(b) "recognised party" means,-

(I) (ii) in relation to the House of the People, every party which has a strength of not less than fifty-five members in the House.'

6. Section 3 of Act of 1999 deals with facilities of the Leaders, Deputy Leaders and Chief Whips of recognised groups and parties and stipulates that subject to any rules made in this behalf by the Central Government, each leader, deputy leader and each chief whip of a recognised group and a recognised party shall be entitled to telephone and secretarial facilities provided such Leader, Deputy Leader or Chief Whip is not fallen in the categories mentioned below this section.

7. Section 2 of the Salary & Allowances of Leaders of Opposition in Parliament Act, 1977 (Act of 1977) reads as under

'2. Definition.- In this Act," Leader of the Opposition", in relation to either House of Parliament, means that member of the Council of States or the House of the People, as the case may be, who is, for the time being, the Leader in that House of the party in opposition to the Government having the greatest numerical strength and recognised as such by the Chairman of the Council of States or the Speaker of the House of the People, as the case may be.

Explanation.- Where there are two or more parties in opposition to the Government, in the Council of States or in the House of the People having the same numerical strength, the Chairman of the Council of States or the Speaker of the House of the People, as the case may be, shall, having regard to the status of the parties, recognise any one of the Leaders of such parties as the Leader of the Opposition for the purposes of this section and such recognition shall be final and conclusive.'

8. Each Leader of Opposition has statutory recognition and en:ed ter certain facilities and amenities to enable him to discharge his function in the Parliament as mandated under Sections 3,4,5,6,7, 8 & 8A of the Act of 1977.

9. Parliamentary system works on precedents and practices. The Act of 1977 provides for the Leader of parties in opposition having the greatest numerical strength and recognized as such by the Speaker / Chairman being recognized as LOP. Direction No. 120 of directions by the Speaker Lok Sabha (the directions) stipulates that 'the Speaker may recognize an Association of Members as a Parliamentary Party or Group for the purpose of functioning in the House and his decision shall be final' Speakers recognition is governed by the direction No. 121 of the directions which provide as under:

'Conditions for recognition

121. In recognising a Parliamentary Party or Group the Speaker shall take into consideration the following principles:—

(I) An association of members who propose to form a Parliamentary Party-,

(a) shall have announced at the time of the general elections a distinct ideology and programme of Parliamentary work on which they have been returned to the House;

tc) shall have at le:ist a strength equal to: the quorum fixed to constitute a sitting of the House, that Is one-tenth tattle total number of members of the House.

The has constituted a body under the Right to Information Act, 2005 (the Act) known as the Central Information Commission to exercise the powers conferred on and to perform the functions assigned to it under the Act. it is located in New Delhi. The Commission shall have the Chief Information Commissioner and upto ten Information Commissioners. The powers and functions of the Chief Information Commissioner in the Central Information Commission are as per the RTI Act.

2. It is proposed to appoint Chief Information Commissioner in the Commission. The Act provides that the Chief Information Commissioner shall be person of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass-media or administration and governance.

3. Further, the Chief Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession. It is clarified that cessation/termination of holding of office of profit, pursuing any profession or carrying any business is a condition precedent to the appointment of a person as Chief Information Commissioner.

4. The Chief Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office or till he attains the age of 65 years, whichever is earlier. The salary and allowances payable to the Chief Information Commissioner shall be the same as that of the Chief Election Commissioner, subject to adjustment of the pensionary/retirement benefits availed by him, if any, in accordance with the provisions of the Act.

5. Subject Appointment of Chief Information Commissioner and Information Commissioners in the Central Information Commission.

The Government of India has constituted a body under the Right to Information Act, 2005 (the Act) known as the Central Information Commission (Commission) to exercise the powers conferred on and to perform the functions assigned to it under the Act. It is located in New Delhi. The Commission shall have the Chief Information Commissioner and upto ten Information Commissioners. The powers and functions of the Chief Information Commissioner in the Central Information Commission are as per the RTI Act.

2. It is proposed to appoint Chief Information Commissioner and more Information Commissioners in the Commission. The Act provides that the Chief Information Commissioner and Information Commissioner shall be person of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass-media or administration and governance.

3. Further, the Chief Information Commissioner and Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession. It is clarified that cessation/termination of holding of office of profit, pursuing any profession or carrying any business is a condition precedent to the appointment of a person as Chief Information Commissioner and Information Commissioner.

4. The Chief Information Commissioner and Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office or till he attains the age of 65 years, whichever is earlier. The salary and allowances payable to the Chief Information Commissioner shall be the same as that of the Chief Election Commissioner and Election Commissioner respectively, subject to adjustment of the pensionary/retirement benefits availed by him, if any, in accordance with the provisions of the Act.

5. Persons fulfilling the criteria and interested for appointment to the post of Chief Information Commissioner and/or Information Commissioner may send their particulars in the enclosed proforma by post to Under Secretary (RTI), Department of Personnel and Training, North Block, New Delhi or through e-mail to [email protected] by 12th October, 2015. Persons who are serving under the State/Central Government or any other Organization, should send their particulars through proper channel (administrative Ministry/Department/StateNTs). Appointment of Chief Information Commissioner and Information Commissioners in the Central Information Commission.

1. As per section 12 (2) of the Act, the Central Information Commission shall consist of the Chief Information Commissioner and such number of Central Information Commissioners, not exceeding ten, as may be deemed necessary. At present, the Central Information Commission has Chief Information Commissioner and 7(seven) Information Commissioners. The tenure of present Chief Information Commissioner shall be over on 01.12.2015.

2. Section 12 (3) of the Act stipulates that the Chief Information Commissioner and the Information Commissioners shall be appointed by the President on the recommendation of a Committee consisting of the following:-

(i) the Prime Minister who shall be the Chairman of the Committee, (ii) the Leader of the Opposition in the Lok Sabha, and (iii) a Union Cabinet Minister to be nominated by the Prime Minister. (Hon' ble Prime Minister has approved nomination of Union Finance Minister in the Selection Committee vide PMO ID note No.600/52/C/1/2015-ES-2 dated 28.08.2015).

The Act further explains that for the purpose of removal of doubts, it is hereby declared that where the Leader of the Opposition in the House of the People has not been recognized as such, the Leader of the single largest group in opposition of the Government in the House of the People shall be deemed to be the Leader of Opposition.

3. Section 12(6) of the RTI Act, 2005 mandates that "The Chief Information commissioner or an Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession."

4. As per the past policy, the Chief Information Commissioner be appointed through the process of advertisement, short listing by Search Committee and recommendations of Committee chaired by Prime Minister and the process for selecting more (up to 3) Information Commissioners may also be initiated so that the Commission is constituted in full strength. The procedure for selection of Information Commissioner includes advertising the 0 post, short listing by a Search Committee and such short-listed panel to be placed before the Selection Committee for its consideration.

