BACKGROUND

As part of the District-wide Budget Reduction Plan, the Board of Education voted on February 2, 2012 to eliminate and reduce various positions in the District. These board approved budget reductions, coupled with the passage of Proposition 30, allowed the District to attain fiscal solvency for 2012/2013, 2013/2014, and 2014/2015.

At its January 22, 2013 budget study meeting, Board members requested several previously approved budget reduction items, along with the Superintendent’s recommended restoration items, be placed on the February 7, 2013 Board agenda for discussion and action.

The Superintendent is recommending the restoration of specific budget items for one fiscal year only, with the intention of maintaining District fiscal solvency for the current and two subsequent years.

Approval of this item supports the goals identified within the District’s Strategic Plan.

RECOMMENDATION

It is recommended the Board of Education provide direction to the Superintendent regarding the restoration of previously approved budget reduction items.

FISCAL IMPACT

Estimated $507,667 to the General Fund for the remainder of 2012/2013 school year and estimated $9,336,495 for 2013/2014.

The Board of Education believes in the importance of recognizing individuals and major contributors who have distinguished themselves by their contributions to public education and the Chino Valley community. As such, a Board member requested that the Board manifest its belief by establishing the Chino Valley Unified School District Hall of Fame.

The permanent honor of being elected to the Chino Valley Unified School District Hall of Fame will represent individuals who, through their individual actions, have contributed to the established vision of the District.

Approval of this item supports the goals identified within the District’s Strategic Plan.

At the December 13, 2012 meeting of the Board of Education, a Board member requested the creation of an arts committee to focus on procuring grants to supplement the arts and enhance student learning. By researching and applying for grants from all available resources, it will be the intent of the council to expand the arts for all students. The establishment of an arts committee is appropriate to such aims.

Approval of this item supports the goals identified within the District’s Strategic Plan.

RECOMMENDATION

BACKGROUND

On January 19, 2012, the Board of Education received a request from the Committee for the Samuel Burton Adult Education Center to consider renaming the Chino Valley Adult School to the Samuel Burton Adult Education Center. The committee revised their proposal to honor Mr. Burton by changing the name of the CVUSD Professional Development Center/Media Services to the Samuel R. Burton Professional Development and Media Center.

On October 14, 2012, the District received a request from Chino High School teacher, Felicia Ambrosia, to consider naming the varsity baseball field at Chino High School after former longtime varsity baseball coach and District employee, Bob Sheehan.

A Citizens Advisory Committee on the Naming of Facilities was appointed by the Board and meetings were held on November 5 and 26, 2012, to discuss the naming proposals, fiscal impact, and impacts to the educational program. Beginning December 12, 2012, the public was notified through the local news media, the District website and cable channel of the 30- day opportunity to submit recommendations for naming these facilities.

On January 17, 2013, the Board held a public hearing on the proposed name changes and entertained public comments. The item is before the Board for further public comment and to take action on the requests.

RECOMMENDATION

The Citizen’s Advisory Committee on the Naming of Facilities recommends the Board of Education name/rename District Facilities as follows:

Diane Boudreaux addressed the Board regarding charter schools.

I.E. COMMENTS FROM STUDENT REPRESENTATIVE

Alexa Uekert provided updates on high school activities: said Chino Hills HS hosted a Castle student leadership development day and held its winter sports rally, are preparing for an upcoming muscle contest, and Sadie Hawkins dance; said Ayala and Chino HS are also preparing for their Sadie Hawkins dance; and Don Lugo HS hosted a coffee morning for parents, and hosted a dance showcase for dance team.

I.F. COMMENTS FROM EMPLOYEE REPRESENTATIVES

Justine Cunningham, A.C.T. President, spoke about the item regarding renaming the Professional Development Center in honor of Samuel Burton and said she concurs with the idea; said Superintendent Joseph and she have been making site visits and have completed the high school visits and are now working on junior high school site visits and received good feedback from the majority of the sites visited and appreciated openness and candor; thanked him for that opportunity and said it has been a good thing for staff to see; said she visited Chino Hills HS before the Christmas vacation and that there was a scheduling conflict which ended up upsetting the PTSA parents who were working on a staff holiday breakfast and had invested time, cost, and effort on the event; said she may have caused some hurt feelings because she asked parents and students to leave, but that was not her intent as she was not aware of the scheduling conflict; said the Association does appreciate the work parents do for students; and closed by saying that she has submitted a letter to the Chino Champion regarding that mistake.

