PREFACE

It gives me immense pleasure to present the 1st report of the Senate Standing committee on Cabinet Secretariat and Capital Administration and development for the period from June,2012 to June, 2013 . I had honour of being the Chairperson of Senate Standing Committee on Narcotics Control and Health respectively, but to be the Chairperson of Senate Standing Committee on Cabinet Secretariat and Capital Administration and Development is a unique and novel experience, due to the vast, enriched and diverse ambit of the Committee. The broad spectrum of the purview of the Committee can be assessed by the fact that multifarious scope of the jurisdiction of the Committee ranges from sophisticated technical issues of the PTA, NEPRA, OGRA, PIA to purely legal matters pertaining to the Establishment Division. However, I feel proud that the Committee tackled all these issues superbly, due to the expertise and diligence of my worthy colleagues whose dedication and un wavered commitment brought about several achievements to the credit of the committee., it frequently engaged in conducting meetings to perform its oversight role effectively, in order to ensure the transparency and the fairness in the relevant divisions as well as the attached departments, if any legislative is needed and proposed for that., as the representative of the peoples, the Committee targeted to facilitate the peoples and protects their interests. In order to perform its core function of the oversight, the Committee adapted the mechanism, which consisted of identifying the malfunction/negligence/ flaws/ misconduct/ discrepancy or deviation from any prescribed rules, probe it; suggest recommendations and follow up / pursue the implementation status. The Committee Members several times in different cases, which were closely related to the sensitive issues like the public health and the environment, visited the sites in order to know the ground realities and also cross checked the deviated statements of few officers. The Committee more focused on the structural changes, resultantly which have paid dividends to the peoples. The Committee’s efforts and the decisions were within the defined framework/mandate. I appreciate my fellow members of the Committee for their active participation and contributions, which helped me to perform this role as the Chairperson effectively. I attribute the achievements accomplished by the Committee to them, because without their diligence and cooperation it would not have been possible. It would be injustice for not acknowledging the cooperation and commitment of the government official of relevant Ministries/ Divisions. The

Committee is determined to keep on playing its active role, by making recommendations to facilitate the Government, to resolve the issues of the public at large in the Country. I appreciate the cooperation of the Chairman Senate Mr. Nair Hussain Bukhari, Deputy Chairman Senate Mr. Sabir Ali Baloch, Leader of the House Raja Zafarul Haq and Leader of the opposition Barister Aitizaz Hussain Syed for their continued cooperation and guidance. We look forward to the continued cooperation of the Senate Secretariat which, under the dynamic leadership of Secretary of Mr. Amjad Parvez, has always been at the beck and call of all members of the Senate, particularly the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development .We would look forward to suggestions from our members on what may be needed to improve further this report, since it would be a regular feature of our work. I am also indebted to the Secretary Committee Ghulam Murtaza and his staff for continuously perusing the implementation status through corresponding with the relevant entities; and my personal staff specially Mr. Mohammad Abid Ashraf and Hafiz Asim Shahjahan for their diligence, commitment, research, valuable and sincere efforts for facilitation of the Committee to attain its goals.

EXECUTIVE SUMMARY

The Standing Committee are the backbone of parliamentary system in the democratic dispensation Parliaments, around the world, function through the Standing Committee, which are deemed to be the eyes and ears of the parliament, eyes riveted on the officialdom to oversee the executive to implement the policies enshrined by the Government. Ears committed and devoted to listen to the voice of the masses and convey to the Government of the day. These committees on one hand, hold the officialdom and Government of the day, accountable and put in valuable suggestions in formulation of the policies by the Government. Furthermore, Parliaments without effective role of Standing Committees cannot discharge their basic obligations of legislation. In short, the whole parliamentary façade rests upon the pillars of the Standing Committees.

The Senate Standing Committee on Cabinet Secretariat and Capital administration and Development according to Scehdule1, Rule 3(1) deals with matters and issues pertaining to several institutions under the administrative control of the Cabinet, Establishment, Capital Administration & Development Divisions and Prime Minister’s Secretariat.

The Committee, under the vigilant Chairpersonship of Honourable Mrs. Kalsoom Parveen endeavored very hard to perform all the aforementioned functions of the Committee i-e parliamentary oversight and the accountability of the officialdom, conveying the sentiments of the public to the Government and legislation on the issues referred by the House. In depth, perusal of the proceedings of the Committee will reveal that despite the vast scope of the work, the Committee did not spare any important issue unattended.

During the proceedings of the meetings, the Committee observed that despite significance changes in the working environment as well as the dynamics of the society, the affairs of the public entities are being run by following obsolete conventional techniques, which consequently maintain the status qou. The Committee in that scenario focused to perform effectively its oversight role, in order to get rid of status quo and avoid the misuse of the excessive power, which ultimately leads to corruption. The Committee observed that there is a dire need to evolve a fool proof system to eradicate violation and negligence of the rules, which ultimately leads to detriment of the interests of the people. It is necessary to bring about core structural changes to insulate the system form corruption and to establish the rule of law. The Committee, therefore,

emphasized on restructuring of the public sector institutions to synchronise them with the needs of the day and to make them more effective and responsive to general public.

The Committee held several meetings during the period from June, 2012 to June, 2013, and took up the issues pertaining to the Cabinet & Establishment Divisions, CDA, PTA, BISP, ERRA, OGRA, NEPRA, and health and educational intuitions under the administrative control of Capital Administration and Division, some of which are highlighted below:-

Highlights of issues taken up by the Standing Committee and the recommendations made ,there on :-

• CDA& CAAD

I. To stop fake allotment of plots by the CDA, a fool proof system of check and balance may be evolved by introducing computer technology according to the international standard. Steps may be taken for improving the financial condition of the CDA.

II. Reasonable increase may be made in the budgetary allocations for the health and education sectors.

III. New hospitals may also be constructed in the rural areas of Islamabad territory. The administration of Poly Clinic and CAD may resolve all the issues for construction of new block.

IV. Ministry of CAAD in coordination with Ministry of IPC should prepare proposals for the settlement of the issues regarding the vertical health programs such as Enhanced HIV AIDS Control Program, Roll Back Malaria program, National TB Malaria Program, Prime Minister’s Program for Prevention and Control of Hepatitis, Strengthening National Tuberculosis Control Program for Ensuring Uninterrupted Drug Supplies. and establishment of check and balance system for the Medicine companies.

V. All the schools under the control of CAAD may be upgraded, strength and capacity of the teachers, in addition the curriculum may be revised and development of the check and balance system may be established for the regulation of affairs of private schools in Islamabad.

VI. Development in Park Enclave project Islamabad may be expedited and handling over possession of the plots to genuine allotees be completed.

VII. The Policy of auction of commercial as well as residential plots by CDA, may be dispensed with and steps may be taken for adoption of an open Auction Policy, for ensuring transparency.

VIII. CDA may take initiatives for the generation of revenue through permanent sources by establishing the developed real estates, development of the new sectors on Public Private Partnerships (PPPs).

IX. All the issues pertaining to the payments of compensation to the affectees, whose land has been acquired, may be resolved on the immediate basis.

X. CDA should prepare proposal on the establishment of its own Police Stations to stop which illegal occupation and encroachment on CDA land.

XI. Detail discussion on the working, performance and organizational hierarchy of the P.M. National Health Complex along with administrative / financial problems of the complex and its components. (NIH, FMDC, HSA, PMRC, FGH) and recommended for the improving its performances.

XII. Detailed discussion on the organizational hierarchy of Health Services Academy; total research scholarships awarded along with the procedures of award of scholarship; educational qualifications of the scholars and research papers / thesis published by the scholars and recommended for up gradation as well as betterment in its affairs.

XIII. Detailed discussion on the alleged case of harassment of a woman by an officer of the Health Services Academy, criteria for the selection of the heads of the 7 departments functioning under the HSA. The Committee also advised for the provision of audit report of HSA for the year 2011-12.

• Earthquake Reconstruction and Rehabilitation Authority (ERRA)

XIV. Briefing on the working and performance of Earthquake Reconstruction and Rehabilitation Authority (ERRA), recommendation for tapping of undue increase in the non-developmental expenditure, completion of the loan based Projects on the priority basis and establishment of the fool proof system of check and balance.

• Benazir Income Support Program (BISP)

XV. Briefing on the working and performance of Benazir Income Support Program (BISP), recommended for starting Micro Financing schemes on the analogy of Gramen Bank Bangladesh, in order to bring the people to self-reliance. BISP should spend money of poor people with utmost care.

• Federal Public service Commission (FPSC)

XVI. Detailed discussion on the Section Officers Promotional Examination (SOPE) and recommended that FPSC should hold the examination annually.

• Pakistan Telecommunication Authority (PTA)

XVII. Forensic audit of the utilization of USF Funds be conducted and the projects in telecom sector may be initiated throughout the country,

XVIII. Disposal of all PTA pending cases, prioritizing the consumer rights and issue of recovery of 47 billion rupees be resolved at the earliest.

XIX. The Process of Auction of 3G spectrum may be expedited and Pubic representatives may also be made part of the Auction Supervisory Committee.

XX. A proper complaint cell be installed and the same be advertised widely in electronic media, and devising a strategy to stop fraudulent, obscene messaging and to regulate night packages.

• Oil and Gas Regulatory Authority

XXI. OGRA should be made more powerful and strong for making decisions independently for fixing of prices of petroleum products.

XXII. The appointment of Board members should be made purely on merit.

XXIII. The formula for fixing of prices of petroleum products may be revised, the profit of the marketing as well as the taxes on the petroleum products may be reduced substantially.

Achievements

• The stoppage of the fake allotments by CDA.

• Commencement of development work in Park Enclave Project of the CDA.

• Resolving the issues pertaining to the Kurri Model Village Project between the CDA and ICT in scrutinizing of genuine allottees.

• Handling over of the plot by the CDA to National Institute of Rehabilitation Medicines (NIRM).

• Removal of barricades from the roads in front Marriot Hotel and Islamabad Club.

• Resolving the problems and removing bottlenecks being faced by various housing societies in the Federal Capital.

• Purchase of ventilators by PIMS.

• The issue of amicable solution of the price fixation of CNG Association by OGRA.

• Release of three billion rupees to OGRA.

• Regularization of the contractual daily wages teachers, working in the educational institutions of capital.

• Auction of 3G spectrum by PTA.

• Establishment of the customer’s complainant cell by PTA and stoppage of obnoxious calls and messages.

• Changes in the auction policy of the CDA in respect of commercial and residential plots.

• Removal of the encroachment from Faizabad.

• Intellectual Property Organisation Bill.(IPO 2012).

• Private Educational Association Regulatory Authority Bill (PEIRA 2013).

• Shaheed Zulfiquar Ali Bhutto Medical University Bill.

• Removal of the encroachment from Faizabad.

• On the recommendations of the Standing Committee, for considering the request of the contractual employees etc,Prime Minister relaxed the ban on the recruitment and regularization of the contractual employees.

FROM THE CHAIRPERSON’s DESK

As a Chairperson of the Standing Committee, I did my best to deliver as much as possible. With the effective contribution by my colleague members and persistent follow up by the Secretary committee, Mr. Ghulam Murtaza, the Committee’s efforts proved very fruitful and brought about several achievements as highlighted in the preceding pages. All this was accrued due to result oriented approach of the committee.

However, after my twelve-year’s experience in the parliament, I came to this conclusion that there is a lack of harmony in the bureaucracy and the parliament. Bureaucracy is deeply entrenched in the obsolete conventional techniques and tries their best to maintain the status quo. In certain cases, they try to hoodwink the Parliament by concealing the facts and resorting to the bureaucratic red-tapism. I very strongly feel that the executive has not attuned itself to the changed dynamics of the society for reasons unknown. In today’s ultra-modern technological era, our officialdom moves at snail’s pace keeping people’s aspirations at oblivion. To get a decision of the Committee implemented is a daunting task. Every time, a new excuse peeps up; a new rule makes it’s way and a new bureaucratic innovation reveals to impediment the implementation of a decision of the parliament. Persistent follow up of the issues is cry of the day to get something through bureaucratic labyrinth. In the following paragraphs, I would like to highlight a few instances where Standing Committee could not get it’s decision implemented. These cases speak volume of the inefficiency, unprofessional and above all callous heartedness of the system. Sole intention to highlight these issues is to invite attention of both houses of the Parliament and to urge upon them to devise a mechanism to get rid of this obsolete and rotten administrative system. Failure of the system can be gauged by the fact that even to resolve a minor issue of administration the Chief Executive of the country has to intervene.

The Committee took up the issue of payment of compensation to affectees of the Capital, land of whom, was acquired by the CDA decades ago. Shocking facts were revealed to

the Committee by the CDA. The CDA authorities themselves confessed their failure to accommodate these affectees as per commitments made with them. The department kept playing Ping-Pong with the affectees under different pretexts, since the last few decades. The inordinate delay has resulted in adverse possession of the CDA’s land measuring thousands of kanals. Thousands of affectees, while waiting for the promises of CDA to be fulfilled, have passed away and their two to three generations have come to fore. Now, they demand land for their legal heirs and the CDA is adamant to listen to their just and legal demands. The Committee took notice of the issue and directed the CDA to resolve the issues at least in the interest of the department. But, the CDA proved impervious, even to the directions of the Committee. They admitted that due to the delay in the award of compensatory rights to the genuine affectees, more than 5000 cases have been instituted against the CDA in various courts. The Committee directed that in order to shed the burden of the litigation the CDA would computerize their legal wing and a mechanism be prepared to hire services of competent lawyers. But, till today, neither legal wing could be computerized no affectees could be compensated. How many generations will further await their rights????? Nobody knows however!!!!!! The Capital’s ever burgeoning populations asks for fabulous increase in the health facilities. The existing health infrastructure is unable to serve the patients, which come not only from the capital and its suburbs but also from Azad Kashmir, Gilgit and other cities. It will be an eye opener for the reader that there is an acute paucity of ventilators in the PIMS, and Poly Clinic, Islamabad. Several people including two members of Parliament have lost their lives due to non- availability of the ventilators. The honourable Chairman Senate himself took the notice of the issue and the Committee followed up but no money could be made available by the Ministry of Finance. Similarly, the Poly Clinic is overcrowded and cannot cater to the hundreds of patients due to non-availability of space in the hospital. The Government of Argentina has very graciously agreed to gift a piece of Argentina Park, adjacent to the Poly Clinic for the construction of the new blocks in the hospital. The Committee gave very clear instruction to the CDA to handover the plot to the Poly Clinic administration, but of no avail. Every time a new pretext is put forth and the Committee is apprised that rules do not permit, transfer and use of land of the park for the hospital. Resultantly, the matter is still lying in the shelf of archives of the CDA.

Recovery of tax to the tune of 48 billion rupees outstanding against various cellular companies is another eye opener. The Committee took cognizance of the issue and was apprised that the Chairman FBR had been removed owing to his failure to recover such a hefty tax amount from the cellular companies. The Committee constituted a Committee comprising representatives of the PTA and FBR. To the astonishment, the Committee new facts were revealed. The PTA informed that they had nothing to do with the recovery and the FBR is still burdening over the question, whether the tax was payable by the cellular companies are not and a year has lapsed. How many more years will be required to resolve this issue???? Nobody Knows it !!!!!!!!!!!!!!!!!!.

A BRIEF LIFE PROFILE

Senator Kalsoom Parveen hails from the province of Balochistan. During her childhood, education used to be a taboo to women. Despite severe family resistance and ardent societal pressure, she continued her education and after completing education she opted for teaching because she wanted to share the fruits which she herself had gleaned through education. She served as a principal, across the length and breadth of the province and witnessed the indigent educational facilities available to the people of her province in general, and to womenfolk, in particular.

2. In those days no one could imagine of sending his daughter to school but she went door to door and besought parents to send their girls to schools. Her endeavor bore fruits and girls started to turn up in the schools. Slowly, the parents started to repose confidence in her and a flock of young and tiny girls started to accompany her to school, every morning.

3. Her confidence boosted and she decided to quit the government job and started to open one room girl’s schools in the remotest areas of her province. Today, her students are serving in all walks of life. Her passion and commitment did not let her stop there and she started to participate in political activities as well. She mobilized the tradition‐trenched women of her province to participate in the community development through politics.

4. In 2003, she was elected to the and now her horizon became broader. She put in all her energies and potential for peace, prosperity and stability of her province.

5. She held the portfolio of Chairperson, Senate Standing Committee on Narcotics Control from 2003 to 2009. During these six years, she succeeded in establishing standard rehabilitation centers.

6. In 2009, again she got elected to the Senate, as an independent candidate, for another stint of six years. She is the first lady in the history of Pakistan, who was elected as an independent candidate. Keeping in view the political situation of the province she decided to join BNP (Awami). This time she took the portfolio of Chairperson, Senate Standing Committee on Health.

Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT HELD ON 25TH JUNE, 2012 AT CDA HQs, ISLAMABAD

The meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairmanship of Senator Mrs. Kalsoom Parveen on 25th June, 2012 at CDA Headquarters, Islamabad.

The agenda before the Committee was as under:-

I. To enquire reported illegal allotment of 40 plots in Sector F-11, Islamabad by Director land, CDA (as reported in the Pakistan today, 17th June, 2012)

II. Briefing on the policy of CDA to requisition services of officers on deputation basis as large number of officers are working in CDA (as reported in the Express Tribune, 12th June, 2012).

The meeting started with the recitation of the Holy Quran. Senator Kalsoom Perveen, Chairperson welcomed the members as well as the officials of CDA. She stated that the purpose of the meeting is to probe into the alleged fake allotment of 40 plots, in F 11 Sector, by the CDA, as there is much hue and cry in the national media. She expressed her concern over failure of the Authority to resolve the issue even after lapse of 21 years. She then asked the Member Estate, CDA to give their version of the issue.

Mr. Khalid Mahmud Mirza, Member (Estate), CDA informed the Committee that the incident took place in 1991 in which affectees of village Bhaka Syydan, in connivance with certain officers and officials of the Land Department of the CDA prepared fake allotment letters of 40 plots in Sector F-11 in 1991. . However, the said letters were never issued and no plots were allotted as the letters were recovered from the houses of the involved affectees. After completion of the departmental scrutiny, a case was registered with FIA in 1998 against the culprits. He further informed that after decision of the court all the allotment letters have been cancelled and are in safe custody.

Senator Kalsoom Parveen, Chairperson Standing Committee pointed out that Land Department has become a safe heaven for real estate agents and the a mafia is at large, in collusion with CDA officials. She along the Committee members showed umbrage over lethargy, sluggishness and incompetence of the Estate and Legal Wings of the CDA, as the fraud was committed in 1991, the case was registered in 1998 and decision of the Court came in 2011, about after 21 years of the incident, which speaks very loud of indigent and poor performance of both the wings of the CDA.

Senator Muhammad Yousaf Baluch inquired about the fate of these fake allotments. Mr. Farkhand Iqbal, Chairman CDA informed the Committee that he also came to know about this case through newspapers and as soon as the matter came in to his notice, he

51 constituted a 3 members Scrutiny Committee to inquire the matter, however the relevant record was not handed over to the Committee, even after the lapse of 25 days.

Senator Kamal Ali Agha reprimanded Member Estate over his lax and non serious attitude to the Committee and recommended that strict disciplinary action may be taken against the responsible officials, who are not providing record to the investigating Committee, as it is earning bad name for the Authority. He proposed that Member (Estate) may not be included in the Inquiry Committee.

Chairman, CDA assured that he will try his best for improving the efficiency of the department. He informed that he will constitute a new committee of officers of the relevant wings of the department and will furnish report within 15 days.

Senator Saeeda Iqbal suggested that for conducting fool proof inquiry the residents of the village Bhaka Syyda may also be called for inquiry proceedings.

The Working of the Legal department was also discussed in detail. All the members of the Committee showed their dissatisfaction over the performance of legal department of the CDA. They were of the view that due to poor performance of this wing about 5000 cases of CDA are pending in various courts and if the legal department of the CDA performs its duty with honesty and dedication the number of pending cases can be reduced easily. D.G Legal, CDA informed that he is answerable to member Estate and also take guide line from him. The Chairperson directed that for early and speedy disposal of the CDA cases in various courts the D.G legal should directly report to the Chairman CDA.

Coming on agenda item No.2, regarding policy of CDA about the deputationists, Member (Admn) informed that due to ban on recruitment CDA, takes officers from other departments and according to government policy these officials are repatriated after completion 3 years period. On a query by Chairperson, he informed that at present about 40 officers of BS-16 to 19 are working on deputation basis and presently about 600 posts of different grades are lying vacant in CDA.

Senator Saeeda Iqbal recommended that only technical persons may be taken on deputation basis and all appointments in BS 1 and 2 may be made from the residents of Islamabad municipality.

Senator Kalsoom Parveen, Chairperson of the Committee inquired about the appointments in CDA from the Baluchistan province. She stressed upon the need that Baluchistan quota may be fully observed in all future appointments as per the provisions of the constitution. Member (Admn) informed that presently about 70 persons belonging to Baluchistanprovince are serving in CDA.

52 The Committee recommended that:

(i) The report of the Inquiry Committee may be submitted within 15 days and Member Estate should not be part of inquiry.

(ii) Immediate steps may be taken for improving the financial condition of the CDA.

(iii) To stop fake allotment a fool proof system of check and balance may be evolved by introducing computer technology according to international standard.

(iv) Director General, Legal Wing, in consultation with the Chairman, CDA will prioritize the cases and provide detail of all cases to the Committee. In future DG (legal) Wing should take guide line from the Chairman CDA specially in the high profile cases to avoid undue delay and for early decision of the case of revenue generation.

(v) The complete detail of deputationists in CDA along-with their grade in their parent department and grade against which they are working in the CDA. Their date of joining /completion of terms may also be provided to the Committee at the earliest for further discussion in the next meeting.

(vi) In future appointments, regional quota of Baluchistan may fully be observed as mentioned in the Constitution and against posts of BS-1-2 only local people may be adjusted.

After detailed discussion on the agenda items, with the permission of the Chair, the Chairman CDA informed the Committee that he is trying his best to restore the confidence of common people on the department by improving the efficiency of the department and by starting development work in almost all the sectors of the city.

Giving detail of some of his initiatives, he informed that steps are being taken for the improvement of situation of Sectors E-13 and I-16, which is not good since last 20 years, work has been started on 11th Avenue and carpeting of roads of various sectors. Chairman also informed the Committee that CDA is planning to construct 6000 flats in Sector I-15 with the cooperation of China and authority is also trying to improve the water situation in the city.

On a query by Chairperson he informed that development work on Park Enclave will be started during the current week as all the formalities including payment, possession of land and award of tenders for development work have been completed. He however, informed that CDA is facing some problems due to delay in conclusion of the inquiry of Kurri Model Village Scam, by the FIA.. The committee directed that this issue will be discussed in the next meeting of the Committee and Director General FIA may also be convened in the meeting.

53 On the proposal of Senator Kamil Ali Agha, the Committee asked for the following:

(i) Detail of all appointments made on regular basis, ad-hoc basis, contract and daily wages from 12th March, 2012 to date.

(ii) Procedure adopted for these appointments.

