(RI) Came to VA before adulthood; sson returned to Eng. and was Parliamentary Army officer. 1649 his reg't. participated in executing Charles I. "The visits of distinguished men from Boston and other places, and his silence in regard to his previous history, perhaps account for the persistently held tradition that he was one of the regicide judges and had signed the death warrant of King Charles...It has been conjectured that Theophilus Whaley may have been identical with Robert Whaley, a brother of Edward, the Regicide, and that he may have changed his name for some reasons connected with the execution of King Charles." (RI). 1660, returned to VA and married. 1680 to Kings Town RI, leaving VA perhaps due to a religious controversy with his neighbors (he was Baptist). Res. near the head of Pettaquamscut Pond (South Kingstown). "Looking over and beyond the Rome estate and the village of Wickford still farther to the north, may be see the picturesque country bordering on Narragansett Bay, called by the Indians Quidneset. Still farther in the same direction lies Potowomut Neck, whereon since my memory the blacksmith's shop stood in good repair... A half- mile or less south of Snuff Mill Pond may yet be seen from the hill a gentle declivity on the eastern side of the lake, on which since my memory stood a homely cottage in which lived for many years Theophilus Whalley, the regicide, and whose location is mentioned in President Styles' history of the Judges of King Charles the First. I extract the following from "Potter's Early History of Narragansett," page 311: 'Whale or Whalley--The following account is abridged from Style's history of the Judges of King Charles I. Theophilus Whale lived on the Willett farm. He came there from Virginia about 1679-80, built an underground hut at the north end of the pond, and lived by fishing and by writing for the settlers. From his name he was supposed to be the judge, and when questioned answered obscurely. Colonel Francis Willett said that the gentlemen who visited them from Boston in his father's time treated Whale with great respect and furnished him with money. In Queen Anne's war, a ship of war whose captain's name was Whale anchored near there, and they visited and recognized each other as cousins.

5 Whale always used to say that he was of collegiate education, had been brought up delicately, and had been a captain in the Indian wars in Vrignia. He knew Hebrew, Greek, &c. He subsisted part of the time by weaving. Whale died about 1719-20, aged 104 years.' " (Recollections of Olden Times, page 30--internet copy of pages 66-67)

"(142) Theophilus Whaley-1, son of Richard Whaley, came to America, prior to 1637, going to Virginia in a military capacity, and married about 1670 Elizabeth Mills. (142)Theophilus Whaley, b. 1616. d. 1720. (143) Elizabeth Mills, b. 1645. d. 1715. [lists 7 children & details]. (142) Theophilus (Robert) Whalley is believed to be the son of Richard Whalley, of Kirkton Hall, Nottinghamshire, England, and a country member of Parliament, in the last of Queen Elizabeth's Reigne. His (Theophilus) brother, Edward Whalley, married Frances Cromwell, who was a cousin of the Great Protector, Oliver Cromwell. Theophilus is supposed to be the Regicide, whom the Colonist hid for years and he changed his name from Robert to Theophilus, for safety and kept his identity a secret. He said little about his family in England, but it was remembered after his death that he had sometimes remarked that until he was eighteen years old he knew not what it was to want a servant to attend him with a silver server and napkin whenever he wanted to wash his hands. He went while he was a young man to Virginia in a military capacity, where he met and married Elizabeth Mills. He returned to England, where he served in the Parliamentary Army, his Regiment taking part in the execution of Charles I. He later returned to Virginia and for religious reasons left that Colony and settled in Kingston, R.I. (idib, page 212-4--internet pg. 129-130)

She was the daughter of 134. Henry Briggs and 135. Elizabeth Spencer.

Notes for Thomas Cornell: Eliza Newton Woolsey Howland: Family Records, 1900, says Thomas from Essex came to Boston in 1636 with Roger Williams and Ann Hutchinson--cites news report in Newport Daily News mentioning him as a cohort with Roger Williams; he was owner of 100 ac. of Portsmouth, RI, which is still in his family (in 1900); family attacked by Indians there; he died there in 1655. "Cornell's Neck" was left to daughters Rebecca and Sarah (Willett); Rebecca sold her share to Sarah; Rebecca Briggs Cornell was murdered at home in Portsmouth on 8 Feb. 1673 (her son Thomas was charged, tried and the jury said he did it or abetted, and was executed).