Denise Arroyo, CSEA President, wished everyone a happy new year and said she hopes everyone had an enjoyable holiday and had plenty of rest; and said that bus driver Lucia Quinonez lost her battle with cancer, and thanked James Na, Andrew Cruz, and Greg Stachura for attending funeral services; said that maintenance worker Bob Burnath lost his 18-year-old step son; said Cindy Swanson, purchasing clerk, lost her 89-year-old mother; spoke about Prop 30 passing and the Governor’s state budget and about the restoration of days and hours to the positions that were reduced; and closed by saying that she had the privilege to have known Sam Burton and that he treated everyone with respect.

John DeMonaco, Chino Valley Independent Fire Board, said the Fire District had its reorganization and that Sarah Evinger is now president and he is vice president; said the District liaison will be either himself or Ed Gray; and said that the Fire Board extended a job offer for a new fire chief and are hoping that an announcement can be made soon.

Sylvia Orozco was selected by unanimous consent as delegate from the Chino Valley Unified School District to the California School Boards Association Delegate Assembly for a term beginning April 1, 2013, through March 31, 2015.

Charles Dickie said that he had bronchitis twice since the last Board meeting; said that as president last year he enjoyed signing donation letters and that he noticed tonight’s donations amounted to approximately $30,000.00; and said that at last week’s Chino Hills council meeting David Black and Fred Youngblood were honored for their service.

Andrew Cruz said that he attended and participated in lots of events; said that he and James Na observed Don Lugo HS classes - amongst many things were students on task and teachers using the latest instructional strategies; said that he, Charles Dickie, and Sylvia Orozco participated in the Make a Child Smile event sponsored by the Chino Valley Fire District; and attended the Baldy View ROP Law Enforcement Academy Class 60 graduation.

Irene Hernandez-Blair visited the Virtual Academy, Chino Valley Learning Academy, Buena Vista Continuation HS, and thanked Mr. Carr, Mr. Ron Mead, Mr. Luis Garcia, Mr. Vasquez, and Anna Purcell for the insight they provided regarding their campuses and students; asked community members to consider contributing to the efforts of Rolling Ridge ES parents who are trying to raise $20,000.00 for special equipment for the autism pre-school.

James Na said he has been asked questions from friends, parents, and educators regarding how the new Board members are doing, and responds that they are doing an excellent job, they have their heart in the right place, and they are here to serve parents, students, staff, and teachers; attended CSEA unit member Lucia Quinonez’ funeral service last week; visited one of the District’s teachers in the hospital and that he was pleased to learn that many fellow teachers donated their vacation time to support their fellow teacher; said that he learned Noah’s Ark was able to fit 30,000 sheep-sized animals and that it took him almost 50 years to learn this; closed by wishing everyone a happy new year and said he loves our students, parents, teachers, and staff members.

Superintendent Joseph congratulated Derek Bub, Chino Hills High School athletic director, for being selected as the Southern Section recipient of the Norm MacKenzie Award for 2012/2013; congratulated Brian Engstrom, LEAD Academy Coordinator and math teacher at Don Lugo HS, for being selected as a finalist for the Educator of the Year by the California League of High Schools in this region; and welcomed everyone back and wished everyone a happy 2013.

President Orozco extended happy new year’s wishes and said she hopes everyone had good holidays with family and friends; congratulated Don Lugo HS water polo team for their championships; attended the Governor’s Budget Workshop and heard great news and is cautiously optimistic; invited the public to attend the next budget session scheduled for January 22 at 5:00 p.m.; said Chino Hills Parks and Recreation will be breaking ground for their new community center and distributed a fundraiser announcement for that; said the Citizens for Kids Educational Foundation membership drive is currently taking place and that since its 2003 inception they have raised over a million dollars to help bridge the funding gap; said the Reading-A-Thon will be held from February 25 through March 1 and that last year more than $90,000.00 was raised: and closed by saying that the Foundation is seeking applications for membership and encouraged everyone who has an interest in serving students to look into it.

Budget Study Session of the Chino Valley Unified School District Superintendent Joseph and Sandra Chen, Assistant Superintendent of Business Services, reviewed: common school financial terms; CVUSD First Interim Multiyear Budget Recap; Governor’s 2013/2014 Budget Proposal; the road ahead; and Superintendent’s recommendations and next steps. Board member Na said that he would like to see line item 3 removed from the Superintendent’s recommendations, add one music teacher for the rest of the year, and increase the GATE stipend to its previous level for next year. President Orozco requested that the entire list of recommended restorations, plus those requested by Board members be included for the Board’s consideration; and Irene Hernandez-Blair requested information regarding how many positions were eliminated and how many are being brought back so that she is able to compare (who and what was eliminated).

