BACKGROUND

The Delegate Assembly is the primary policy-making body of the California School Boards Association (CSBA). Delegates adopt the association’s platform, take positions on other critical issues that come before it, elect officers and directors and adopt bylaw changes. Delegates serve as a two-way communications link between the Board members in the region and the regional director and play an important role in fostering collegiality within their region.

Because of its enrollment, the Chino Valley Unified School District is entitled to appoint one delegate to serve a two-year term to the CSBA Delegate Assembly beginning April 1, 2013, through March 31, 2015. The appointment and biographical sketch form must be received by CSBA by March 15, 2013.

Approval of this item supports the goals identified within the District’s Strategic Plan.

RECOMMENDATION

BACKGROUND

Assembly Bill 790, written by Assembly Member Warren Furutani, calls for the establishment of “Linked Learning” pilot programs by up to 20 applicants in California. These applicants can include school districts, county offices of education, and charter schools serving students in grades 9 through 12. The pilot program will be used to assess how Linked Learning can be expanded into schools across the state.

“Linked Learning” programs are designed to transform students’ high school experience by bringing together strong academics, demanding career and technical education, and real-world experience to help students gain an advantage in high school, postsecondary education, and careers. Students follow industry-themed pathways, choosing among fields such as engineering, arts and media, or biomedicine and health. Participation in Linked Learning prepares students to graduate from high school and succeed in a full range of postsecondary options, including two- or four-year colleges, certification programs, apprenticeships, military service, or formal job training.

Four San Bernardino County school districts have agreed to form a Linked Learning consortium to work with two expert intermediaries, ConnectEd and the San Bernardino County Superintendent of Schools (SBCSS), as well as other partners to improve high school student achievement and better prepare students for college and career through a Linked Learning Approach.

The partnering school districts include Chino Valley Unified School Distirct (CVUSD), Colton Joint Unified School District, SBCSS, and the Upland Unified School District. SBCSS will serve as the lead entity of the Linked Learning San Bernardino Consortium. ConnectEd: The California Center for College and Career, will guide the planning, implementation, and materials as well as provide coaching, professional development, and mentoring for the writing of the Linked Learning pilot application.

January 17, 2013 Page 2 ConnectEd: The California Center for College and Career, through the support of The James Irvine Foundation, has approved a grant in the amount of $35,000.00 for the CVUSD to support the District’s planning to develop a district-wide system of Linked Learning pathways.

SUBJECT: PUBLIC HEARING TO RECEIVE COMMUNITY INPUT ON THE PROPOSED NAME CHANGE OF DISTRICT FACILITIES

BACKGROUND

On January 19, 2012, the Board of Education received for information a request from the Committee for the Samuel Burton Adult Education Center seeking consideration to rename the Chino Valley Adult School to the Samuel Burton Adult Education Center. On February 16, 2012, the Board of Education approved moving forward with the process, and subsequently appointed six community members to the Citizens’ Advisory Committee on the Naming of Facilities on September 6, 2012.

On October 14, 2012, the District received a request from Chino High School teacher, Felicia Ambrosia, to consider naming the varsity baseball field at Chino High School after former longtime varsity baseball coach and District employee, Bob Sheehan.

In accordance with Board Policy 7310, Naming of Facility, the Citizens Advisory Committee on the Naming of Facilities held public meetings on November 5, 2012, and November 26, 2012, to discuss naming proposals as well as the fiscal impact and other consequential impacts to the educational program.

On the proposal to change the name of the Chino Valley Adult School to the Samuel Burton Adult Education Center, the Citizens’ Advisory Committee was asked by the Committee for the Samuel Burton Adult Education to instead honor Mr. Burton by changing the name of the CVUSD Professional Development Center/Media Center to the Samuel R. Burton Professional Development and Media Center. This change came about as the fiscal impact to change the name of the Chino Valley Adult School and other consequential impacts to the educational program came to light. As Mr. Burton was heavily involved with the formation of the Professional Development Center/Media Center, the Citizens’ Advisory Committee supports and makes the recommendation to the Board of Education to proceed with the process for this name change. All costs associated with this request will be covered by the Committee for Samuel Burton.

