Emergency Ruling in Regard to Livestreaming Services Rabbi David J Fine, PhD President, New Jersey Rabbinical Assembly March 14, 2020 Psak Din: In the current state of emergency, where most of our congregations have closed their doors in the midst of the containment efforts of the COVID-19 crisis, live streamed services of even a single individual (the shaliah tzibbur) may be deemed a minyan when at least nine others eligible to count in a minyan are connected to the site at the time of the live streaming. In 2001, the Committee on Jewish Law and Standards of the Conservative movement (CJLS) approved a responsum by Rabbi Avram Israel Reisner by a vote of 18-2, that permitted one to perform one’s obligation to participate in prayer, hear the Torah, shofar, megillah and say kaddish when connected to a minyan through the internet. However, Rabbi Reisner required a minyan of ten eligible Jews to constitute a live minyan at the source of the “broadcast.” That decision was reasoned through a careful reading of the relevant precedents regarding when one can fulfill an obligation when in “ear-shot” but not in the same room as the minyan, and gave important consideration as well to the importance of live face-to-face gatherings. In the nineteen years that have passed since Rabbi Reisner’s paper was approved by the CJLS, we have seen an extraordinary increase in the development and use of technology towards virtual meeting space.

    Parashat Tazria 2008 Rabbi David Silverberg Most of Parashat Tazria is devoted to the laws of tzara'at , different forms of skin discoloration that renders an individual tamei (ritually impure). The Mishna (Negaim 4:11) writes that a discoloration on a person's skin renders him tamei only if it surfaced prior to the discoloration of the hair on that spot of the skin. If the person's hair first turned white, and this discoloration was then followed by a whitening of the skin, the individual is not rendered tamei . The Mishna then proceeds to record a debate concerning an individual's status in a case where he is uncertain whether the discoloration first surfaced on the skin or on the hair. Whereas the majority view maintains that the person is indeed tamei in such a case, Rabbi Yehoshua was of the opinion that he is not tamei unless he knows for certain that the skin changed color before the hair. The Talmud (Bava Metzia 86a) records a remarkable and startling story relevant to this halakhic debate, telling that an argument surfaced in the "heavenly academy" on this very issue. The "students" of the academy followed the majority view, rendering an individual tamei if he cannot ascertain whether the skin changed color before the hair, while the Almighty Himself, as it were, insisted that the person remains ritually pure in this case. They decided to summon a certain sage named Rabba Bar Nachmani, who was an expert in this area of Halakha and could thus provide the authoritative ruling on this issue.

Shane Dingman, The Globe and Mail, Volkswagen’s deception, and how it was discovered, Sept. 22 ‘15 To sell a car in North America, the company must prove it is in compliance with the U.S. Clean Air Act. Cars must pass tests such as the EPA’s Urban Dynamometer Driving Schedule (UDDS), also known as “the city test” – an 11.9 km test at an average speed of 30.6 km per hour, or the Highway Fuel Economy Test, which is a 16-km test at an average speed of 77.2 kph. The test measures pollutant in emissions and involves very specific calibrations to which car-makers and testers have agreed. VW has yet to describe publicly how it engineered its defeat device, but the EPA says VW’s onboard computer software recognized the test conditions – perhaps because the car steering wheel was not turning at high speed – and activated technology that would capture Nox [nitrogen oxides] and allow it to pass the test.     A Response to Dr. Shapiro: A Defense of the Torah Temimah A Response to Dr. Shaprio: A Defense of the Torah Temimahby: Y. Lander (of the Ishim v’Shitot blog) I read with interest Dr. Shapiro’s recent post questioning the accuracy of R’ Baruch Epstein’s tale concerning his dialogue with the Netziv’s first wife, Rayna Batya. Dr. Shapiro points to several discrepancies in R. Epstein’s account and based on those discrepancies posits that R’ Baruch deliberately contrived the story in order to call attention to the plight of women in his time. I would like, however, to present a more prosaic but equally plausible interpretation of the discrepancies that Dr. Shapiro notes. Dr. Shapiro refers to the “the well-attested fact that Epstein was a plagiarizer” [1] and therefore one must be suspicious of anything he writes. That Epstein frequently fails to provide proper attribution when quoting other authors is certainly irrefutable but I am not at all certain that this was due to conscious plagiarism. I found that only two of Epstein’s works show significant signs of plagiarism –Torah Temimah and Tosefes Bracha[2] – whereas the chiddushei Torah cited in Mekor Baruch and Baruch She’Amar (Tefillah and Pirkei Avot) are original. If Epstein was indeed a plagiarizer then from where did he get the sudden burst of originality that appears in the latter two works? Why would he plagiarize in Torah Temimah, stop for Mekor Baruch and then continue in Tosefes Bracha? Further, Y. Bezek, in the article cited by Shapiro, points out that among the sources that R’ Epstein plagiarizes is Maimonides Sefer Hamitzvos.