BACKGROUND

The Board of Education has established policies and standards of behavior in order to promote learning and protect the safety and well-being of all students. When these policies and standards are violated, it may be necessary to suspend or expel a student from regular classroom instruction.

Expulsion is an action taken by the Board for severe or prolonged breaches of discipline by a student. Except for single acts of a grave nature, expulsion is used only when there is a history of misconduct, when other forms of discipline, including suspension, have failed to bring about proper conduct, or when the student's presence causes a continuing danger to him/herself or others.

A student may be expelled only by the Board of Education. The Board shall expel, as required by law, any student found to have committed certain offenses listed in Education Code 48915.

RECOMMENDATION

• The Superintendent or designee shall hold a conference with the parent/guardian and the student. At the conference, the student’s rehabilitation plan shall be reviewed and the Superintendent or designee shall verify that the provisions of this plan have been met.

• School regulations shall be reviewed and the student and parent/guardian shall be asked to indicate in writing their willingness to comply with these regulations.

• The Superintendent or designee shall transmit his/her recommendation regarding readmission to the Board. The Board shall consider this recommendation, in closed session, if information disclosed would be in violation of Education Code 49073- 49079. If a written request for open session is received from the parent/guardian or adult student, it shall be honored.

BACKGROUND

The Board of Education may admit students expelled from other districts in accordance with law when consistent with the Board’s goal to provide a safe and secure school environment for students and staff.

The District shall not enroll a student expelled by another district for any of the offenses listed in Education Code 48915(a) or (c) (mandatory expulsion offenses) during the term of the student's expulsion, unless the enrollment is at a community day school. A student expelled for an act specified in Education Code 48915(a) or (c) may enroll in the District after the term of his/her expulsion if the Board finds, at a hearing, that the student does not pose a continuing danger to students or staff.

The Board, when making its determination whether to enroll an individual who has been expelled from another school district for any of the acts mentioned above, may consider the following options: deny enrollment, permit enrollment, or permit conditional enrollment in a regular school program or another educational program.

BACKGROUND

Senate Bill 1476 requires a school principal to submit to the governing board of the school district a request for a waiver of the requirement to successfully pass the high school exit examination for a pupil with a disability who has taken the high school exit exam with modifications that alter what the test measures and has received the equivalent of a passing score on one or both subject matter parts of the exam.

This waiver can be granted if the principal certifies that the pupil has all of the following:

 A current Individualized Education Plan that requires modifications to be provided to the pupil when taking the high school exit exam.  High school level coursework either satisfactorily completed or in progress in a high school level curriculum sufficient to have attained the skills and knowledge otherwise needed to pass the high school exit exam.  An individual score report for the pupil showing that the pupil has received the equivalent of a passing score (350) on the high school exit exam while using a modification that fundamentally alters what the high school exit exam measures.

The student cases included in this agenda item have met the requirements specified above as described in SB 1476.

The Chino Valley Unified School District is a tobacco-free district and has a strong commitment to provide tobacco use prevention education to its students through the Tobacco Use Prevention Education (TUPE) program. This proclamation is a means of recognizing the District’s support of Save a Sweet Heart Day on February 14, 2013.

As part of the Save a Sweet Heart Day, several schools will participate in school site activities to encourage students and staff to stop smoking and improve their health. Participating student groups and clubs sponsor secondary school activities. Students will receive educational items to reinforce tobacco use prevention.

WHEREAS, Save a Sweet Heart Day encourages smokers to quit;

WHEREAS, increasing numbers of children are experimenting with a product that can produce a lifetime addiction with an increased risk of cancer;

WHEREAS, more Americans die every year from tobacco-related diseases than from AIDS, alcohol, car accidents, fires, illegal drugs, murders, and suicides combined;

WHEREAS, youth-related promotions such as Save a Sweet Heart Day encourage youth not to smoke; and

WHEREAS, the health benefits of not smoking are substantiated and well known.