January 17, 2013 Page 16 On the proposal to name the Chino High School varsity baseball field after Bob Sheehan, the Citizens’ Advisory Committee supports and makes the recommendation to the Board of Education to proceed with the process to recognize Mr. Sheehan’s accomplishments as a longtime coach by allowing a bronze plaque to be placed at the field, rather than naming the field after Mr. Sheehan. Any costs associated with this request shall be covered by the Chino High School staff member(s) submitting the request, and/or booster club(s) and the Associated Student Body.

In accordance with Board Policy 7310, Naming of Facilities:

1. Beginning December 12, 2012, the public was notified through the local news media, the District cable channel and the District website of the 30-day opportunity to submit recommendations for names of these facilities.

2. Upon the conclusion of the 30 days, at the next regularly scheduled board meeting, the Board shall hold a public hearing on the proposed name change and entertain public comments.

3. At the following regularly scheduled Board meeting, the item shall come before the Board; the Board will again entertain public comments and take action on the items.

Approval of this item supports the goals identified within the District’s Strategic Plan.

BACKGROUND

Pursuant to Article 15.6.1 of the current Collective Bargaining Agreement between the California School Employees Association, Chapter No. 102 (Association), and the Chino Valley Unified School District (District), the Association shall submit in writing a request to the District to negotiate the effects of layoff or the decision to reduce hours.

As a result of those negotiations between the Association and the District, the attached Memorandum of Understanding (MOU) pertains to layoffs identified in Board Resolution 2011/2012-46, Board Resolution 2011/2012-48, Board Resolution 2011/2012-49, and Board Resolution 2012/2013-09. The MOU is subject to ratification by the Association’s membership and adoption by the Board of Education. The Association’s membership voted to ratify the MOU on December 4, 2012.

Approval of this item supports the goals identified within the District’s Strategic Plan.

RECOMMENDATION

It is recommended the Board of Education adopt the Effects of Layoffs Memorandum of Understanding between the California School Employees Association, Chapter No. 102, and the Chino Valley Unified School District.

January 17, 2013 Page 18 EFFECTS OF LAYOFFS MEMORANDUM OF UNDERSTANDING BETWEEN THE CALIFORNIA SCHOOL EMPLOYEES ASSOCIATION AND ITS CHINO CHAPTER 102 AND THE CHINO VALLEY UNIFIED SCHOOL DISTRICT

NOVEMBER 15, 2012

Pursuant to negotiations between the Chino Valley Unified School District (District) and the California School Employees Association and its Chino Chapter 102 (CSEA), the following MOU is in regards to layoffs identified in Board Resolution 2011/2012-46, Board Resolution 2011/2012- 48, Board Resolution 2011/2012-49 and Board Resolution 2012/2013-09 (See Attachments A).

General Provisions

1. The positions being eliminated by classification are set forth in the referenced addendum attached hereto (See Attachment B). 2. Unit members laid-off or subject to voluntary reductions in hours receive health and welfare benefits as per Article 12 at the District’s contractual cap at the laid-off employee’s current level until the effective date of layoff. The District will pay that portion of the COBRA payments on behalf of the laid-off employees that is mandated by law. 3. Unit members laid-off or subject to voluntary reductions in hours shall be allowed to utilize vacation, Personal Necessity and/or unpaid leave, to seek other employment opportunities, unemployment or retirement benefits pursuant to the applicable provisions of Article 8 and Article 14 of the classified collective bargaining agreement until the effective date of layoff. 4. Unit members laid-off or subject to voluntary reductions in hours shall be allowed paid time to attend meetings with representatives from the Employment Development Department (EDD) regarding unemployment benefits as scheduled by the District until the effective date of layoff. The District agrees not to contest any laid-off employees’ valid unemployment claim.

Displacement Rights and Additional Work Provisions

Displacement Rights:

1. Layoff of classified bargaining unit members shall be conducted in accordance with Article 15 of the classified collective bargaining agreement and applicable laws. 2. The parties agree to review the entire displacement rights process in the Collective Bargaining Agreement (CBA). The order of layoff list and displacement options (bumping list) shall be provided electronically to CSEA. Employees receiving a layoff and/or bumping notice shall be noticed of their individual displacement option(s). All notices sent to affected unit members shall be provided electronically to CSEA (Chapter President and to the assigned CSEA Labor Relations Representative). 3. The district will provide a current electronic copy of the 39/63-month Reemployment List to CSEA (Chapter President and the assigned CSEA Labor Relations Representative) after the bumping process has been completed. Said 39/63-month Reemployment List shall be periodically updated and provided to CSEA.