(iii) Detail of plots, Khokhas, given on rental /lease, public private partnership and BOT basis during the last 5 years along with the criterion/ policy of the CDA.

Senator Mrs.Kalsoom Parveen, Chairperson Standing Committee also advised that following information may be provided at the earliest:

(i) Detail of income earned from all commercial and residential plots and its use during the last three years.

(ii) Detail of all the tenders floated during the last 5 years, and work on which has not been completed so far.

(iii) Detail of schools, hospitals and societies (functional and non- functional).

(iv) Detail of plots which have been commercialized during last 5 years.

(v) Detail of new plots created in the developed sectors of Islamabad, during the last five years, and policy under which the said plots have been created.

The Committee also advised that Syed Imran Shah, Dy.DG may be restored to the post of DG as recommended by the DPO of CDA in 2010. Chairman, CDA assured that he will be restored to the post of DG within 10 days.

The meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairmanship of Senator Mrs.Kalsoom Parveen on 26th June, 2012 at 11:00 am in Committee Room No.1 Parliament House Islamabad.

The agenda before the Committee was as under:-

I. Briefing on the working and performance of Earthquake Reconstruction and Rehabilitation Authority (ERRA).

II. Briefing on the working and performance of Benazir Income Support Programme (BISP).

The meeting started with the recitation of Holy Quran. Senator Mrs.Kalsoom Parveen, Chairperson, Standing committee welcomed the participants of the meeting and stated that ERRA has important role in the rehabilitation of affectees of earthquake and in the aftermath of the October 8, 2005 earthquake it played vital role but unfortunately the Authority has deteriorated gradually and certain drastic measures are required to be taken to enhance working and performance of the Authority. She also took umbrage over late submission of working paper by the ERRA. However, she appreciated the appointment of the incumbent Deputy Chairman as for the first time, since inception the Authority, a Professional has been deputed as Deputy Chairman. Thereafter, she asked the Deputy Chairman ERRA for briefing.

Maj.Gen. Muhammad Azeem Asif, Deputy Chairman ERRA giving introductory remarks informed that ERRA is an important organization for rehabilitation and reconstruction of calamity hit areas. He assured that with the help and guidance of the Committee ERRA will improve its efficiency to fulfill expectations of people.

Brig. Syed Wajid, Chief of Staff of ERRA gave a detailed briefing on the Establishment, working and performance of ERRA. He informed that ERRA, which is an autonomous body came into being in 2006, for post disaster damages, assessment, recovery, reconstruction and rehabilitation of the areas affected by the earthquake. The Authority is under the administrative control of the Prime Minister’s Secretariat. He further informed that all the projects are required to be approved by the ERRA Council and the ERRA Board. He gave a detailed account of overall working of the ERRA; detail of projects completed by the ERRA in various sectors; source of funding and problems being faced by the Authority.

After his briefing members of the Committee raised questions/queries on the working, performance and funding position of ERRA.

55 . Senator Mrs.Kalsoom Parveen, Chairperson, Standing Committee enquired about the detail of amount, in cash and in kind, received from international community after October 8, earthquake. She showed her grave concern over strategy of the Authority for execution of projects as most of the earthquake hit areas have completely been neglected and colossal funds have been spent in the areas which were not at all affected by the earthquake. The ERRA officials failed to satisfy the Chair. The Committee decided to convene next meeting in Abbottabad and to pay a visit to the affected areas to assess the performance of the Authority. She also enquired about the recruitment policy of the Authority and number of personnel working in the authority. The Committee unanimously showed dissatisfaction over substantial increase in the non-developmental expenditure of the Authority and directed to take austerity measures to rectify the present situation. The Chair lamented that even after lapse of 7 years the worst affected area of Tehsil Balakot could not be reconstructed and huge amount of funds has been wasted in the Utopian project of New Balakot City Project.

Senator Talha Mehmood pointed out that certain roads built by the ERRA in District Kohistan have been washed away by the last year floods. He also showed his concern over staffing of the ERRA. He also inquired about the policy of payment of Housing Subsidy in earth quake hit areas; areas where people have been compensated. He apprised that a lot number of despite fulfillment of all formalities have not been given housing subsidy. The Chair directed to submit detail to the Committee in this regard. Senator Talha Mehmood demanded that complete detail of all foreign and domestic loans taken by EAD in the name of ERRA should remain with ERRA and copy of the same may also be furnished to the Standing Committee.

Senator Saifullah Magsi pointed out that most of the loan money is not spent in the given time frame and resultantly, cost of the projects is increased, therefore, amount should be utilized as early as possible to avoid escalation charges. Over inordinate delay in the Project of New Balakot City and in construction of certain schools in various quake hit areas Senator Kamil Ali Agha advised that full detail of problems being faced in land acquisition and efforts made efforts made by the authority may be furnished to the Committee. Senator Rubina Khalid suggested that ERRA and BISP should jointly work on the projects of livelihood. Senator Muhammad Yousaf Baluch stated that detail of pay package of the employees of ERRA may be provided to the Committee.

Giving reply to the observations/queries/questions of the members of the Committee, Brig. Syed Wajid apprised the Committee that that 99% work in housing sector, 58% in health sector, 67%, in transport sector, 41% in education sector, and 94% in water and sanitation has been completed and the rest of the work will also be completed as soon as funding position is improved. He informed the Committee that during the previous fiscal year 8 billion rupees were allocated to the Authority and only Rs.3.5 billions were released . This year, against allocation of 10 billion rupees only Rs.4 billion is expected. He requested for the assistance of the Committee to resolve this issue to enable the Authority to get rid of its liabilities . He also pointed out that ERRA and NDMA are working on same lines, therefore, there is dire need to fix the functions of each agency to reduce the undue expenditure.

56 After detailed discussion the Committee unanimously recommended that:

i) Undue increase in the non-developmental expenditure may be tapped immediately.

ii) Detail of losses occurred in every district and complete detail of work done/remaining may be furnished to the Committee.

iii) The loan based Projects may be completed at the earliest and detail of hurdles, if any, may be furnished to the Committee.

iv) Complete detail of all type of loans (along-with terms and conditions) may also be provided to the Committee.

v) EAD may also attend the next meeting of the Committee in this connection

vi) A fool proof system of check and balance may be evolved for the eradiation of corruption in ERRA.

Senator Mrs.Kalsoom Parveen, Chairperson Standing Committee advised that following information may also be provided to the Committee.

i) Detail of staff serving in ERRA including regular employees along-with their salary/pay package and their present posting. Detail of employees working in all wings of the Authority along with their qualification may also be furnished. ii) Detail of all contracts awarded by the authority along with terms and conditions; names of contractors; original cost of all the projects; and the cost in which these projects have been completed or likely to be completed; amount payable to the contractors along with reasons. iii) Detail of all types of loans/fundings/donations along-with terms and reference of these loans/grants etc. iv) Detail of all types of liabilities. v) Complete detail of vehicles purchased by the ERRA; mode/ policy of purchase of the said vehicles; use of these vehicles. vi) Detail of the affectees who have not been paid housing subsidy along with reasons and the time by which they would be accommodated. vii) Present position of the New Balakot City Project; amount which has been spent on the said project so far; expected time of completion of the said project. viii) Mechanism of monitoring in field at ERRA level; number of engineers working in the Authority. ix) Detail of pre fabricated shelters provided by the Saudi Government; name of company to which work of installation of the said shelters was awarded; criterion adopted for installation of these shelters; number of shelters installed so far; number of shelters to be installed and reasons for such an inordinate delay.

After discussion on the ERRA, Chairperson advised officials of BISP for briefing. Mr.Ahsan Ali Mangi, DG BISP informed that recognizing the need of the poor affectees of the

57 food and inflation, specially the women, the BISP was launched in 2008, as according to survey of Planning Commission about 17% people of Pakistan are spending their lives below the poverty line. He stated that initially the direct cash programe was started and later on under the graduation programe deserving people are being compensated.

Senator Mrs.Kalsoom Parveen and Senator Talha Mehmood pointed out that in the start of the programme 8000 forms were distributed through Parliamentarians and what system has been adopted now and also detail of action taken on the rejected forms of parliamentarian.

DG BISP informed that initially for the identification of poor people the forms were distributed, however more than 50% forms were rejected, as those were not up to the required criteria, therefore an international standard survey was conducted with the help of World Bank, with the cost of Rs.3 billion. He however informed that 6 Pakistani companies qualified for the survey.

Almost all the members shown their great concern over the spending of huge money on survey. Senator Mrs.Kalsoom Parveen enquired about the need of tender for foreign companies, as it could be done easily on local basis. She also enquired about the mode of payment to survey companies. Senator Kamil Ali Agha enquired that on which criteria contact was awarded and also about detail of survey. Mr. Muhammad Sher Khan, Secretary BISP informed that survey was conducted on the basis of neutrality and non-partisan basis and about 98% survey work has been completed.

Senator Talha Mehmood asked about the detail of total staff of BISP along-with their pay package, detail of aid/donation/Government funding (year-wise) and detail of spending of this amount. He also asked for yearly audit report of BISP.

Senator Kamil Ali Agha was of the view that it is a good scheme for the poor people; therefore the allocation of amount for this purpose may be spent carefully and there should not be corruption at all in the BISP. He asked for the detail of all type of amount received to BISP so far.

In response, DG, BISP informed that at present about 1900 persons are serving in the BISP and total amount received so far is 12 billion, out of which, about 3.50 billion were spent on administrative side, and about 2.25 billion were spent on advisement.

Senators Mrs.Kalsoom Parveen, Kamil Ali Agha and Talha Mehmood showed their displeasure on the spending of huge amount on advertisement as it was totally useless. They were of the view that amount spent on advertisement could had been spent for the welfare of the poor people. They demanded that criteria/procedure for giving advertisement may be furnished to the Committee. Senator Mrs.Kalsoom Parveen and Senator Yousaf Baluch pointed out that due share is not being given to the people of Balochistan although the level of poverty is higher in Balochistan than other parts of the country. DG, BISP informed that in Balochistan out of qualified persons of 450,000 only 360,000 are getting financial support and the remaining will also get as soon as their NICs are prepared. The Committee members assured for full support for

58 the preparation of ID Cards etc. Senator Yousaf Baluch gave proposal and assurance for his full support for establishment of wind mills for water for the poor people in Lasbela (Balochistan). Senator Rubina Khalid suggested that investment may be made through clusters and community.

The Committee unanimously recommended that;

1. BISP should spend money of poor people with utmost care.

2. BISP should start schemes for the uplift of poor people on permanent footing instead that of giving Cash.

3. Detail of all amount received in shape of aid/donations/loans/Government funding and its use may be provided to the Committee.

4. Detail of amount spent on advertisement may also be provided to the Committee along-with the detail of companies.

5. Schemes of Micro Financing like Bangladesh may be started from the village level by giving the status to modern village.

6. Financial assistance may also be given on priority basis to the districts of Punjgur, Khuzdar and Awaran of Balochistan.

7. Schemes may also be started for bringing the people to self-reliance, as government cannot give cash to a huge community permanently.

Subject: - MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CAPITAL ADMINISTRATION & DEVELOPMENT

A meeting of the Senate Standing Committee on Cabinet Secretariat (Cabinet Secretariat and Capital Administration & Development) held on 2nd July, 2012 at 11:10 am under the Chairmanship of Senator Mrs.Kalsoom Parveen, in the Parliament House, Islamabad.

. The agenda before the Committee was as under:-

i. Detailed briefing on the departments/organizations under the administrative control of the Cabinet Secretariat.

The proceedings of the meeting started with the recitation from the Holy Quran. Chairperson, Senator Mrs.Kalsoom Parveen welcomed the members as well as officials of Cabinet Division and its attached departments. She informed that it is introductory meeting and the detailed meeting of each department/authority will be held separately.

Mr.Shahidullah Baig, Additional Secretary Cabinet informed that Cabinet Division is acting as Secretariat of Federation for the implementation of the Rules of Business, 1973. He gave detailed briefing about organizational structure, sanctioned strength, detail of meetings of Cabinet function of the its various wings/ regulatory authorities and Emergency Relief Cell.

Members of the Committee raised many queries observations on the performance of various wings/authorities working under the Cabinet Division. Almost all the members inquired about the status of the reports of various Commissions and action taken by the government on these reports.

Senator Mrs.Kalsoom Parveen, Chairperson of Standing Committee inquired about the purpose and achievement of National Book Foundation. She advised that detail of officers serving in National Book Foundation in B-17 and above alongwith pay & allowances and educational qualification may also be furnished in the next meeting. Budgetary allocation and its utilization by the Foundation for the last three years may also be furnished to the Senate Secretariat.

Senator Mrs.Kalsoom Parveen and Senator Abdul Haseeb Khan also raised many objections on the affairs and losses of the PCPP. They were of the view that this corporation should run in to profit, as presently printing work of all the government departments is with this corporation. They therefore advised that detail of losses, detail of work done by the PCPP and detail of NOCs issued by PCPP during the last 04 years may be provided for the next meeting of the Committee on this subject.

The members also raised questions about the Pakistan Chair abroad. They inquired about the purpose of these Chairs, meetings held so far, purposes achieved so far target

60 detail of overall expenditures from 2008 to 2012. They advised that full detail in this regard may be provided for the next meeting of the Committee.

Senator Abdul Haseeb Khan and Senator Kamil Ali Agha were very critical of the procedure of awarding of Civil awards. The Committee advised that full detail about the procedure/criterion for awarding civil awards, detail of members of the Award Committee and detail of Awards winning personalities along with their achievements may be provided for discussion in the next meeting.

The members of the Committee advised that number of advices, status of implementation of on these advises, detail of Board, members and action taken on the non- implementation of the advises of the NTISB may be provided as soon as possible for discussion in the next meeting of the Committee.

All the members also raised many objections on the working and performance of OGRA/NEPRA. Senator Kamila Ali Agha inquired about the formula of fixing of prices of petroleum products. He was of the view that these authorities give preference to the interests of the international companies rather than the watching of the interests of the common people.

Senator Mrs.Kalsoom Parveen, Chairperson inquired about the non issuance of licenses of CNG stations in Baluchistan, although Baluchistan is supplying gas to all the country and people have made investment of billions of rupees, she advised that full detail of licenses issued during the period from 2008 to 2012, licenses issued during ban period, criteria for appointing Board members reasons for giving only 2 licenses in Baluchistan and terms of references of both the Authorities may be provided for discussion in the next meeting of the Committee.

Discussing the affairs of Emergency Relief Cell, the Committee was informed that major functions of the Cell is to provide assistance to the affectees of major disasters. Senator Syeda Sughra Imam & Senator Abdul Haseeb Khan pointed out that there is overlapping and similarity between the functions of various departments like this Cell, ERRA and NDMA. They therefore, advised, that after the 18th Amendment and creation of new Ministry the work of similar nature should remain with one department, which will reduce the burden on government exchequer and as well as will also improve the performance of the department for providing better facilities to the common people.

Additional Secretary Cabinet Division assured that he will bring the matter to the notice of the competent authority and report in this regard will be provided in the next meeting of the Committee.

The Committee was informed about the working of people’s Works Programme. Mr. Muhammad Asif, Joint Secretary, informed that Rs.10 billion have been kept under the PWP-1 and under the Prime Minister’ Directives sanctioned amount is also spent on the various development schemes under PWP-11. Senator Mrs. Kalsoom Parveen and Senator Saeeda Iqbal pointed out that system of changing the schemes is very complicated, therefore it should be made simple for the early completion of schemes and timely utilization of fund. Senator Begum

61 Najma Hameed advised that details of all schemes under PWP-1 and PWP-II name of Parliamentarians, amount allocated for cash scheme, detail of completion and also detail of unspent amount may be furnished for discussion in the next meeting.

The Committee advised that detail of officials sent to surplus pool and details of moveable and immovable assets of all the devolved ministries/ departments and all vertical programmes may be provided immediately for information, as future of number of officials are being ruined because some provinces are reluctant to accept them without sufficient.

Affairs of Abandoned Properties Organization were also discussed. The Committee advised that full detail about the abandoned properties, detail of allotment of lease with cost may be provided. The Committee also advised that detail of Board Members, Chairman and recruitment made (province-wise) of the Frequency Allocation Board (FAB) may also be provided.

Chairman, PTA informed that basic purpose of the creation of PTA was to privatization, regularization modernization, investment and to watch the interests of the consumers of the Telecom sector. He informed that PTA had given 5 licenses without auction and 2 were given on auction for 291 million US dollar each. The Committee advised that detail of different type of licenses issued so far with auction and without auction and present status of 3 G licenses may be provided for discussion in the next meeting, as huge amount is involved in this regard, which can reduce country’s circular debt. The Chair directed that details about procedure of approval for the grant of license to cellular companies and copies of the files and names of the signatories who accorded approval for grant of license to all the cellular companies working in the country may be furnished to the Senate Secretariat.

At the end, the Chairperson thanked all the members and other participants of the meeting and informed that separate meetings of each Wing/ Board/ Authority will be held in the near future for detailed discussion on all the affairs of that organization. Therefore, departments should prepare themselves for the future meetings. She also pointed out that detail of some departments like NIH and Prime Minister’s National Health Complex working under the administrative control of the Cabinet Division has not been provided in the briefing.

The meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairmanship of Senator Mrs.Kalsoom Parveen on 3rd July, 2012 at 11:00 am in the Parliament House Islamabad.

The agenda before the Committee was as under:-

I. Introductory briefing on the departments/organizations under the administrative control of Capital Administration and Development Division.

The meeting started with the recitation of Holy Quran by Senator Talha Mehmood. After welcoming remarks, Senator Mrs.Kalsoom Parveen, Chairperson, Standing Committee apprised that CAD is a new Ministry; therefore a lot of work has to be done by the Ministry for settling all the issues.

Mr. Imtiaz Inayat Elahi, Secretary CAD gave briefing about Ministry and its all attached departments. He informed that Ministry was created in April, 2011 for the limitations of the Islamabad territory.

He apprised the Committee about the organizational structure, number of employees and budgetary position of the Ministry and its attached departments. Giving the detail about educational institutions at Islamabad, Secretary CAD informed that there are about 421 schools in Islamabad territory and all schools have been upgraded to Model Schools, however due to budgetary constraints about 50 schools will be upgraded annually.

Members of the Committee advised that good and trained teachers may be provided to these schools for improving the educational standard in the capital. They were also of the view that curriculum should be prepared at Federal level, as there are lot of sensitive issues involved in the matter and similarly FBISE may be attached with the Ministry of CAD, as all the issues of FBISE are linked with educational institutions of the Capital. The Committee members also showed their concern over the state of affairs of private schools. The Committee directed that affairs of all the private schools may be regulated including fixing of fee, curriculum and pay structure of teachers etc. The Committee advised that before finalizing proposals suggested in PERA Act may be submitted to the Committee members for their suggestions.

Almost all the members raised many questions/observations about the performance and affairs of PIMS/Poly Clinic/NIRM in a lengthy discussion.

Senator Mushahid Ullah Khan pointed out that sufficient number of ventilators has not sufficiently been installed in PIMS, therefore, the same should be provided immediately. He narrated his own pathetic experience of treatment at PIMS and stated that even for a senator it is not possible to get treatment from these hospitals. He was of the view that with the proper planning and implementation the working condition of PIMS and Policy Clinic can be improved

63 reasonably. Senator Mrs. Kalsoom Parveen pointed out that certain Mafias are fully active in both the hospitals; therefore, patients are facing problems in getting treatment and as well as also getting low quality medicines. She also indicated that there are incidents of wrong prescription of medicines by the doctors, which resulted in death of patients. She recommended that all private hospitals and laboratories may also be regulated, as they are charging very high price of laboratory tests and treatment. She also advised that by making Argentina park the part of Poly Clinic the extension work of the hospital may be started immediately, as the present building is not sufficient to meet the requirements.

Senator Sughra Imam recommended that due consideration may be given to the public complaints about the difficulties, behaviour of staff and that of low quality medicines. She advised that people may be responded about their complaints. Senator Kamil Ali Agha enquired about the criteria of purchase of medicines and also about other hospital’s equipments. Senator Rubina Khalid recommended that medical representative of medicine companies may not be allowed to enter in the medical institutions. She also advised to improve the condition of Emergency Wards in the hospitals and sufficient budget may also be provided for the purchase of new equipments as well as for the replacement of old one.

Senator Talha Mehmood demanded that details of medicines bulk purchased during the last 03 fiscal years, names of medicine companies, names of contractors, total value of purchased medicines/equipments and detail of appointments made during last 2 years may be provided for further discussion. He also pointed out that there is a large number of corruption cases and use of expired medicine in these institutions, therefore, strict disciplinary action may be taken against the mafia involved in these activities. He was of the view that due to corruption and wrong decisions, funds are being misused and low quality medicines are being purchased. The Committee observed that a large number of officers have been working on the administrative posts for the last many years and they in collusion with the medicine companies have been perpetrating all this. The Committee unanimously recommended that purchase committees of both the PIMS and Poly Clinic may be dissolved immediately and new purchase committees be constituted comprising honest and upright officials/doctors.

Replying to the queries of the members of the Committee, Mr.Nazar Muhammad Gondal, Federal Minister for CAD and Secretary CAD informed that there are purchase Committees of each hospitals responsible for the purchase of all types of medicines and equipments. They informed that the medicines are purchased from registered medicine companies according to PPRA Rules through open tender. They assured that strict disciplinary action will be taken against the officials involved in any type of corruption. They further informed that medicines are registered by the Drug Control Authority which is under the control of Cabinet Division. The Honourable Minster agreed to the recommendations of the Committee and stated the same would be implemented.

Members of the Committee also raised their concern for the not proper functioning of following vertical health programmes under the Ministry due to which people are facing problems:

(i) Enhanced HIV AIDS Control Programme. (ii) Roll Back Malaria Programme.

64 (iii) National TB Malaria Programme. (iv) Prime Minister’s Programme for Prevention and Control of Hepatitis. (v) Strengthening National Tuberculosis Control Programme for Ensuring Uninterrupted Drug Supplies.

Mr. Nazar Muhammad Gondal and Secretary CAD informed the Committee that after 18th Amendment these programmes were handed over to the provinces, however all the provinces have requested that these subjects may be handed at Federal level. Besides the donor agencies have also refused to talk with provinces for the donations and about provision of vaccination as donor agencies feel better to deal the matters at center level than the provinces They however informed that presently the matter is with Ministry of IPC.

After detailed deliberation, the Committee unanimously recommended that:

1) All basic facilities may be provided to all upgraded schools in Islamabad Capital Territory.

2) Sanctioned strength of teachers may be provided to the upgraded schools as per their requirements.

3) Self-respect may be given to the teachers.

4) The control of Federal Board of Intermediate and Secondary Education (FBISE) may be handed over to CAD as all the federal institutions in Islamabad are interlinked.

5) Proposals for selection of curriculum of various classes may be prepared at Federal level.

6) Check and balance system be evolved for the regulation of affairs of private schools in Islamabad, regarding their curriculum, building position and pay structure of teachers etc.

7) Details about bulk purchase of medicines, name of medicine companies, name of contractors, total cost of prescribed medicines during last 3 fiscal years by PIMS, FGSH and NIRM may be provided for the information of the Committee.

