Jack Williams, executive director of the Republican Legislative Caucus and chairman of the Draft Fob James Committee, said James would qualify at 3 p.m. today at the State Republicans Headquarters in Birmingham. James, a millionaire businessman, was originally a Republican. but s wit c nea to the Democrat ic Party in 1978 to run r or governor. He won the race by beating three o f Alabama's best - known politicians: , and . James ran again for governor in 1986 and 1990, but finished third in the Democratic primary both times. A Mason-Dixon Political-Media Research poll last week showed James would be the leading candidate at this point for the Republican nomination if he decided to enter the race. Without him in the race, Montgomery businessman Winton Blount and state Sen. Ann Bedsole of Mobile were the leading GOP candidates, the poll said. Other Republicans who have announced for the governor's race are Donald Champion of Millbrook, Mickey Kirkland of Montgomery, and Robin Swift of Atmore.

ISSUES OF CONCERN o GOP polls show education to be the number one issue. o Crime is the #2 concern for Alabama residents. o Purpose of the GOP rally is to put fire into the Republican party for the 1994 races. o Republicans have a good shot at electing for Attorney General. o The Alabama GOP has requested that you mention Judge Perry Hooper in your remarks (bio enclosed) . He is the GOP candidate for Chief Justice of the Alabama supreme Court and is also National Committeeman and has been in that position since 1972. Hooper has no primary opposition. o Rep. Spencer Bachus will be attending the rally and introducing you (bio enclosed) . At this time he has no primary or general opposition. This is also the case for Reps. and Terry Everett -- however, they will not be attending the events. Filing deadline: April 8 Primary: June 7 o There are three-five potential GOP candidates for Governor. Republicans have reason to believe they can win this race (see enclosed poll which shows Gov. Folsom with less than 50% in head-to-head with GOP candidates) . o Former Governor Fob James (Democrat turned Republican) was lobbied by Chairman Peters to run for Governor and has decided to run and has qualified. This apparent backing of Fob James by the seated Chairman of the State GOP has the other gubernatorial candidates a bit upset. Be aware that Peters and Hooper may hope to have you say some words of approval for James -- doing so would obviously hurt the other primary candidates. o Gov. ln his weekly radio ~tlur~ss, Peters accused Attorney Ceneral Jimmy Evans and State Supreme court Chief Justice Sonny Hornsby of conspiring with black politioal leaders and the p1aintiff trj~l lawyers to keep control of th~ Alabama Supreme court in the hands of plaintitt trial lawyers.

11 Peters noted that Evans recen'tly announced d "settlement of a lawsuit brought by Joe Reed's Alabama Democratic Conference. Reed sued to have. two positions tha.'t were creat.e'1 several ye~:i:-s ago on the State Supreme Court void~d because the lawsuit claimed the positions were not cleared by the U.S. Justice Department. In the settlement proposed by Jinuny Evans, judges on the supreme Court, the court of Criminal Appeals and the Court of Civil Appeals up for election or re-election this year would not be affected.

Before the next elections, however, the Gov~rnor would be required to appoint two blacks to the Court of Criminal Appeals, two blacks to the Court of Civil Appeals and one additional black judge to t.he Suprem~ Court, which already has one black justice.