January 17, 2013 Page 19 4. In accordance with Education Code 45115 unit members on the above referenced layoff list (See Attachments A) may elect retirement in lieu of layoff.

Additional Work Provisions:

1. If there is a vacant classified position and there are no bargaining unit members on the above referenced layoff list who have reemployment or bumping rights to that position, the most senior qualified unit member on the reemployment list has the right to the vacant position, provided that the District determines that he/she meets the minimum qualifications of the job description and passes the required tests at the time the position becomes vacant, even if he/she has never previously held that position. Furthermore, in order to be considered for a vacant position the unit member on the reemployment list must submit an application during the time the District advertises the vacant position. 2. Unit members who are on the current 39-month reemployment list as a result of the aforementioned Board Resolutions and who are laid off not in a regular assignment shall receive offers to substitute and/or work in temporary assignments in any classification they meet minimum qualifications. Unit members on the 39-month reemployment list shall notify the District in writing of those classifications they are interested in working and they meet minimum qualifications (subject to verification by the District for specific qualification requirements normally required of all substitutes). 3. Unit members who are on the current 39-month reemployment list as a result of the aforementioned Board Resolutions shall receive not less than their normal contractual rate of pay at the appropriate step for any classification previously worked and not less than step A for classifications not previously worked.

Performance of Remaining Work and Employee Workloads

1. The District acknowledges that, due to layoffs, the same level of services may not be provided. 2. Each supervisor will work closely with the unit member(s) he/she supervises in assigning the priority and frequency of tasks within the unit member’s job description. Should a unit member believe they have been subjected to unreasonable workload demands due to elimination of positions, the parties will meet to identify options for resolution. Management has the right to decide priorities and frequency for the tasks to be performed. The frequency and duration of tasks may vary from time to time based on District needs. 3. The District will not use volunteers or non-unit members to perform tasks customarily performed on a regular basis exclusively by the positions laid off specified in Attachment “A”. This section shall be in accordance with Appendix “D” of the CBA. 4. The District shall not assign unit members tasks outside of their job description unless the Education Code and Collective Bargaining Agreement procedures for out of class work are followed. 5. The parties agree to meet as needed to review and identify options for resolution for any workload issues that may arise.

This MOU is subject to the grievance procedure contained in Article 5 of the Collective Bargaining Agreement.

This MOU shall expire when unit members on the current 39/63 Month Reemployment List as per Board Resolution 2011/2012-46, Board Resolution 2011/2012-48, Board Resolution 2011/2012-49,

President, congratulated and welcomed to the Board Irene Hernandez-Blair and Andrew Cruz and said it will be a pleasure working with them for the next four years; thanked Fred Youngblood and David Black, and said the Association appreciated working with them during the time they served on the Board; addressed the action item on the agenda regarding restoration of grade level/department chair stipends, and said the Association is happy to see the item on the agenda, but there was disappointment that it is only for the remainder of the school year; said the Association believes that it is a bargainable item and that it was removed at the February 2 budget session last year and that a grievance has been filed on that, but hopes tonight’s action will be the resolution, but was disappointed to see it was for this school year only; and that the Association is willing to have more conversation if it needs to.

Denise Arroyo, CSEA President, welcomed James Na back to the Board and welcomed Irene Hernandez-Blair and Andrew Cruz to the Board; thanked Fred Youngblood and David Black for their service to the Board and the community; acknowledged CSEA classified employees who are retiring and for their years of service including: Lucy Diaz, 24 years of service; Patricia Angeleri, 27 years of service; Maria Gonzalez, 20 years of service; Vitalina Sousa, 36 years of service; David Lara, 18 years of service; and Rosemary Zamora, 16 years of service; said this reflects the commitment that classified employees have to the students and District; said that bus driver Lucia Quinonez has stage 4 cancer and is in hospice care, and asked that she be kept in prayer; wished the Board and staff a merry Christmas; and closed by encouraging everyone to take the time to rest and spend time with the family.