NOW, THEREFORE, BE IT RESOLVED, the Board of Education of the Chino Valley Unified School District does hereby support February 14, 2013, as Save a Sweet Heart Day in this District, and in doing so, urges all smokers and smokeless tobacco users to demonstrate to themselves and our children that they can quit, and to further encourage our children not to start smoking. The Board encourages its students and staff to participate in tobacco use prevention education activities, making a visible statement that we are firmly committed to a tobacco-free community; and

BACKGROUND

Claim 13-01-01 submitted on January 10, 2013, by Felicia Mills, a teacher at Ayala HS. Claimant alleges vehicle damage after being hit by a sprinkler head that ricocheted from a District lawn mower. Claimant makes a settlement demand for reimbursement for vehicle damages of $579.00.

The Board is requested to reject the claim against the District to allow the insurance carriers to investigate the merit of the claim and make a recommendation regarding disposition.

Approval of this item supports the goals identified within the District’s Strategic Plan.

RECOMMENDATION

It is recommended the Board of Education reject the claim and refer it to the District’s insurance adjuster.

BACKGROUND

Internships provide a high quality of learning, support and practical classroom experience for professionals in training. The Chino Valley Unified School District has an opportunity to establish an internship partnership with the Iowa State University of Science and Technology. The Dietetic internship program will allow the intern to assist in planning and/or updating the District's current meal pattern and nutrition standards to comply with the National School Meal Program requirements. Additionally, the intern will assist in monitoring current menus to ensure the accuracy of the set specific calorie limits for age- appropriate meals for grades K-6, 7-8, and 9-12, and aid in the planning of next year's menus to enhance the integrity of and comply with the National School Meal Program's future regulation changes.

California Education Code 1240 requires that the San Bernardino County Superintendent of Schools visit all deciles 1-3 schools (Williams schools) identified in the county and report the results of findings on a quarterly basis. The instructional materials sufficiency, facilities inspections, and School Accountability Report Card (SARC) reviews were conducted during the first quarter of the 2012/2013 school year and reported in October 2012. The San Bernardino County Superintendent of Schools office is required to file quarterly reports on schools progress in rectifying any findings.

In summary, there are no findings to report in the following areas:

CLAIMS AND ACTIONS AGAINST THE DISTRICT

The Board of Education desires to ensure that the District's operations are conducted in a manner that minimizes risk, protects District resources, and promotes the health and safety of students, staff, and the public. Any and all claims for money or damages against the District shall be presented to and acted upon in accordance with law, board policy, and administrative regulation as well as the District's Joint Powers Authority (JPA) agreement or insurance coverage.

Any claims for money or damages not governed by the Government Claims Act (Government Code 810-996.6) or excepted by Government Code 905 shall be presented consistent with the manner and time limitations in the Government Claims Act, unless a procedure for processing such claims is otherwise provided by state or federal law.

Upon notice to the District of a claim, the Superintendent or designee shall take all necessary steps to protect the District's rights under any applicable contractual agreements, including the right to indemnification from its insurance or other coverage provider.

In accordance with Government Code 935.4, the Board of Education delegates to the Superintendent the authority to allow, compromise, or settle claims of $50,000 or less pursuant to any conditions of coverage in the District’s JPA agreement of insurance.

This policy applies retroactively to any existing causes of action and/or claims for money and/or damages.

Roster of Public Agencies

The Superintendent or designee shall file the information required for the Roster of Public Agencies with the Secretary of State and the County Clerk. This information shall include the name of the school district, the mailing address of the board, and the names and addresses of the board presiding officer, the board clerk or secretary and other members of the board. (Government Code 53051) Any changes to such information shall be filed within 10 days after the change has occurred. (Government Code 53051)

Time Limitations

The following time limitations apply to claims against the District:

1. Claims for money or damages relating to a cause of action for death or for injury to person, personal property or growing crops shall be presented to the Board of Education not later than six months after the accrual of the cause of action. (Government Code 905, 911.2)

2. Claims for money or damages as authorized in Government Code 905 and not included in item #1 above including claims for damages to real property shall be presented not later than one year after the accrual of the cause of action. (Government Code 905, 911.2)

Receipt of Claims

A claim, any amendment thereto, or an application to present a late claim shall be deemed presented and received when delivered to the District Office or deposited in a Post Office, subpost office, substation, or mail chute or other like facility maintained by the U.S. Government, in a sealed envelope properly addressed to the District Office with postage paid or when otherwise actually received in the District Office or by the Board secretary or clerk. (Government Code 915, 915.2)

Upon receipt of a claim against the District pursuant to the Government Claims Act, the Superintendent or designee shall promptly provide written notice to the District's JPA or insurance carrier in accordance with the applicable conditions of coverage.