Page 10 of 55 SIXTH DISTRICT This document is from the collections at the Dole Archives, University of Kansas http://dolearchives.ku.edu J Beyond the statue of Vulcan, beyond the 16th Street Baptist Church bombing: this is I' metropolitan Birmingham, Alabama, in the 1990s. Birmingham has one of the roughest, in more before i than one sense of the word, heritages of any big city in the . It didn't exist the Civil War and was a creature entirely made of steel. Built beneath Red Mountain, which is made entirely of iron ore, by 1890 it had the South's biggest steel mills. By the early 20th Century, as the statue of Vulcan, Roman god of fire and metalworking, looked out over the smokestack-rich city in the valley, Birmingham seemed the most up-to-date and progressive city in the South. But worldwide overcapacity in steel and technological obsolescence at home sent the American steel industry into long-term decline starting in the 1950s, and in the years when commercial Atlanta was billing itself as "The City Too Busy to Hate" and building its giant airport, industrial Birmingham's political leaders were plotting to avoid desegregation. Birming- ham's violent reaction to civil rights-police commissioner Bull Connor set dogs and firehoses against peaceful demonstrators, and Ku Klux Klansmen bombed the 16th Street Baptist Church killing four young girls in 1963-made a vivid impression over the new medium of television news, helping to pass the Civil Rights Act of 1964, and created a reputation from which Birmingham was still suffering a generation later. Today, greater Birmingham is a different place. It is still racially polarized, with most blacks living in neighborhoods in the valley corridor between two mountains and most whites on those mountains or in the valleys beyond; and the legal troubles of longtime black Mayor Richard Arrington have not helped. But Birmingham has been transformed economically, with the at Birmingham medical complex now replacing the steel mills as the metro area's biggest employer. For many years, Alabama's 6th Congressional District consisted of all or most of Birmingham and surrounding Jefferson County, a district that included heavily Democratic black precincts and heavily Republican wealthy and not-so-wealthy white areas. But for 1992, the prevalent interpretation of the Voting Rights Act 1982 revisions, pressed for heavily by blacks and Republicans, required the creation of a new black-majority district. Birmingham's valley areas, 75% black, were appended with rural Black Belt counties to become the new 7th District. This left a restructured 6th District, which included the rest of Birmingham and Jefferson County, all of which was only 8% black, plus all of Shelby County, a rapidly-growing, affluent, very heavily Republican county just to the south. It also stretched out to include a few heavily white rural areas in the university town of Tuscaloosa. The result was one of the biggest political changes in the country. The old 6th District was 37% black, the new 6th District 9% black. The old 6th District went 57% for George Bush in 1988, just 4% more than the national average, making it winnable by either party in House races. The new 6th District went 76% for Bush in 1988, far ahead of any other Alabama district, and one of the most Republican districts in the country. This spelled trouble, and ultimately defeat, for Democratic Congressman Ben Erdreich. First elected in 1982, Erdreich compiled an economically moderate record that was popular in Birmingham business circles; he and his family were among the few prominent Birmingham whites who supported civil rights at a time when that was not only politically courageous but physically dangerous. What is amazing is not that he lost but that he fought gamely and almost won. The Republican candidate, chosen in a runoff, was former state party chairman and state legislator Spencer Bachus; Erdreich avoided a possible primary when 7th District incumbent Claude Harris retired. Erdreich attacked Bachus for breaking a pledge not to negatively campaign; then he attacked Bachus for missing 3,000 votes during his tenure in the legislature. But this was not enough. Although Erdreich was leading in polls through much of the campaign, Bachus's party identification and his enthusiastic endorsement by helped him win 52o/o-45%, with 61 % in Shelby County and 53% in Jefferson. With any significant number of black voters in the district, it is clear from returns, Erdreich would have won easily: he lost the 6th portion of Jefferson County by 17,000 votes, but the rest of the county went Democratic by 57,000 votes in the 7th District race. Bachus is a former sawmill owner and lawyer who first was elected to the legislature in 1982 at 35; he was an active legislator for a Republican in a heavily Democratic body. He doesn't look like statewide material yet: he ran for attorney general in 1990 and got 36% of the vote. But, having defeated the strongest possible Democrat, he seems unlikely to lose this district, except in a Republican primary.

He attcmded Birmingham Southern College after the Marine Corps and then transferred to the UnlverGity of AJabama where he received degrees in the Commerce School and Law ~chool.

He served as a Staff Attorney for Justice Davis Stakely in the Supreme Court of Ah:bama from whom he learned the importance of legal integrity and that legal opinions should be written so that everyone can understand them. Just~ce Stakely was a true ~outhern sent!e:nnn who loved the law, Afterwards he entered the private *actice or'law and in 1964 was elected Judge ot Probate of Montgomery County. He was overwtleimingly re-elected in 1970.

*12 ALABAMA: FOLSOM, HUBBERT GO GENTLY INTO THAT SOUND BITE The TV ad campaigns of Gov. Jim Folsom (D) and AL Educ. Ed. Assn. Pres. Paul Hubbert (D) "go into full swing this week, with both camps airing 'positive' messages but preparing to respond to cheap shots." Spokespersons for Folsom and Hubbert "said [4/4] they plan to air television commercials on a continuing basis until" the 6/7 primary. According to Fox, Folsom began running an ad 4/4 that "begins with a child's drawing of a schoolhouse, then tracks through a schoolhouse door into a school where Folsom talks to a group of students about problems facing Alabama's schools and his efforts to fix them." Hubbert's first two spots were scheduled to begin airing 4/5. "One features Hubbert with his family, as a narrator tells how he's 'fought for the basics in schools' and has been 'a leader four governors have turned to, to solve some of our biggest problems.'" The other ad "shows the candidate driving around an unnamed area (identified by campaign officials as Montgomery) where a 'kid was killed, and right across the street there was a shooting in this mall"' (Rabiroff/ Nabbefeld, BIRMINGHAM NEWS, 4/5). ON THE REPUBLICAN SIDE: BIRMINGHAM POST-HERALD's Bryant: Alabamans will know by the 4/8 filing deadline what ex-Gov. Fob James (R) is "planning for this election year." With the "possible exception of James, the Republican field ... appears to be set with the four millionaires and the preacherman in the lead roles." The millionaires: State Sen. Ann Bedsole (R), contractor Winton Blount (R), Preserv/Nat Res Commis. Jim Martin (R) and ex-Hunt Finance Dir. Robin Swift (R). And Minister Mickey Kirkland (R) as, of course, the preacher. "James fowls up everything if he joins the Republican field, as expected, this week. Although nine weeks out is late to start a campaign, he would open with high name recognition, even if it is accompanied by high negatives" (4/5).