V. COMMUNICATIONS

BOARD MEMBERS AND SUPERINTENDENT

Charles Dickie, congratulated James Na on being reelected to the Board; congratulated Andrew Cruz and Irene Hernandez-Blair for being elected to the Board and said he looks forward to working together with them; said he rode in the Chino Christmas parade last Saturday; said he and his wife attended the Madrigal Feaste at Ayala HS, and said the food was delicious and the talent was extraordinary and urged the community to attend the various upcoming District programs; and wished everyone a merry Christmas.

Andrew Cruz said that last week he was a Principal for a Day at Eagle Canyon ES and spoke about what he observed throughout the day, including teachers using instructional methods and strategies, children engaged, clerks maintaining the school, and parent volunteers, all which help student success; said he was invited to a Christmas show by Ms. Aguire’s 1st graders, and spoke about the value of fine arts; and said his 1st grade daughter participated in her first Christmas parade.

Irene Hernandez-Blair thanked everyone present, voters of the community for placing her on the Board and putting trust in her to do the right thing, and is glad the whirlwind is almost over; thanked President Orozco for making sure all her papers are in order at the dais; participated in Principal for a Day at Boys Republic and the Adult School; said she followed Principal Rick Landorf in the morning and that it was overwhelming and she is concerned that he doesn’t have an assistant principal and doesn’t know how he manages all that he does in a day; said it is wonderful that our community has a program that exists for troubled and at risk youth, and is elated to know that our community embraces them; said she and her family will be attending the Madrigal Feaste for the first time this Saturday; said she is not sure how the process works, but would like to create an arts committee for grants to restore and supplement the arts, and asked for community volunteers who may be interested once she is guided through the process; wished her son a happy 10th birthday for Friday; and wished everyone present and in the community a merry Christmas.

James Na thanked Mr. Dickie for serving as President; said he is gentlemen and a scholar and truly appreciated his kindness and character; said he thinks the true strength of our school District is that we are professional and compassionate; said he attended the City of Chino Christmas parade; said students from Don Lugo HS decorated the carriages and thanked them for their wonderful and hard work; acknowledged Isaiah’s Rock for serving those in need and that they are currently preparing to distribute toys to the community this Christmas time; thanked Fred Youngblood and David Black for their service; welcomed Andrew Cruz and Irene Hernandez-Blair; asked that we trust in God and not in our own understanding and that we need to do good and serve others; and wished everyone a merry Christmas.

Superintendent Joseph thanked David Black and Fred Youngblood for their service; congratulated Irene Hernandez-Blair and Andrew Cruz; congratulated James Na on his reelection; shared some of the events taking place throughout the District including: winter concerts that schools hold; said inmates at CIW refurbished 30 bicycles to be given to students through the C.A.R.E. program; said staff have been collecting toy and gift card donations for C.A.R.E. families; said the Chino Fire Foundation donated $3,000.00 to the C.A.R.E. program for gifts; said many schools are holding toy and gift card collections to help their own or to spread throughout the community; said some schools are offering part of their entry fees to concerts to benefit the victims of the storm Sandy; said some of our students performed at Disneyland; said 100 hundred students will be given $130.00 to shop at next week’s Make A Child Smile event at Wal-Mart, courtesy of Chino Valley Fire; said the Chino Lions are donating proceeds from the sale of Christmas trees to the Citizens for Kids Educational Foundation; said students at Boys Republic have been busy producing Della Robbia wreaths; said local businesses are spearheading toy and food collections for families in need; said that employees, students, and parents belonging to many organizations, churches, synagogues, and mosques are also helping families; and wished everyone a happy holiday season, merry Christmas and happy Hanukkah!

President Orozco commented to Mrs. Blair that her own son was in 1st grade when she was first elected to the Board and that he is now in 7th grade; thanked Charles Dickie for his leadership as Board President and for calmness through troubled waters; thanked David Black and Fred Youngblood for their service, hard work, and dedication; congratulated James Na and welcomed Andrew Cruz and Irene Hernandez-Blair; said she attended the CSBA conference and looks forward to sharing many of ideas with the Board; attended the Principal for a Day event and the Chino Christmas parade; acknowledged Don Lugo HS floral students who assisted with decorating for the parade; and said the students were asked to decorate all the carriages after the city saw the beautiful work they were doing for the school District’s carriage, which is a testament to the beautiful work the students do.