1638, Sep. 6, Boston: He was licensed, upon trial, to keep an Inn. In the room of William Banistone, till next General Court. 1639, Jun. 4: He was fined L30 for several offences, selling wine without license, and beer at 2d. a quart. 1639, Jun. 6: He was abated L10 of his fine, and allowed a month to sell off his beer which is upon his hands, and then to cease from keeping entertainment, and the town to provide another. 1641, Feb. 4: Portsmouth. He had a pice of meadow granted, to be fenced at his own cost. 1641, Mar. 16: Freeman. 1641: Constable. 1642-1644: Ensign. 1643, Sep: He was for a brief period at New York (Throgg's Neck), but Mr. Winthrop records under this date, that the Indians set upon the English who dwelt under the Dutch, and killed "such of Mr. Throckmorton's and Mr. Cornhill's families as were at home." He further says of the English settlers: "These people had cast of ordinances and churches," and "for larger accomodation, had subjected themselves to the Dutch, and dwelt scatteringly near a mile asunder. Some that escaped the Indian attack went back to Rhode Island." 1646, Feb. 4: He was granted 100 acres at the farther end of Wading River (Portsmouth). 1654: Commissioner. 1655: Freeman. 1657, Dec. 10: Rebecca Cornell was granted 10 acres, in lieu of 10 acres granted her husband. 1661, Apr. 30: Rebecca Cornell, widow and executrix of Thomas Cornell, sold richard Hart for L30, two parcels of land containing 8 acres with home, fruit trees, &c. 1663, Oct. 25: She deed land to son Joshua Cornell at Dartmouth. 1663, Jul 27: She deeded to eldest son Thomas Cornell all her housing, orchard, land and fencing in Portsmouth. 1669: She deeded land to son Samuel, of Dartmouth. (from Rhode Island Genalogies, p. 55) 11 Notes for Rebecca Briggs: 1673, Feb. 8. The Friends' records state "Rebecca Cornel, widow, was killed strangely, at Portsmouth, in her own dwelling house, was twice viewed by the Coroner's Inquest, digged up and buried again by her husband's grave in their own land." Her son Thomas was charged with her murder, but although the jury's verdict in regard to this affair was, that "he did murder his mother Rebecca, or was aiding or abetting thereto;" yet the evidence in the case would seem to have been in no way conclusive. There was much evidence taken. The son said in his own defence that having discoursed with his mother about an hour and a half he went into the next room and staid three-quarters of an hour. His wife then sent his son Edward to his grandmother to know whether she would have some milk boiled for her supper. The hild saw some fire on the floor and came back and fetched the candle. Then Henry Straight, myself and the rest followed in a huddle. Henry Straight saw what he supposed was an Indian, drunk and burnt on the floor, but when Thomas Cornell perceived by the light of the candle who it was, he cried "Oh Lord it is my mother." Her clothes and body were much burned, and the jury found a wound on uppermost part of stomach. John Briggs testified as to an apparition of a woman that appeared at his bedside in a dream, and he cried out "in the name of God what art thou," the apparition answered "I am your sister Cornell" and thrice said "See how I was burnt with fire." John Russell, of Dartmouth, testified that George Soule told him (since the decease of Rebecca Cornell), that once coming to the house of Rebecca, in Portsmouth, she told him that in the spring she intended to go and dwell with her son Samuel, but she feared she would be made away with before that. Thomas, Stephen, Edward and John Cornell (sons of Thomas), gave testimony as to their grandmother's death, saying their father was last with her. Mary Cornell, wife to John, aged twenty-eight years, testified that three or four years past being at her mother-in-law, Rebecca Cornell's, and meeting her on returning from the orchard to the house, she said to deponent that she had been running after pigs and being weak and no help and she being disregarded, she thought to have stabbed a penknife into her heart, that she had in her hand, and then she sould be rid of her trouble, but it came to her mind, "resist the Devil and he will flee from you" and then she said she was well satisfired. (By one account Thomas Cornell is given two additional children, viz: William and Ann). (from Rhode Island Genalogies, p. 55)

Will of Rebecca, widow of Thomas, dated 2 Sept. 1664, proved 1673. Gave her Portsmouth lands to son Thomas and his eldest son Thomas and his wife Elizabeth. To son Richard, land at Acushnet and Accoxet in Dartmouth (now New Bedford and Westport, Mass.). Bequest to son William. To sons John, Samuel and Joshua, lands of Accoxet. To daughter Sarah, lands in the Bronx (New York). To daghter Anne and her husband Thomas (i.e. Thomas Kent), ten acres in Portsmouth. To daughter Rebecca, land in the Bronx. Bequests to daughters Elizabeth and Mary. The will disposes of a considerable amount of plate. (Original will among unrecorded papers at the Portsmouth Town House.) (American Genealogist, v. 19, p. 132.)