5. Accordingly, an advertisement inviting particulars of interested persons for the post of Chief Information Commissioner and Information Commissioners in the CIC was published on the website of this Department on 09.09.2015 and also in all editions of 2 English newspapers(Times of India and the Hindu) and two Hindi newspaper(Dainik Bhaskar and Hindustan). Persons were given option to apply for both the posts through a single application. The last date for receipt of applications was 12.10.2015. A total of 341 applications have been received. Applications received after the cut-off date of 12.10.2015 are not being considered. A list of applications received after the cut-off date is enclosed at Annexure - II.

6. As per Section 12(5) of the RTI Act, 2005, the Chief Information Commissioner and Information Commissioners shall be persons of eminence in public life with wide knowledge and experience in "law, science and technology, social service, management, journalism, mass media or administration and governance."

7. Accordingly, all these 341 applications have been broadly categorised into 7 categories of knowledge and experience, as mentioned above. Few applications which do not fall within these 7 categories, have been mentioned in "others" category. However, for the sake of categorisation, only the main field of knowledge and experience have been mentioned. Tabulated details on the basis of such categorisation is at Annexure-I.

8. The category-wise distribution of these applications is as under:-

9. A list of existing 8 Central Information Commissioners (1 CIC and 7 ICs) as per their field of excellence is at Annexure-Ill.

10. It is pertinent to mention that in a Review Petition filed by Union of India against Hon'ble Supreme Court judgement dated 13.09.2012 in Namit Sharma case, the Hon'ble Supreme Court vide its judgement dated 03.09.2013, inter-alia, gave the following directions:-

(1) We direct that only persons of eminence in public life with wide knowledge and experience in the fields mentioned in Sections 12 (5) and 15 (5) of the Act be considered for appointment as Information Commissioner and Chief Information Commissioner.

(ii) We further direct that persons of eminence in public life with wide knowledge and experience in all the fields mentioned in Section 12 (5) and 15 (5) of the Act, namely, law, science and technology, social service, management, journalism, mass media or administration and governance, be considered by the Committee under Sections 12 (3) and 15 (3) of the Act for appointment as Chief Information Commissioner or Information Commissioners.

(iii) We further direct that the Committees under Section 12 (3) and 15 (3) of the Act while making recommendations to the President or to the Governor, as the case may be, for appointment of Chief Information Commissioner and Information Commissioners must mention against the name of each candidate recommended, the facts to indicate his eminence in public life, his knowledge in the particular field and his experience in the particular field and these facts must be accessible to the citizens as part of their right to information under the Act after the appointment is made.

11. 12. During the last round of selection Search Committee had shortlisted 3 candidates against the post of Chief Information Commissioner and 9 candidates against 3 posts of Information Commissioner. The Search committee had decided that the vigilance clearance from the respective Cadre Controlling Authority in respect of shortlisted serving officers and inputs from the Intelligence Bureau in respect of retired officers / private persons be obtained before placing the recommendations of the Search Committee to the Selection Committee. As per the earlier procedure, the Search Committee would empanel the names of suitable persons to the Selection Committee headed by the Prime Minister for selection of Chief Information Commissioner and Information Commissioner(s) in the Central Information Commission. •

Appointment of Chief Information Commissioner and Information Commissioners in the Central Information Commission.

1. As per section 12 (2) of the Act, the Central Information Commission shall consist of the Chief Information Commissioner and such number of Central Information Commissioners, not exceeding ten, as may be deemed necessary. At present, the Central Information Commission has Chief Information Commissioner and 7(seven) Information Commissioners. The tenure of present Chief Information Commissioner shall be over on 01.12.2015.

2. Section 12 (3) of the Act stipulates that the Chief Information Commissioner and the Information Commissioners shall be appointed by the President on the recommendation of a Committee consisting of the following:-

(i) the Prime Minister who shall be the Chairman of the Committee, (ii) the Leader of the Opposition in the Lok Sabha, and (iii) a Union Cabinet Minister to be nominated by the Prime Minister. (Hon'ble Prime Minister has approved nomination of Union Finance Minister in the Selection Committee vide PMO ID note No.600/52/C/1/2015-ES-2 dated 28.08.2015).

The Act further explains that for the purpose of removal of doubts, it is hereby declared that where the Leader of the Opposition in the House of the People has not been recognized as such, the Leader of the single largest group in opposition of the Government in the House of the People shall be deemed to be the Leader of Opposition.

3. Section 12(6) of the RTI Act, 2005 mandates that "The Chief Information commissioner or an Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession."

4. As per the past policy, the Chief Information Commissioner be appointed through the process of advertisement, short listing by Search Committee and recommendations of Committee chaired by Prime Minister and the process for selecting more (up to 3) Information Commissioners may also be initiated so that the Commission is constituted in full strength. The procedure for selection of Information Commissioner includes advertising the post, short listing by a Search Committee and such short-listed panel to be placed before the Selection Committee for its consideration.

5. Accordingly, an advertisement inviting particulars of interested persons for the post of Chief Information Commissioner and Information Commissioners in the CIC was published on the website of this Department on 09.09.2015 and also in all editions of 2 English newspapers(Times of India and the Hindu) and two Hindi newspaper(Dainik Bhaskar and Hindustan). Persons were given option to apply for both the posts through a single application. The last date for receipt of applications was 12.10.2015. A total of 341 applications have been received. Applications received after the cut-off date of 12.10.2015 are not being considered. A list of applications received after the cut-off date is enclosed at Annexure - II.

6. As per Section 12(5) of the RTI Act, 2005, the Chief Information Commissioner and Information Commissioners shall be persons of eminence in public life with wide knowledge and experience in "law, science and technology, social service, management, journalism, mass media or administration and governance."

7. Accordingly, all these 341 applications have been broadly categorised into 7 categories of knowledge and experience, as mentioned above. Few applications which do not fall within these 7 categories, have been mentioned in "others" category. However, for the sake of categorisation, only the main field of knowledge and experience have been mentioned. Tabulated details on the basis of such categorisation is at Annexure-I.

8. The category-wise distribution of these applications is as under:-

10. It is pertinent to mention that in a Review Petition filed by Union of India against Hon'ble Supreme Court judgement dated 13.09.2012 in Namit Sharma case, the Hon'ble Supreme Court vide its judgement dated 03.09.2013, inter-alia, gave the following directions:-

(i) We direct that only persons of eminence in public life with wide knowledge and experience in the fields mentioned in Sections 12 (5) and 15 (5) of the Act be considered for appointment as Information Commissioner and Chief Information Commissioner.

