Based on the AHL, it is part of the legal basis to develop provisions in delegated Regulation on Union surveillance programmes and on disease-free compartments Empowerments in the AHL Delegated act Implementing act Union Art 29 Art 30 surveillance Criteria to list diseases relevant List of diseases subject to USP programme (USP) for USP and their geographical scope Technical content of the USP Disease-free Art 37 (5) Provisions for Art 37 (4) compartments recognition of compartments free List of diseases for which from diseases of aquatic animals disease-free compartments may be established Union surveillance programmes (USP) • Compulsory surveillance programmes run at the Union level for diseases that meet certain criteria • Apply in all or part of the Union • Currently: Decision 2010/367/EU = avian influenza • Delegated Regulation (Doc SANTE/7066/2019) lays down criteria to list diseases for USP and technical provisions for USP for HPAI and infection with LPAIV (H5/H7) • Implementing Regulation (Doc SANTE/7136/2019) • lists for USP HPAI and infection with LPAIV • sets out geographical scope = territory of Member States Disease free compartments • Implications on many aspects of AHL and delegated Regulations associated to it, including entry in the Union • Limited to certain category A, B and C diseases • Currently • Directive 2006/88: compartments free from diseases of aquatic animals • Regulation (EC) 616/2009: compartments free from avian influenza • Delegated Regulation (Doc SANTE/7066/2019) lays down provisions for recognition of disease-free compartments for aquatic animals • Implementing Regulation (Doc SANTE/7136/2019) lists all category A, (B) and C diseases of aquatic animals for the establishment of free compartments • HPAI-free compartments to be addressed later .
