1 Review

1.1 Project Introduction

Henan Wastewater Management and Water Supply Sector Project (WWTP & WSP) financed by Asian Development Bank (ADB) includes 19 subprojects, 4 water supply projects and 15 waste water treatment project. Four cities including , , , and 14 counties of Haihe Basin are involved in the projects.

Haihe Basin is one of the worst polluted water system in China and more than 80% have been polluted. Henan is the second biggest province in Haihe Basin and five cities in its north part: Anyang, Jiaozuo, Puyang, Xinxiang and . The main rivers of these five cities have been polluted by family or industry sewage. And the pollution dose impact the middle line engineering through Henan Province of South-to-North Water Diversion. The construction of these projects will improve the waste water management and water supply of these five cities and will make environment and public sanitation better and control the pollution of Haihe Basin. These projects will help to improve the surface and underground water quality of these five cities and downriver cities and the protection of water quality and the reduction of water disease will help to improve the living quality of poor people in city.

According to subproject resettlement plan, in Henan wastewater management and water supply sector project financed by ADB resettlement impact are land acquisition and temporary land acquisition.

1.2 Monitoring and Evaluation

In order to supervise the implementation of resettlement action and ensure resettlers keep at least same living level, the 1st Independent Monitoring and Evaluation (IM&E) of the project is carried out in July, 2005. We find existing or potential problems and give suggestions by checking land requisition and resettlement pace, capital, management and life & production changing before and after resettlement. In the 2nd Independent Monitoring and Evaluation carried out in December, 2005, our monitoring staff followed and checked the problems found in the first M&E, further checked land requisition and resettlement pace, capital, management, and gave related suggestions on the existing and potential problems in resettlement. And then, in the 3rd Independent Monitoring and Evaluation carried out in November, 2006, the implementation situation on the suggestions proposed in the 2nd time was investigated, the income restoration of

affected households was evaluated through tracking investigation, and further suggestions on the remaining problems were also proposed.

It is the 4th Independent Monitoring and Evaluation starting from July, 2007. Monitoring staff of NRCR, Hohai University went to investigate all the 19 projects in the 14 towns of the 4 cities. Monitoring team had done a tracking investigation on the resettlement implementation, resettlement funds and income restoration of affected households, checked the problems found in the 3rd time, and proposed relevant suggestions on the new problems.

In January, 2008, the 5th Independent Monitoring and Evaluation on this project was started. The data of resettlement impacts, resettlement fund flow by the time of this period of Monitoring and Evaluation would be collected and compared with RAP; the actual compensation and resettlement schedule would be investigated according to the schedule in RAP; the transaction of land use license, resettlement information publicity, and public participation would be investigated; whether there are complains and appeals to the resettlement work and policy would be investigated; the baseline data of the affected households of the subprojects which have been adjusted would be prepared.

It is the 6th Independent Monitoring and Evaluation starting from November, 2008. Through the data which were collected by each subprojects, we would evaluate whether the schedules and the effects of each subprojects meet the requirements of the RAP on the basis of the 5th Independent Monitoring and Evaluation. The analysis should be done if the result is unconformity with RAP. The subprojects which have been adjusted would be done a tracking investigation.

In December 2009, the 7th Independent Monitoring and Evaluation on this project was started. According to the schedule of Independent Monitoring and Evaluation, it is the final one. Therefore, the data of resettlement impacts, resettlement fund flow by the time of this period of Monitoring and Evaluation would be collected and compared with RAP; the actual compensation and resettlement schedule would be investigated according to the schedule in RAP; the transaction of land use license, resettlement information publicity, and public participation would be investigated; whether there are complains and appeals to the resettlement work and policy would be investigated;and at last, it will explain the overall situation of immigrant revenue recovery by tables and chart.

2 Monitoring and Evaluation on Resettlement Executing Institution

In order to ensure smooth implementation of the projects , implement the RAP well, strengthen the supervision and management of resettlement action and achieve the target of the resettlement, all levels of Henan set up Provincial, Municipal, and Country Project Office, and form a management system from top to bottom.

Henan Water Pollution Control Project Financed by ADB Leading Team office is set up in No.2 office of foreign financed office of Henan Provincial Department of Finance (Henan Provincial ADB Financed Project Office)and takes in charge of resettlement management of the projects. The subproject office of each country has responsibility for concrete resettlement work. Muncipal project office takes the responsibility of coordination and contact.