(ii) We further direct that persons of eminence in public life with wide knowledge and experience in all the fields mentioned in Section 12 (5) and 15 (5) of the Act, namely, law, science and technology, social service, management, journalism, mass media or administration and governance, be considered by the Committee under Sections 12 (3) and 15 (3) of the Act for appointment as Chief Information Commissioner or Information Commissioners.

(iii) We further direct that the Committees under Section 12 (3) and 15 (3) of the Act while making recommendations to the President or to the Governor, as the case may be, for appointment of Chief Information Commissioner and Information Commissioners must mention against the name of each candidate recommended, the facts to indicate his eminence in public life, his knowledge in the particular field and his experience in the particular field and these facts must be accessible to the citizens as part of their right to information under the Act after the appointment is made.

11. PMO has approved constitution of Search Committee for short-listing a panel of names for the post of Information Commissioners and Chief Information Commission in Central Information Commission as under:-

12. During the last round of selection Search Committee had shortlisted 3 candidates against the post of Chief Information Commissioner and 9 candidates against 3 posts of Information Commissioner. The Search committee had decided that the vigilance clearance from the respective Cadre Controlling Authority in respect of shortlisted serving officers and inputs from the Intelligence Bureau in respect of retired officers / private persons be obtained before placing the recommendations of the Search Committee to the Selection Committee. As per the earlier procedure, the Search Committee would empanel the names of suitable persons to the Selection Committee headed by the Prime Minister for selection of Chief Information Commissioner and Information Commissioner(s) in the Central Information Commission. Minutes of the meetings of the Search Committee held on 10.11.2015 and 16.11.2015 for shortlisting persons for the post of Chief Information Commissioner and one post of Information Commissioner in the Central Information Commission

The Search Committee was informed that Shri Sunil Arora, Secretary, Ministry of Information and Broadcasting, a member of the Committee has sought to recuse himself.

2. The Search Committee was informed that as per Section 12(2) (a) of the RTI Act, the Central Information Commission shall consist of the Chief Information Commissioner (CIC) and as per Section 12(2)(b) of the RTI Act, the Commission shall consist of such number of Information Commissioners (ICs), not exceeding ten, as may be deemed necessary. At present, there is one CIC and seven ICs in the Central Information Commission. Shri Vijay Sharma, CIC will complete his tenure on 01.12.2015 (a list of the existing ICs is at Annexure- I). The Committee took note of the provisions of Section 12(5) of the RTI Act that the CIC and IC shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.

3. The Committee was informed that Circular No. 4/2/2015-IR dated 09.09.2015 seeking applications from interested persons for the posts of CIC and ICs was posted on the website of Department of Personnel and Training (DoPT) on 09.09.2015 and advertisement was published in The Hindu, Times of India (English) and Dainik Bhaskar and Hindustan (Hindi) in all their editions in India on 09.09.2015. The last date for receipt of applications was 12.10.2015. A total of 341 applications (11 for CIC, 157 for IC and 173 for both posts of CIC and IC) had been received by the last date (the details of the 341 applications are at Annexure II). 4. The Committee was further informed that High Court of Delhi vide its • judgment dated 06.11.2015 has given the following directions: (i) The selection process that has already been commenced vide Notifications dated 25.02.2014 and 16.07.2014 shall be finalized within six weeks from today and the three vacancies of Information Commissioners existing as of today shall be filled up amongst the 553 applications that were received in response to the said two notifications.

(ii) The selection process pursuant to the Circular dated 09.09.2015 shall be confined for selection and appointment of the Chief Information Commissioner in the vacancy that would arise w.e.f 02.12.2015 and one Information Commissioner which is likely to arise w.e.f 02.12.2015.

5. The opinion of Attorney General was sought in the matter. The Committee was informed that as per Attorney General's opinion (Annexure- III), an SLP is to be preferred only with regard to direction at para 4 (i) above and no challenge is required with regard to direction at para 4 (ii) as it is in order.

6. With a view to shortlisting the candidates, the Committee deliberated upon the eligibility and suitability of each candidate in terms of their eminence and experience in the categories mentioned in Section 12(5) of the RTI Act. The Committee decided that 5 applications received late after due date i.e. 12.10.2015 shall not be considered.

7. After detailed deliberations, the Committee shortlisted the following applicants (in alphabetical order of surname) for the post of CIC:

Sh. Arun Kumar He is a retired IAS officer with more than 37 Misra, IAS years of experience in Administration and (Retired) Governance. His educational qualification (UP:1976) includes B.Sc. (Hons) in Maths and MA (DoB:28.02.1954) (History). He is also a Humphrey Fellow from American University, Washington DC. He has worked as Secretary, Ministry of Housing and Urban Poverty Alleviation, Government of India for around three years. He has also worked as Senior Advisor/Principal Advisor, Energy in Planning Commission of India. In addition, he has a vast experience of working in Government of Uttar Pradesh in Ministries/Departments like Power, Agriculture, Health, Education, Urban Development and Planning. 3. Basant Seth He is serving as Information Commissioner in (DoB:16.02.1952) Central Information Commission since 01.03.2012. He is a qualified Chartered Accountant with a Post Graduate Diploma in Bank Management with 37 years of experience in the field of banking management, finance and administrative matters. He has worked as a whole time Director in Small Industries Development Bank of India (SIDBI) for more than two years and as Chairman & Managing Director of Syndicate Bank from 31.08.2009 to 28.02.2012.

AGENDA NOTE FOR THE SELECTION COMMITTEE FOR THE POST OF CHIEF INFORMATION COMMISSIONER AND INFORMATION COMMISSIONER IN THE CENTRAL INFORMATION COMMISSION Date: 11.12.2015, Time: 4.00 P.M.

1. Introduction

Right to Information Act, 2005, mandates constitution of a Central Information Commission consisting of the Chief Information Commissioner(CIC) and such number of Information Commissioners(ICs) not • exceeding ten, as may be deemed necessary. The Commission adjudicates appeals and complaints under the RTI Act. At present, the Central Information Commission has Chief Information Commissioner and 7 Information Commissioners. The current constitution of the CIC is at Annexure-'I'.

2. Rule and Legal position

2.1 The Rule position with respect to qualification, tenure etc. of Chief Information Commissioner and Information Commissioner is at Annexure - 'II'.

2.2 Constitution of the Committee

Section 12 (3) of the Act stipulates that the Chief Information Commissioner and the Information Commissioners shall be appointed by the President on the recommendation of a Committee. The Committee has now been constituted with the following composition: (May kindly see the details at Annexure 'II')

i. The Prime Minister who shall be the Chairman of the committee, 6. Leader of single Largest Party in opposition in Lok Sabha (Shri Mallikarjun Kharge, INC). iii. The Union Finance Minister (Shri Arun Jaitley).

