An Act to amend the Howrah Municipal Corporation Act, 1980.

West Ben. WHEREAS it is expedient to amend the Howrah Municipal Corporation Act LVIII of Act, 1980, for the purposes and in the manner hereinafter appearing; 1980. It is hereby enacted in the Forty-fifth Year of the Republic of India, by the Legislature of West Bengal, as follows:-

1. (I) This Act may be called the Howrah Municipal Corporation Short title and (Second Amendment) Act, 1994. commence- ment. (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

2. In section 2 of the Howrah Municipal Corporation Act, 1980 Amendment of section 2 (hereinafter referred to as the prncipal Act),— of West Ben.. Act (1) for clause (10B), the following clause shall be substituted:— LVIII of '(10B) "edible " means or vegetable fat like 1980. vanaspati, and includes fat or , mutton fat, goat fat, , cocoa or refined salseed fat;'; (2) for clause (IOC), the following clause shall be substituted:— '(IOC) "edible " means , , groundnut oil, , mahua oil, oil, , poppyseed oil, oil, taramira oil, til oil, niger , sayabeen oil, maize (corn) oil, refined , oil, , imported rapeseed oil, , palinolein, , sun-flower seed oil, , or , in pure state, imported sealed oil labelled as such, any vegetable oil, prepared by hardening process such as hydrogenation and

labelled as such and bearing in the label in English and Bengali the names of the entering into its composition, or any other oil which the State Government may, by notification, declare to be an edible oil for the purposes of this Act;'; (3) for clause (16A), the following clause shall be substituted:- 116A) "infectious disease" or "communicable disease" means an illness due to a specific infectious agent or its toxic products capable of being directly or indirectly transmitted from man to man or from animal to animal or from environment (through air, dust, soil water, or food) to man or animal, and declared as such by the State Government by notification;'; (4) for clause (18B), the following clause shall be substituted:- 118B) "milk" means the secretion derived from complete milking of healthy milch animals, free from colostrum, and includes buffalo milk, cow milk, goat or sheep milk, mixed milk, standardized milk, recombined milk, toned milk, double-toned milk, or skimmed milk—raw, pasteurized, boiled, flavoured, or sterilized;'.

Amendment 3. of section In section 232 of the principal Act, for the words "municipal 232. magistrate", the words "Judicial Magistrate of the first class" shall be substituted.

Amendment of section 4. In sub-section (1) of section 233 of the principal Act, for the 233. words "municipal magistrate", the words "Judicial Magistrate of the first class" shall be substituted.