In the implementation of project resettlement work, project offices of each level try their best to finish their own work. Each project sets up internal monitoring system and there is peoson specially assigned for the work. Meanwhile, the resettlement implementation institutions of each level have set up appeal system to guarantee a transparent and effective channel, therefore, they can solve the problems and requests of Dps in time.

The PMO adopted an internal monitoring mechanism to examine the resettlement implementation. During land acquisition, Henan Project Office and sub-project departments had persons specially assigned for monitoring and examining. They examined fund utilization, land requisition process, and restore of resettler income. Once discovering some problems, they would report to the leading group timely and consulted with resettlers concerned to solve them. Report forms are used to respond the questions on resettlement from ADB in time. The results of investigation indicate that management and implementation institutions set up an external independent mechanism and internal mechanism of M&E and fulfil their own responsibility and task in the resettlement implementation.

Monitoring & Evaluation suggests that the staff in related organizations should have further training on resettlement policy and implementation and this training should combine theory study with visit on the spot. Especially they should investigate and study the projects financed by ADB and add the institution efficiency and ability.

3 Schedule of Project Land Acquisition

3.1 Land Acquisition Procedure

According to No.3 order of Ministry of Land and Resources- Administration Approach on Construction Land Checkup and Approval, the checkup and approval procedure of new construction land is: land prejudication, project decision, land using application, planning, checkup and approval, implementation, land register: z According to project approval document and land using approval, municipal or county National Land Resource Bureau or the town governments, street offices involved in land acquisition investigate the approved construction land and freeze it. Any organization and individuals cannot use or explore this land without legal permission. z On the basis of investigation and other materials of land acquisition, municipal National Land &Resource Bureau sign land acquisition agreement with landowner of land acquisition after checkup and confirmation. z Publicize land acquisition plan and the policies, procedures, resettlement plan of land acquisition and compensation price. The scope of land acquisition and purpose also should be open for participation and supervision. z Village collective economic organizations and their members and other obliges

should be compensated and resettled and land acquisition compensation

should be handed out in time.

3.2 Transaction stage of Land Acquisition Procedure

(1) Permanent acquisition

Up to December, 2009, in the 19 subprojects:

13 subprojects including Anyang WWTP, Linzhou WWTP, Huaxian WWTP, Neihuang WWTP, WWTP, Huojia WWTP, Yanjin WWTP, Wenxian WWTP, Wuzhi WWTP, Qingfeng WWTP, Changyuan WWTP, Puyang WWTP and Nanle WWTP have finished the transaction of land acquisition procedure and got the land use licenses;

Land acquisition application of 2 subprojects including Weihui WSP and Fengqiu WWTP have been approved by the Ministry of Land and Resource;

Land acquisition applications of Boai WWTP have been submitted to the Ministry of

Land and Resource;

Resettlement impacts of Puyang WWTP have been changed greatly because of site-selection, so the RAP has been updated by the end of Dec., 2007. But it had finished the transaction of land acquisition procedure and got the land use licenses.

Resettlement impacts of both Qingfeng WSP and Boai WSP have been changed because of design scheme and site-selection, so the RAP has been updated by the end of Dec., 2007. Currently, the land acquisition application is submitted to Henan Provincial Land and Resource Department.

Boai WSP and Puyang WSP have no permanent land acquisition.

By the end of December, 2009, all the subprojects have got the license for temporary land acquisition.

4 Resettlement Implementation Schedule

4.1 Resettlement Implementation

By the end of December, 2009, RAPs of 17 subprojects have been approved by ADB and resettlement for permanent land acquisition has been finished. resettlement work of the 3 subprojects have been on the march.

In the 17 subprojects of which the resettlement for permament land acquisition has been finished:

The actual resettlement schedules of Linzhou WWTP and Neihuang WWTP match with the planning schedules completely;

The actual resettlement schedules of Weihui WSP, Boai WWTP and Wuzhi WWTP are ahead of the planning schedules;

The actual resettlement schedules of Anyang WWTP, Huaxian WWTP, Weihui WWTP, Huojia WWTP, Fengqiu WWTP, Changyuan WWTP, Yanjin WWTP, Wenxian WWTP, Qingfeng WWTP and Nanle WWTP are later than the planning schedules.

Permanent land acquisition scope and area of Puyang WWTP are changed. The waste water treatment plant construction in the RAP is canceled, and only a sewage pumping station would be built, but currently the transaction of land acquisition procedure has finished and the resettlement work is in process.

Resettlement impacts of both Qingfeng WSP have been changed because of design scheme and site-selection, so the RAP has been updated. The resettlement work is still in process.