2.3 Hon'ble Supreme Court in its judgement dated 03.09.2013 in a Review Petition filed by Union of India against Hon'ble Supreme Court judgement dated 13.09.2012 in Namit Sharma case gave certain directions for making appointments to the post of Chief Information Commissioner and Information

1 Commissioners. The operative part of the judgement is placed at Annexure- For the sake of emphasis, few of the directions are mentioned below:

(i) We further direct that persons of eminence in public life with wide knowledge and experience in all the fields mentioned in Sections 12(5) and 15(5) of the Act, namely, law, science and technology, social service, management, journalism, mass media or administration and governance, be considered by the Committees under Sections 12(3) and 15(3) of the Act for appointment as Chief Information Commissioner or Information Commissioners. (ii) We further direct that the Committees under Sections 12(3) and 15(3) of the Act while making recommendations to the President or to the Governor, as the case may be, for appointment of Chief Information Commissioner and Information Commissioners must mention against the name of each candidate recommended, the facts to indicate his eminence in public life, his knowledge in the particular field and his experience in the particular field and these facts must be accessible to the citizens as part of their right to information under the Act after the appointment is made.

3 Search Procedure

3.1 A Circular dated 9.9.2015 seeking applications from interested persons for the post of Chief Information Commissioner and Information Commissioners in the Central Information Commission was posted on the website of DoPT on 9.9.2015 after approval of the competent authority. Advertisement was also published in The Hindu and Times of India in English, Dainik Bhaskar and Hindustan in Hindi in all its edition in India on 9.9.2015. The last date of receiving applications was 12.10.2015.

3.2 A total of 341 applications (11 for CIC, 157 for IC and 173 for both posts of CIC and IC) had been received by the last date for the posts of CIC and ICs. The details of the 341 applications with particulars in a tabular form are at Annexure IV and Annexure V.

3.3 It is pertinent to mention that in the last process for selection of Chief Information Commissioner and Information Commissioners initiated on 17.02.2014, a writ Petition(C) 3386 was filed by R.K. Jain & ors. v/s Union of India in Public Interest under Article 226 of the Constitution of India before High Court of Delhi. After hearing both the sides on 21.5.2015, the Hon'ble Court reserved the matter for orders. Meanwhile the process of selection 2

• initiated in February, 2014 was concluded with appointment of Mr. Vijai Sharma as Chief Information Commissioner on 10.06.2015 and Shri Sudhir Bhargava as Information Commissioner on 11.06.2015.

3.4 The case was re-notified for hearing on 09.10.2015. After hearing the arguments, the Court has pronounced its order on 6.11.2015 in WP(C) 3386 (Annexure-VI) and has given following directions:

(i) The selection process that had commenced vide Notifications dated 25.02.2014 and 16.07.2014 shall be finalized within six weeks from today and the three vacancies of Information Commissioners existing as of today shall be filled up from amongst the 553 applications that were received in response to the said two notifications.

(ii) The selection process pursuant to the Circular dated 09.09.2015 shall be confined for selection and appointment of the Chief Information Commissioner in the vacancy that would arise w.e.f. 02.12.2015 and one Information Commissioner which is likely to arise w.e.f. 02.12.2015.

3.5 Opinion of Learned AG has been obtained with regard to direction of Hon'ble High Court of Delhi as mentioned at para 2.3 (i)&(ii) above and Ld. AG has opined that an SLP may be preferred only in regard to direction (i) since direction (ii) is in order and no challenge is required (Annexure - VII). • 4. Search Committee and shortlisting of candidates 4.1 Prime Minister on 26.10.2015 had approved re-constitution of a Search Committee for the present round of selection process, as given below:-

3 4.2 The Search Committee met on 10.11.2015 and 16.11.2015 to take note of the agenda to fill up the post of Chief Information Commissioner. Search Committee shortlisted candidates for the post of Chief Information Commissioner keeping in view the direction of Hon'ble High Court of Delhi dated 6.11.2015 and legal opinion of Ld. AG in the matter. In the said meetings, The Committee, after detailed deliberations, shortlisted applicants for the post of Chief Information Commissioner and also shortlisted the names of applicants for the post of Information Commissioner to be used in case the existing Information Commissioner's name is recommended by the Selection Committee for the post of Chief Information Commissioner. The copy of the minutes of the Search Committee meetings dated 10.11.2015 and 16.11.2015 is annexed as Annexure - 'VIII'.

4.3 The Search Committee decided that Vigilance Clearance from the • respective Cadre Controlling Authority in respect of shortlisted serving officers and inputs from the Intelligence Bureau in respect of retired officers be obtained before placing the recommendations of the Search Committee to the Selection Committee.

5. Shortlisted applicants

5.1 The Search Committee shortlisted the following applicants, in alphabetical order of surname, for the post of Chief Information Commissioner:

Annexure - II

The qualification, tenure etc of Chief Information Commissioner and Information Commissioner.

1. Section 12(3) of the RTI Act;- The Chief Information Commissioner and the Information Commissioners are appointed by the President on the recommendation of a Committee consisting of - i. The Prime Minister; ii. The Leader of Opposition in Lok Sabha ; and iii. A Union Cabinet Minister to be nominated by the Prime Minister

Explanation.—For the purposes of removal of doubts, it is hereby declared that where the Leader of Opposition in the House of the People has not been recognised as such, the Leader of the single largest group in opposition of the Government in the House of the People shall be deemed to be the Leader of Opposition.

Ministry of Law and Justice has opined that in the absence of Leader of opposition, the Leader of the single largest party in opposition can be considered as the leader of the single largest group in opposition, only for the limited purpose of RTI Act.

The Prime Minister on 28.8.2015 has nominated Shri Arun Jaitley, Union Section 12(3) Finance Minister as the Member of the Selection Committee under M of the RTI Act.

2. Section 12 (5) of the RTI Act;- The Chief Information Commissioner and Information Commissioners shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.

3. Section 12(6) of the RTI Act;- The Chief Information Commissioner and Information Commissioner shall not be a Member of Parliament or Member of Legislature of any state or Union Territory or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession. 4. Section 13(1) of the RTI Act;- The Chief Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office and shall not be eligible for reappointment: Provided that no Chief Information Commissioner shall hold office as such after he has attained the age of sixty-five years.

5. Section 13 (2) of the RTI Act;- Every Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office or till he attains the age of 65 years, whichever is earlier, and shall not be eligible for reappointment as such Information Commissioner:

Provided that every Information Commissioner shall, on vacating his office under this sub-section be eligible for appointment as the Chief Information Commissioner in the manner specified in sub-section (3) of section 12:

Provided further that where the Information Commissioner is appointed as the Chief Information Commissioner, his term of office shall not be more than five years in aggregate as the Information Commissioner and the Chief Information Commissioner.

Operative part in the Judgement of Hon'ble Supreme Court in the Review Petition (C) No. 2309 of 2012 in the case of Union of India Vs Namit Sharma

(i) We declare that Sections 12(5) and 15(5) of the Act are not ultra vires the Constitution.