8) Purchase Committees of the PIMS and Poly Clinic may be dissolved immediately and new purchase committees comprising honest officers and doctors may be constituted. Compliance report in this regard may be submitted to the Senate Secretariat within ten days.

9) All the officials/doctors (other than the specialists in their respective fields), who have been working on the same posts for more than 03 years in all the departments/wings of the PIMS and Poly Clinic may be replaced immediately.

65 Compliance report in this regard may be submitted to the Senate Secretariat at the earliest.

10) Argentine park may be made part of Poly Clinic as soon as possible.

11) New hospitals may also be constructed in the rural areas of Islamabad territory to reduce rush in FGSH and PIMS.

12) Reasonable increase may be made in the budgetary allocations for the health and education sector.

13) All possible steps may be taken for the eradication of corruption in hospitals.

14) Low quality medicines may not be purchased.

15) Check and balance system should be evolved to look after the affairs of medicine companies.

16) Tendency of visiting of medical representatives of the medicine companies to hospitals may be stopped.

17) Public complaints about the treatment and provision of medicines in the hospitals may be adhered to by giving proper reply to them.

18) CAD should also suggest proposals for regulating the affairs of private hospitals/laboratories as their charges are on very high side, as are not affordable by the common people.

19) A meeting of the Standing Committee will be held with PPRA Authorities and Drug Controlling Authority for the purchase of quality medicine in the hospitals.

20) Strict disciplinary action may be taken against officials involved in corruption in the hospitals.

21) The condition of emergency wards in the hospitals may be improved by providing necessary equipment/ medicines and by increasing number of staff.

22) Ministry of CAD in coordination with Ministry of IPC will prepare proposals/material for the settlement of the issues of following vertical health programmes for the next meeting of the Standing Committee.

The meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairmanship of Senator Mrs.Kalsoom Parveen on 9th July, 2012 in the Parliament House Islamabad.

The agenda before the Committee was as under:-

I. Detailed discussion on non-implementation of the directive of Senate Standing Committee on Cabinet Secretariat made in its meeting held on 23.05.2011 regarding promotion of certain officers of BS-17/ OMG to BS-18.

II. Detailed discussion on the proposed reforms by the FPSC regarding Section Officers Promotional Examination;

III. Details of officers working on contract/extensions after retirement in BS- 20/21/22;

IV. Detail of officers presently made OSD of BS-20/21/22;

The meeting started with the recitation of Holy Quran by Senator Abdul Haseeb Khan. After welcoming remarks, Senator Mrs.Kalsoom Parveen, Chairperson, Standing Committee stated that in spite of the fact that Standing Committee on Cabinet Secretariat in its meeting held on 23.05.2011 had recommended that the case of promotion of two officers may be processed on the analogy of the other officers also involved in the same case. Besides, a letter was also written on the above Standing Committee for the early consideration of the promotion cases, but no action was taken by the Establishment Division in this regard. She was of the view such type of hurdles created by the officers/officials who remain for indefinite period on one post therefore advised that strict disciplinary action may be taken against the officials who are not obeying the instructions of the Standing Committee. She also advised that meeting of the DPC may be convened for the early decision. Senator Saeeda Iqbal pointed out that as departmental committee has exonerated the concerned officers, therefore their case of promotion may also be considered as in the case of other officers who are involved in the case. Senator Abdul Haseeb Khan was of the view that due wattage should be given to the instructions/directions of the Committee, therefore instead of ignoring the recommendations of the Standing Committee case may be decided on parity basis.

Senator Kamil Ali Agha however was of the view that in care of corruption the strict disciplinary action may be taken by all concerned including who have been given promotion and extension etc. Giving the reply of the query/ observation of the members of the Standing Committee, Mr.Taimur A. Osman, Establishment Division informed the Committee that three DPCs have already been held in this regard and during the last meeting, the Committee had advised that copy of the Challan may be placed in the next meeting of the DPC. He showed

68 that decision in any case will be taken within 15 days. He also recommended that detail of allegation and basis on which the other involved persons were declared innocent may be furnished for the information of the Committee.

Coming on the Agenda item regarding the proposed reforms regarding conducting of Section officer promotional Examination, Mr. Munir Ahmed, Special Secretary Establishment Division informed that OMG Cadre was created in 1975 in which government servants in BS-11 to 16 having 8 years’ service are eligible for sitting in the Sectional Officer Promotional Examination in this examination is being taken by FPSC however Secretariat Training Institute has recommended there is need to make reforms in this regard as number of officials do not come up to mark. Therefore the delivery of government functionaries is deteriorating. He informed that education qualification is being increased from Matric to Graduation, the age limit is being decreased from 8 years to 5 years and IT, Economics, Pakistan Arithmetic and Statistics subjects are also being included in the question papers however Senator Mrs.Kalsoom Parveen, Chairperson pointed out that education standard for Balochistan and FATA is comparatively low than other parts of the country therefore special relaxation may be given to FATA and Balochistan. Senator Mrs.Kalsoom Parveen, Chairperson recommended that qualification for the people of Balochistan and FATA may be reduced from Graduation to Intermediate level. She also advised that special relaxation in the appointments may be given to the people and these areas as is being in Pakistan Army. Senator Saeeda Iqbal stated that is the previous practice that brining the people of backward area equal to developed area special preference is being given therefore the people of Balochistan and FATA may be given special relaxation in qualification, age, etc. Senator Haseeb Ahmed Khan also recommended that to reduce the sense of deprivation of people of Balochistan and FATA some positive steps are required to be taken. Senator Kamil Ali Agha pointed out that candidate should improve their efficiency and all departments should make similar policy in this regard. Senator Rubina Khalid stated that due to due to importance of IT in the world; it should remain the part of question papers. Senator Najma Hameed recommended that all recruitment and promotion may be made on merit.

Mr. Taimur A. Osman, Secretary Establishment Division informed the Committee that a meeting in this regard is being held in the Establishment Division on 20th of this month. He assured that possible steps will be taken to give special preference/ relaxation to the people of Balochistan and FATA.

The Committee advised that:

2) The qualification for this examination for Balochistan may be fixed intermediate.

3) The subjects of Arithmetic and Statistics may be excluded from the written tests as it has no relevancy with the service matters. The age limit for the candidate of Balochistan and FATA may be fixed three years subject to condition that they have served in FATA and Balochistan Secretariat for three years.

4) Minimum time for conducting this examination should be six months for proper preparations.

69 5) A special meeting may be convened by the Establishment Division as soon as possible for given special relaxation to the candidates of Balochistan and FATA.

All proceedings pointed out that Urdu is not giving preference in official proceedings which is violation of the Constitution. On the observations, the Committee advised that necessary steps may be taken for starting official business in Urdu language including conducting of tests, interviews of FPSC/Provincial Public Service Commissions, etc. and the candidates may be given choice for taking tests either in English language or Urdu language without disturbing the merit.

The Secretary Establishment Division gave detail of the officers who have been given extension after their retirement from government service. He informed that it is not extension in service but appointment is given on contract basis however the members of the committee expressing concern directed that no extension should be given as due to extension the promotion right of junior officers is suffered badly therefore there should be no extension at all because it is not being given on merit and there should be same criteria for giving the extension to any officer. Proper legislation should be made for not giving extension/contract without advertisement. Extension may only be given in case of rare technical expertise of retired officers. Detail of all the case who re-employed given extension may be provided to the Committee with reasons along-with their expertise.

Secretary Establishment Division gave detail of officers presently OSD in BS-20 to 22. He informed that presently 29 officers are working OSD in the service pool of Establishment Division. He informed that the number of officers increases/decreases from time to time as officers waiting for posting / on long leave also considered OSD. The Committee advised without unnecessary reasons, officers may be not made OSD. Their services may be utilized properly as they are receiving all perks and privileges. The Chair directed that complete list of narrated detail in each case may be furnished immediately.

II. Detailed discussion on the alleged sale of 2700 fake plots by the management of Interior Employees Co-Operative Society, as reported in the Daily’ Al-Sharq, dated 11th July, 2012. Comprehensive discussion on all the affairs of the society envisaging date of registration of the society, number of members of the society; date of approval of lay out plan of the society; number of plots allotted to the members; date of issuance of the NOC by CDA to the Society; alterations made by the society in the original lay out plan as approved by the CDA; annual audit reports of the society since its inception and complaints lodged by the members against the society management and action taken thereon.

III. Follow up of the recommendations of the Committee made in its meeting held on 25th June, 2012.

The meeting started with the recitation of Holy Quran by Senator Saeeda Iqbal. Senator Mrs.Kalsoom Parveen, Chairperson welcomed the participants of the meeting. However, she and all other members of the Committee expressed their concern for not attending the meeting of the DG, FIA and for late submission of working paper. The Committee, advised that DG, FIA should personally attend the next meeting and submission of working paper in time.

Mrs. Nargis Satti, Secretary Cabinet assured that in future working paper will be submitted 3 days before the sitting of the Committee. After that Chairperson advised FIA officials for briefing.

Mr. Ejaz Ahmed Khan, SHO FIA informed that FIA had initiated inquiry of this case on the information of its own sources and FIR was accordingly registered on 17.08.2011, as after proper investigation it came to the notice that as per award listed issued by CDA out of 7200 Awards about 1505 names were fake and it was also noticed came into the notice that the then Director Land issued fake letters from his house in connivance with some officials of CDA and Kurri Action Committee. He informed the Committee that some of the names included in the Award List have ID Cards from other parts of the country. He informed that FIA had recommended for action against officials of CDA for departmental action by CDA. He, however, informed that CDA officials are not cooperating rather are creating hurdles in the

71 finalization of the enquiry proceedings as some of the fake allottees are again being submitted to FIA by CDA. He assured that if the CDA extends its full cooperation FIA will finalize the enquiry proceeding within 3 weeks.

Mr. Khalid Mahmud Mirza, Member CDA also informed that during the departmental inquiry it was mentioned that it is a defective list as some major irregularities were noticed. He informed that Establishment Division suspended the Director involved in this case while CDA has suspended the services of Assistant Director found involved in the inquiry proceeding.

Having taken version of both the FIA and CDA the members of the Committee strongly criticizing the performance of the CDA in this case raised some questions.

Senator Kamil Ali Agha stated that on one side CDA has not taken departmental action against the officials involved in this scam and on the other hand the legal wing of the CDA has not persuaded the case in the courts and resultantly they have been granted bails. He was of the view that on the proper pursuing of the case in the court bails could had been rejected. Senator Sughra Imam pointing out some paragraphs of the findings of the Departmental Inquiry Committee there was no need to involve the FIA and CDA themselves would have rectified the Award list on their own and disciplinary proceedings should also be initiated against the involved officials. She also enquired as to why the ex-Chairman CDA gave statement in the court that no loss had been occurred to CDA.

Senator Mrs.Kalsoom Parveen, Chairperson criticizing the role of the CDA high ups pointed out that due to this type of corruption and inefficiency department is facing financial problems and is unable even to do the routine repair and maintenance work. She advised that in the next meeting of the Committee the contention of the CDA in the court about this case and detail of departmental action taken against all the 7 employees of the department may be provided. She was of the view that the lawyers on the CDA panel are not properly pursuing the case. She also advised that CDA should first verify all the applications received against the findings of the FIA before shifting to the Agency.

After discussion on the Kurri Model Village Scam the affairs of Interior Housing Society came under discussion. Senator Mrs.Kalsoom Parveen informed that there are media reports that there are some major irregularities in the affairs of the Interior Employees Housing Society and that society is involved in the sale of 2700 fake plots. She showed her concern that in spite of the fact that society was registered in 1984, but the members could not have allotted plot so far. She stated that society could not properly deliver even after 28 years of its registration. She also expressed her displeasure over the CDA and office of the Registrar for not properly supervising the affairs of the society.

Senator Kamil Ali Agha enquired about the total land of the society, mortgaged land, number of plots, detail of allotment made so far, total membership and total cost of the purchased land.

Senator Sughra Imam stressed on the need that District Administration and CDA should had been act upon as the recommendations of the previous Standing Committee.

72 Giving the detail about the society Malik Muhammad din, Registrar Cooperative Housing Society informed that society was registered in 1983 and the total land purchased by the society is 4371 kanals, out of which 3598 kanal is under the possession of the society. He informed that about 1973 kanals have been purchased outside the society area. He also gave detail about the position of the management of the society from 1984 to till date.

Director Planning CDA informed that the society applied for lay out plan on a piece of land about 1600 kanals in 2005 for 1279 different size of plots. He informed that NOC was issued to society on 07.10.2010.

Mr. Asif Nawaz, President and Mr. M. Ibrahim, Secretary General of the society informed that some news reports has contradicted its previous news item regarding fake allotment of 2700 plots. They informed that the elected body of the society is trying to settle all the difficulties being faced by the society regarding change of land in the society area and allotment of plots to the remaining members.

Mr. Amer Ali, Deputy Commissioner, Islamabad informed that there is ban on new registration of societies and also on starting of 2nd phase of societies till the completion of phase one of the society. He also informed that the powers of Administrator have been restrained, as he cannot buy land and cannot make expenditure beyond the limit of Rs.1000/- He also informed the Committee that no member is entitled for the plot until and unless, he does not deposit the cost of the land.

Mr. Shahidullah Baig, Additional Secretary Cabinet informed that there is lack of coordination between the CDA and the office of the Registrar as some affairs of the society are being looked after by the CDA and some that of Registrar Cooperative Housing Society are being looked after by the CDA and some that of Registrar Cooperative Housing Society, which is functioning under the Ministry of Interior. He was of the view that after the issuance of NOC in the period of one year the society should deliver to the members and in case of failure CDA should cancel the NOC.

After detailed deliberation on the issue, the Committee advised that following information may be provided to the Committee.

i) Detail of previous managements of the society alongwith detail of their assets.

ii) Detail of total land purchased alongwith cost and land purchased outside the society area by the previous management till 2008.

iii) Detail of total membership made from time o time from 1984 to 2008.

iv) Detail of all assets of the society e.g Land +deposit.

v) Detail of land reserved for civic amenities including school, hospital, park, mosque, and graveyard etc.

vi) Detail of complaints against present management.

73 vii) Detail of revenue generated.

The Committee also advised that:

i) The society will not make any sale/purchase outside scheme report of the Committee.

ii) All scattered land must be exchanged in the scheme area of the society.

iii) Members may be given preference in the allotment of the pots if they have paid the cost charges of the land.

iv) If any society does not show its performance the registration of such society should be cancelled.

v) Government should take steps to finish the overlapping between the government departments in the affairs of the society.

vi) Land of Interior Society acquired by CDA, should taken up with CDA quickly.

During the discussion it also came to the notice that in the areas of Park Enclave scheme CDA has given about 600 kanals land to Bahria Town for road. The Committee members enquired of CDA officials about the terms and conditions of the agreement and cost if this deal, but no one replied stating that they were unaware about the detail of terms and conditions.

The Members expressed their great concern on the giving of land to Bahria Town without cost and on the unawareness of the officials of CDA.

The Committee therefore advised that detail of all terms and conditions with for giving the CDA land to Bahria Town may be provided at the earliest and names of the officials who made this agreement may also be intimated to the society.

After detailed deliberation, the Committee unanimously recommended that:

i) FIA will finalize its inquiry report within 3 weeks.

ii) CDA will extend its full cooperation to the FIA for the conclusion of its report.

iii) Before submitting the observations on the 1505 fake allottees as pointed out by FIA, CDA will verify these complaints at its own in the first instance.

iv) Till the conclusion of the findings of the FIA, no commercial allotment including Kohkaz etc will be made by the CDA officials.

v) Detail of action taken against all the involved persons by the CDA at its own and present position of the case in the court may also be provided for the information of the Committee.

74 Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT

The meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairmanship of Senator Mrs.Kalsoom Parveen on 26th July, 2012 in the Parliament House Islamabad.

The agenda before the Committee was as under:-

I. Detailed discussion on the working and performance of Pakistan Telecommunication Authority.

II. Detailed discussion on criterion for appointment of a member and Chairman of the Authority.

The meeting started with the recitation of the Holy Quran by Senator Abdul Haseeb Ahmed Khan. After welcoming the members of the Committee and officials of Cabinet Division and PTA, Senator Mrs.Kalsoom Parveen, Chairman Standing Committee expressed her deep concern over the non-appointment of Chairman PTA even one week after the retirement of Ex-Chairman. The summary for the appointment must had been moved one month before the expiry of the ex-Chairman’s tenure. She enquired about the procedure of the appointment of Chairman PTA and role of the CCI in increasing of the number of members of the PTA Board.

Mr. Shahid Ullah Baig, Additional Secretary Cabinet Division informed that under the Act the appointment of the Chairman PTA, appointment is made from amongst the members of the PTA Board. A summary in this regard containing 3 names is submitted for the final approval of the Prime Minister who gives the approval according to his discretion. Mr.Shahid Ullah Baig, Additional Secretary Cabinet informed that there is also a proposal under consideration to increase the number of the members of the PTA Board. He further informed that according to act of PTA, number of members can be increased without any approval of CCI and Prime Minister.

Senator Abdul Haseeb Khan enquired about the prescribed qualification for the appointment to the post of members and Chairman. Senator Saeeda Iqbal and Rubina Khalid pointed out that normally all the facts and figures are not mentioned in the summary, which are submitted to the Prime Minister and President resultantly political Govt. suffer the consequences of the incorrect information mentioned in these summaries. Senator Kalsoom Parveen further advised that summary for the appointment as Chairman PTA should have been submitted well before time to avoid undue delay as PM has too many other official engagements. After lengthy discussion on this issue, the Committee directed that:

i) In future summary for appointment to the post of Chairman/members may be submitted well before the retirement of the existing incumbents.

ii) Provincial quota may be reserved in the appointment of the members of the PTA Board.

75 iii) Full criteria including education qualification of the members of the Board may be given to the Committee.

iv) Appointment to the post of Chairman PTA may be made immediately without any further delay.

Coming on the agenda item on the working and performance of Pakistan Telecom Authority, Mr. Khawar Siddique Khokhar, Member (Technical), PTA informed that Ministry of Information Technology issues policy and PTA regulates this policy. He informed that main functions of the PTA are to regulate telecom sector, recommendation to the government on policy formulation, creation of fair competition, consumer protection, modernization and receiving depositing applications for radio spectrum. He informed the Committee that PTA is an autonomous body and functioning independently and not answerable to any department and is free to implement the government policy, however appeals against the decision of the Authority can be lodged in the High Courts.

Mr. Shahid Ullah Baig, Additional Secretary Cabinet also informed that PTA has full financial autonomy and is fully competent to make all decisions regarding discharging of its functions through PTA’s own board of governors. DG(Finance), PTA informed that PTA has earned about Rs.30 billions during the last five years, however 90% share of this amount was given to Universal Service Fund (USF) for the improvement of telecom sector (which is under the control of Ministry of Information Technology).

After the briefing by the officials of PTA, the members of the Committee raised many questions/queries about the working and performance of PTA.

Senator Mrs.Kalsoom Parveen inquired about the procedure and criteria for issuance of licenses to various telecom companies, as she informed that it is in his personal notice that one member of the board of governors of PTA issued two licenses at its own. She also stated that funds of Universal Service Fund (USF) are only for the use for the development of basic infrastructure in the rural area, but no progress has been made in this regard so far, as out of 36 districts of Balochistan only 11 districts have been provided with telecom facility. She advised that the detail of court cases of PTA may be provided as in her view the law department of the PTA is not properly pursuing the cases in the courts.

Senator Rubina Khalid also inquired about the basic criteria for issuance of licenses. Senators Mrs.Kalsoom Parveen and Rubina Khalid raised serious objections on the late night packages of various telecom companies. Both the ladies Senators were of the view that the young generation is being morally destroyed through these long and cheaper packages, therefore PTA should re-visit of these policies of telecom companies and should make policy for the charging of higher rates on these packages. Similarly both the honourable members also pointed out that some of the mobile companies are giving immoral publicity in the electronic media, therefore PMRA should also take action in this regard.

Mr. Khawar Siddique Khokhar, Member (Technical) PTA replying the queries/ objections of the members of the Committee informed that licenses are issued through open international auction tenders. He informed that in 2004 each M/s Telenor and Warid was given

76 licenses after fulfilling all the criteria on the bid of 291 millions dollars. He stated that there were about 800 pending cases in the various courts however out of these 80% have been decided in favour of the PTA. As regards the affairs of USF, he informed that it is functioning under the administrative control of Ministry of Information Technology therefore PTA is not aware of about the performance of USF. Regarding the late night packages and immoral advertisement in the electronic media, he stated that at the present there are no proper rules for giving direction to the telecom companies on this issue; however PEMRA Authority will be contacted about the immoral advertisement in the electronic media.

Members of the Committee expressed their concern on the negligence of PTA and over-lapping of two departments i.e. PTA and Ministry of IT on the regulation of telecom sector, as Ministry of IT issues policies and PTA implements these policies and similarly PTA is generating funds and giving these funds to Universal Service Funds (USF) which is not under the control of PTA, therefore PT A is totally unaware about the use of these funds by the USF.

After detailed deliberations, the Committee recommended that:

i) Moral values of the country may be kept in mind by the telecom companies while making advertisement in the electronic media.

ii) Proper supervision may be made on the late night packages by increasing the rate of these packages.

iii) Detail of extension programmes of USF in telecom sector may be provided for the information of the Committee.

iv) Speedy disposal of the cases of PTA pending in various courts should be ensured.

v) Over-lapping of departments of policy making and its implementation may be furnished.

vi) Top priority may be given in the protection of consumer rights.

Discussing on the issue of 3 G policy, Member PTA informed that Ministry of IT approved this policy in December 2011 and tenders in this regard was floated also in international media. PTA had hired the services of international reputed consultant, however Auction Supervisory Committee, which is being represented by the various Ministries/Divisions have raised some objections on procedure adopted by the PTA, therefore a new tender is required in this regard. The members of the Committee expressing their displeasure stated that due to auction of 3 G technology we can earn a big amount of foreign exchange, which can improve the financial condition of the country therefore delay in this regard is a big loss to the country.

The Committee therefore decided that a meeting in this regard to discuss the issue of 3 G policy will be held shortly and Auction Supervisory Committee may also be advised to attend the meeting for making decision in this regard as soon as possible.

The meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairmanship of Senator Mrs.Kalsoom Parveen on 31st July, 2012 in the Parliament House Islamabad.

The agenda before the Committee was as under:-

I. Discussion on the terms and conditions under which CDA granted permission to Bahria Town for the construction of road from Kurri Model Village to Bahria Enclave, Islamabad.

II. Detailed discussion on state of development in Park Enclave project Islamabad.

The meeting started with the recitation of Holy Quran by Mr.Amer Ali, Deputy Commissioner, Islamabad. Senator Mrs. Kalsoom Parveen after welcoming the members of the Committee and officials of various departments advised Deputy Commissioner Islamabad for briefing about the affairs of Government officers Cooperative Framing Society Ltd., Islamabad.

