BUSH, ) President of the United States, et al., ) ) Respondents. ) ) ORDER With respect to Respondents’ Motion for Joint Case Management Conference, Entry of Coordination Order and Request for Expedition [#7], the Calendar and Case Management Committee of the United States District Court for the District of Columbia hereby grants that motion in part and orders the following, pursuant to its authority under LCvR 40.5(e): 1. Senior Judge Joyce Hens Green will be designated to coordinate and manage all proceedings in these matters and to the extent necessary, rule on procedural and substantive issues that are common to the above-captioned cases. 2. A hearing before Judge Green will be held on Monday, August 23, 2004, at 9:30 a.m. in the sixth floor conference room. One lead counsel only for each petitioner in the above cases will be required to be present in person or by phone. Counsel must be available for the entire day and must have authority to resolve procedural and scheduling matters. Substantive matters may also be discussed for possible resolution at that time. No more than one counsel per petitioner will be permitted to attend. If counsel is only available by phone, he or she should immediately contact Sheldon Snook, Administrative Assistant to Chief Judge Thomas F. I. SUMMARY OF RECENT DEVELOPMENTS On December 28, 2004, Respondents moved to dismiss Mr. al-Marri’s habeas petition. The Motion was fully briefed in accordance with the Order of the Honorable Joyce Hens Green dated December 16, 2004, which was issued pursuant to this Court’s Order of November 29, 2004, transferring this case to Judge Green for coordination and management as reflected in the September 15, 2004, Resolution of the Executive Session. On January 31, 2004, Judge Green issued a Memorandum Opinion Denying in Part and Granting in Part Respondents’ Motion to Dismiss (“January 31, 2005 Order”) in eleven of the coordinated cases.1 That Order did not apply to eight other cases, including Mr. al-Marri’s case. January 31, 2005 Order at 15 & n.15. PORTER: The following interview is being conducted on behalf of the Oral History Project of the District of Columbia Circuit. The interviewee is Judge Joyce Hens Green, the interviewer is Jennifer Porter. The interview is taking place at the judge's chambers on Sunday, March 11, 2001. It is now 11:20 a.m. Now Joyce, didn't you have some libel cases that were of interest to you and probably also to posterity? JUDGE GREEN: Well, if I start with the first one, I'm not so sure posterity is holding its breath. This 1985 jury action involved the Liberty Lobby, Inc. and its chair, Willis Carto, and the National Review and its chair, William Buckley, Jr. A libel action of one conservative opinion magazine and its principal versus another conservative opinion magazine and its principal. The men had been great friends in past years and then had come to a division of their ways. Most interesting thing about the claims and counterclaims were the lawyers involved, and Mr. Buckley, who performed much like he did on his own television show. At one point, slouching in the witness chair, he turned to me to ask if he could leave because he had a very important speaking engagement and had to catch a plane. When I said "No," he kept insisting that he was losing a great deal of money. The jury overheard this and did not appear impressed by his attitude. A news weekly reported a little bit about this trial and that a judge in Washington had denied Buckley his way.

    FEATURES The Contemporary Presidency Judicial Restraint and the New War Powers JASMINE FARRIER University of Louisville Over the past four decades, members of Congress have filed 10 lawsuits challenging military actions abroad that were ordered or sustained by presidents without prior legisla- tive consent. In dismissing these cases, federal courts told the plaintiffs to use their legisla- tive tools to show disapproval of the actions already in progress. Under this logic, the House and Senate must have a veto-proof supermajority to end an existing military engage- ment before a case can be heard on the merits. These precedents contrast with previous war powers cases initiated by private litigants, which focused on prior simple majority legisla- tive authority for presidential action. [I]t is the exclusive province of [C]ongress to change a state of peace into a state of war. (United States v. Smith 1806, 1230) [I]t is error to suppose that every case or controversy which touches foreign relations lies beyond judicial cognizance. (Baker v. Carr 1962, 211-12) [N]one of the legislation drawn to the court’s attention may serve as a valid assent to the Vietnam War. Yet it does not follow that plaintiffs are entitled to prevail. (Mitchell v. Laird 1973, 616). War Is a Three-Branch Question From the founding to 1950, war usually proceeded in constitutional order: congres- sional authorization followed by executive enforcement. Over that century and a half, fed- eral judges adjudicated dozens of war-related disputes raised by private litigants that hinged on executive branch adherence to Congress’s prior legislative direction.

    FACES OF GUANTÁNAMO GUANTÁNAMO ’S MANY WRONGLY IMPRISONED APRIL 2007 666 Broadway, New York, New York 10012 (212) 614 6464 [email protected] INTRODUCTION President Bush’s announcement of the transfer of so-called “high-value detainees” from secret CIA ghost detention sites to Guantánamo is a thinly-veiled attempt by the Administration to re-shape the image of Guantánamo – and the men detained there – in the face of widespread condemnation both at home and abroad. The Administration would like to re-claim that Guantánamo is holding “the worst of the worst” despite overwhelming evidence to the contrary. The political debate and the media attention are focused on the way a small minority of suspects will be tried. Lost in the discussion is the matter of hundreds of men who have never been charged and will never be tried because there is no evidence justifying their continuing indefinite detention. It is the Administration’s position that these men can be imprisoned indefinitely without charge or trial. The President would never be required to justify the legality of their detention, and these men would never be able to present their case and obtain a hearing before a court. Quite simply, the President’s mere assertion that executive detention is justified would be sufficient to lock someone up forever. For the men at Guantánamo, the theory of their imprisonment - now in its fifth year for most of them - is that they were soldiers, technically, "enemy combatants." The "enemy combatant" definition in use exceeds what is permissible under the Geneva Conventions; and scores, perhaps hundreds of men do not fit even within its broad reach.

Pets.’ Mot. at 1. Upon consideration of the motion, respondents’ opposition thereto, the petitioners’ reply, and arguments of counsel, the petitioners’ motion must be denied. However, so that the Court is kept abreast of the petitioners’ detention status, it will require the respondents to submit a declaration to this Court advising it of any transfers and certifying that any such transfers or repatriations were not made for the purpose of merely continuing the petitioners’ detention on behalf of the United States or for the purpose of extinguishing this Court’s jurisdiction over the petitioners’ actions for habeas relief for a reason unrelated to the decision that the petitioners’ detention is no longer warranted by the United States.1 1An Order consistent with the Memorandum Opinion is being issued contemporaneously herewith.