(ii) We declare that Sections 12(6) and 15(6) of the Act do not debar a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case may be, or a person holding any other office of profit or connected with any political party or carrying on any business or pursuing any profession from being considered for appointment as Chief Information Commissioner or Information Commissioner, but after such person is appointed as Chief Information Commissioner or Information Commissioner, he has to discontinue as Member of Parliament or Member of the Legislature of any State or Union Territory, or discontinue to hold any other office of profit or remain connected with any political party or carry on any business or pursue any profession during the period he functions as Chief Information Commissioner or Information Commissioner.

(iii) We direct that only persons of eminence in public life with wide knowledge and experience in the fields mentioned in Sections 12(5) and 15(5) of the Act be considered for appointment as Information Commissioner and Chief Information Commissioner.

(iv) We further direct that persons of eminence in public life with wide knowledge and experience in all the fields mentioned in Sections 12(5) and 15(5) of the Act, namely, law, science and technology, social service, management, journalism, mass media or administration and governance, be considered by the Committees under Sections 12(3) and 15(3) of the Act for appointment as Chief Information Commissioner or Information Commissioners.

(v) We further direct that the Committees under Sections 12(3) and 15(3) of the Act while making recommendations to the President or to the Governor, as the case may be, for appointment of Chief Information Commissioner and Information Commissioners must mention against the name of each candidate recommended, the facts to indicate his eminence in public life, his knowledge in the particular field and his experience in the particular field and these facts must be accessible to the citizens as part of their right to information under the Act after the appointment is made.

(vi) We also direct that wherever Chief Information Commissioner is of the opinion that intricate questions of law will have to be decided in a matter coming up before the Information Commission, he will ensure that the matter is heard by an Information Commissioner who has wide knowledge and experience in the field of law. JUDGMENT

1. This petition as a Public Interest Litigation, is filed alleging inaction on the part of the respondents in filling up the vacancies of Chief Information Commissioner and three Information Commissioners in the Central Information Commission and contending that the same has frustrated the very object of the Right to Information Act, 2005 (for short `RTI Act').

2. We have heard the learned counsel for both the parties.

3. As per Section 12 of the RTI Act which provides for constitution of Central Information Commission, the Central Information Commission shall consist of the Chief Information Commissioner and such number of Central Information Commissioners not exceeding 10 as may be deemed necessary.

4. As against the total sanctioned strength of Information Commissioners of 10, by the date of filing of the petition on 06.04.2015, three posts were lying vacant for the past one year in addition to the post of Chief Information Commissioner which was lying vacant since 23.08.2014.

5. It is explained by the Under Secretary, Department of Personnel and Training, Government of India in his affidavit dated 09.04.2015 that an advertisement was published on 28.02.2014 in two English newspapers and one Hindi newspaper inviting applications for filling up two posts of Information Commissioners that were lying vacant by that time and in response to the same, 293 applications were received. The Search Committee which met on 21.04.2014 considered the applications and recommended panels for consideration of the Selection Committee constituted under Section 12(3) of the RTI Act. Even before the Selection Committee could meet, one of the Central Information Commissioners • (Shri Rajeev Mathur) was elevated to the post of Chief Information Commissioner on 22.05.2014 and thus one more vacancy of the Central Information Commissioner arose. Therefore, a fresh advertisement was issued on 16.07.2014 inviting applications making it clear that those who have applied earlier in response to the earlier advertisement need not apply afresh. In pursuance thereof, 260 fresh applications were received by the last date i.e. 19.08.2014. Thus, the total applications received were 553

(293+260). While so, the tenure of the Chief Information Commissioner (Shri Rajeev Mathur) expired on 22.08.2014 and thus the post of CIC also fell vacant. On 24.10.2014, a Circular was posted on the website of Department of Personnel and Training inviting applications for the post of CIC and in response to the same a total number of 203 applications were received. It was further stated that the Search Committee met twice on 16.01.2015 and 06.02.2015 to shortlist the applicants for the Chief Information Commissioner and Information Commissioners respectively and that the selection would be made by the Selection Committee as provided under Section 12(3) of the RTI Act after the IB/CBI inputs and Vigilance Clearances were received.

6. Having taken note of the contents of the said affidavit, we passed the following order on 09.04.2015:

"In pursuance of the order passed by us on 08.04.2015, a detailed affidavit has been filed by the Under Secretary, Department of Personnel & Training explaining the steps that have already been taken for filling up the vacancies of the posts of the Chief Information Commissioner and the 3 Central Information Commissioners and assuring that the entire process of selection and appointment would be completed expeditiously. We have heard the learned counsel for both the parties. Having regard to the undisputed fact that the non-appointment of the Chief Information Commissioner has virtually frustrated the very purpose of the Right to Information Act, 2005, we are of the view that it is necessary for this court to monitor the steps that are being taken for filling up the vacancies in question so as to ensure that all the vacancies are filled up within a timeframe.

/6 7 Therefore, let the petition be listed on 11.05.2015 by which date the respondents shall report to this court the progress made. Since it is pointed out by the learned ASG that the respondent has been wrongly described in the memo of parties and that as a matter of fact the Union of India is represented by the Department of Personnel & Training, the respondent in the memo of parties shall stand substituted as under:- `Union of India through the Department of Personnel & Training, Ministry of Personnel, Public Grievances & Pensions, North Block, New Delhi'. The amended memo of parties be filed by the petitioner within one week from today." 7. When the petition was listed again on 21.05.2015, a status note on behalf of the Respondent — Union of India (DoPT) has been filed stating that the process of appointment of the Chief Information Commissioner and Information Commissioners is at an advanced stage and that the Search Committee met on 27.04.2015 and shortlisted the applicants. It is also stated that the selection would be made soon after the vigilance clearance from the respective Cadre Controlling Authority in respect of shortlisted serving officers and inputs from the Intelligence Bureau in respect of retired officers is received. In the circumstances, it was submitted by Shri Sanjay Jain, the learned ASG that no further orders are necessary in the petition. However, Shri Prashant Bhushan, the learned counsel appearing for the petitioner submitted that it is necessary to issue directions to complete the selection process within a time schedule in view of the fact that more than 35,000 cases are pending in the Central Information Commission as of today.

After we have reserved the judgment on 21.05.2015, the petitioners filed a fresh application being CM No.20965/2015 bringing to the notice of this court that on 08.06.2015 the senior most Information Commissioner by name Shri Vijay Sharma was appointed as the Chief Information Commissioner and in the vacancy arose, Shri Sudhir Bhargava was appointed as the Information Commissioner. While pointing out that the three vacancies of Information Commissioners have not been filled up so far, it is further stated that the Department of P&T has issued a fresh Circular dated 09.09.2015 inviting applications for the post of Chief Information Commissioner and the Information Commissioners. Contending that the said Circular dated 09.09.2015 is nothing but an attempt to delay the entire process of appointment of the Information Commissioners against the existing 3 vacancies, the petitioners sought a direction to forthwith appoint the remaining three Information Commissioners in CIC and to set aside the Circular dated 09.09.2015.