Mr.Amer Ali, Deputy Commissioner, Islamabad informed that society was registered in 1990 and the total membership of society is 44. He informed that society has purchased 530 kanals for plots measuring of 10 and 20 kanals, cost of the land was 4,60,000 for 10 kanals plot and Rs.9,20,000 for 20 kanals plot and Rs.2,00,000 as development charges. However due to non-deposit of development charges by the members in time and scattered land the society could not developed worth mentioning. He informed that Administrator of the society could not be appointed as under the revised laws administrator has no power to incur the amount more than 20,000/- per month.

Senator Mrs.Kalsoom Parveen expressed her concern over the state of affairs of the society, as after laps of about 22 years the society could not come in true shape. The Committee therefore advised that the election of the society may be held as soon as possible and the Committee will over see the election process, therefore there is no need of appointment of an administrator. If an administrator has been appointed his appointment should be cancelled immediately. The Deputy Commissioner agreed and assured the Committee that complete direction will be implemented in letter and spirit after Eid.

After that the issue of granting of permission by CDA to Bahria Town for the constriction of road in Park Enclave came under discussion.

Mr. Farkhand Iqbal, Chairman CDA and DG Planning informed the Committee that although CDA has granted permission for construction of Jinnah Avenue from main Kurri

78 Road to Kurri Model Village yet the road would be the property of CDA also with the possession of right of way of the road and the M/s Bahria Town will have no exclusive right, but it will remain public thoroughfare. Chairman CDA further informed that CDA has to construct this road, through its own sources, however Bahria Town has been allowed to construct this road as they have agreed to construct this thoroughfare at their own. Senator Sughra Imam inquired that whether it is property of government or that of a private party. She was of the view that by granting permission to Bahria Town for the construction of road more benefits have been given to Bahria Town. Senator Najma Hameed also was of similar views.

Senator Dr. Saeeda Iqbal was of the view that performance of CDA is deteriorating day by day and stated that CDA would take years to construct this road. She also stated that allottees of Bahria Town should also be given facilities like people of other housing projects. She informed that there is no bar on starting project in cooperation with private investors.

Senator Mrs.Kalsoom Parveen Chairperson Standing Committee inquired about the cost of construction of road and if CDA had constructed this road through its own resources then Bahria Town could use this road or not. She also asked whether allotment of any piece of land has been made to Bahria Town.

Mr. Ihsan, G.M Planning, Bahria Town informed that Bahria Town will spend about Rs.500 million on the construction of road. Mr. Ghulam Sarwar Sindhu informed that no land in this regard has been allotted to Bahria Town and CDA cannot stop any one to use this road, as it is general thoroughfare approved in the CDA Master Plan. The Chairperson observed that as per brief of the CDA, no irregularities found in granting permission of construction of Two Link Roads to M/S Bahria Town ( Pvt) Ltd. The permission has been granted after fulfilling all the pre requisites. These roads will not benefit only to the residents of Bahria Enclave but will also provide access to the surrounding inhabitants and also to the inhabitants of Kurri Model Village and Kurri Agro Farming Housing Scheme. She appreciated the help of M/s Bahria Town to CDA for construction of road from their own resources, which will help CDA and public at large. She appreciated the performance of Bahria Town for providing the basic facilities to the people and directed that the Committee would pay a visit to the site of road and Bahria Enclave after Eid.

The Committee advised that not any piece of land may be allotted to any private investor; however investment can be obtained on the basis of private-public partnership basis.

Mr. Ghulam Sarwar Sindhu, DG Planning informed that there are 696 plots in the Park Enclave housing project, out of which 643 are of 500 yards, while 54 are of 1000 yards and the development work has been started, which will be completed in a period of one year. Chairman CDA informed that balloting of plots has already been held and boundary wall is being constructed around the housing scheme.

The Committee advised that development work may be completed in the stipulated time, which will restore the confidence of the people on CDA.

The meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairmanship of Senator Mrs.Kalsoom Parveen on 7th September, 2012 in the Parliament House Islamabad.

The agenda before the Committee was as under:-

I. Adoption of alleged non-transparent policy for auction of commercial plots in F-9 and G-9 Sector, Islamabad.

II. Briefing on the alleged non-observance of transparency in the draw of plots in the Park Enclave.

After recitation from the Holy Quran, Senator Mrs.Kalsoom Parveen, Chairperson Standing Committee welcomed the participants of the meeting. At the outset, she expressed her great concern over the non-implementation on the recommendations of the Standing Committee made about Office Cooperative Farming Society. She advised DC, Islamabad to brief in this regard.

Mr. Amer Ali Ahmed, DC, Islamabad informed that he had issued instructions to the Registrar Circle Islamabad for taking the control of the affairs of the society; however Circle Registrar Islamabad has informed that the management of the society has taken stay order from a Civil Court in this regard. Malik Din Muhammad, Circle Registrar informed the Committee that when he went to the office of the society for taking the charge of the affairs of the society, the administrator showed stay order obtained from a Civil Court, however he will try his best for the vacation of the stay order.

All the members expressed displeasure for not proper pursuing the case by the legal wing of the ICT in the Court. The Committee advised that affairs of the society may be taken under control within a week and immediate steps may also be taken for the vacation of the stay order. The Committee also made following recommendation in this regard.

(i) The Circle Registrar should inform the general public through media not to make any deal with the society till the finalization of the issue.

(ii) The Accounts of the society may be frozen immediately.

(iii) The present management of the society can not make sale/ purchase.

(iv) No development work can be started by the present management.

80 After that Chairperson advised the Chairman CDA for briefing on a news item appeared in electronic / print media regarding alleged corruption of billion of rupees in the process of auction of commercial plots in Sector F-9 and G-9.

Mr. Khalid Mahmud Mirza, Member (Estate) informed that 12 commercial plots of measuring 1333.33 sq. yards are located in Sector F-9 and G-9 and the main purpose was to generate the revenue for various development projects of the CDA. He informed that an advertisement for the pre-qualification was given in the press on 12th July, 2012, but only 6 parties shoed their interest, however due to poor response another advertisement was made in the press and in reply 16 parties showed their interest. A sub-committee of the Auction Committee of the CDA recommended that out of 16 applicants only 10 parties fulfill the requisite condition for the pre-qualification, therefore, for healthy competition the Committee suggested following 3 options: (i) As the number of plots 912) is more than the pre-qualified bidders (10) hence no bidding can be held through pre-qualified bidders in this case owing to lack of competition. So the authority may opt for open auction to fetch more benefit for the authority and to ensure transparency. OR (ii) The authority may reduce the number of plots up to 4 in one stretch and re- advertise the same in the press. OR (iii) The report of the evaluation committee may be placed before the CDA Board for further guidance and decision.

He further informed that in the meanwhile a TV Channel aired a programme about alleged corruption in the process of the auction of the commercial plots, resultantly Prime Minister of Pakistan took the notice and for the time being stopped for further action in the matter.

Mr.Shahidullah Baig, Additional Secretary, Cabinet Division also informed that on the news item in the media, Prime Minister took the notice for submission of report on this issue, who has submitted the report to the Prime Minister of Pakistan.

The Members of the Committee expressed their personal experiences about the bad governance and cases of corruption in CDA. They were of the view that CDA should take immediate steps to stop the perception of corruption in the Authority. Senator Mrs.Kalsoom Parveen, Chairperson stated that there is corruption in most of the section of the CDA, and Chairman CDA should therefore look into it. She assured that Committee will extend its support to CDA in its all good work, but will also point out on its wrong doings.

Senator Talha Mehmood pointed out that track record of CDA is not so good, as number of cases of corruption and bad governance have already been pointed out, through media and as well as all in to his personal notice and there are also several examples of work done against the decisions of CDA Board. He suggested that to avoid of litigation, CDA should also give possession of plots on the receipt of 100% payment like private dealings and CDA should also generate revenues resources except that of selling of plots only. He suggested that CDA

81 should impose tax on all commercial business like private schools, marriage halls, guest houses and hotel & restaurants operating in residential areas.

Senator Rubina Khalid recommended that financially strong parties should be approved for pre-qualification of bidding etc. and plots should be given to highest bidding party through open auction. Senator Kamil Ali Agha also recommended that for taking more prices of the CDA land the plots should be sold through open auction rather than on the condition of pre- qualification.

Senator Sughra Imam inquired that, whether in accordance with PPRA rules commercial plots can only be sold through the condition of prequalification. In response, Additional Secretary Cabinet Division informed that there is no condition of PPRA rules on the size of the plots for open auction. Mr. Farkhand Iqbal, Chairman CDA informed that the size of residential area in Islamabad has been expanded, but the commercial area is still limited up to Blue Area only, therefore CDA had planned to generate funds for development purpose, however as usual some quarters are creating undue hurdles in this regard.

After lengthy discussion, the Committee gave following guide lines for future line of action: (i) All commercial plots may be sold through open auction. (ii) To avoid future unexpected hurdles/court cases payment schedule may be issued to the successful bidders and possession of the plots may be given on the receipt of at least 50% payment. (iii) CDA should also suggest other means except that of only selling of land for revenue generation. (iv) CDA will provide the detail of all commercial business schools, marriage Halls, Hotels & Restaurants and Guest Houses etc. functioning in the residential plots. Coming on agenda item regarding balloting in Park Enclave, all the members expressed their concern on a news item that all good plots have been given through balloting to some politicians, bureaucrats, judges and journalists, etc, while poor people have been given plots on normal places. The Committee therefore advised Chairman CDA to provide following detail:

i) Total number of plots in the scheme.

ii) No. of good plots including corner plots.

iii) Total number and name of good plots given influential segments of the society.

iv) Opinion of computer experts on the balloting process.

v) An exclusive meeting of the Standing Committee will be held to discuss only the agenda item of ways and means of revenue generation by the CDA for the development of various projects in Islamabad other than the selling of land.

82 After detailed discussion on the agenda items, on a point raised by Senator Dr. Saeeda Iqbal, the Committee advised that allottees of E-12 and G-14 may be given possession of their plots as soon as possible as they have already deposited the full cost of their plots. The Committee also advised that dues of remaining affectees of New City Project may be given urgently. The Committee strongly directed that the early solution may be sought out for giving the right of way as pointed out by Senator Rubina Khalid

83 Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT.

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 11th September, 2012 in the Parliament House Islamabad.

The agenda before the Committee was as under:-

I. Detailed discussion on the affairs of Police Foundation with particular reference to registration of Foundation, number of members of Foundation, number of allottees of Foundation, land purchased by the Foundation, land purchased by the Foundation without affiliation, land purchased without possession, number of complaints against the Foundation, number of members who have not been allotted plots so far and reasons thereof.

II. Detailed discussion on the policy of CDA for conversion of categories of plots i.e. residential into the commercial, marriage halls into multi-stories flats & hotels and number of plots converted in these categories so far.

III. Detailed discussion on the proposed construction of a power house in Islamabad by the CDA.

The meeting started with the recitation from the Holy Quran. Senator Mrs.Kasloom Parveen, Chairman Standing Committee welcomed the participants. She expressed displeasure over the stance of the management of Police foundation that being a charitable organization the affairs of the foundation cannot be discussed in the Committee meeting. All other members also endorsed the view point of Chairperson. They were of the view that all the issues including the approval of lay out plan etc are approved by the CDA, hence the Committee can discuss the affairs of all departments/bodies being controlled by the CDA. They were of the opinion that no one can be allowed to act as a state within the state.

Besides, the Committee members were also not satisfied on the way the Director (Housing), Police Foundation, briefed the Committee without the requisite information. The Committee also expressed its concern that instead of MD, Police Foundation, presentation was being given at lower level.

The Committee showing its displeasure over the issues of Police Foundation advised that the following affairs of the Police Foundation will be discussed in the Committee and presentation of the Foundation will be made by the MD/President/Secretary General, of the Police Foundation:

84 (i) Original charter.

(ii) Original / altered lay out plan.

(iii) List of original members.

(iv) List of present membership.’

(v) Total land purchased.

(vi) Total amount received/disbursed so far.

(vii) No of Plots allotted so far.

(viii) No. of persons who have not been allotted plots so far and reasons thereof.

(ix) Name of allotment authority of all allotted plots.

(x) No. of plots allotted to martyred/ widows/ orphan without cost.

(xi) Allotment and sale of plots despite cancellation of LOP/NONC of Police Foundation by the CDA.

The Chairman CDA informed the Committee that due to energy crisis all over the country, the domestic as well as industrial consumers are facing problems, therefore, the CDA has planned to construct a Power House to cater the energy needs of the district of Islamabad. He informed the Committee that the present requirements of Islamabad are 63 MWs however CDA is planning to construct Power House of 100MWs capacity. After the completion of the said project Islamabad will be a load shedding free zone, and it will be a role model for the rest of the municipalities of the country. Giving detail of present position of the proposed project, he informed that it will be run through Chakwal Coal and the services of consultant are being hired for the project. The Committee appreciated the idea of the CDA to construct power house of its own without taking financial assistance from the government. The Committee further advised that similar steps may also be taken for all the municipal corporations’ municipalities etc which will help to fulfill the requirement of electricity and it will reduce load shedding.

Regarding the non issuance of allotment letters to the affectees of Bahkanm Syedan, who have been denied of their right to get plots, in compensation of their land, as per CDA policy, since 1985. The Chairperson said that the affectees had tendered an application and the matter was discussed in the meeting of the Sub Committee of Senate Functional Committee on Government Assurances. The Sub Committee directed the CDA to hold negotiations with the affectees and further take up the matter in the Senate Standing Committee on Cabinet. Senator Rubina Khalid and Senator Saeeda Iqbal advised for the early disposal of the case, as they are genuine affectees. Sentor Robina Khalid further observed that it is a great injustice as even after lapse of two decades, they are being deprived of their genuine right. The Chairman, CDA informed that negotiations were held with the affectees in his office. He further said that he had constituted a Committee comprising Ghulam Sarwar Sindhu (DG), Director Land, CDA and

85 Director Staff to the Chairman, which will finalise the matter within a week. The Chairman assured the Committee that the matter will be resolved in the light of recommendations of the Committee. Coming on agenda item regarding policy of CDA for conversion of residential plots into commercial area. Mr. Ghulam Sarwar Sindhu, Director General, CDA informed that it is not general policy of the CDA to give permission for the conversion of residential into commercial zone, however, in some cases after the approval of the CDA Board some plots have been converted for commercial purpose. The members of the Committee however did not agree with the statement of Mr.Sindhu. The Committee informed that there are several cases of conversion of residential area into hotel/restaurant, guest houses and beauty parlor etc. They were also of the view that CDA has failed to implement its own bye-laws in this regard. The Committee advised that the administration of CDA should take stern action to stop the starting of commercial business into residential plots. Senator Rubina Khalid advised that CDA should take action according to a saying that “to nip the evil in the bud. Senator Mushahid Ullah advised for the identification of case by the CDA in this regard, and proposals to come up on these weaknesses of the department as full detail was not available in this regard. The Committee advised that in the next meeting of the Committee Enforcement Wing of CDA, Building Control Department and Legal Wing of CDA will brief the Committee Sector-wise in this regard.

(i) The Committee advised that affectees of Bahkan Syedan may be given plots as early as possible as per commitment of the Chairman, CDA and allotment letters be issued to them.

(ii) The Committee advised that detail of use of Conventional Center, Chines Cultural Center and Arts & Craft may be provided.

(iii) The Committee advised that CDA should prepare proposal on the establishment of its own Police Station which may help CDA in illegal occupation and encroachment on CDA land.

(iv) The Committee also directed that the detail of foreign funding to NIH and progress of research work of NIH may also be provided to the Committee.

(v) The Committee also advised CDA officials to remove the un-necessary wall chalking and posture at the public places within 10 days.

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 2nd October, 2012 in the Parliament House Islamabad.

The agenda before the Committee was as under:-

(i) Action taken on the recommendations of the Standing Committee made in its meeting held on 13th August, 2012 regarding implementation of 3G Technology.

(ii) Detailed discussion on various projects executed/ being executed by the USF including Mastung Development Project with particular reference to the procedure adopted for award of contract/ bidding of the project; observance of PPRA rules in bidding of the project; total cost of the project; payments released/ being released and audit report of the said project and all other projects executed/ being executed through USF

(iii) Detailed discussion on the organizational hierarchy of USF with particular reference to its planning , executing and monitoring wings

(iv) Detailed discussion on the performance of the legal department of the PTA during the last four years.

The meeting commenced with recitation from the Holy Quran. The Chairperson, at the outset, expressed her grave concern over late delivery of the working paper, by the PTA and USF, and directed the Chairman, PTA to ensure timely delivery of the same in the next meetings of the Committee. Mr. Farooq Awan, Chairman PTA ensured the compliance of the directions of the Chair in future.

In her augural remarks, the Chairperson stated that delay in the auction of 3 G Technology was detrimental to the national interest as the said auction would prop and boost up the country's economy. She lamented over inordinate delay in finalization of the auction process. She was also apprehensive of interest shown by certain Indian Companies to offer consultancy services, as appointment of an Indian Consultant would undermine the country's strategic interests. Mr. Farooq Awan, Chairman, PTA apprised that originally, the auction process had to be finalized in January,2012 but it got delayed due to controversy between ASC and PTA over appointment of the consultant which derailed the whole process. But now PTA was working on war- footing to conclude the auction process at the earliest. Sharing the progress, made so far, in the matter, he stated that advertisement for hiring services of a consultant had

87 been floated in the leading national and international journals. A considerable number of companies of international repute had shown interest and applications were being scrutinized and evaluated. He assured that consultant would be appointed by 15th October, 2012. The Chair directed that there would be no further slackness in the matter. The Chairman, PTA ensured that the auction would be finalized by 31st December, 2012.As far as the appointment of Indian consultant he informed that it would be done after getting security clearance.

Senator Kamil Ali Agha showed his reservations over appointment of the ASC. He brought in question both the role and legality of that committee. He severely criticised the inclusion of ministers for Water and Power and Petroleum, in the ASC and asked as to what was their relevance to the matter. Replying to the queries of the worthy senator the Chairman, PTA stated that the ASC had been appointed by the Honourable Prime Minister and purpose of the said committee is to supervise the auction process however, all technical matters would be finalized by technical committee, headed by the Member; Technical PTA. Senator Kamil Ali Agha stated that irrelevant ministers would be replaced by the professional persons in the ASC. The Committee unanimously endorsed his view point and the Chair recommended that only relevant persons would have been part of the supervisory committee.

Replying to a query, raised by Senator Saif Ullah Magsi, the Chairman PTA informed that 800-900 million dollars was the expected revenue from this auction. Many factors would be considered for base price determination. The government would also have the power to cancel the bid if expected revenue was not fetched. The Secretary, IT submitted that the price paid by a bidder would ultimately be received from the subscribers and this factor would have to be kept in consideration while determining base price. Senators Kamil Ali Agha and Saif Ullah Magsi severely opposed this suggestion and stated that under such pretext the base price would not be lowered. The Chairman, PTA assured that merit and transparency will fully be observed in the process.

Mr. Ali Asghar, DG, Law, informed the Committee that primarily, the Law Department performs the following functions:-

1. Assists and advises the authority in the matters requiring legal opinion. 2. Provides legal support to all divisions of PTA as well Zonal Offices. 3. Formulates and drafts and notifies regulations. 4. Evaluates proposed bills and rules. 5. Handles litigation in various courts of law and prepares para-wise comments.

He threw light on the performance of law department during the last four years highlighted the following:-

(a) Regulations drafted and notified. (b) Legal opinions and comments given by the law department. (c) 3 G related prepatory work including drafting of information memorandum, contract for consultant and rfp.

88 As far as court cases were concerned, he informed that during the last four years out of 689 cases 476 cases have been disposed off.

The Committee showed serious reservations and concern over the performance of the law department as the Law and Enforcement Departments of the Authority had miserably failed to safeguard the rights and interests of the consumers due to oblivion, slackness, and above all, connivance with the mobile companies. The Chairperson pointed that two cellular companies had allegedly been issued licenses without fulfilling all pre requisites as, the then Chairman issued licenses, on his own, without obtaining concurrence/approval of other members of the authority which was in contravention with the regulations of the Authority. The Chairman, PTA assured that original files on which approval for issuance of licenses was given, would be made available to the Senate Secretariat for the perusal of the Chairperson.

The Chairperson asked the D.G as to how many show cause notices had been served upon all cellular companies during the last four years. The DG law informed that about 700 show cause notices had been given to the companies during the period asked for. The figures given by the DG, were not very convincing and impressive, Senator Rubina Khalid remarked. There were flagrant violations on the part of the companies and the Authority had failed to take any effective step to stop the same, she further added. What steps had been taken to regulate night packages, obnoxious and fraudulent messages and all other illegal activities, she asked. The DG Commercial Affairs informed that one month time- limit had been given to the companies to regulate and control the night packages, which would expire on 11th October, 2012. After expiration of the deadline and receipt of the response of the companies, the Authority would devise strategy in this regard.

Senator Kamil Ali Agha concurred with the Honourable Senator and asked as to how many notices had been served upon various companies during the last one month. The DG Law could not respond satisfactorily. What was mechanism in place to register a complaint. The DG informed that a Complaint Cell was working in the Authority to entertain the complaints of the subscribers. Even members of Standing Committee were ignorant of existence of such cell how come a lay man would know the same Senator Rubina Khalid observed. The DG apprised that advertisements were floated, on regular basis, in the national newspapers. Senator Rubina Khalid advised that advertisements would be made in the electronic media and cellular companies would be asked to bear the cost. The Committee unanimously recommended that a proper mechanism be installed to rectify all the flaws pointed out by the Committee.

Senator Kamil Agha asked about the procedure of hiring the services of lawyers by the Authority. The DG law informed that the Authority, on annual basis, hired services of law firms through prequalification. The worthy Senator objected to enrolment of law firms and advised that lawyers would be hired by the Authority through open competition instead of law firms, to pursue the cases in various cases. The Chairman, PTA ensured that all recommendations of the Committee would be complied with and a report in this regard would be submitted to the Committee.

Senator Mushahid Ullah Khan asked about re-instatement of Member Finance, PTA despite the fact that an inquiry was pending against him and had been facing serious

89 charges therefore his reinstatement would affect proceedings of the inquiry. Responding to the query, the Chairman PTA informed that the Member was reinstated on the directive of the Honourable Prime Minister. The worthy senator astonished as to how a person against whom an inquiry was pending with FPSC, could be reinstated. He asked the chair to consult FPSC and Establishment Division in this regard. The member Finance PTA Mr. Nasrul Karim Ghazanvi stated that inquiry had been pending against him since the last two years. Senator Mushahid Ullah Khan refuted his arguments. The Committee unanimously recommended that Establishment Division would be approached to clarify rule position regarding reinstatement of a civil servant against whom a case was pending. The Committee further directed that Establishment Secretary be asked to furnish a copy of the summary submitted to the prime minister for reinstatement of the member finance. The Chair also asked the Chairman PTA to submit a copy of the charge sheet framed against the member. The Chair also directed to invite the Chairman/ Secretary, FPSC and Secretary, Establishment in the next meeting of Committee.

