Short Title. – This Act shall be known and cited as the “Charter of the Cebu Port Authority” SECTION 2. Declaration of Policy . – It is the declared policy of the State to promote the establishment and growth of autonomous regional port bodies to produce an efficient, safe, economical and coordinated system of movement of goods and persons through the port, consistent with the constitutional mandate to give all regions of the country optimum opportunity to develop. SECTION 3. Creation of the Port Authority- There is hereby created a public-benefit corporation to be known as the Cebu Port Authority, hereinafter referred to as the Authority. The Authority shall be under the supervision of the Department of Transportation and Communications for purposes of policy coordination. SECTION 4. Definition of Terms- For purposes of this Act, unless the context indicates otherwise, the terms used herein shall mean as follows: (a) “Port facility” shall included wharves, piers, slips, docks, bulkheads, basins, warehouses, cold storage, loading and unloading equipment, and passenger terminals and -

As of 2004, the total length of the non-toll road network was reported to be 202,860 km, with the following breakdown according to type: • National roads - 15% • Provincial roads - 13% • City and municipal roads - 12% • Barangay (barrio) roads - 60% Road classification is based primarily on administrative responsibilities (with the exception of barangays), i.e., which level of government built and funded the roads. -

For each included country, it offers a) a general overview, b) national port development policies, c) examples of national good practices and d) challenges for further port development and productivity enhancement. 2.1.1 Bangladesh 1) Overview Bangladesh is the 42nd largest market-based economy in nominal term in the world and 31st largest by purchasing power parity. It is classified among the next eleven emerging market middle income economies and is considered to be a frontier market. Over the past few years, Bangladeshi economy has been growing rapidly and it continues to grow at an impressive rate. According to the IMF, Bangladesh remained the second fastest growing major economy from 2016 to 2018, with a rate of 7.0 percent. Figure 2.1.1.a. 1. MAERSK LINE VS COURT OF APPEALS FACTS: Maersk Line is engaged in the transportation of goods by sea, doing business in the Philippines through its general agent Compania General de Tabacos de Filipinas. Private respondent Efren Castillo is the proprietor of Ethegal Laboratories, a firm engaged in the manufacture of pharmaceutical products. On November 12, 1976, private respondent ordered from Eli Lilly. Inc. of Puerto Rico through its agent in the Philippines, Elanco Products, 600,000 empty gelatin capsules for the manufacture of his pharmaceutical products. The capsules were placed in six (6) drums of 100,000 capsules each valued at US $1,668.71. The 600,000 empty gelatin capsules in six drums were already shipped on board MV "Anders Maerskline" for shipment to the Philippines via Oakland, California. Shipper Eli Lilly, Inc. specified the date of arrival to be April 3, 1977. Said cargo of capsules were mishipped and diverted to Richmond, Virginia, USA and then transported back Oakland, Califorilia. The goods finally arrived in the Philippines on June 10, 1977 or after two (2) months from the date specified in the memorandum. As a consequence, private respondent as consignee refused to take delivery of the goods on account of its failure to arrive on time. Private respondent alleging gross negligence and undue delay in the delivery of the goods, filed an action before the trial for rescission of contract with damages against petitioner and Eli Lilly, Inc. as defendants. Denying that it committed breach of contract, petitioner alleged in its that answer that the subject shipment was transported in accordance with the provisions of the covering bill of lading and that its liability under the law on transportation of good attaches only in case of loss, destruction or deterioration of the goods as provided for in Article 1734 of Civil Code.