The learned counsel for the petitioners Shri Prashant Bhushan submitted that the Circular dated 09.09.2015 is bad firstly for the reason that despite the pendency of the present writ petition, the respondent failed to take the leave of this court to put up a fresh Circular inviting applications and secondly there is no reason to terminate the process of selection that was already initiated on 25.02.2014. It is also contended that the Circular dated 09.09.2015 is absolutely vague and did not even disclose the number of vacancies intended to be filled up.

10. The Circular dated 09.09.2015 issued by the Department of Personnel and Training reads as under:

The Government of India has constituted a body under the Right to Information Act, 2005 (the Act) known as the Central Information Commission (Commission) to exercise the powers conferred on and to perform the functions assigned to it under the Act. It is located in New Delhi. The Commission shall have the Chief Information Commissioner and upto ten Information Commissioners. The powers and functions of the Chief Information Commissioner in the Central Information Commission are as per the RTI Act. 2. It is proposed to appoint Chief Information Commissioner and more Information Commissioners in the Commission. The Act provides that the Chief Information Commissioner and Information Commissioner shall be person of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass-media or administration and governance. 3. Further, the Chief Information Commissioner and Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession. It is clarified that cessation/termination of holding of office of profit, pursuing any profession or carrying any business is a condition precedent to the appointment of a person as Chief Information Commissioner and Information Commissioner.

The Chief Information Commissioner and Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office or till he attains the age of 65 years, whichever is earlier. The salary and allowances payable to the Chief Information Commissioner shall be the same as that of the Chief Election Commissioner and Election Commissioner respectively, subject to adjustment of the pensionary/retirement benefits availed by him, if any, in accordance with the provisions of the Act. 5. Persons fulfilling the criteria and interested for appointment to the post of Chief Information Commissioner and/or Information Commissioner may send their particulars in the enclosed proforma by post to Under Secretary (RTI), Department of Personnel and Training, North Block, New Delhi or through e-mail to [email protected] by 12th October, 2015. Persons who are serving under the State/Central Government or any other Organization, should send their particulars through proper channel (administrative Ministry / Department / State / UTs). Having perused the Circular dated 09.09.2015, we found that it is absolutely silent about the process of selection that was already initiated vide Notifications dated 25.02.2014 and 16.07.2014. It also does not disclose the number of vacancies that are sought to be filled up. In the status note dated 07.05.2015 filed by the Department of Personnel and Training, it was stated that in response to the earlier advertisements, altogether 553 applications were received. It was also stated that the said applicants were already shortlisted and vide communication dated 05.05.2015 and

02.05.2015, the vigilance clearance was sought from the respective Cadre Controlling Authority in respect of shortlisted serving officers and inputs from the Intelligence Bureau in respect of retired officers. We have taken note of the fact that during the pendency of the writ petition, the vacancy of Chief Information Commissioner has been filled up and one Information Commissioner has been appointed in the fresh vacancy that arose. That being so, we are unable to understand as to why the Respondents have again issued a fresh notification dated 09.09.2015. • 12. However, the list of the Chief Information Commissioner and the Information Commissioners holding office as of today, furnished by the learned Standing Counsel for Central Government, reflects that the tenure of one of the Information Commissioners out of seven would expire on 31.12.2016 and the others have a long tenure of more than two years. As is evident, there is no likelihood of any vacancy of Information Commissioner in near future. However, the Chief Information Commissioner's tenure will be completed on 01.12.2015. In case one of the serving Information Commissioners is appointed as the Chief Information Commissioner in the vacancy that would arise w.e.f. 02.12.2015, one more vacancy of the Information Commissioner is likely to arise. •

13. In these circumstances, instead of setting aside the Notification dated 09.09.2015, we consider it appropriate to issue the following directions: (i) The selection process that has already been commenced vide Notifications dated 25.02.2014 and 16.07.2014 shall be finalized within six weeks from today and the three vacancies of Information Commissioners existing as of today shall be

filled up amongst the 553 applications that were received in response to the said two notifications.

(ii) The selection process pursuant to the Circular dated 09.09.2015 shall be confined for selection and appointment of the Chief Information Commissioner in the vacancy that would arise w.e.f. 02.12.2015 and one Information Commissioner which is likely to arise w.e.f. 02.12.2015.

• 14. The writ petition is accordingly disposed of.

Perused the file and the judgement of the Delhi High Court dated 6.11.2015 in R.K. Jain & Anr. Vs. U01 & Anr. (WP 3386/2015).

2. The Public Interest WP was disposed of with the following two directions:

The selection process that has already been commenced vide Notifications dt. 25.2.2014 and 16.7.2014 shall be finalized within six weeks from today and the three vacancies of Information Commissioners existing as of today shall be filled up amongst the 553 applications that were received in response to the said two notifications.

(ii) The selection process pursuant to the Circular dt. 9.9.2015 shall be confined for selection and appointment of the CIC in the vacancy that would arise w.e.f. 02.12.2015 and one Information Commissioner which is likely to arise w.e.f. 0.12.2015.

3. I have discussed the matter with the Secretary, DoPT and other officers of the Ministry. In so far as the direction (ii) is concerned, it is clear to me that appointment of CICI pursuant to Circular dt. 9/9/2015, which vacancy will arise on 2/12/2015, ought to be carried out and no challenge ought to be made to the Supreme Court. Thus, the selection of CIC should go ahead and appointment order ought to be issued in a regular manner and wold not be subject to the result of any challenge which may be made by the Government.

4. A controversy has arisen in regard to the latter part of direction (ii) relating to the vacancy of one I.C. which is likely to arise w.e.f. 2/12/2015. I am informed that no current I.C. is likely to retire on 2/12/2015 or immediately thereafter. The said direction seems to be based on the fact that if a current I.C. is appointed as CIC then a consequent vacancy would arise in the case of I.C. It is in this manner that this direction has to be construed.

5. Should a current I.C. be appointed as CIC then the consequent vacancy of I.C. may be filled up pursuant to Circular dt. 9/9/2015. This concludes the discussion on this direction.

6. In regard to direction (i), the Department is aggrieved of the fact that vacancies of all three ICs have been directed to be filled up pursuant only to notifications dt. 25/2/2014 and 16/7/2014. Applicants who have applied pursuant to Circular dt. 9/9/2015 have excluded. In fact, it is the stand of the Department that appointments have since been made on 10/6/2016 and 11/6/2015 and the said notifications of 2014 have since exhausted themselves. Further, it is suggested that the current vacancies of ICs should be allowed to be filled up by applicants who have applied pursuant to 9/9/2015 and earlier applicants can also apply afresh. In fact more than 80 of the earlier applicants (pursuant to Notifications of 2014) have also applied.