Senator Mushahid Ullah Khan stated that his reinstatement on the same post would seriously affect the proceedings of the inquiry as he was custodian of the record. All witnesses were his subordinates and he was their reporting officer. The Committee unanimously recommended that till the finalization of inquiry Mr. Nasrul Karim Ghazanvi be removed from the post of member Finance.

The Chairperson then invited the CEO USF to brief the Committee on the Mastung Development Project. The CEO gave a detailed briefing to the Committee envisaging the selection of an area for starting a Project, Planning, Monitoring and execution of a Project. He stated that basic purpose of the USF is to cater to the needs of the unserved and under served areas of the Country.

Regarding the Mastung Development Project the CEO stated that all formalities were observed for award of contract. However, the Committee unanimously refuted the facts submitted by the CEO. Senator Saif Ullah Magsi stated that hailing from Mustung, he knew the area very well and at least he was not in a position to endorse the details being given by the USF. The Chair directed to invite the PTCL and the Contractor of the Project to the next meeting of the Committee. The Chair further directed not to release any payment to the Contractor until the next meeting of the Committee, which would be held alongwith Governor Balochistan at Governor House, Quetta.

Senator Rubina Khalid inquired of the Projects executed/ being executed in the Province of KPK, FATA and asked the CEO to submit detailed information in this regard at the earliest

The Committee unanimously recommended as under:

(i) The PTA may devise a strategy to stop fraudulent, obscene messaging and to regulate night packages.

(ii) A proper complaint cell be installed and the same be advertised widely in electronic media.

90 (iii) Law Department may hire services of lawyers instead Law firms.

(iv) Mr. Nasrul Karim Ghazanvi be removed from the post of Member Finance till finalization of inquiry against him.

(v) Secretary Establishment may submit a copy of summary submitted to the Honourable Prime Minister for re-instatement of Member Finance PTA and to clarify rule position regarding reinstatement of a civil servant against whom an inquiry is pending.

(vi) USF may not release any payment/funds to the contractor of Mustung Development Project until next meeting of the Committee at Governor House, Quetta.

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 16th October, 2012 at National Institute of Health, Chak Shahzad, Islamabad.

The agenda before the Committee was as under:-

(i) Detail discussion on the working, performance and organizational hierarchy of the P.M. National Health Complex along with administrative / financial problems of the complex and its components. (NIH, FMDC, HSA, PMRC, FGH)

(ii) Detailed discussion on the organizational hierarchy of Health Services Academy; recruitments made in the Academy; educational qualification of all the officers working in the academy total foreign / indigenous funds / grant / loans received and their utilization; total research scholarships awarded along with the procedures of award of scholarship; educational qualifications of the scholars and research papers / thesis published by the scholars.

(iii) Detailed discussion on the alleged case of harassment of a woman by an officer of the Health Services Academy.

The meeting started with the recitation from the Holy Quran Before the starting of discussion on the agenda items, all the committee members expressed their concerns, that Secretary Cabinet is not giving due importance to the committee, as she is not attending the meetings of the committee for 2nd time, although the meeting of the Committee on 03-10-12 was adjourned due to non presence of the Secretary Cabinet. The members of the committee pointed out that affairs of the Health Services Academy are not being run in proper manners, therefore, Secretary Cabinet should personally attend the meetings for listening the suggestions of the members for the improvement of the situation. The Committee advised Additional Secretary Cabinet to convey the concern of the committee to the Secretary Cabinet.

After that Senator Kalsoom Perveen, Chairperson of the Standing Committee advised for briefing Dr. Huma Qureshi Acting Executive Director, Health Services Academy informed about the working, recruitment, faculty / research, grants, loans and about expenditures / utilization of funds of the HSA. Giving the detail of funds / grants and loans to the Health Services Academy, she informed that for the year 2011-12 total revenue of the HSA was about Rs. 206 million. She also gave detail of various types of expenditures of the last 3 years. She informed that about 205 students of various programs will be given scholarship during the year 2011-12.

However, all the members expressed their concern on the briefing and on all other affairs of the HSA. Senator Kalsoom Perveen, Chairperson Standing Committee pointed out that on one hand the present incumbent of the post of Executive Director HSA does not have the requisite

92 qualification for the post, but on the other hand she has been given the charge of 3 important departments i.e. HSA Tobacco Cell and to that of PMRC, resultantly day to day affairs of these departments are not being governed efficiently. She therefore, advised that competent and eligible officials may be appointed on these posts as soon as possible. She also pointed out that people posted on higher posts are being paid extra benefits, although they are not performing their duties properly.

Senator Saeeda Iqbal also pointed out that the requisite qualification for the post of Executive Director HSA is Ph.D, while the present incumbent does not have the requisite qualification. Similarly Senator Kamil Ali Agha, Haseeb Ahmed Khan, Rubina Khalid, Sughra Imam and Senator Mushahid Ullah Khan also showing their strong reservations on these state of affairs advised the Additional Secretary Cabinet for taking immediate remedial action in this regard. The Committee advised Acting Executive Director of the posting of Executive Director, Health Services Academy of a person having requisite qualification / experience placed for the post and also for appointment of separate heads of the Tobacco Cell and PMRC. The Additional Secretary Cabinet assured for compliance.

. Senator Kalsoom Perveen, Chairperson of the Committee, Senator Haseeb Ahmed Khan and Mushahid Ullah Khan inquired about the detail of donations / funds being provided to the HSA. Dr. Huma Qureshi informed that an amount of Rs. 151 million was given by USAid and WHO. Giving the detail of expenditures she informed that about Rs. 152 millions were spent on various purposes, including Rs. 60 million on 46 workshops in the year 2011. Senator Mushahid Ullah Khan expressing his concern on the spending of Rs. 60 million on workshops advised to give the detail of all workshops, as it is not possible to hold a weekly workshop throughout a year. All the other members were also not satisfied with the stance of the Acting Executive Director. The Committee therefore, advised to give detail of these workshops including detail of topics participants, expenditure on each workshop, and the target achieved from these workshops.

Dr. Huma Qureshi informed the committee that about 5000 people were given training in public health sector the degree of which is equal to M.Phil and these trainees are working as EDOs, and DHOs in the various districts of the country.

Senator Sughra Imam pointed out that there is no clarity in the presentation, as there should be metro-picture of the training. She also asked for the provision of detail of students of private and public sector. She inquired whether the people who have got training are providing requisite service, she also inquired about the actual posting of these trainees at districts level. She therefore, advised that detail of 5000 trainees of HSA along with their present posting may be provided at the earliest for the further line of action of the Committee.

Senator Kalsoom Perveen inquired about the observance of provincial / regional quota in the appointments from the candidates of Balochistan. She also inquired about the posting of the trainees who have got training from HSA from the province of Balochistan. She further pointed out that the board of the HSA is not working properly. Senator Saeeda Iqbal asked about the detail of board meetings held during the last 3 years.

93 Dr. Huma Qureshi informed that provincial / regional quota is being observed in appointments and also in selection of trainees. She informed that not a single meeting of the board of HSA was held since 2009. The committee advised Additional Secretary Cabinet to make arrangement for holding the meetings of the HSA on regular basis and also for observance of regional quota as mentioned in the Constitution, as presently due representation has not been given to the province of Balochistan.

Senator Khalida Perveen and Sughra Imam pointed out that procedure for giving of scholarships to the students is very complicated and lengthy, resultantly needy students are not being paid scholarships in time. The committee therefore, recommended that the scholarships may be given on merit to the needy students within the shortest time. The committee advised that province wise detail of selection of students for scholarships along with criteria for giving scholarship to the students may also be provided to the committee as soon as possible.

Senator Kalsoom Perveen inquired about the pay and allowances and criteria for the selection of the heads of the 7 departments functioning under the HSA. The Committee also advised for the provision of audit report of HSA for the year 2011-12.

Senator Haseeb Ahmed Khan pointed out that day to day administration of the HSA is not being run efficiently, as one person is heading 3 departments, he therefore, suggested that one person should be made responsible for one department for the smooth functioning of the organization. Senator Haseeb Ahmed Khan also inquired about the mission of the academy and steps taken to achieve the objectives. He also stated that there is lack of team work in the administration of the academy.

Senator Kamil Ali Agha pointed out in the year 2010-11 about Rs. 110 millions were spent while in 2011-12, Rs. 300 millions were spent for various purposes. He inquired about difference of huge expenditure between years 2010-2011and 2011-12.

Senator Sughra Imam further pointed out that the academy has been derailed from its basic vision, as its basic purpose is not being served inspite of spending of millions of rupees from the government exchequer. She therefore, advised that Cabinet Division should look into the affairs of the Academy, as government is spending huge amount on these institutions but targets are not being achieved.

The Committee expressed its concerned that all the affairs of the work relating to various workshops were given to a very low level official (Zia Butt), which clearly shows the lack of leadership in the academy. The committee therefore, advised to remove Zia But from all the affairs of the academy immediately and compliance report in this regard may be submitted for the information of the committee.

The Committee expressing its dissatisfaction on the departmental inquiry report conducted on the harassment case in the hostel of HSA advised Dr. Jehanzeb Orakzai to conduct a fresh inquiry in the matter. The Committee also requested the Senator Saeeda Iqbal to assist the inquiry committee. The Committee however, directed that till the findings of the inquiry report the involved official may not be assigned any official duty.

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 18th October, 2012 in the Parliament House, Islamabad.

The agenda before the Committee was as under:-

(v) Detailed discussion on the affairs of Police Foundation, Islamabad with particular reference to the details asked for during the last meeting of the Committee.

(vi) Detailed Discussion on the Gulberg Islamabad Housing Society with particular reference to the launching of Agro Farms Scheme by the Society.

(vii) Detailed discussion on the opening of new sectors in Islamabad, by the CDA. Status of the land acquired for this purpose; mode of compensation to the affectees; any package deal negotiated / concluded with the affectees; representation of the affectees in the package deal.

(viii) Detailed discussion on the Estate Management Wing of the CDA with particular reference to the affectees whose lands were acquired decades ago, by the CDA, but have not been compensated so far.

The meeting started with the recitation from the Holy Quran. After welcoming remarks Senator Kalsoom Perveen, Chairperson Standing Committee stated that during the last meeting of the Committee the district administration were advised to take necessary action in the affairs of Islamabad Officers Cooperative Housing Society. She pointed out that although administrator of the society was removed and new administrator was appointed, however, the previous administrator have withdrawn about Rs.57 lacs from the accounts of the society, in spite of the fact the accounts were freezed. She further stated that under the existing instructions the administrator can not make expenditure beyond the limit of Rs.10000/- and also he can not make any deal for the purchase / disposal of land, however, the Ex- Administrator misusing his powers has purchased / disposed of some pieces of land. She also informed that the Ex-Administrator has illegally increased the membership from 44 to 113.

Syed Amir Ali Deputy Commissioner Islamabad informed, that in the light of the directions of the Standing Committee, administrator of the said society was replaced by appointing Circle Registrar Cooperative Housing Society Islamabad as administrator. He also informed that the accounts of the society were freezed and election schedule for the selection of new elected body has also been published in the newspapers. He informed that Circle Registrar is

95 on 3 days leave, therefore, he has not attending the meeting; however he will be informed about the concerns of the Committee.

All the Committee members expressing their deep concern on these state of affairs directed that:

i) Legal action may be taken against the ex-administrator of the society, who have violated relevant rules for drawing amount from the accounts of the society during the frozen period. Similarly action may also be taken on purchasing / disposing of land, and for illegally increasing the membership from 44 to 113.

ii) The election schedule of the society may be rescheduled as most of the members have gone for Hajj.

iii) Only the original members (44) may be allowed to participate in the election process and illegal membership may be cancelled.

After that the affairs of Police Foundation came under discussion Mr. Zahid Mehmood, MD Police Foundation giving the briefing stated that the housing scheme for the welfare of the police personnels was started in Sectors 0-9 and E-11. He informed that total membership of the society is 1824 and total land purchased is about 1325 Kanals in E-11 Sector. The number of residential plot are not 1254.

The members of the Committee raised many questions / queries / observations on the affairs of the housing society of Police Foundation. Senator Rubina Khalid asked that how many lower grade employees of the police department are original members of the society. She was of the view that if it is a welfare organization for the police personnels, then Constables, Hawaldars, widows and orphans of the police Shuhda should had been adjusted by giving the plots, but on the other hand, all the high level police officers have been adjusted and no share is being given to the lower level.

Senator Kamil Ali Agha inquired that, whether all the plots were allotted to only police personnels on the prescribed procedure and rules and regulations or also to non-entitled persons. He advised to give the detail of allotments of plots by normal procedure and also through discretionary powers of MD Police Foundation. He also advised to give detail of action taken against the responsible persons who have, allotted plots to the non-entitled persons. He strongly criticized on the plea of MD Police Foundation that it is a charity organization, as it is running the business of billions of rupees under the name of charity.

Senator Kalsoom Perveen, Chairperson Standing Committee also expressed her strong concern on the affairs of the foundation, as it failed to fulfill the purpose, for which it was launched. She pointed out that the list of allotees furnished to the Committee shows that the foundation is not a charity organization, as it is giving plots measuring 4 kanals to the top police officers and other well placed bureaucrats. She also pointed out that besides other irregularities the foundation has also illegally grabed and encroach upon land of private persons measuring 81

96 kanals. The MD Police Foundation concurred with the observations of the chair and stated that all the relevant details will be furnished to the Committee for its next meeting.

All the Committee members showed their reservations on using the name of public sector organizations for running Cooperative Housing Societies, which has become purely a private business. The Committee therefore, advised CDA and ICT to take necessary action in changing the names of the housing societies from Ministries / public sector departments and also in the name of charity.

As all the Committee members were not satisfied on the affairs of the Police Foundation as some major irregularities were came into notice from the briefing submitted by the Police Foundation, the Committee therefore, decided that all the affairs including total land purchased number of plots, detail of original allotees (entitled / non-entitled), dispute of land etc housing scheme of Police Foundation and the points raised by Senator Kamil Ali Agha as above will be discussed in the next meeting of the Committee.

The Committee then took the agenda item regarding the Gulberg Cooperative Society / Cooperative Forms Scheme of the Intelligence Bureau of Pakistan.

On various queries / observations raised by the Committee members, the general secretary of the Gulberg Housing Society flared up and leveled acquisition on the Committee, stating that Malik Riaz CE Bahria Town inclusion with the ICT was pursuing to ditch the society. He went to the extent saying that the Committee was also taking dictation from Malik Riaz, and this agenda item has been included on the behest of Malik Riaz, besides he was of the view that the cooperative society is not accountable to any Parliamentary Committee. Then showing upfront to the Committee he left without the permission to the chair. The Committee unanimously observed that the behaviour of said officer was very rude to the Committee. The Committee therefore, decided to move privilege motion under Rule 70 of the Rules of Procedure and Conduct of Business in the Senate 2012. The Committee also observed that primary task of the security agencies including IB is the security of the country, as because of their involvement in the property business, the country has gone to docks. The Committee further advised that instead of running real estate business all security agencies should constrate on their primary task, that is intelligence and counter intelligence. The Committee further decided that later on the matter will be taken up with the Honourable Prime Minister of Pakistan.

While briefing on the opening of new sectors in Islamabad Mrs. Shaista Suhail Member Estate CDA informed that about 54 thousand acres of land acquired by CDA is in adverse position. The chaired observed that because of slackness, sluggishness and connivance of CDA officials / officers’ mushroom like fraudulent real state has flourished. Had CDA been able to open new sectors in time, the growth of cooperative societies would not have been possible.

On the detail submitted by Member Estate CDA regarding land acquisition for various sectors i.e. C-13, C-14, C-15, C-16, D-13, E-13, F-13, H-16, I-17 the Committee advised that all the process of land acquisition / award of contract to the affectees may be made fully

97 transparent as soon as possible and the CDA should evolve a policy for the early settlement of all the issues in this regard.

The Committee pointed out that people have vacated their land, but they are not being compensated in time. Senator Kalsoom Perveen pointed out that the award for the affectees of Behika Syeda was announced in 2004 but still affectees have not been satisfied by giving them due compensation, although the people have given the occupation of their land to the CDA.

Senator Kamil Ali Agha also inquired about the background for not giving the compensation to the common people, but it is being given to the influential people. He therefore, advised that there should be no discrimination in the payment of compensation to all the affectees. In response to the observations of the members of the committee, CDA assured that a board meeting will be held within a week. The Chairman CDA assured the Committee that the issue will be resolved as early as possible.

i) The Committee advised that the issue of Afghan refugees may be raised with all concerned, as they are creating problems in taking over the possession of the land in various sectors. ii) The CDA should develop sectors on public / private partnership basis. iii) The CDA should make necessary arrangements immediately for the computerization of all land record. iv) The CDA should re-organize its Law Department more efficient and effective. v) The needy legal experts may be included in the legal team of the CDA, and proper pursuance of the cases may be made in the civil courts. vi) In future affectees may be paid compensation within the shortest time according to the land sharing formula of that area.

Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT.

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 14th November, 2012 in the Parliament House Islamabad.

The agenda before the Committee was as under:-

(i) Detailed discussion of the working and performance of the OGRA with particular reference to mechanism of determination of petro-products prices and implementation of the Supreme Court’s verdict to reduce the CNG prices.

(ii) Detailed discussion on the procedure of grant of permission for opening of new CNG Stations and number of CNG Stations opened during the last four years and future policy in this regard.

The meeting started with the recitation of Holy Quran by Senator Abdul Haseeb Khan. Senator Mrs.Kalsoom Parveen, Chairperson Standing Committee welcomed the participants and gave a short background for convening the meeting. She stated that the problem of prices of petroleum products is a very serious issue, as the whole economy/ industry of the country has deep link with these prices. She, therefore, advised to give full detail of mechanism of fixing of prices and overall working of OGRA. Similarly Senator Abdul Haseeb Khan also stated that the wheel of the economy and prices of essential commodities have connection with the prices of petroleum products, as when these go up; the prices of items of daily use are also arisen and vice versa. He stated that according to his observations the OGRA is not independent in the determination of formula for increasing and decreasing of prices. He therefore advised to inform about the final authority in this regard.

. Senator Kamil Ali Agha also advised to give detail on the role of OGRA in fixation of prices. He inquired that who is importing oil and who is selling it in the market and earning the profit beside about the role of OGRA in this business, as according to him it does not seem to be a transparent mechanism. He pointed out that some portion of oil and gas is being explored in the country, but the prices of this production is too linked with the importing products. He, therefore, advised to provide detail of factors involved in fixing of the prices of petroleum products.

Mr. Shahidullah Baig, Additional Secretary Cabinet Division informed that Cabinet Division is authority for making appointments of the Board members and Chairman OGRA through open advertisement on merit. Mr. Saeed Ahmed Khan, Chairman, OGRA informed that OGRA is functioning under Ordinance 2002, and there are three main functions of OGRA including competition, leveling fields for oil companies and to that of protection of interests of the consumers. He informed that OGRA operates independently, however the policy of fixing of prices is being given by the Ministry of Petroleum. He informed that previously

99 prices of petroleum products were being fixed on weekly basis, but on the direction of the Supreme Court of Pakistan, these will now be fixed on monthly basis, however presently prices are freezed, and new prices will be fixed on 1st December, 2012. He further informed the Committee that under the instructions of the Government the prices of local production are also fixed in dollars and no concession of local products is being transferred to the common people.

All the members expressed their deep concern on the ways and means, on which the OGRA/ Government are fixing the prices of these products, as according to existing formula instead that of common people the interests of the petroleum companies are being watched and protected. They pointed out that the oil prices have been freezed in the country, while the prices of petroleum products are decreasing in whole of the world therefore, all the profit is going into the pockets of big oil companies.

Senator Kalsoom Parveen, Chairperson Standing Committee advised that appointments of Board members should be made on merit and the OGRA should be made more stronger in dealing with all the matters, as due to weakness of the Authority, middle men are earning profit of billions of rupees on the cost of common people.

Senator Abdul Haseeb Khan and Senator Kamil Ali Agha also recommended that OGRA should be given more authority and autonomy, as presently it is depending on Cabinet Division and Ministry of Petroleum in discharging even its day to day functions. Senator Kamil Ali Agha advised that the OGRA Ordinance should be brought in to the Parliament in shape of and Act for detailed discussion for taking input of the Parliamentarians. He was of the view that on one hand the oil companies are earning huge profit, while on the other hand the industry of the country has been ruined, and all the burden is being shifted on the common people. He further pointed out that all the government taxes may be collected under one name and not in indifferent shapes.

Senator Saeeda Iqbal recommended that formula for fixation of prices may be simplified, as in the present shape common people cannot understand, that what is happening with them. She also recommended that government taxes should be collected in one go and the profit of oil companies may be reduced.

Senator Kalsoom Parveen advised that proper legislation may be made for giving suitable relief to the common people. She advised that this relief can be given by de-linking the local products with dollar, besides on the low prices of oil in the international market. She strongly advised that formula may be revised keeping in view all the facts and figures in true spirit including difference of cost between imported and local production.

Chairman OGRA giving the detail of CNG prices in the country informed that prices are fixed according to given formula duly approved by the Cabinet and CCI. He informed that production and exploration of Gas doest not come under the purview of OGRA, He gave detail of formula for fixing the price of CNG including cost at Well, operational cost, return investment, Gas development charge, operational cost at CNG Station, margin, GST etc. which comes to total about Rs.92.53 per kilogram, but after giving the policy statement by the Secretary Petroleum in the Supreme Court regarding de-regularization of Gas prices the Supreme Court

100 has advised to fix new prices as Rs.61.64/KG and the Supreme Court has further directed the OGRA/Ministry of Petroleum to fix the prices of CNG after in consultation with the representatives of the CNG Association and the report in this regard may be submitted to the Court on 19.11.2012.

Mr. Ghias Ahmad Pracha, Chairman CNG Association thanked the Committee for listening the view point of the Association in this regard (which is also a big stakeholder in this business). He informed that the policy of regularization of prices of CNG was wrong. He informed that there is misperception about usage of gas and ratio of prices at CNG stations. He further informed that Supreme Court in its Judgment has advised to reduce the price of CNG up to Rs.20/KG, and it should not be linked with the prices of Gasoline, as the Natural Gas is completely local product. He also informed that at present the profit of CNG owners is at zero level, therefore a reasonable policy may be formulated in this regard.

After the briefing by the Chairman OGRA and statement of Chairman CNG Association, Senator Mrs. Kalsoom Parveen, Chairperson Standing Committee stated that Establishment of CNG Stations at large scale was a wrong decision of the government. She also pointed out that out of 38 CNG Stations only 24 are operational in the province of Balochistan, while the province is providing gas to whole of the country. She therefore advised that Government should not impose ban on the installation of CNG Stations in the province. She advised that government should take care of the interests of owners of the CNG pumps, as they have made huge investment in this business, therefore, government should make a policy for giving due protection to their mega investment. She also advised that province-wise detail of employees serving in OGRA may be provided for the information of the members of the Committee. Senator Saeeda Iqbal recommended that Malakand Division which is also a backward area may be given special preference in this regard.

Senator Kamil Ali Agha too was of the view that investment on a large scale has been made in this sector; therefore it will not be fair to do injustice with the owners of the CNG Stations. He recommended that reasonable relief should also be given to common people. He recommended that till the starting of new business by the owners of the CNG stations, they may not be disturbed, and they may also be given reasonable profit for the continuation of their business and similarly due care should also be given to the national interests/common people.

