In their complaint, plain- tiffs dispute the manner in which Nuanuaolefeagaiga was selected. Plaintiffs had argued the defendant’s selection did not comply with requirement of the law. The Trial Division of the High Court issued a decision on Mar. 31st, which the plaintiffs say did not reach the facts of the case, but granted the defen- dant’s motion to dismiss on the basis that the plaintiffs had no standing to bring this cause of action. (See Samoa News edi- tion Apr. 6th on court’s deci- sion dismissing plaintiffs’ challenge.) In its decision, the court found that plaintiffs lacked standing both as private citizens and as representatives of the Ta’u County Council. And as private citizens, the court said that plaintiffs failed to state any harm or particularized injury to them, according to the plaintiffs. And as representatives of the Ta’u Village Council, the court determined that Ta’u County alone could not assert standing because the senatorial elections were something particular to all three counties — Ta’u, Faleasao and Fitiuta. However, plaintiffs disagree with the court, and say that as private citizens and matai, plaintiffs represent the interest of their families and villages. “Unlike a voter for the posi- tions of governor or a member of the [local] House, who vote based on their independent and individual interest,” the motion states, “plaintiffs as senator electors represent the individual members of their Samoan com- munal families when casting their votes.” Plaintiffs believe that “this elevates the position of the matai to a higher standing than that of the average voter.” Plaintiffs also argue that the injury to them as matai and the injury to them as members of the Ta’u County Council are Page 4 samoa news, Thursday May, 11 2017 Letter to the Editor

[ata: Leua Aiono Frost] Amata announces winner of the MALOFIE Congressional Art Competition 2017 (BASED ON A PRESS RELEASE) — Washington, DC — Wednesday, May 10, 2017 — Congresswoman Aumua Amata has announced the winner of the 2017 MALOFIE Congressional Art Competition — Pacific Horizon’s Ms. Nina Vergara. The competition was held on April 21, 2017 at the Sadie’s By The Sea Hotel; and the winner’s piece will be displayed in the US Capitol building with other pieces of art from across the country. Nine entries from both public and private high schools from the territory competed for the honor. The competition was judged by three individuals with back- grounds in both Art and Education; Mrs. Rhonda Logologo- Huang, Principal of Aua Elementary School, Ms. Mandy Autaga- vaia, an elei designer from the Independent State of Samoa, and Mr. Sungju Myung, an educator and a student at the United States Military Academy at West Point, New York. First place went to Pacific Horizon’s Vergara, second place went to Ms. Fa’ae’e Laolagi of Samoana, and third place was given to Mr. Siuki Michael Lawrence Sionesini of Samoana High School. For the second year in a row, Hawaiian Airlines offered to pay the round trip ticket for the winner to the nearest airport in the U.S. that Southwest Airlines fly out of so the winner can travel to Washington D.C. to be part of the banquet held for all the winners across the United States and its Territories. Southwest Airlines has been a sponsor for the Congressional Art Competition for years and they fly the winners to and from Washington D.C. for the celebration for free. “I want to congratulate our winners, and all of the other par- ticipants,” said Amata. “It is always a pleasure for me, whenever I am walking over to the Capitol, to see our young people’s art- work hanging on the wall, as it always gives me a little taste of home. I am proud of the talent our students have, and want to encourage them to continue reaching for their goals,” continued Amata. “I also want to thank this year’s sponsors for their gen- erous contributions, and without whose efforts this event would not have been able to take place,” concluded Amata. Congresswoman Aumua Amata and her staff would like to recognize and thank the following businesses and individuals for their generous contributions to this year’s competition: Hawaiian Airlines, McDonald’s of American Samoa, Happy World, the Honorable Representative Kitara Vaiau, the Honorable Represen- tative Sam Meleisea, Daily Store, Happy Trucking, Talofa Air- ways, Paramount Builders, iBC Store, Star Kist Samoa Inc., KDJ Kristopher’s Store, Lima Fesoasoani, Tutuila Store, S.O.F.I.A.S., Pago Airport Inn, Blue Sky American Samoa, KS Mart, Matai’s Restaurant, and Samoa Motors. North Korea claims the pri- mary suspect is a man it has identified only by the ubiqui- tous surname “Kim.” It says he is a North Korean resident of Pyongyang who worked for a time in the Russian Far East. State media said he was involved in the timber industry in Khabarovsk, which is one of the primary places North Koreans can go overseas to work. The North further said that a South Korean agent named Jo Ki Chol and a “secret agent” named Xu Guanghai, director general of the Qingdao NAZCA Trade Co. Ltd., met Kim in Dandong, on North Korea’s border with China, to give him communications equipment and cash. The North also said “a guy surnamed Han” taught Kim how to enlist accomplices. “These terrorists plotted and planned in detail for the use of biochemical substances including radioactive and poi- sonous substances as the means of assassination,” Vice Minister Han said, reading from a pre- pared statement. “These bio- chemical substances were to be provided with the assistance of the CIA ... while the South Korean Intelligence Service was going to provide necessary support and funding for this attempt at assassination on our supreme leader.” In statements for foreign distribution, North Korea often refers to its leader Kim Jong Un without naming him, instead using the phrase “supreme lead- Page 16 samoa news, Thursday May, 11 2017 Syrian Kurds clear mines after taking town, dam from IS

BEIRUT (AP) — Syrian The capture of Tabqa, a key Kurdish-led forces were step in the advance on Raqqa, clearing mines at the country’s the extremist group’s de-facto largest dam and the nearby town capital, came seven weeks after of Tabqa on Thursday, a day the launch of the Kurdish-led after seizing them from Islamic offensive, backed by the U.S.- State militants. led international coalition. It also came a day after the Trump administration announced it will supply the Kurdish-led Syrian Democratic Forces with heavier weapons, a decision that infuriated Turkey, which views the main Kurdish militia in the group as an exten- sion of an outlawed rebel move- ment fighting an insurgency in its southeast. The SDF, which also includes Arab fighters, has captured large swathes of land in northern Syria from IS with the help of U.S.-led airstrikes. But the Kurdish YPG, which forms the backbone of the group, is linked to the Kurdistan Workers’ Party, or PKK, which Turkey, the U.S. and other Western nations view as a terrorist group. Turkish President Recep Tayyip Erdogan called on the U.S. to reverse its decision, saying weapons in the hands of the Kurdish-led forces are a “threat” to his country. Unnerved by the Kurdish advances along the border, Turkey sent troops into Syria last year to help allied Syrian forces battle IS and block the SDF. The capture of Tabqa sets the stage for an advance on Raqqa, some 25 miles (40 kilometers) to the east. C M A spokesman for the coali- tion, Col. John Dorrian, said Y K that after Tabqa is secured, the Syrian Kurdish-led forces will continue operations to “isolate and seize Raqqa.” Dorrian said 30,000 residents had been displaced since the fight for Tabqa began on March 21, and that the priority was now to protect those who remained. The media office of the Syrian Democratic Forces said Thursday a special operation was underway to de-mine the dam and the surrounding area. Concerns were raised ear- lier this year that the dam could be damaged in the fighting or degraded by lack of mainte- nance, or that the extremists might sabotage it to flood the surrounding areas.