7. In my view, an SLP may be preferred only in regard to direction (i) since direction (ii) is in order and no challenge is required.

8. The SLP may clearly state that no objection is being taken to the judgement of the High Court in regard to appointment of CIC pursuant to Circular dt. 9/9/2015. A statement in this regard may be made in the List of Dates and Synopsis at the beginning.

Minutes of the meetings of the Search Committee held on 10.11.2015 and 16.11.2015 for shortlistinq persons for the post of Chief Information Commissioner and one post of Information Commissioner in the Central Information Commission

The Search Committee was informed that Shri Sunil Arora, Secretary, Ministry of Information and Broadcasting, a member of the Committee has sought to recuse himself.

2. The Search Committee was informed that as per Section 12(2) (a) of the RTI Act, the Central Information Commission shall consist of the Chief Information Commissioner (CIC) and as per Section 12(2)(b) of the RTI Act, the Commission shall consist of such number of Information Commissioners (ICs), not exceeding ten, as may be deemed necessary. At present, there is one CIC and seven ICs in the Central Information Commission. Shri Vijay Sharma, CIC will complete his tenure on 01.12.2015 (a list of the existing ICs is at Annexure- I). The Committee took note of the provisions of Section 12(5) of the RTI Act that the CIC and IC shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.

3. The Committee was informed that Circular No. 4/2/2015-IR dated 09.09.2015 seeking applications from interested persons for the posts of CIC and ICs was posted on the website of Department of Personnel and Training (DoPT) on 09.09.2015 and advertisement was published in The Hindu, Times of India (English) and Dainik Bhaskar and Hindustan (Hindi) in all their editions in India on 09.09.2015. The last date for receipt of applications was 12.10.2015. A total of 341 applications (11 for CIC, 157 for IC and 173 for both posts of CIC and IC) had been received by the last date (the details of the 341 applications are at Annexure II). 4. The Committee was further informed that High Court of Delhi vide its • judgment dated 06.11.2015 has given the following directions: (i) The selection process that has already been commenced vide Notifications dated 25.02.2014 and 16.07.2014 shall be finalized within six weeks from today and the three vacancies of Information Commissioners existing as of today shall be filled up amongst the 553 applications that were received in response to the said two notifications.

(ii) The selection process pursuant to the Circular dated 09.09.2015 shall be confined for selection and appointment of the Chief Information Commissioner in the vacancy that would arise w.e.f. 02.12.2015 and one Information Commissioner which is likely to arise w.e.f 02.12.2015.

5. The opinion of Attorney General was sought in the matter. The • Committee was informed that as per Attorney General's opinion (Annexure- Ill), an SLP is to be preferred only with regard to direction at para 4 (i) above and no challenge is required with regard to direction at para 4 (ii) as it is in order.

6. With a view to shortlisting the candidates, the Committee deliberated upon the eligibility and suitability of each candidate in terms of their eminence and experience in the categories mentioned in Section 12(5) of the RTI Act. The Committee decided that 5 applications received late after due date i.e. 12.10.2015 shall not be considered.

7. After detailed deliberations, the Committee shortlisted the following applicants (in alphabetical order of surname) for the post of CIC:

In addition, he has a vast experience of working in Government of Uttar Pradesh in Ministries/Departments like Power, Agriculture, Health, Education, Urban Development and Planning. 3. Basant Seth He is serving as Information Commissioner in (DoB:16.02.1952) Central Information Commission since 01.03.2012. He is a qualified Chartered Accountant with a Post Graduate Diploma in Bank Management with 37 years of experience in the field of banking management, finance and administrative matters. He has worked as a whole time Director in Small Industries Development Bank of India (SIDBI) for more than two years and as Chairman & Managing Director of Syndicate Bank from 31.08.2009 to 28.02.2012.

Since the name of Shri Basant Seth who is serving as IC has also been shortlisted by the Search Committee for the post of CIC, it shortlisted e the following applicants (in alphabetical order of surname) for the post of IC (this may be utilized in case Shri Seth is recommended by the Selection Committee for the post of CIC):

The qualification, tenure etc of Chief Information Commissioner and Information Commissioner.

1. Section 12(3) of the RTI Act;- The Chief Information Commissioner and the Information Commissioners are appointed by the President on the recommendation of a Committee consisting of - i. The Prime Minister; ii. The Leader of Opposition in Lok Sabha ; and iii. A Union Cabinet Minister to be nominated by the Prime Minister

Explanation.—For the purposes of removal of doubts, it is hereby declared that where the Leader of Opposition in the House of the People has not been recognised as such, the Leader of the single largest group in opposition of the Government in the House of the People shall be deemed to be the Leader of Opposition.

Ministry of Law and Justice has opined that in the absence of Leader of opposition, the Leader of the single largest party in opposition can be considered as the leader of the single largest group in opposition, only for the limited purpose of RTI Act.

The Prime Minister on 28.8.2015 has nominated Shri Arun Jaitley, Union Finance Minister as the Member of the Selection Committee under Section 12(3) of the RTI Act.

2. Section 12 (5) of the RTI Act;- The Chief Information Commissioner and Information Commissioners shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.

3. Section 12(6) of the RTI Act;- The Chief Information Commissioner and Information Commissioner shall not be a Member of Parliament or Member of Legislature of any state or Union Territory or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession.

Section 13(1) of the RTI Act;- The Chief Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office and shall not be eligible for reappointment: Provided that no Chief Information Commissioner shall hold office as such after he has attained the age of sixty-five years.

5. Section 13 (2) of the RTI Act;- Every Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office or till he attains the age of 65 years, whichever is earlier, and shall not be eligible for reappointment as such Information Commissioner:

Provided that every Information Commissioner shall, on vacating his office under this sub-section be eligible for appointment as the Chief Information Commissioner in the manner specified in sub-section (3) of section 12:

Provided further that where the Information Commissioner is appointed as the Chief Information Commissioner, his term of office shall not be more than five years in aggregate as the Information Commissioner and the Chief Information Commissioner.

Annexure -III

Operative part in the Judgement of Hon'ble Supreme Court in the Review Petition (C) No. 2309 of 2012 in the case of Union of India Vs Namit Sharma

(i) We declare that Sections 12(5) and 15(5) of the Act are not ultra vires the Constitution.

(ii) We declare that Sections 12(6) and 15(6) of the Act do not debar a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case may be, or a person holding any other office of profit or connected with any political party or carrying on any business or pursuing any profession from being considered for • appointment as Chief Information Commissioner or Information Commissioner, but after such person is appointed as Chief Information Commissioner or Information Commissioner, he has to discontinue as Member of Parliament or Member of the Legislature of any State or Union Territory, or discontinue to hold any other office of profit or remain connected with any political party or carry on any business or pursue any profession during the period he functions as Chief Information Commissioner or Information Commissioner.