(Rhode Island Genealogies has numerous notes on each of Thomas and Rebecca's children, and notes which I quote re: Rebecca's murder)

72. Henry Fowler II31, born 159031. He was the son of 144. Henry Fowler I and 145. Annis Knight.

Child of Henry Fowler II is:

12 36 i. Henry Fowler III, born Abt. 1632 in Hambleton (Rutland) ENG; died September 19, 1687 in Marmaroneck (Westchester) NY; married Rebecca Newell June 04, 1655 in Providence, RI.

74. Abraham Newell II32,33,34, born 1581 in Ipswich (Suffolk) ENG; died June 13, 1672 in Roxbury (Suffolk) MA. He was the son of 148. Abraham Newell and 149. Frances. He married 75. Frances Foote? 1619. 75. Frances Foote?35,36, born 1594; died November 13, 1682.

Notes for Abraham Newell II: Came on the Francis, age 50 in 1634, with wife Frances, 40, and children Faith, 14 ("Ruth" in church records), Grace, 13, Abraham, III, 8, John 5, Isaac 2, Jacob (born on ship). Freeman, 1635. Tailor, probably native of Essex, England.

Hotten says Faith Newell, aged 14 and Henry Howard aged 7 came aboard the Francis with John Bernard, 36 and wife Mary, 38, sailing "the last of April, 1634." (278-9) See also The Great Migration, vol 1, p. 161.

Doret Newell Jenkins in GenForum: Newell #683, cites similar information from "Original Lists of Persons of Quality of Those who Embarked for New England, 1634-1637," and adds that same list is on page 270-1 of "The Genealogical Dictionary of New England of Those Who Arrived Before 1692," vo. III, and notes Jacob born on voyage; says Abraham, son of Abraham; child born within 6 weeks of 30 Oct 1651; assumes Frances died and Abraham married 8 Feb 1652 to Susannah Rand, daughter of Rober of Charlestown. I wonder if that couldn't be Abraham, III.

Roxbury, MA Newell deaths: Isaac, son of Abraham, died 25 Dec. 1678, age 11; Abraham, 9 Oct 1726.

"There is no listing of a parish in England that Abraham and Frances had membership. They became members of John Eliot's Roxbury Church--no date is recorded when they owned the covenant. The children were in their late twenties and early thirties when they became members. You either lived in accord to the church's teachings or you were not welcome. Many were returned to England for disputing the teachings and authority of the church." (from Newell Ancestry, by William M. Emory, cited in Trakel: A Family Genealogical History., p. 18)

"So this was the beginning of the flow of dissenters and nonconformists to the New World. The Charles the First Act, the imposition of a forced loan without the grant of Parliament raised a storm of indignation, especially among the nonconformists. This Act motivated many to emigrate during the 1630's. The Abraham Newell family was among those. Hotton's "List...", pages 277, 278 and 279, from Suffolk, Port of Ipswich, name of ship 'Francis' of Ipswich, Master - Mr. John Cutting, Date - April, 1634. (from Ipswich Custom House, 10 November, 1634). Abraham Newell has no parish listing; therefore, the family was probably of teh non-conformist inclination. ...To quote Holmes - "Directory of Ancestral Heads of New England Families 1600-1700" we read, 'Newell, Abraham, born in England 1584, came from Ipswich, England to Roxbury, Massachusetts 1634 and settled there. Mr. Newell was made a Freemand in March of 1634. Both he and his wife lived to advanced life, he dying 30 June 1673 at 91, and she in November of 1682, age nearly 100 years.'... [Goes on to cite Drake: 'The Town of Roxbury,' 1876]: "Most of the Roxbury Colonists came from the Nazing Parish Church, Essex County, England. A William Pynchon, 'a gentleman of learning and religion' was one of the principal founders of Roxbury and the first member in forming the Congregational Church there...." [And cites "Savages Genealogical Dictionary - Vol. III, pages 270-273, as noted above.] (ibid, 19-22)

"The location of his homestead is fixed by a description in Volume 34 of the Boston Record Commisioners' Reports, dealing with "the Town of Roxbury," as follows: 'Abraham Newell and Edward Porter were the original proprietors of the homesteads and orchards afterwards known as 'Maccarty Farm' This tract contained sixty acres and lay between Hawthorne Street and Walnut Avenue, extending from Cedar Street on the north to Marcella Street on the south.' And again, in a nother reference to Newell property in connection with the 'Story of the Dedham Turnpike,' dealing with the Isaac Morrill estate, bounded by Dudley, Warren, St. James and Washington Streets, a part of which was called 'the Foxholes.' Reference is to twenty six acres bounded on the south by Abraham Newell and Edward Bugby, 'which seems identical with territory on both sides of Circuit Street.' A deed of Setp. 4, 1666 shows that Mr. Newell's dwelling house, which stood on a tract of sixteen acres, had been burned, and that his son Abraham built a house on the site. A brief account of the fire is given in the records of Rev. John Eliot, minister of the First Church of Roxbury, who wrote as follows: 'June 20, 1665. At shutting in happened a burning in Roxbury in ye dwelling House of Abraham Newell Sr & June 23 his old barn fired by his