*15 ALABAMA: BLOUNT FACES QUESTIONS ABOUT WIFE'S 1969 DEATH In 1969, contractor Winton Blount (R) "faced a manslaughter charge in connection with the death of his wife." The charge was dropped and a grand jury did not indict. "Still, questions remain" about the death of Beverly Blount. Ex-Montgomery police chief Drue Lackey "claims politics led to the decision to drop the charges": "I really didn't want to get involved in this thing again, but I think it was apparent at the time it was taking place that politics got into it." Blount, whose father had just been appointed postmaster general in the Nixon admin., "denies the claim": "My memory of it was that it went to the grand jury and there were no more charges. It was a tragedy. The brakes were faulty on the car. My wife was killed." On 3/2/69, Blount was driving a Jaguar with his wife in the passenger's seat when the car "skidded and its passenger side struck another car." The police estimated Blount was going 90-95 mph in a 40 mph zone. The police report was quoted as saying that Blount was "obviously drunk." Blount: "I had been drinking, but speed and faulty brakes had as much to with it as anything." Mrs. Blount was buried "less than a day after she died" and while police had requested an autopsy, it was not performed. Blount said his wife was buried so soon because, "I was making decisions from shock the best I knew how." Blount was charged with second-degree manslaughter. Lackey said he recalled the arresting officer telling him about the case: "I told him, 'We've got a standard operating procedure. If you've got the evidence, go ahead and charge.' Then he told me who it was, and I told him it didn't make any difference. 'If you've got the evidence, go ahead and charge.' Then politics took over, I guess." Blount's father, Winton "Red" Blount, said charges of politics are "absolutely false": "I know absolutely nothing about it. Winton was so upset there was no way he had any part in it. HOTLINE 3/24/94 *10 ALABAMA: PASSAGE OF FOLSOM'S EDUCATION PLAN GETS TOUGHER A-Plus, the key group backing Gov. Jim Folsom's (D) education reform plan, "apparently is giving up hope the plan will be approved in the current regular session" and instead is "shifting its attention" to a special session scheduled by Folsom for 4/26 "if lawmakers fail to enact his plan." The legislative session ends 4/25. A-Plus managing dir. Cathy Gassenheimer: "We would like to be wrong, but we just don't see the plan making it to the floor of the House this session." Folsom's bill passed the state Senate 1/93, but was stalled in the House Rules Cmte, which voted 12-5 on 2/16 "not to move it up to the top of the House agenda" (Dean, BIRMINGHAM NEWS, 3/20). BIRMINGHAM POST- HERALD' s Bryant advises Folsom to "forget about education reform" for this session: "Consider calling the special session in July, after the primaries. You'll have a better idea about your own political future and more than 25 percent of the legislators will be lame ducks" (3/22). NEWS' Gordon writes some Rules cmte members voted against Folsom "because of his refusal to at that time reveal how he proposed to pay for his plan" and some "were probably doing the bidding" of AL Educ. Assoc. Pres. Paul Hubbert (D), who is challenging Folsom in the 6/7 primary (3/20). BACK ON THE ROAD: Ex-Hunt Finance dir. Robin Swift (R) is back campaigning this week after passing out during a Birmingham fund-raiser 3/15. Swift "blamed it on a stomach virus" (MONTGOMERY ADVERTISER, 3/23). NOT GOING TO HAPPEN: A bill co-sponsored by state Sen. Ann Bedsole (R) that would give subpoena power to the state Ethics Commis. "sparked" a second day of filibustering in the Senate. Proponents of the bill "gave up." State Sen. Danny Corbett, an opponent of the bill, said Bedsole "was pushing it to help" her gov. campaign (MONTGOMERY ADVERTISER, 3/23). We have been encouraged by both public and private polling which shows that Senator Bedsole commands a strong position even before we have begun our paid media campaign. These polls show State Senator Bedsole within the margin of error seven to ten points of the leader, former Democrat Governor Fob James. It is important to note that James starts with nearly 40% unfavorable ratings, if he even decides to run in the Republican Primary, and that another oppon~nt hAd spent $350,000 on network T.V. at the time of these polls.
