Rutledge LAURA KRUGMAN RAY Justice John Paul Stevens, now starting his thirty-third full term on the Supreme Court, served as law clerk to Justice Wiley B. Rutledge during the Court’s 1947 Term. That experience has informed both elements of Stevens’s jurisprudence and aspects of his approach to his institutional role. Like Rutledge, Stevens has written powerful opinions on issues of individual rights, the Establishment Clause, and the reach of executive power in wartime. Stevens has also, like Rutledge, been a frequent author of dissents and concurrences, choosing to express his divergences from the majority rather than to vote in silence. Within his chambers, Stevens has in many ways adopted his own clerkship experience in preference to current models. Unlike the practices of most of his colleagues, Stevens hires fewer clerks, writes his own first drafts, and shares certiorari decisionmaking with his clerks. -

Alabama: Commandments, Amendments, and Defendants Patrick R. Cotter Alabama’s 2004 election was a quiet affair. Signs that a presidential campaign was occurring—candidate visits, partisan rallies, hard-hitting tele- vision commercials, or get-out-the-vote efforts—were largely missing from the state. The outcome of Alabama’s U.S. Senate race was a forgone conclu- sion from the beginning of the year. All of the state’s congressmen were easily reelected. Contests for the few state offices up for election in 2004 were generally both invisible and uncompetitive. The only part of the ballot that generated any interest—and even here it was limited—involved a pro- posed amendment to Alabama’s already long state constitution. Alabama’s 2004 election was also a clear Republican victory. Republi- cans George W. Bush and Richard Shelby easily carried the state in the presidential and U.S. Senate elections. The GOP kept it 5-to-2 advantage in Congressional seats. Republicans swept all the contested positions on the state Supreme Court. Alabama’s 2004 election campaign was not the first time the state had experienced a quiet presidential campaign. Nor was it the first in which Republicans did quite well. Both the 1988 and 2000 campaigns were also low-key affairs. Both were also campaigns that the GOP clearly won. These earlier low-key, Republican-winning, presidential campaigns did not significantly alter the state’s partisan politics. Rather, the close partisan balance that has characterized the state since the 1980s continued beyond these elections. THE REHNQUIST COURT AND BEYOND: REVOLUTION, COUNTER-REVOLUTION, OR MERE CHASTENING OF CONSTITUTIONAL ASPIRATIONS? THE PROCESSES OF CONSTITUTIONAL CHANGE: FROM PARTISAN ENTRENCHMENT TO THE NATIONAL SURVEILLANCE STATE Jack M. Balkin & Sanford Levinson* I. INTRODUCTION: PARTISAN ENTRENCHMENT Five years ago, we offered a theory of how constitutional change and constitutional revolutions occurred, which we called the theory of “partisan entrenchment.”1 Much has happened in the subsequent half-decade, and we are grateful for this opportunity to offer an update of our thoughts, together with some amendments to our initial formulation. By far the most important amendment is to draw out in more detail how the development of constitutional doctrine by courts occurs within the broader framework of changes in constitutional regimes, which include changes in institutions, legislation, and administrative regulation. The forces of democratic politics drive these regime changes, and the major actors are not courts but the political branches. Although courts may initially resist these changes, in the long run, they cooperate with them, shape their contours, and legitimate them through the development of constitutional doctrine. In the second half of this essay, we describe an emerging regime of institutions and practices that we call the “National Surveillance State,” which, we think, represents the major constitutional development of our era. The National Surveillance State responds to the particular needs of warfare, foreign policy, and domestic law enforcement in the twenty-first century. That such a state is emerging has become clear in the wake of 9/11 and debates about the War on Terror. Module 1 Read Ahead History of ALDOT Module 1: History of ALDOT Objectives After attending the training in Module 1, participants will be able to: • understand the history of ALDOT from birth out of corrections in 1911 until today. • identify the many changes that have occurred throughout the history of ALDOT. • understand the many reorganizations of areas, regions, divisions, and bureaus. Early History of ALDOT In 1911, the State Highway Commission was created under Governor Emmet O’Neal’s Administration (1911-1915). The State Highway Commission consisted of five commissioners and three regular employees. The State Highway Commission was organized along with an Oyster Commission and was initially housed in the cloak room of the Senate Chamber in the Alabma State Capitol. The first five Alabama State Highway Commission Members were Robert E. Spragins, Chairman, of Huntsville; John Craft of Mobile who later became Chairman of the 2nd Commission; V. B. Atkins of Selma; G.N. Mitcham, Professor of Civil Engineering at Auburn University; and Eugene A. Smith, State Geologist at the University of Alabama. Regular Members of the Commission were W.S. Keller, State Highway Engineer who had experience at the County Engineer level; Robert P. Boyd, Assistant State Highway Engineer who had experience at the County Engineer level; and C.L. Rabb, Clerk. Earliest Years Early highway executives in 1911 shared some of the same financial woes as their current counterparts. The Financial Act of 1911 appropriated $154,000 from the State Convict Fund. The Act allowed the funds to be used for construction of roads and for the overhead expenses of the state executives. -

FUCHSt I Wiley Blount Rutledge brings an essentially new background to the Supreme Court of the United States. Not previously has there come to the high tribunal a jurist who combines a Western origin and career with legal training and participation as a teacher in the modern legal education of the West. The sig- nificance of his appointment extends beyond mere geography because it involves the emergence on the Court of new currents of thought and experience. It was natural and on the whole salutary for the membership of the Court to swing so largely to the Northeast during the two decades following the First World War, for the legal pro- fession reflected more fully in that section than in any other the advances in jurisprudential thought and in legal education which industrialism had produced. -

The Retirement Systems Of Alabama 1998 Annual Report In Memory Of Dr. William C. Walsh Deputy Director Retirement Systems of Alabama Dr. William C. Walsh was Deputy-Secretary Treasurer of the Retirement Systems of Alabama from June 5, 1974 through his death, August 7, 1998. He was an integral part of the one-two punch that saw the Retirement Systems grow from a 25% funded, $500 million orga- nization to a fully funded, $22.6 billion organization. He was the only assistant director of a state pension pro- gram to serve as president of the National Council of Teachers’ Retirement Systems. The members of the Retirement Systems of Alabama have lost a strong advo- cate in the passing of Dr. Walsh. He is survived by his wife, Jackie, daughter, Catherine and son, Will. THE PROPERTY TAX IN ALABAMA: Its Historical Development and Current Impact Ira W. Harvey, Ed.D. Retired Educational Consultant CEO of Decision Resources, LLC June 2012 Center for Leadership and Public Policy Alabama State University Montgomery, Alabama FOREWORD As is the case across the United States, many Alabamians believe that they are taxed heavily and that their tax burden is unreasonably high. In reality, Alabama competes for the lowest tax burden overall in America and it is well-entrenched as the 50th ranked state in terms of property tax levies. In this report, the author documents the historical precedents for this situation. Importantly, the report also indicates the action that can be taken to modify the property tax so that it can play a more equitable role in funding government services than is the case currently with the heavy reliance on a sales tax that is highly regressive in its impact. The author of this report, Ira W. Harvey (Ed.D., Auburn University), is considered one of the foremost authorities on taxation and education finance in Alabama. He is currently self- employed as an education finance consultant as president of Decision Resources, LLC. In his long career, he has held senior finance positions with the University of Alabama at Birmingham, the Alabama State Department of Education, and the Alabama Department of Finance. In addition, he has had consulting affiliations with Alabama Association of School Boards, the Alabama Commission on Higher Education, the Alabama Higher Education Partnership, and the University of Alabama and Auburn University systems.