13 girle.' Just who is 'girle' may have been is a problem. She may have been a granddaughter, or more likely a servant. Mr. Eliot records another fire in the following language: '1 mo. 6, 1672. Abraham Newels house was burnt. our congregation made a collec'o for him of 14 lb.'" [This continues with much detail, including facts and citations, but I will skip on.] ("Newell Ancestry", p 5)

Notes for Frances Foote?: Surname "Foote?"--per Anthony Gagliani in GenForum: Newell #695. I note elsewhere: "It is also of importance to note that the Roxbury Land records show that the Newell family owned land next to the Foote Family of Providence, as Rebecca Newell, a daughter of Abraham newell, Jr., was married in the Foote home to Henry Fowler." (in "Newell Ancestry", by William M. Emory, cited in Trakel: "A Family Genealogical History", page 42).

Children of Abraham Newell and Frances Foote? are: 37 i. Rebecca Newell, born July 15, 1637 in Roxbury (Essex) MA; died in Westbury, NY; married Henry Fowler III June 04, 1655 in Providence, RI. ii. Faith/Ruth Newell, born 1620. iii. Grace Newell, born 1621. iv. Abraham Newell III, born 1626. v. Isaac Newell, born 1632. vi. Jacob Newell, born Bet. 1633 - 1634 in Atlantic Ocean.

76. William Thorne37,38, born Bet. 1505 - 1617 in (Dorsetshire) ENG; died Bet. 1657 - 1664 in NY. He was the son of 152. John Thorne. He married 77. Susannah Booth Bef. 1636. 77. Susannah Booth, born in England; died Aft. 1675.

Notes for William Thorne: "The marriage of the daughter of Nicholas Parsell to the son of William Thorne will afford a parting opportunity to again consider the close family relationships that existed amongst the leading Dutch-English traders before they came to America in connection with the tobacco monopoly. The ancestors of William Thorne came from -Staffordshire where Thomas Thorne was proprietor of the manor and estate of Thornes, in the parish of Shenstone, temp. Edward IV., in which reign he built a mansion at Thornes. In the History of Shenstone, by the Rev. henry Sanders, B. A., published in 1794 [Vol. ix, No. 4, 2061, among the collection of Miscellaneous Antiquities in the British Museum Reading Room], it is said that this was a manor in the parish of Shenstone, adn belonged to a family of the name of Thornes, in the reign of Henry VI, who most likely purchased lands here from the lords of the manor, and, as was usual in those days, and earlier, took the name of Thornes from the place. The Thomas Thornes mentioned by Sanders had issue, Thomas, who in 1470, let Thornes on lease to one Richard of