Review of Contents of The Claim

The Superintendent or designee shall review any claim received to ensure that the claim contains all of the following information as specified in Government Code 910 and 910.2:

1. The name and Post Office address of the claimant.

2. The Post Office address to which the person presenting the claim desires notices to be sent.

3. The date, place, and other circumstances of the occurrence or transaction which gave rise to the claim asserted.

4. A general description of the indebtedness, obligation, injury, damage, or loss incurred insofar as it may be known at the time of presentation of the claim.

5. The name(s) of the public employee(s) causing the injury, damage, or loss if known.

6. The amount claimed if it totals less than $10,000 as of the date of the presentation of the claim, including the estimated amount of any prospective injury, damage, or loss, insofar as it may be known at the time of the claim, together with the basis of computation of the amount claimed. If the amount claimed exceeds $10,000, the dollar amount shall not be included in the claim and the claimant shall indicate whether the claim is a "limited civil case."

Notice of Claim Insufficiency

If a claim is found insufficient or not to satisfy the form requirements under Government Code 910 and 910.2, the Board or its designee shall review all claims for sufficiency of information. The Superintendent or designee shall, within 20 days of receipt of the claim, personally deliver or mail to claimant, at the address stated in the claim or application, a notice that states the particular defects or omission in the claim. (Government Code 910.8, 915.4)

The Board shall not act upon the claim until at least 15 days after such notice is given. (Government Code 910.8)

Amendment to Claim

Within the time limits provided under the section entitled “time limitations” above or prior to final action by the Board, whichever is later, a claim may be amended if, as amended, it relates to the same transaction or occurrence which gave rise to the original claim. (Government Code 910.6)

Late Claims

For claims under item #1 entitled “tTime lLimitations” above, any person who presents a claim later than six months after the accrual of the cause of action shall present, along with the claim, an application to present a late claim. Such claim and the application to present a late claim shall be presented not later than one year after the accrual of the cause of action. (Government Code 911.4)

If a claim is presented late and is not accompanied by an application to present a late claim, the Board or its designee may, within 45 days, give written notice that the claim was not presented timely and that it is being returned without further action. (Government Code 911.3)

The Board or its designee shall grant or deny the application to present a late claim within 45 days after it is presented. This 45-day period may be extended by written agreement of the claimant and the board provided that such agreement is made before the expiration of the 45-day period. (Government Code 911.6)

The Board or its designee shall grant the application to present a late claim where one or more of the following conditions are applicable: (Government Code 911.6)

1. The failure to present the claim was through mistake, inadvertence, surprise, or excusable neglect and the District was not prejudiced in its defense regarding the claim by the claimant’s failure to present the claim within the time limit.

2. The person who sustained the alleged injury, damage, or loss was a minor during all of the time specified for presentation of the claim.

3. The person who sustained the alleged injury, damage, or loss was physically or mentally incapacitated during all of the time specified for presentation of the claim and the disability was the reason he/she failed to present the claim.

4. The person who sustained the alleged injury, damage, or loss died before the expiration of the time specified for the presentation of the claim.

If the application to present a late claim is denied, the claimant shall be given notice in substantially the same form as set forth Government Code 911.8. (Government Code 911.8)

If the Board does not take action on the application to present a late claim within 45 days, the application shall be deemed to have been denied on the 45th day unless the time period has been extended, in which case it shall be denied on the last day of the period specified in the extension agreement. (Government Code 911.6)

Action on Claims

Within 45 days after the presentation or amendment of a claim, the Board (or Superintendent, if delegated this authority) shall take action on the claim. This time limit may be extended by written agreement between the district and the claimant before the expiration of the 45-day period.

If the 45-day period has expired, the time limit may be extended if legal action has not commenced or been barred by legal limitations. (Government Code 912.4)

The Board may act on the claim in one of the following ways: (Government Code 912.4, 912.6)

1. If the Board finds that the claim is not a proper charge against the District, the claim shall be rejected.

2. If the Board finds that the claim is a proper charge against the District and is for an amount justly due, the claim shall be allowed.

3. If the Board finds that the claim is a proper charge against the District but is for an amount greater than is justly due, the Board shall either reject the claim or allow it in the amount justly due and reject it as to the balance.

4. If legal liability of the District or the amount justly due is disputed, the Board may reject or compromise the claim.