After detailed deliberations, the Committee unanimously recommended that:

1) OGRA should be made more powerful and strong for making decisions independently for fixing of prices of petroleum products.

2) The appointment of Board members should be made purely on merit and with fully transparent manners.

3) As directed by the Supreme Court, the prices of petroleum products may be fixed once in a month.

101 4) The formula for fixing of prices of petroleum products may be revised keeping in view the interests of the common people and government exchequer and not by watching the interests of the big petroleum companies.

5) The profit of the petroleum companies may be reduced reasonably and similarly government should reduce the ratio of taxes for giving the relief to the common people.

6) The prices of local oil production may not be linked with that of imported petroleum products and similarly the local products may not be linked with dollar.

7) OGRA should fix the prices of CNG after in consultation with the CNG Association.

8) Government should not impose ban on the installation of CNG stations in the province of Balochistan.

9) Detail of province-wise appointments in OGRA may be provided.

Senator Saeed Iqbal, Convener of the Sub-committee presented the report of the Sub-Committee which was constituted in the meeting of the Standing Committee held on 26th July, 2012 regarding “Overall performance, issues and requirements of all public and private schools under the administrative control of Ministry of Capital Administration and Development” The detail of which is as under:

1) Education policy should be made after in consultation with the experts / educationists.

2) Curriculum may be amended according to modern requirements and after in consultation with all stakeholders.

3) Sufficient teaching staff may be provided to the upgraded schools/colleges according to their requirements.

4) Necessary steps may be taken for imparting quality education to the students.

5) Preference should be given to Primary education.

6) Computer classes may be started immediately in all the schools from 6th Class.

7) Professional and technical training may imparted in technical institutions according to market requirements otherwise these may be finished.

8) Steps may taken for the in-service training of teachers.

9) Transport facilities should be given to teachers of rural area and a special allowance may also be given for posting in rural schools/colleges.

102 10) Steps may taken for the provision of transport to all the schools / colleges especially to that of girls institutions.

11) There should be rational number of teachers and students in all the schools, which should not cross from 35 to 40 students in a class.

12) Immediate steps may be taken to finish the overcrowding of students in the schools / colleges.

13) Volunteer teachers should be hired according to requirements.

14) There is dire need to construct more colleges in the I-10, I-9 sectors

15) Posts of BPS-1 to 15 should be allocated for locally domiciled residents of Islamabad.

16) Nursery and Prep classes should be made mandatory in all schools.

17) Daycare centers may be established in schools / colleges for facilitation of the teaching staff.

18) Trend of teaching tuition by the teachers to their own class students may be stopped immediately, and action may by taken against such teaching staff, who are involved in teaching tuition to their own class students.

As regards the issues of private educational institutions in Islamabad, the Committee appreciated and approved the proposals prepared by the Private Educational Institutions Regulatory Authority (PEIRA) which is presently in the National Assembly for approval. However Senator Abdul Haseeb Khan gave following proposals for consideration.

(i) The scope of the bill should not include “functioning” which is responsibility of the school itself, and the government should focus itself only on registration and regulation of private schools.

(ii) Under clause 4, syllabus of Federal Board of Secondary and Intermediate Education be added.

(iii) There is no mention of textbooks which needs to be addressed.

(iv) Authority should not be responsible for maintaining uniformity of academic standards; this should be the responsibility of respective school.

(v) Authority should not be responsible for ensuring teachers capacity development; this should be also responsibility of respective school.

(vi) School registration should be initiated based on independent review before operation of any private school.

103 (vii) Registration process should be led by academics who have deeper understanding of school education.

(viii) Registration should be renewed every year based on meeting all minimum standards.

(ix) Authority should have core staff including “Secretary of the Authority” to manage the responsibilities of the Authority.

(x) Authority should not intervene in reviewing school financial and academic reports; its role should be regulating schools through registrations and inspections.

(xi) Authority should play facilitative role enabling school owners to get their schools registered and run on guidelines provided by the Federal Government.

The Standing Committee unanimously approved the report of the Sub-Committee and advised that Ministry of Capital Administration and Development and Federal Directorate of Education should take necessary action regarding implementation on the recommendations of the Sub-Committee.

Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 28th November, 2012 at Parliament House, Islamabad.

The agenda before the Committee was as under:-

(i) Detail discussion on overall working and performance of Kashmir Housing Society and problems being faced by the society in execution of their projects.

(ii) Follow-up discussion on the affairs of Police Foundation Islamabad with reference to recommendations of the Committee made in its previous meetings.

(iii) Detail discussion on the Park Enclave Project, Islamabad with particular reference to ascertain transparency in the balloting process, as referred by the Senate, in its sitting held on 15-11-2012 for consideration and report to the House.

The meeting started with the recitation from the Holy Quran by Senator Haseeb Ahmad Khan. After welcoming remarks by the Chairperson Standing Committee, she gave the short background for calling the meeting on the issue of Park Enclave. She stated that this issue was already discussed in various meetings of the Standing Committee; however, the issue was also raised in the sitting of the Senate held on 15-11-2012. She indicated that during the discussion several members had raised many questions / queries on the balloting process of the Park Enclave. After detailed discussion in the House the matter was referred to the Standing Committee on Cabinet. She then advised Chairman CDA for briefing. Syed Tahir Abbas Chairman CDA informed that 3 main issues relate to the Park Enclave i.e.

i) Balloting

ii) Construction of boundary wall and

iii) The internal development

Giving the detail he informed that there is no problem of construction of boundary wall as, all the issues have been settled with all concerned land owner and work on the construction of boundary wall is smoothly in progress. As regards the work on internal development, he informed that the tender for development work was given on single tender basis to Messers NESPAK without the approval of Prime Minister and Cabinet, therefore, PEPRA objected on

105 giving the tender to Messers NESPAK without open competition, resultantly CDA has cancelled that tender and placed the matter before the CDA board for the appointment of consultant through open competition basis. He assured the Committee that development work will be completed at the end of 2013, and there after allotees can start the construction work for their houses accordingly. He indicated that due to lot of criticism in the media and objection by the NAB, CDA board has decided for re-balloting with fully transparent manners to avoid any type of objection from any quarter.

After the briefing by the Chairman CDA Members of the Standing Committee and the members who were invited as special invitee gave many suggestions / recommendations for the early completion of the scheme. Senator Hadayatullah who was the mover, informed to that this scheme was to be completed in January, 2013, but no progress is on ground. He therefore, advised to restore the confidence of the people on this scheme. Senator Kalsoom Parveen Chairperson Standing Committee indicated that the work on this scheme was started in July, 2011 but due to some issues, it is still in dormant condition. She stated that it is a good scheme, therefore, it should not be spoiled. She was of the view that due to negative media campaign of Messers Bahria Town, the Park Enclave Scheme is for behind than the project started by Bahria Town, although it is about 10 km away from the CDA Scheme. She pointed out that the issue of giving tender to NESPAK should have been settled earlier, and in future no tender may be given to any company on single tender basis. She advised that all possible steps may be taken for the restoration of confidence of the common people on the CDA. She also advised that the issue of Kurri Model Village may be settled immediately and the people of the area may be satisfied as they have given their land to the CDA. On this point Chairman CDA informed that an agreement with the affectees of Kurri Model Village have already been made and CDA has decided to construct a model village for the affectees and whole process will be completed with full transparent manners within the shortest time.

The Committee advised to implement on the agreement signed with the people and the progress report in this regard may be submitted to the Committee. Senator Haseeb Ahmad Khan stated that a ray of hope has been developed after the briefing of the Chairman CDA. He advised to take proper and visible measures for the restoration of the confidence of the people on the authority. He also recommended that the tendency of awarding of single tender may be stopped permanently, as it creates misunderstandings. Senator Rubina Khalid stated that the Committee will fully support the CDA in this regard. Senator Saeeda Iqbal suggested that the reasons for raising objection on the balloting process may be obtained from NAB, and then the matter may be referred to Ministry of Law for opinion.

Senator Kamil Ali Agha showing strong concern on the performance of CDA stated that there should be visible progress in this regard, but it is very slow as on the objections of PEPRA regarding the awarding of the tender to NESPAK, the CDA should had taken the steps for the appointment of consultant very earlier. On the issue of balloting he pointed out that it is not an easy problem, action should be taken against the responsible officials, as it is the matter of the trust of the people on the authority. He advised that immediate steps may be taken for the starting of development work on the project.

Senator Saifullah Khan Bangash pointed out that some front portion of this scheme was given to Bahria Town; therefore, it created some problems. He therefore, recommended that this

106 issue may also be considered. Senator Mushahid Ullah Khan also advised that action may be taken against all concerned responsible for delay in development / balloting process.

After detailed deliberations on this subject the Committee unanimously recommended that:

i) Detail of objections of NAB may be taken and opinion of Law Division may be sought for re-balloting, and after taking the opinion of Law Division, the balloting process may be completed without any further delay.

ii) For the internal development work appointment of consultant may be made immediately and the development work may be completed at the end of December, 2013 positively as committed.

iii) In future the concept of awarding of contract on single tender basis may be stopped permanently, and PEPRA Rules regard may be followed strictly.

iv) The Chairman CDA should take visible steps for the improvement in the performance of the authority.

v) CDA should also utilize the service of its own town planners for the development work in its various sectors.

vi) FIA and NAB should only take the issues for investigations only if these are referred to their agenda by the concerned departments.

On the issue of J&KCHS, the representative of J&KCHS briefed the Hon’ble Committee about the status of Sector G-15/F-15 and said that the Scheme is consisted of 4474 Kanals and the development work on 3482 Kanals is almost completed therefore, the society has requested the CDA for the release of mortgaged land. They informed that the society has no issue with the CDA in respect of Sector G-15/F-15 except the acquisition of patches of 30 Kanals.

The Member Planning, CDA informed that the Society has not completed the Scheme in time and also not submitted the NEC of 323 Kanals land affiliated by the land lord. Mr. Muhammad Fayyaz Awan, Secretary Society giving the reply of the query of CDA stated that in Islamabad High Court in a Writ Petition in 2012 had given its verdict in favour of the society in this regard.

On the Committee advised the society to provide the copy of the NEC of 323 Kanals to CDA, as early as possible as there after CDA to release the remaining mortgaged land.

Sector F-15 (Extension)

Mr. Muhammad Fayyaz Awan Secretary of the Society informed the Committee that the Society had submitted a Layout Plan alongwith complete land documents, contour plan and land ownership documents of 1534 Kanals alongwith scrutiny amounting to Rs.4,00,000/-, which was received by the CDA on 1st November 2004, but the documents were misplaced by the CDA and therefore Society had again submitted a copy of the same vide letter No.5/2003/KK(Ext) dated 22.3.2012, besides that not a single letter or notice of CDA is unattended.Director Planning CDA informed that the documents submitted by the Society are not attested by the Revenue Department. The Committee advised the Society to provide the attested photo copies to the CDA at the earliest. DC Islamabad advised the ADCG to attest the papers of the Society as and when provided without any delay. After that the Committee directed the CDA that as and when the attested copies are provided the Layout Plan of F-15 (Extension) be approved accordingly.

Agro Farming Scheme, Zone-IV

The Member Planning, CDA informed that J&KCHS has submitted a Layout Plan of Scheme over an area of 2644 Kanals on 1.12.2012 and the observations of CDA have been conveyed to the Society to complete the formalities for approval of Layout Plan. The Committee advised the Society to complete the documents as early as possible.

The representative of the Society informed the Committee that the J&KCHS submitted its Agro Farming Scheme consisting of three Mouzas Pahag, Panwal and Bokhar duly approved by the AGM. The site of the Scheme is one Kilometer away from expressway, and all the required land is owned and under the possession of Society for which NEC has also been obtained and will be submitted to CDA within few days.

The Chairman and Vice Chairman of J&KCHS informed the Committee that IB Cooperative Housing Society have illegally occupied 714 Kanals land of J&KCHS and is developing its Agro Farming Scheme on the land of the Society and CDA has also approved the Layout Plan of IB Cooperative Housing Society, for land which is scattered on 5 Mouzas and on 714 Kanals land of J&KCHS.

The Committee taking serious notice of this situation directed the Registrar, ICT and CDA to hold an enquiry and to get vacated the land of J&KCHS if illegally occupied by the IB Cooperative Housing Society.

Khayaban-e-Kashmir-II Zone-V and Sector F-16

Mr. Abdul Latif Qureshi, Vice Chairman, J&KCHS informed the Committee that the Society has also two other residential Schemes in Zone-V and Sector F-16, of which Layout Plan and Engineering Design are approved, but NOCs have not been issued by the CDA so far, resultantly the Society is not in a position to start the development work and recovery of dues from the members.

The Committee advised CDA to issue the NOC of Zone-V and Sector F-16 Schemes of J&KCHS if all codal formalities have been fulfilled. The Member Planning CDA assured the Standing Committee that all the issues of J&KCHS will be resolved amicably.

Taking part in the discussion Senator said that the Committee of the Senate on Human Rights in its meeting held on June 27, 2012 on the subject of enforced disappearances decided to set up a Sub Committee comprising of the following to look into the issue and make specific recommendations.

1. Senator Farhatullah Babar, Convener 2. Senator Ms Nasreen Jalil, Member 3. Senator Ms Suriya Amiruddin, Member

The Sub–Committee was tasked to report on the violation of human rights namely the enforced disappearances of citizens and to suggest ways and means to address the same.

He said that the Sub Committee submitted its preliminary report within the stipulated time frame of 60 days. Copies of the recommendations were then circulated by the Secretariat among all members for study before it is taken up for formal discussion in a Committee’s meeting.

He paid tributes to the members of the Sub Committee Ms Suriya Amiruddin and Ms Nasreen Jalil for their most valuable inputs and painstaking efforts in examining all aspects of the issue and making some informed recommendations.

Senator Farhatullah Babar said that the Sub Committee had formulated six recommendations to address the issue as detailed below:

A. Presently the security/intelligence agencies had no legal powers to detain and arrest those suspected of terrorism, militancy and/or other anti state activities. The agencies which picked up suspects for interrogation/investigation lacked legislative sanction for their acts and thus invited criticism both nationally and internationally. He said that it was necessary to empower the agencies through an Act of the Parliament to perform their function so that they performed their national duties with legal sanction and avoid criticism which was bringing bad name to these agencies.

He said that the Supreme Court had also observed from time to time that the functioning of the agencies must be regulated by law. The Commission on Enforced Disappearances in its report has also recommended that appropriate legislation needs to be made to provide specific powers of arrest and detention to the Army and Law enforcement agencies for a limited period under special circumstances in order to curb anti-state activities. Only such legal provisions can put an end to new cases of enforced disappearances.

109 Senator Farhatullah Babar recalled that earlier this year the National Assembly passed a unanimous Resolution calling for the enactment of necessary legislation. He then read out excerpts from the National Assembly Resolution of March 14, 2012 as under:

“This House calls upon the Government to ensure prevalence of the rule of law and to implement, without further delay, observations of the Supreme Court of Pakistan and recommendations of the Commission of Enquiry on Enforced Disappearances for enactment of necessary legislation to resolve the problem of missing persons and also recommendations of the Commission of Inquiry concerning the murder of Syed Saleem Shahzad for a comprehensive frame work law to regulate the role and functioning of the intelligence and security agencies”.

He said that the Senate of Pakistan had also on March 7, 2012 passed a similar unanimous Resolution against enforced disappearances calling upon the government to take effective and immediate steps to address the issue.

Senator Farhatullah Babar said that the Sub Committee took into account the recommendations of Commission of Enquiry on Enforced Disappearances, the observations of the Supreme Court and the Resolutions of the National Assembly and the Senate of Pakistan in formulating concrete recommendations in this regard. He said that in formulating its recommendation it was conscious of the universality of the view that it was important that state agencies were strengthened by internal autonomy and vesting with legal powers to detain, interrogate and prosecute suspects to deal effectively with the challenges of national security. At the same time it was also necessary to balance the powers with a measure of parliamentary oversight and government control so as offset the growing criticism of these agencies on grounds of acting beyond the pale of law.

Senator Farhatullah Babar said that the Sub –Committee had prepared a draft legislation for this purpose which had been circulated among the members of the full Committee. Explaining the salient features of the proposed legislation he said that the head of the security agency shall have powers to take into custody a person against whom an order of detention has been issued by him in writing provided that such arrest be made in the presence of an officer of Agency in BS 17. The agency shall also have powers to collect evidence against persons acting or likely to act in any manner against the security and integrity of Pakistan.

The preventive detention will be for up to 30 days that may be extended for reasons to be recorded, up to a maximum of 90 days. Any person thus detained shall, within seven days, be communicated the grounds on which the order has been made, and shall be given an opportunity at the earliest of making a representation before the head of the agency against the order. The head of the agency will be required to decide the representation within 30 days and may at any time order handing over of any such person to the FIA or the local police for proceeding against him under the applicable provisions of law.

Senator Farhatullah Babar said that the issue however was far too important and serious that involved several stake holders and serious issues of law and working of state agencies and it called for taking all stake holders on board for a broad based consensus. He said that the Sub

110 Committee’s recommendations were only of a preliminary nature and proposed that the views of the Ministries of Defence, Interior and Human Rights be also invited and if possible public hearings may also be held on the issue for broad based consultation and dialogue and taking all stake holders on board.

B. He said that the second recommendation of the Sub Committee was that the report of the Commission on Enforced Disappearances be published and its recommendations also implemented.

C. The Sub Committee also recommended that Pakistan may sign and ratify the International Convention on Prevention of Enforced Disappearances of citizens. It will help establish the right to truth regarding the circumstances of the enforced disappearance, the progress and results of the investigation and the fate of the disappeared person.

D. Senator Farhatullah Babar said that the fourth recommendation of the Sub Committee was that compensation may be paid to the victims of enforced disappearances whenever located and brought to surface.

E. He said that it also proposed that the Human Rights Committee may meet the Commission on Enforced Disappearances to further the efforts for the search for missing persons.

F. Senator Farhatullah Babar said that the Sub Committee believed that the judicial system is not equipped either in law or prosecution capacity to meet the challenge of terrorism. It is recommended that amendments to the ATC Bill be expedited in consultation with stake holders for speedy trial of militants.

G. Another recommendation of the Sub Committee he said was that the government should facilitate the forthcoming visit of the United Nations Working Group on Enforced or Involuntary Disappearances and use the opportunity of its visit to remove misperceptions and to demonstrate that the government is serious to solve the problem.

Senator Farhatullah Babar said that the recommendations at F and G appeared to have become redundant as the Foreign Office had already welcomed and met the UN Working Group and a Bill to amend the ATC had been tabled in the National Assembly. He also complimented the Foreign Office and Minister for bold and imaginative handling of the visiting UN Working Group on Enforced Disappearances despite some internal opposition from other quarters in the government.

The Chairman of the Committee and other members of the Committee complimented Convener Senator Farhatullah Babar and other member of the Sub Committee for the valuable work done by them.

The Committee after discussion decided that the issue being far too important and serious required that a broad based consensus of all stake holders be evolved. Accordingly it was decided to seek the views of the relevant ministries of Defence, Interior and Human Rights on

111 the recommended measures. It decided to call for their views within 10 weeks during which time the Committee will also hold public hearings on the issue to elicit larger body of opinion of the civil society and stake holders.

Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 7th December, 2012 at Parliament House, Islamabad.

The agenda before the Committee was as under:-

(i) Action taken by the CDA on the findings of the FIA into the illegalities and corruption in the award of Kurri and Reharra Village, Islamabad.

(ii) Follow-up discussion on the affairs of Police Foundation Islamabad with reference to recommendations of the Committee made in its previous meetings held on 11th September, 2012 and 18th October, 2012.

After the recitation of Holy Quran and welcoming remarks Senator Kalsoom Parveen Chairperson Standing Committee advised CDA officials for briefing on the findings of the FIA into the illegalities and corruption in the award of Kurri / Reharra Village, Islamabad and also on action taken in this regard. She enquired about the status of FIA inquiry.

Mrs. Shaista Sohail Member Estate CDA giving briefing on the issue informed that according to CDA rules the land in these mauzas was acquired in 1960 to construct so may important schemes in the areas, however, unfortunately government could not take the possession of the area at that time and affectees continued to dwell on and utilized the land.

Continuing his statement she informed that an agreement was signed with the action committee of affectees in 2008 and award was announced in 2010. She indicated that due to several complaints against award, therefore, allotment files were not completed however, allotment letters were issued in haste. Resultantly the CDA authorities cancelled all the allotment and ordered for inquiry in the matter and the inquiry committee gave findings that there were some irregularities. She further informed however, later on FIA also jumped into the matter and prolonged inquiry for 2 years resultantly all projects were delayed.

Senator Kalsoom Parveen Chairperson Standing Committee enquired about the difference between the FIA findings and CDAs’ own report, and what will be the procedure to meet this challenge. She pointed out that it is very easy to checkout the original also fake applications through the NIC and with the help of Revenue Department / ICT. She strongly criticized for handing over CDAs’ own issue to FIA / NAB. She was of the view that CDA should handle these matters at its own and if the situation is beyond control the department, then the matter can be referred to the investigating agencies. She pointed out that FIA can not take suomoto notice at its own on any issue. She advised to prepare a fair, neat and clean report in this regard as soon as possible and CDA should be made powerful authority to decide its all matter, at its own as due to investigation process of other departments, the cost of the scheme is increased un-necessarily.

113 Senator Kamil Ali Agha pointed out that during the last meeting, the CDA was advised that in coordination with FIA the matter may be solved immediately, but no progress has been shown so far. He advised to save the affectees from further burden therefore; settlement in this regard may be made as soon as possible.

Chairman CDA agreeing on the observations of the members of the Committee stated that due to delay, there are some problems. He assured that the matter will be solved as soon as possible; as he will sit with DG FIA in this regard. He also informed the Committee that Chairman NAB will also be taken into confidence to settle the issue; and in case of any problem, the matter will be brought into the notice of Cabinet.

He further informed that according to FIA findings about 3422 affectees have been declared illegal, therefore, the case was placed in the CDA Board on 16-10-2012, but in the meanwhile the NAB has took over the case, therefore, further action can only be taken on receipt of report from NAB. She however, informed that the NAB authorities have indicated the matter will be resolved very soon.

After the briefing by the CDA, the members of the Committee showed great concern on the delay of whole process, and also taking the case by the FIA and NAB. Senator Kalsoom Parveen Chairperson Standing Committee enquired about the local committee of Kurri Model Village. She asked that how and why this committee was constituted, and what was its legal authority. Mr. Shahidullah Baig Additional Secretary Cabinet advised CDA that till the matter is lying in the NAB and FIA, the CDA should also prepare it report to avoid further delay.