14 the Ruddings. This lessor is described as of Salop, and from that period may be dated the settlement of the family at Shvlock. Members of the family had, however, been resident in Shrewsbury some ninety hyears previous to the letting and subsequent alienation of the manor of Thornes. The last-named Thomas Thornes married Mary, daughter of Sir , of Moreton Corbet, Knight, and had issue Roger, who was grandfather of Roger Thornes, called The Wyse Thornes, who died in 1531. He was so named in Shrewsbury for that bothe toune and countrey repared to hym for advyse, whoe gyded this toune polytyckely, and lyeth buried in St. Mary's Church. This Shropshire worthy married a daughter of Sir Roger Kynaston, but being himself descended form a younger son, he did not inherit Shevlock, and died without issue. Shevlock continued in the male line until 1670, when the last male heir, Thomas, the son of Francis Thornes, by Beatrix, daughter of Sir Andrew Corbet of Moreton Corbet, died unmarried. Then we see that at the time of the granting to Edmund Pearsall of the tobacco monopoly, the thornes and Pershalls were relations by marriage to the same families in the Staffordshrie- Shropshire, specially the Moreton-Corbets, who were also tenants of the Pershalls. [Shropshire Notes and Queries, vol.1-2, page 32]. William Thorne of Flushing was the son of a Dutch-English trader from the Chesepeake Bay country, where the family were located on the Delaware peninsula, in the eastern shore of Maryland, in Somerset County. William Thorne was one of the party who, early in 1640, came from Hellgate Neck to the plains of Long Island where they founded the town of Hempstead. He had gone from Virgnia to Lynne, Massachusetts, in 1638, where he located. The next year he joined the other Dutch-English traders on Long Island. He thereby acquired a right to the land and property under the terms of the agreement for the first town government. When the patent was granted in 1644, for Hempstead, he obtained a proprietary right which he appears never to have exerciesed in the distribution of lands except for the benefit of others to whom he sold. He however retained his old holdings under the original town, which lands were subsequently, about 1677, occupied by his son William Thorne. William Thorne returned to Hellgate Neck before Doctor Denton arrived at Hempstead with his associates from Stanford. Upon his return to Hellgate Neck, William Thorne settled on lands which were later to be organized as the town of Flushing, but which he named Thornes Neck. Waller in his history of Flushing says William Thorne acquired htis property in 1642. But the sequence of events would make it nearly two years later before he occupied this neck of land. The next year, 1645, he was one of the original associators in foundeing the town of Flushing. Here he was early joined by Nicholas Pearsall, who was not one of the original incorporators. ...John Thorne was with his father, William Thorne, in Flushing, where he remained after his marriage, adn the records show that he there offered his services as a soldier in 1667. [New York Genealogical and Biological Register, vol. 19 page 153; Maryland wills, vol.1, page 51; Hempstead Town Records, vol. 1, page 309; vol. 8, pages 292-397.]" (C. E. Pearsall, 1477-8).

Notes for Nicholas Pearsall: Nicholas Parsell, signer of the Flushing Remonstrance (NYM:390 & Pearsall Fam., v.3, 1928, pp.1474-8) Nicholas Parsell and John Thorne accepted as "freeman" along with 8 others by Gen. Assbly of CT 12 May 1664 (during Brit. occupation of New Amsterdam).

Resided at Pearsall's on Hellgate Neck, and Flushing, Long Island. Constable of Flushing, apptd. Dec. 24, 1664. Queens County, Deed Book A, p. 43: deed dated March 16, 1686/7 wherein Nicholas Parcell of Flushing and Sarah his wife convey to William Fowler of the same place a salt meadow on Trues Neck bounded by William Lawrence and David Roer. Deed Book B. I, page 163: deed dated March 27, 1689/90, wherein Nicholas Parsell

15 of Flushing conveys to Daniel Whitehead land in Flushing on south side of the Kills, witnesses Thomas Oakley, john Everett, and Daniel Denton, Jr. "Witnessed and took part in the warfare in the Chesapeake Bay country which finally resulted in his being captured, along with his brothers and others on the Delaware River, and being carried as prisoner of war to new Amsterdam before Governor Van Twiller, only to be released and brought by De Vries to Virginia. But this did not happen without Nicholas Pearsall and his brothers throroughly spying out the land around New Amsterdam and making friends among those who were the most trustworthy in that community. So favorable was their report upon their return to Virginia that the movement of the Dutch-English traders to Long island, in 1639, completely changed the course of the tobacco trade in America, and hence in the world. Nicholas Pearsall settled at the town of Pearsall along with his brothers; the next year he removed to the open plains and joined with those who had founded the town of Hempstead as a great cattle and farming venture. Nicholas Pearsall had no love for the New Englanders who in 1644 proposed to join in patenting a town of Hempstead. He did not look with great favor upon the proposition to bring in such a large number of Puritans as would enable them to control the policies and politics of the town, so he returned to Hellgate Neck, as soon as he saw that the negotiations were going to result in these accessions to the town's population. There were others who thought as he did, and the year after the patent was issued for the town of Hempstead, they formed a more congenial company who moved across the creek on Hellgate Neck and founded the town of Flushing.... [goes on to note Quaker founding of Flushing]...Nothing more is known concerning Nicholas Pearsall until 1664 when he was appointed constable of the town of Flushing....Nicholas Pearsall survived all his brothers....There is no finer eulogy that can be made concerning Nicholas Pearsall than that he was a good and faithful father to these fatherless boys [sons of Thomas, his brother, whom he raised as guardian]. Every one of the sons of Thomas Pearsall named a son Nicholas and thereby so fastened this name upon the descendants of Thomas Pearsall that for several generations it was the distinguishing charactersistic of this branch of the family to have a son Nicholas. ...Thus we see that although Nicholas Pearsall had no sons of his own to continue his line, these sons of Thomas remembered him and continued his name for many generations."