5. If the Board takes no action on the claim, the claim shall be deemed rejected.

If the Board allows the claim in whole or in part or compromises the claim and the claimant accepts the amount allowed or offered to settle the claim, the Board may require the claimant to accept it in settlement of the entire claim. (Government Code 912.6)

The Board or its designee shall transmit to the claimant written notice of action taken or inaction which is deemed rejection. The notice shall be in the form set forth in Government Code 913 and shall either be personally delivered or mailed to the address stated in the claim or application. (Government Code 913, 915.4)

BACKGROUND

Board policies, administrative regulations, and bylaws of the Board are routinely developed and revised as a result of changes in law, mandates, federal regulations, and current practice. The new Administrative Regulation 4112.6 All Personnel – Personnel Files is being created to reflect updated laws and current District practice. This item was presented to the Board on January 17, 2013, as information, and additional revisions were requested.

New language is provided in UPPER CASE while old language to be deleted is lined through. Additional language is provided in BOLD UPPER CASE.

Consideration of this item supports the goals identified within the District’s Strategic Plan.

RECOMMENDATION

It is recommended the Board of Education receive for information the new Administrative Regulation 4112.6 All Personnel – Personnel Files.

PERSONNEL FILES

THE SUPERINTENDENT OR DESIGNEE SHALL MAINTAIN ELECTRONIC PERSONNEL FILES FOR ALL CURRENT EMPLOYEES AT THE DISTRICT'S CENTRAL OFFICE.

THE SUPERINTENDENT OR DESIGNEE SHALL DETERMINE THE TYPES OF INFORMATION TO BE INCLUDED IN PERSONNEL FILES, INCLUDING, BUT NOT LIMITED TO, RECORDS REQUIRED BY LAW, AND SHALL PROCESS ALL MATERIAL TO BE PLACED IN SUCH FILES.

PERSONNEL RECORDS FOR CURRENT AND FORMER EMPLOYEES SHALL BE RETAINED IN ACCORDANCE WITH 5 CCR 16023.

PLACEMENT OF MATERIAL IN PERSONNEL FILES

ANY SUPERVISOR OR ADMINISTRATOR WHO PLACES WRITTEN MATERIAL OR DRAFTS WRITTEN MATERIAL FOR PLACEMENT IN AN EMPLOYEE'S FILE SHALL SIGN THE MATERIAL AND INDICATE THE DATE OF THE PLACEMENT.

WHEN AN EMPLOYEE IS ASKED TO SIGN ANY MATERIAL THAT IS TO BE PLACED IN HIS/HER FILE, HE/SHE SHALL BE INFORMED THAT THE SIGNATURE ONLY SIGNIFIES THAT HE/SHE HAS READ THE MATERIAL AND DOES NOT NECESSARILY INDICATE THAT HE/SHE AGREES WITH ITS CONTENTS.

ANY REQUEST BY AN EMPLOYEE TO INCLUDE MATERIALS IN HIS/HER PERSONNEL FILE MUST BE APPROVED BY THE SUPERINTENDENT OR DESIGNEE.

AN EMPLOYEE MAY INITIATE A WRITTEN REACTION OR RESPONSE TO HIS/HER PERFORMANCE EVALUATION. THE RESPONSE SHALL BE PERMANENTLY ATTACHED TO THE EVALUATION AND PLACED IN THE EMPLOYEE'S PERSONNEL FILE.

INFORMATION OF A DEROGATORY NATURE SHALL NOT BE ENTERED INTO AN EMPLOYEE'S PERSONNEL FILE UNLESS AND UNTIL THE EMPLOYEE IS GIVEN NOTICE AND AN OPPORTUNITY TO REVIEW AND COMMENT ON THAT INFORMATION. SUCH A REVIEW SHALL TAKE PLACE DURING NORMAL BUSINESS HOURS. THE EMPLOYEE SHALL BE RELEASED FROM DUTY FOR THIS PURPOSE WITHOUT A SALARY REDUCTION. INSPECTION OF AN ELECTRONIC PERSONNEL FILE SHALL TAKE PLACE ON A SECURED COMPUTER. THE SUPERINTENDENT OR DESIGNEE SHALL KEEP A RECORD OF THE DATE AND TIME THE FILE WAS REVIEWED AND THE NAME AND TITLE OF THE PERSON(S) PRESENT DURING THE REVIEW.

IN NO INSTANCE SHALL ANY MATERIAL BE REMOVED FROM THE RECORDS. REQUESTS FOR COPIES OF MATERIAL IN A PERSONNEL RECORD MUST BE MADE IN WRITING.