Boai WSP and Puyang WSP have no permanent land acquisition.

4.2 Linkup situation between resettlement work and project

construction

Among all the subprojects, except Weihui WWTP of which the project construction is 4 months ahead of the end of resettlement work, resettlement work of other subprojects are all finished ahead of the project construction. Linkup situation of each subproject is basically proper. See details in Table 4-2. The project constructions of Boai WSP and Qingfeng WSP are not started after the resettlement work finished. However, the resettlement work of both projects are not affected.

Because the pipeline network construction is started before the resettlement work is finished, the project construction is 4 months ahead of the end of resettlement work. But it dosn’t conflict with the compensation work of permanent land acquisition, so the linkup situation is also seen proper.

The design scheme and site-selection of Qingfeng WSP and Puyang WWTP have been adjusted, so the land acquisition and resettlement work are still in process.

5 Project Impact

Impacts of Henan Province WWTP & WSP are permanent land temporary land acquisition, so the actual impacts monitoring are based on these 2 aspects.

5.1 Actual Impacts of Permanent land Acquisition

According to final RAP of each subprojects and data from the 6th Independent Monitoring, the total area of actual permanent land acquisition of 19 subprojects is 1068.09 Mu, 90.79 Mu less than the planning 1158.88 Mu; there are 717households (2920 persons) being affected actually, 70 households (375 persons) more than the planning. The reasons include: 1. Actual land acquisition area of some subprojects is less than the RAP; 2.There are more households and persons being affected actually than the planning of Qingfeng WSP and Anyang WWTP.

The actual permanent land acquisition impacts of Linzhou WWTP, Huaxian WWTP, Huojia WWTP, Fengqiu WWTP, Changyuan WWTP, Boai WWTP, Boai WSP, Wenxian WWTP, Wuzhi WWTP and Nanle WWTP match with the planning;

The actual permanent land acquisition impacts of Anyang WWTP, Weihui WWTP, Weihui WSP and Yanjin WWTP are less than the planning;

The actual permanent land acquisition impacts of Neihuang WWTP, Qingfeng WWTP, Qingfeng WSP and Puyang WWTPare more than the planning;

In Puyang WSP, there is no permanent land acquisition impact.

The reason for the actual permanent land acquisition impacts of some subprojects being less than the planning is that each of the construction scale of plants is adjusted so that the area of permanent land acquisition is decreased;

The reason for actual permanent land acquisition of some subprojects being more than the planning is that the plant construction scale is increased or the affected households ask the project owner to acquire the corner land where they can’t plant. For example:

To Qingfeng WWTP, the villagers asked the project owner to acquire the corner land around the land in the scope of land acquisition planning.

5.2 Actual impacts of temporary land acquisition

By the end of December 2009, the actual temporary collective land acquisition acreage of the 19 subprojects is 2141.36 Mu, which is 396.34 Mu less than the planning 2537.7 Mu; the actual temporary state-owned land acquisition acreage is 2150.37 Mu, which is 287.2 Mu less than the planning 2437.57 Mu. Reason is pipeline network of some subprojects has not been finished or even commenced. According to the RAP of each subproject, there is no house demolition impact, but actually house demolition impact is involved in Huaxian WWTP and Wenxian WWTP, and the demolition area is 1508 m2. Details could be seen in Table 5-2.

Temporary land acquisition of 11 subprojects, including Anyang WWTP, Linzhou WWTP, Huaxian WWTP, Neihuang WWTP, Weihui WWTP, Weihui WSP, Huojia WWTP, Fengqiu WWTP, Changyuan WWTP, Yanjin WWTP, Wenxian WWTP, has been finished because the pipeline network construction of these subprojects has been finished. The pipeline network construction of Fengqiu WWTP has been finished, but the actual temporary land acquisition is 150 Mu, which is 295 Mu less than the planning 445 Mu, because the pipe-jacking construction method is used in the pipeline network construction of Fengqiu

WWTP, and the land acquisition impact is decreased. In addition, the sideway land acquisition being cancled is another major reason;

There is no temporary land acquisition in Pipeline network construction of Nanle WWTP in its RAP. The project owner has explained it in the RAP approved by ADB;

The pipeline network construction of other 7 subprojects is still in process.

