Euro-Burma Office 26 March to 1 April 2011 Election Monitor POLITICAL MONITOR NO. 12 LEGISLATIVE, EXECUTIVE AND JUDICIAL POWERS OF SPDC TRANSFERED TO UNION LEVEL ORGANIZATIONS AND OFFICIALS Republic of the Union of Myanmar State Peace and Development Council Notification No. 5/2011 11th Waning of Tabaung, 1372 ME 30 March 2011 1. Formation of Union level organizations and election of Union level persons related to legislature, executive and judiciary and seeking of approval of the Hluttaw have been done in accord with the relevant laws and rules at Pyidaungsu Hluttaw, Pyithu Hluttaw and Amyotha Hluttaw formed in accordance with the Constitution of the Republic of the Union of Myanmar which came into force on 31 January 2011. 2. It is hereby announced that legislative, executive and judicial powers exercised by the State Peace and Development Council have been transferred to the Union level persons who were elected in accord with the relevant laws and rules and approved by the Hluttaw from the time they made affirmation at the Pyidaungsu Hluttaw on 30 March 2011. 3. Election of Region or State level persons related to legislature, executive and judiciary and seeking of approval of the Hluttaw have been done in accord with the relevant laws and rules at Region or State Hluttaws formed in accordance with the Constitution of the Republic of the Union of Myanmar which came into force on 31 January 2011. 2. Section 56 of the Constitution of the Republic of the Union of Myanmar which came into force on 31 January 2011, delineates the Self-Administered Divisions and Self-Administered Zones as follows:- (a) grouping Leshi, Lahe and Nanyun townships in Sagaing Region as Naga Self-Administered Zone; (b) grouping Ywangan and Pindaya townships in Shan State as Danu Self- Administered Zone; (c) grouping Hopong, Hsihseng and Pinlaung townships in Shan State as Pa-O Self-Administered Zone; (d) grouping Namhsan and Manton townships in Shan State as Palaung Self- Administered Zone; (e) grouping Laukkai district, Laukkai and Kongyan townships in Shan State as Kokang Self- Administered Zone; (f) grouping Hopan district, Hopan, Mongmao, Panwaing, Naphan, Metmung and Pansang (Pankham) townships in Shan State as Wa Self-Administered Division. 2. In accord with the Constitution of the Republic of the Union of Myanmar, formation of the Leading Bodies of the Self-Administered Division and Self- Administered Zone has been done in accord with relevant law at Self-Administered Division and Self-Administered Zones. 3. It is hereby announced that legislative and executive powers of Self-Administered Division and Self-Administered Zones have been transferred to the members of Leading Bodies of the Self- Administered Division and Self-Administered Zones formed in accordance with the relevant law from the time they made affirmation at the Offices of the Leading Bodies of the Self- Administered Division and Self-Administered Zones on 30 March 2011. 4. Section 288 of the Constitution of the Republic of the Union of Myanmar states “Administration of district and township level shall be assigned to the Civil Service personnel” and Section 289 states “Administration of ward or village-tract shall be assigned in accord with the law to a person whose integrity is respected by the community”. 2. Respective Region or State Peace and Development Councils reported that the relevant persons at District, Township and Ward or Village-tracts are ready to take over duties and functions of District, Township and Ward or Village-Tract Peace and Development Councils. 3. Hence, the duties and functions of the following District, Township and Ward or Village-tract Peace and Development Councils were handed over to persons shown against each commencing 30 March 2011. (a) District Peace and Development Council Deputy Commissioner of District General Administration Department (b) Township Peace and Development Administrator of Township Council General Administration Department (c) Ward or Village—tract Peace and Head of Ward and Village-tract Development Council 4.