The Board of Education encourages excellence as a goal for all students and wishes to publicly recognize students for unique or exemplary achievements in academic, ATHLETIC, extracurricular or community service activities. The purpose of such awards shall be consistent with school goals.

The Superintendent or designee shall identify high school students who have met the criteria for the Distinguished Scholar award for graduation.

Graduate with Honors

The Superintendent or designee shall identify high school students who have met the criteria for the Graduate with Honors award for graduation.

Valedictorian and Salutatorian

To honor superior academic achievement, graduation ceremonies shall include recognition of a valedictorian and salutatorian. The Superintendent or designee shall establish procedures that ensure a fair determination of the students who have achieved the highest grade point average in the graduating class. If a tie exists, the principal may honor more than one valedictorian and/or salutatorian.

Scholarship Fund

The Board may maintain a scholarship fund which shall be used to provide, scholarships to qualifying students or graduates of district schools. (Education Code 35315) Scholarship funds shall be collected, deposited, administered and audited in accordance with law.

BACKGROUND

The Board of Education has established policies and standards of behavior in order to promote learning and protect the safety and well-being of all students. When these policies and standards are violated, it may be necessary to suspend or expel a student from regular classroom instruction.

Expulsion is an action taken by the Board for severe or prolonged breaches of discipline by a student. Except for single acts of a grave nature, expulsion is used only when there is a history of misconduct, when other forms of discipline, including suspension, have failed to bring about proper conduct, or when the student's presence causes a continuing danger to him/herself or others.

A student may be expelled only by the Board of Education. The Board shall expel, as required by law, any student found to have committed certain offenses listed in Education Code 48915.

Approval of this item supports the goals identified within the District’s Strategic Plan.

RECOMMENDATION

Based upon the recommendation of the Expulsion Hearing Administrative Panel, it is recommended the Board of Education approve the student expulsion cases 12/13-12, 12/13-15, and 12/13-16.

Administrative Regulation 5144.1 Students, Suspension and Expulsion/Due Process Readmission after Expulsion states:

• The Superintendent or designee shall hold a conference with the parent/guardian and the student. At the conference, the student’s rehabilitation plan shall be reviewed and the Superintendent or designee shall verify that the provisions of this plan have been met.

• School regulations shall be reviewed and the student and parent/guardian shall be asked to indicate in writing their willingness to comply with these regulations.

• The Superintendent or designee shall transmit his/her recommendation regarding readmission to the Board. The Board shall consider this recommendation, in closed session, if information disclosed would be in violation of Education Code 49073- 49079. If a written request for open session is received from the parent/guardian or adult student, it shall be honored.

BACKGROUND

The Board of Education may admit students expelled from other districts in accordance with law when consistent with the Board’s goal to provide a safe and secure school environment for students and staff.

The District shall not enroll a student expelled by another district for any of the offenses listed in Education Code 48915(a) or (c) (mandatory expulsion offenses) during the term of the student's expulsion, unless the enrollment is at a community day school. A student expelled for an act specified in Education Code 48915(a) or (c) may enroll in the District after the term of his/her expulsion if the Board finds, at a hearing, that the student does not pose a continuing danger to students or staff.

The Board, when making its determination whether to enroll an individual who has been expelled from another school district for any of the acts mentioned above, may consider the following options: deny enrollment, permit enrollment, or permit conditional enrollment in a regular school program or another educational program.

RECOMMENDATION

BACKGROUND

The Board of Education recognizes that the District may own personal property which is unusable, obsolete, or no longer needed by the District. Lists of surplus items are emailed to the Purchasing Department to be placed on an upcoming Board agenda. After Board approval, items may be picked up by District warehouse or a liquidation company for public auction. Proceeds of the sale are deposited into the General Fund.

The Board is requested to reject the claim against the District to allow the insurance carriers to investigate the merit of the claim and make a recommendation regarding disposition.