After detailed discussion the Committee unanimously recommended that:

i) For the preparation of fair, neat and clean report, CDA should take assistance of Revenue Department / ICT and its own legal department.

ii) All issues with FIA / NAB should be settled and report in this regard may be submitted up to 28th January, 2013 positively. The Committee advised Additional Secretary Cabinet to make sure on the recommendations of the Standing Committee.

iii) CDA should be made powerful for making decisions within the authority and routine cases should not be un-necessarily sent to investigating agencies.

iv) The issues of local Committee at Kurri Village may also be seen.

v) As previously recommended, the legal Wing of CDA should be reorganized for proper and in time pursuance / monitoring of the CDA cases in the courts.

vi) In case of necessity, the services of good private lawyers can also be hired on cost.

While starting discussion on the affairs of Police Foundation, Senator Kalsoom Parveen Chairman Standing Committee advised to inform about the detail of NOC of the scheme of police foundation and also disputes of the police foundation with others.

114 MD Police Foundation informed that there are two housing projects of police foundation in 0-9 and E-11 and the CDA had approved layout plan for 1079 kanals, in 2004, however, later on CDA cancelled the NOC, as according to CDA some formalities were not completed. He informed that police foundation got stay order against the decision of the CDA, and the matter is still pending in the court. He further informed that there are dispute of housing society with some land provider, including a sitting MNA from Islamabad. On the observation of Senator Kamil Ali Agha, he admitted that in spite of cancellations of its layout plan by the CDA some allotments were made from 2008 to 2010.

Senator Kalsoom Parveen Chairperson Standing and other members of the Committee showing deep concern advised that for giving relief to the allotees, CDA and Police Foundation should sit together for the settlement of all issues including the vacation of stay order from court. The Committee also advised Police Foundation to remove the objections of the CDA, and CDA should request the court for early hearing of this case.

As regard the issue of land dispute with land providers the Committee advised that take the foundation should all possible steps to settle these issues with the help of CDA and other departments.

The Committee advised that there should be no change in the original layout plan as any change in the plan can create many problems. The Committee advised to give progress report in this case up to 31st December, 2012 positively.

Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT.

A meeting of the Senate Standing Committee was held on 19th December, 2012 at 11:00 a.m. in the Parliament House, Islamabad. Honourable Senator Mrs. Kalsoom Parveen, Chairperson of the Committee, presided over the meeting.

Agenda of the meeting was as under:-

i. Further discussion on the auction of the 3 G Technology.

ii. Detailed discussion on the observance of provincial quota by the PTA, in the recruitment of the employees, with particular to the verification of degrees of the Chairman, Members and all the Director Generals of the Authority.

iii. Submission of compliance report, by the PTA on the recommendations of the Committee made in its previous meetings.

The meeting started with recitation from the Holy Quran. At the outset, the Chairperson showed umbrage over absence of the Secretary Establishment. The additional Secretary Establishment apprised that the Secretary was in Prime Minister Secretary to attend a meeting. She observed that the Secretary Establishment did not attend the meeting of the Committee without any prior intimation/ information. Senator Abdul Haseed Khan endorsed the Chair's observation and stated that he had been making hue and cry, since the last three years, over non seriousness of the top bureaucrats. Its breach of privilege of the Parliamentary Committees, he added. Secretaries would solicit prior permission from the Chair in future, he suggested. Senator Saeeda Iqbal also concurred with his viewpoint and stated that the Secretaries ought to give top priority to the meetings of the Parliamentary Committees.

Senator Kamil Ali Agha said that this attitude of the Secretaries was sheer upfront to the Parliament and in future, such practices would be avoided. The Chair endorsed views of the members and directed the concerned to ensure the availability of secretaries in the meetings of he Standing Committees.

Taking up agenda item pertaining to the auction of 3 G Technology, the Chairperson observed that the meeting had been convened to expedite the auction process as it would not only bring billions of dollars to the national exchequer but would also offer better facilities to the consumers. In August, 2012 the PTA had apprised that owing to delay in the auction the country was suffering from the loss of billions of rupees and the PTA had ensured that the auction process would be completed by 31st August, 2012, but unfortunately, the same seemed to be impossible, she further added. The country was facing worst economic crisis and if auction was further delayed it would further worsen the situation. She lamented over inordinate delay in the auction and asked the Chairman PTA to update the Committee on the progress made so far in this regard.

Mr. Farooq Awan, Chairman PTA extended his gratitude to the Chair for convening the meeting on such an important issue and stated that the auction of 3 G Technology had been in limbo since 2007. Unfortunately, countries like Bangladesh and Afghanistan had gone much ahead of Pakistan in Telecom field, he added. Throwing light on the modus operandi of the auction, he apprised the Committee that, under rules of business, M/O I.T gave policy directive in 2011 to carry out the auction. They directed the PTA to hire services of consultants of international repute. Subsequently, the Government constituted a Auction Supervisory Committee ( ASC), headed by the Federal Minister for Finance, to ensure transparency and merit in the auction process.

For consultancy, the PTA constituted an In House Group of Experts but the ASC rejected the same and directed the PTA to follow proper procedure for hiring consultants. Accordingly, the PTA floated an advertisement and 9 people showed expression of interest. Only three were short listed and one was selected but the ASC rejected the same on the ground that all short listed firms had equal qualification and the selected firm was financially not sound. Due to delay in the auction process the national exchequer was facing loss to the tune of 400 million rupees per day, the PTA therefore, decided to hire services of individuals as consultantants instead of firms.

Senator Kamil Ali Agha stated that the Committee's sole interest was to expedite the auction process and to maintain transparency. He asked the Chairman, PTA as to why individuals had been hired as consultants instead of firms. The Chairperson asked as to what benefit had been accrued by hiring individuals as consultants. Responding to the query regarding hiring the services of individuals as consultants the Chairman PTA apprised the Committee that this phenomenon was not novel as the PTA had hired 81 persons as consultants in the past. Secondly, the M/o I.T did not ask to hire firms rather they asked to hire consultants of international repute. Secondly, the persons who had been hired also run international firms and they were internationally acknowledged in the telecom field. Curriculum Vitae of the hired consultants would be submitted to the Committee and they would also have attended the next meeting of the Committee through video link. Thirdly, they had completed their job just in 545000 dollars whereas the firms had asked for 20 million dollars. The matter was referred to the NAB and they had also cleared the same.

Senator Kamil Ali Agha Chairperson asked about the issue of recovery of tax , worth 47 billion rupees , outstanding against various cellular companies. The Committee, in its previous meeting, had constituted a committee comprising representatives of FBR and PTA. The Chair showed dissatisfaction over non submission of report by the PTA in this regard. Member Technical, PTA assured to submit the report in the next meeting of the Committee.

Over the issue of verification of degrees the representative of HEC informed that they had not received any documents from Cabinet Division. The Chair directed to submit verified copies of the degrees of the members and Chairman of the PTA by 10th of January, 2013. Mr. Shaid Ullah Baig, Additional Secretary ensured the same.

117 The Committee members unanimously emphasized on the observance of provincial quota in all recruitments and appointments in PTA.

At the end, the Committee made the following unanimous recommendations:-

1. The Process of Auction of 3 G Technology be expedited. Pubic representatives may also be made part of the Auction Supervisory Committee.

2. Issue of recovery of 47 billion rupees be resolved at the earliest. Educational Degrees of members and Chairman PTA be submitted to the Senate Secretariat by 10th of January.

3. Strict observance of provincial quota be ensured in all recruitments of the PTA.

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 2nd January, 2013 at Parliament House, Islamabad.

The agenda before the Committee was as under:-

(i) Detailed discussion on the policy of rehiring of civil servants after attaining the superannuation with particular reference to the letter written by the Secretariat Group Officers, addressed to the Chief Justice of Pakistan.

(ii) Detailed discussion on the induction of Sindh Police Officers into PSP. Names of all those officers who have been inducted and those who have been dropped despite the fact that their names were recommended by the Sindh Government along with the reasons for dropping their names.

(iii) Detailed discussion of the policy of transfer / posting of the Civil Servants. Names of officers along-with reasons who have been transferred prematurely during the last six months. List of all those officers. Deputations may also be submitted who have been surrendered prematurely.

The meeting started with the recitation from the versus of Holy Quran. Senator Kalsoom Parveen Chairperson Standing Committee welcomed all the participants of the meeting. She showed deep concern on the rehiring of retired government employees especially on their posting on regular posts, which is creating hurdles in the promotion of officers. She also expressed her concern that some officers reached on superannuation without promotion on higher grade due to non-holding of meetings of the Central Selection Board since 2011.

Senator Saeeda Iqbal also stated that it is common practice to give extension to the retired officers. She too was of the view that due to extension the promotion of existing officers suffers badly, which creates hot burning amongst them. She therefore, advised to revise this policy. Senator Rubina Khalid also recommended that the extension policy should be revisited, as the retired officers have to go home even after two years of extension period. She was not agreed on the stance of the government that extension is being given on the non-availability of suitable officers.

Mr. Taimur A. Osman Secretary Establishment Division endorsing the view points of the members of the Committee stated that extension is not desirable; however, in some inevitable cases extension is given for a maximum period of 3 years. He informed that Establishment Division tries its best that the promotion policy may not be suffered due to extension in services. He informed the Committee that to stop extension in services permanently, we have to make changes in the relevant rules. He informed that some formalities as mentioned in the rules have to observed at the time of extension.

119 After the statement by the Secretary Establishment Division, Senator Saeeda Iqbal stressed that either the extension may not be given to anyone, or it may be given to everyone, and there should be no discrimination in this matter.

Senator Kalsoom Parveen Chairperson Standing Committee stated that the cases of technical, engineering and doctors etc are different ones, but there is no need to give extension at all to the officers of regular cadre. Senator Rubina Khalid however, pointed out that there are thousands of young doctors who can replace easily the retired doctors; therefore, young doctors may be given preference instead of giving extension to the old ones.

The Committee also showed its concern for no holding of the meeting of the Central Selection Board since 2011, resultantly the promotion of hundreds of officers is suffering badly and in some cases officers have gone to retirement without their promotion. Secretary Establishment Division informed that due to stay order in Islamabad High Court, the meeting of the Central Selection Board could not be held since 2011.

Senator Najma Hameed pointed out that appointment on the post of Commercial Attachees is not being made on merit and also not from the officers of Trade Group and on the other hand appointments are being made from the irrelevant peoples on pressure. She therefore, advised to make appointments on the post of Commercial Attachees in Pakistani mission abroad purely on merit and from the officers of the Trade Group. However, Secretary Establishment Division informed that appointment on these posts is made by the Ministry of Commerce, not by the Establishment Division.

After detailed discussion the Committee recommended that:-

i) No extension may be given however, in inevitable cases the rehired persons may be appointed as consultant and not on regular posts.

ii) Establishment Division will provide a complete list of rehired officers during the last 3 years.

• Establishment Division should take necessary steps for making suitable amendments in Sub-Section 1 of Section 14 of the Civil Servants Act to stop the rehiring policy.

iii) Necessary steps may be taken immediately for the vacation of stay order issued from Courts regarding stopping the meetings of the Central Selection Board.

iv) The policy of making officers as OSD may be finished and in case of complaint against any officer, there should be some mechanism of accountability.

Coming on agenda item regarding dropping of names of Sindh Police Officers for induction into PSP cadre, Secretary Establishment Division informed that 40% vacancies of each province are reserved for induction into PSP subject to fulfillment of certain formalities including, having good ACRs, no disciplinary proceedings against the concerned officers and

120 approval of the Governor of the concerned province. He informed that there were 53 vacancies of the Sindh Police Officers for their inductment into PSP, while Sindh Province sent the names of 67 police officers belonging to the Province however, as some of them did not fulfill the requisite criteria therefore, their names were dropped, and Secretary S&GAD who personally came for this purpose in the Establishment Division, was informed accordingly.

However, Senator Kalsoom Parveen Chairperson Standing Committee informed that according to her information the names of 27 persons were not considered in spite of the fact that they had the requisite requirements. She pointed out that in case of any deficiency, requirement should be completed by the concerned authorities.

Secretary Establishment Division assured to look into the matter and to furnish the detail of dropped officers. He informed the Committee that provincial police officers of all the provinces have been inducted into PSP, except the province of Punjab, as Punjab province has not been sending the names of the police officers since last 10 years. All the Committee members showed their deep concern on these state of affairs and recommended that the high ups in the province of Punjab may be requested to send the names of the provincial police officers for their induction in the PSP cadre.

Starting discussion on the policy of transfer / posting of the civil servants Secretary Taimur A. Osman, Secretary Establishment Division informed that every civil servant can be posted in any where in the country. He informed that there are some rear cases of transfers / postings of premature transfer; however, this only happens on the recommendations of the competent authority. He further informed that recently Supreme Court of Pakistan has given direction that no officer may be transferred premature, without mentioning of sufficient reasons and completion of reasonable tenure i.e. at least one year.

Senator Kalsoom Parveen informed that some officers of province of Balochistan who came on deputation in the centre were returned back to the province without completing their tenure in the Federal Government. She therefore, advised that there should be a specific period for an officer for remaining on one post. Secretary Establishment Division informed that Establishment Division strictly follows the policy in this regard however; the concerned head of the departments makes internal postings and transfers. The Committee advised to strictly abide by the directions of the Supreme Court of Pakistan and an officer may not be posted / transferred without completing of reasonable time and also not without any specific grounds.

After discussion on formal agenda item, Senator Kalsoom Parveen Chairperson Standing Committee informed that the NIRM Hospital has been expended therefore, the hospital have requested for the increasing of staff from 300 to 387 for their requirements. She informed that Finance Division has already agreed to their proposal, but the case is pending in the Establishment Division since 2008. She therefore advised to give sanction of the necessary staff for the Hospital. Secretary Establishment Division assured for early decision in this regard. The Committee further advised Establishment Division to give suitable package to the families of deceased civil servants including provision of employment to one son / daughter of the deceased civil servants (in service).

121 Subject:‐ MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 6th February, 2013 at Parliament House, Islamabad.

The agenda before the Committee was as under:-

(i) Detailed discussion on the allotment of plots to the officers of the CDA with particular reference to resentment amongst officials of CDA (The Chairperson has desired that allotment process may be held in abeyance until the meting of the Standing Committee.

(ii) Update the installation of eight modern fountains, imported from China along with date and cost of the import of the said fountains and present status of the same.

(iii) Present status of the modern tourist train project alongwith cost incurred on the purchase of the said train.

(iv) Up date of the project of the installation of Dinosaurs at Ankara Park, Rawal Lake, Islamabad and cost incurred on the purchase of the said project.

(v) Update on the Ladies Club Project built at G-9/G-10.

(vi) Detail Report on the allotment of plots to the non awardees in the Badia Qadir.

(vii) Detail report on the allotment, in the name of Saif Co. Dubai, of plot No.11- A, F-10 Markaz.

(viii) Detailed discussion on the affairs of Roshan Pakistan Scheme.

The meeting started with the recitation from the versus of Holy Quran by Senator Haji Ghulam Ali. Senator Kalsoom Parveen Chairperson Standing Committee welcomed all the participants of the meeting. Initiating the proceeding of the Committee, she informed that 3 started questions were raised by the Senator Haji Ghulam Ali in the sitting of the Senate held on 29th January, 2013 regarding construction of plaza in Sector G-9, which were referred by the House to the Standing Committee. She advised Chairman CDA to brief the Committee on the issue.

Syed Tahir Shahbaz, Chairman CDA informed the Committee that after receiving full information from all concerned he will brief on this issue in the next meeting of the Committee as at the present he is not fully aware of the whole situation. Senator Haji Ghulam

122 Ali was also agreed to the request of the Chairman CDA. The Committee therefore decided that the matter will be discussed in the next meeting of the Standing Committee.

After that Senator Kalsoom Parveen, Chairperson Standing Committee inquired about policy for allotment of plots to the officers/officials of the CDA. The Chairman CDA informed that CDA is making allotments of plots to the officials according to the rules of the department. He indicated that during the year 2012 a list of 109 officials of CDA were prepared for the allotment of plots, however this was challenged by the CDA officials. He informed that a fact finding committee has been constituted in this regard and the report of which will be presented before the Standing Committee. He however in formed that there are three different types of decisions of courts in this regard; therefore CDA is trying to take a consolidated decision of the court. Mr.Shahidullah Baig, Special Secretary Cabinet Division informed that the Division had recommended that the plots may not be given to any officer of BPS-17 and above and including deputationists and only constructed houses/flats may be given to the officials in BS-1 to 16. Senator Rubina Khalid recommended that every government servant may be given plots/ constructed house on his superannuation. Senator Kalsoom Parveen, Chairperson Standing Committee advised that instead of taking decisions from courts, all policy matters should be approved through Parliament and its Standing committees. She further recommended that undue references may not be sent to NAB/FIA for the affairs of the department. Chairman CDA assured that the authority will give due weight-age to the recommendations of the Parliament.

On the issue of allotment of plots to the non-awardees in Badia Qadir, Chairman CDA gave detail of total number of main awardees and applicants whose cases are under review. He informed that the matter is however pending in the courts. Senator Kalsoom Parveen, Chairperson Standing Committee stated that the total number of applicants are apparently about 555. She inquired about the reasons for moving the cases in the courts. The Chairman CDA replied that after the decision of NAB some people went to the Court that the affairs of package deal may not be disturbed. He however informed that CDA Board has taken decisions that the plots may be given to the awardees falling in main package. The Committee strongly showed its concern that the cases of Badia Qadir are pending since 1987, resultantly the peoples who have given their precious land to the CDA are still facing so many problems, therefore CDA should activate its Law Wing to pursue the court cases effectively, as the present performance of Law Wing is not up to the mark. The Committee recommended that all appointments in the Law Wing should be made on merit with reasonable remuneration. The Committee advised to provide progress report of the CDA cases pending in various courts. The Committee further recommended that the land acquisition Act of the CDA should be amended to bring the appeal period at par with other parts of the country ( i.e. 6 months) which is presently about 5 years.

To make more efficient, the Committee also recommended that the Law Wing of CDA should be brought into the direct control of Member (Estate) instead of Member (Planning) as almost all cases of Estate Department are pending in the various courts.

(i) Implementation status on the recommendations of the Standing Committee regarding Jammu Kashmir Housing Society made in its meeting held on 28th November, 2012.

(ii) Detailed discussion on the affairs of Roshan Pakistan Scheme.

The meeting started with the recitation from Holy Quran. Senator Mrs.Kasoom Parveen, Chairperson Standing Committee welcoming all the participants stated that the Roshan Pakistan Scheme was granted NOC in 2004 without completing all formalities/ requirements, which was cancelled in 2012 by the CDA due to some reported malpractices in the affairs of the scheme. She pointed out that suddenly CDA has again issued NOC to the Roshan Pakistan Scheme, in spite of the fact that the owners of the scheme have not fulfilled all the requirements/formalities of the CDA, besides there are serious types of charges of corruption against them, as they in some cases have made allotment of plots twicely. Senator Kamil Ali Agha also showing his strong concern on the affairs of Roshan Pakistan Scheme inquired that whether the new NOC has been given on the completion of all the formalities.

Syed Tahir Shahbaz, Chairman CDA admitted that in 2004 NOC was issued to this scheme without fulfillment of the requirements of the CDA, however when the matter came into his notice, the NOC was cancelled. He further informed that the owners of Roshan Pakistan Scheme were advised to complete all the required formalities. In response they have provided documents resultantly CDA has issued NOC conditionally to the Scheme, with a clear-cut direction that all formalities may be completed within one month, otherwise NOC will be withdrawn. He informed the Committee that the owners of the schemes have given the documents of 1376 canals to the CDA.

The Committee expressing its dissatisfaction over the affairs of Roshan Pakistan Scheme advised to conduct a detailed inquiry on the allegations of allotment of the plots twice or thrice and also to withdraw approval of layout plan if they do not complete all the required formalities within stipulated time.

On the affairs of Jammu Kashmir Housing Society, the President and General Secretary of the Society informed that the management of the society had deposited the papers for layout plan of 2600 canals but the CDA has approved layout plan for two months only with the condition that society cannot start development work and even cannot give advertisement for starting of development work.

124 Syed Tahir Shahbaz, Chairman and S.M. Mustafain Kazmi, Member(Planning), CDA informed the Committee that the society has requested for layout plan of 2600 canals but practically they have given the ownership papers only for 1900 canals and therefore in this situation the society cannot be allowed to start development work and also for advertisement in the press. They assured that as and when the society will deposit ownership papers for remaining 700 canals, the society will be allowed to start development work and can also make advertisement in the press. Mr. Shahidullah Baig, Special Secretary Cabinet was also of the same view.

After listening the management of the society, Mr.Shahidullah Baig, Special Secretary Cabinet and CDA, the Committee advised to facilitate the society as possible. The Committee also advised to the management of the society to furnish the remaining papers of 700 canals to the CDA for the grant of layout plan/NOC on permanent basis.

Senator Ishaq Dar, Senator Mian Raza Rabbai, Senator Kamil Ali Agha and Senator Muhammad Talha Mehmood proposed some amendments in the Bill, which were unanimously approved by the Standing Committee. The Report of the Committee in this regard has been presented by the Chairperson Standing Committee in the sitting of the Senate held on 6th March, 2013.

Senator Mrs.Kasoom Parveen, Chairperson Standing Committee welcoming all the participants, initiated the proceedings of the Standing Committee informed that during the meeting of the Standing Committee on Privilege the concerned officials of Intelligence Bureau as well as DG, IB apology on the attitude of one of the official of the IB with the members of the Standing Committee and again apology in the meeting of the Standing Committee to the Chairperson and all the members of the Standing Committee. The Committee accepting the apologetic attitude of the management of the society deferred the agenda item for discussion in the next meeting of the Standing Committee.

On the affairs of Islamabad Officers Cooperative Housing Society, DC Islamabad informed that the election schedule of the society will be announced very shortly for holding the election within two months. He further informed that presently there are 44 members of the said society.

Senator Ghulam Ali raised a question regarding Plot No.29-G, G-9, Islamabad, subsequently the matter was referred to the Standing Committee on Cabinet Secretariat and Capital Administration & Development. Senator Ghulam Ali who was mover in this issue informed the Committee that a plot measuring 4089 SY has been illegally allotted to M/s Arif and other. Giving the history of this plot he informed that this plot was auctioned in 2003 but due to non-payment, the cancellation of plot was issued but later on due to manipulation and mutual understanding an application was submitted for the restoration of plot after about 8 years in spite of the fact the prices of real estate were increased tremendously in this period as thus about 7 billion has been given on the cost of Rs.39 crore. He further informed that a lot of hurry has been shown in the allotment of plot from one party to the other party (M/s Awami Trade Center). He was therefore of the view that a lot of corruption has been made in the whole process as allotment of plot has been made without depositing of transfer fee as well as arrears. He therefore requested that before final decision there is a dire need to assess the market value of this plot. He was of the view that by taking the actual price of the plot, the CDA can improve its financial position easily.

127 Senator Kamil Ali Agha also criticized on the whole process of the plot from 2003 to onward as if a person cannot deposit the amount in 2003 and how this plot was allotted to him on the same price in 2009. He therefore advised that a detailed inquiry may be conducted in this regard. Senator Col (R) Syed Tahir Hussain Mashhadi who also attended the meeting as observer also pointed out that all the affairs of the plot have been dealt in hastily therefore inquiry may be conducted. Senator Mrs. Rubina Khalid was of the view that fluctuation of the prices of the real estate business is a normal routine; therefore this aspect should also be kept in mind. Senator Saifullah Magsi proposed to conduct detailed inquiry into the matter. Senator Dr. Saeeda Iqbal informed that the matter is pending in the Court.

