Overview 1.1 On 8 January 2020, we published the consultation for our Wholesale Fixed Telecoms Market Review (WFTMR)1. This document sets out our proposed regulatory financial reporting requirements on BT in these markets. BT’s regulatory reporting will be subject to these requirements from April 2021 for five years. 1.2 Because the WFTMR covers most wholesale fixed telecoms markets we regulate and will determine our regulatory approach for the next five years, we are taking the opportunity to conduct a more holistic review of BT’s reporting requirements. This will ensure they remain fit for purpose while making the published information more accessible and easier to understand. 1.3 Our proposals cover the preparation and presentation of information published by BT, and information provided privately to Ofcom. What we are proposing We are proposing to impose regulatory financial reporting requirements on BT which require the production of Regulatory Financial Statements (RFS). -

We serve the interests of consumers and businesses across the UK’s nations and regions, through our work in mobile and fixed telecoms, broadcasting, spectrum, post and online services. Over the past year we have learned that being connected is everything. High-quality, reliable communications services have never mattered more to people’s lives. But as consumers shift their habits increasingly online, our communications sectors are transforming fast. It is an exciting moment for our industries and for Ofcom as a regulator - it requires long-term focus alongside speed and agility in response to change. Against this backdrop our statement sets out our detailed goals for the coming financial year, and how we plan to achieve them. On telecoms, Ofcom has just confirmed a new long-term framework for investment in gigabit- capable fixed networks. In the coming year, we will shift our focus to support delivery against this programme, alongside investment and innovation in 5G and new mobile infrastructure. Following legislation in Parliament, we will put in place new rules to hold operators to account for the security and resilience of their networks. -

Mobile Data Strategy British Sky Broadcasting Group plc (‘Sky’) Response Introduction 1. Sky welcomes the opportunity to respond to Ofcom’s consultation on mobile data strategy (“the Consultation”) 2. Sky is a heavy spectrum user, with activities ranging across many frequency bands. We use spectrum to deliver our services (via satellite, DTT, Wi-Fi and mobile), to create our content (using wireless microphones and cameras) and to connect our customers (through in-home and public Wi-Fi). 3. Our varied use of spectrum makes us well placed to appreciate the tensions between competing applications which make use of scarce spectrum, and the challenges that policymakers may face when considering approaches to spectrum policy prioritisation in the medium- to long-term. 4. Sky is also a member of the Dynamic Spectrum Alliance, and supports the submission made by that organisation in response to the Consultation. This response is made in addition to the submission from the DSA. Wi-Fi will continue to play a fundamental role in serving demand for mobile data 5. Sky concurs with Ofcom’s view that there is likely to be significant continuing growth in demand for mobile data services. As the Consultation notes, increased video traffic and potential M2M communications are likely to be key drivers behind this, alongside the possibility of new and innovative services which are yet to emerge. 6. In many of Sky’s previous responses to Ofcom, we have outlined our views on the future levels of demand for wireless data transfer, and the crucial role that Wi-Fi plays and will likely play in meeting this demand. -

Researching Digital On Screen Graphics Executive Sum m ary Background In Spring 2010, the BBC commissioned independent market research company, Ipsos MediaCT to conduct research into what the general public, across the UK thought of Digital On Screen Graphics (DOGs) – the channel logos that are often in the corner of the TV screen. The research was conducted between 5th and 11th March, with a representative sample of 1,031 adults aged 15+. The research was conducted by interviewers in-home, using the Ipsos MORI Omnibus. The key findings from the research can be found below. Key Findings Do viewers notice DOGs? As one of our first questions we split our sample into random halves and showed both halves a typical image that they would see on TV. One was a very busy image, with a DOG present in the top left corner, the other image had much less going on, again with the DOG in the top left corner. We asked respondents what the first thing they noticed was, and then we asked what they second thing they noticed was. It was clear from the results that the DOGs did not tend to stand out on screen, with only 12% of those presented with the ‘less busy’ screen picking out the DOG (and even fewer, 7%, amongst those who saw the busy screen). Even when we had pointed out DOGs and talked to respondents specifically about them, 59% agreed that they ‘tend not to notice the logos’, with females and viewers over 55, the least likely to notice them according to our survey. -

SKY’S RESPONSE TO OFCOM’S STRATEGIC REVIEW OF DIGITAL COMMUNICATIONS – DISCUSSION DOCUMENT Executive Summary 1. Sky welcomes Ofcom’s strategic review. It provides an opportunity to address a series of important issues that have implications not only for consumers of communications services in the UK, but also for the long term health of the UK economy. 2. It is critical that Ofcom approaches the review with vision, imagination and an open mind. The purpose of this strategic review should not be to confirm the merits of the status quo, or to search for potential minor adjustments in course. Ofcom should be prepared to consider options that have the potential to deliver significantly better outcomes in the communications sector over the next decade and beyond. 3. The review is an excellent opportunity to take a step back from ‘business as usual’, to consider what is working well in the sector, and what isn’t. It also provides an opportunity to consider critical questions in relation to the UK’s communications infrastructure – questions that risk falling between the gaps in Ofcom’s regular cycle of market reviews. 4. It is now apparent that there is substantial concern with a series of growing problems in the sector, shared by a wide range of communications providers (“CPs), consumers, and politicians. These include: (i) the increasing dominance of high speed broadband services by BT, which risks unwinding the benefits of years of strong competition in broadband services; (ii) the inadequate quality of service delivered by Openreach – and its significant impact, every day, on large numbers of UK consumers and businesses, and (iii) the level and type of investment in the UK’s fixed line communications infrastructure. -

Anticipated acquisition by ITV plc of SDN Limited The OFT’s decision on reference under section 22(1) given on 15 August 2005. Full text of decision published 24 August 2005. PARTIES 1. ITV plc (ITV) is a vertically integrated broadcaster active in the acquisition and production of broadcasting content, the packaging of that content into channels (ITV1, ITV2, ITV3, ITV News, and Men and Motors) and the distribution of those channels on analogue and the Digital Terrestrial Television (DTT) platform. It has 48.5 per cent share ownership on Digital 3and4 limited, which holds the licence for Multiplex 2.1 2. SDN Limited (SDN) holds the licence for and operates Multiplex A, part of the DTT transmission system. It was jointly controlled by S4C, United Business Media and NTL. In the year ending 31 December 2003 it had a turnover of £7.76 million in the UK. TRANSACTION 3. On 27 April ITV acquired the entire shareholding in SDN, following the shareholders’ triggering of a buy out option. 4. The statutory deadline is 26 August. The administrative deadline has expired. JURISDICTION 5. As a result of this transaction ITV and SDN have ceased to be distinct. The parties overlap in the ownership of DTT multiplex licences and in the supply of multiplex capacity for pay-TV and commercial TV. The share of supply test in section 23 of the Enterprise Act 2002 (the Act) is met as they have 33 per cent of multiplex licences and at least 25 per cent of capacity available for both pay-TV and commercial TV in the UK.