The Board of Education desires to ensure equal opportunities for all students in admission and access to the District's Educational programs, guidance and counseling programs, athletic programs, testing procedures, and other activities. ALL District programs and activities shall be free from discrimination, including harassment, with respect to a student's actual or perceived sex, gender, ethnic group identification, race, national origin, religion, color, physical or mental disability, age, or sexual orientation.

DISCRIMINATION MAY ALSO INCLUDE RETALIATION TOWARDS STUDENTS AND THEIR PARENTS/GUARDIANS FOR ENGAGING IN A “PROTECTED ACTIVITY”. BACKGROUND

Education Code 41020 states the Governing Board of each school district must provide an annual audit of all funds under the jurisdiction and control of the District.

Education Code 41020 further requires that not later than December 15 of each year, a copy of the annual audit report for the prior year be filed with the County Superintendent of Schools, the State Department of Education, and the State Controller’s Office.

By January 31 of each year, the Board of Education must review the annual audit for the prior year at a public meeting. The Annual Audit Report has been provided under separate cover.

A representative from Vavrinek, Trine, Day & Co., LLP, will present the audit report and answer questions at the Board meeting.

Consideration of this item supports the goals identified within the District’s Strategic Plan.

ANY AUTHORIZED REVIEWER SHALL MAINTAIN STRICT CONFIDENCE OF THE CONTENTS OF A PERSONNEL FILE.

FILE REVIEW BY EMPLOYEE

ANY EMPLOYEE WISHING TO INSPECT HIS/HER PERSONNEL RECORD SHALL CONTACT THE SUPERINTENDENT OR DESIGNEE.

WITH THE EXCEPTIONS NOTED BELOW, ALL PERSONNEL RECORDS RELATED TO THE EMPLOYEE'S PERFORMANCE OR TO ANY GRIEVANCE CONCERNING THE EMPLOYEE SHALL BE MADE AVAILABLE FOR INSPECTION BY THE EMPLOYEE. (EDUCATION CODE 44031; LABOR CODE 1198.5)

THE SUPERINTENDENT OR DESIGNEE SHALL NOT BE REQUIRED TO MAKE AVAILABLE TO THE EMPLOYEE: (EDUCATION CODE 44031; LABOR CODE 1198.5)

1. RECORDS RELATED TO THE INVESTIGATION OF A POSSIBLE CRIMINAL OFFENSE.

2. LETTERS OF REFERENCE.

3. RATINGS, REPORTS, OR RECORDS THAT WERE OBTAINED PRIOR TO THE EMPLOYEE'S EMPLOYMENT, PREPARED BY IDENTIFIABLE EXAMINATION COMMITTEE MEMBERS, OR OBTAINED IN CONNECTION WITH A PROMOTIONAL EXAMINATION.

PERSONNEL RECORDS RELATED TO THE EMPLOYEE'S JOB PERFORMANCE OR TO ANY GRIEVANCE CONCERNING HIM/HER SHALL BE MADE AVAILABLE TO THE EMPLOYEE AT REASONABLE INTERVALS AND AT REASONABLE TIMES.

THE SUPERINTENDENT OR DESIGNEE SHALL PERMIT THE EMPLOYEE TO INSPECT THE PERSONNEL RECORDS AT THE LOCATION WHERE THE DISTRICT STORES THE PERSONNEL RECORDS, WITH NO LOSS OF COMPENSATION TO THE EMPLOYEE. (LABOR CODE 1198.5)

THE EMPLOYEE MAY BE ACCOMPANIED BY A REPRESENTATIVE OF HIS/HER CHOICE WHILE REVIEWING HIS/HER PERSONNEL RECORDS.

INSPECTION OF AN ELECTRONIC PERSONNEL FILE SHALL TAKE PLACE ON A SECURED COMPUTER. THE SUPERINTENDENT OR DESIGNEE SHALL KEEP A RECORD OF THE DATE AND TIME THE FILE WAS REVIEWED AND THE NAME AND TITLE OF THE PERSON(S) PRESENT DURING THE REVIEW.

IN NO INSTANCE SHALL ANY MATERIAL BE REMOVED FROM THE RECORDS. REQUESTS FOR COPIES OF MATERIAL IN A PERSONNEL RECORD MUST BE MADE IN WRITING.