6 Compensation and Ressetlement

6.1 Compensation standard

Of most of the subprojects, the compensation standard accords with the RAP. In the subprojects involving permanent land acquisition, the land compensation standard of Qingfeng WSP and Qingfeng WWTP is higher than RAPs; the resettlement subsidy standard of Huojia WWTP is higher than RAPs, the resettlement subsidy standard of Boai WWTP is lower than RAPs, resettlement subsidy standard of other subprojects accords with the RAPs; young crop compensation standard of Huaxian WWTP, Weihui WSP, Puyang WWTP and Changyuan WWTP is higher than the RAPs; house demolition compensation of Huaxian WWTP involving house demolition is 380 Yuan/m2, house demolition compensation of Anyang WWTP involving house demolition is 310 Yuan/m2

Explanation:

A. For the subprojects of which the compensation standard is higher than the

planning, the reason is the DPs’ request. After full negotiation and discussion,

and the approval of the City/County People’s Governments, the standard is

adjusted properly;

B. For Boai WWTP of which the young crop compensation is lower than the

planning, the reason is that the village group and the villagers ask the project

owner to construct roads and aqueducts, and set telegraph poles for them. With

the agreement of the villagers, the young crop compensation standard is

reduced accordingly.

6.2 Resettlement

After the symposiums between M&E team, project owners and affected households, it is found that the resettlement schemes of the 14 subprojects includes mainly:

(1) Adjsuting contracted land

A. Adjusting contracted land inside the village group

If the contracted land is adjusted in the whole village, the land compensation and

resettlement subsidy should be distributed in the whole village, such as Weihui

WSP; if the reserved land of the village is used to adjust the cultivated land per

capita after land acquisition which will equal with the cultivated land per capita

before land acquisition, the land compensation and resettlement subsidy should

be obtained by the village group, such as Boai WWTP;

B. Adjusting contracted land inside the villagers’ group

If the contracted land is adjusted in the affected villagers’ group, land

compensation and resettlement subsidy should be distributed in the whole

villagers’ group, such as Changyuan WWTP and Nanle WWTP; if the reserved

land of the villagers’ group is used to adjust the cultivated land per capita, for the

reduced cultivated land area per capita, the land compensation and resettlement

subsidy would be distributed according to relevant standard, and the rest of the

land compensation and resettlement subsidy should be obtained by the villager

group for the public affairs, such as Wenxian WWTP.

(2) Monetary xompensation

A. Pay land compensation and resettlement subsidy to the affected persons.

The distribution means of the land compensation is different among each

subprojects including total compensation being paid to affected persons or

certain proportion of the land compensation being paid to the affected

persons and certain proportion being obtained by the village group for the

public affairs; the resettlement subsidy compensation would being paid to the

affected persons in total. Such as Anyang WWTP, Yanjin WWTP, Neihuang

WWTP, Wuzhi WWTP, Weihui WWTP, Fengqiu WWTP, Linzhou WWTP and

Huaxian WWTP.

B. All the land compensation is obtained by the village group, and the

resettlement subsidy is distributed to the affected persons, such as Huojia

WWTP.

Details could be seen in Table 6-3.

(3) The young crop compensation would be distributed to the owners.

For the other 5 subprojects:

The land compensation and resettlement funds of Qingfeng WWTP are preserved in the village group, because the villagers are still discussing whether to adjust the contracted land and the final scheme would be determined in the end of this year;

The land acquisition and resettlement work of Qingfeng WSP, Boai WSP and Puyang

WWTP are not finished;

There is no permanent land acquisition involved in Puyang WSP.

For resettlement, each subproject owner and local functional departments also have done some work for the “sustainable living” of the DPs as following:

(1) Professional skill training

The skill trainings are mainly focused on the agricultural skill and some working skills out of home.

(2) Supply some non-technical posts of the construction field for the affected

labors

This kind of resettlement exists in all the subprojects. The posts mainly include earthworks portage during the construction period and the guard and cleaning work for the plants. However, a general problem is that the posts quantity is not enough for all the affected labors.

Better cases are in the following:

A. The affected households of Huaxian WWTP are provided with chances of

employment and making money. The project owner of Huaxian WWTP

contracts out some construction work to the affected households, such as fill

and level up the paths to the consruction field—60,000 Yuan, roads of the

plant—450,000 Yuan, earthworks—230,000 Yuan, barrier clearance—20,000

Yuan, surroungding wall—182,000 Yuan, and discharge ports—5,000 Yuan.

The total amount is 947,000 Yuan;

B. The affected households of Nanle WWTP are provided with the chance to

contract the surrounding wall construction of the plant during the construction

period. The total amount is 130,000 Yuan;

C. The affected households of Anyang WWTP would get 1000 Yuan/Mu per year

beside relevant compensation, and the funds would be provided by the city

financial department.