(iii) We direct that only persons of eminence in public life with wide knowledge and experience in the fields mentioned in Sections 12(5) and 15(5) of the Act be considered for appointment as Information Commissioner and Chief Information Commissioner.

(iv) We further direct that persons of eminence in public life with wide knowledge and experience in all the fields mentioned in Sections 12(5) and 15(5) of the Act, namely, law, science and technology, social service, management, journalism, mass media or administration and governance, be considered by the Committees under Sections 1111 12(3) and 15(3) of the Act for appointment as Chief Information Commissioner or Information Commissioners.

(v) We further direct that the Committees under Sections 12(3) and 15(3) of the Act while making recommendations to the President or to the Governor, as the case may be, for appointment of Chief Information Commissioner and Information Commissioners must mention against the name of each candidate recommended, the facts to indicate his eminence in public life, his knowledge in the particular field and his experience in the particular field and these facts must be accessible to the citizens as part of their right to information under the Act after the appointment is made.

(vi) We also direct that wherever Chief Information Commissioner is of the opinion that intricate questions of law will have to be decided in a matter coming up before the Information Commission, he will ensure that the matter is heard by an Information Commissioner who has wide knowledge and experience in the field of law. The Committee constituted under Section 12 (3) of the Right to Information Act, 2005 met under the Chairmanship of the Prime Minister of India at 4.00 pm on 11.12.2015 and then at 5.00 pm on 16.12.2015 in Room No 10 Parliament House, New Delhi to make recommendation for appointment of Chief Information Commissioner in the CIC.

The meeting was attended by the following:

(i) Shri Narendra Modi, Prime Minister, Chairman (ii) Shri Mallikarjun Kharge, Leader of Indian National Congress, the single largest party in Opposition in Lok Sabha, Member (iii) Shri Arun Jaitley, Finance Minister, Member

Dr. Jitendra Singh, Minister of State, Ministry of Personnel, Public Grievances and Pensions, and Shri Sanjay Kothari, Secretary (Personnel) also attended the meeting and assisted the Committee.

2. The Committee was apprised that there could be a maximum of ten Information Commissioners in the Central Information Commission. At present, there are seven Information Commissioners. There is no Chief Information Commissioner (CIC) as the previous CIC has demitted office on 01.12.2015. The Committee was also apprised that the Chief Information Commissioner and Information Commissioner shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.

3. The Committee considered the directions of the Hon'ble Supreme Court in a Review Petition No. 2309/2012 filed by Union of India against Hon'ble Supreme Court judgement dated 13.9.2012 in the matter of Namit Sharma versus Union of India.

4. The Committee also considered the orders of Hon'ble High Court of Delhi issued on 06.11.2015 and the opinion of Ld. Attorney General for India in the matter of WP(C) 3386 filed by R.K. Jain & ors. versus Union of India. The operative parts of the above mentioned order as given in para 13 of the judgment are as follows:

5. It was noted that consequent to the Notification dated 09.09.2015 there were 184 applicants for Chief Information Commissioner and 330 applicants for Information Commissioners. The Search Committee met on 10.11.2015 and 16.11.2015 and shortlisted names for Chief Information Commissioner and names of Information Commissioner.

6. The Committee perused the detailed agenda including the process involved in the search procedure for short-listing the applicants for consideration. 7. The Committee decided that recommendations will be done while complying with para 13(ii) of the orders dated 06.11.2015 of hon'ble High Court in of WP(C) 3386 filed by R.K. Jain & ors. versus Union of India. Regarding para 13(i) of the order, appropriate action will be taken based on the outcome of the Special Leave Petition filed in the matter.

The Committee constituted under Section 12 (3) of the Right to Information Act, 2005 met under the Chairmanship of the Prinle Minister of India at 4.00 pm on 11.12.2015 and then at 5.00 pm on 16.12.2015 in Room No 10 Parliament House, New Delhi to make recommendation for appointment of Chief Information Commissioner in the CIC.

The meeting was attended by the following:

(i) Shri Narendra Modi, Prime Minister, Chairman (ii) Shri Mallikarjun Kharge, Leader of Indian National Congress, the single largest party in Opposition in Lok Sabha, Member (iii) Shri Arun Jaitley, Finance Minister, Member

Dr. Jitendra Singh, Minister of State, Ministry of Personnel, Public Grievances and Pensions, and Shri Sanjay Kothari, Secretary (Personnel) also attended the meeting and assisted the Committee.

2. The Committee was apprised that there could be a maximum of ten Information Commissioners in the Central Information Commission. At present, there are seven Information Commissioners. There is no Chief Information Commissioner (CIC) as the previous CIC has demitted office on 01.12.2015. The Committee was also apprised that the Chief Information Commissioner and Information Commissioner shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.

3. The Committee considered the directions of the Hon'ble Supreme Court in a Review Petition No. 2309/2012 filed by Union of India against Hon'ble Supreme Court judgement dated 13.9.2012 in the matter of Namit Sharma versus Union of India.

4. The Committee also considered the orders of Hon'ble High Court of Delhi issued on 06.11.2015 and the opinion of Ld. Attorney General for India in the matter of WP(C) 3386 filed by R.K. Jain & ors. versus Union of India. The operative parts of the above mentioned order as given in para 13 of the judgment are as follows:

(i) The selection process that has already been commenced vide notifications dated 25.02.2014 and 16.07.2014 shall be finalised within six weeks from today and the three vacancies of Information Commissioners -4\ I Ti 9 ) 1

• existing as of today shall be filled up amongst the 553 applications that were received in response to the said notifications.

(ii) The selection process pursuant to the circular dated 09.09.2015 shall be confined for selection and appointment of the Chief Information Commissioner in the vacancy that would arise w.e.f. 02.12.2015 and one Information Commissioner which is likely to arise w.e.f. 02.12.2015.

5. It was noted that consequent to the Notification dated 09.09.2015 there were 184 applicants for Chief Information Commissioner and 330 applicants for Information Commissioners. The Search Committee met on 10.11.2015 and 16.11.2015 and shortlisted names for Chief Information Commissioner and names of Information Commissioner.

6. The Committee perused the detailed agenda including the process involved in the search procedure for short-listing the applicants for consideration. Notwithstanding the short-listing done, the Committee considered all eligible applicants who applied in response to advertisement made on 09.09.2015 for the post of Chief Information Commissioner.

7. The Committee decided that recommendations will be done while complying with para 13(ii) of the orders dated 06.11.2015 of hon'ble High Court in of WP(C) 3386 filed by R.K.