Senator Kalsoom Parveen, Chairperson Standing Committee advised CDA to clear its position on this allegation as prima facie appears that CDA has not observed its normal codal formalities. She further pointed out that it appears that some decision has been taken by CDA Board in haste. She also advised to give the reasons for increasing the storey of this Mall and how a plot cost of seven billion has been given at the cost of Rs.39 crore.

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs. Kalsoom Parveen on 9th April, 2013 at Islamabad.

The agenda before the Committee was as under:-

(i) Affairs of Health Services Academy (HSA) and NIH in the light of recommendations of the Standing Committee made in its previous meeting.

(ii) Detailed discussion on the administrative hierarchy of the Prime Minister’s National Health Complex, Islamabad.

The meeting started with the recitation of versus from the Holy Quran. After welcoming remarks, Senator Kalsoom Parveen Chairperson Standing Committee showed her deep concern over the non-implementation on the recommendations of the Standing Committee made in its meeting held on 16th October, 2012 regarding appointment of the head of HSA on permanent basis, as Dr.Huma Qureshi is presently holding the charge of HSA on acting charge basis and who is also looking after the work of PMRC and Tobacco Cell cannot give sufficient time to more than one department which is effecting the performance of these departments. She was of the view that she is already over-loaded, therefore an independent head of each department should be appointed immediately. She inquired about the rule position on the appointment on acting charge basis.

Senator Rubina Khalid was of the view that a number of experienced doctors are available; therefore a single person may not be given the charge of multiple departments. Senator Abdul Haseeb Khan stated that he has so many reservations on the affairs of HSA, as presently HSA has no its own institute and is functioning without any objective and plan. He therefore recommended that HSA should work according to its original vision, and also for the purpose for which it was established.

Senator Kamil Ali Agha also pointed out that the Committee had recommended about six months ago for the separate appointment of qualified / competent heads of HSA, PMRC/Tobacco Cell etc. but no action has been taken in this regard so far. He urged that independent appointment of head of each department can improve their performance therefore no institution should not be destroyed on the cost of any one.

Senator Dr. Mrs. Saeeda Iqbal stated that there are some vested interests behind the appointment on Acting Charge basis, therefore Acting Charge should be abolished immediately and appointment to the post of ED, HSA may be made on regular basis. She

131 pointed out that some institutes are charging heavy amount in the name of out-sourcing, but practically they take the same work from their own employees.

After detailed discussion on this issue the Committee strictly advised Cabinet Division that Acting Charge may be taken back immediately from Dr. Huma Qureshi and suitable person may be appointed to this post.

Mr. Omar Hamid Khan Khan, Senior Joint Secretary Cabinet assured that head of each department will be appointed on permanent basis within 15 days as acting charge can only be given for a very short period.

Senator Mrs.Kalsoom Parveen, Chairperson Standing Committee inquired about the names of institutions, who are giving donations to the HSA. Dr. Huma Qureshi informed that a German Institute was giving donation to the HSA, however the said institute has refused to give donation in future. She however informed that USAID had given an amount of Rs.770 millions and out of which only Rs.500 millions have been spent, while Rs.270 millions could not be used, and the amount was lapsed. All the members of the Committee showed strong concern, and were of the view that due to poor performance of the HSA donors are refusing to give donations to the institute, therefore the management of the HAS should improve the working of the Academy, as it happened only due to mismanagement and lack of planning in the HSA. The Committee advised to fix the responsibility against the responsible on the lapse of Rs.270 millions, as this amount could be used for different development or welfare projects, besides thousands of deserving people could be benefited through this money.

Senators Mrs.Kasloom Parveen, Rubina Khalid and Saeeda Iqbal inquired about the detail of officials who got training through HSA. They also enquired that whether all the trainees joined back to the HAS, or otherwise. In reply Dr. Huma Qureshi Acting ED, HSA informed that only three persons reported back to HSA. The Committee showed its deep concern on these state of affairs and advised that a complete list of trainees who got the training on the cost of HSA but did not return back may be submitted to the committee for information and further directed that in future proper guarantee may be obtained from trainees for serving for HSA.

Senator Mrs.Kasloom Parveen, Chairperson Standing Committee advised that un- necessary seminars may not be held, as these seminars have no utility at all, besides these are not creating any awareness amongst the common people, but only are the burden on the national exchequer.

The Committee further advised that the HSA Administration should take necessary steps for self-sustainability so that there should be no need of any donation, as HSA has sufficient scope for increasing its revenue. The Committee also advised that proper advertisement may also be made for the appointment of teaching faculty as soon as possible. The Committee also advised that cases of employees whose services were recently terminated by HAS may be reconsidered and they may be given chances till the recruitment on regular basis. Senator Kalsoom Parveen advised for verification of degrees of all the doctors/scientists working in the HAS and to submit report to the Committee. The Committee also advised to give complete

132 detail of employees serving on contract basis. It was also decided that in the next meeting, the Ministry of Law & Justice may also be invited to attend the meeting. The Committee also took serious notice that a person is sitting on the post of Coordinator Mid Victor Control even after his retirement since after about 10 years. The Committee therefore advised that he may be relieved from his duties and appointment to the post may be made from amongst existing eligible officers of the department.

On the proposal of Senator Mrs. Rubina Khalid, the Committee advised HSA administration to prepare a complete five years plan indicating the requirements and future planning of HSA.

Senator Mrs. Kalsoom Parveen also pointed out, that there are reports that in some cases people are being paid less salary as per agreed terms and conditions at the time of appointment, as it came to the notice in the case of Dr.Komal Jalil. She, therefore, advised to give complete detail of this case.

On the affairs of Tobacco Cell, Senator Mrs. Kalsoom Parveen pointed out that this Cell is not working efficiently, therefore she advised to give complete detail of meetings of Tobacco Cell with the concerned authorities for the eradication of Tobacco in the country. She pointed out that according to her information the use of Shisha and smoking is common practice in every restaurant / hotel of the Capital. She, therefore, advised to provide complete detail of performance of the Tobacco Cell.

While discussing the affairs of NIH, Chairperson Standing Committee pointed out that the no regular appointment to the post of ED, NIH has been made since last three years. She also inquired about the post of Joint Executive Director (JED). She further pointed out that there should be no unnecessary membership in the board of governors of the NIH and about the detail of officials of NIH, who are on ex-Pakistan leave and advised that the detail of doctors may be provided who proceeded abroad since 2001 but did not come back. Senator Abdul Haseeb Khan also recommended that the qualified and suitable person may be appointed on the sensitive posts.

Dr. Birjees Mazher Kazi, ED, NIH however informed that the post of ED NIH is of 21 grad and his also in grade 21 since last 3 years but he is still working on acting charge basis. As regard appointment on the post of JED, he informed that the present incumbent of the post is in B-20 since 2005, and she is the senior most from amongst the existing officers of the NIH.

The Committee advised that if the present incumbent of the post of ED NIH fulfills the requisite criteria/qualification, he may be appointed ED, NIH on permanent basis and if not appointed to the post may be made on permanent basis in any case.

Senator Kamil Ali Agha pointed out that M/s C&MB had manufactured interferon successfully and made experiment and 100,00 interferon injection were produced in 2008 with the approval of Ministry of Health, for clinical trial and raw material for a further one million injections was also produced, and the locally produced interferon was comparable in quality to WHO standard, as confirmed by a German analytical company, but the injections and the raw material were lost without use.

133 The Committee observed that if the interferon project had continued uninterrupted, locally produced interferon would have reached in to the reach of vast majority of poor hepatitis patients at affordable prices and the momentum generated at the production facility would have led to development of several other vitally important life savings drugs and thus could be saved millions of lives and money.

The Committee therefore unanimously advised that a team under the supervision of ED, NIH will jointly work out a strategy for indigenous production of interferon in the country and submit the report to the concerned department as well as to the Committee within two months

A proposal for regularization of all contractual employees of PMNHC may be submitted to the Cabinet Division and a report may be submitted to the Committee within a week.

Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs. Kalsoom Parveen on 24th April, 2013 at Islamabad.

The agenda before the Committee was as under:-

1) Implementation status on the recommendations of the Standing Committee made in the several meetings regarding Kuri Model Village and Park Enclave.

2) As pointed out by some honourable members of the Standing Committee, discussion on the terms and conditions under which land has given to M/s Bahria Town for Bahria Enclave scheme.

The meeting started with the recitation of versus from the Holy Quran. Senator Mrs. Kalsoom Parveen, Chairperson Standing Committee welcomed all the participants. At the outset Senator Dr. Saeed Iqbal showing strong reservations on the attitude of the administration of the CDA towards Parliamentarians informed that neither Chairman CDA nor members of CDA board bother to give the proper response and respect to the parliamentarians. The Chairperson advised Chairman CDA for improvement in behaviour and attitude towards parliamentarians. Chairman CDA apologized to the honourable members and assured for proper response and better coordination with the members in future.

Senator Kalsoom Parveen Chairperson Standing Committee on Cabinet Secretariat & CAD stated that there were a lot of expectations from new team of CDA for improving the situation in the authority; however the Committee has still so many reservations on the performance of the CDA, as no visible improvement has been noticed. She pointed out that in spite of the fact that the people have deposited amount in the Kuri Model Village Scheme since last 15-16 years, but no development work could be started so far and similarly the affairs of Park Enclave Scheme are also not being handled properly, as even after lapse of two years there is no reasonable improvement in giving the possession of plots to the applicants, as well as also in the development work. She stated that Standing Committee had given recommendations so many times in this regard, but all in vain. She indicated that due to poor performance of CDA people are taking back their money from this scheme.

Giving the reply of above queries and observations, Syed Tahir Shahbaz, Chairman CDA admitted that there is a little delay in the development work; however there is no any issue of financial problems in the execution of all development schemes of the project. He indicated that according to direction of the Standing Committee development work of the scheme has been started and tenders of some projects have already been opened and all the

135 development work will be completed up to 31st December, 2013. He informed the Committee that after negotiations with NAB it has been decided that there is no need of re-balloting of the plots, as in the case of re-balloting there were chances of going the matter in to courts. He further informed that mostly the people have deposited down payments of their plots so far and no one has deposited the full payment of the plot. He informed that according to policy amount deposited for plots can be refunded in case of demand by the applicant.

Ms.Shaista Sohail, Member (Estate), CDA also informed that all the issues relating to land acquisition have been solved and work of boundary wall has been almost completed. She informed that the design of the scheme has been completed by the CDA at its own, which has been divided into different phases. Giving the detail of development work, she informed that the work has already been started on the construction of internal roads, water supply, mosque, sewerage and water treatment plant etc.

Senator Mrs.Kalsoom Parveen, Chairperson Standing Committee pointed out that due to inefficiency and poor performance the prices of CDA schemes are going down, while the prices of plots of Bahria Enclave Scheme are going up, although the site of Bahria Enclave is far away from the CDA scheme.

Senator Kamil Ali Agha stated that it seems lack of interest of the CDA officials in the development of Park Enclave Scheme. He was not satisfied with the CDA officials in handling the affairs of the scheme as due to poor performance people are drawing money from the project, which clearly indicates their dissatisfaction on the project. He therefore advised that being state owned organization CDA should be a role model for others. He recommended that CDA may give a monthly plan for execution of development work of the Park Enclave Scheme for the monitoring of the Committee.

Senator Dr. Saeeda Iqbal enquired that why CDA has given permission to the farmers for the cultivation of crops in the scheme area, although it was in the possession of the CDA for the last two years and CDA has already made payments at the time of acquisition of this land. She, therefore, advised that the Enforcement Wing of the authority should be activated for the proper safeguard of the CDA land.

Senator Mushahid Ullah Khan also pointed out that due to inefficiency of the enforcement wing of the CDA, the land mafia has occupied the official land in the various parts of its territory, therefore there is need to remove the deficiencies of the Enforcement Wing on priority basis.

The Chairman CDA assured for moving forward according to the observations of the members of the Standing Committee.

On the affairs of Kuri Model Village scheme, Chairperson enquired about the total number of plots and also about the fate of the findings of the FIA in this regard. She also enquired about the number of people, who were allotted plots on bogus papers in this scheme. Ms.Shaista Sohail, Member CDA informed that in the light of the findings of the FIA report and no clear cut reply of the NAB, it has been decided that in coordination with local people decision

136 for allotment of plots will be taken at site. She however informed that 592 plots are intact. She assured that at the end of May, 2013 the issue of allotment of plots will be solved amicably, and after that the development work will be started immediately.

After detailed discussion the committee decided that:

(i) CDA should fix target for the completion of all development work of the Park Enclave Scheme up to 31st December, 2013 and monthly progress report in this regard will be submitted to the Committee for information.

(ii) The process of giving possession of plots to the allottees should be started soon after 31st December.

(iii) Enforcement Wing of the CDA may be reorganized. An exclusive meeting of the Standing Committee will be held very shortly for detailed briefing on the reorganization/ performance of the Enforcement Wing of CDA.

(iv) Similarly the Legal Wing of the CDA should also be reorganized and progress of lawyers on CDA pool may be monitored regularly on monthly basis.

(v) The Legal Department should take immediate steps for giving importance to the priority cases.

(vi) All Litigation cases of Kuri Housing Scheme should be cleared up to 31st May, 2013.

(vii) Allotment may be made immediately of all the clear cases of Kuri Model Scheme and thereafter the cases of disputed plots may be taken up for decision.

(viii) After 31st May, 2013 CDA will inform the Committee about the actual position of the Kuri Housing Scheme.

(ix) Cabinet Division should play its supervisory role into all the affairs of the CDA.

While starting discussion on the issue of construction of road by M/s Bahria Town in Kurri Model Village Scheme, Chairperson and other members of the Committee enquired about the terms and conditions, on which Bahria Town was given contract for the construction of road. Chairperson Standing Committee further pointed out that it has been reported in the press that Bahria Town has increased the cost of their plots from 60 lakhs to 85 lakhs. Senator Kamil Ali Agha stated that on one hand Bahria Town increases prices of their plots without any proper justification, and on the other hand it does not give the possession of plots to the allottees in time.

137 Brig(R) Rauf Raja, Asst. Chief Executive Bahria Town informed that Bahria Town has constructed road at the cost of Rs.750 million in the area, which will be beneficial for all, as this road will remain the property of CDA, and it will be used as a thoroughfare for all the commuters. The representative of M/s Bahria Town informed that Bahria Town has not increased the prices of already allotted plots, while the prices of new allotted plots are governed by the market value. He further said that CDA has no concern with the price mechanism of Bahria Town plots.

The Committee advised that Bahria Town should not increase the prices of its plots without proper justification, besides if any allottee deposits full cost of his plot, he may be given possession of his plot immediately. The Committee also advised CDA and Bahria Town to furnish the details of land purchased by the Bahria Town for Bahria Enclave scheme, its original layout plan, extension layout plan.

After discussion on the formal agenda items, Senator Kamil Ali Agha informed that there are daily incidents of exchange of gun fire in the Bani Gala Housing Scheme (near Rawal Dam). He informed that according to his information some land mafias have illegally occupied the CDA land in the area and they are also allotting the official land to the people. He advised that official land which is in occupation of land mafias may be got vacated and parks may be constructed on this land for the general public. The Chairman CDA assured for taking action in this regard.

Senator Mrs. Kalsoom Parveen, Chairperson Standing Committee enquired about the latest status of plot No.29, G-9/4 and plot given to Saif Co., Dubai. Chairman CDA informed that the cases are still in the Islamabad High Court however the Commission constituted for the enquiry of different cases of CDA (including these two plots) has already given its recommendations to the Islamabad High Court, and as soon as the Commission’s report is opened by the Court, it will be brought into the notice of the Standing Committee.

A meeting of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 28th May, 2013 at Parliament House, Islamabad.

The agenda before the Committee was as under:-

(i) Discussion on the affairs of multi-professional employees cooperative housing society Islamabad with particular reference to number of members / plots and number of schemes and details of investment made outside the society areas.

(ii) Discussion on the affairs of Ministry of Interior cooperative housing society with particular reference to allotment of plots to the members and also on development work.

(iii) Discussion on present status of report, submitted by the judicial commission pertaining to various projects of CDA, in Islamabad High Court.

The meeting started with the recitation from Holy Quran. The Chairperson Standing Committee welcomed all the participants. Before starting discussion on normal agenda items, Senator Kalsoom Parveen Chairperson Standing Committee advised CADD / PIMS administration to brief on the recent incident of indiscipline in PIMS, in which a senior doctor of PIMS misusing his authority misbehaved with a trainee doctor. The Additional Secretary CADD, administrator PIMS and the inquiry officer informed the Committee that an inquiry was conducted to probe into the incident, however, no concrete evidence of misbehave has been brought into the notice of the one man inquiry committee. All the Committee members showing dissatisfaction on the report of the inquiry officer advised Ministry of Capital Administration & Development that a three member impartial inquiry committee may be constituted, which may conclude its findings within 10 days. The Committee showing its serious reservations on the performance of the PIMS constituted a three member Sub-Committee consisting on Senator Kamil Ali Agha as Convener and Senator Dr. Saeeda Iqbal & Senator Rubina Khalid as members. The TOR of the Sub-Committee will be as under:-

i) Indiscipline / non-provision of proper medicines to the patients and poor condition of equipments installed for various types of clinical tests / examinations in the PIMS.

ii) The Committee will submit its report within 2 months.

139 After that Chairperson Standing Committee advised the management of the multi- professional employees housing society to provide detail of its various schemes.

Mr. Abdul Majeed Chaudhary Secretary multi-professional employees housing society informed that work in E-11, E-13, B-17, B-18 and F-17 is almost complete and the people are residing in these schemes. He also informed that the management of the society is providing adequate security to the people by installing security cameras to the residents. Giving further detail, he indicated that the facilities of schools, hospitals, parking, graveyard and underground parking etc have been provided to the people residing in these schemes. He however, informed that the society had made investment on a piece of land of 54 acres as joint venture with CDA. However, later on Supreme Court of Pakistan had given direction that CDA cannot develop any land as joint venture, therefore, this deal was cancelled. He informed that the management has approached the CDA for refunding of their dues of the society incurred on this scheme.

Chairman CDA Mr. Tahir Shahbaz informed the Committee that CDA has no major problems with the multi-professional employees housing society, as it has reasonably delivered to the members of the society by providing them developed plots in time.

Senator Kalsoom Parveen and all the Committee members appreciating the performance of the management of the society advised that CDA should refund their dues as soon as possible.

On the affairs of Interior employees cooperative housing society General Secretary of the management informed that the society was registered in 1984 and the first layout plan of the society of 1629 kanals has been approved and the second one is in progress. He informed that CDA has acquired 829 kanals land which was the property of the society therefore, CDA may be advised to compensate the society for the satisfaction of the members of the housing society. He also gave the detail of land purchased and present status of development etc.

Senator Kalsoom Parveen Chairperson Standing Committee raising questions / queries enquired that as to why new members were given priority in the allotment of plots on the founder members. She also enquired about the land purchased in shaamlats and with affiliations. She advised that detail of total land purchased, number of members, plots allotment made so far and reasons for not completing development work in time may be submitted to the committee at the earliest. Chairperson Standing Committee also advised that CDA and the management of the society should settle the issue of 829 kanals with mutual understanding and report in this regard may be submitted for the information of the Standing Committee.

The Committee decided that meetings of the Committee will be held for detailed discussion on various projects of CDA pending in Islamabad High Court in due course of time.

Subject:- MINUTES OF THE MEETING OF THE SENATE STANDING COMMITTEE ON CABINET SECRETARIAT AND CPITAL ADMINISTRATION AND DEVELOPMENT.

A visit of the Senate Standing Committee on Cabinet Secretariat and Capital Administration & Development was held under the Chairpersonship of Senator Mrs.Kalsoom Parveen on 11th June, 2013 at Federal Government Services Hospital (Polyclinic), Islamabad.

The agenda before the Committee was as under:-

(i) Shifting of Emergency Ward from Houses into the original building of the hospital.

(ii) Provision of low quality / sub-standard and inadequate medicines.

(iii) Lack of life saving procedures and investigation.

(iv) Dilapidated condition of General and Officers Wards.

(v) Detail of promotion in Gazette cadre of non-graduates.

(vi) Misuse of government officials.

The meeting started with the recitation from Holy Quran. Before starting normal discussion on agenda items, Senator Kalsoom Parveen, Chairperson Standing Committee on Cabinet enquired about the protest of some employees at the entry gate of Policlinic, Dr. Iftikhar Naaro and some other officials of the Polyclinic informed that meetings of the departmental recruitment committee were held for the selection of 128 technical / non-technical officials, which have been cancelled, therefore, the affectees were protesting at the gate of the hospital. Senator Kalsoom Parveen Chairperson Standing Committee advised Additional Secretary CADD to brief on this issue.

Mr. Abdul Latif Laghari Additional Secretary CADD informed that a section officer of Ministry of CADD (who is also member of the departmental recruitment committee) raised some observations on the experience certificate required for some technical posts before the Secretary CADD resultantly Secretary CADD cancelled whole the process of recruitment.

On a query raised by the Chairperson Standing Committee on Cabinet, the hospital authorities informed that ED Polyclinic is competent authority in the recruitment of these posts. After listening the view point of Ministry of CADD and administration of Polyclinic, the Committee advised that:-

i) In future the cases of all appointments under the preview of ED Polyclinic should not be sent to the Ministry of CADD.

ii) The recommendations of the departmental recruitment committee may not be dispensed with.

141 iii) The appointment letters may be issued to all successful / eligible candidates subject to observation of provincial / regional quota.

On some other issues of the Polyclinic Hospital, the Committee further recommended that:-

1) Special check and balance system may be evolved for the medicines being purchased in bulk and also through local purchase.

2) The number of posts of pharmacists may be increased as soon as possible. The administration of the Polyclinic should furnish their requirement into the Ministry of CADD for the creation of new posts.

3) Number of medical stores for local purchase should be increased to avoid undue delay in the provision of medicines and the concerned medical stores should be advised to provide medicine to the patients.

4) To provide facilities to the people the equipment installed for MRI test and city scan may be replaced immediately, as the present machines are outdated.

5) The issue of 2.54 acres of land of Argentina Park may be solved in consultation with all concerned. The issue will be discussed in the next meeting of the Standing Committee with all relevant departments.

6) After the expansion of Polyclinic, the emergency ward may be shifted in the main building of the Hospital.

7) In coordination with Pakistan Computer Bureau computerization system may be completed on priority basis for the registration of patients and for medicines.

8) Special steps may be taken for the provision of qualitative medicines to the patients.

9) Special attention and care may be provided to all, specially the poor patients.

10) On the basis of army doctors the promotion process of doctors may be improved and all irrelevant hurdles may be removed in the promotion of female doctors.

11) No discriminatory treatment may be made in the duty roaster of nurses especially in night duty.

12) Immediate action may be taken for giving promotion to the nurses and there should be no discriminatory treatment to anyone.