The demolished households involved in Huaxian WWTP would be relocated by township government. By investigation, the house price of the allocation houses is 320 Yuan/m2.

The house demolition compensation mainly includes: house compensation (380

Yuan/m2), moving house compensation (300 Yuan/household), attachment compensation (50-200 Yuan/household). Obviously, the compensation is higher than the replacement standard.

7 Resettlement Funds

By the end of December 2009, after comparing the actual resettlement output with the resettlement fund in RAP, the the resettlement funds having been disbursed is

76,866,800 Yuan, which is 97.54% of the planning 78,804,600 and 1,937,800 Yuan less than the planning. Details could be seen in Table 7-1.

The actual resettlement output of 11 subprojects, including Linzhou WWTP, Hua WWTP,

Neihuang WWTP, Weihui WSP, Changyuan WWTP, Yanjin WWTP, Wenxian WWTP,

Qingfeng WSP, Puyang WWTP, Wuzhi WWTP, Nanle WWTP accords with the resettlement fund in RAP;

The actual resettlement output of 5 subprojects, including Huojia WWTP, Boai WSP,

Fengqiu WWTP, Puyang WSP and Qingfeng WWTP is more than resettlement fund in

RAP;

The actual disbursement of Anyang WWTP, Boai WWTP and Weihui WWTP are not equal with the planning, because pipeline network of these subprojects is not finished, permanent land acquisition of some subprojects is less than the RAPs.

9 Following Investigation on Resettlement Restoration

In M&E reports, direct impacted population are not involved in the two projects: Boai

WSP and Puyang WSP, so we did not investigate resettler income; Baseline investigation on resettlement income of other 17 subprojects were been done in 1st M&E report; In 3rd M&E report, we did follow-up investigation on resettlement income restoration of 11 subprojects except Anyang WWTP, Qingfeng WSP, Puyang WWTP,

Wenxian WWTP, Neihuang WWTP and Yanjin WWTP, and factory location of Wenxian,

Neihuang and Yanjin WWTP changed, so investigation on resttlers’ income in 3rd M&E report were to be baseline materials; In 4th M&E report, we did follow-up investigation on resettlement income restoration of Wenxian WWTP, Neihuang WWTP and Yanjin WWTP;

In 5th M&E report, factory location of Qingfeng WSP and Puyang WWTP changed, so investigation on resttlers’ income in 5th M&E report were to be baseline materials; In 6th

By following income restoration, income of resettlers in 17 subprojects have restored to be the same as that before land acquisition, even higher than before. Measures to income restoration are mainly to be as follows: (1) Land readjustment. Fund utilization has three types: A. In Boai waste water project, because there is flexible farmland in the village. Farmland can be readjusted to villagers. Land acquisition compensation and allocation subsidy will be used for public affairs; B. The plan of Changyuan waste water project and Nanle waste water project is to readjust farmland with compensation capital distributed in village groups on average; C. Weihui water supply is to readjust farmland with compensation distributed on average in whole village.

D. If the reserved land of the villagers’ group is used to adjust the cultivated land per capita, for the reduced cultivated land area per capita, the land compensation and resettlement subsidy would be distributed according to relevant standard, and the rest of the land compensation and resettlement subsidy should be obtained by the villager group for the public affairs, such as Wenxian WWTP As a result of land adjustment, there is little effect of income in this 5 subprojects. With the compensation in time and the development of economy, villagers’ income becomes higher than before. (2) No land readjustment. Fund utilization and distribution has three ways: A. All compensation capital has reached to each family. Ten subprojects including: Anyang WWTP, Neihuang WWTP, Puyang WWTP, Yanjin WWTP, Qingfeng WSP Wuzhi WWTP, Weihui WWTP, Fengqiu WWTP, Linzhou WWTP and Huaxian WWTP don’t readjust land any more and provide the capital to each family. Farmers impacted by these projects make use of the compensation to improve their living condition or operate some individual business. And for the reduction of their farmland, they have more time doing other jobs to increase their income. B. Land compensation is given to village, allocation subsidy and young seed compensation given to each family. Huojia waste water project adopts this kind of

compensation type. Resettlers in the 12 projects have got compensation except. They can make use of the compensation and more time operating individual business or working temporarily outside. Besides, with economy develops, their income becomes higher than before, see Table 9-2 and Chart 9-1.
