police Deparent, although

the Central Division of the LAPD is subject to excessive calls, strained police resources, and high rates of alcoholism, homelessness, etc., the imediate project area (the Buner Hill area) does not generate these problems.

To ensure that the project wil not create any detrimental impacts on the surounding area, the specific details of each establishment wil be reviewed pursuat to a plan approval process required under Case No. CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA. This process wil allow for a comprehensive review of each request with input from each prospective tenant, the Police Deparent, the Council offce, and any other interested paries. Securty plans, floor plans, and seating limitations, and as well as the mode and character of the operation, wil be addressed and assured through this process and the imposition of site-specific conditions.

3. With reaard to the operation of the proposed business explain:

a. The method of business operation: (large volume of alcohol to food sales, "late" hours (after midnight), high % unskiled (no ABC training class) staff, high % of underage (under 21) staff, etc.)

The business operations wil var by establishment depending on the natue of each establishment (i.e., restaurant versus wine bar or grocery store). The method of operation wil be reviewed and approved by the Zoning Administrator durig the plan approval process. Case No. CPC 2006-9702-ZC-CU-CUB-CUX-ZV-DA includes a condition requing all employees of each business serving alcohol on-site to receive "Server Awareness Alcohol Training" (STAR) and LEAD programs, as respectively sponsored by the LAPD and California Alcoholic Beverage Control Deparent.

b. Would the business duplicate a nearby business already in existence?

While there are a number of establishments with on-site licenses within the census tract, the proposed project wil introduce up to 2,660 new residential units and the associated residents, along with employees úom the commercial businesses. The sale of alcohol at the proposed restaurants wil be a public convenience to these new residents as well as to the visitors, tourists, and employees in the surrounding offce buildings. According to the Deparent of Alcoholic Beverage Control, there are only three outlets with licenses for off-site sales within the census tract. The proposed project wil introduce a full service grocery store to serve the expanding residential population in Bunker Hil. The sale of alcohol at the thee proposed

retail locations within the project wil provide a public convenience to the existing residents in Bunker Hil as well as serving the residents of the new 2,660 units that wil be constrcted as par of the proposed project.

Furhennore, the project is located within an area designated for Regional Center Commercial uses and is adjacent to other commercial uses, including restaurants and retail shops in the offce buildings to the south of the project site along Grand Ave. The project is also located within the Buner Hil Redevelopment Project Area, which is an established mixed-use community intended to provide a full range of residential and commercial options for businesses and households within walking distance of the Civic Center offce towers on Bunker Hil. Other prominent land uses within the area include MaCA, the Walt Disney

Concert Hall, California Plaz the Music Center and other high-rise offce building developments. Land uses within the project's imediate vicinity include residential, entertinent, offce, governent, parking strctues and sUUace parking lots. The sale of alcoholic beverages is an excepted component within this tye of project. The development provides a settg wherein many patrons are likely to fulfill shopping, dining and entertinent needs in one visit. A review of other similar mixed-use projects indicates that the sale of alcohol is an integral par of such mixed-use settings. c. Other non-alcohol sales business options available so alcohol does not have to be sold, e.g., more specialty products, broader range of items like fresh meats or fruits and vegetables, etc.

The proposed project wil include a varety of retail stores and commercial uses for residents and visitors alike that wil not involve the sale of alcoholic beverages. The grocery store is anticipated to be a major tenant and the taget tenant is an upscale health food grocery store that wil offer a broad range of organic produce, meats, and other items. The sale of alcohol wil be an accessory use to the project as a whole, and marketed at a segment of the population that is not likely to become a high crime risk for the City.
